might have revealed a confession of guilt; and on the contrary puts forward other reasons why one would gladly have wished to have the case declared civil and composable; it nevertheless does not take away the fact that the request to be allowed to compound cannot have arisen from anything other than a complete conviction of the crime, from the awareness of the punishment prescribed for it, and from the fear of undergoing that punishment, on which account that request can therefore also not be viewed otherwise than as a confession of that crime; however very much he has also managed to evade it, certainly because, if the defendant had confessed the committed act in its aggravating circumstance to the judge, the judge would thereby have become more attentive and would assuredly have investigated how far the Company's interest was mixed with the committed acts, and would most certainly then have considered himself unauthorized to have him escape the corporal punishment by means of a certain monetary fine. The investigation having been assigned to the pro interim fiscal not only with that intention, so that when the aforesaid Valkenburg could be convicted of the crime, to then have him punished according to deserts, but also having had as its purpose had; to be informed by that precise investigation of the circumstances that accompanied the case, the undersigned must express his astonishment that from the day that these inquiries were demanded of the fiscal office, which was the 29th of June last, until the day that the often-mentioned Valkenburg forestalled the fiscal office by supplicating the Council of Justice that his case might be declared civil and composable, although constituting an interval of more than four months, no other inquiries were obtained than two declarations and a single interrogation of the accused's own brother; which latter the undersigned, in order to get at the truth, would certainly not have preferred if he could have obtained more impartial declarations, even if it were only from the common crew of the ship de Sterreschans, and for which abundant opportunity presented itself; while the declaration of the Captain of the Burgher Militia Johannes Coenraad Pie moreover still remained unconfirmed and unsworn, and as such was placed with the documents. The undersigned leaves it in its place whether the intervening composition did not make a more precise investigation inadvisable; however it may be regarding this, this is certain: that, pursuant to the solemn promise made to the lords majors, the Council and consequently also every member, whenever he is aware of anything regarding the matter, is obliged to furnish their highnesses with those elucidations that can possibly be obtained on that subject, in order to enable the high rulers to judge what is substantial in the complaints brought forward by the burgher court-martial against the independent fiscal van Lijnden, who has departed from here, and the persons involved therein. And in order to contribute thereto on the part of the undersigned as much as is in his power, in case the documents to be sent over by the Council of Justice might perhaps cause some doubt in judging the crime committed or not committed by him, Valkenburg, he will only briefly cite here what the present Lord Commander brought to his knowledge some months ago, namely: that, when the aforesaid Valkenburg, with the hooker ship de Sterreschans, which had found itself dispatched to Saldanha Bay to collect some wheat, had returned to this roadstead, certainly upon the information that will have been supplied to him that on account of some equipment goods of his ship complaints were about to be brought against him, the same did not immediately fail to come and request of the Lord Commander, then chief administrator, that, since before his departure for the said bay the boat of his ship had been knocked away from behind the vessel by a strong south-east wind, and having fetched up on Robben Island had been shattered there, and also on that occasion one of his cables had broken, which he had not been able to recover with the anchor because he had had no buoy on the rope; these things might be supplied to the inventory of his vessel, or else written off from the same; That the Lord Chief Administrator, for particular reasons, and indeed because he had learned from the side that the aforesaid Valkenburg had sold the boat and the and the rope in the Saldanha Bay, having been unable to grant the request made, had nevertheless promised to condescend thereto if only a sworn declaration from the other ship's officers could be produced by him, Valkenburg; And that this declaration not having been able to be produced by him, Valkenburg, consequently the inventory was not supplemented with this stated item. Honorable sirs, it is established that the petitioner, at the time he commanded the mentioned hooker vessel, and specifically on the occasion that he was in Saldanha Bay with his vessel in the month of February of this year, delivered diverse ship's gear and provisions to the captain of a French merchant ship that was also anchored there at the time, all of which is specified in the documents attached hereto. Furthermore, it appears in particular from the private declaration of Captain Dupin and some of his subordinate officers that the aforementioned goods and effects were indeed sold by Commander Valkenburg for such prices as are stated by the description of those goods, without the same Dupin and associates, any more than the deponents of the other declarations, having determined whether the gear and provisions sold and delivered in the aforementioned manner properly belonged to the hooker ship De Sterrenschans or whether they were the commander's own property. It is true that Second Lieutenant Jan Seijbels Helders, upon swearing to his declaration annexed hereto under number 4, testified that the boat sold by the petitioner Valkenburg to Captain Dupin belonged to the hooker ship De Sterrenschans, but against that, the petitioner's brother, at article 14 of the questionnaire presented to him, attached hereto under number 5, declared that the same boat was by no means the ordinary ship's boat, giving as his reasons for this knowledge that a boat of six oars belongs to the ship De Sterrenschans, while the one sold was constructed and boarded for nine oars; whereas the deponent under number 3, being the lieutenant of that vessel, Johan Jacob Carstens, declares that he does not know whether the provisions belonged to Commander Jan Valkenburg or to the Honorable Company. The undersigned, finding the matter thus situated, has furthermore examined the report, mentioned by the petitioner in his request and attached hereto in copy under number 6, of two sea captains expressly commissioned by the Right Honorable, Highly Respected Lord Governor Van de Graaff, from which it appeared to him that the hooker ship De Sterrenschans, on 13 May of this year, and thus after it had returned to this roadstead from Saldanha Bay, was inspected by the sea captains J: Bakker and D: Muller, and both the state of the gear itself and the inventory were properly examined, in such a manner that the commissioners had not the slightest hesitation in declaring frankly that at the time everything was found complete according to the inventory. However, no matter how much it might seem to follow at first glance from this that the gear sold by the petitioner must be considered to have belonged to him exclusively, the undersigned nevertheless understands on the other hand that, the aforementioned examination having taken place after the sale of the aforementioned goods, it could very easily have happened that the petitioner at the time, fearing prosecution, supplemented the missing and sold goods, and thus put everything in order to be able to undergo the ordered examination; which latter point, if it could be proven, would certainly cause the petitioner to fall within the terms of the laws framed for ship commanders regarding gear. For, although in the Edict of the High and Mighty Lords Majores dated 21 May 1670, as well as in the edict of this government of 12 February 1732, the letter of the prohibition does not explicitly set any punishment when ship commanders sell gear and other items belonging not to the Company but to themselves, this appears from the definition of the punishment, which, consisting besides dismissal and arbitrary correction in a fourfold restitution of what was alienated, cannot suitably be applied to cases in which the Honorable Company suffered not the least damage. Also, the Articles of War speak expressly of the alienation and sale of goods belonging to the ship, the 27th article reading as follows: The officers of the ships shall be obliged to manage and watch over their gear properly, as well as to keep an accurate record of the consumption, and to hand over the remainder every time to the respective master shipwrights, and to regulate that accordingly as shall be deemed fit, and whoever has alienated any gear to his own profit or might dare to sell any of it, shall be subject to corporal punishment. would be at least very difficult to prove, the undersigned is nevertheless, under respectful correction, of the opinion that the facts charged against the petitioner never cease to result in notable disadvantage to the Honorable Company, which is why it is generally forbidden for the Company's servants to trade in goods that belong to their administration. The undersigned judges therefore that the petitioner always remains in the position of having acted against the interests and the intention of his masters, and that he can therefore, no matter with how much confidence one has sought to bend and palliate this by the means of his request, never consider himself as entirely unpunishable, however much the undersigned must also testify to encountering very great obscurity and uncertainty in the laws known to him regarding the determination of a condign punishment, which, as can be inferred from what was previously stated, stems from the obscurity with which the nature of the act is surrounded. Having thus presented the principal circumstances both of law and of fact, it remains finally to determine whether the matter in question is composable, yes or no. The famous professor Voet expresses himself in this regard as follows: "To which public prosecutors, although it was forbidden in the previous Century that they should be permitted to compound over any crime, howsoever named, because thereby often not only entirely innocent persons were exposed to extortion, but also rich people were, as it were, enticed to commit Crime, as those who through transaction could pay not with their hide but with their money or purse, according to the ordinance on Justice of King Philip of the year 1570 article 13. Afterwards, however, compositions over minor crimes were permitted to the officers, just as many serious crimes are compounded with permission of the sovereign or of the Court of Audit as representing the Sovereign, especially when the crime with which someone is accused, though probable from strong presumptions, cannot be proven by full proofs as clear as the midday sun," professor Voet alleging in this respect several names of Doctors of Law. Mr. Pieter Bort, on Criminal Matters, 2nd section, 9th part, numbers 2 and 3, says: "That in order to avoid long litigation, troubles, and costs, one may enter into submission, and that the Prosecutor General with the approval of the Court also has the power to do so; all by virtue of the 27th Article of the Court's instruction," the said Mr. Bort adding hereto at number 4: "That the Court permits the Prosecutor General thereto when it finds from the information of the Prosecutor General that the crime is composable." Since therefore the case in question not only cannot be brought into the class of enormous crimes, but also, insofar as it concerns the nature of the act, is subject to doubt and suffers from defect of proof, the undersigned judges, under favorable interpretation of Your Honorable Worships, to be permitted to declare that the request of the Petitioner can be acceded to without any difficulty, especially since the Honorable Company, as far as is evident, has suffered no damage, and insofar as the petitioner has not acted in accordance with the intention of his Masters, composition is practicable in this Colony instead of submission, and can and ought always, according to the doctrine of the cited gentleman Mr. Pieter Bort, to be regarded not as a grace but as a distribution of justice, arranged and adapted to the doubtful nature of the crimes laid to the charge of the Petitioner. Appeared before the undersigned commissioner members from the Honorable Council of Justice of this government, Lieutenant Johan Jacob Carstens, of competent age, stationed on the Honorable Company's hooker ship the Herrenschans, who, at the requisition of the Merchant and Fiscal pro interim Mr. Jacob Pieter Deneys, declared it to be true: That the deponent, having arrived on January 15 of this year in his aforesaid capacity on board the aforesaid hooker ship, which was lying anchored here in the roadstead, received on the 18th following within the said vessel three heavy anchors and two heavy cables, which were brought on board by one of the government boats without the deponent being able to state from where they were sent. That the aforesaid ship, having set sail 4 to 5 days thereafter according to its destination for Saldanha Bay, the very same anchors and cables were, shortly after arrival in that bay, shipped off by the deponent himself onto a French private ship lying there at that time named Le Doque and commanded by Captain Dupin, which had shortly before been driven from its anchors in the Cape roadstead and had in that manner arrived in the said bay; there having been transferred at the same time from the aforesaid hooker onto that same French ship a quantity of ship's provisions, consisting of a heavy cable and several hawsers of cordage that were already found in the aforesaid hooker ship when the deponent came on board there. Declaring nothing further, the deponent gives as reasons for his knowledge as in the text, being prepared to confirm the foregoing under oath if required. Copy Right Honorable Sir Your Right Honorable's letter of today having been resumed directly in our meeting, the Commander has declared that if the officer sent by Your Right Honorable to deliver his first letter to him had properly announced himself instead of handing that letter over at the door, he would then have been received with just as much politeness as the person who was the bearer of Your Right Honorable's second letter. We have furthermore done everything in our power to resolve the dispute that arose between Your Right Honorable and the American Captain by means of friendly intercession, which we may now believe has had the desired effect. By this, as well as by leaving the path of Justice open to Your Right Honorable to obtain justice for His Britannic Majesty's subjects, we intended nothing other than to give evidence of our sentiments for the happy friendship and alliance that subsist between the Crown of England and our Republic. And as we dare solemnly assure Your Right Honorable that we are as far from dealing the slightest shock thereto as Your Right Honorable ever can be, we cannot hide our surprise both at the entire insulting content of Your Right Honorable's letter, and principally at the assertion that we are said to have sent smiths to our batteries in order to make red-hot shot for the destruction of the ship that Your Right Honorable commands. Such conduct is called ridiculous by Your Right Honorable and treated as such, yet we believe we must assure Your Right Honorable that we are incapable of committing acts that would make us ridiculous not only to the English but also to our own nation. Since on none of our batteries the slightest preparations have been made for the production of red-hot shot, of which not even an idea has existed, and since nothing can have shown evidence of such an intention, we are very willing to suppose that abominable malice has sought to incite Your Right Honorable against us through such a lie; and as accusations of so dangerous a nature have not only filled us with indignation, but also require that the strictest investigation be conducted concerning them, we request and insist that Your Right Honorable please inform us who brought these accusations against us, so that we may obtain satisfactory redress for both ourselves and our nation, and thereby convince Your Right Honorable how little credit should have been given to such malice. We shall, at the very first opportunity, send a true report of our correspondence with Your Right Honorable to the Netherlands, and remain with due respect.
