By the Dutch private ship De Jonge Franc we had the honor to write to your Right Honorable Lordships on the 11th of September last; and the duplicates of which having been sent with the private ships De Vrouwe Wynanda Luberta and De Dapperheid, we subsequently also furnished to your Right Honorable Lordships by those two ships our humble advices of the 19th, 27th, and 29th of the aforesaid month of September, principally having served for the dutiful notification of the departure from here of the aforementioned ship De Jonge Franc for the Netherlands, as well as the arrival here in the roadstead of the private return ship Den Onzekeren from Batavia, mentioned in the heading, and the State's frigate De Orangezaal from the Fatherland. — The aforementioned Dutch private return ships, De Vrouwe Wynanda Luberta and De Dapperheid, having likewise sailed for the Fatherland on the 4th of the recently passed month of October, there have furthermore departed from here for Batavia: on the 24th of September, 't Slot Cappelle on the 24th ditto, St Laurens on the 12th of October, Constancia on the 16th ditto, the State's frigate d'Orange Zaal. Against which, in turn, have successively appeared here in the roadstead from the Fatherland: on the 2nd of October, the private ship the Vrouwe Sara Hendrina, which on the 27th thereafter has already sailed for Batavia; on the 7th of October, the Company's vessel Bekvliet, with 37 dead, 90 sick; on the 10th ditto, the private ship De Zeevaart, with 32 dead, 60 sick; on the 15th ditto, the private ship Meerenberg; on the 25th ditto, the private ship Josephus de Twede, with which last-mentioned vessel was brought to this place a detachment of the first battalion of Württemberg troops, of which four common soldiers died during the voyage hither. — The aforementioned Dutch private ship Den Onzekeren, which arrived here from Batavia, now lying ready to continue its voyage to the Netherlands, we let this serve as escort to that vessel, the private flute ship De Goede Verwagting, in accordance with what was pre-advised in our aforementioned humble letter of the 11th of September, laden with wheat, wines, and other goods for Batavia, having also been dispatched today, in order to depart thither with the first favorable opportunity. — In our aforementioned advisory letter of the 27th of September, your Right Honorable Lordships were informed of the report received here by the North American vessel The Light Horse, that of two of our Company ships having lain at Mauritius, one of them, probably the Ceylon return ship De Paarl, had already departed from there in the month of May, and that the other, which was believed to be the ship De Draak, also returning from Ceylon, alongside the State's ship of war the Princes Louisa, in the beginning of the now passed month

At the same time we find ourselves further obliged to bring to your high knowledge also: that, since it had been learned that there would be an opportunity to purchase from the aforementioned French ship l'Auguste a quantity of 6 to 700 bales of Bourbon coffee beans, but that Mr. Schuler, as owner of that vessel and its cargo, would not part with the said coffee beans for a lower price than 7 stivers per pound, to be paid in Spanish dollars; and by the extract demand of returns from the Indies received this year with the ship de Leviathan, freedom has been given to this Government to spend the price for it, and that in the Ceylon return ship de Draak expected from Mauritius, or other return ships, there will probably be found as much space as is needed to send the aforementioned coffee beans to the Fatherland; we have therefore authorized the undersigned head administrator Johannes Isaac Rhenius to purchase the aforementioned coffee beans, or as much more as might otherwise be obtained, from the said Mr. Schuler at the said price of 7 stivers the pound, to be paid in Spanish dollars: pursuant to which the purchase of 654 bales, amounting together to a net 64422 pounds of Bourbon coffee beans, at 7 stivers the pound, having taken place, the same are to be sent to the Fatherland at the first convenient opportunity, and in the shipment of the said coffee beans particular care will be taken to leave them in the mats in which they were brought here, in conformity with the instruction given in the aforementioned demand; while we hope that this our action will obtain your Right Honorable Worships' respected approval— and since for this purchase an amount of 8351 pieces of the twenty thousand Spanish reals held in stock here in the Company's treasury for the slave trade had to be applied, whereby in the future, when that trade is to be undertaken upon the arrival of the vessels requested from the Fatherland for that purpose, one will be greatly inconvenienced, we therefore take the liberty most humbly to request your Right Honorable Worships that the aforesaid expenditure of 8351 pieces of reals may again be replenished in stock here— On the occasion that the aforementioned ship de Goede Verwagting is present here, the burgher and wine merchant of this place, Jacobus Johannes van den Berg, presented by petition in our meeting of 25 September last: That now already for two consecutive years a very small quantity of wines had been exported from this country, and most winegrowers had a large stock of wines which, on account of the present low prices, they could not sell without great loss to themselves, whereas on the other hand the wine merchants here, for lack of sufficient stock

prospect of a strong market were held back from purchasing a large stock of wines in order to subsequently sell them off again, requesting that he, van den Berg, might be granted permission to charter the aforementioned flute ship de Goede verwagting in order to load the same for his account with Cape wines for the return voyage to the Fatherland, and that furthermore he, the petitioner, might be permitted to sail to the Netherlands in person on the said flute ship itself together with his son, as well as that he might be favored in this his undertaking with our favorable letter of recommendation to Your Right Honorable Noble Worships. Which proposal and the requests made therein having been carefully considered by us, we have taken into account that when, by a dispatch dated 1 March 1776, a proposal had been made from here to Your Right Honorable Noble Worships to permit private individuals to ship Cape wines as freight, under such recognition as Your Right Honorable Noble Worships might see fit to establish, in order to load the Company's ships and vessels sent out to fetch grains and other products from this corner to Europe, Your Right Honorable Noble Worships were pleased to reply thereto by a letter of 3 April 1778 that, however much you felt inclined to contribute everything that could serve to promote the prosperity of the Cape inhabitants, the aforementioned proposal had nevertheless been found too general for a decision to be made upon it without further information. That Your Right Honorable Noble Worships having also proposed some points and demanded a report thereon from here, the same points were dutifully answered thereupon by humble letters of 1 March 1779, while this matter nevertheless subsequently remained unsettled, apparently caused by the representations made since on behalf of the Cape citizenry to Your Right Honorable Noble Worships, which concerned the state of this Colony. That, however, instead of a permission such as the aforesaid to send wines on freight to Europe, which would principally have served to afford the inhabitants an opportunity whereby they might unburden themselves of their abundant products, Your Right Honorable Noble Worships, by a letter written to this Government by the Chamber of Zeeland on its highest authority dated 28 July 1785, left freedom to purchase on the Company's account the abundant local products of which one could not unburden oneself, either for the Company's establishment or through sales to foreign nations, on such a footing as the aforesaid very revered dispatch contains more at large. That thereupon, by humble letters of 14 April 1786, it was very reverently shown to Your Right Honorable Noble Worships that the lack of warehouses and cooperage prevailing here, whereby one was rendered unable to let the inhabitants enjoy the aforementioned favorable dispositions, especially with regard to the wines, for as long as one should not be provided for that purpose with a sufficient quantity of cooperage and also with the necessary warehouses. That, although regarding the warehouses one might perhaps be able to provide for them until a further opportunity by hiring the same from private individuals, the lack of the requisite cooperage had nevertheless not yet been remedied, whereby one thus remains entirely unable up to the present to purchase on the Company's account those abundant wines of which the winegrowers would now gladly wish to unburden themselves, on the abovementioned footing established by Your Right Honorable Noble Worships. And that it is thus very much to be feared that, in the present circumstances of a scarcity of money, now that such an abundance of wines is found that, against the upcoming new harvest of that product, the lack of cooperage will also prevent the winegrowers from gathering the majority of their wines, the additional lack of opportunity to sell off the stock on hand would give rise to very lamentable consequences for this Colony, which will certainly bring about an adverse effect on the revenues of the Honorable Company, to prevent which one finds oneself obligated to employ all possible precautions, the more so because Your Right Honorable Noble Worships, always keeping in view the flourishing and prosperity of this Colony, were pleased to permit the aforementioned allowed outlet for the country's products not so much to obtain thereby a private advantage for the Honorable Company, as rather to ensure that the sale of the products of this country be sustained in a manner that can least burden the Company. Whereby we then also certainly anticipated that Your Right Honorable Noble Worships, knowing and realizing these circumstances, would kindly be pleased to approve that the Government, from consideration of the same and finding itself compelled thereby, although without having obtained specific authorization to permit the shipping of wine on freight, proceeded to grant a means by which at least a good portion of the abundant products was exported, in such a manner that this, without establishing any precedent for the future, as an extraordinary favor serving thereto, left fully deferred to Your Right Honorable Noble Worships all means and precautions that could serve to

After consideration of all this, we proposed to the aforementioned Van den Berg the following deliberated conditions, so as to accede to his request solely on that basis and without deviating from it in the slightest, provided that the master of the above-mentioned ship De Goede Verwagting—having already received orders by written declaration on 10 October past, pursuant to the charter party, to proceed on the voyage to Batavia with that vessel after its unloading—would make no difficulty whatsoever in submitting to the further orders for its return, and upon which conditions the frequently mentioned Van den Berg would be obliged to declare himself as promptly as possible, namely: That the petitioner could not be granted the chartering of the ship De Goede Verwagting, but rather that, as it stood on charter to the Honorable Company, he might load that ship on freight with as many wines as he should be inclined and that vessel could properly carry. That since it was of the highest importance to the Honorable Company and the Colony that no substandard wines be sent from here to the Netherlands, whereby that principal product of this country might fall into disrepute, the petitioner should be required to have all wines he wished to ship, after they were prepared and casked for shipping, tasted and examined by commissioners from the Court of Justice, so that an accurate report thereof be rendered, containing not only the sorts of the wines, but also the numbers or marks of the casks into which they shall have been put; while the aforesaid commissioners would also be permitted and required to reject from shipment all such wines as they should judge unfit to be sent to the Fatherland. That among the wines he would transport, those of Constantia might not be included, which, if discovered, would be confiscated everywhere for the benefit of the Honorable Company without any form of process. That also no other goods might be loaded into the said ship on behalf of the petitioner except only the aforesaid wines, likewise under penalty of immediate confiscation as just mentioned, and that if the petitioner should be inclined to load any other products of this country into the aforementioned vessel besides the frequently mentioned wines, he would have to make a further request and declaration to that end. That a proper and specific statement must be made to the Government here of both the wines and the other products to be permitted further that are loaded into the ship by the petitioner, in order to draw up the necessary invoices and bills of lading to be signed by the master. That the wines and other products to be further agreed upon would be loaded here at the expense of the petitioner, and also unloaded in the Netherlands, the latter if it should please Your Right Honorable Worships, and in any case according as the orders of the Honorable Company require. That the said wines and other products that might yet be added, being thus loaded into the ship for the account of the petitioner, should upon arrival in the Netherlands also be stored at the Company's warehouses in order to be sold for his profit at the first convenient opportunity, and that the petitioner would have to submit in that respect to such arrangements as Your Right Honorable Worships might see fit to frame, both concerning the recognition duty that Your Worships would be pleased to deduct on account of the sale, and in the manner of payment. That also for the freight of the wines and further subsequent products to be loaded by the petitioner, there should be deducted by the Honorable Company from the proceeds thereof such an amount as Your Right Honorable Worships should understand and determine ought to be borne and sustained upon that cargo in proportion to the return voyage of the ship, regarding freight charges, interest, average, and primage, which are granted to the owners or charterers of the ship according to the charter party. That the petitioner must also bear the payment of eighty guilders for every day the ship might be detained for the loading of the aforesaid wines beyond the eighty days stipulated by the charter party, in the manner conditioned and stipulated by the said charter party. That the petitioner, insofar as it concerns him as a passenger, or his wines to be loaded and further goods that might yet be added thereto, should otherwise be obliged to conform strictly in all parts to the said charter party concluded by the Honorable Company with the owner of the ship. That, since the concession which the Government proceeded to grant to the petitioner, allowing him to send a cargo of wines and other products of the country on freight to the Fatherland, took place without any authorization obtained for that purpose from Your Right Honorable Worships, and it was thus uncertain whether this would receive Your Worships' highest approval, there was consequently explicitly reserved to the Honorable Company the right, in case it should be judged that this Government ought not to have acceded to this, to seize all the wines loaded by the petitioner on behalf of the Company in the Fatherland and retain them for itself, against such prices as the same wines and further products had cost the petitioner up to the loading.

That, insofar as anything in this matter might still have been omitted regarding the stipulation of the necessary conditions, the decision and disposition in everything and in all cases would fully reside in and depend on the pleasure and approval of Your Right Honourable Worships, and to which the petitioner would also have to submit without any the least exception. However, regarding which conditions, when they were further declared by us to the repeatedly mentioned citizen Jacobus Johannes van den Bergh; he stated that, insofar as it concerned the approval deferred to Your Right Honourable Worships, both regarding the deduction of the recognition fee on account of the sale, and for the assessing of the loaded wines on the Company's behalf, as well as submitting to your highest decision and disposition insofar as anything might still have been omitted in the conditions, he could by no means agree to this, by reason of the uncertainty in which he would find himself placed regarding a fixed arrangement of his measures, with the request that a certain determination might be made more closely concerning this, according to which he would be able to conduct himself; And it having been taken into consideration in this regard that no further certainty regarding the aforesaid matters could be given to the mentioned Van den Bergh than that by which Your Right Honourable Worships might otherwise find yourselves impeded in the manner in which you would deem it necessary to proceed in this case; We, since for that reason we were obliged to remain persistent with the aforesaid made conditions, and the repeatedly mentioned Van den Bergh was not inclined to conform thereto, have therefore also had to let the aforementioned ship De Goede Verwagting proceed on its voyage to Batavia. left the Sunda Strait on 17 July; which vessel now lying ready to sail for the furtherance of the further voyage, we have the honor to present these our humble letters to Your Right Honorable Noble Worships, and to have them accompanied by the original short invoice of its lading, having been brought here from the aforesaid main place in the Indies. And whereas both the skipper and first mate who were stationed on the said vessel Den Onzekeren passed away during the voyage hither, and that the person of Francois Heamonet, who upon arrival here commanded the same as captain, as well as Hendrik Tillemans, who at that time performed the duties of first mate, according to the personal declaration of the said Heamonet, had neither taken a nautical examination before Your Right Honorable Noble Worships nor taken the oath to the Honorable Company, it was taken into consideration by us that, although the charter party of the said ship merely states that the skipper and mates must be to the satisfaction of the Gentlemen Charterers and submit to their instructions, it has nevertheless been observed with respect to the said deceased skipper and first mate, also according to the testimony of the said Captain Heamonet, in such manner as applies to such officers of other private ships chartered by the Company, that they undergo a nautical examination with the Honorable Company and take the oath to the same; and that it was consequently deemed utterly necessary that, in order to be able to entrust the cargo belonging to the Company aboard the aforesaid ship Den Onzekeren to those who were to take command of it in place of the deceased skipper and first mate, they were also obligated to possess the qualifications by virtue of which the Honorable Company has conferred that trust upon such officers. For which reason we have thought it proper to have the aforesaid Francois Heamonet and Hendrik Tillemans undergo a nautical examination before appointed commissioners, in order that, if they were then found to possess the required knowledge and competence for the command of the aforesaid vessel, they might be continued therein, and thereupon also be made to take the oath to the Honorable Company. The examination having been conducted, and it having been reported to us by the aforesaid commissioners that they found the said Captain Heamonet to possess in all respects the qualifications required to be able to entrust the aforesaid command to him with confidence, but that on the contrary the person of Hendrik Tillemans was found capable of no more than the service of second mate, without being able to be declared qualified for the post of first mate by the commissioners with confidence; we immediately resolved to be satisfied with the aforesaid Captain Heamonet, and consequently, after he has taken the oath of loyalty to the Honorable Company, to confirm him in that post, but at the same time instructed him to present, on behalf of his shipowners or charterers, someone else who is qualified for the post of first mate instead of the aforementioned Tillemans, in which satisfaction could also be taken in accordance with the charter party.
