Right Honorable, Valiant, Most Respected, Right Wise, Prudent and Very Generous Gentlemen, Commanding Gentlemen: The Dutch private ship Mentor having set sail on today's date from here to the Netherlands, we have thereby supplied to Your Right Honorable Most Respected have been capable of setting aside anything from which such expenses could have been paid, and on the other hand out of consideration that, since the replacement of that number of officers remains suspended, thus thereby no burden to the Regiment arises, found ourselves compelled, under Your Right Honorable Most Respected's approval, to condescend to the request of the aforementioned Officers, and to allow three months' salary in advance to be disbursed to them according to the enclosed Memorandum of the Pay Bookkeeper. Even more so, as the said officers fall within the terms of, upon withdrawing from their further service, whereby the aforementioned advanced three months' salary is to be made good again, being forfeited from the half pay which the 25th Article of the Capitulation in the cases stipulated therein grants for their life. departed for Batavia, in contrast to which, on the 6th and 7th of that month, there appeared here in the roadstead from there the private French ships l'Elizabeth Sophie and le Neptune, laden for the account of the Honorable Company, of which two ships the first was planned for the Chamber of Delft and the other for both Chambers of the Meuse; the ship l'Elizabeth Sophie now lies ready to sail for the further voyage to the Netherlands. While the ship le Neptune, having sprung a heavy leak on the voyage hither from Batavia, was thereby forced to unload its cargo here, concerning which all possible assistance was provided by us in order to put that vessel in a state for a speedy departure. Likewise, in the aforementioned month of January, the following two Company return ships arrived safely here: The return ships: the Hoop, with 3 dead and 8 sick, having departed Batavia on 23 October and cleared the Sunda Strait on 6 November. Huisduinen, with 2 dead and 4 sick, which, having sailed from Punto Gale on the 26th of the said month of November, will need to be provided with a new foremast here. On the 19th of the past month of January, there also arrived here the private ship de Vrouwe Jacoba Maria, chartered on behalf of the Company, this corner to the Netherlands, and regarding which the skipper was to conduct himself according to the orders of this Government: seeing that in our respectful letter of 9 December of the past year to Your Noble Honorable Worships, the reasons were detailed why we were at that time compelled, for lack of returns here for the Netherlands, to send on ahead the private ships Josephus de Tweede and Rhijnbord to Batavia, as well as the Factor to Ceylon, we shall, in this matter again most respectfully adhering to that, inform Your Noble Honorable Worships concerning the aforementioned ship de Vrouwe Jacoba Maria and Lucia Theresia that, for those same reasons, we had to take the decision to cause that vessel likewise to proceed on from here to Batavia, because in any case the time of the year is already too far advanced to have that ship pursue its voyage to Ceylon, and there could thus be no likelihood that that vessel could still return from there before the end of the favorable season. Having, among other things, also advised Your Noble Honorable Worships in our humble letter of 24 October of the past year of the arrival in this roadstead of the private Swedish ship la Bonne Resolution, laden at Batavia for the account of the Honorable Company, we find ourselves presently obliged to inform Your Noble Honorable Worships further concerning that ship: that since that vessel had suffered damage to the cargo of saltpeter, pepper, and coffee due to a heavy leak sprung on the voyage hither from Batavia, according to the statement of Skipper Andries Lundgren commanding thereon, request was made to us thereupon by the said Skipper Lundgren upon his arrival here for the necessary assistance for unloading the cargo and for a storage place for the same, so that the ship could be properly repaired; whereupon we, in order to accommodate the said skipper herein as much as possible, for lack of suitable warehouses, and because this could be done with the greatest convenience, granted him permission to employ the decommissioned ship 't Huis te Spijk for storing the cargo, as being best suited thereto, provided however that the storage and unloading take place without any of the least risk to the Honorable Company, for the account of the owners of the said ship la Bonne Resolution; in addition to which, upon the request of the often-mentioned Skipper Lundgren, the master of equipment of this Government, Justinus van Gennep, and Captain Jan Liereveld were commissioned, in the presence of such further nautical experts as the aforementioned skipper might choose, at the requisition of the said skipper, to go on board the aforementioned ship la Bonne Resolution and survey the condition of the cargo and damaged goods: all of which having been carried into effect in that manner, and the often-mentioned ship la Bonne Resolution having been unloaded and repaired from the leaks it sustained, that vessel was thereby, in the beginning of the aforementioned month of January, already

already again in a state of departure, to which end the dispatches to the Netherlands with the same were prepared on the 4th of that month; but since the said ship La Bonne Resolution, after receipt of those dispatches, although since then daily abundant opportunity of weather and wind had been present to leave this roadstead and undertake the voyage to the Netherlands, remained staying here in the roadstead until the 17th of that month, we had for those reasons deemed it necessary for the interest of the Honorable Company, and accordingly in our meeting of the aforementioned 17 January had already taken the resolution to protest against the commanding master on board, Andries Lundgren, and the other officers regarding this unnecessarily long delay of the aforementioned ship La Bonne Resolution, which protest would then indeed have occurred; but the aforementioned ship La Bonne Resolution having set sail from here on that same day, and specifically during our aforementioned meeting, the protest therefore remained without effect. While with all this we shall further note that the copy of the short invoices of the ladings of the aforementioned two ships Elizabeth Sophie and the Neptune were sent over with the aforementioned ship La Bonne Resolution, the same, because upon the arrival here of the aforementioned ships Elizabeth Sophie and the Neptune the letter to the Chamber of Rotterdam per the ship La Bonne Resolution had already been delivered to Captain Lundgren, being enclosed in separate covers and handed over to the aforementioned master. Also on the aforementioned 7th of this month the ship Trompenburg arrived here from Batavia, which was sent hither by the Gentlemen of the High Indian Government for the transport of goods and provisions for this Government; with which vessel, having privately obtained here a list of the return ships for the autumn of 1785 and this spring of 1786, we have the honor to convey a copy thereof to Your Right Honorable High Mightinesses alongside this. Your Right Honorable High Mightinesses having already been pre-advised in our abovementioned respectful letter of 9 December last concerning the feared prospect that one already had here locally of a meager grain harvest, we must now, to our deep regret, report further to the same in that regard that the harvest of wheat has turned out so unfortunately, and the shortage thereof alas is of such a nature, that what the country people have to deliver of it to the Honorable Company cannot reach a fourth part of the quantity that is strictly required solely for the Company's establishment here for consumption for one year, no matter how much, upon the certain reports concerning the miserable condition of the grain harvest, in order to encourage the same country people by preference to deliver the wheat to the Honorable Company, the price thereof was increased by fifty percent, matching what private bread bakers were permitted to pay as an utmost price for the corn under a heavy fine. And which disadvantageous circumstances are so great even among some of the principal grain-growing country people themselves, that they who otherwise made important deliveries are now compelled to provide for their necessary bread and new seed by purchase of what others can still spare. And since the consequences of this cannot but be faced with dread, as the inhabitants multiply more and more and the garrisons of necessity are more numerous, without any adequate relief from elsewhere being to be expected or fetched for this place; we have therefore had to represent to their Right Honorable High Mightinesses the Gentlemen of the High Indian Government by missive the absolute impossibility of being able to fulfill the demands of wheat for the Indies, and therewith on the contrary, setting forth the sad prospect and the circumstances which from that shortage are to be expected as well for the Company's garrison as for all inhabitants, having only been able to obtain subsistence for a few months from what the harvest has yielded, requested to be pleased to take a compassionate regard of all this, in order to protect this place in the speediest manner, through a relief of three to four hundred lasts of rice or as much more as may be possible, from the most miserable consequences which must inevitably be faced toward the final months of this year from such a shortage. When in the year 1782, at the request of His Excellency Lieutenant-General de Bussy, the Ceylon return ship the Morgenster, then present here, was assigned by us to the French for the transport of provisions from here to Mauritius for the service of the King's squadrons in the Indies; we gave notice thereof to Your Right Honorable High Mightinesses in our humble missive of 8 October of the same year 1782; after which, by letters of 22 January 1783, we further advised Your Right Honorable High Mightinesses that the aforementioned ship the Morgenster had been sent on further from there to the Indies by the French ministry at Mauritius. having received information under date of 17 Sept: of the same year regarding the use that had been made there of the aforesaid vessel the Morgenster for the transport of troops etc. to the Indies; without any of those letters (which are transmitted herewith in copy) making the slightest mention of the coffee beans that had remained in the said ship the Morgenster, until subsequently upon the return of that vessel from Ceilon in the year 1784 information was given to us by the Master Gerrit Berg that those coffee beans had been unloaded at Mauritius by order of the French government, with the delivery of an official report drawn up there regarding that unloading; it was then necessarily assumed that care had already been taken there to forward those coffee beans by one opportunity or another, either to the main capital of the Indies or else to the Fatherland; that since upon receipt of the same report from the Master Berg, which was in the month of June of the year 1784, the ship 'T Huys te Spijk had already departed in the preceding month of April for the transport of the French troops from here to Mauritius, one was consequently unable at that time—as otherwise would certainly have happened—to give the order to the Master of the said ship 'T Huis te Spijk to transport the coffee beans unloaded from the Morgenster from there hither; without the said French Ministry itself having made use of the ship 'T Huijs de Spijk and having caused the aforementioned coffee beans to be brought hither therewith, whereas on the contrary they left us totally ignorant in that regard; in which uncertainty one also remained until, in the month of December of the aforesaid year, there passed through here Mr. Cherreau, Intendant at Mauritius, and informed us that the coffee beans unloaded from the ship the Morgenster were still at that place, and the quantity thereof estimated to consist of 150000 pounds, which were stored there in the King's warehouses: upon that received report, deliberations were held in our meeting of the 13th of the aforementioned month of December concerning the measures that should be taken to fetch the aforementioned coffee beans from Mauritius at the least expense to the Honourable Company for shipment to the Fatherland, as being destined thither; but since the aforementioned Mr. Intendant Cherreau had also testified that he could give no assurance whether the same coffee beans had remained well-preserved in whole or in part, just as it is also evident from the official report cited hereinbefore that of the bales which had been taken there at random, both from the middle and from the sides of the hold of the ship the Morgenster, and opened, many of them, having absorbed the intruding moisture, caused the entire cargo throughout to appear to be of a bad quality, caused by the long lying in the ship; and that since by expressly sending a ship to fetch the aforementioned coffee beans, it would for those reasons be greatly risked that if the spoilage had since increased further, a fruitless voyage would then be made by such a vessel; we have therefore, for those reasons, suspended the final resolution on that subject at that time until an opportunity might present itself in one way or another to have the coffee beans fetched from that island in passing by one of the Company's ships; as the case now presents itself that the aforementioned provision ship Trompenburg, owing to the absolute impossibility of being able to send any wheat from here to Batavia, will have a great deal of hold space remaining on the return voyage thither, we considered that no better means has presented itself to fetch from there the coffee beans unloaded at Mauritius from the ship the Morgenster; therefore the resolution was taken to have the said ship Trompenburg call at the said island of Mauritius on its return voyage to Batavia in order to transport the aforesaid coffee beans from there, at the disposal of the Gentlemen of the High Government of the Indies, also to the main capital; to which end the necessary orders will be handed to the Captain of the said ship Trompenburg, Willem Udemans, and he will be charged thereby to address himself to the Governor of that island in this regard and to request that two commissioners of that government may be appointed in order, together with him the Captain and the First Lieutenant of the ship Trompenburg, to weigh the aforesaid coffee beans accurately and to note specifically which bales thereof have still remained preserved or have become spoiled; and that furthermore, in case any among those coffee beans should happen to be found whose decay might cause any harmful infection in the ship, that portion shall then be thrown into the sea or will have to be burned there; whilst the said Captain Udemans will at the same time be recommended to direct his conduct in this regard in such a manner as he shall find to be most consistent with the best interests of the Honourable Company.

Which measures taken by us we therefore hope may receive the esteemed approval of Your Right Honourable Noblenesses. This having been prepared thus far, the State frigates Marm and Munnikkendam have since returned here on the 2nd of this month, which, under the command of the Captains Albert Spengler and Kuijper, both departed on the 2nd of December last from Batavia and on the 22nd of the same month from the Sunda Strait, with the voyage from here to be continued further to Europe. As likewise successively on the 3rd and 6th of this month from the aforesaid Indian capital there have returned here the private ships loaded for the Company, le Castries and the Jonge Jacob; the first mentioned of which, having already departed from Batavia on the 6th of April of the year just past, nevertheless—as we already have had the honour to advise Your Right Honourable Noblenesses by our humble letters of the 6th of September of the same year—on account of heavy damage sustained and necessary repairs, had to put into Mauritius, where that vessel stayed from the 27th of May to the 22nd of December; the Jonge Jacob having sailed on the 22nd of November from the aforesaid Indian capital and on the 8th of December from the Sunda Strait: While the first mentioned of these private vessels is consigned to the Chamber of Rotterdam and the last mentioned to the presiding Chamber. Also, on the following dates, the following outbound Company ships landed at this place safely and in good condition: namely: on the 3rd of February the Zeenimpf, without deaths or sick, which stayed from the 26th of November to the 4th of December at the Island of St. Jago. on the 4th of the same month the Ridderkerk, with 5 deaths, 33 sick. Schoonderlo, with 5 deaths, 42 sick. The frigate de Negotie, with no deaths, 2 sick. The list of such ships of foreign nations as have successively called at this corner since the dispatch of our last humble letters being likewise enclosed herewith, we further have the honour to note that, among others, with the English Company ship the Earl of Talbot, there passed through here the English General Lord Campbell, Governor-elect of Madras. For the rest, we still take the liberty to send enclosed to Your Right Honourable Noblenesses the original brief invoice of the cargo brought into the ship Elizabeth en Sophie at Batavia, as well as the copies of the invoices of the cargoes of the previously mentioned return ships de Hoop, the Jonge Jacob, Huisduinen, le Nepthune, and le Castries. Copy which persons repatriate from this government with the frigate Munnikkendam. — bills of exchange, of which the receipt was sent to the presiding Chamber of Amsterdam with the same ship Huisduinen. — We have furthermore, at the request of the former Burgher Councillor of this place, Ian Serrurier, granted him permission to depart for the Netherlands with his wife and daughter by the aforementioned national frigate Munnikkendam; and with which frigate also cross over from here to there the widow of the late junior merchant and storekeeper Petrus Lodovicus Le Sueur, and a young son of the fellow junior merchant and overseer of the Company's timber warehouse, William Ferdinand van Reede van Oudtshoorn. As also repatriates from this government by the aforementioned frigate Munnikkendam, with cessation of pay and without enjoyment of premium, the former steward Ian Hoets; concerning whom we take the liberty most respectfully to request Your Right Honorable Worships that, if the said Hoets should be inclined to return hither again, it may then favorably please Your Right Honorable Worships, in consideration of the fact that he is married here and leaves behind his wife with six children, and that he has always given good satisfaction in his service, to grant him the necessary passage for this purpose on one of the Company's ships. The Sea Captain Willem Jacob Andriessen having arrived here at this place with the aforementioned French private ship l'Elisabeth Sophie from Batavia, to whom it was granted by Their Right Excellencies the Gentlemen of the High Indian Government to cross over with that ship to this government in order to repatriate from here by a suitable opportunity; Their aforementioned Right Excellencies have written to us by dispatch and instructed us not only to assist the said Captain Andriessen therein, but in case of a vacancy on the ships repatriating from Ceylon, Bengal, and China, to employ him and place him in command, or if this occasion should not present itself, then to place him as second captain on those ships. The State's frigate of war Alarm, under the command of Captain Spengeler, now lying ready to sail for the Netherlands, we avail ourselves, Noble, Steadfast, Highly Honorable, Highly Wise, Prudent, and Very Generous Lords, of that opportunity to transmit herewith to Your Noble, Highly Honorable Lordships these our respectful letters, for the dutiful notification that the return ships de Hoop and Huysduynen under convoy of the State's frigate Munnikkendam, as well as the Dutch private ship de Ionge Iacob, having sailed on for the Netherlands on the 25th of the recently elapsed month of February, subsequently on the beside-mentioned dates from here set sail for Batavia the following outward-bound Company ships, namely: Zoutman Schoonderlo 27 February: Ridderkerk 2 March: Beverwijk Horssen de vrouwe Catharina Iohanna In contrast to which, successively on the 25th of February and the 2nd of this month of March, there arrived here in the roadstead the Dutch private ships de Vrouwe Johanna Maria and Willem en Ian, of which the first-mentioned departed from Batavia on the 25th of November of the past year, and the last-mentioned on the 16th of the same month previously; and we take the liberty of offering to Your Noble, Highly Honorable Lordships, enclosed herein, the copies of the short invoices of the ladings of those two ships. Also, on the 28th of the aforementioned month of February, the frigate de Meermin returned here, which vessel, according to the notification in our humble letters of the 9th of December past, having carried on the slave trade for the Honorable Company on the East Coast of Africa, set sail for here from Mozambique on the 28th of January last, bringing with her a cargo of select slaves consisting of: 190 adult male slaves 58 female slaves 24 slave boys 23 girls Together 295 head of bondsmen in [illegible] The total number of slaves traded for having consisted of 345 head, of which 50 died during the trade and on the voyage hither, so that the aforesaid number of 295 was brought to this place. The Lord Count de Meuron, Colonel of the Swiss Regiment of that name stationed here in garrison, having already long urged and insisted upon to the undersigned Governor for a furlough of twelve months in order to proceed to Europe for the transaction of some private affairs, and such no longer having been able to be refused to him; therefore, by the above-mentioned Governor, under Your Noble, Highly Honorable Lordships' honored approbation, leave has been granted to the aforementioned Lord Colonel de Meuron for one year, in consequence of which he is now to depart for the Netherlands with the bearer of this, the State's frigate Alarm; the command over the Regiment during the absence of the oft-mentioned Lord Colonel de Meuron having been turned over and assigned by him to the Major of that Regiment; while we take the liberty of offering herein to Your Noble, Highly Honorable Lordships an authentic copy of the granted furlough document to the aforementioned Lord Colonel de Meuron, alongside which is also transmitted a requisition and memorandum of what has been furnished here on the Company's behalf for the service of the aforementioned State's frigate Alarm. And further, the day before yesterday, there came to anchor here the English King's ship The Bristol, along with two frigates, The Active and Cygnet, which together, under the chief command of Captain Charles Hughes as Commander on the ship The Bristol, departed from Bombay on the 15th of January last and are bound for Europe. The alongside mentioned French private ship Le Castries, returning from Batavia with a cargo for the Honorable Company, now lying ready to sail to proceed on its voyage to the Netherlands, we take the liberty, as is our duty, to bring to Your Right Honorable Worships' knowledge that the captain of that vessel presented a request, which we have the honor to offer Your Right Honorable Worships in copy herewith. From this request it appeared that if the sum of 1860 rixdollars demanded therein was not granted to him (notwithstanding his charter party in no way implies that the Company is obligated to assist him with any provisions), the said captain would find himself under the necessity of selling as much of his cargo as necessary to furnish the aforementioned requested sum for the payment of his ship expenses incurred here. Considering, on the other hand, that since the amount of the expenses incurred for the repairs made to the aforementioned vessel at Isle de France is unknown, and it would be entirely inappropriate if the Honorable Company did not hold a preferential claim, with respect to what has been furnished from its stores for the ship's needs, upon the freight money that the shipowners are to receive from the Company for that vessel; we have therefore felt obliged, subject to Your Right Honorable Worships' favorable approval, to resolve to cause the demanded sum of 1860 rixdollars to be provided from the Company's treasury here to the aforementioned Captain Marchés, under the condition, however, that he should bind himself, in the name and on behalf of his shipowners, to pay both the aforementioned sum and whatever else has been furnished here for the benefit of the ship out of the freight monies that will be credited by the Honorable Company on account of the said ship; and that, accordingly, the said shipowners must allow the total amount of the expense account, to be signed by him, the Captain, to be deducted from the said freight monies. Since my presence here, having found that neither with us, nor with other nations, were good nautical charts of the southern coast of Africa available; and having come to my knowledge that the Naval Captain and Master of Equipage of this Government, Duminy, on his various voyages which he had made along those coasts and bays, had many observations and separate pieces concerning the position and direction of the bays and soundings of the Reef or Bank of Anguittes; I have, on the occasion of his voyage made in the past year to Mozambique, required and earnestly requested of him to make the further observations still lacking to him regarding that entire southern coast, in order to join all his separate pieces together and to be able to bring them into a General Plan. He has gladly complied with this, and has formed from it a very interesting Chart, which I have the honor herewith respectfully to submit to Your Right Honorable High Mightinesses; and since I dare to rest assured that the Capes and Bays of that entire region are brought upon that Chart to their true Longitude and Latitude, I dare to flatter myself that a substantial service will thereby be rendered to Dutch Navigation, and thus that this work will give some pleasure to Your Right Honorable High Mightinesses. The aforementioned Naval Captain Duminy is furthermore engaged in bringing every Bay situated on the aforesaid Sea Coast to a larger scale, with the addition of the Anchorages and Soundings in each of the same, together with a Memorandum relative thereto; which I hope also to have the honor in due time likewise to cause to be sent to Your Right Honorable High Mightinesses. Zedert myn Aanweesen alhier, ondervon„ den hebbende, dat nog by ons, nog by andere Natien, goede zeekaarten van den zuydelyken Oever van Africa voor handen waren - en aan my kennelyk geworden zynde, dat den Capitain ter Zee en Equipagiemeester deezes Gouvernements Duminy in zyne onderscheiden Reisen, dewelke hy langs die Kusten en Baayen hadde gedaan, veele Observatien en apparte stukken van de legging en Strekkinge der Baayen en Peylingen van het Rif of de Bank van Anguittes hadde; heb ik van denzelven ter gelegendheid van zyne in den gepasseerden Jaare gedaan en sogt Copee na Mosambique, gerequireerd en ernstig ver„ zogt, om de aan hem nog ontbreekende, nadere Observatien, omtrent die geheele zuydelyke Oever te doen, ten eynde om alle zyne separate stukken by den andere te voegen en in een Generaal Plan te konnen brengen. That as we had the honor to report in our humble letter of February 8th last with the French packet ship l'Elizabeth Sophie the said ship le Neptune having sprung a severe leak on the voyage hither from Batavia, whereby it became necessary to unload its contained cargo here, and having been requested by the captain of that ship, Louis de Martignac, to provide the necessary assistance for the unloading of that cargo and storage space for the same. Copy The original short invoice of its lading has been sent over to the Noble Lords Directors at the Chamber of Delft, for which the oft-mentioned returning ship le Neptune is designated. The unloading, repair, and reloading of the said ship le Neptune having then taken place in the manner described, notice was subsequently given to us in writing by the aforesaid Captain de Martignac that upon the re-embarkation of the cargo it was found that seven bales of coffee beans and two pieces of rope belonging to the Company's goods were missing and had been stolen, with the request that an investigation be conducted into this, and that he, the captain, might be released from responsibility in that regard: In which request of the just-mentioned captain, however, we believed we could not concur, since, as has already been cited hereinbefore, the unloading and reloading of his vessel had to take place at the account of his shipowners, without any risk whatsoever for the Honorable Company; and that he, the captain, moreover had complete freedom, both during the unloading and the storage of the goods, to take all such precautions as he deemed necessary. Which request was accordingly turned down, the necessary copies of the petition of the aforementioned captain and the declaration submitted therewith nevertheless having been placed into the hands of the provisional Fiscal, in order to conduct a careful investigation into the committed theft as soon as possible, and in the event that anything of the stolen goods should be recovered, to hand the same over again to the same Captain de Martignac, or else to the person whom he shall have authorized thereto upon his departure, for the account of his shipowners. The authenticated copies of the writings submitted to us by the oft-mentioned captain are enclosed herewith. Furthermore, there arrived here this morning the warships of the State, Utrecht and Wassenaar, commanded by the gentlemen Captain Jacob Pieter van Braam and Gerrit Oorthuijsen, which departed hither from Point de Galle on January 28th last. Consequently, the petitioner has the honor to observe to you that in order to remedy the needs of his vessel, it is of absolute necessity that he unload his between-decks, containing coffee, arrack, and tamarind belonging to the Company, and that these items be placed in a place of safety to be re-embarked aboard his said vessel as soon as the repairs are completed, and following the assistance of workers and materials for this purpose that the said petitioner has the honor to ask of you with urgency in order to accelerate operations. Consequently, on the 19th of January last, the petitioner having given orders to his second-in-command to proceed, he began on the said day to unload the items from these two decks and sent them aboard the said vessel serving us as a warehouse under the conduct of Mr. Desmorice, 1st Lieutenant; the said items, whose stowage and unstowage aboard the said warehouse vessel had been carried out by the man named Julien Yves Bouton, marine officer of the Neptune, and the launch and the cargo boats had been escorted by the Sieur Garau, officer of the said vessel, according to what is stated in the report that the petitioner has the honor to place before your eyes, in which quantity of items that were unloaded and transferred aboard the warehouse, the major item of the Company consisted of eleven hundred and seven bags of coffee, of which only eleven hundred bags were returned aboard the Neptune, which makes seven bags missing; likewise the major item of the Neptune consisted of forty-five pieces of cordage of various qualities, and two pieces were embezzled from him aboard the said warehouse, as well as the seven bags of coffee. The petitioner has every reason to believe that the theft took place aboard the said warehouse according to the reports that have been made to him concerning the conduct of the persons appointed to its guard, and notably regarding the proposition that was made to one of his officers concerning these same items; which greatly astonished the petitioner, who adds that the said theft could perhaps only have been committed through the partners of the foremast of the said warehouse when it was dismasted; since following the orders of the said petitioner, the hatches were only permitted to be opened in the presence of his first lieutenant, keeper of the keys. to make him pay, although he had already paid for his first one, even if unserviceable, of which testimony had also been given by one of the quartermasters of the said Regiment, named Louchain; and since, due to the difficulties raised by the majority of the judges to the effect that the necessary inquiries ought to be made concerning this matter before passing judgment on the charges brought against the said soldier Robert, he had at that time remained unsentenced. And that he, the Governor, upon the reports which the Major of the Regiment had successively delivered to him concerning the aforementioned sessions held on that case, having always presented to the same the fairness and justice that accompanied the said difficulties of the judges, had therefore also expected that Colonel de Meuron, being informed thereof, would not have hesitated, but on the contrary would have set to work on such inquiries as were serviceable to clear away everything that could hinder the judges in passing judgment. Yet that, on the contrary, it was noticed by the said Governor that Colonel de Meuron had seen fit, just before the day on which he, with the foreknowledge of him, the Governor, had intended to convene a court-martial, to have arrested fourteen of his officers, being those who in the previous court-martial had constituted the majority in the decision to have the necessary inquiries regarding the excuse produced by the soldier Robert supplied to the judges before passing judgment on him; and that the said Colonel de Meuron had thus attempted, with the exclusion of those fourteen officers, to make the court-martial proceed. That he, the Governor, as soon as he had been informed of this utterly impermissible conduct, had inquired about it of Captain de Bonstetten, as being the oldest of the Captains of the Regiment who was then present, and having received a confirming answer from him, had at that time deemed it necessary for that reason to order the court-martial to be suspended, all the more since he, the Governor, came to learn that the aforementioned quartermaster Louchain had subsequently given a declaration concerning that matter before commissioners, completely contrary to what he, as has already been said before, had deposed in pleno judicio; so that he, the Governor, had sent a written order to Colonel de Meuron through the Major of the Regiment to suspend the convened court-martial until the required inquiries had been made and the proceedings had been prepared in full form. That, however, thereupon, instead of clearing the embarrassment of the judges and allowing the arrested officers, as bound and authorized thereto, to accede to the court-martial, the often-mentioned Colonel de Meuron had seen fit to address a missive to him, the Governor, whereby he gave notice that, pursuant to the aforementioned written order from the Governor, the court-martial that had already been convened over the proceedings of the soldier Robert had not proceeded; that although he had thus begun by obeying according to his duty, as he would always do, he was nevertheless compelled to protest against it. That according to the Carolina and that which had been witnessed by him, the Colonel, in the Swiss Regiments in which he had served, he believed he could maintain with good foundation that the proceedings against the soldier Robert had been convened in the required form, but that the subaltern officers of whom the court-martial was composed had not observed their duty by refusing to pass judgment against the criminal who was brought to trial before them; that by having the quartermaster Louchain appear before them and demanding a deposition from him, they had committed an act of authority infringing upon the authority of him, the Colonel, because the code had assigned to him, the Colonel, alone the power to give the order to arrange the inquiries, and to the chief judge of the Regiment to take them upon that order; that those officers, moreover, had undertaken to commit another act of authority against the sovereignty of the high court-martial by rejecting a judgment pronounced by the same. That for these reasons he, the Colonel, did protest in the most solemn manner against those whom this might concern, regarding the breach made upon the laws of the nation, by which all tribunals in the Swiss Regiments must be regulated. having conformed, after serious deliberation on this matter by us, and having noted, in the first place: that the declaration made by Colonel de Meuron in his aforementioned letter, stating that he would obey the order of the Governor received regarding the suspension of the court-martial, was diametrically opposed to what follows at the end of his letter, namely that he, the Colonel, would keep the soldier Robert in custody until Your Noble and Most Honorable Worships had enabled the undersigned Governor to know in what manner to decide the fate of that soldier, since from the aforementioned order of the Governor it could not be inferred that his intention had been to cause any delay in the proper administration of justice, but on the contrary, that in order to keep the said administration of justice in order and according to the prescription of the laws, the judges would have to be fully and properly instructed regarding the defense brought forward by the accused; That furthermore it had by no means (as Colonel de Meuron seemed to wish to suppose) been maintained on the part of the Governor as though the court-martial had not commenced according to order, but rather that in the progress and the proceedings one had not acted to the satisfaction of the judges and the trial therefore suffered from prominent defects; that also the officers had not refused to pass sentence on the offender, but that the same supreme power which commands the judgment of offenders to the judge also commands the same judges by the established laws and ordinances to weigh the crime well and to pay heed to all circumstances that accompany it, so that, whenever anything should occur therein that must serve to mitigate or aggravate, to take such into account when sentencing; and the said officers, having thus raised difficulties about sentencing before and until the trial had been properly prepared, had also acted according to the duty prescribed to the judges by the same ordinances, as the observation of this with relation to the matter of desertion is specially found noted in the Caroline ordinance, Paris edition of the Year 1734, article 108, page 171, in force with the aforementioned Swiss Regiment, reading: "in the investigations that are made against a soldier accused of desertion there are four principal heads to examine, namely: 1st: the causes of the desertion, to know what drove him to this action, if he did not receive his pay properly, etc." That, as regarded the right to which Colonel de Meuron appealed, as though it pertained to him alone to have an investigation made, and to the supreme judge to accept it, one had also not attempted to deprive either of them of anything in that respect, in so far as the investigation was conducted properly in every way and satisfied the requirements of the law; That by the protest which the Colonel had allowed to follow thereupon, and the accompanying notification of his intention to transmit to Your Noble and Most Honorable Worships the judicial proceedings and all the documents relating to the case, as well as by keeping the soldier Robert in custody until Your Noble and Most Honorable Worships should have heard the motives thereof, neither justice was served, nor would the intention of Your Noble and Most Honorable Worships be answered. And since, on the contrary, both the good order in the aforementioned Swiss Regiment and the general welfare were in the highest degree dependent upon criminal justice taking its course and crimes being punished properly, the resolution was therefore taken by us to order the said Colonel de Meuron, as he was then also commanded, with the delivery of an extract of our resolution, without the least further delay, to convene anew the court-martial, combined with the aforementioned fourteen officers illegally excluded therefrom, for the judgment of the repeatedly mentioned soldier Robert, and thereby to have the aforementioned court-martial fully instructed regarding all the points about which the same, or rather the objecting majority, desired information, so that by them, as is fitting for all upright judges, a verdict might be pronounced with complete peace of conscience, based on upright equity, and in no way depending on an informal and inadmissible manner of proceeding; To the taking of which formal resolution we believed we had to proceed all the sooner, since we were also ordered, among other things, by Your Noble and Most Honorable Worships in your letter of 12 May of the past Year 1785, to avoid in future making such rulings whereby further interpretation or decision would be left to Your Noble and Most Honorable Worships; wherefore we hope that the conduct pursued by us in this matter may obtain the esteemed approval of Your Noble and Most Honorable Worships. While taking the liberty to present alongside this the extract from our aforementioned resolution of 2 February, relating to that affair, as well as authentic copies of the letters from the undersigned Governor to Colonel de Meuron, and the protest of the same Colonel, to which we most respectfully refer, we shall only note herewith that since the departure from here of Colonel de Meuron, the proceedings against the soldier Robert in question having been completed, his punishment, owing to some additional circumstances, has been mitigated to the extent that he was condemned by sentence of the court-martial to remain banished to Robben Island for the period of five years. — By our humble letter of
