to make very humble mention here concerning the four disputes that occurred with the government, and the acts of violence committed by the same thereupon. Firstly, that however indisputable it may be that the Company had no outstanding matters with the fled Tabidas Nagerdas, one nevertheless seems unable to avoid granting proper protection here to the servants and dependents of the said Company, which however in this case did not occur further on behalf of the brokers than by placing under sequestration certain goods, which were subsequently released again at their own request, without those same brokers, who declared their claims of 39240:—17:— rupees and suffered damages, having been further involved in any disputes. Secondly, that we never referred the Banyan Laa Rettingje Gookel (otherwise named Boetoesa) to our Council of Justice, but decided that matter upon his own petition, when Holmberg had sworn on oath that those 45 cannassers of sugar had been delivered by him before the toll, as appears from the resolution of the 15th and 18th of August 1772; but since this Banyan did not find his account in this decision, he subsequently addressed himself to the Nabob with a multitude of scraped-together complaints. Thirdly, on the contrary, we deemed it necessary to refer the claim of the Banyan merchant Deanaet, who is under English protection, against the former packhouse master Holmberg, to the Council of Justice of this trading post, in imitation of the aforementioned Englishmen, who previously, when we demanded of them to compel the free merchant Boucard, who is subject to them, to pay for what he had bought at our public auction of the goods of Director Drabbe for the benefit of the Company itself, repeatedly referred us to their Council of Justice in Bombay, as appears from the letters exchanged with that ministry on the 26th of February and the 26th of May 1767, as well as the 7th of October 1768, and further our resolutions of the 24th of March and the 30th of August 1765, and the 5th of April 1770, without there having been any possibility of obtaining anything from this Boucard; and because the Company's firmans expressly dictate that no one shall do any harm to the Dutch, nor address or detain them, but that they shall be left to their Captain (chief) who shall dispense justice over them, it appeared to us to be a formal violation of those same glorious privileges if we were to let those matters be decided by the city governor, as the English wished, according to his arbitrary views, which naturally must lean towards the side of the natives, since they must hand over a third part of all claims they obtain through legal channels. 3rd, that as soon as the English decided to have these matters settled by arbitration, we immediately consented thereto. 4th, that this same matter (be it said with all respect) was never treated further before our assembly, nor were any declarations or sentences given therein, other than merely referring the same to our Council of Justice; much less that we should have had the imprudence to declare this merchant's claim unfounded when we had not examined the same. On the contrary, it will appear most clearly to Your High Nobilities from our letter to the English Surat ministry of the 2nd of January 1773 that we observed the utmost impartiality and even offered to provide this Deanaet with a competent person who could plead his case as attorney. And 5th, that the only competent judge in this matter could be none other than the aforementioned Council of Justice, since it is certain in law that the plaintiff or claimant must follow the court of the defendant, unless he can secure him before his own court by means of arrest. All of which leads us to hope that Your High Nobilities will also be pleased to look upon our conduct in this matter with a more favorable eye, and remain convinced that your humble servants will never fail to do everything that can earn them the satisfaction of their high superiors. And the incoming toll henceforth being arranged on the same footing as the outgoing, with payment in kind, the same is strictly observed, and receipts are granted by the regents or authorized persons of both sides; while henceforth care will be taken that the reports of the annual survey as of the ultimate of August are sworn to immediately after they come in, as has also happened at present. Yet we request Your High Nobilities favorably to pardon us that we are unable, with the bearer of this, along with presenting this to your High Mightinesses, to offer our resolutions further than up to the 20th of November last.

We have likewise, in obedient compliance with Your High Noblenesses' orders of the 18th of August last past, returned the purchased wagon and mules to their seller, with orders to count the money received for them back into the treasury; the executors of the estate of the deceased Second Rangeman, according to their declaration, being about to count the funds appearing in the estate account into the treasury forthwith under bond, the restitution being made in favor of the debt of the brokers, for whose discharge of some deficient received obligations we offer Your High Noblenesses our respectful thanks, as Monsieur Moncriff de la Grange also most solemnly does, for the passage granted him to Ceylon in order to return from there to Europe on a Company vessel, while we have announced to the Broach servants that they must adhere to the former custom without displaying themselves magnificently after the English fashion, which is altogether unnecessary. The persons confirmed and promoted by Your High Noblenesses' favor, such as the Second Sluijsken, the Storekeeper van Citters, and the Broach Factor Bocquet, take the liberty to declare to Your High Noblenesses, one by one, how grateful they are for the kindness shown to them, and assure Your High Noblenesses that they will seek to make themselves worthy of it through zealous and faithful conduct in the service. Likewise, we find ourselves obliged to humbly thank the same for the favor shown to Lieutenant van den Busch, together with the assistants Beems and Bosman, with their respective promotions. And we have granted to the newly arrived Under-Merchant van Toulon and Ensign Sonnetter, who already received the transfer of the armory on the 20th of this month, a seat, to the first-named in our assembly and at the 137 Court of Justice of this Office, the arrived Factor Bocquet being due to depart immediately for Broach, and Lieutenant van den Busch to cross over to Malabar with the bearer of this, yet in such a manner that this shall not delay that vessel for a single moment in its voyage, as we have instructed the ship's officers in their orders, in such case, not to call at the Cochin roads, but to bring the aforesaid Busch to Galle, from where there will be an opportunity to send him to Malabar. The Chief Mate, and by Your High Noblenesses appointed Equipage Overseer Boelen, having duly received the transfer of his administration on the 24th of this month, has provided the necessary sureties, the former Equipage Master van der Hegge, after the 8000 rupees advanced to him were duly counted back into the treasury and he further provided his surety according to the order, crossing over with the bearer of this in his capacity as Chief Mate. Because upon a further investigation, which we had to have conducted by the four senior members of our Council—van der Heijden, Heijdeman, Zimmerman, and van Citters, assisted by expert shipwrights, according to our resolution of 26 December—following the report submitted on 25 December by the former equipment overseer van der Hegge, which is likewise attached hereto, it appeared to him upon exact inspection that the said vessel was so eaten away by worms that the solid hull from the keel upwards has been attacked by the worms in such a manner that it could not be dispatched on so distant a voyage without danger; although the continuous careening and coating with which vessels are constantly maintained here might still have allowed it to serve on this coast for some years. As has appeared from our resolutions of today, although that small vessel with ordinary annual repairs could still serve here for a long time, it cannot at present be dispatched without danger, the entire keel being eaten away by worms and therefore, according to the testimony of the shipwrights, unfit to put to sea before the defective parts are cut out and repaired. 289 Surat To the Honorable Robert Gambier, Esquire Presiding at the Head of the Council for the Affairs of the Honorable English Company, and Governor of the Mughal's Castle and Fleet, as well as Honorable Sir and Gentlemen We have received Your Honor's letter of yesterday. When a certain Mr. Jan Chambres came to us some days ago requesting to be taken under the protection of the Netherlands State, we could not nor were we permitted to refuse it to him, pursuant to the authority which the Republic of the United Netherlands shares equally with all sovereign states, and which Your Honors and the servants of the English Company exercise themselves in the Indies. We judged that it was not necessary, upon granting protection to this gentleman, to inquire into his service, nor into the reasons which led him to make this application, since he appeared to be a European born, who moreover showed to the first undersigned a commission from the Lord President and Council of Bombay dated the 8th of March 1769, whereby he was appointed, on behalf of the Honorable English Company, as Captain of a Company of Infantry of the said Company, serving for the preservation and defense of His Majesty's Castle and Island of Bombay, as well as all establishments or factories subordinate thereto; likewise that he had never been in the service of the Mughal, just as he also declared never to have inhabited the Castle, much less that he would have taken his departure from there, but rather from his own house rented in this city. Yet now being informed by Your Honor's letter that this Chambres was allegedly employed in the defense of the Castle, on which grounds Your Honors wish to maintain that we are incompetent to 291 grant protection, we do not wish to deny that the possession of the Castle gives Your Honors a large share in the government of this city, but we can in no way concede how this taking into possession could cause the servants and military of the English Company whom Your Honors, the Lord President and Council of Bombay, see fit to send to the Surat Castle to perform their service, to cease to be the subjects of His Majesty the King of England; while it is likewise known that no military man can be said to change sovereigns because he is placed by his superiors in that or another garrison for a short time; indeed, all soldiers always remain subject to their Sovereign, even if they are loaned to other powers for a time, without our having any need to inspect our farmans in this matter, for apart from the fact that they would decide nothing in an international dispute, namely whether we have the power to grant the protection of the State of the United Netherlands to an English subject serving as a soldier in Surat, the latest Farman is of the year 1729, when the Mughal certainly did not yet suppose that the English Company would make itself master of the Castle by force of arms 30 years later. Castle gives you a great share in the direction of this city, but we could in no way concede how this possession could cause the servants and soldiers of the English Company whom your President and Council at Bombay see fit to send to perform their service in the Castle of Surat to cease to be the subjects of His Majesty the King of England, while it is equally certain that no soldier could be said to have changed his sovereign merely because he happens to be placed by his superiors for an interval in this or that other garrison; indeed, all men of war remain equally subject to their sovereigns, even if they were lent for some time to some other power, without our needing to refer in this matter to our farmans, for notwithstanding that they could decide nothing in a purely national dispute, namely whether we could grant to a British subject in service at Surat the protection of the States of the United Provinces, the latest farman is nevertheless from the year 1729, a time at which the Mughal certainly could not yet presume that the English Company would, by means of arms, 30 years later make itself master of the Castle at Surat. Whatever this dispute may be, Gentlemen, which you now maintain according to your interests, and however certain we are that the impartial world will justify our stance, we cherish altogether too much the good harmony that now exists not to declare that we would have granted no protection to that person in case you had previously informed us that he had fled and had solicited us not to protect him, although shortly afterwards he absented himself from our wharf. We hope that this report will be without foundation, and it would surprise us in the highest degree to find that your Honors would act so improperly, as well as grant protection or afford refuge to any person employed by us, the possessors of the Mughal Castle, for your Honors cannot but be certain that your Honors are not permitted to do so. A reference to your Honors' firmans, gentlemen, will convince your Honors that this has never been permitted to your Honors. Should Captain Chambres therefore have taken your Honors' protection, or be found among your Honors, we insist that your Honors please deliver him up directly to the deputation which now goes over to your Honors to await him.
