Original missive by the Honourable Commander Johannes Isaac Rhenius and the Council of this place, consigned to the aforementioned Illustrious College of the High Noble Lords Seventeen, per Vreedenburg and Mentor. No. 2. Missive by the said Commander and the Council, directed to the Honourable Lords Directors of the Particular Chambers noted in the margin. No. 3. Duplicate missive by the said Commander and Council under date 24 February dispatched to the aforementioned Lords Seventeen per the ship Dordrecht, with its annexes according to the register. No. 4. Original secret missive by the Commander alone, addressed to My Lord Mr. Pieter Jacobus Guepin, advocate of the General Company, in which is enclosed a letter to the Lords of the Secret Committee. No. 5. Authentic copy of the report of the Dispenser Lord van Reede van Oudtshoorn and Trade Transferrer van Eerten regarding the equivalent that shall be granted in money, instead of rations and provisions, to the Company's servants (excluding common soldiers and sailors). No. 6. Extract from the report of Lord Colonel Gordon and authentic copies of reports of the Master of Equipment Cornelissen and requisites of the hospital regarding the impossibility of granting money to the servants instead of rations of provisions. To the Right Honorable, Highly Esteemed Gentlemen Directors commissioned to the illustrious Meeting of the Seventeen, representing the General Dutch Chartered East India Company, at the presiding Chamber, in Middelburg Right Honorable, Steadfast, Highly Esteemed, Most Wise, Prudent, and Very Generous Gentlemen High Commanding Gentlemen We refer ourselves in all respect to our humble Letters of 24 February last per the Honorable Company's return ships Vreedenburg, Mentor, and Horssen, as well as the packet boat 'T Haasje. In response to your Right Honorable esteemed Letter of 31 March 1791, we humbly submit: addressed to Your Right Honorable per the privately chartered Ship Dordrecht, and we shall, while offering its duplicate, respectfully communicate to the same that said Vessel commenced the journey to the Netherlands on the 29th of the aforementioned month. Paragraph 2: After Your Right Honorable's esteemed orders, contained in Your Missive of 4 January of the past Year, were duly put into execution by us, we immediately resumed consideration of the Letters with which it pleased Your Right Honorable to honor us on 31 March of the past year. In order to properly execute the orders and appointments occurring therein, we deemed it most appropriate in that regard to follow the example of the High Indian Government, contained in the Extract of the minutes of that which was resolved in the Council of India on 20 September last, sent to us for observance. In accordance with this, in order to give effect to the ordered abolition of all allowances of European and Indian products to the Honorable Company's Servants here, (the common soldiers and sailors alone excepted,) against an equivalent in money, and also to provide Your Right Honorable as soon as possible with the required statement of all those allowances with the equivalent substituted for them in the manner aforesaid, and likewise to supply our Considerations as to what extent the same allowances, with respect to the common Soldiers and Sailors, might also be replaced by some monetary allowance, we demanded from the undersigned Dispenser and the Transferor of Trade Casparus van Eerten to form a Price Current, according to which the buyout value of all local Products in which any allowances are made can be calculated now and henceforth, upon the further approval of Your Right Honorable; as well as a general and specific statement of all allowances, both in cash and goods, that the Honorable Company's servants have lawfully enjoyed, both of European and Indian, as well as domestic goods, and how much the first two mentioned items, as having to be imported from abroad, amount to with 25 percent advance, and the others at cost price; and also to the undersigned Colonel Gordon, the Master of the Equippage Cornelisz, and the Regents of the hospital, for each to examine his own department and subsequently report to us whether and to what extent the said allowances to the common soldiers, sailors, and the Hospital might also be replaced by some allowance in money; The aforementioned Commissioners having properly fulfilled that which was demanded of them, as seen in the report accompanying this in authentic copy and the lists annexed thereto, we shall cause the allowances made up to now to cease with the end of this month, and in their stead have the specified equivalent paid in money, to be continued therewith monthly in accordance with Your Right Honorable's esteemed orders; and to that Report we add three others by the Regents of the Hospital, the undersigned Colonel and Chief of the Honorable Company's Militia

and the requisitions shall consequently be reduced. Militia here and the Master of Equipage Cornelisz submitted to us, from which Your Right Honourable Noble Lordships, if it pleases you, will be able to see the impossibility of replacing those allowances to the common soldiers and sailors with money. Therefore, we shall provisionally cause the same to continue, until we shall be honoured on this matter with the further orders of Your Right Honourable Noble Lordships. Paragraph 3. In order to comply with the order of Your Right Honourable Noble Lordships concerning the requisitions, and so that pertinent records shall be kept of the allowances that are still to be made, we have ordered the respective administrators to pay all possible attention to ensuring that the requisitions for supplies from the motherland and the Indies for this Government, after this change has been made, are reduced and diminished; provided that it is observed, just as was ordered by the High Indian Government, that the requisition for cash, after calculation of the purchase costs, is increased by 25 percent advance in a separate column. Paragraph 4. We have furthermore earnestly recommended to all the respective administrators and persons who have the management of any administrations, howsoever called, where allowances for the Company's needs in tools, equipage goods, etcetera will still be made, to watch carefully that, in accordance with the order, an exact record and accounting of what has been supplied, verified by proofs of those who shall receive the same, come to pass, to which end the aforementioned recipients shall henceforth be required to give a receipt upon the warrants to be granted for the goods handed over to them on account of said allowance, and that the books pertaining thereto are regularly sent to the Netherlands. We shall properly cause to be observed the arrested Equipage book sent to us, as well as the method of placing the buoy ropes on the treasure chests. Paragraph 5. We have delivered one of the received copies of the newly arrested Equipage book to the Master of Equipage Cornelis Cornelisz, together with an extract from the venerable letters of Your Right Honourable Noble Lordships concerning the recommendation to take heed that the equipage goods given along with the outbound ships, especially the anchors and ropes, are properly accounted for, and are received into the Honorable Company's warehouses and into the books belonging thereto. Paragraph 6. To the aforementioned Master of Equipage we have also communicated the resolution of Your Right Honourable Noble Lordships dated 25 March of last year, containing the manner in which, for the greatest possible utility, the buoy ropes shall henceforth have to be placed on the treasure chests, in order to govern himself strictly according to it when transporting chests with specie. Paragraph 7. The regiment of Wurtemberg having already been dispatched, we shall dutifully observe the orders of Your High Lordships regarding the depot of Meuron. Regarding that which was written by Your Right Honourable Noble Lordships concerning the regiment of Wurtemberg, taking into consideration that that corps is no longer present here, considering it merely as communicated, we shall, regarding the point touching the complaints that have come before Your Right Honourable Noble Lordships, that the recruits destined for the Regiment of Meuron are not forwarded to Ceylon with the first opportunities of shipping, respectfully represent to Your Right Honourable Noble Lordships that the same recruits have never, to the knowledge of any of us or by our doing, been detained here any longer than was required to await the opportunity to proceed on their journey to their destination; and that consequently we, as we ourselves feel the necessity of an expeditious dispatch of those soldiers, shall strictly comply with the command of Your Right Honourable Noble Lordships to send them onward in future with the very first shipping opportunities to the Government of Ceylon. Paragraph 8. Regarding the point wherein Your Right Honourable Noble Lordships demonstrate the necessity. Corps, the precedence in the said ordinary court-martial ought henceforth to be assigned to one of the aforesaid Majors and the members to be drawn from the Captain-Lieutenants, Lieutenants, and Ensigns, and that subsequently the superior court to which the appeal would fall should be composed of the Head of the Militia at the time as permanent president, together with the other Staff Officers and Captain-Commandants of the Garrison, in alternating turns, with the perpetual exception, however, of the Major who shall have held the presidency in the ordinary Court-Martial during the handling of the dispute or case over which the appeal is made. Yet, on the other hand, regarding such a composition of a higher court than the ordinary military Court-Martial in this government, the sentiment of the undersigned Colonel Gordon has been that there must necessarily be a higher court above the local court-martial in case of appeal, that such appeal should be referred to a court of justice in Batavia, whether by a Court-Martial there or otherwise, and that for the following reasons, which are grounded upon his many years of experience here: namely, first, because the local court-martial judges nothing other than purely Military Delicts, and was established because, through the changes introduced into the Council of Justice, the officers who previously held a seat therein have been excluded; and secondly, because it is also natural that military men investigate and punish their own delicts, both in order to curtail all lengthy proceedings, and because they possess more knowledge of Military matters, and this better confirms their necessary authority over their subordinates; as well as because, to introduce a second military Court of Appeal here, there are firstly too few Officers; secondly, because the accused might complain of not being treated impartially enough, while likewise many estrangements and jealousies could arise from this, and it is therefore better that in a case, which will also seldom occur, this court of appeal be established in Batavia; and all of us immediately took into consideration the present weakness of the garrison, whereby it is utterly impossible to bring together the necessary number of Staff Officers and Captains to form the just-mentioned higher court with them, all the more so since Colonel Gelquin is about to repatriate, and the vacant post of Lieutenant-Colonel Hamell, who has departed for Batavia, not having been filled again, the total number of those Staff Officers will thus be reduced to three individuals, to wit, the undersigned Chief of the Honorable Company's Militia, Major de Lille, and Major of Artillery Tiesscher, of which latter two one must always hold the precedence in the ordinary court-martial, and thus could have no seat in the superior court to be erected; and also that the manifold occupations with which the Council of Justice is more and more overwhelmed would not well permit it to be again meddled with, whether in whole or only in part, in matters that were once, for very weighty considerations and reasons, withdrawn from its judicature and decision, and therefore we think that the same court should be established in Batavia. Thus, with the exception of the undersigned Commander, who has declared himself in favor of constituting the aforesaid Court on the footing just cited in the best possible manner in this Government itself, we have resolved respectfully to submit for the consideration of Your Right Honorables whether, for the aforesaid reasons, it would not be best that such a high Military court-martial or Court, instead of locally here, should rather be erected in Batavia, where a far greater number of Field Officers is at hand, and that in the few extraordinary cases where it might be applicable, appeals should be made thither from the sentences of the Court-Martial, on the same footing as presently takes place regarding ordinary cases being heard before the Council of Justice: by which arrangement, in case Your Right Honorables should be pleased to embrace it, not only would we be saved from our embarrassment, but the objective which Your Right Honorables yourselves had envisaged with the erection of such a court could undoubtedly be best fulfilled. We have allowed the shipping of wines to proceed. Section 10. But since several inhabitants have approached us requesting permission to send wines, aloes, and some other articles on freight to the Fatherland on the return ships present here, in accordance with the aforesaid conditions with which most of the burghers have been provided by their correspondents in Europe; we, in consideration of the fact that Your Right Honourable Worships long before the shipping of any goods on freight was permitted had graciously deigned to allow the inhabitants of this Colony to send wines on freight to the Fatherland by the ships of the Honourable Company, have likewise permitted them, by the posting of notices, to register at the Trade Office only the wines that they are inclined to ship, in order to ship them as far as the ship's hold will allow, on condition that the freight thereof, according to the determination recently made by Your Right Honourable Worships, shall be calculated at 32 guilders the leaguer, which shall be paid in the Netherlands as before, and the wines thus to be shipped shall, as has been done hitherto, be noted on the bills of lading of each ship, whilst the proceeds thereof may be paid to the order of Your Right Honourable Worships to such persons as the respective shippers shall designate for that purpose. Section 11. On this occasion, the inhabitants having refused to pay the import duty on the goods loaded on freight, we also consider it our duty to bring to the knowledge of Your Right Honourable Worships that several people who have received goods on freight from the Netherlands by Company ships have raised difficulties regarding the payment of the import duty which they are bound to pay to the Company, under the mistaken notion that no import duty was levied on such goods on the Company's behalf. We have therefore, by publication, exhorted them thereto in order to disabuse the public of the error in which it found itself, and to notify everyone of their obligation to pay, and by publication and posting of notices have made their obligation to the aforesaid payment known to each and every person, and have qualified and instructed the Fiscal ad interim, Mr. Jacob Pieter de Neijs, in respectful answer to Your Right Honourable Worships' letter of 31 October last, so that, since every pretext of ignorance that might be pleaded has thereby been removed, he may proceed at law to the actual enforcement of payment against those who might still remain unwilling to pay the sums owed by them. Section 12. As most of the provisions and orders prescribed to this Government for observance, both by Your Right Honourable Worships and by the Supreme Indian Government, have reached their conclusion, and we now find ourselves able, in accordance with Your Right Honourable Worships' orders, to take the letters arriving successively directly under consideration; we have, at our meeting of the 23rd of March last, reconsidered the letter received by the packet boat De Faam on the 15th of the same month, with which it pleased Your Right Honourable Worships to honour us on 31 October of last year. And while respectfully assuring that the orders given therein shall be dutifully obeyed, we shall, with regard to the request received alongside it from Jan Roos tending to be allowed to return to this Government, take the liberty to reply to Your Right Honourable Worships with the adjacent considerations regarding the request of Jan Roos: that the only matter for consideration is the motive for which he went up to the Fatherland in the year 1785 with other malcontents, and the well-founded fear that, if his request were granted without taking proper precautions, this might perhaps have some evil consequence at a time when, on account of the ordered impositions and taxes, the unrest in the minds of the public has not only flared up again, but is also daily fanned more and more by the instigations of people of an infinitely more dangerous temper than the said Roos himself. Wherefore we leave entirely to the humble discretion of Your Right Honourable Worships to what extent, and under what conditions and stipulations, it might be advisable to condescend to the aforesaid request of the said Roos. Section 13. But with regard to the request of Regina van Wijk, humbly beseeching Your Right Honourable Worships to cast a favourable eye upon it, since no such or other reasons militate against the request of Regina van Wijk, wife of Cornelis Johannes Baak—which Baak, although not finally discharged from the service of the Honourable Company, has nevertheless been placed off the payroll so that he may apply his talents to the instruction of youth by giving lessons—we gladly join the petitioner in most urgently soliciting Your Right Honourable Worships to grant her both the requested permission to travel over to join her aforementioned husband, and, on account of his straitened circumstances, to grant her exemption from the payment of the usual transport and board money.

The petition of Lieutenant Comans to excuse them as well for her as for her children. Paragraph 14. In order to be able to report dutifully to your Right Honourable Worships on the petition of Lieutenant Comans, who had command of that small hull on the return voyage of the brigantine Helena Louisa, and in which petition we have observed to our particular surprise that it is not only stated that the said vessel was not provided with proper supplies of required equipment, goods, and provisions according to the orders of the Honourable Company, but that among others, for the purpose of accountability, handed over to the aforementioned servants, among others by the same Comans, various entries are also charged to the Noble Company, amounting together to a considerable sum of travel expenses advanced by him, Comans, while he was obliged in the service to come up hither repeatedly from Saldanha Bay and False Bay, both to give notice of the condition of his aforementioned vessel under his command, and to solicit continuous replenishment of the said missing ship and victual requirements, we have placed the same petition in the hands of the Resident in False Bay, Christoffel Brand, the Master of Equipage Cornelis Cornelisz, and the Transferor of Trade Casparus VErten, in order that they may jointly account for themselves regarding the aforementioned points, and accordingly state the reasons why the equipment, goods, and provisions, when they were demanded and their delivery was found necessary, were not delivered, and for what reasons in particular the said Comans was not provided the means to be able to give notice hither successively of his needs and condition in the usual manner by sending letters with the crew stationed in False Bay and Saldanha Bay, without being obliged always to come up expressly himself; and which accounting we shall dutifully submit to your Right Honourable Worships, and we shall, when this accounting has been received, and we are thereby enabled to judge with reason concerning the grievances of the petitioner as well as the claims founded upon them, not fail to take up this point again in order to report further dutifully on the same to your Right Honourable Worships. Paragraph 15. Having received some months ago from Batavia an ordinance concerning the levying of the tax on all legacies and collateral successions, which henceforth, pursuant to the revered order of your Right Honourable Worships, must be paid throughout the entire Netherlands Indies and at this remote corner, arrangements having been made in order to bring the levying of the duty on legacies and collateral successions into operation, we have, by interpretation of the 22nd, 23rd, and 26th paragraphs of the ordinance received on that matter, provisionally resolved to appoint as receiver of this duty the undersigned Cashier, as collector at this principal place and its subordinate districts the Secretary of Justice, and in the outer districts the Secretaries of the respective colleges of Landdrost and Heemraden there; provided, however, that the latter shall have to render account and answer to the first-mentioned for their collections with the surrender of the sums received, so that everything having merged into one mass under his administration could also be handed over by him to the receiver with greater order; and as appraisers here the Messengers of Police and Justice, of Commissioners from the Council of Justice, and of the Orphan Chamber, and in the outer colonies likewise the Messengers of the aforementioned colleges of Heemraden, and the edict itself, in order to remove all difficulties, placed for interpretation in the hands of Willem Stephanus van Ryneveld, appointed as Collector. Paragraph 16. But since it has appeared to us in the most convincing manner upon careful resumption of the aforementioned ordinance, that if the introduction and levying of the aforementioned tax were not to be accompanied by very many inconveniences and confusions, caused by the difference in the state of affairs between this establishment and the principal place where the draft was made, then very necessary alterations and amplifications would have to be made to the same as the locality of this colony and its particular institutions might require; thus, before doing anything further in this matter, we handed over the edict received on this subject to the Secretary of the Council of Justice, Willem Stephanus van Rijneveld, who was appointed as Collector, and furthermore commissioned him to investigate with the requisite attention how the difficulties appearing in the same could best be resolved and cleared out of the way by appropriate interpretations, and the edict thus in its context be made applicable to this government, in order to report as soon as possible on his deliberations and findings, with the submission of a concept drafted in the manner aforesaid, who has complied therewith in the accompanying memorial. then since the Burgher Councillors of this place came to make representations against the introduction, the undersigned Acting Commander communicated to us that, while the just-cited representation of Secretary van Rijneveld was still before us for reading, two of the Burgher Councillors had been to see His Honour, and had declared both for themselves and their fellow councillors that, having learned how by order of Your Right Worshipful Honourable Nobilities the levying of the collateral succession tax was about to be introduced in this Government, they believed they could not avoid, according to their duty, to forewarn him that this news had aroused the greatest dissatisfaction and discontent among the inhabitants, to the extent that they feared that the immediate introduction of this tax in the circumstances in which the colony currently fluctuated would be of very vexatious consequences, with the added request that he, the Acting Commander, to prevent this, would therefore be pleased so to direct in Council that the introduction of the same tax on legacies and collateral successions might be superseded until the impending arrival of the Right Honourable Gentlemen Commissioners-General, in order to give the community an opportunity to present themselves with their grievances to their High Honours. Paragraph 18: The undersigned Acting Commander, having subsequently requested our opinions on this delicate point each separately, meanwhile pre-advised that, since the state of the Honourable Company at present happened to be such that without extraordinary efforts on the part of its servants to help support and maintain it, it would inevitably have to surrender, and with its ruin that of the whole colony would also be dragged down, he was therefore of the opinion that, in order to avert so great a calamity, as well as to acknowledge to Your Right Worshipful Honourable Nobilities the infinite obligation which all the inhabitants in general, but certainly we and with us the other servants, owe to the same for the unbroken tokens of favor and goodness, and at the same time to discharge our dutiful obedience to the commands of Your Right Worshipful Honourable Nobilities, no matter how precarious the state of the colony and how fermented the spirits of the public might have been represented by the Burgher Councillors, yet with due observance of the fitting prudence and the necessary discretion, the aforesaid tax ought to be introduced. The undersigned, thereupon likewise delivering their opinions one after the other, the undersigned Colonel Gordon declared that, since the introduction of the collateral tax happened to be a positive order, he conformed in all respects with the sentiment of the Acting Commander and consequently also believed that the same tax ought to be introduced, provided only that the payment were adapted to the local situation of this colony. The undersigned cellar master Le Sueur, advising hereupon, testified to be of the opinion that the collateral tax, in order to meet the Honourable Company in its pressing circumstances, ought indeed to be introduced, but that he at the same time, taking into consideration the great scarcity of money in which the colony finds itself, believed that one ought to allow those who would have to make the payment of the said tax to suffice with rendering an inventory of the estates and having the same appraised, in order to leave the payment itself postponed until the arrival of the Right Honourable Gentlemen Commissioners-General, provided meanwhile sufficient security were given by everyone who would be subject to the discharge of this impost, that the same, being demanded, would be paid. Whereas, on the contrary, the undersigned Cashier De Wet was of the sentiment that, since the Burgher Councillors had already come to make representations to the undersigned Acting Commander against the introduction of the collateral tax, with the request that the same might remain postponed, and the arrival of the Gentlemen Commissioners happened to be imminent, the introduction of the aforesaid measure ought to be awaited until their High Honours' arrival here, in order, when their High Honours might take into consideration the present circumstances of the colony regarding the immediate execution, thereby to prevent that the placard, once issued, would not need to be revoked again, but that meanwhile, to prevent the disadvantage which might arise for the Honourable Company by omitting the publication of that placard, the collector ought to be authorized to summon the administrators of the inheritances which according to the placard are subject to the collateral tax, to continue withholding from those inheritances such a sum of money as would be required for the payment of the collateral tax, in order always to be able to be paid whenever the placard should subsequently be published. while the report of the Collector van Ryneveld has been converted into a resolution of our Council, declaring administrators and heirs of deceased persons whose inheritances would be found subject to this duty solely liable for it, under which provision it has further been unanimously resolved by us to adopt the aforementioned report of Secretary Van Rijneveld and to convert it into a resolution, in order that the same, combined with the ordinance sent hither by the aforementioned High Indian Government, may be compiled into such an edict as would be required for the best understanding of the matter and explanation of the opinion of your Right Honourable; While we, furthermore, in consideration of the inconveniences that arose regarding the appraisals in the presence of the Fiscal, alongside appointed members from the Council of Justice and their secretary, as well as the Landdrost and Heemraden, beyond what the commissions can attend without a trail of any other expenses than the fixed salary, and consisting principally in that, while the aforementioned expenses cannot reasonably be charged to the estate from which the duty must be levied, very often all the profit that should accrue to the Company from such an estate would be absorbed by the same expenses if one wished to let them fall to its account, have resolved to declare that these appraisals in the presence of the aforementioned commissions shall only take effect in so far as anything in this principal place, or in the village of Stellenbosch, or any other nearby place whither one could betake oneself without applying any extraordinary expenses, would fall to be appraised, while for everything that is situated so far away that the employment of wagons and other encumbrances might be required to be able to make the valuation on the premises themselves, it could suffice with a conscientious statement of the value of the donated or inherited property to be submitted by the donee and executors or administrators, together with two reputable men, under presentation of oaths, unless the Receiver, the Collector, or the Fiscal, or the respective Landdrosts, might harbor any suspicion that in one case or another the statement thus to be made was not handled in good faith, in which case, at their request, an express commission would be ordered by the Commander at the time or delegates from the Council of Justice or the Board of Heemraden, to have the valuation carried out de novo in the presence of the aforementioned officers of Justice by the appraiser of the property in question on the premises themselves where it is situated or to be found; whereupon, if it is found that the appraisal made by the donee, executors, or administrators was done below value, in addition to the application of Article 28 of the ordinance itself, all costs of extraordinary attendance, wagon hire, etc., shall also be charged to the account of the benefited persons or heirs in whose favor the appraisal took place, whereas in all other cases in which the commissions being carried out here locally or in the village of Stellenbosch, or in the vicinity of both of the same, no attendance fees could be calculated, the salary determined by Article 29 of the same ordinance shall be charged to the donor or the estate to which the property belongs; While we have furthermore resolved that the fine to be forfeited, when on the countryside acts of donations inter vivos having been executed in the presence of seven witnesses, the donor and donee might neglect to immediately give notice thereof to the Collector, shall be charged to the same donor and donee, each for one half, and we have fixed the said fine at One hundred Rixdollars. §20 Before, after the publication of the aforementioned Edict had taken place, the posting could be effected, very many serious and emphatic verbal representations and urgent requests were made by the combined Burgher Councillors of this place against the introduction of the duty on all legacies and collateral inheritances, to the effect that both the posting of the Edict and the introduction of the duty, in whatever manner and under whatever conditions such might also happen, might be suspended until the arrival of the Right Honourable Gentlemen Commissioners-General over Netherlands India, who are expected here daily; which representations and requests having afterwards been repeated by them in writing, as it were in the name of all the Burghers of this colony, with no less seriousness and emphasis, we, before deciding on a document of so much weight, took the same into circulation, and shall

so we shall transmit that same document to Your Right Honourable Excellencies together with our decision thereon as soon as possible. We have in the meantime caused the edict to be posted. 421 We shall not fail to send Your Right Honourable Excellencies that same document at the first forthcoming opportunity, and at that time dutifully inform them of the decision we shall have taken thereon. Meanwhile, pursuant to the resolution adopted by the majority of our Council, we caused copies of the frequently mentioned edict regarding the tax on legacies and collateral successions to be posted at the first opportunity; but to prevent any further sensation in the already stirred-up minds of the common people and the consequences we might have had to fear therefrom for the peace and tranquility of this colony, we simultaneously caused it to be proclaimed that, for the sake of the representations made by the Burgher Councillors, the aforementioned ordinance should provisionally take no effect until the arrival of the Right Honourable Commissioners-General, but should remain suspended for that duration, in the hope that the public, having in the meantime been disabused by reading the document itself of the misconception into which it has been led by some ill-disposed, turbulent, and dangerous persons, will in the future show itself more tractable, and, seeing the fairness of the aforementioned tax, will also come to feel its obligation to contribute its share with willingness and zeal, in order now also, in its pressing circumstances, to come to the aid of the Honourable Company through the bearing of unavoidable taxes, for so many received benefits with which it has always endowed this establishment. The edict for the levying of the 50th Penny we have placed into the hands of the undersigned Cashier, in order to report how the same must be arranged according to the local conditions of this country. § 22. Not long after the receipt of the ordinance concerning the levying of the tax on all legacies and collateral successions, there having also reached us the edict decreed at Batavia on 25 October last concerning the levying of the 50th Penny, although it might well be deduced from what occurred with the introduction of the tax on legacies and collateral successions that the levying of this duty could not be introduced without the greatest opposition on the part of the Burghers, we nevertheless commissioned the undersigned Cashier, before we should dare to undertake anything further in this matter, to examine the aforementioned edict with all accuracy, and subsequently report to us how the levying of the aforementioned imposition, assuming that the same must absolutely take effect upon the arrival of the Right Honourable Commissioners-General, could best take place according to the local conditions of this country, and what changes should to that end be made in the form of the decreed edict, in order to make the manifested will and desire of Your Right Honourable Excellencies executable in this matter; we intend, when the undersigned Cashier shall have complied with this requisition of ours, thereupon immediately to take such measures that a beginning can at once be made with the levying itself, as soon as the aforementioned Commissioners-General shall be pleased to order it. The representations of the Burgher Councillors having also concerned a reduction in the tithe and a change in its collection, we were the sooner inclined to proceed with this postponement of the immediate introduction of the levying of the 50th Penny, inasmuch as the representations and petitions of the Burgher Councillors were not only directed against the introduction of the tax on all legacies and collateral successions, but they also came to make no less urgent representations to the undersigned Commander in the name of the corn-growing inhabitants concerning the tax of the Tithe which the aforementioned farmers are obliged to render as an acknowledgment to the Honourable Company, and the manner in which the same must be paid in money to the Patrol Watch, with an accompanying urgent request that on the matter of the tithe a reduction might be made proportioned to the present unfavourable circumstances of the Colony, and that with regard to its collection, in order to remove a multitude of inconveniences, the facility might also be introduced that the payment of the said tax could henceforth, at the choice of everyone, be made in products as well as in cash money. We have considered ourselves unauthorised to grant the reduction of the tithe. § 24. In the opinion of many, it ought on the contrary to be maintained by all possible means, and not the least reduction in the payment of a recognition fee ought to be granted, which has already been paid on the present footing for so long. The requested reduction in the payment of the tithe was indeed provisionally declined; however, for the sake of the exceedingly oppressive circumstances in which the colony currently finds itself, we had to resolve to make the desired change in the collection of this tax in such a manner that henceforth everyone shall have the liberty to make the payment in products accepted by the Honourable Company as well as in money. We have given the necessary notice thereof to the public for their information, and in the meantime, in order to keep everything free of confusion, we have established the orders that as soon as anyone arriving with any products shall have declared to the clerk his desire to settle the due tithes in kind with the Honourable Company, the said clerk, after having kept a pertinent record of such person and the quantity of his delivered wheat or other grains, shall send him under the escort of a soldier from the patrol guard, whom he may request each time for that purpose from the officer or sergeant on duty there, to the grain storehouse. There, after such persons have acquitted themselves, proof of receipt shall be given to them, while subsequently, on a monthly basis, both on behalf of the Dispenser and by the aforementioned clerk, a specific list must be delivered to the Trade Office of all such people as have discharged their payment of the tithe by paying in kind, as has been said here before, in order to discover, by comparing these lists with one another, whether any fraud might have been committed in this matter. We have caused the placard regarding the levying of office tax by way of a recognition fee to be posted. §25 The High Government of the Indies having also sent us an ordinance to put into execution here as well the levying of the office tax by way of a voluntary recognition, introduced by order of Your Right Honourable Excellencies throughout the whole of the Indies as well as at this remote corner, we have caused the said ordinance to be duly proclaimed at this castle and posted everywhere, while we have postponed the placement of the offering box in which this recognition must be deposited, and the appointment of commissioners to preside over the receipt, until the time of payment shall be at hand, in order then to take proper resolutions thereon and give the necessary notice thereof to the public. The placement of the offering box and the appointment of the commissioners will be determined further by us. §26 Meanwhile, we dare flatter ourselves that this tax will not meet with such difficulties as that on legacies and collateral successions, since this latter tax mainly concerns the servants of the Honourable Company, and we hold ourselves assured that all of them in this Government, along with us, out of a full conviction of their duty, will contribute with all cheerfulness to assist the Honourable Company as far as lies in their power, and to show that nothing lies closer to their hearts than to help promote its preservation and prosperity. Further respectful report on the memorial submitted to us by the ad interim Fiscal De Neys in the case of the Commander Jan Valkenburg. §27 In our humble letter of 3 January last, we respectfully gave notice to Your Right Honourable Excellencies that we would, at an upcoming meeting, once again take into reconsideration the memorial submitted to us on that day by the ad interim Fiscal Mr. Jacob Pieter de Neys, in order to take such further measures, both with regard to the same and with respect to the elucidations which we deemed ourselves bound to furnish to Your Right Honourable Excellencies concerning the aforementioned proceedings conducted against the Commander Jan Valkenburg, as the nature and circumstances of the case might require, in order to render a respectful report thereof to Your Right Honourable Excellencies. §28 We therefore deem ourselves obliged to communicate further in that regard to Your Right Honourable Excellencies that, when the just-cited memorial of the ad interim Fiscal was reconsidered at our meeting of 6 January last, the undersigned Dispenser submitted the note, accompanying this in authentic copy, against the permission to repatriate granted by our resolution of the 3rd of the said month, and we then resolved to requisition from the Council of Justice authentic copies of all the documents that pertained to this affair. From which last-mentioned it appears that the Commander Valkenburg has not been able to produce the required declarations concerning a heavy rope and his ship's boat, documents regarding the matter having been submitted separately by the master and the dispenser. Paragraph 30. But since from the aforesaid advices it became evident, among other things, that the undersigned Commander, shortly after the return of the aforementioned Valkenburg from Saldanha Bay, had communicated to us that he, Valkenburg, had not been able to produce the required sworn declaration of the ship's officers that the heavy rope and the boat reported lost by him were truly lost, this communication was acknowledged by the undersigned Commander, but he declared at the same time that after the lapse of some time Valkenburg had fulfilled that requirement with respect to the rope, without adding thereto a declaration that the boat in question had been lost. After which declaration, we, having maturely deliberated both upon the documents received from the Council of Justice and upon the aforementioned advices, and having therein considered that, although we found ourselves informed of the manner in which the settlement for a sum of 2000 rixdollars had been entered into and concluded by the frequently mentioned Valkenburg with the ad interim Fiscal Mr. Jacob Pieter de Neijs, these documents were nevertheless not sufficient, and therefore are insufficient properly to elucidate even this single point of the complaint of the Burgher Military Council according to our promise made to Your Right Honorable Worships, to inform Your Right Honorable Worships according to our promise as to the truth of the accusations made by the Burgher Military Council, both against the Independent Fiscal Van Lijnden who has departed from here and against various persons appearing in the writing of the Military Council; and that necessity demanded more than ever that this solemn promise should be fulfilled with the greatest haste, for the fulfillment of which we were disappointed by the ad interim Fiscal; and that in order to enable ourselves to do so, we had already, by resolution of 29 June, demanded of the said ad interim Fiscal to examine properly all the documents submitted by the Burgher Military Council, in the firm trust that from such an investigation and the considerations which the ad interim Fiscal might and could add thereto, it would have appeared to what extent the accusations made were well-founded or not. Paragraph 31. But since the ad interim Fiscal, far from fulfilling the order given to him and the expectation in which we rested, and we have therefore ordered him to fulfill that which was already long required of him in this regard, has on the contrary contented himself and limited himself to having some of the declarations delivered to him along with the representation of the Burgher Military Council re-examined and sworn to, and to resubmitting the said declarations as such, without adding thereto any representation or any considerations, we have unanimously resolved to order the said Fiscal anew to examine with the greatest possible speed both the representation of the Military Council itself and the documents relating thereto, and, with the addition of such considerations as he by virtue of his office is competent to make and supply, to report to us what the truth really is regarding the complaints brought forward, and to what extent the accusations made both against the Independent Fiscal Van Lijnden and against various persons are founded on truth or not, in order that this investigation and considerations may serve for the elucidations which we have long since promised to supply to Your Right Honorable Worships, and to accompany them with such a truthful account of this matter, whereby we with reason hope that Your Right Honorable Worships will be undeceived concerning the false accusations imputed to the inhabitants of this colony, as if a destructive fire of misguided patriotism were about to arise among them, of which up to now no signs have appeared. of the 20th of that month resumed Missive, in which it came to be surrendered, among other things, that we should detain here the American vessel The Fame, which was then ready to sail, until its Captain should be compelled by our authority to make payment to three subjects of his Britannic Majesty, who had been assigned as sailors on board the aforementioned American ship, but had been taken off from it by him, Lord Sutton, of such claims as were formed by the said sailors against the said Captain; with the addition that, in view of the impending departure of the said American vessel, he insisted upon a speedy settlement in this matter, as he otherwise could not tolerate that it should leave this roadstead, as may more fully appear to your Honorable High Mightinesses from the aforesaid copy of the Missive. Paragraph 34. Upon resumption of the said Missive, it being communicated to us by the undersigned Commander that he had not neglected, immediately upon receipt of the aforesaid Missive, in consideration of the good understanding and close alliance currently so happily existing between our Republic and the Crown of England, to employ all good offices that were in his Honor's power to persuade the aforesaid American Captain, by way of friendly intercession, to the payment of the claim formed against him; but that his efforts in this had turned out to be entirely fruitless, since the said American Captain not only came to regard himself as the aggrieved party, but also maintained that he was bound to no payment because the engagement on which the claim of the aforesaid sailors was grounded had been broken by them through leaving the service of his shipowners before the end of the voyage for which they had been hired, but because the efforts employed by the undersigned Commander to clear away this difference have been fruitless, we have deemed ourselves incompetent to do anything further in this matter and have left the ordinary course of Justice to Lord Sutton, we thought that on our part nothing else or further could directly be done in this matter, and therefore simply answered Lord Sutton to his Honor's said Missive that for the aforesaid reasons we were compelled to refer his Honor to the Council of Justice of this Government for the attainment of that justice which he claimed for his Britannic Majesty's subjects, and that we hoped and trusted that his Honor would please make use of that ordinary and most impartial way in preference to all others by which the territory of the State might be violated, as we would otherwise find ourselves compelled to guard against it, as your Honorable High Mightinesses will be able to see in more detail from the authentic copy of our Missive dated 20 February last addressed to his Honor. The day after the dispatch of our just-cited letter, the aforesaid instances having been repeated by Lord Sutton, we again received a Missive from Lord Sutton, also enclosed herewith in authentic copy, in which his Honor complains that the translation of his previous letter had not given a proper report of his Honor's wishes, with repeated request however that the American ship The Fame might be detained until their wages should have been paid to the three English sailors by its Captain, we have once again left the course of law open to his Honor. In answer to this Missive we gave Lord Sutton, under date of 21 February, the answer also accompanying this, and repeatedly left open to his Honor the ordinary course of Justice for obtaining justice for the subjects of his Britannic Majesty. His Honor, however, did not need to make use of it, after which his Honor, however, due to the termination of the dispute, did not make use of it, as the American Captain, seeing that Lord Sutton had caused everything to be made ready to prevent his departure, and also being afraid that his Honor would execute his very intention to procure justice for himself by means of armed sloops, finally, upon the repeated requests of the undersigned Commander, proceeded to satisfy that which Lord Sutton had demanded of him. Since this reply could not reach Mr. Sutton, as his Honour set sail that very day in the afternoon, we nevertheless did not wish to leave him uninformed of it, and we sent that letter off with the English King's ship The Gorgon, which departed from here yesterday, whose captain was willing to take charge of it. § 38 Together with the both aforementioned documents, from which the falsity of the accusations of Mr. Sutton will clearly appear to Your Noble High Mightinesses. However, since on none of the batteries were the slightest preparations made for the production of red-hot cannonballs, of which not even an idea existed, and all that occurred in this matter took place in the presence of Mr. Staringh, Captain of the National Frigate Thetis, who found himself, as well as us, troubled on that account by Mr. Sutton, we requested from the said Mr. Staringh a copy of the reports sent to his Honour from his board. We take the further liberty of offering this to Your Noble High Mightinesses in authenticated copy, along with the declaration provided by the Colonel of Artillery Gilquin, and a statement given by the off-payroll bookkeeper De Witt, with whom Mr. Sutton had lodged, given at the request of the undersigned Commander; hoping and trusting that from all these documents it will not only appear to Your Noble High Mightinesses that we have done our duty in this matter, but also that we have not deserved the threats unjustly and recklessly made against us by Mr. Sutton instead of a friendly farewell. § 39 Return of the permanent frigate ship De Meermin from its expedition to search for the ships 't Slot ter Hooge and Rotterdams Welvaaren, without having discovered them. With respectful reference to all that we have taken the liberty to communicate to Your Noble High Mightinesses regarding the dispatch of the permanent frigate ship De Meermin to search for the missing return ships 't Slot ter Hooge and Rotterdams Welvaaren, and regarding the plan we had formed to make that expedition, if possible, serve to the benefit of the Honourable Company, we shall now have the honour dutifully to inform Your Noble High Mightinesses that the said frigate ship De Meermin returned safely here on the 9th of the past month of March, and by the Sea Captain François Duminy it was reported to us that he had learned nothing of the ship 't Slot ter Hooge nor of the ship Rotterdams Welvaaren, neither at Mauritius nor on the island of Madagascar or at Rio de la Goa, and was also informed by various French seamen, who frequent both this coast and the island of Madagascar, that no Dutch ships had appeared in any of the harbours of those waterways. § 40 These vessels have thus probably perished. And as upon the arrival of all English, French, and North American ships that have arrived here from the East Coast of Africa and the island of Madagascar, we have always inquired very closely whether the two aforementioned return vessels had not been discovered anywhere, without obtaining the slightest intelligence thereof, other than that which we have dutifully shared with Your Noble High Mightinesses, we believe we may conclude that those unfortunate hulls have perished, and we lament the heavy loss which is thereby inflicted upon the Honourable Company in its pressing and distressed circumstances. § 41. Successful outcome of the trade conducted by the abovementioned frigate ship De Meermin. However much we were affected by this sad news brought here by the frigate ship De Meermin, we were equally pleased with the outcome of the trade which we, as it were in passing, had that vessel conduct for the account of the Honourable Company at Mauritius and Bourbon. Seeing that the 3000 muddens of wheat, which we had shipped on it to be offered at Mauritius, and which with the expenses incurred both here and at the said island had cost in purchase the amount of 8769 Rds. 10 st., were disposed of there to the Government for 13440 Spanish reals or 15120 Rds. —, for which subsequently were purchased a quantity of one thousand bales of Bourbon coffee and 29387 lb of black ebony wood; upon which sale thus not only a sum of 6350 Rds. 38 st. was gained for this Government, but we also venture to flatter ourselves that upon the safe arrival of the coffee and the ebony wood in the Netherlands, a considerable profit of 35000 to 36000 Dutch guilders will flow from it for the benefit of the Honourable Company, which taken together could yield an advance of circa 50000 guilders. § 42. Section 45. by the abundant delivery of gunpowder to this government Christophorus Columbus, and offer to your Right Honourable Highnesses herewith authentic copies both of the journal and the account kept aboard the aforementioned frigate ship the Meermin, and hope that both the prompt remittance of the mentioned coffee and the design and outcome of the expedition of which it is the result may carry the highly esteemed approval of your Right Honourable Highnesses. The repatriated Governor van de Graaff, having also submitted to your Right Honourable Highnesses with his memorandum of considerations concerning the defense system of this colony a provisional petition for ammunition goods, and among these such a quantity of gunpowder as he deemed inevitably required for a vigorous defense of this establishment, your Right Honourable Highnesses were pleased to qualify the respective chambers to send a quantity of gunpowder hither with each of the outgoing ships, without adding thereto any order for the construction of the powder magazines required for its storage. This has exceeded the capacity of the powder magazines, whereby we already found ourselves compelled in the previous year respectfully to request your Right Honourable Highnesses not to let those shipments continue, as by a continuation thereof we would be placed in the impossibility of storing the gunpowder safely. The consignments of the aforementioned ammunition of war nevertheless having been continued by almost all shipping opportunities, from that was born the necessity to store the same outside the magazines constructed for that purpose, and for which the mentioned Governor caused the storekeeper to employ the tool rooms located on the Amsterdam Battery. Yet since the still continuing delivery of gunpowder would shortly make storage entirely impossible, and the storekeeper of the magazines has even represented to us the danger to which the costly Amsterdam Battery could be exposed if, with its cellars piled high with gunpowder, one should have to make the intended use of that fortification, we have resolved—both from the awareness of the danger to which not only the just-mentioned Battery, but also all works and the entire Cape Town settlement would always be exposed by such a storage of powder, notwithstanding all possible precautions, and under the firm assumption that through the reduction of the garrison a reduction in the stock of gunpowder will also be ordered by your Right Honourable Highnesses, and it is thus not probable that your Right Honourable Highnesses will order the construction of magazines—in order to withdraw ourselves from the aforementioned apprehended danger, to send all the gunpowder stored outside the magazines intended for that purpose, as well as whatever might still be delivered, to Batavia or to Ceylon, where, on account of the circumstances in which that government finds itself, we deem that its delivery will not only be agreeable but also useful. and since we have not been able to find ourselves informed by Your Right Honorable Worships concerning the destination of the minister, were brought in for this government by the successive outbound and homeward-bound vessels that passed by, wherewith the same also returned safely to these roads on the 4th of this month. Section 45. Since we likewise have not been honored to see the orders of Your Right Honorable Worships concerning the Minister Johan Heinrich Manger, arrived here with the private ship the Geertruida en Petronella, and have found his destination not listed on the muster roll of that vessel, we learned from the said Manger that he had been sent out for this establishment and specifically for the colony of Graaff-Reinet. And therefore, considering that if he were detained here and it were subsequently found that he was not intended for the Cape but for Batavia or some other station of the Indies, there will always be an opportunity to have the said Manger proceed on his voyage from here; whereas, on the contrary, a very considerable time would have to elapse before he could return from the said capital to this government in case, having traveled on, it should afterward appear that he ought to have performed his calling here; not to mention the hardship that would lie in having to undertake such a fatiguing journey back and forth for nothing and contrary to his made declaration and testimony; we have resolved, under the most favorable kind interpretation of Your Right Honorable Worships, provisionally to detain the frequently mentioned Minister Manger here while enjoying his salary, pending the orders or information that Your Right Honorable Worships will be pleased to give us in this regard. 46. The Scholarchs of this city having submitted to us a few weeks ago a memorial accompanying a Plan for the improvement of the school system in general, and for the founding of a good French and Latin school in particular, already drafted by them in the year 1790 and offered to us for approval, but at that time and since kept outside the deliberations of our council by the repatriated Governor van de Graaff for private reasons; so we now take the liberty of presenting both the aforesaid documents to Your Right Honorable Worships in authentic copy. And since we have found the drafted plan to be arranged in all parts in the best manner according to the local condition of this country, we believe we should not omit to request Your Right Honorable Worships most submissively to be pleased to honor the same with Your Highest approval. And pursuant to the request of the Scholarchs, we have resolved: First, to authorize them to collect and administer the funds for which subscriptions have already been made toward the establishment of the said institute, in order to render an account thereof annually upon the submission of the poor fund accounts, in the same manner as takes place in a thoroughly satisfactory way with regard to the funds belonging to this fund. Secondly, to permit them to make a beginning with the institute itself, and to nominate to us for that purpose such persons as they believe will possess the required abilities to be able to give the necessary instruction in the first rudiments of the said languages. Thirdly, to grant them authorization, pursuant to their request, to choose and appoint 2 to 3 competent men in Europe to look out for the necessary subjects whom one will need in due time, should the plan be approved by Your Right Honorable Worships, for the further instruction of the youth, and to propose the same to Your Right Honorable Worships. detail of the reasons which prevent us from sending the resolutions of our council further than up to the last of December past to your Right Honorable Worships, the support, and the Scipio and the small brigantine the Comeët, of which the former stayed at St. Iago from 23 January to 1 February and the latter from 7 to 12 February, without having met the Country's warship the Amazone there, on which we have learned with heartfelt pleasure that the Right Honorable the Commissioners General over the Netherlands Indies have set sail. However much we have endeavored to do everything possible, pursuant to your Right Honorable Worships' orders, to transmit the resolutions of our Council regularly every three months, the Secretariat, despite all zeal and diligence, has not been able to advance further than the preparation of the copies of the resolutions taken since the departure of the Governor van de Graaff up to the end of December last. We hope and trust that your Right Honorable Worships, both from the volume which these resolutions take up and from the subject matter over which they range, will realize what endless paperwork had to flow from them, and will therefore also be pleased to remain fully convinced of the absolute impossibility in which one finds oneself in this Government to transmit the same resolutions, according to the terms of your orders, in quadruplicate for the present. We shall, however, employ everything possible to have another set of copies of the aforementioned resolutions prepared, in order to send the same with the greatest speed to the Amsterdam Chamber, and we most urgently request that your Right Honorable Worships, out of conviction of the manifold occupations with which we have been continually burdened for more than a year already, will not take it amiss that we limit ourselves for this time to the dispatch of these two sets. Pursuant to the most respected order of the Right Honorable the Gentlemen Directors in the Fatherland, dated 31 March of last year, containing the immediate abolition of all rations and allowances, both of European and of East Indian products, to their servants in this Government (the common military and seafaring personnel alone excepted), in order to grant them a monetary equivalent for the lack thereof, it has pleased your Honors, and specifically by resolution of 20 January last, to commission the undersigned to make an accurate investigation of all those allowances, whether they might consist of cash or of goods which the servants lawfully enjoyed from the Company's warehouses; to draw up a price current of the ordinary retail cost of domestic products when these might be included under the emoluments; and to calculate European and East Indian goods, as having to be brought from abroad, at a 25 percent advance on the net purchase cost. In order dutifully to fulfill this and to enable your Honors to judge what those allowances have actually consisted of to date, and what they would yield monthly in money calculated separately for each servant, they have therefore thought it best to draw up the specific statement accompanying this, with the addition of the calculation of those allowances and a summary of the amount that they would come to make up, calculated across the qualified servants currently serving in this Government and a few other persons; to which the undersigned, in order to observe the utmost possible brevity in this regard, referring themselves, only note further the market price of the domestic products that they have determined as follows, namely: The leaguer of wine at 40 Rds. The muid of wheat at 3 Rds. The muid of barley at 1 2/3 Rds. One hundred lbs of biscuit at 4 Rds. One hundred lbs of suet at 10 Rds. A live sheep at 2 Rds. Prices which your Honors, when the average turnover of those articles is examined over five years, will find yourselves are by no means taken too high. However, as some doubt might arise among your Honors as to why the undersigned have not regarded the spices as having to be brought from abroad as such, but on the contrary have placed them among the domestic products in the aforesaid specific statement, they shall have the honor to supply your Honors with the following reasons in that regard: That the spices, if calculated at 25 percent above the net purchase price, this price would be far from sufficient to procure that ingredient.
