The messenger reports that the defendant is not present. The Honorable Independent Fiscal Mr. Jan Jacob Serrurier, by virtue of his office, Plaintiff in a criminal case, on the one part, upon and against the burgher Daniel Verwij, defendant in person, on the other part; to the end of coming to account for the insult and affront done to this Council of Justice through his very far-reaching impertinence, obstinacy, and insolence committed against justice. The Honorable Plaintiff by virtue of his office requests, in view of the non-appearance of the defendant, the first default with the benefit thereof and a second writ of edict against today fourteen days. Pieter Hacker, President, together with the Council of Justice of the Government of the Cape of Good Hope, make known: Whereas the burgher Daniel Verwij was summoned on the 30 December of the past year 1784 by our order by public edict and tolling of the bell, to appear in person before our Council within the time of two forthcoming weeks, to the end of coming to answer for and purge himself of his great and very far-reaching impertinence, obstinacy, and insolence committed against justice, and the affront and insult thereby done to his lawful judge; and the same Verwij nevertheless has not yet appeared, but on the contrary keeps himself a fugitive and in hiding; so the Honorable Independent Fiscal Mr. Jan Jacob Serrurier has requested of us today the first default with the benefit thereof and a second writ of edict. Wherefore we have granted to the said Honorable Fiscal the first default with the benefit thereof, and consequently barred the defendant from the declinatory exception, as well as deemed it necessary to have the defaulting and hiding Daniel Verwy summoned and cited for the second time by public edict and tolling of the bell by these presents, to appear in person before our Council of Justice yet within the forthcoming two weeks, to come and purge himself of the first default and his aforesaid serious offenses, on pain that, in case of neglect thereof, further proceedings shall be instituted against him according to law. Thereafter appeared in the Council the burgher Ensign Christiaan Pieter Brand, as brother-in-law, and the burgher Sebastiaan van Reenen, as belonging to the kindred of the aforesaid Daniel Verwy, who came to present a petition concerning the aforesaid Verwij, reading as follows: [illegible] After the reading of which, the aforesaid Sebastiaan Valentijn van Reenen further verbally requested that the officer, denoting thereby the Honorable Independent Fiscal, might withdraw when that petition was being deliberated upon. The Honorable Fiscal, having meanwhile stated his opinion on the contents of that petition, maintained that the request made therein ought to be rejected; but that his Honor reserved the right to institute such action as should be deemed advisable regarding the injurious and libelous terms used therein with respect to him, the Honorable Fiscal. Whereupon the Honorable Fiscal having withdrawn and the contents of that petition having been discussed, it was unanimously resolved to give thereon the following apostil: The Council rejects the request made by the petitioners in this petition; leaving reserved to the Honorable Independent Fiscal the right to institute such action as shall be deemed advisable with respect to the injurious and libelous terms used in the aforesaid petition. To the Honorable President Pieter Hacker and the Honorable Council of Justice here at the Cape of Good Hope. Honorable Lord and Gentlemen. Sara Lambregts, wife of the free burgher Daniel Verwij, together with the further undersigned kinsmen of the same, respectfully show: How it has become apparent to them, to their bitter sorrow, from the edictal citation published and further posted on the 30th of the recently elapsed month of December at the request of the Officer, Mr. Jan Jacob Serrurier: That the same Officer, in his assumed and demanded criminal action, imputes, upon the report of the commissioners, that he has made himself guilty of far-reaching disobedience, obstinacy, and impertinence toward Your Honorable Council; With the result that Your Honors first granted a warrant of personal arrest against him, and thereafter, when he, seeing the provost marshal with four of his subordinate constables searching for him in his house, from which he was not far off, had hidden himself in the best possible manner in order to avoid public scandals both for himself and his burgher class, Your Honors proceeded to put into effect the aforesaid summons. Yet, considering, Honorable Lord and Gentlemen, that we could infer nothing else from the contents of the said edictal citation than that the true origin and first beginning of the matters militating against our husband and kinsman Daniel Verwij were presented to Your Honors by the Officer in too withheld and distorted a manner, such that the granted personal arrest and the edictal citation in its too vigorous terms can directly and in the first place be attributed to none other than him; and we, according to what is known to us of the concatenated course of events—indeed, according to the evidence which our aforementioned husband and kinsman Verwij held in hand—are fully convinced that he has made himself a party and recusant not so much against Your Honorable Council, but principally against the scheming conduct of the Officer. Because the same, from the form and manner in which His Honor so shortly before instituted a similar kind of action before Your Honors against the fellow free burghers Bartholomeus Goedhart and Johan George Barends, with the result that they were also criminally apprehended for a slight fault, according to the outcome of the punishment in proportion to the charge, has given to us and to the concerned burgher class sufficient reasons and grounds for suspicion to conclude that His Honor is animated and pregnant with such vindictive inclinations of mind, according to his own provable expressions and other concurrent matters, with respect to the burgher class who have complained, are still complaining, and have already requested redress from the High and Mighty Sovereign, as well as those participating and contributing therein, among whom the aforementioned Verwij naturally and justly also belongs; for which no better occasion could ever come to his hand than a semblance of a criminal fault, in order to present the same, as in the subject case, in the worst manner to Your Honors, to the end that—which naturally serves for his own preservation—he may always be covered by Your Honors' decrees, which are genuine yet grounded solely on the most damaging submissions; And that we also have full confidence that we shall be able fully to maintain on behalf of our aforementioned husband and kinsman Daniel Verwij that he never had the least intention to injure Your Honorable Council directly or indirectly, but that he only made himself a party and recusant against the intrigues of the aforesaid Officer, Mr. Jan Jacob Serrurier; and in that regard could not possibly have acted otherwise than as the desire of the concerned burgher class and the safeguarding of his own person and family from shame and blemish came to require. Thus we find ourselves compelled by the urge of the marital bond and the voice of blood to turn to Your Honors, speaking humbly and urgently: That, whereas we have before us this well-known proposition of law, that in assumed criminal cases vice versa wives may defend the person and affairs of their husbands, and children those of their parents in their absence, in order to prove their innocence; As well as the notable piece made known in print by the Hollandsche Historische Courant of Tuesday the 14th of September 1784, No. 111, under the title Netherlands, reading:

reading word for word Rotterdam 12 September, the day before yesterday proceedings were held here before the aldermen for the master Chief Officer as prosecutor in case of summons in person for incarceration against the notorious Martheyntje Kalf, who for some time expressed herself in a violent, rebellious manner in her conversations, with the result that the prosecutor was denied his claim and the defendant was set at liberty, though under pledge of appearing again at the first requisition wherever she shall be required, the well-known Mr. Belderdyk having been the lawyer of the defendant. That it may therefore please Your Honorable worships' judicial pleasure, in consideration of the proof offered herebefore that it was in no way the intention of the defendant to offend Your Honorable worships, but rather that the scrupulous fear of the intrigues and snares of the present officer, from which he could deduce nothing other than the aforesaid scandal for himself, were the reasons why he took a recusant stance against the same; therefore to provisionally release the defendant, our husband and relative Daniel Verwy, upon rescission or retention of the further edictal citation, from personal appearance. And by reason of the fact that we cannot know with certainty whither he has retreated, therefore to admit us to ordinary proceedings to the end of being allowed to appear by attorney on his behalf against the Master Officer to demonstrate and prove his innocence, the petitioners being prepared at that point to present themselves as sureties for the proceedings and the costs thereof according to the citation required by law. In the forenoon, present the Honorable Esteemed Mr. Pieter Backer, President, and all the Members, with the exception of the Honorable Independent Fiscal Mr. Jan Jacob Serrurier, the Colonel Mr. Robbert Jacob Gordon, and the Merchant and Auctioneer Mr. Oloff Martinus Bergh, on account of both business and indisposition, with the co-optation of the two Burgher Councillors, the Honorable Johannes Smuts and Jan Coenraad Gie. The Honorable Tobias Christiaan Rönnenkamp, acting ratione officii as Plaintiff in criminal matters due to the indisposition of the Honorable Independent Fiscal Mr. Jan Jacob Serrurier, serving by word of judicial declaration, stated that he submitted all the documents pertaining to the case, together with the executed, published, and everywhere affixed edict mandates, and requested, in view of the non-appearance of the defendant, that he be definitively sentenced as in default and in hiding to be banished forever from this Country and its jurisdiction, on pain of being punished according to his deserts if he should at any time fall into the hands of Justice, with condemnation in the costs. The Honorable Independent Fiscal Mr. Jan Jacob Serrurier, ratione officii Plaintiff in criminal matters, on the one part; against and opposed to The burgher Daniel Verwey, defendant and in person, on the other part; to see service of the intendit on account of his extreme insolence, obstinacy, and brutality committed against Justice, as well as the insult and affront thereby inflicted upon this Council. Whereas the burgher Daniel Verwey, having been summoned by the former Burgher Lieutenant Hendrik Oostwald Eksteen to bear witness to the truth at the Plaintiff's expense in the lawsuit instituted by him before our Council against the burgher Jacobus Arnoldus van Reenen, and thus to answer such interrogatories as would be presented to him before the Honorable Delegates of this Council, did not hesitate, instead of appearing in Court according to his duty, rather to ride out into the country and thus default, but moreover, when the said Verwey, on account of his non-appearance, both at the request of the Plaintiff and according to the custom of legal proceedings, was condemned by default to answer the aforesaid interrogatories, thought fit to give as an answer to the court messenger when the latter notified him, Verwey, upon his return, of the aforesaid condemnation: "It is an old custom that when someone is summoned to bear witness to the truth and does not appear, judgment is requested by the party, yet I will not appear. For nowadays a person must be afraid to come down there near the jail, because people there are violently seized and put into the jail." The frequently-mentioned Verwey, furthermore, when the court messenger had appointed him on the following day to appear on the day thereafter, or on Friday the 12th of November last, before the Honorable Delegates from our Council at half-past ten o'clock in the forenoon, in order to comply with the aforesaid Sentence and to answer interrogatories, gave as an answer to the court messenger: "I will not appear, and besides that I intend to ride out into the country this afternoon." Just as the aforesaid Verwey then also did not appear before their Honors. To which the messenger however replied in the negative— Wherefore the Council, in consideration of the great and very far-reaching impertinence, obstinacy, and insolence of the aforesaid Verwy, as well as the contempt, insult, and scorn thereby inflicted upon this Council, all of which, if not curbed according to the requirements of the case and if the willful as well as stubborn offenders were not punished according to their deserts, would not only be offensive to the good inhabitants, but all good order and due obedience would be broken and trampled underfoot, and thus the absolute ruin of this in every respect flourishing Colony would be caused thereby, the Council of Justice has granted the well-mentioned Fiscal a decree, in order that by virtue of the same he might cause the repeatedly mentioned Daniel Verwy to be summoned in person before our Council; but the aforesaid Verwy, although that citation was served pursuant to the decree granted for that purpose and expressly cited therein, after having obtained a copy thereof, saw fit to answer: "I shall read the copy of the citation attentively and give a further answer," and the following day to give in writing and arrogantly as an answer to that citation— "I do not accept the citation and protest against the costs, while I see from the citation that I am summoned criminally by the officer and the specification of the presumed criminal acts is omitted from it, which I nevertheless ought to know in order to propose an exception thereon regarding the incompetence of that summons in criminal matters." Right Honorable, Valiant, Highly Esteemed, Most Wise, Provident, and Very Generous Gentlemen, High Ruling Gentlemen. In our humble letter of 23 August of the past year, we had the honor most respectfully to inform Your Right Honorable High Mightinesses how, due to the daily worsening, feeble condition of the since deceased Secretary and fellow member of this Council, Mr. Olof Marthini Bergh, we were compelled to look out for someone who, with full confidence, could be assigned to assist Mr. Bergh in that painful and weighty office; and to that end, upon the proposal of the undersigned Governor, we had appointed the then Junior Merchant and Storekeeper Oloff Godlieb de Wet, who, through various offices in which he had always earned the satisfaction of this Government, was known to each of us as a zealous person, well versed in the land and its people; and who subsequently, when the said Mr. Bergh departed this life, was unanimously appointed by us as effective Secretary, with confirmation of the seat already granted to him in our assembly as a member, which has always been attached to that office. Yet, whereas Your Right Honorable High Mightinesses, by the most revered letter from the presiding Chamber of Zeeland dated 28 June 1785, among other arrangements concerning the internal affairs of this Government, were pleased to determine that, upon the first vacancy of the office of Secretary, the person promoted thereto should only be permitted to hold the rank and title of Merchant, and that upon such appointment of another Secretary, the same would no longer be given a vote in the Council, and that he consequently would only be Secretary without simultaneously being a Member, we find ourselves placed in no small embarrassment. Ever mindful, according to our solemn duty, most scrupulously to obey and follow the revered orders that flow down to us from Your Right Honorable High Mightinesses, we would not have hesitated for a single moment strictly to obey this order, had we not taken into consideration that it can never be understood to agree with the honored intention of Your Right Honorable High Mightinesses to reward the zeal of faithful servants with their humiliation, and thereby, as it were, to extinguish the fire of emulation, that driving force of upright souls, whereby not infrequently the greatest detriment is inflicted upon the entire service, to which we respectfully believe the respected orders of Your Right Honorable High Mightinesses must always be made relative; just as executing that order would without doubt involve great hardship regarding the said Mr. de Wet, who could only be persuaded, upon the urgent solicitations of the undersigned Governor, to accept an office whose importance and weightiness—as our resolutions and letters bear undeniable evidence— is magnified more and more by the daily increasing volume of business in this Government, and for which competent subjects are so scarce. Now, having already long before the receipt of the aforementioned order enjoyed the honor of having a seat as an ordinary member in our assembly, he would again have to suffer the humiliation of having to step back and vacate a chair which alone could animate him to yield to the strong urgings of the first-signed, and consequently would also not be allowed to participate in the favor of Your Right Honorable High Mightinesses so generously shown to the other members of our assembly. For which reasons and motives, especially because of the continued good satisfaction that the repeatedly mentioned Mr. de Wet provides us through his zeal in this difficult post, we also thought we might respectfully make use of the favorable qualification that Your Right Honorable High Mightinesses were pleased to grant this Council, namely that if this Council should have weighty remarks concerning any points which Your Right Honorable High Mightinesses saw fit to establish—as we hope, under the highly favorable and kind interpretation of Your Right Honorable High Mightinesses, these our remarks may be considered—to bring the same to the notice of Your Right Honorable High Mightinesses prior to putting them into execution. Nevertheless, we drifted upwards with the fleet and found ourselves on the 19th of the same month, at 6 o'clock in the evening, at a depth of 30 fathoms, Beachy Head north of us. The wind shifting to the south, we tacked toward the French coast. At night the wind broke out again so fiercely that we had to take in the mainsail and main topsail; we hove to under the reefed foresail, main staysail, and reefed mizzen. The terror of that night was indescribable; the sky was nothing but fire from the ceaseless lightning, and the claps of thunder followed one another so closely that they could not be distinguished from each other. In this dreadful situation we were forced to carry the aforementioned sails to steer the ship, which threatened to break apart. The wind was also so variable that no sail could be carried, as one moment it was a flying storm and the next a dead calm. The sea anchor had no effect in keeping the ship to the sea, which in the calm moments constantly fell off and rolled with the gunwales underwater. On the 2nd of January, around [illegible] o'clock in the morning, six shrouds of the main rigging on the leeward side parted all at once, whereupon the mainmast immediately fell, in spite of preventer stays, preventer tackles, and a spare shroud. We could not save anything from the wreckage; nevertheless, we soon got rid of it, as the leeward rigging remained caught on the cable and could be easily cut away. The mizzen gear caused the greatest hindrance, since the mizzen topmast had fallen through the mizzen sail. While we were busy clearing this, a heavy sea swept over onto the quarterdeck, carrying away everything on it. The boatswain's mate and a sailor were swept overboard by it and could not be saved. I myself was picked up by the sea and thrown against a large hencoop, sustaining a severe head wound; however, this coop was the reason I remained on board, since I washed against it and then had time to grab hold of the gratings. The coop subsequently washed overboard to leeward. The waist was full of water, which was already running between the decks through the mainmast partners. We pumped with all pumps. The 3rd ditto in the forenoon we set a spar upon the stump of the mizzenmast, resolved at the same time to erect a rig as well as one could, and to touch at the island of St. Iago, there to put the fore-rigging in order, which had suffered greatly. The 4th ditto took in the spare yards, the wind south-southwest, good weather and decreasing sea. The 5th and 6th ditto worked with all diligence on the erection of our rig, wind and weather as before. The 7th ditto we discovered that both the trestletrees and cheeks of the foremast were broken, struck the topmast 12 feet, cut a new fid-hole therein, and lashed the same around the foremast, intending then still to carry the fore-topsail with 2 reefs. Duplicate No 8 which shall be brought in the above-mentioned manner, shall receive, besides the fixed price of three Spanish dollars, six Dutch stivers more per hundred pounds for milling wages, but nothing more, whether it be for freight, average, or under whatever name it might be. The Captain shall receive in payment for the cost of the cargo a sum of six thousand Spanish dollars, above the said valuation, in paper currency or silver coin, according to the exchange and value they have here; and the remainder shall be satisfied by the government here in bills of exchange or drafts upon the Honorable Company, payable in the Netherlands at six months after sight. Article 5 The Honorable Company shall deliver to Captain Carpenter, against payment in the Company's Treasury here, eight or ten leaguers of mature ordinary Cape wines of a past year, to be taken by him for a trial, and grant him the liberty, upon his return, in proportion to the profits to be made on those wines, to take again a quantity thereof in payment or on account of the remaining cost of the cargo of wheat and flour, in order to receive that much less against it in bills of exchange or drafts; the prices of those wines shall then be further agreed upon and settled. Article 7 Lastly, Captain Carpenter binds himself to deliver the aforementioned quantity of wheat and flour here at the latest by the middle of next October, or as much earlier or sooner as shall be at all possible for him by employing all best endeavors. But in case the delivery should happen later than the said middle of October, the government here shall have the preference and full liberty to accept the aforementioned cargo of wheat and flour at the aforesaid stipulated prices, or to agree further thereupon, or to permit the Captain to sell the same here to private persons. Petitioner No 8 That he, the petitioner, for that reason directly addressed himself to the company vessel of his nation also staying here, named Mars, commanded by Captain Hederik Bagge, in order to obtain from the same the necessary assistance for the further voyage and to continue the same in company with that vessel; but that unfortunately that ship, having already made a voyage of two years and being itself in a very poor condition, is utterly unable to render the required assistance to the petitioner's vessel in time of need, being in the first place destitute of capable boats which in case of an inevitable disaster at sea could serve to rescue the crew, as well as of anchors, cables, and other necessities of that nature which could enable him, in view of the approaching winter season, to await here in the roads the readiness for the voyage of the vessel under the petitioner's command, without there being any opportunity at this government to be accommodated with one thing and another at present, and that the aforementioned vessel Mars therefore makes all possible speed to depart from here, and cannot possibly stay so long until the ship of the petitioner shall have been brought into some state to sail along; the petitioner thus finding himself in great embarrassment, and wishing to leave nothing untried, if possible, to expose his aforementioned vessel to no further danger, makes bold to take his recourse to your Right Honourable, Valiant, and Worshipful Sirs, humbly requesting that it may graciously please you to grant him some assistance in this matter, and to allow him to continue his voyage in company with the Dutch return ships about to depart first from here, and that he may be convoyed by the same ships up to the European coasts; he being able to assure your Right Honourable, Valiant, and Worshipful Sirs that his petitioner's ship being a very good sailor, there is no fear of any difficulty that the same would cause any delay whatsoever to the convoy.
