As for the fact that the Prosecutor triumphs so, as if it were an act of courage when one can help someone to the gallows, that the principal defendant allegedly came to a confession on the twenty-fifth article of his interrogatories, where he, the principal defendant, answered that he had told the widow Wessel Wessels such things as he had said based on the legal opinions, the question is whether this can now be called a confession. What, then, is stated in the legal opinions? Nothing other than what is shown in certain passages in the trial of the Fiscal Boers and Smit, namely that gathering, loading, and transporting to his former place cannot be regarded as committing beach theft, as appears in particular from the second opinion of Mr. Lusac, citing in addition the placards and ordinances enacted by the States General regarding how everyone is obliged to conduct themselves in the case of stranded ships and the gathering of washed-up goods. Whereupon the Public Prosecutor rather persists in an outward continuation, as if he were persuaded to institute this action against the principal defendant, although not the slightest prejudice can be drawn from the answers of the principal defendant, which the Public Prosecutor sought to bring forward during the interrogatories in the aforesaid matter, in order to keep them as a reserve, and in which an implicit threat is enclosed, properly designed to intimidate the principal defendant, but which, being put to work, would only show that the Public Prosecutor would rather risk a reckless trial than desist from an unfounded claim. And having now most clearly demonstrated to your Honourable Worships in what a wrong light, out of context, and contrary to the express intention of the principal defendant, the Public Prosecutor has drawn up his accusation against both law and reason. Thus, the defendant in his capacity, by overturning the Prosecutor's unfounded arguments, says that the defendant is not in the situation of giving bad counsel regarding beach theft and violations of the laws and locally given and established orders, for there was no malice on his part. The principal defendant had also not yet heard any local orders, unless the principal defendant was kept blinded, no more than he knew the law from the Commissioner of the Danish Nation, Sr Hendrik Gustinus, when the defendant came to the beach or to the stranded ship. That the defendant in his capacity has not submitted any depositions that would strongly resist the Prosecutor's unfounded accusations and his deponents and relators has its particular reasons and was deliberately held back to deduce the following documents in more detail when advances are made on his part, as well as by his deponents and relators. And whereas the conclusion taken on this side has thereby been substantiated, it is well and rightly trusted that the same will be adjudicated with costs. Namely, that the claim and conclusion of the Officer will be denied with costs, and on the contrary, the defendant will be honourably and profitably relieved and discharged from this defamatory action. Shows with due respect Fredrik Burger, Military Captain in the service of the Honorable Dutch East India Company, serving here in that rank, and promoted to the same in this year by the favor of Your Right Honorable and Severe and Honorable Worships, for which he will show the purest tokens of gratitude throughout his life. But however pleasant the moment was for him when he perceived that it had pleased Your Right Honorable and Severe and Honorable Worships to elevate him to this rank, so much the more painful is the present moment for him, when he sees himself deprived of his rank by someone to whom he believes such does not belong. Reasons why he is turning through this most humbly to Your Right Honorable and Severe and Honorable Worships, humbly taking the liberty to submit to the same: That he, the petitioner, entered the service of the Honorable Dutch East India Company in the year 1755, and served the same as an officer from the year 1761 until the year 1772 with diligence, zeal, and ambition, as befits a gallant military man; that having repatriated in the year 1772 in the rank of Lieutenant to attend to his family affairs, and subsequently having completed his business, he was immediately appointed by the Lords Directors, upon whom he had had the honor to call, as Military Lieutenant of this Government. If anyone had had anything to say about the conduct or service of the petitioner, or if anything had ever been brought against the same, or had already been decided, Your Right Honorable and Severe and Honorable Worships would know that it would already have been done by the Lords and Masters, and they would not have deigned him worthy of that post with which they honored him, to cross over once again to their territories and to occupy the same there. The petitioner has now reached the age of 60 years, and in 1781, with the first rumors of the war between England and the States General of the United Netherlands, it pleased Your Right Honorable and Severe and Honorable Worships, as the oldest Lieutenant, to promote him to the rank of Captain-Lieutenant. Pursuant to what was resolved concerning this in the Council of Policy on the 14 January and 8 May 1744, we the undersigned Members of the Council of Justice here, by order of the Right Honorable Cornelis Jacob van de Graaf, Governor of Cabo de Goede Hoop and the jurisdiction thereof, etc. etc. etc., in the presence of the skipper of the ship Hoorn, Jan Tierens, have tasted 5 leggers of ordinary Cape white wine, marked No 1 to 5, which were loaded today into that vessel for the Fatherland, and have found those wines good of taste, and the leggers well conditioned, the aforesaid casks each being branded with the Company mark, and from each legger, in the presence as aforesaid, one bottle was tapped off, which were sealed with the Company mark, numbered like the leggers, and delivered to the aforesaid commander to serve for tasting. Trusting hereby to have complied as required, the undersigned let this serve as a humble report.
