the widow de Plooij cum suis in the torture chamber had been presented verbally to your Right Honourable and your Right Honourable had been asked for your most wise counsel, primarily concerning this matter whether your Right Honourables deemed it necessary that one should proceed with the claim for death upon the confession, and a pair of buckles that one has in hand as a part of the corpus delicti, or whether the officer representing should continue to wait with the producing of his claim, until such time as a further corpus delicti had been discovered, and if one might proceed to the last part of his proposition, that then a commission might be appointed for the tracking down of the stolen goods; that your Right Honourable was then pleased to hold that request in advice, however upon a petition presented by the officer prosecutor at a further meeting it was approved by your Right Honourable to supersede the claim in the principal case until such time as the stolen goods should have been discovered, appointing to that end a commission of the Landdrost and Heemraden of Swellendam, who were then also duly written to by order of your Right Honourable pursuant to the resolution taken. Yet since the remote distance of that drosdy and the difficulty of putting such a resolution into execution in this rainy season, has given the officer representing, by reason of his office, the reasonable fear that some months might pass before one could be informed of the outcome of the commission, and a prolonged detention might be the cause of not only harming the health but also causing the death of all the accomplices, whereby the execution which necessarily ought to be applied to such a crime would be rendered illusory; as experience has already shown in the person of Hendrik de Plooij as the principal accomplice, and that of Stijntje de Plooij, the former of whom is already dead and the latter has become very ill. Reasons why the officer representing takes the liberty to turn to your Right Honourable, humbly requesting that this and that may be taken into serious consideration by your Right Honourable, and to instruct the officer representing with such orders as shall be found appropriate according to the nature of the case; the officer representing declaring to be ready, in case it should be deemed necessary by your Right Honourable, to make the principal claim verbally. Which having been read and taken into consideration, that the remainder of the corpus delicti, notwithstanding the commission for the tracing thereof was decreed, will probably not be discovered, and the prisoners meanwhile here in their custody might, one after the other, through a longer delay, come to die unpunished, the Council has directed the officer to make a written claim in the principal case on that part of the corpus delicti which is presently evident. Hereafter were brought to the table the documents circulated and read from the Landdrost of Zwellendam, against the Hottentot Dirk; thus the Council, having paid careful attention to all that merited any reflection and could move their Right Honourables, Administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, has condemned the prisoner Dirk, as their Right Honourables condemn the same hereby, to be taken to the place where criminal sentences are customarily executed here, and there, being delivered to the executioner, to be punished with the rope at the gallows until death ensues; furthermore, his dead body being dragged to the outer place of execution and there hanged again on the gallows, thus to remain until consumed by the air and the birds of heaven; with condemnation in all the costs and expenses of justice, and rejection of the further or otherwise made claim and taken conclusion of the officer. Furthermore, deliberations having also taken place concerning the conduct held in this matter by the burgher Jacob van Reenen, as being entirely contrary to good order and frustrating justice in the proper punishment of crimes, as well as withdrawing from it the vagabonds and evildoers falling under its jurisdiction, the Council has placed this case in the hands of the Landdrost of Zwellendam, to the end of instituting such action against the said van Reenen as shall be deemed advisable. Heesen Dragoon having been exhibited, the council, having considered everything that merited reflection and could move their Honorable Worships, administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, condemned the prisoner Heesen Dragoon to be taken to the place where criminal sentences are customarily executed here, and there the first prisoner Kees to be delivered to the executioner, and having been exposed under the gallows with a rope around his neck, further to be tied to a post, severely flogged with rods on his bare back and branded, further to be confined for the term of his life to Robben Island, in order to labor there in chains on the Honorable Company's public works, and the second prisoner Dragoon to witness this execution and, having been flogged by the Caffers, to be riveted into chains, in order to labor therein for the period of three consecutive years on the public works at the drostdy of Graaff-Reinet; with condemnation of both prisoners in the costs and expenses of justice and dismissal of the further or other claim and conclusion submitted by the officer. While finally there was brought to the table the trial instituted by the pro-interim fiscal, the Honorable Gabriel Exter, against the person of Louis Hernandez, concerning which, everything that could be taken into consideration also having been ripely considered, their Honorable Worships, administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, condemned the prisoner Louis Hernandez to be taken to the place where criminal sentences are customarily executed here and, having been delivered there to the executioners, to be punished with the rope on the gallows until death follows, further his dead body to be taken and buried there, with condemnation of the prisoner in all the costs and expenses of justice. Thursday the 23 August 1787:— In the forenoon, present the Honorable Johannes Isaak Rhenius, president, and all the Members, except Messrs. van Echten and Maasdorp, the first due to indisposition and the latter due to occupation:— The Landdrost of Stellenbosch and Drakenstein, Hendrik Lodewijk Bletterman, ex officio Plaintiff, on the one part, against the Commandant of the Swellendam invalids, Jacob van Reenen Junior, Defendant, to prove to the satisfaction of the court that he has prosecuted in Batavia the appeal interposed by him against a certain sentence pronounced on the roll by the aforementioned Council of Justice in the case of the Heer Ryneveld, ex officio, against him, the Defendant, initiated in a case of advice, and in default thereof, pursuant to the very general order of the superiors dated 15 June 1718, to hear requested the declaration of desertion of the aforesaid appeal, with costs. The sworn Clerk of this council, qualified to act ex officio in the matters of the Landdrost of Stellenbosch, enters his claim with production of the sentence passed against the Defendant, as in the presentation. The Defendant produces a letter written to him by Messrs. Schults and de Jong in Batavia, whereby he shows that the same serves in reply to a letter written by him, the Defendant, to those gentlemen to appoint them for the prosecution of his appeal before the Honorable Council of Justice, but that the power of attorney was not accepted by the said gentlemen for the reasons stated therein. The ex officio Plaintiff says that the Defendant has had enough time to appoint other agents, and that the former Landdrost, the Heer Ryneveld, during his lifetime also qualified the advocate fiscal in Batavia to defend this case. The Defendant says that, after receiving the said letter, he again requested the said Messrs. Schultz and de Jong to be willing to serve him, but that he has not yet received an answer thereto, the draft of which letter sent by him is with his attorney, which he can produce immediately if so required. The Council holds this case in advice until the next court day and orders the Defendant then to submit further proof that he has properly prosecuted his appeal in Batavia. After which the acting fiscal, the Honorable Gabriel Exter, presented the following memorial: To the Honorable President and Council of Justice of this government. Honorable President and Gentlemen. The undersigned fiscal shows with due respect: That, following the inquests and other investigations gathered before commissioner gentlemen from this Honorable Council, very strong and grounded presumptions and suspicions have come to fall upon the 3rd Surgeon of the Honorable Company's hospital, Leendert Gijzendorp, that he made himself guilty of the murder and burglary committed on the 23rd of the past month of June at the house of the mandoor of the New Hospital, Willem Nieuwenhuijzen; and, the said Gijzendorp having been taken into custody by virtue of your Honors' decree granted for that purpose, the ex officio memorialist has consequently, according to custom, had him interrogated several times on articles drawn up for that purpose, confronted with several deponents, and had the depositions re-read, yet with the unexpected result that the prisoner continues absolutely to deny both deeds. That, although considering all the circumstances, during the further interrogations these same presumptions are not in the least diminished, but are rather increased by the many contradictions and imprecise answers; so that, the corpus delicti being established by very many converging circumstantial proofs and arguments, the prisoner must be held essentially guilty; and on that account, in order to receive the punishment ordained for this or similar crimes, one ought to proceed to a sharper examination; the ex officio memorialist, under correction, nevertheless believes he must primarily consider: That, according to the general rule and the concept of criminal procedures, torture, as a means both perilous and violent to bring the accused to confession, is to be employed with the greatest circumspection, and not otherwise than when the proofs happen to be so clear and decisive that, on the foundation thereof, without the confession of the prisoner, a claim could be made against him in ordinary proceedings and he could consequently be condemned; which qualification or similar direct proofs are entirely lacking in the case at hand. For, notwithstanding that the boy is said to have been standing at the door as late as 4 o'clock, and also that the prisoner entered the house in that same minute, 4 minutes past 4 o'clock, when the deponent van Lutserburg came out of it and, according to his witness, nothing had been broken open; and that the prisoner denies the weightier circumstances which mainly incriminate him, places them at other times, or says he paid no heed to them for the reason that he was a little intoxicated, whereas he remembered lesser and indifferent things; these and other circumstances, which together with the nature of the boy's wounding yield very strong indications against the prisoner and declare him very likely to be guilty, cannot and may not, however, be regarded and held as such proofs as are sufficient in ordinary proceedings to make a formal claim and proceed to condemnation, because, taken directly and strictly, they do not by far constitute even a half proof. With the greatest respect, Your Honorable Worships' very humble servant, the burgher fire master here, Arend van Wiellig, makes known That at the beginning of the past year a certain slave by the name of Achillis of Ternate, at that time belonging to the farmer Meld van der Spuij, was condemned by Your Honorable Worships on account of the accidental manslaughter of his comrade to be, after prior scourging and branding, shackled in chains for the period of two consecutive years and thus returned to his master. That the petitioner, having the utmost compassion for the innocence of that boy and the misfortune whereby, due to the extreme provocation of his adversary, he struck a single blow without repeating it, and the remorse and sorrow he showed over the offense committed by him, therefore resolved to purchase the said boy from the aforesaid Van der Spuij. That during the time he has lived with the petitioner, this boy has always shown the utmost proof of his vigilance, zeal, and fidelity, and has also continually requested the petitioner for release from those burdensome and tedious fetters in which he has been bound for, according to estimation, well over a year. The following request: The Right Honourable Plaintiff, before making his claim, requests that the defendants in person provisionally shall be incarcerated, so that when this case shall be terminated by final judgment by Your Honourable Worships, the sentence to be passed therein shall not be rendered illusory by the absence of the defendants, and even the more so because the Right Honourable Plaintiff maintains that from the multiple depositions given by irreproachable witnesses it is evident that the defendants have made themselves guilty of an infringement on civil liberties and violated the right of the high authority by using the name of the one who represents the sovereign in the countryside, upon which according to the letter of the law a corporal punishment is established, and which therefore can be executed on nothing other than the persons of the defendants; furthermore that the defendants in person may be ordered to answer to such interrogatories as shall be put to them to that end by the Right Honourable Plaintiff before commissioners from this Honourable and Worshipful Council. The citizens Johannes Andries Holtshausen the younger and Pieter Lombart Christoffelz, defendants in person on the other side, to hear such criminal claim and conclusion or request or requests as the Right Honourable Plaintiff shall make and take upon and against them, the defendants in person, to answer thereto and to proceed further as by law. The defendants say they did not use the name of the Landdrost. That these proceedings to be initiated by the respected memorialist against the said van Reenen, in conformity with the instructions on the manner of proceeding and the principal Doctors of Law, strictly must be begun with bodily apprehension, or at least a summons in person; however, the respected memorialist is unauthorized for the one as well as the other without Your Honors' appointment. Salemon van Echten and Johannes Smuts, both by occupation and indisposition. Whereby the Honorable President made known to the convened members that His Honor had arranged this meeting expressly at the request of the burgher Cornet at Zwellendam, Douwe Gerbrand Stein, who had been with His Honor this morning to present a request concerning his brother Jacobus Stein, who was placed in detention the day before yesterday, and that His Honor had ordered that man to appear before the council chamber to make his request; whereupon it was approved to have the said Stein enter, and having entered, the following memorial was exhibited by him. Gives to know your Honorable Worships' very humble servant, the citizen Jacobus Steen, proceeding as according to law: That he, the petitioner, having been sued by and on behalf of the Landdrost of the Colony of Graaff-Reinet before this Noble Honorable Council of Justice in a case of alleged adultery committed with the wife of the citizen Johannes Adam Reineke, was subsequently, pursuant to your Honorable Worships' interlocutory disposition, heard before commissioners from this Noble Honorable Council, and answered such articles as were presented to him on behalf of the aforesaid Landdrost. That although he, the petitioner, did confess at the said interrogation that he had had carnal conversation with the aforesaid wife of Reineke, he, the petitioner, was nevertheless at that time, when making the said answers, overcome by fear and dread, and was by no means mindful of that which he ought to have put forward for his notorious innocence. And since it has already pleased your Honorable Worships (as he presumes, in view of the weak evidence in this matter and the denial of the aforesaid wife of Reineke) to release the petitioner from his detention on bail, the petitioner now sees himself provided with the opportunity to submit to your Honorable Worships such circumstances upon which he, the petitioner, can rest assured that your Honorable Worships, in accordance with your known equity, will wish to reflect favorably regarding the petitioner, who finds himself in the most unhappy situation. The petitioner therefore takes the liberty respectfully to submit for your Honorable Worships' consideration that, according to the opinion of the most renowned Doctors of Law who have treated upon such a delicate subject as adultery, for the imposition of the punishment merited by the laws, there is required not only complete proof from irreproachable witnesses, but also the confession both of the adulterer and of the person with whom the adultery is said to have been committed; and that if one of these requisites is lacking, the law maintains that the fact is not fully proven. Now, when one puts the case in question to the test of this well-known legal doctrine, one will quickly discover that, regarding the evidence or witnesses in this matter, there is a very great difference from those undeniable depositions which, in the subject case, are required for proceeding in matters of adultery; since in the entire lawsuit not a single testimony is to be found wherein it is decisively stated that the petitioner was seen committing unchastity with the aforesaid female person. On the contrary: the evidence submitted on the part of the officer consists solely of a statement by the wife of the petitioner, which according to law is just as reproachable as the statements of those who pretend to have heard the commission of the aforesaid act by the petitioner from the mouth of the petitioner's wife. If one examines, Noble Honorable Sirs, the further requisites in the subject case, one will find that, besides the aforesaid defect, there is still lacking the full-throated confession of the wife of Reineke, the said woman having candidly declared before the commissioners that the claim of having had carnal conversation with the petitioner is untrue. The petitioner, it is true, as has been said hereinbefore, confessed before the commissioners that he had carnally mingled with the aforesaid female person; but he begs your Honorable Worships to be pleased to take into consideration that his wife has already for some years suffered from an ailment whereby the cohabitation of marital duties was absolutely prevented, which has had the disastrous consequence for the petitioner (who is still very young and thus lives in those years in which one can so hardly resist the instincts of nature peculiar to every mortal), that, having fallen into the uttermost melancholy, he took a wrong recourse and now and then indulged excessively in drink, on which occasions he, the petitioner, certainly his enflamed desire for the aforesaid female person not

could not conceal: that the petitioner, having thus believed that at those moments when he was bewitched by drink he might possibly have satisfied his animal lusts with the aforesaid female person, and therefore, in order to proceed in all things without concealment, made the aforesaid confession before the gentleman commissioners, which confession he now solemnly declares was by no means made out of a certain consciousness of the act, but solely out of fear and dread and in the belief that he might possibly in his aforementioned drunkenness have come to that deed; but that the conversation which the deponent had believed as aforesaid to have held with the wife of Beineke being entirely denied by the said wife of Reineke in her answer: the petitioner will therefore now be able to refer to the aforesaid answers with very good reason, and thus on the foundation of what is alleged above could very easily await the proceedings which the aforesaid landdrost would wish to prosecute against the petitioner. But since the said proceedings have been instituted extraordinarily and the pursuits thereof generally cause much public scandal, so that although the same could bring little prejudice to the petitioner in principle, they nevertheless have hateful consequences; and could be detrimental to the petitioner, who lives far inland, in his household existence. Whereas recently, during the demolition of a wall in the envelopes of the Castle by the slaves working there, some so-called Spanish reals were found while digging, and as far as they could be obtained from the finders through possible investigation, they were placed into the hands of the undersigned and subsequently, with the foreknowledge of the Lord President of your Honourable assembly, given into sequestration to the secretary of the council; the undersigned, having moral certainty that these accidentally found piasters belonged to the chest of money containing the aforementioned species of coin that went missing some time ago from the treasury in this Castle, considered it necessary, pursuant to the pro tempore performance of the office of fiscal requested of him and thus ex officio, to propose to the Right Honourable Lord Governor and the Honourable Council of Policy, and to request that this amount, as money belonging without any doubt to the Honourable Company, be received into the Honourable Company's treasury; And whereas the undersigned, by these newly arising circumstances, has been strengthened not a little in his suspicions with regard to the three men who, on account of that missing money, were tortured on violent suspicions and are still detained on Robben Island, although not sufficiently grounded to be able to act de novo pursuant to the intention of the interlocutory sentence pronounced by your Honours; and as according to that same assertion the suspicions are equally certain that the thirty pieces of American coin, according to the confession of one of the three aforementioned detainees, namely Johannes Koningswinter, buried by him before his arrest in one of the privies inside the Castle, but found by a certain soldier of the battalion stationed at the aforesaid Castle and delivered into the hands of the undersigned and subsequently surrendered for safekeeping to the aforementioned Secretary of your Honours, also belong to that missing chest; the undersigned has likewise judged it his duty to submit for the consideration of your Honours whether some silver and gold found with the said Koningswinter, consisting of 2 pieces of silver pocket watches, 2 pairs of ditto buckles, a silver pocket clasp, and a pair of gold sleeve buttons found with the said Koningswinter, and according to his confession likewise purchased with his alleged found Spanish reals, should be sold at public auction, and the proceeds thereof, added to the aforesaid small sum of 30 pieces of that same coin, be transferred, with the approval of the said Lord Governor and the Honourable Political Council, into the Honourable Company's treasury. The undersigned Jacob van Reenen gives to know with the requisite respect in the humblest manner How the petitioner has learned that on the 6th of September last, by the merchant and Landdrost at Zwellendam, the gentleman Constant van Nult Onkruydt, an ex officio memorial was submitted, and whereupon by Your Honors to the Prosecutor ex officio permission was granted to have the petitioner summoned in person before this Honorable Court of Justice, in order to hear such criminal claim and conclusion, or request or requests, as the Prosecutor ex officio shall see fit to make and take against him, the petitioner, and to answer thereto, on account of an alleged crime by advice given to and the releasing of the executed Hottentot Dirk. Concerning which reflection alone the petitioner feels a cold chill in his heart, to be made known to Your Honors as such a person, and nothing would be more abominable to the conscience of the petitioner than to help advance a person in his evil and to deliver him from his well-deserved punishment by his help and assistance, and thus to be a cause that such a villain would proceed to further evil and heinous deeds; the petitioner trusts to have shown the contrary to Your Honors on the report of the commissioners concerning a murder committed on the wife of the burgher B: Rotman, in order to search out and capture the perpetrators of the said heinous deed. And in order to show his innocence in this accused crime, the petitioner shall take the liberty to submit this annexed declaration to Your Honors, which, being drawn up according to the truth, as the matter with the said Hottentot occurred, not in his last committed misdeed, but in a previous, much lesser offense, to the reading of which the petitioner, for the sake of brevity, respectfully refers. From which Your Honors will perceive that the alleged action of the Prosecutor ex officio, being far-fetched, has taken its origin from a wrong report. Trusting that Your Honors will find, after the same has been considered with Your Honors' customary exactitude, that the petitioner has completely rendered himself guilty of no civil, much less of a criminal offense. For, considering with attention the evidence exhibited before Your Honors by the Prosecutor ex officio to maintain his alleged action, will it according to the law merit enough credit to sue the petitioner in a civil procedure, much less to bring a criminal action against him. For shall a murderer, a rogue experienced for a long time, merit so much credit with the judge so as to sue someone criminally? The petitioner trusts that such is contrary in jurisprudence to all written laws. Thursday the 4th of October 1787. In the forenoon, present the Honorable Johannes Isaak Rhenius, President, and all the members. The interim Fiscal, Gabriel Exter, ratione officii, plaintiff on the one side, against the burgher Johannes Joachimus Theron, defendant in person on the other side. The defendant in person, for the purging of his default, states that the plaintiff ratione officii had first caused him to be summoned for the 6th of September, but that he had requested to be allowed to appear one court day later, in accordance with which the plaintiff ratione officii had consented thereto, which he, the defendant, declares had completely slipped his mind. The Court accepts the purging of default, provided that it shall take effect and the defendant shall refund the costs. To purge his first default and further, on the principal matter, to hear such criminal demand and conclusion, or request or requests, as the plaintiff ratione officii, serving on this day, shall think fit to make and take against him. The plaintiff ratione officii serves a written demand, furnished with 2 annexes, concluding therewith as at the end thereof. The defendant in person requests, since his circumstances do not allow him to litigate, that this case may be declared civil and composable. The plaintiff ratione officii refers to his demand, and further leaves this case to the judgment of the Court. The Court, after due consideration of the matter, administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, condemns the defendant Johannes Joachimus Theron to be placed on water and bread for the period of eight days, with further condemnation in all the costs incurred in this matter. The defendant, having heard this sentence pronounced, most humbly requested that it might please the Court to mitigate the same, for the reason that his wife was heavily pregnant and he was losing a considerable amount in his livelihood; with the further addition that, in case the Court should be pleased to take a favorable decision on this his petition, he would in future carefully guard against such improper conduct. Which request having been deliberated upon, it was approved and understood not to be able to enter into the same, wherefore the Court persisted in its taken decision. With all due respect, your Honorable Worships' very humble servant, the undersigned burgheress Maria Magdalena Pieterse, wife of the burgher Adam Johannes Reineke, makes known: How she, the petitioner, having arrived in the month of January of the past year at the Colony of Graaff-Reinet, was there, before and prior to being questioned, although under protest of her lawful husband, immediately arrested, guarded by a watch, and subsequently, by the Landdrost of the aforementioned Colony, Mr. Maurits Herman Otto Woeke, ratione officii, unexpectedly examined solely on the accusation of the burgher Pieter Lombard, who is a brother-in-law of the wife of the burgher Jacobus Stein and related to him by affinity, regarding the alleged crime of adultery or committed double adultery, as well as on the attempt of poisoning, and this solely on the notice of the aforementioned wife of the said Stein. That she, the petitioner, by such treatment, through fear and out of the weakness of her sex, as can well be imagined, was consternated and troubled in her mind, so much so that she, as is said, allegedly confessed to having committed the aforementioned crime of adultery. Whereupon she, the petitioner, was summoned under date of the 28th of April of the past year, as is stated in the citation served on her. When she, the petitioner, under date of the 6th of September last past, having appeared in person in obedience to your Honorable Worships, the plaintiff ratione officii in his official capacity, as she the petitioner trusts, serving on that day, requested and obtained from your Honorable Worships that she, the petitioner, regarding the aforementioned matter, should be heard on interrogatories by the words "believes" or "not." In consequence of which she, the petitioner, having also been meticulously questioned several times and confronted, now out of detention and in her certain innocence, has persisted in the negative. Yet, although the aforesaid Jacobus Stein confessed and his aforementioned wife so shamelessly as untruthfully dared to claim before the Honorable Commissioners from this formidable bench that she had kept watch, possibly resulting therefrom that they, after having lived for a considerable time in disagreements in a completely improper manner in their marriage, of which the principal plaintiff ratione officii could pretend no ignorance, devised extreme means to dissolve the same by that way. In a matter of such gravity, in which the petitioner, if she were to succumb—which she hopes will not happen—would be rendered infamous, which would not only cause her and her entire family much heartbreak, but would wound her very soul and bring eternal shame upon her posterity. The petitioner could not rest without most respectfully reminding your Honorable Worships that, according to the ordinance or style of proceeding in criminal cases dated 9 July 1570, Article 46, it is decreed: That in all stages of legal proceedings, up to, note well, the execution of the sentence, everything that may serve to exonerate the accused shall be received. To which end the petitioner will reverently have your Honorable Worships observe that the crime of adultery, according to the general fundamental principles of the legal scholars, must clearly and convincingly be proven to have been committed, either by credible witnesses testifying not from hearsay, but from personal sight and certain knowledge, or from the outcome, or by any other means of proof admissible in law. And that at least full proof or complete evidence is required, namely in people of conduct suspected in this regard, which is solidly proven in this respect by the criminalist Julius Clarus, Sententiarum, Book 5, Final Question 10, Number 2, with which accords the reading of Mascardus, De Probationibus, Conclusion 64, Number 13, stating there among other things: Adulterium non probari confessione adulterae vel adulteri; Consequently, the rules of prudence suggest that a simple confession, much less one extorted through fear instilled by imprisonment and caused by the weakness of the female sex, without being supported by valid proofs, proves nothing against anyone. Wherefore the petitioner, doing that which ought to have been done by her in the first instance, turns with the utmost respect to your Honorable Worships, with a very humble and submissive request that it may please your Honorable Worships to provisionally discharge the petitioner from personal appearance and to admit her to be represented by procurators, in order to maintain the petitioner's innocence through the ordinary channels and to seek the proper evidence for that purpose, and to grant the petitioner a copy of the claim and all such documents with which the Officer, the Plaintiff in his official capacity, would wish to proceed against the petitioner in court. The undersigned Alida Adriana Theron, born Mostert, gives most humbly to know with the requisite respect for Your Honors, how the petitioner finds herself in the most oppressive and sad circumstances, as she, being heavily pregnant and living in a household of nearly twenty slaves, cannot manage them, and on Thursday the fourth of this month it was reported that it has pleased Your Honors to incarcerate the petitioner's husband Johannes Joachimus Theron on charges brought by the Honorable Fiscal pro interim concerning an alleged crime that the petitioner's husband is said to have committed against a servant of Justice, and to place him on water and bread for the period of eight days. Far be it from the petitioner to seek to argue that her said husband is not guilty in whole or in part of the alleged crime, since owing to her absence at the time it is unknown to her how the matter of which her husband is accused took place. Yet, being well aware that crimes ought to be punished, but given the oppressive circumstances in which the petitioner finds herself, and being conscious of the noble sentiment residing in the hearts of Your Honors, she takes the liberty of turning to Your Honors, because already on the aforementioned Thursday evening an insurrection took place among her slaves (since they find themselves without a master) and the petitioner's work of molding bricks and hauling clay must entirely stand still in the meantime, which must cause enormous damage and loss for her, to which is now further added that her said husband has a corpulent body and a very congested chest, whereby the petitioner has nothing but bitter consequences to expect, and her husband already lies ill. A petition was presented of the following content. To the Right Honorable Lord Johannes Isaak Plonius President, together with the Honorable Members of the Honorable Council of Justice of this Government. Right Honorable Lord and Honorable Lords With deepest respect, Christina Maasdorp, widow of the late former Burgher Captain at Stellenbosch Nicolaas Vlock, the burgher Hendrik Vlock, as well as the former burgher Adjutant David Malan, respectfully make known: That the petitioners have, to their deep regret, been informed that their fellow burgher Christiaan Vlok, son of the first, brother of the second, and brother-in-law of the third petitioner, did not hesitate to violate the arrest placed by Your Right Honorable on a wagon loaded with grain belonging to him, Vlock, which had the consequence that he was summoned by the Landdrost of Stellenbosch and Drakenstein to hear the officer's claim, and to which summons served the same is said to have replied that he would not appear even if one wanted to drag him to the gallows; a conduct which the petitioners cannot deny to be entirely contrary to the duties of an honorable burgher man, while they nevertheless trust that Your Right Honorable will of yourselves be able to deduce from such conduct that it does not correspond with that of a person possessing sound mind and judgment, as appears from the answer given by him to the petitioners that he did not know that he had ever made himself guilty of either the one or the other, and which the petitioners can attribute to nothing other than the sad condition, and one painful to the petitioners, in which he finds himself, being afflicted with epilepsy to such an extent that the third petitioner, who took in and accepted him, Vlock, into his home in consideration thereof and of the destitute state into which he has fallen as a result, currently by no means dares to trust letting him go away from home anywhere alone, so that the petitioners presume the least announcement of a punishment to be imposed on him would hasten his death, and the petitioners also trust that the punishment, under correction, will be pardonable in consideration of the condition in which he finds himself. Wherefore the petitioners take the liberty to turn to Your Right Honorable, humbly requesting: that it may be your favorable pleasure graciously to forgive the actions committed by their aforementioned son, brother, and brother-in-law Christiaan Vlok on the aforementioned grounds, and to cause the proceedings instituted by the Landdrost of Stellenbosch and Drakenstein to be ceased, so that the petitioners jointly, and the first petitioner in particular in her very advanced age, may remain spared from all further rightful grief of heart. taking into consideration the circumstances in which she, Maria Magdalena Pietersen, finds herself, having, while these proceedings were pending, been delivered of two living children, which same Maria Magdalena Pietersen could be further inconvenienced in this matter, in view of the harm that those innocent infants might come to suffer from this or that agitation caused thereby; but since, however, in the last held meeting, the husband himself of the aforesaid Maria Magdalena Pietersen, the burgher Adam Johannes Reineke aforesaid, appeared in court with the request, on behalf of his wife aforesaid, that this matter might be concluded, without the confession of that woman having yet become further apparent; so the Council has maturely weighed all these motives and reasons and judged that, in the case in question, the penalty to be inflicted could not but be deferred to the discretion of the judge, and consequently pronounced the following sentence in this matter: The Council, having attentively read and summarized the written claim and conclusion of the officer, and having also paid attention to what was further brought forward in court, administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, declares the defendant Jacobus Stein to be forfeited of all civil offices and prerogatives and incapable of ever holding any of the same, condemns him furthermore to a fine of one hundred rixdollars for the benefit of the acting plaintiff, as well as to all costs incurred in this lawsuit; the Council denying the further or otherwise made claim and taken conclusion of the officer. That the petitioner could therefore very easily await the proceedings initiated on and against the petitioner on that basis; but, since the petitioner resides far inland and the continuation of such proceedings could cause him much neglect in his business, the petitioner therefore requests that your Honors please declare this matter civil and composable. This having been read, the prosecutor ex officio, presenting three written declarations, stated that since in deciding a case the judge focuses mostly on intent, there appears to have been no intention on the part of the defendant to kill the Hottentot, as is most clearly established by these proofs. With due respect, the undersigned pro interim fiscal represents: that on Monday the 15th of the recently passed month of October, it was reported to the presenter that the previous evening, a slave named October belonging to Iacob Snel, who is stationed at the Honorable Company's stables and serving as an overseer on the Paarden Eiland, had died a few hours thereafter from blows inflicted by his said master; and the presenter having made the necessary investigations and inquiry into the matter ex officio, it will appear to your Honors from the declarations obtained and the autopsy report attached hereto that said Snel actually first gave his aforementioned boy some loose blows with a sjambok, then tied him to a ladder and continued with blows, alternating with a sailor [his cousin], until the loins and buttocks of the slave were completely bloody and bruised, from which the same then came to die, though according to the opinion of the chief surgeon he might perhaps have been saved with expert help. That also, according to the testimony of the sailor Iane Christ: Kous, the slave is said to have given occasion for that treatment in that he, having entered the house unexpectedly, had grabbed his master by the legs and thrown him to the ground, then sat on him and held him fast until he was pulled off by the deponent and the aforesaid sailor, and his master was thus freed from him; which nonetheless seems subject to some contradictions and doubt, while in the declaration of the bondsman of the Marine Lieutenant van de Graaff it is testified that the master had brought the boy into the dwelling house by the arm, and in any case the act itself could also not be excused; so that the presenter, for the suppression of such crimes and excesses that are very much in vogue and for the lawful punishment thereof, considers himself obligated by his office to take further information and to institute an action against the aforesaid Iacob Snel in due form.
