No. 12 307 Translation of an English letter written by the Governor and Council of Bombay to the Director and Council at Suratta, received on 10 June 1786 from the hands of the deputies Spencer and Cherrij. Gentlemen, On the 20th ultimo, we were honored with Your Honors' letter of the 9th preceding, claiming from the Honorable English East India Company payment of a bill of exchange of one hundred thousand rupees granted by you on 9 June 1781 to the heirs of the deceased Banyan merchant Baijsa upon the cloth suppliers of the Noble Netherlands Company, Berampje Soeraabje and Harmootje Rettingje; in answer to which, we have the honor to inform Your Honors that before the goods in question were taken for the use of our Honorable Employers, the claim of the heirs of Baijsa upon the same was fully investigated and examined, when it appeared from their voluntary declaration that they could produce neither acceptance nor payment of the bill of exchange which Your Honors had granted them upon your cloth suppliers, which was fully corroborated by the non-acceptance of the bill of exchange, and which consequently, through this defect, could be of no force or validity whatsoever; and further, that when the heirs of Baijsa were called before our Council of Souratta, they in like manner freely declared that they were never put into the actual possession of the goods which are said to have been transferred to them in payment, nor did it appear that any endorsement or receipt was placed upon the bonds in their possession, which they produced, for any part thereof from the Noble Netherlands Company; in consequence of which, the goods, upon the capture of your factory, undoubtedly became the property of our Honorable Employers, and were taken possession of as such. Right Honorable Sir and Gentlemen, We have had the honor to receive Your Honors' letter of 31 May last. We are particularly sorry to have perceived from it that Your Honors see fit to reject the request in our preceding letter of 9 May before, namely to indemnify the Noble Netherlands Company for the amount of the bill of exchange granted by us on 9 June 1781 to the heirs of the Banyan merchant Baijsa upon the suppliers of the Company, which was deprived of its effect by Your Honors' Chief and Council at Souratta upon the capture of the Directorate, to the sum of one hundred thousand rupees with interest. The reasons, Right Honorable Sir and Gentlemen, which the Surat Chief and Council have been pleased to give to justify their conduct, were already fully refuted in our aforementioned letter to Your Honors of 9 May, as well as in our numerous letters to Their Honors, and their weakness receives by no means any greater strength from what Your Honors are pleased to advance in your aforementioned last letter of the 8th instant; for whatever the heirs of Baijsa may have declared at the time when we were made prisoners of war and the Dutch possessions at Souratta were captured by the British arms, possibly through that natural fear which is often inherent in the native when he must testify among Europeans, it is certain and beyond all contradiction that the bill of exchange in question was accepted by them, as this is proven not only by the sworn testimony of the then secretary of our council, Egbert Nicolaas Wiardi, appended to our letter to the Chief and Council at Souratta of 16 March 1786 under No. 3, who delivered the bill of exchange itself into the very hands of the heirs of Bhaysa, but also primarily by the receipt of those goods which were delivered by the suppliers in reduction or satisfaction of the aforementioned bill of exchange; of which complete proof is afforded by the acceptance and keeping of the key of the warehouse in which the same goods were stored and kept, a proof, Gentlemen, that was judged of such importance even by the native, that the aforementioned heirs of Baijsa could by no means be induced to surrender these keys when they were demanded by Your Honors' Chief and Council, and which reduced the said ministry to the necessity, in order to get to the goods, to

However, since notwithstanding this, it has pleased Your Honor to dismiss our claim and to refuse the payment of the aforementioned sum of one hundred thousand ropijen with interest, we find ourselves compelled to bring this affair to the knowledge of our superiors in Europe, in order to take such measures regarding it as they shall deem necessary, and in the meantime to protest in the strongest terms against all losses and damages which the Noble Dutch Company shall suffer through this refusal by Your Honor. In answer to our letter of the 26th of October 1784, by which we claimed from Your Honor the restitution of all the possessions and privileges which the Dutch Company had before the war, Your Honor pleased to write back to us by your honored letter of the 3rd of November 1784, that the Noble English Company by its last Treaty had ceded and transferred the city and Pergunna of Brootchia to Madajee Scindia Bhadur, who was now in full possession of its sovereignty; and when Your Honor, subsequently by your letter of the 6th of January 1785, informed us that you had resolved to follow the example of Bengal in the restitution of the Directorate as far as local circumstances would permit, we requested by our answer of the 22nd of the said month from Your Honor an explanation of this reservation, while already protesting against it in advance. To this last letter of ours we have never seen ourselves honored with any answer, nor has Your Honor, as far as has come to our knowledge, taken the slightest step to restore to us the Trading Post of Brootchia with its privileges etc., to which however the Noble English Company is indisputably obligated, by virtue of the 5th Article of the peace concluded between His Majesty the King of Great Britain and the Republic of the United Netherlands on the 20th of May 1784, by which His said Majesty has expressly bound himself to return Trinconomale as well as all other cities, forts, harbors and possessions which during the war have been taken by the arms of His Majesty or those of the English Company, in whatever part of the world it may be, without Your Honor's pretext, that Brootchia has been ceded and transferred to Madajee Scindia Bhadur, being able to serve the English Company, as it had no authority to give away anything, by way of gift, sale or under whatever name it may be, which had not yet been ceded to it by any Treaty. We therefore find ourselves entitled and, according to the express further orders of our superiors, obligated to reclaim by this, repeatedly, from Your Honor Gentlemen, the Trading Post at Brootchia taken away by Your Honor, with all the privileges and prerogatives which the Dutch Company had and possessed there before the war, by no means doubting that Your Honor will yet, according to good faith, and in fulfillment of the concluded Peace Treaty, promptly comply with this our rightful requisition. Gentlemen We have had the honor to receive your address of the 21st ultimo repeating your Request to be restored to your factory in Broach, and as it is not in our power at this time to give you any other answer to this demand, than was conveyed in our Letter under the 3d November 1784, we have resolved to immediately transmit copies of your Letters on this subject, to the Honorable the Governor General and Council at Fort William and request their Directions, of which you shall be hereafter duly advised by us, as soon as we receive them from the controlling power in Bengal. However much we wish to cultivate the so happily restored harmony, we cannot in any way acquiesce in Your Honors' aforementioned reply, out of consideration on the one hand that His Majesty the King of Great Britain has engaged, both in the Preliminary and Definitive Peace Treaties between the two Nations of the 2 September 1783 and 20 May 1784, Article 5, to return immediately to Their High Mightinesses the Lords States General all towns, fortresses, ports and garrisons that have been taken during the War by the British arms or by those of their East India Company, and on the other hand that this delay causes significant injury to the Noble Dutch Company, both in trade and especially in the privation of those privileges which are attached to their factory at Brootchia; but we find ourselves brought to the unpleasant necessity hereby formally to repeat the protest that we have already made in advance in our letter of the 22 January 1785, and consequently to protest against all losses and damages which the Noble Dutch Company shall come to suffer by this delay in the execution of the concluded peace treaty. Copy Exchanged English letters concerning the Toll affair No. 11 23 33 To the Right Honorable Rawson Hart Boddam Esquire President for all affairs of the British Nation and Governor of his Majesty's Castle at Bombay together with The Council Right Honorable Sir and Gentlemen. When Your Honor's ministry at this place in the year 1778 saw fit to impede the Noble Dutch Company in a privilege that it had freely exercised until that time, namely to export its merchandizes free of tolls to whatever place desired throughout the entire Mughal empire after the customary tolls had been paid upon import at Surat, we applied, for the purpose of redress and the lifting of these impediments, first to the aforementioned Ministry by our letters of 5 October 1778 and 22 February 1779, and when this proved fruitless, to Your Honors yourselves by letters of 30 April, 13 September, and 27 November, likewise of the last-mentioned year 1779. In answer to which Your Honors, by your reply of 18 December following, were pleased to say: "we cannot take upon ourselves to decide in a matter of so much importance, but for your complete satisfaction we shall put the entire subject in order and transmit it to the Honorable Court of Directors /their superiors/ with faithful copies of every paper, whose explicit orders we shall request for our governance" Yet to our further letters of 26 February and 26 September 1780, and the proofs annexed thereto showing that the Company had always exercised this right undisturbed, even after Your Honors had become the masters of the Surat Castle, Your Honors have never honored us with any answer. The right itself, however, is of too great importance, and the damages that the Noble Company has sustained during the impediments caused thereto by Your Honors are too substantial, for us to delay any longer in most urgently requesting Your Honors, Gentlemen, once again to lift the impediment imposed as aforesaid, or to inform us in your reply, with which we hope to be honored, what prevents Your Honors from allowing us to enjoy such an indisputable right freely and without opposition. And in case Your Honors should still be awaiting orders from your superiors, we further request that, in order to prevent greater detriments to the Noble Dutch Company, Your Honors please embrace the provisional accommodation proposed by us in the letter of 25 February 1780, namely that a separate account be kept of the merchandizes that we shall export, or otherwise, if Your Honors deem it better, that we in the meantime and until this question is finally decided consign the amount thereof in specie with Your Honors yourselves, or wherever you shall see fit. 547 Brief presentation of the true state of the Honorable Company at the Office of Surat, as the same was found at the closing of the trade books of the said year 1785/1786, under the last day of August Anno 1786, in comparison with the book year 1784/1785 and the determination made in Anno 1755; Namely: I. General demonstration and comparison of the profits and charges of this book year against the book year 1784/1785, to wit: The true profits of this book year amount to ƒ 198,077:3:— In Anno 1784/1785 the same amounted to ƒ 226,573:4:8 Thus now less: ƒ 28,496:1:8 The charges amount to, including the travel allowances up to ƒ 1,648:—:— provided at Cochin to an under-merchant, a bookkeeper, and an assistant sent hither, and here charged to the salary accounts of the beneficiaries, during a full year or the course of the books of Anno 1785/1786: ƒ 54,635:16:8 In Anno 1784/1785 the same amounted in 10½ months to a sum of ƒ 46,345:13:8, which comes, as under Article III, for a full year to: ƒ 49,503:8:8 Thus in this book year more: ƒ 5,132:8:— The greater incurred charges added to the lesser obtained profits, it appears that this Office has advanced less in the present book year than in 1784/1785 by: ƒ 33,628:9:8 And taken on its own, or if one from the true profits obtained in this year up to: ƒ 198,077:3:— Deducts the incurred ordinary true charges of: ƒ 54,635:16:8 it appears that this Office during the course of these books or in one year has advanced by: ƒ 143,441:6:8 II. General comparison of the profits and charges against the determination made, with accompanying reasons from which the differences originate, as follows: For the profits, there was set by the Memorandum of Retrenchment dated 9 May Anno 1755 ƒ 867,000:—:—, which reduced by one fifth or in Dutch money amounts to ƒ 693,600:—:— And the same amount to: ƒ 198,077:3:— Thus less: ƒ 495,522:17:— The origin of this so disadvantageous difference with regard to the profits is principally to be attributed to an incomparably lesser importation of merchandise compared to the times after which the cited memorandum was formed, as the same consisted only of a good two-thirds portion of the cargo of a single ship, which moreover arrived here so short a time before the rainy season that one had no more than one and a half months' time for sales; otherwise the prices of the goods at present in general, apart from spices, are much higher than at the time the aforesaid memorandum was drafted. The charges were determined by the Memorandum of Retrenchment and General Regulation on the Provision for the Servants at about ƒ 119,500:— which now, according to current value, is: ƒ 95,600:—:— The same amount in this book year to: ƒ 54,635:16:8 Thus less: ƒ 40,964:3:8 Which lesser amount was principally occasioned by a general reduction of the expenditure in this Directorate. Charges brought into the loss sustained by the Honorable Company on account of the stranding of the ship Walcheren in the year 1773, which subsequently, in conformity with the Surat Political Council resolution of the 25th of March of this year, has been booked to the debit of this account with ƒ 9981:13:8. For 100 days of interest on a principal of 25000:-:- rupees at ¾ per cent per month, calculated from and including the 24th of May 1785 up to and including the 31st of August of the same year, was paid on the 11th of July of this year to Boekendas Persotumdas to the debit hereof: 750:-:-. In conformity with the Political Council resolution of the 7th of July of this year, there was written off in favor of Mantchergie Gorseedje and Gouvenram Roederam, Honorable Company brokers, to the debit hereof, the interest allowed to the merchants on account of merchandise collected and paid for before the specified time in the book-year 1780/1781, which amount was also suffered in account with them by the English, amounting to 5310:-:-. Regarding the employment of the opposite sum, the Director will render the requisite account to Their High Mightinesses in his first upcoming secret missive, and the same must therefore continue to be carried forward until the highest disposition thereof shall have been obtained. When the provisions made by the English to the servants who were prisoners of war here shall be verified, this will be settled with them. While the adjacent entry must continue to be carried forward until Their High Mightinesses' esteemed authorization for writing it off has been obtained, as there is nothing to be recovered thereof, either from the Nawab or from the English, this sum, to which some entries may yet have to be added, will therefore also have to continue to be carried forward for the time being. At the closing of the Trade Books for the year 1785/86, on Tuesday the 2nd of January 1787, the undersigned Trade Bookkeeper found such Debtors, Creditors, and outstanding Accounts as follow below and overleaf with a brief demonstration of their origin; Namely in Surat from and Conditionally Paid Funds. ƒ 3927:12:— The origin of this having been mentioned at length in the latest preceding memorandum inserted into the resolution of the 8th of February of this year, I most obediently refer to the same. The War Between Great Britain and the Paid to the Warehouse Master Wiardi for erecting a bamboo fence with an ash-roof for the cotton presses in place of that which was removed and destroyed from afar by the English in June 1781 at the outbreak of the war.
