Further report concerning the wrecked China return ship Bre„ derode. — Mention having provisionally been made in the beginning of this regarding the wrecking near Cape Anguilsas of the China return ship Breederode, we must now further report to Your Honorable High Mightinesses regarding this fatal case, that skipper Godlieb Mulder, who had commanded the aforementioned ship, having since arrived here at the bay, related to us the following circumstances thereof, to wit: — that when they, on the 4th of this month, came in sight of the land, according to 01. 10 98:19 according to the bearing 573 miles from the southernmost corner of Cape Anguilsas, the lead had then been cast at 50 fathoms on muddy, rocky ground, and they had had the wind east-southeast and southerly with moderate and decreasing breez„ es: that they thereupon continued on with small sail to the west-southwest, and at the 3rd glass of the first watch found themselves at 2½ miles from the shore, which they estimated to be the aforementioned Cape Anguilhas, whereupon they immediately tacked close to the wind in order to get out to sea, and by force of sails at the fourth glass could no longer see the shore; that they, having thus continued tacking close to the wind, the ship came to strike at the 5th glass, notwithstanding they having kept a sharp lookout with all hands had observed no breakers or break„ ing of the sea: that they thereupon immediately lost the rudder and suddenly got 6 feet of water into the ship, and had endeavored to pump the ship clear with 3 pumps, but that, because against all continuous pumping and bailing, the water in the ship rapidly began to in„ crease, they had endeavored to steer the ship with its bow toward the shore in order, if possible, to beach the ship on a good shore and in that way still salvage something of the cargo, the ship however remained lying with the bow toward the south; that they, having found at midnight that the water in the ship was ever continuing to in„ crease, had therefore been obliged to resolve to abandon the ship in the morning around 5 o'clock, and having thereupon low„ ered the dinghy and the boat, a total of 87 per„ sons were saved, without being able to rescue the remaining 12, since the dinghy and the boat were smashed high and dry, as well as into pieces, upon the beach; that since it had appeared to them that the ship had come to strike on the reef lying to the south of Cape Anguilsas, they therefore determined that the aforementioned rock lay further east than is shown on the chart, or else that another unknown rock must lie at that latitude. — Meanwhile and the undersigned Fiscal has been requested to conduct an investigation in this regard. Meanwhile Your Honorable High Mightinesses will, by your pleasure, be able to observe from the accompanying copies of letters written to us by the Landdrost of Stellenbosch regarding this matter, that proper orders were immediately given by him to take the requisite care for the goods washing ashore, of which we expect further reports daily; having meanwhile requested the undersigned Independent Fiscal to conduct a careful investi„ gation Appearance in False Bay of the ship De bersa. to investigate whether and to what extent any misconduct or neglect of duty occurred among the ship's officers regarding the aforesaid wrecking of the said ship Brede„ rode. — After this had thus Vrouwe Wynanda Lu„ far been prepared, yesterday there arrived in False Bay the Dutch private ship chartered by the Honorable Company, the Vrouwe Wynanda Luberta, having departed on the 15th of February of this year from Batavia, where shortly before its de„ parture the copy of the letter received therewith from Batavia being annexed hereto the flute De Vreede and the ship De Batavier had safely arrived, without any news of the aforementioned capital city having been brought to us with the said arrived vessel. — However, we have the honor to annex hereto the copy of a dispatch received by us with the said ship De Wij„ nanda Luberta from the gentlemen of the High Indian Government, dated 11 February of this year, wherein we are instructed to detain the personnel and equipment received here for the service of the country's squad„ ron squadron under the Gentleman van Braam until his return here, unless one could assume on good grounds its delivery to Ceylon by the month of October, in which case the same should be sent thither; we have not neglected to give proper notice hereof to the above- mentioned Captain of the present frigate of the State, The Phoenix, Mr. A Kuvel. the - notice thereof. and to beg you to send him back, either to India or to Europe, after having been so kind as to give orders to the Captain of the ship on which he will be found not to let him leave until after the Prince de Luxembourg has communicated the decision he wishes to take regarding him. In order that you might, Monsieur the Governor, legitimately oppose the request that I have already had the honor to make to you on this subject, you would have to have the goodness to prove to me that the Prince de Luxembourg cannot dismiss an officer who has placed himself in such a position, and I think it will be entirely impossible for you to achieve this end, since the Gentlemen of the Chamber of Seventeen grant him military justice within his regiment, and this military justice consists of punishing the officer and the soldier according to the requirement of the case; now, he who commands can only relinquish his authority in a civil or criminal matter. The Sieur Valmont being in neither case, he is entirely under the discipline of the one who appointed him. Such is my way of seeing things as well as that of the Prince, I am sure of it. If you do not believe his powers are so extensive, demonstrate it to me, I beg you, by a writing that may convince him that if I have not fulfilled his intentions, it was through no fault of mine. It will then be up to him to uphold his rights, and to send to the head of his Corps (if he should happen to lose his case), instead of a military man, a councilor of some parliament who can answer to all the legal proceedings that the officers and soldiers might wish to bring against him, for I do not feel I have enough insight to argue against so many individuals from the moment subordinates are permitted to contest the punishments inflicted upon them. Farewell to subordination, and a Commander becomes a cipher at the head of his Corps. I am so convinced of this truth, Monsieur the Governor, that if the Company offered me a salary of one hundred thousand ecus to submit to such humiliations, I would refuse them. The discipline of a Corps must concern solely the one who commands it, and his orders of all kinds must be executed, leaving it thereafter to those who are aggrieved to assert their rights; but until these are well established, a Commander must not be disapproved of, because that is to debase him and excite the cabals that occur all too often in many Corps. The Prince de Luxembourg having therefore, in my opinion, no account to render except to the Gentlemen of the Seventeen, with whom he contracted, no one other than them can disapprove of his conduct, if he were to place himself in such a position, which is far from being the case. He will have cause to be very surprised at the resistance being offered to his Colonel Commandant carrying out the orders he gave him. I beg you to observe, Monsieur the Governor, that this is the second time I have been humiliated in this city; your predecessor did so in a very insulting manner, and although being a subordinate I was by no means made for that, today, when I am in Chief command, I am stripped of my authority, and I am given the worst of it against a man expelled from the Corps for nearly three years. Copy To Monsieur Monsieur Van de Graaf Governor of the Cape of Good Hope and to the Gentlemen of the Noble Council of the Government Governor and Gentlemen I would be spared the unfortunate necessity of troubling you with my complaints, if the motive that determines me to do so were not as extraordinary as it is illegal, and if the honor to which I am entirely devoted were not closely involved in the mistreatment they wish to inflict upon me before your eyes. It is my status and my reputation that are being attacked at this moment; they wish to strip me of the one, and tear the other from me by proceedings that an Officer of the noble Company ought not to expect in a free country, and where I ought at least to enjoy the rights of an honest Citizen. I am the bearer of an eighteen-month furlough, ratified by the Governor of Ceylon, and by the Commander of the troops at Colombo; it is under this entitlement that I have been at the Cape of Good Hope since the eleventh of this month. Mr. Mr. d'Hugoney, now Colonel of the regiment of Luxembourg, in which I serve in the capacity of Captain, has reappeared here, and without having previously been recognized by his Corps, he does more than wish to use the authority that a Chief may reasonably have over an Officer; he wishes to dishonor me in the eyes of a Garrison where, since my stay, no one could reproach me for the slightest fault. It would be humiliating for me to enter into justification, if I did not have authentic documents to achieve it in a satisfactory manner, the production of which can be submitted to you at the first request. I am convinced that, with the intention they have of finding fault in me, they will not fail to impute an excess of vanity to me; but when they wish to rob me of my honor, what does it matter if my self-esteem is distorted? It is enough for me to have nothing to reproach myself with, nor to have provoked the affair that Mr. d'Hugoney is stirring up against me. No step toward me preceded the one that was taken with the Officers of the regiment of Meuron: presented to them, received favorably under the auspices of Mr. de Champenoy, my former Comrade, was I to expect that the one to whom I was indebted for a connection dear to my heart would be deputed a few days later to destroy his own own work? Nothing is more true, however, since Mr. de Champenoy himself undertook to report to the Officers of Meuron that the Governor of this Colony had given the order to make me quit the uniform. This would have been for me, Governor and Gentlemen, an overwhelming setback, and one which nonetheless would have contradicted public opinion regarding the wisdom that guides you. Moreover, under what title and on what foundation? Would it be because Mr. d'Hugonet is the bearer of an Order from the Prince of Luxembourg to appoint to my post? It will appear to any reasonable man that such authority, even if it were to have any force two thousand leagues from his homeland, can only be executed within the Corps, and must be placed before the eyes of the Administrative Council, in the presence of the accused officer, since it must affect the honor of a gallant man. This would therefore be to attribute to the Prince a lack of Generosity of which he is incapable toward anyone whatsoever. It would also destroy the esteem, I dare say, of the Officers of the Corps, which refutes the means that may have been used to mislead my Protector's conscience. Mr. d'Hugoney has indeed felt this truth, and that is why it was of essential importance to him to strike me a blow as sensible as that of the deputation sent to the Officers of the Regiment of Meuron. This unheard-of Deputation, against which I claim your justice, Governor and Gentlemen, will have cause to seem astonishing to you, when you learn that it alone would destroy the validity of Mr. d'Hugoney's claims, even supposing that he had been justified in putting them into effect, by the manner in which it was composed. 1st. Mr. de Champenoy resigned more than a year ago; he is no longer considered part of the Corps, and has no standing other than the regret of having left, perhaps too lightly, the service of the Noble Company. 2nd. Mr. de Mezeroy, assistant in the message in question, is clothed only in the Luxembourg uniform; his status as an Officer is not recognized in the Corps, since he has never been in it. To what authority, to what kind of decision am I therefore subjected? Can Mr. d'Hugoney, the Officers whom he brought from Europe, and those he met here, be my Judges, and even more, the arbiters of my honor? Can they among themselves destroy the esteem of the majority of the officers of the regiment, and decide on a post that I hold from them, pursuant to an article of the Capitulation, and pursuant to the Prince's regulation sent to the Corps ten months ago, which subjects the reception and advancement of an Individual to the approval of the Governor of the Settlement where the regiment is stationed, and to that of the Corps beforehand? It is therefore not in the power of Mr. d'Hugoney and the Officers who accompany him to strip me of my Status, for it would be at least a glaring abuse for a Corps Commander to be able to dispose of it in such a manner. To add to that a proceeding that tends to cover with infamy the one who is being oppressed is, Governor and Gentlemen, the height of delirium, tyranny, and injustice. I repeat, Gentlemen: they have misled the conscience of the Prince of Luxembourg, just as they have also misled it regarding the late Chevalier de Beaudrais, our Colonel, who in dying carried with him the regrets of the entire island of Ceylon, which Mr. d'Hugoney had difficulty conceiving, so he told me. I would attach here the extract of several letters in which I could take pride, if I did not fear becoming burdensome, but I undertake to produce them, if you deem them necessary. You will see some among them that would cause me to blush for the connections that dictated them; these have just failed by a step I did not expect. Whatever the boldness of Mr. d'Hugoney's conduct may be, I do not seek in any way to counter it by cursing the help of your authority, but I claim in all its extent the rigor of Justice and of the Laws, of which you are the dispensers. Yes, Governor and Gentlemen, it is from their support that I await my fate, and that I dare hope for a justification, which in some way rehabilitates me from the scandalous conduct that was used against me, and while waiting until I can obtain in Europe from the Council of Seventeen a reparation as authentic as the outrage I have just received is great. So have the undersigned, in order to dutifully fulfill, as much as in them lies, the commission assigned to them and what was ordered therewith, in a meeting, in which, pursuant to the order, the Captain at Sea of the aforementioned frigate de Meermin, Francois du Menij, and the Commander of the hooker Catwijk aan Rhijn, Christiaan Andries Stuur, were also present and assisted, deliberated with each other on the means which seemed to them to be the most possible and suitable for achieving the intended objective: wherefore the undersigned have the honor most humbly to present their opinion in this matter to Your Right Honorable and Worshipful, and to state therewith: that concerning the reflections occurred to Your Right Honorable and Worshipful whether the ship 'T huijs te spijk or the hooker Catwijk aan Rhijn could not be employed for the expedition for the search of the Company's three remaining ships Overduijn, de Harmonie, and Zeeduijn, the undersigned must take the liberty to remark thereon: that the ship 'T huijs te spijk, it is true, according to the report made thereof by express commissioners, can still be employed for transport to the Indies of such a cargo to which no leakage or soaking through can cause any damage, and for which reason that vessel is also already destined for the conveyance of wine to Batavia: that it makes, however, all too certain a very great difference whether a ship of such condition as 't huijs te spijk, which, besides and above the reported defects in its between and upper decks, is already old and very far worn out, is employed for a direct voyage from here to Batavia, and thus along a waterway where the same is exposed to no apparent disasters at sea other than those which are beyond the reach of human foresight; or whether such a vessel is dispatched on a cruise for the search of ships along the coasts, especially those which must be navigated for that purpose, and which in themselves are always, but particularly in this season of the year, highly dangerous: that for such an expedition, a good, firm, and strong vessel that can withstand the dangers at sea is absolutely and necessarily required: that therefore the ship 'T huijs te spijk, in the situation in which it presently is, cannot serve for such a voyage, because it is in such a state that, with a few slight mishaps which it is inevitably bound to encounter on such cruises, it may come to pass that it must also retire into one or another harbor the best it can, without being able to put to sea again from there, whereby the principal objective of that expedition would be entirely frustrated, and one might thereby still find oneself forced to send out from here anew yet another ship or vessel for the search of the missing three ships, as well as of the ship 'T huijs te spijk itself.
