held yesterday; wanting to insinuate against their Honors as if they had acted in bad faith in their office, considering further the false and lying accusations used by him, blacksmith Jeegers, against the sworn clerk of this council, it was approved to place the said blacksmith van Dilburg provisionally under civil arrest, and to order the officer to institute such action against him as shall be deemed advisable, and likewise during his detention to prosecute the action already commenced against him, the blacksmith. After which, through the sworn clerk St. Rino Lodewyks van der Riet, qualified to manage the affairs of the Landdrost of Stellenbosch and Drakenstein, the following representation was served, accompanied by 10 annexures: To the Honorable, the Respected Johannes Isaak Rhenius, President, together with the further Honorable Members of the Respected Council of Justice of this Government. Shows with due respect the Landdrost of Stellenbosch and Drakenstein, Hendrik Lodewyk Bletterman: That on the 19th of May of the past year 1786, the Right Honorable Governor sent to the memorialist a letter written by the then Field Sergeant in the Hantam, Adriaan van Zijl, addressed to His Right Honor and dated the 13th of April prior, containing a request to be permitted to go shoot elephants and to take some volunteers with him; His Right Honor had told the bearer of that letter that he could not permit this, as His Right Honor believed more opportunity would be given to the marauding Bushmen to cause harm to the inhabitants there, and also did not know whether he, van Zijl, would have to go out with the planned commandos; the memorialist thus expected of him, van Zijl, not to act against the order of the said Governor, all the more so since he had shortly before proposed to the Military Council at Stellenbosch the necessity of a commando to be undertaken against the marauding Bushmen, and had also for that purpose requisitioned a cart, horses, and provisions from the residents living there to fetch powder and lead, and had also received the cart and horses, and did not employ them for that purpose, and was only on the 6th of June thereafter, upon his request made in that regard and grounds submitted, discharged from his post; That the aforesaid van Zijl, at the end of the month of November of the aforesaid year 1786, brought to the notice of the memorialist that he had made an expedition, not, however, to shoot elephants, but only to barter or purchase some oxen for himself, as he also declared to have acquired only 6 to 8 cattle for himself, and that he, van Zijl, having on that occasion been with a nation of the Hottentots called the Coracorse, was requested by them to assist them against a party of marauding Hottentots, but as they had fled into the caves or gorges of the mountains, nothing could be undertaken against them with any success, and that he had found elsewhere on a height some ore resembling graphite dust, intending to give the same to the said Governor, leaving about one ounce with the memorialist; The memorialist having expressed his surprise to him, van Zijl, that he had undertaken the expedition contrary to the order of the said Governor, he undertook to account properly for himself to His Right Honor, with repeated declaration of not having shot any elephants. he was then finally assured at the beginning of the month of August, which person had brought the letter to the Right Honorable Lord Governor and which answer he had received, as well as that he would have brought back a soldier's chest with beads and knives from the Cape, received from the burgher Stadelen, to the said van Zijl; that the relator, upon these obtained reports, on date 13 August and 26 September last, having written to the present field-corporal in the Hantam, Willem Adriaan Nel, to send up the Hottentots and bastard Hottentots who were taken along on that expedition by the aforesaid van Zijl: on the 7th of the past month of October the Hottentot Piet Eland, as well as the bastard Hottentots Paul and Gerrit, came to the relator, saying that one of the bastard Hottentots was kept back by the aforesaid field-corporal Nel, because he, Nel, happened to be a very close relative of the aforesaid van Zijl; that they were also not sent up by him, Nel, but had already long been intending to come, and had only been waiting for an opportunity to lodge their complaint concerning the often-mentioned van Zijl, while out of fear of the aforesaid people, some of the Hottentots who had been along on the hunt had already returned to the Namacqua land: they giving the following account: That they, in the rainy season of the past year, without however being able to determine the positive day or month, alongside the Hottentots Little Piet Eiland, Piet Namacqua, the latter being in hire with the burgher Jan Wieser, the Hottentots Andries and Ruijter, as well as the bastard Hottentots: Paul, Gerrit, Stoffel, and Gerrit Beer, which last-mentioned resided with the above-mentioned van Zyl, but have now already departed for the Namacqua Land, while he, Piet Eiland, and his people have their resting places in the Hantam and now belonged under the command of the aforesaid field-corporal Nel, having been commanded by the aforesaid field-corporal van Zyl to pursue the Bushmen Hottentots, who had for the most part stolen the cattle of the burgher Paul Karstens, with him, both his sons Petrus and Andries van Zijl, alongside the burgher Jan Wieser. That the aforesaid van Zijl, both his mentioned sons, the burgher Jan Wieser, with him, Piet Eland, Piet Namacqua, Andries, Ruijter, and Gerrit Beer, continuing their way, having first passed the Great River and thereafter two Hottentot kraals, had arrived three stages or three days' travel further at a third kraal, where by the just-mentioned van Zyl Hottentots to the number of four hundred and forty were hired and taken along, while he, van Zyl, had occupied himself on the way with shooting hippopotamuses to consume on the journey. had wanted to give some of the stolen cattle, provided they kept everything secret, which they had nonetheless declined, desiring to have three of his breeding cattle, which he had refused to do; and that the aforesaid Wieser had sold a portion of his stolen cattle to the burgher Paul Karsten and a cow to Christiaan Bok. And the aforesaid Hottentots have finally declared that of the Hottentots brought along with him he had kept with him, two of them had however already departed for the Namacque land, while they, on the contrary, had resolved to make all the foregoing known to the Gentlemen, as they were afraid to remain any longer among the Dutch people. As the documents annexed hereto, marked on the back from Letter A to K inclusive, dictate in more detail, all of which the petitioner respectfully requests may be returned to him, the petitioner, after Your Honorable Worships have ruled upon them, in order to be submitted in justification of the petitioner's action ratione officii. That the petitioner ratione officii, under respectful correction, considers that the acts of violence committed in general by the aforesaid former Field Cornet Adriaan van Zyl, together with his sons, the burghers Petrus and Andries van Zyl, as well as the burgher Jan Weeser, and that of Van Zyl in particular, are of such a nature that they are not only contrary to the natural freedom which all Hottentots, and especially those living in peace with the colonists here, have in common with other free peoples, but also and primarily to the repeated orders and edicts issued in that regard by the authorities of the country; and that these acts of violence and the killing of so many innocent people are consequently entirely impermissible and punishable in the highest degree; while both the unavoidable consequences thereof and an infringement upon the said freedom were found, shortly after the establishment of this colony, to be very ruinous and often irreparably harmful, so that on that account the High and Mighty Lords Majores explicitly wrote to the government here, and by diverse edicts it was most strictly enjoined and forbidden by the government to everyone to do any violence or injury to any of the Hottentot nation, of whatever name, on pain that those who make themselves guilty thereof shall be punished as disturbers of the public peace and violators of law and freedom. And it is on the grounds of those laws enacted against the aforesaid acts of violence that the petitioner, under correction, considers that the nature of the crimes committed by the aforesaid Van Zyl together with his two sons and the aforesaid Jan Wiese, in itself, as well as the execution of the sentence to be pronounced in that regard, requires that the petitioner secure the persons of the aforesaid individuals, finding himself consequently under the necessity of requesting the requisite authorization from Your Honorable Worships for this purpose. There appeared in the Council the wife of the currently detained burgher Johannes Smit of Dilburg, who presented the following petition. Honorable Sirs, The undersigned, wife of Jan Smit, most respectfully makes known with all due reverence that to her utmost regret and most bitter grief, the petitioner's aforesaid husband has been placed in civil custody by special order of Your Honors, and is still detained therein, whereby he finds himself prevented from attending to his private affairs, which are of such an extensive nature that the petitioner finds herself unable to oversee them properly, especially his lime kiln, as a result of which all contracted deliveries of lime to both the Honorable Company and other private individuals must come to a standstill, which on the one hand tends toward great inconvenience and on the other hand toward notable loss; that the petitioner, far from doubting, much less examining the reasons that have moved Your Honors hereto, on the contrary trusts that they are in all respects according to merit. Yet, that the petitioner, by virtue of the close relationship she has through marriage with her aforesaid husband, most humbly solicits that this step may be viewed favorably as proceeding from a compassionate heart and particular affection for her aforesaid husband, and thus to permit the petitioner the liberty to address herself favorably through this to Your Honors, and humbly to solicit that what has been committed by the petitioner's aforesaid husband may be considered to have occurred through an excessive thoughtlessness and negligence, and by no means with a malicious intention and design, and thus graciously to release him from his civil arrest, especially in consideration of his weak physical condition, which, worsening from day to day, might hasten his death, albeit under such orders as Your Honors may please to determine. The defendant requests pardon, and says that it had not been his intention to insult the gentlemen of the Commission. The officer persists as before. The defendant once again asks for forgiveness. The Council keeps this matter under advisement for circulation. The said pro interim Fiscal, the Honorable Gabriel Exter, in his official capacity, in a criminal case on the one part, against the headman of Paarden Island, Johan Coenraad Snel, defendant in person on the other part. The Prosecutor in his official capacity submits a written claim accompanied by several annexes, concluding thereupon as at the end. The defendant brings forward nothing against this. The Council, having read the written claim of the officer, and having attended to all that was relevant to the matter and could move Their Honorable Worships, administering justice in the Name and on behalf of the High and Mighty Lords States General of the United Netherlands, condemns the defendant Johan Coenraad Snel to a monetary fine of one hundred rixdollars for the benefit of the Prosecutor in his official capacity, as well as the costs of these proceedings, and denies the further or otherwise made claim and conclusion taken by the officer. The Honorable President gave the Council to understand that the pro interim Fiscal, having requested His Honorable Worship to cause the estate of the burgher Johannes Smit van Dilburg, pursuant to custom after his bodily apprehension, to be inventoried or noted in the presence of commissioner gentlemen, such had been permitted by His Honorable Worship to the said pro interim Fiscal; in which all the members acquiesced. Whereafter, having been brought to the table the proceedings initiated by the aforesaid pro interim Fiscal in his official capacity on and against the aforementioned Smit van Dilburg, and kept under advisement at the last meeting; upon which having been maturely deliberated, and attention having been given to all that was relevant to the matter and could move Their Honorable Worships, so the Council, administering justice in the Name and on behalf of the High and Mighty Lords States General of the United Netherlands, declared the aforesaid Johannes Smit van Delburg to be infamous, condemns the same to a monetary fine of one thousand rixdollars to be distributed according to custom, confines the same for the period of five consecutive years to Robben Island, and after the expiration of the said five years banishes the same for the term of his life from this country and the jurisdiction thereof, with condemnation to all the costs incurred in this trial; as well as to the restitution of such sum of one thousand

Furthermore, having discussed how one ought to deal with the partly inventoried and partly sealed estate of the aforementioned Smit, opinions on this matter differed very strongly, while the Honorable President was of the opinion that this estate, as had always been customary of old, ought to be accepted, sold, and settled by this council, whereas others were again of the opinion that this matter ought to be left in statu quo until the advice of the Honorable Council of Justice in Batavia should have been obtained regarding this; however, because it was firmly maintained that the wife of the aforementioned Smit would request to be separated from her said husband, Mr. Hozak considered that the goods ought to be left under inventory and seal until the wife should make such a request, and in default thereof to leave Smit the power to dispose of his estate himself, which opinion being also embraced by the majority, this matter has therefore remained undecided for the present. ex officio against Johannes Smit of Tilburg acting in a criminal case, a decree of bodily apprehension has been granted by this Court against the said Smit; and thereupon followed the annotation and sealing of the goods of the said Smit: it has been drawn into great doubt by me whether that annotation of the goods of a joint estate between Smit and his wife, whereby that community of property was encumbered and those persons were deprived of the free disposal and administration of their goods, ought indeed to have taken place, and that on this foundation: 1. that in the ordinance concerning the matter of criminal justice in the Netherlands of the year 1570, at article 30, it is established that after proper preliminary investigation, the delinquent being placed in custody or summoned to appear in person, according as the matter shall be disposed, and according to the status of the accused, the goods are at the same time annotated, recorded, and placed into our hands, note well in case of confiscation, whether according to the placarts or otherwise under common law, and so forth; 2. that likewise the subsequent ordinance concerning the general style of proceeding in criminal cases of that same year 1570, after it was prescribed in several preceding articles when and in what cases a criminal apprehension can and ought to take place, finally dictates in clear words at article 5 that whenever the crime or the misdeed shall be such that, according to written laws, customs of the place, or our aforesaid ordinance, confiscation of goods occurs or attaches, attaches, we ordain that alongside the apprehension of persons or the decree of apprehension and the attachment of his body, which decree must also contain an order for the seizure and annotation of goods, the officer and the magistrates shall immediately and at the same time carry out the aforesaid annotation and seizure of goods; 3. that since from the cited articles of the ordinance it clearly appears that the annotation of goods is strictly and clearly limited only to such cases in which the crime entails confiscation of goods, without anything in the least appearing in either the preceding or the following articles from which it would follow that in all occurring cases, without any exception or limitation, the annotation of the delinquent's goods ought to accompany bodily apprehension; and 4. that no other law or ordinance, either general or local, is found which prescribes to the judges whether, upon a bodily apprehension, annotation and seizure of the delinquent's goods must absolutely take place; 5. that this law being absent, and the aforesaid ordinances thus being able and also bound to serve as a rule and guideline in such criminal procedures in decrees of bodily apprehension, from which the intention of the legislator therefore most clearly appears, that no annotation of goods of a delinquent can take place unless the crime is of such a nature that one can proceed to the confiscation of those goods, and that therefore by necessary consequence, no confiscation of goods existing, the annotation thereof cannot follow either; 6. that this being thus established, and there being accepted in addition the placart of Their High Mightinesses of 10 August 1778, introduced in all lands and places of their jurisdiction, whereby the confiscation of goods in all offences, both great and small, none excepted, has been abolished, quashed, and annulled; from this arises my contention that the annotation of goods of persons upon whom bodily apprehension has been granted without any exception and indefinitely, as in the aforesaid case of Johannes Smit, is solely based on an introduced and adopted custom here locally, which appears to be justified only by habit without the authority of a law, all the more since the examples thereof show that in some cases the annotation of goods has occurred, and in similar cases again not. However, acquiescing for this time and agreeing to the annotation made of the goods of the often-mentioned Johannes Smit, but in order to remove all doubt in such matters for the future, it is my opinion that this Court ought to address the local government, presenting the case to them and requesting thereon advice and a decision, so that in the future it may serve as a certain, fixed rule and guideline in the execution of justice. was signed: J. Meanwhile the majority conformed to that sentiment of Mr. Horak, notwithstanding that Mr. Smuts made known his utmost astonishment that Mr. Horak, along with all the members in the previous meeting having consented to the inventory made of the estate of the said Smid, nevertheless now seemed again to reject that inventory, or at least to call the same into question, without deciding the main matter, namely the actual acceptance of this estate as being a consequence thereof. And the minority, having joined the side of the Honorable President, was fully of the sentiment that the estate of the aforesaid Smit ought to be accepted by this Council without any hesitation, liquidated, and subsequently divided between him, Smit, and his wife; adducing as reasons for this position that not only the examples thereof available in such great numbers at the Secretariat of Justice, but even the still so very recent case of Valentijn van Dappoer, banished to Robben Island (who, just like the now-sentenced Smit, had left a wife behind locally), demonstrated most clearly that it has always, and beyond contradiction by anyone, been a constant custom that the estates of those persons who had undergone a corporal punishment, under which banishment is included, were accepted by the Council of Justice. That it moreover appeared from a certain resolution taken by the High Indian Government on 6 March 1752 that Their High Excellencies operate under the firm assumption that always and in all cases the estates of the delinquents prosecuted before this Council were also immediately inventoried and accepted for settlement by the same Council, whereby was taken into particular consideration the passage in the said resolution: notwithstanding it was consistent with equity that the judge who has the disposition over a criminal prisoner at the same time also possesses the disposition over his seized assets: where Their High Excellencies seemed to declare this position of theirs in plain words. To which was further added the resolution taken by the Honorable Political Council of this Castle dated 12 October 1762 on the occasion of the decision of the dispute between the Council of Justice and the Orphan Chamber here concerning the estate of a certain Michiel Zwaan, reading among other things verbatim: that in order to prevent all disputes that might arise again upon the occurrence of similar cases, it is understood that whenever henceforth anyone should happen to pass away who, by the commission of any criminal offense, has made his person subject to the court, his estate shall then also be administered by the Council of Justice; from which the Honorable President along with the minority, arguing consequently, were confirmed all the more in their opinion that, since it was thus decreed and determined by a Political Council resolution that the estate of anyone who had merely made himself subject to the court, without any mention being made therein of prior incarceration, much less condemnation, must be accepted by the Council of Justice, with all the more reason the estate of Smit van Dilburg now in question ought to be administered by the aforesaid Council, as there was among other things still actually found in the same a sum of one thousand guilders besides the interest, of which he, Smit, had taken possession in a fraudulent manner from the deceased former Burgher Captain Jan de Waal, and from which this latest action of the office of the fiscal instituted against him, Smit, arose. That furthermore the said custom had been observed up to the present date without any interruption, notwithstanding the abolition of the confiscation of goods alleged by the majority, published in the year 1778; without it appearing anywhere, however, that by that abolition the courts of justice were deprived of or prohibited from the settlement and administration of the estates of their delinquents, which naturally had to have the consequence that this remained on the old footing, since indeed in this country no alteration whatsoever regarding that had taken place. was of the opinion that an ancient custom having become law through length of time could not be altered so lightly, much less completely abrogated, so long as no notable incongruities were discovered therein, which one could certainly not maintain resided in this ancient custom designated by the majority as a local established and adopted usage; considering that the settlement of an estate by a board such as that of this council appeared infinitely more appropriate in the present case than that such an estate should be entrusted into the hands of private persons, which latter method of settlement experience showed to be far more oppressive and costly for an estate than a judicial settlement; with the further addition that, leaving all the above cited aside, their sentiment must nevertheless prevail toward the judicial assumption and sale of the estates of those who were criminally placed in custody and sentenced as such, whether by corporal punishment or banishment; adducing thereto the following reasons: 1: That such a condemned person, being civilly dead, can consequently in no way settle his own estate nor grant a power of attorney to those through whom he would wish to have his estate settled, considering that a power of attorney given by an infamous person is ipso jure null and of no value, and that the wife of such a person, not being separated from her husband, also has no personam standi in judicio, and thus, without being properly assisted, cannot grant a power of attorney. 2: That through judicial settlement, which takes place after a proper inventory, all malpractices that might be committed are prevented, and thus the condemned person cannot pretend that his estate was diminished through arbitrary management. 3: That the sale of such an estate ought also to be conducted by the judge, since out of it the fraudulently obtained benefits, as well as the costs of all proceedings caused by the crime of the condemned person, whether in civil or criminal matters, must be satisfied with all the interest resulting therefrom. 4: That it would tend to the disrespect of the judge if the estate of a criminally condemned person were permitted to be sold by a private person at his discretion, whereas, on the contrary, if the estate is sold by the sequestrator in the presence of commissioners, who moreover must report their actions to the full Council of Justice, the wife of such a condemned person cannot bring any complaints against it with valid reasons, being assured that no prejudice is done to her. 5: That, besides it being very improper that a private person should be favored over the sequestrator, such a private attorney would directly encroach upon the office of the sequestrator. And finally 6: That before the year 1778, when confiscation was abolished, even in such cases where confiscation was not proceeded with, the estates of delinquents were assumed by the Council of Justice; and whenever these were found not to be insolvent, the remainder of the funds was refunded to the delinquent or his heirs; of which a multitude of examples are at hand. This having continued in the same manner after the abolition of confiscation, the president was of the opinion that the abolition of confiscation by no means impeded the judicial settlement of the estates of delinquents. While Mr. van Reede van Oudtshoorn further declared for his own part that he did not wish to be responsible for the consequences if the estate of the aforesaid smith was not assumed by this council, for the wife of the said smith might happen to pass away during his confinement on Robben Island, and he or she might leave foreign heirs, who could then hold the Council of Justice here accountable for their inheritance portion, in which case one would clearly and distinctly perceive the incongruity that would take place if the estate were in the hands of private persons who could have acted with it at their discretion. not whether Your Honorable Worships will be pleased to rest assured that the aforementioned slave of the petitioner was never mistreated by the petitioner's wife in such manner as may perhaps be presupposed by the Officer prosecuting ex officio, but that, even if the said slave is capable of displaying any marks from which one could or might wish to deduce an improper chastisement, the same at any rate and in all cases cannot be directly attributed to the petitioner's wife, since one cannot know in what manner the said slave may have obtained those marks of mistreatment, of which—being a cunning rascal—he currently seeks to make use in order to bring his master or mistress, were it possible, under suspicion before their authorities. The petitioner therefore takes the liberty of submitting the aforementioned reasons beforehand for the consideration of Your Honorable Worships, and therefore considers, on the basis thereof, that he could very properly await the proceedings that are about to be undertaken by the officer on and against the wife of the petitioner. However, since the petitioner is a resident of an outlying district whose place lies ten to twelve days from here, and consequently the pursuit of all such proceedings with an officer, which in themselves are always odious, could significantly prejudice the petitioner's business affairs in the countryside, and moreover the petitioner's wife is of such a corpulent bodily constitution that she is judged utterly incapable of undertaking such a distant journey hither, especially if the same were to have to take place more than once; the petitioner has therefore thought it best to turn hereby to Your Honorable Worships with a most humble request that Your Honorable Worships, in consideration of what has been deduced hereinbefore and to prevent unavoidable detriment to the petitioner and his household, may be pleased to declare this matter civil and composable; while Your Honorable Worships may further have the goodness to return the petitioner's said slave April to him. But in case the court should grant the composition, the officer requested that the slave in question be judicially sold for the benefit of the petitioner, on condition that the same should never ever be permitted to come again under the power of him, the petitioner, or any of his family, and that he might further be recommended to instruct his wife on behalf of the court to beware in the future of such excesses toward her slaves, on pain of heavier correction.
