he on that occasion likewise understood that, if the aforesaid Authorities in the Fatherland are to properly feel the weight of the allegations appearing therein and rightly comprehend their meaning, these must not be mutilated by any interpretations, the less so because, being clear and plain, the aim that was envisioned can thus also very easily be penetrated; but that these, just as they are in their coherence, ought to come under the discerning eye of Their Right Honorable Excellencies. That the undersigned, therefore abandoning his first intention to engage in a detailed refutation, now merely insists that this Protest as it lies, with all the as yet unsent documents that have any relation to the history of the Helena Louisa, together with this his Counter-declaration, may be transmitted as soon as possible to the Assembly of the Seventeen, in order to await Their Right Honorable Excellencies' decision thereon. Yet so that he cannot avoid, for the better elucidation of some passages that might require some clearing up, as well as to clear himself of the imputation so artfully slipped into his protest under convoluted terms by the aforesaid Fiscal van Lijnden, as if the undersigned had not only exceeded the commission received by him with regard to the careening of the oft-mentioned brig the Helena Louisa, but had also engaged with his fellow members in making secret agreements and forming compacts to compel the Lord Governor to formulate conclusions contrary to his approval and according to the inclination of the undersigned and his fellow members, in the meantime to set down whether the same were conflicting with the interests of the Company or not. That whereas it is true that conferring commissions of such a nature—such as the careening of grounded ships and the examination of their defects—upon members of the Political Council, in times when everyone discharged his duty and conscientiously guarded the interest of his masters, would have had a very bad grace, indeed would even have conflicted with the dignity of the government, it is also indisputably certain that such commissions, in a time like this, have become most necessary for the achievement of the masters' interests. That the preservation of the aforesaid vessel the Helena Louisa having been the sole aim of the undersigned, and he with his fellow commissioner having exerted himself to effect this in the least costly manner, to the extent that if its dispatch to Saldanha Bay, pursuant to the resolution of the majority of the council, had been permitted to proceed, the voyage would have been made at their own private expense, and consequently there was never any question of expenses to be applied for the account of the Honorable Company in this matter; wherefore nothing could have been more groundlessly conceived on the part of the Fiscal than to base his pretension principally on this pretext. That the undersigned, far from ever at any time having made an agreement with any member of the council to thwart the Lord Governor in matters wherein there was merely the appearance of looking after the Company's interests, on the contrary very often concurred with the said Lord Governor in passing resolutions against the opinions of the members who now happen to harmonize with him, so that this accidental agreement is nothing other than the result of a clear awareness that the undersigned, along with the members now constituting the majority of the council, has in this case of his obligation. While the undersigned, with regard to the contention of Mr. van Lijnden: That any member of the council being commissioned to this or that task would thereby come to lose his voting voice. That, on the other hand, the faculty and power is left freely to a commander-in-chief to conclude proposals that have been made, or indeed to leave them entirely without conclusion; And that the members of the Political Council can be regarded as nothing other than councilors attached to the commander-in-chief to assist him in the charge imposed upon him, without possessing the faculty of passing any resolutions against his pleasure, must declare himself to be of an entirely contrary opinion and hold it to be indisputable: That when one or more members from the midst of the council are commissioned to attend to this or that matter, they then represent the body of the government itself; that consequently they can never be compromised with, or considered as a party to, such person or persons into whose post they, by virtue of their commission, intervene and whose authority they must supervise; but that, on the contrary, not only when they have completed their commission and made a report of their proceedings to their committors, but also even pending their aforesaid commission, in the deliberations on the subject of which their commission treated, they always continue to possess their decisive voice.

always and uninterruptedly concluded and held, and continue to hold: That a Chief Commander may indeed, for as long as he sees fit, withhold from the knowledge of the Council this or that matter which ought to be brought to its deliberation, since the consequences that might result from an unnecessary proposal are for his account; but that such a matter having once been brought into consideration, the Lord Governor no longer has the right nor the power to withdraw it from their decision; no, but he is certainly bound, after the votes on the subject in question have been taken, to dictate the Resolution to the Secretary according to the opinion of the majority and to cause it to take effect, even if the opinion of the aforesaid majority ran directly contrary to the pleasure and the understanding of the Governor himself. And that the Members of the Political Council are not Councillors of the Governor, whom he can consult or pass over at his discretion, but are indeed Councillors of the East India Company, with whom the Lord Governor is bound and obliged to treat concerning its interests, and upon whom the Masters themselves confer the power to be able and obliged to oppose the Chief Commander, when they judge that he may no longer be allowed to proceed according to his own discretion in matters that arise; just as this, besides in so many other instruction papers, has been very distinctly prescribed to them and earnestly recommended for observance, as: Firstly, by the memorandum in the form of a regulation left behind here in the year 1713 by the Right Honorable Lord Commissioner Johannes van Steelant for the information of this Government, in which it is said, among other things: "Seeing that the best knowledge of affairs is obtained by reviewing and registering or remembering the Company's successive ordinances, it is also nothing but all the better and more secure for a Commander to deliberate with Members, where everyone has knowledge of affairs, than that a Chief, however quick and prudent he may be, is detained with unnecessary contradictory arguments; for to that end a Governor here has also been joined to the Council for support, entirely not to govern alone, for then there would be no Council needed, just as their Right Honorable Lords recently, by Missive of 23 July 1711, written to the Governor Louis van Assenburg and Council at Cabo de Goede Hoop, were pleased to express themselves, among other things, in these terms: 'Truly expressions that appear to us entirely indecent and unedifying; for, even assuming the aforesaid Governor had believed good reasons militated on his side and in support of his delivered advice, to prefer the aforesaid Skipper de Koningh above the aforesaid Chief Mate, assigned to the aforesaid ship Bentem, he, the Governor, was indeed permitted to bring forward and allege the same in the Cape Council for information, but was nevertheless obliged, notwithstanding that, to come to a resolution with and according to the majority of votes, without wishing to make his private sentiment prevail above that of the other Council members; nay, what is more, to conclude to the contrary and put such into effect, as we find to have happened in the subject case, because in that manner the entire Cape Council would not be necessary, if one could see fit to let affairs be handled and put into execution by the Governor alone according to his own fantasy; but let that be far from it; wherefore, so as not to enlarge ourselves too much on this subject, we, together with the Governor-General and Council, will refer him, the Governor, regarding this subject to a diligent examination of the papers and retroacta resting in the hall.' And lastly, still by the Lords Masters themselves in their Right Honorable Lords' honored letters of 31 December 1788, reading in substance as follows: 'The Governor further giving notice that they were eagerly busy with executing and improving the works that could suffer no delay, and that subsequently, when the old envelope lying around the Citadel should be finished, they would provisionally take in hand both the projected bastions between the Castle and the Duijvelsberg and also alter the defective Battery Charonnes and bring it into better condition without loss of time, likewise without a statement of expenses, we cannot conceal our surprise thereat, and deem it in these times, still so precarious for the finances of the Company, even necessary most earnestly to recommend that above all no other of the works proposed by him be executed without having obtained special qualification thereto, as it is indisputable that by such actions the matter can be disarranged and the provisional work cannot, after all, be done without expenses, which are entirely uselessly wasted if the construction of the works, according to the judgment that will one day be decisively passed thereon, must either be altered or is deemed entirely unnecessary due to emerging considerations.' Copy Copy The undersigned, having received a copy of the protest submitted by Mr. van Lynden to the Council of Policy on the 23rd of June against a resolution of the 15th of the same month, which was passed by a majority of votes, has the honor to remark briefly upon it that the arguments presented therein might at first glance persuade anyone by their sound, were it not that the rules prescribed and determined by the governing Lords—both regarding deciding by a majority of votes and concerning the affinity of Council members, as found in the retro-acts—being taken into consideration, completely invalidate this entire line of reasoning. Furthermore, regarding an alleged agreement and conspiracy with the Council members to form a cabal, the undersigned declares that such conduct is far beneath his way of thinking, leaving this allegation to the conscience of those who are guilty of committing it. signed: I: I: Rhenius In the margin: Exhibited in the Council of Policy on 24 July 1798. Furthermore, if this said vessel is condemned, they should have condemned the said English vessel in which I am travelling to Europe with two hundred troops, which was shipwrecked at the same time as the said brig; and which I find fit to make any voyage, as any person with knowledge of shipbuilding and seafaring must have. These are to certify to whom it may concern that we the undersigned on the 28th day of this month between the hours of seven and nine in the morning saw the keel of the brig Helena Louisa from stem to stern, that is in some places we saw ten inches of it, in others eight, and the least we saw of it was six inches. We also felt the remaining inches of it with our hands and arms which we put under the keel and found it to be perfectly good. We also declare that the repairs done to the brig on that morning in the space of those two hours was such as renders her safe to make her voyage to any distant country; and we declare that it is our opinion that should it be thought proper to repair her more substantially by heaving her down, it is only to shift a small plank which appears a little shaken, which might be completed in a day or two, and which when done we give it as our opinion the ship is as good as new. Petrus Johannes de Wit and Jan Fredrik Kersten, as contractors for refloating the Dutch brig Helena Louisa from the beach, that at three o'clock in the afternoon of 29 May last we proceeded on board the same ship, lying anchored in 4½ fathoms of water, in order to examine whether the ship had sustained any damage since it was hauled off the beach and brought to anchor, as the flag of the ship had flown in distress, as well as to sound how much water was at the pumps; thus we declare having accomplished this, and regarding the distress signal received from the Captain-Lieutenant Jan Bringman the answer that he had been compelled to do so because he had had no food or drink on board for the crew; whereupon we sounded the pumps and found in the stern near the pump a generous 5 inches and 6 inches of water in the bow, and that the Captain-Lieutenant declared having pumped no more than once since one o'clock at night, and this only with one pump that was furthermore damaged, the second pump being unserviceable, which pumping had been done by the Captain-Lieutenant at 10 o'clock in the forenoon. On that occasion, showing ourselves aggrieved concerning various points in which, according to our humble understanding, the highly respected orders of Your Right Honourables were less observed than formerly, we simultaneously, with fitting respect, brought to the attention of Your Right Honourables the disorderly conduct that took place with relation to the dispatching of the resolutions of the Council of Policy, under the well-founded supposition that, since the originals were not signed by us, one would not have had the audacity to send off copies thereof. However, when the third respectful undersigned asked the first sworn clerk of the Political Secretariat in conversation to what extent the resolutions of this place had been dispatched to the Fatherland, the same, to his greatest astonishment, received the answer that those up to the month of June of the past year 1790 had been dispatched; but, becoming confused, he retracted this by saying that those which had been sent were, as he believed, of earlier dates. However, on the occasion when the aforesaid first sworn clerk presented the resolutions of the months of October, November, and December of the year 1789 for signature to the first undersigned, and the same inquiry was likewise made by him, the repeatedly mentioned clerk finally declared that, although the resolutions from the month of October 1789 onward had not been signed by the respective council members, authentic copies of the same had nevertheless been sent to Europe, just as if the originals had been signed by the members conformable to ancient custom. Upon this disclosure, we consequently thought it most prudent provisionally not to sign them, to which end we also made that decision unanimously, on the grounds that, if one has dared to take the liberty of authenticating those documents as so many opinions of the council members without their having obtained their sanction through the subscription of those members, one may then rightfully suspect that one may possibly have intended by this to make us acknowledge matters that were diametrically opposed to our views; and it would therefore not seem strange to us if one had forwarded all the decisions to Your Right Honourables as taken with unanimity of votes, although the contrary thereof is true for many of them. We thought it our duty to give Your Right Honourables the necessary notice of this; and, having furthermore recommended the esteemed persons, families, and weighty deliberations of Your Right Honourables to God's safe protection, may we be permitted to sign this with the deepest respect. that upon the arrival of the ship de Batavier, we received a report from the Master of the Equipage that smallpox had been discovered in four persons on board that vessel, but that they had recovered since 5 August, without any further signs of that disease, so greatly to be feared for these Colonies, having been discovered in any of the ship's crew, as Your Noble High Mightinesses will further be able to see from the accompanying authenticated copy of the declaration by the officers. Upon receipt of that report, we immediately appointed a commission of medical men to examine carefully the persons who had suffered from smallpox, which commission submitted to us a written report, which we take the liberty of likewise presenting to Your Noble High Mightinesses in authenticated copy, and from which Your High Mightinesses, if it pleases you, will be able to see that the said commission was of the opinion that that vessel ought to be removed from this roadstead, which we then also put into effect by causing that ship to depart for Robben Island, where the same is properly provided both with the required refreshments and with all other necessities. However, since there are several permitted chests and cases on board that vessel containing private goods for this Colony, which must be unloaded here, and as Mr. Rijk Lesueur, son of the undersigned Cellar Master, has also arrived on it as a passenger, we have therefore resolved to have the aforementioned goods and passenger transported to the ship het duijfje, lying at this roadstead, and before beginning therewith, appointed a medical commission to deliberate on what precautions ought to be observed both in the unloading of the goods and in the transfer onto the ship het duijfje, to which end they are to ascertain and investigate very precisely in which places aboard ship these goods have been located, in order that those accordingly Awaiting the report of this commission, we shall not fail to make a dutiful report thereof to Your Noble High Mightinesses at the first opportunity, while we shall meanwhile exert everything in our power to safeguard this important Colony from the all-destroying smallpox and to cause the frequently mentioned ship de Batavier to proceed on its voyage from Robben Island to India's capital as soon as possible. We may have the pleasure of dutifully communicating to Your Noble High Mightinesses the safe arrival, on 9 of this current month, of the packet boat de Snelheid with 7 dead and 2 sick, which vessel departed from Batavia on 4 August and sailed from Sunda Strait on the following day. Upon the arrival of that small ship, we received a written report from its officers, which we take the liberty of presenting to Your Noble High Mightinesses in authenticated copy, from which Your High Mightinesses will be able to see that, due to the mortality and continuous sicknesses on board that vessel, Captain Ian Coenraad Havenkamp was forced to turn the prow toward Mauritius, where he came to pass away; that the said Captain was succeeded in command by Lieutenant Roelof Iurgens Erdrep, who had to engage five French seamen at Mauritius in order to undertake the voyage to this corner with peace of mind. Enclosed we take the liberty of presenting to Your Noble High Mightinesses an authenticated copy of the conditions upon which Lieutenant Erdrep engaged those seamen, together with the account of the expenses that he had to incur at Mauritius, in payment of which he passed a bill of exchange to the charge of the Noble Grand Mightinesses, the Directors of the Chamber of Hoorn. The aforementioned Erdrep having made a request to us by petition to be favored with the command of the aforementioned packet boat, we believed we could condescend thereto, as he gave good proofs of competence on the voyage from Mauritius hither, and we therefore hope that our arrangement in this regard will carry the honored approval of Your Noble High Mightinesses. The frequently mentioned packet boat having been put in a state today to undertake the voyage to the Netherlands, we let this serve respectfully to accompany that small ship, and we present herewith to Your Noble High Mightinesses the summary invoice of its Batavian cargo, together with the account of expenses for what was provided to it at this Government. Concerning the documents left behind at this Government by the Military Commissioners, Messrs. to let the division of the companies of the aforementioned artillery corps remain as it currently stands today, and to maintain the internal management of those two corps, until such time as it shall please Your Right Honourable Worships to honour us with Your highest further orders concerning this matter. Also examined at our meeting was a memorandum and draft regulations, left behind by the frequently mentioned gentlemen Military Commissioners, concerning the arrangement and management of the Company's hospital here, which plan we have resolved to establish and introduce immediately. Consequently, the undersigned Secunde and Independent Fiscal have been appointed as regents over the said hospital, together with the head of the militia, the chief of artillery and engineering, the equipage master, and the pay bookkeeper, in order to assume the management over the aforementioned hospital pursuant to the provisions made in those regulations. From this, however, the Independent Fiscal may excuse himself whenever the business of his difficult office will hinder him therein, whilst at the meeting to be held by the said regents, the bookkeeper of the hospital shall have to serve as secretary. To this end, copies of the aforementioned memorandum and draft regulations with all the documents belonging thereto have been issued to the regents, with authorization that if, in the execution of the points mentioned therein or any of the same, significant objections should arise for the Honourable Company, they are to make the necessary representations to us concerning this. And we have deemed that what is proposed in the aforementioned memorandum concerning the necessity of constructing a new building for a hospital should be left deferred to the respected decision of Your Right Honourable Worships. Of the memorandum and plans concerning the management of the seafaring personnel in this Government, left behind by the well-mentioned gentlemen Commissioners, we have placed copies into the hands of the equipage master and the pay bookkeeper, as well as the Captain Engineer Hendrik Pieter Wijting Schull, currently commanding the troops on the line, with orders to provide us with their considerations and advice on whether and to what extent the arrangement specified therein could be introduced here. And we shall not fail, at a convenient opportunity, to supply Your Right Honourable Worships with the considerations that we expect from the said deputies, along with respectful notification of the resolution that we shall take thereupon. The undersigned Governor has also produced at our meeting the project plan left behind by the often mentioned gentlemen Military Commissioners for a basis or arrangement for the national depot here. Therewith he also submitted the report, annexed hereto in authentic copy, which he had required from the pay bookkeeper Marthiesen regarding the manner in which that plan could be followed as closely as possible without any burden to the Honourable Company or without departing from the orders already established thereon, in order to await thereupon the further orders that Your Right Honourable Worships will be pleased to give us regarding this. Whereupon the Governor came to submit that, since one did not yet dare to proceed with the appointment of an effective officer to the aforementioned depot when the same would be 100 heads strong, at which currently no one other than the Commandant alone was present, much less to the appointment of as many officers and non-commissioned officers as the more aforementioned gentlemen Military Commissioners come to propose in their plan; and since it was nevertheless of the utmost necessity that at the said depot, which had once again grown to a considerable strength of 150 men and daily had to become stronger through the arriving ships, at least a subaltern officer be stationed in order to maintain good order and discipline among those men, and to counter and prevent all irregularities that otherwise notoriously must occur among them, which the Commandant of that depot, Major de Sandol Roy, had also represented to him, the Governor, in a written memorandum, which we likewise take the liberty to present to Your Right Honourable Worships in authentic copy; therefore, subject to the approval of Your Right Honourable Worships, to appoint a sergeant with the rank of officer, besides another four sergeants and six corporals instead of six sergeants and just as many corporals, as the pay bookkeeper Matthiessen stated in his aforementioned report. The Governor furthermore declared that he otherwise did not wish to be held responsible for the consequences that might result from a lack of subordination and good discipline among those troops, and he further submitted for consideration whether it was currently advisable to send away the troops of the national depot, in view of the weak state of the garrison and the critical circumstances in Europe. but to add to sergeant's pay, which they considered to be contrary to the order of Your Noble High Mightinesses, the undersigned cellar master and cashier have, however, been willing to condescend to an increase in the number of non-commissioned officers among those troops, who shall again be brought to the national depot with the outgoing ships, and the undersigned dispenser has further added hereto in support of his position that he had to insist all the more upon an immediate dispatch of the trainees, because because the undersigned Governor had even declared that he feared that, through their greater increase, disorders might arise if no officer were additionally placed among them, while the undersigned Independent Fiscal was of the opinion that it was most necessary to provisionally appoint a titular Officer to that depot and he would even consider it dangerous not to proceed to this, since representations are being made on this account, and that with regard to the dispatch of those men, he he, in view of the critical circumstances in which one presently finds oneself, could by no means give his vote—and the undersigned Governor, however, for various considerations, thought it necessary regarding this dispatch of the aforementioned Depot to conform to the sentiment of the majority, nevertheless leaving the consequences thereof to the accountability of those who formed the majority. Pursuant to that resolution, 60 men belonging to the depot have already been embarked on the ships Voorland and the Goeverneur Valk and we have qualified the pay-bookkeeper to provide henceforth, upon the dispatch of those troops, one month's advance pay to each of them, while we once again solicit Your Noble High Mightinesses to please let us receive your positive orders, according to which we shall have to conduct ourselves in the future concerning this depot. We take the liberty to offer Your Noble High Mightinesses in authentic copy a petition presented to our assembly by the junior merchant Willem Jan van Oostern, arrived here from from Batavia, and we believe we must not fail respectfully to request Your Noble High Mightinesses that it may please your High Mightinesses, in consideration of the commendable conduct which the petitioner has maintained during his stay here, and the desire he shows to qualify himself more and more in the Company's service, together with the good expectations which one may reasonably entertain thereof, to cast a favorable reflection upon the petitioner's solicitations and to declare him employable in this Government. We We also take the liberty to offer Your Noble High Mightinesses enclosed an account of redress for the undercharge on 2 mast spars of 24 palms and 1½ deck planks supplied in this Government to the State's warship the Ceres. The proceeds of the Public Revenues, on the contrary, have yielded ƒ 9203„15„8 more than in the previous financial year, which arises from the higher received duties on the sold real estate and recognition of wines, sale of stamps, and other revenues; whereas, on the other hand, the tithes on grain have yielded less, due to the small delivery that was made thereof to the Honorable Company, as well as well as the revenues of the loan places have yielded less than in the preceding financial year. The received interests have amounted to ƒ 888„11„ less than in the year 1787/8, because a good portion of the funds left out at interest were paid off in the preceding financial year. To the Right Honourable Sir Corneles Jacob vande Graaff, Governor and Director of Cabo de Goede Hoop and its dependencies, etc., etc., together with the Honourable Council of Policy. Right Honourable Sir and Honourable Gentlemen, As the undersigned were specifically pleased to be commissioned to examine the condition of the Honourable Company's ship de Batavier, currently lying outside the roadstead, and the persons thereon who have suffered from smallpox, we have the honour to report with great respect that, after we arrived this morning by government boat alongside the said vessel, we had the said persons, being three sailors and a second lieutenant, come to the accommodation ladder, and inspected them with great attention. The second lieutenant and one sailor were richly scarred in the face; the two others also had some smallpox pits, though not very many. By their external appearance and their report, we are fully assured that it was indeed smallpox. According to the testimony of the patients, they were all recovered by 5 August last, and after their recovery, despite being among the crew members who had not yet had this disease, they have remained free of it to this day, proving that the epidemic has ceased. The goods and clothes that the said patients used during their illness were, according to the statement of the captain and officers, thrown overboard immediately after their recovery, and the ship was subsequently sprinkled and washed, smoked with gunpowder and juniper berries, and this was continued virtually every day, so that every precaution was taken to prevent further infection. However, given the misery and destructive circumstances caused by the contagion of the said disease, which has several times made victims of the natives in this corner of the world in the most barbarous manner, one cannot but fear the consequences with the greatest apprehension. The smallpox matter can be preserved for six or more months and still infect. Thus, however cautious one is, the proximity of this vessel or its people is and remains always dangerous. Subject to your Right Honourable and Honourable approval, our advice would be that the said vessel should be sent from here to Robben Island, in order that the disabled persons on board, after their woolen clothes and bedding have been thrown overboard beforehand, and their other goods stored between decks have been washed through with vinegar and rinsed therewith, as well as their bodies, subsequently be brought ashore there in a government launch for their recovery, preventing communication with the inhabitants of the land as much as possible in the beginning, so that the said infectious disease does not plunge the inhabitants of this colony into a sea of misery. Copy We the undersigned, officers and passengers, declare hereby that after we departed on 4 August of the current year from Onrust with a healthy crew of 24 heads and three passengers to sail for the Netherlands, we encountered on the 6th a heavy sea from the South to South-South-East that caused our ship to roll terribly and take on much water. On the 7th we had rain throughout the entire day, falling from a dense and unhealthy sky that we had already observed upon our departure from Onrust. The air, being thick and impure, thus discharged itself by raining for seven consecutive days. This caused us, by the 7th, to already have four sailors lying in their hammocks with a violent fever. On the 8th our surgeon became ill. On the 9th there were already 8 men lying with the fever, on the 12th eleven men, and on the 13th the Captain, First and Second Lieutenant, Surgeon, Boatswain, Sailmaker, Carpenter, and eleven sailors were down with the fever; indeed, one sailor was snatched from us by death, so that there were only three healthy sailors and two boys left on deck who could perform their duties. And when the fever temporarily left Lieutenant Erdrol, he too would crawl above now and then, but as this was of short duration, Mr. King, with the few healthy men, saw fit to manage by carrying small sails at night and by day according to the circumstances of the weather. As in these dreadful circumstances nothing else was to be expected than that the sick would all die (since no medicine could be administered to them, as no one had knowledge thereof, although chicken soup and other things were cooked and given to them daily from our own provisions, and we gave everything that we thought might refresh them), and as we further had to fear that the few healthy ones would also fall ill, in which case the ship and cargo would be left to the mercy of the weather and the wind, we resolved to put in at Mauritius, toward which we set course on the 22nd, and where on the 29th of this month we anchored in the outer roadstead. Copy Memorandum, presented to the Right Honorable Governor, concerning the national depot or the Pepiniere. In compliance with the highly honored order of Your Right Honorable to submit my thoughts on the establishment and dispatch of the Pepiniere, I have the honor to set down the following articles. At the aforementioned Pepiniere, there should be, besides the commander: One competent officer six sergeants six corporals to help manage the administration of that corps, and to train and drill the men. 2½ and non-commissioned officers. The aforementioned officers, being accustomed to the establishment and administration, should remain there permanently. The depot currently being approximately 140 men strong, and according to the plan of the Right Honorable Gentlemen of the Military Commission, one sergeant being placed for every 25 men and one officer for every 100 men, in case of unexpected large increases, all military non-commissioned officers who remain here from the ships could provisionally serve there, and subsequently continue their voyage to the Indies; leaving otherwise to the wiser and more enlightened judgment of Your Right Honorable whether it would not result in many unpleasantries and confusion if all the other military personnel remaining here were placed there, because the artillery battalion, Schur, False Bay, and further outposts must recruit from it. The military personnel belonging to the Pepiniere should remain here for six months, in order to be instructed in the manual of arms and become accustomed to the climate during that time. Their uniform and clothing should be arranged in the least expensive manner, and indeed such that the soldier can pay for it without great hardship and that it is serviceable to them both on land and at sea. Whereas for more than two years already, no separate lists of men have been received with the ships for the Amsterdam Chamber, and by virtue of the directive of the Gentlemen of the High Government of the Indies dated 1 October 1787, none other than those noted on separate lists may be drafted for this government, none from the aforementioned ships remain at the depot, and that is the reason why it increases very slowly; nevertheless, in order to establish a regular dispatch, and to maintain the depot in conformity with the intention of the aforementioned Right Honorable Gentlemen of the Military Commission, the undersigned believes, subject to the respectful correction of wiser counsel, that Your Right Honorable could decide without any hesitation to draft men from vessels that do not bring separate muster rolls, pro rata according to their charters and the condition in which they arrive here, and to place an equal number from the Pepiniere back onto them, while the main capital of the Indies loses nothing thereby, and doing so would keep the Pepiniere in its present standing. The aforementioned men having been here for six months, to send them to the Indies in groups of 20 to 25 men with each ship under the command of the person who commands the military personnel on board, for which purpose a specific muster roll of such persons who are in condition to depart must be provided to the pay office by the Commander of the depot. To send a separate muster roll of these men to the Gentlemen of the High Government of the Indies, so that their Right Honorable Excellencies can have investigated whether these people accustom themselves better to the Indian climate than the other troops arriving there directly from Europe. The dispatch of the Pepiniere provisionally being established on the aforementioned basis, it should be left to the discretion of the Gentlemen of the High Government of the Indies to make such changes therein in due course as their Right Honorable Excellencies might deem fit, while it certainly raises many doubts whether sending them under the command of an officer, and the drafting of all military personnel from the Honorable Company's ships, would carry their highest approval, and whether the Honorable Company would not be burdened with many supernumerary officers, and indeed all the more so because the Gentlemen Mayores in Europe assign the command of the military personnel to a commander or sergeant. According to the capitulation with the Honorable Company, these people must sail outward and homeward without earning wages, and on the other hand enjoy a free kit; to enable them to purchase some small items of sugar, tea, tobacco, etc., for the continuation of their voyage, one month of advance wages could be provided to them. Lastly, the undersigned submits to the consideration of Your Right Honorable whether it would not be useful and serviceable if all the ship's sea kit and bedding that the soldier brings ashore with him were taken over by the non-commissioned officers of the depot and kept until their departure, in order thereby to prevent him from selling it for a small price and being in want of everything upon departure. Hoping hereby, so far as my humble knowledge goes, to have complied with the honored intention of Your Right Honorable, I sign myself with profound respect. In the beginning of To the Right Honorable and Valiant Sir Cornelis Jacob van de Graaff, Governor and Director of the Cape of Good Hope and its Dependencies, etc. etc. etc., together with the Honorable Council of Policy of this Government. Right Honorable and Valiant Sir, Right Honorable Worshipful Sirs, With the utmost reverence, Your Right Honorable and Valiant's and Honorable Worships' very humble servant, Willem Joan van Oosterzee, makes known: That the Petitioner, having been engaged in the year 1787 as a junior merchant in the service of the Honorable Company, and having consequently undertaken the voyage to Batavia with the ship de Geertruyda, arrived back at this corner of the world the past year with the country's warship the Beschermer by highly favorable permission of the High Government of the Indies, both for the restoration of his fragile health and to be able properly to settle certain private affairs. That the Petitioner, notwithstanding that he had already experienced during his first stay in Batavia that the climate there was not at all favorable for his bodily constitution, nevertheless, in the hope that habit would bring about a favorable turn herein, undertook this voyage again in the aforementioned capacity, yet to his great sorrow perceived that neither habit nor adaptation to the country's customs and ways of living could promise him any change for the better, but rather, following the example of so many others, no other prospect could present itself than a speedy end to his young years of life, as also became evident upon the Petitioner's arrival at this corner of the world, where by God's blessing he was able quickly to recover his former health, and has continually enjoyed the same ever since. That the Petitioner, not only for these reasons, but also on account of the alliance which he has contracted with a woman of this Country, has become so attached to the same, that the mere thought of having to go and inhabit once again the climate of Batavia, which is so unbearable for him, plunges him and his wife into the most dreadful thoughts. Reasons why the Petitioner takes the liberty to unbosom these his interests to Your Right Honorable and Valiant and Honorable Worships, not doubting that your paternal goodness, of which so many may justly boast, will not take it amiss of the Petitioner that he, in these his worrisome circumstances, turns to Your Right Honorable and Valiant and Honorable Worships, praying that it may please you to cast an eye of compassion upon the Petitioner's humble request, and to deign to grant that the Petitioner be permitted to perform his service in this Government in such manner as Your Right Honorable and Valiant and Honorable Worships shall deem most convenient for the greatest interest, to which end the Petitioner takes the liberty to offer his humble service, to be employed provisionally in all such services wherein he can least cause prejudice to other servants of this Government, since he finds himself in such circumstances that he can live without lucrative offices, and thus so far completely satisfy his desire that no others who have already performed longer service here than the Petitioner and might have more need of it, should suffer any prejudice through the Petitioner's employment, and he relies solely on Your Right Honorable and Valiant and Honorable Worships' goodness to employ him in this government to the greatest utility and the least expense of the Honorable Company, and thereby to free him from the sad prospect of either having to return to the Indies or spending a part of his best years without being able to be of use to society, or at least without preparing himself to be able to be so at some future time. The undersigned Major and Commander of the National Depot for the Indies has the honor to represent very respectfully to His Excellency: that the Depot being at a strength of 157 men, commissioned staff included, it becomes embarrassing and even onerous for the undersigned to command it as it ought to be, having not a single officer, and the non-commissioned officers being in too small a number. He would burden himself with too great a responsibility if he delayed to observe to His Excellency the Governor that this Depot is becoming too considerable for him to be able alone to acquit himself of maintaining this troop in the order that the military profession requires; he believes himself all the more founded in his repre- sentations, since it is to his knowledge that the gentlemen of the Military Commission have found it prudent and necessary, in order all the better to fulfill the goal of the noble Company with regard to its recruits for the Indies: that as this Depot reaches one hundred men, there ought to be an officer, and in proportion as it increases by this number of one hundred men, there should be one more officer. That one hundred men ought to be divided into four squads of 25, and that in each squad there should be 1 Sergeant, 1 Corporal, and lance-corporal or vice- Corporal. It would also be very essential that there be at this Depot an officer who would perform the duties of Adjutant, so that in case of an absence of the Major or of a serious indisposition, he could directly supervise the con- duct of the non-commissioned officers and soldiers both at drills and at the barracks.
