R. van der Riet in his said capacity renounces further productions, since nothing has been brought forward in defense by the defendant in his answer from which the claim could in any way be contradicted and found to be well-grounded, the more so because the declaration exhibited by the plaintiff in his official capacity has also been contradicted by the defendant, and therefore requested prompt and summary justice. The defendant also renounces. The Council keeps this matter under advisement for reading of the record. The Honorable Gabriel Exter, acting pro interim in the Fiscal office here, requester, in order to see an answer served to his claim submitted in his official capacity, pursuant to the appointment of the Honorable Council of Justice, against the requirants, the quartermaster and Lieutenant in the service of the Company Arnoldus Kasteleyn de Keulenaar and Second Lieutenant Johannes Cornelis de Buissonje, defendants. The defendants deliver a written answer furnished with annexes and request prompt and summary justice. The officer also renounces. The Council refers this case to the Honorable Council of Justice of this government. Whereupon came to the table the representation submitted by the Landdrost of Stellenbosch and Drakenstein, the Honorable Hendrik Lodewyk Bletterman, regarding the Hottentots Toorn and Heyn, which being deliberated upon and taking into consideration that the two depositions later obtained by the said Landdrost could shed much light on this matter, it has been approved to return this representation to the officer, to the end that he, furnished with the said two depositions, may proceed further against the aforementioned Toorn and Heyn as he shall find proper. Hereupon taking in hand the representation exhibited by the aforementioned Landdrost of Stellenbosch regarding the burgher Hendrik Isaak Beukes, which being considered, the requested personal summons upon the said Hendrik Isaak Beukes was granted to the officer, and he was enjoined to furnish himself with the inspection certificate upon which he relies in the said representation. Furthermore, being brought to the table the proceedings commenced by the pro Interim Fiscal, the Honorable Gabriel Exter, upon and against the burgher Jan Theunis Mulder, which being deliberated upon, the Honorable President declared his opinion to be that, since Corporal Klepson has been punished according to the strict letter of the law, the said Mulder, as buyer of the stolen goods, ought also to incur the punishment enacted by the same law and indeed in the same article, and therefore be condemned

7. The Messenger, entering, reports that the 1st cited person, Andries van Zeyl, has not appeared. The sworn Clerk Ryno Johannes van der Riet, appearing for the Prosecutor, having exhibited some depositions, states the following: The Prosecutor, before making any claim, requests by virtue of the 4th article of the Criminal Ordinance, that the defendants may be incarcerated and consequently ordered to enter into close criminal custody, and that in such a manner that they, through separate confinement, be deprived of all correspondence with each other, so that when this case shall be terminated by final judgment by Your Honourable Worships, the sentence to be rendered therein may not be rendered illusory by the absence of the defendants, since the punishment imposed on such crimes as the defendants have committed can be executed on no one other than the persons of the defendants, and that because there are against the defendants more than semi-full proofs, very vehement and probable suspicion concerning extreme acts of violence committed against a large number of Hottentots, as was extensively demonstrated from the memorial exhibited by the Prosecutor in the month of November last in Your Honourable Worships' assembly, and regarding which some evidence has since been obtained whereby the propositions of the Prosecutor have been most strongly corroborated, and furthermore that the defendants may be ordered to answer such interrogatories as shall be put to each of them separately by the Prosecutor before Commissioners from this Honourable Worshipful Council. And on account of the defendant in person and defaulter Andries van Zeyl, the Prosecutor takes the liberty to request of Your Honourable Worships a default, and by virtue thereof, according to the Criminal Ordinance, that there may be granted to the Prosecutor a writ of bodily arrest against the aforementioned Andries van Zeyl, and that the necessary authorization for the one and the other may be granted to the Prosecutor, and the burghers Andries van Zeyl, Adriaan van Zeyl, Petrus van Zeijl and Jan Wieser, defendants in person in the aforementioned capacity on the other side, to hear such criminal claim and conclusion, or request or requests, as the Prosecutor shall come to make and take upon and against the defendants in person on account of the violence committed by them against certain Hottentots, to answer thereto and further to proceed as in law. The Landdrost of the colony of Stellenbosch and Drakenstein, the Honourable Hendrik Lodewyk Bletterman, Prosecutor in a criminal case on the one side, against and, if necessary in all cases, the necessary assistance for apprehending shall be rendered to the Prosecutor, or else, should Your Honourable Worships unexpectedly not incline toward the request, which is nevertheless made on the basis of the laws, that then there may be granted to the Prosecutor a default and a second citation by missive under the Council's seal for three months from today under pain of bodily apprehension. The defendants in person request copies of all the documents, in order to be able to answer thereto. The Prosecutor maintains that no copies can be granted to the defendants, since the trial has nevertheless been formally instituted, and therefore requests that the request may not be taken into consideration. The defendants persist in their request. The Council grants the officer his request made in respect of the defendants Adriaan van Zeijl, Petrus van Zeyl and Jan Wieser, they being consequently to be incarcerated in close custody, without access and correspondence, and orders the defendants in person to answer to such interrogatories as shall be put to them, each in particular, by the Prosecutor before the Commissioners of this tribunal; furthermore, concerning Andries van Zeyl, the Prosecutor is granted a default and a second citation by missive for three months from today under pain of bodily apprehension. Potgieter, to wit, that she was living in illicit intercourse, during the marriage of and with the burgher Louis Cotzee, and that their mother had already been delivered of a dead child, and was due to give birth to a second, and that the wife of the burgher David Botha could give testimony of the miscarriage; that the principal representant, concerning that accusation, had the aforementioned Louis Cotzee, as well as the wife of the said Cotzee named Johanna Dienaar, summoned before him at the drostdy concerning a certain infamous 11. infamous correspondence with the aforementioned widow Potgieter and her present husband, Fredrik Otto, from which also the crime and adultery can in part be proved, in order to hear the parties extrajudicially concerning the one matter and the other, without the aforementioned Cotzee or his wife having complied therewith or having deigned to come clear and answer for themselves about it; that, meanwhile, long thereafter, the aforementioned Cotzee came to the drostdy on a certain day in the beginning of the month of November last, and after having committed some insolences with respect to various persons, appearing more fully from the depositions annexed hereto, subsequently came to the aforementioned Landdrost and treated him in a violent and insolent manner, both in words and deeds, which the proofs annexed hereto indicate, and to whose contents the aforementioned plaintiff takes the liberty of referring for the sake of brevity; so that the aforementioned representant, for the protection of his house and life, was compelled to resist him, Cotzee, by force, and to have him driven out of the house with the assistance of the surgeon there, Zalstroon, and an orderly dragoon who had arrived in the meantime, without having given any further order to those two persons than to drive him, Cotzee, beyond the door, just as the Landdrost later learned was done, out onto the street, and in which he was unable to maintain order at that moment, since, through the blows to the head received from him, Cotzee, he had not only fallen into a rage, but was also somewhat stunned, and had, as it were, fallen into an agitation and confusion of the senses, since he could not have supposed that people could be found who, not only forgetting all that they owe to their fellow human beings, but also setting aside all deference and the proper respect that they owe to someone who, in the name of the Sovereign, has been dignified with a part of the administration of Sacred Justice by the High Government of these lands, and who consequently, for more than one reason, ought to be maintained in that respect and proper deference which the general welfare demands be accorded to his person. in his capacity, is assured that your Honorable Worships will never tolerate that any lesion be inflicted upon the office of the respective officers in the countryside, much less that the patronizing of such vagabonds obstruct the illustrious course of justice, or that similar persons, who are subject to accusation of adultery as well as disobedience and violent insolence committed in the house and to the person of the Landdrost, should ever or at all evade their well-deserved punishment, or see their insolent mindset reinforced with impunity. The undersigned has therefore deemed it most advisable, before proceeding to any criminal procedures, to turn to your Honorable Worships with the humble request that, after your Honorable Worships shall have taken this memorial, with the documents annexed thereto, into careful consideration, to grant to the memorialist a decree of summons in person by missive under the seal of this Honorable Worshipful Council, both in regard to Louis Cotzee in the case of accused adultery and violent insolence committed against the Landdrost, Mr. Woeke, as well as in regard to his wife Johanna Sienaar on account of the divulging and writing of most scandalous letters violating decency, and consequently to appear in person before this Honorable Worshipful Council on a certain term to be fixed, in order to hear such criminal demand and conclusion, or request or requests, as the memorialist shall deem fit to make and take upon and against them, to answer thereto, and further to proceed according to law, cum expensis. Since the petitioner, being an indigent man, is unable by way of the law to demand satisfaction for the scorn and violence done to him, but on the other hand the petitioner trusts that such committed acts—and if the petitioner may call them so, committed crimes—cannot be drawn into personal actions, but that the judge, under whose fatherly protection such a mistreated person belongs, will take him under their honours' very powerful protection; For which reasons the petitioner takes the liberty of turning to your Right Honourable, and of bringing these his experiences most respectfully before the eyes of your Right Honourable, with the humble request that it may please your Right Honourable to take the petitioner under your Right Honourable's protection, and to be pleased to maintain the petitioner and to grant him such satisfaction as your Right Honourable shall find appropriate according to the state of affairs. it must be known that whenever one is innocent one also needs to fear nothing, and therefore needs no one's protest out of fear of punishment, and this premature step only too clearly verifies his, Cotzee's, guilt, whereupon the Officer demanding justice implores your Honorable Worships' reflection; wherefore the Officer demanding justice once more requests your Honorable Worships that the petition and act of him, Cotzee, may be returned. Whereupon the parties having retired, the Secretary of this Council requested that their Honorable Worships might be pleased to reflect upon the expressions used in this matter by his sworn clerk, by calling the aforesaid declaration an unlawful instrument; that, because the same had been passed before him, the Secretary, he therefore believed he had to take this injurious remark to heart, and for that reason requested the Council to investigate whether this instrument was unlawful or not, and, if found not to be so, to maintain him in his office, as he otherwise, having the reputation of drafting unlawful acts, would consequently also be deemed guilty of malversations in his function. The Merchant and Landdrost of Stellenbosch and Drakensteyn, Mr. Hendrik Lodewyk Bletterman, Officer demanding justice in a criminal case on the one side, against the citizens Andries van Zeyl, Petrus van Zeyl, and Johannes Weeser, prisoners and defendants in the aforesaid case on the other side. The Officer demanding justice submits a written demand furnished with annexes, concluding thereby as at the end of the same. Which having been read to the defendants, they say they have not deserved that punishment. The Officer demanding justice persists in his made demand and requests justice. The defendants request whether it might not be permitted to them to submit something further in writing for their defense. Whereupon the Officer having been heard, he said he could well tolerate such, if the Honorable Worshipful Council wished to grant it. The Council keeps this matter under advisement for circular reading, and grants the defendants their made request, with their written submission to be placed in the hands of the Secretary in order to add the same to the case. The defendant says he has spoken the truth, adding that he received blows from his master because he had broken open the cellar, and that he had confessed of his own accord, further persisting that he is not guilty of the murder of the Hottentot woman Jannetje with her child. The Council keeps this matter under advisement for circular reading. Furthermore, the said Landdrost of Stellenbosch and Drakensteyn appeared again in the Council, who requested, by virtue of the confession made by Adriaan van Zeyl and associates, namely that his third son Willem van Zeyl had allegedly made himself guilty of the killing of the Hottentot child named Antje, a summons in person by missive upon the said Willem van Zeyl, which request was granted to the Officer. It was also requested by the said Landdrost that no access might be granted to the wives of the defendants Adriaan van Zeyl and Johannes Weeser to their said husbands, considering the agitation that knowledge of the Officer's demand against the defendants could cause in the minds of those women. In which request the Council concurred. After which it was requested by the very same Landdrost to know whether the summons in person requested by him upon the citizens would still proceed or not, since he has been ordered to exhibit the inspection certificate and he cannot comply therewith for reasons already set down in his submitted memorial, which still remain valid. The following petition, presented by Sara Johanna Wiese and Helena Johanna Laubscher, wives of the burghers Adriaan van Zeyl and Johannes Wiese, who are detained here and being prosecuted by the Landdrost of Stellenbosch and Drakenstein, was brought before the session by the undersigned on the order of the Honorable President for deliberation among the Members: To the Honorable Johannes Isaak Rhenius, President, together with the Honorable Council of Justice of this government. Honorable Sir and Honorable Gentlemen. With due respect, your Honors' very humble servants, Sara Johanna Wiese, wife of the burgher Adriaan van Zeyl, and Helena Johanna Laubscher, wife of the burgher Johannes Wiese, make known that their said husbands, having been summoned by and on behalf of the Merchant and Landdrost of Stellenbosch and Drakenstein, Mr. Hendrik Lodewyk Bletterman, to appear before your Honors' court of justice, and although the petitioners are fully convinced of the innocence of their said husbands—since the Hottentots whom the petitioners' husbands, as the petitioners are informed, attacked and, as they further report, wounded while rendering help and assistance to some other oppressed Hottentots in recovering the cattle that had been taken from the latter, were veritable Bushmen who daily engage in stealing and robbing both from the burghers and from the good, tame Hottentots living in those regions, of which the undersigned, if allowed time and opportunity, could at all times provide very valid proofs to your Honors—the Landdrost has nevertheless proceeded so far against their said husbands that they have both been placed in criminal detention, in solitary confinement, and subsequently interrogated on articles of inquiry at the requisition of the prosecutor: That however well the petitioners know that the reason and purpose for holding a criminal detainee in solitary confinement is solely to prevent the accused from receiving any hints whereby he might be enabled to mislead the judge: so the petitioners, alas to their bitter grief, must now experience that, notwithstanding their said husbands have already been examined before the Commissioner Gentlemen and have answered the articles—and therefore, as the petitioners respectfully submit, the reasons for which one is obliged to cut off and prevent all communication with the said detainees have ceased—the petitioners have nevertheless not yet had free access to their said husbands, and thus have not been permitted to attain the bittersweet joy of bringing some comfort to these their beloved spouses in their wretched circumstances by their presence. The petitioners, convinced of the sentiments of equity and justice which this Illustrious assembly causes to be joined so closely with the administration of law and justice, and at the same time being unable to obtain any permission from the said prosecutor to see their husbands; have therefore resolved to turn hereby to your Honors, humbly pleading that your Honors may be pleased favorably to grant them the requested access to their said husbands: your Honors being assured that no improper use will be made of this concession by the petitioners. Criminal Claim and Conclusion, to answer to which request or requests the aforesaid Prosecutor shall then make and take upon and against him, the defendant in person, and further to proceed as according to law. The defendant in person, having heard these declarations read, says that the same are not in all parts stated according to the truth, although he nevertheless avows the shooting to death of the Hottentots, and that such occurred because those Hottentots had attacked him. The Council condemns the defendant in person to answer to such interrogatories as shall be put to him by the officer qq. in the presence of Commissioners. Whereafter it was requested by the just-mentioned St. van der Riet in the aforesaid capacity, that in case the aforementioned Pieter Johannes du Plessis continued to persist before the Commissioners in his confession now given in full court, their Honors might by virtue thereof be authorized to have the said Du Plessis taken into criminal apprehension, which request was taken under advisement until such time as a report regarding the contents of his responses should have come in to the Council. The Council, having heard with astonishment what was brought forward by the Prosecutor in his official capacity, enjoins the same to refrain in the future from such remonstrances against a sentence passed by this court, and further grants him the requested copies of the trial. After which it was brought forward by the sworn clerk Ryno Johannes van der Riet, as qualified to attend to the affairs of the Landdrost of Swellendam, that, whereas it had pleased this Council on his request made on the last court day, namely that the Commissioner Gentlemen who would attend the interrogation of the burgher Petrus Johannes du Plessis might be qualified, if the same du Plessis at that interrogation persisted in the murder of the Hottentot confessed in full court, to place him in criminal custody, to dispose thereon that their Honors held this request under advisement until such time as further report regarding that interrogation should have come in, he, the sworn clerk, therefore now reiterating his request while producing the interrogatories, the Council has thereupon seen fit to resolve to have the said du Plessis placed in civil arrest until such time as the inquest report shall have come in, and the officer shall have submitted a report on what was brought forward by the aforesaid du Plessis in his responses regarding the declaration made. 28 having been heard before the delegated Commissioners on interrogatories and having continued to persist fully, the prosecutor taking action again takes the liberty of renewing his request for the apprehension of the said Du Plessis, concluding accordingly that he shall be ordered to be placed in criminal detention. On the last court day, Mr. Gerrit Hendrik Meyer, as a member of this Honorable Council, having stated to this illustrious gathering that he was reliably informed that the post-mortem inspection of the corpse of the Hottentot shot dead by the aforesaid Du Plessis had been carried out accurately, whereas Du Plessis, however, fully admitted at his interrogation that when the Commission sent by the Landdrost arrived at the place where the homicide had occurred, they did not find the body, but saw signs where that body was supposedly buried; thus that corpse, apparently because of the long intervening time and because it must have already transitioned to putrefaction, was not inspected by that judicial Commission, but having heard indeed that that body was examined without qualification by a certain Jesaias Meyer and Fredrik Botha, who must have arrived there by chance, which persons then also buried that body; that this is also the reason why no post-mortem report could be sent by the Landdrost; and since from the statement of the brother of the aforesaid Du Plessis, named Jacobus Du Plessis, it can be sufficiently gathered that a corpus delicti is established, at least in all cases as much as the two persons who buried the corpse would be able to declare, the prosecutor taking action furthermore takes the liberty of imploring Your Honors' highly wise advice whether, upon the confession and evidence which according to the submission of the claimant are complete, one could proceed to a claim on the principal case, or rather whether one ought to wait until those two persons who inspected and buried the body shall have come Capeward in order to provide a declaration concerning the one and the other; and in the event Your Honors should incline towards 29 towards the latter, I take the liberty to request that those two persons may be summoned on behalf of the Council to come Capeward immediately, in order to give an account of their findings. Whereupon, this matter having been deliberated, it was approved to have the burghers Jesaias Meyer, Hendrik Vevier and Daniel Pienaar summoned on behalf of the Council to come Capeward with the greatest haste in order to give a statement regarding their inspection conducted on the corpse of the Hottentot shot dead, and to allow the aforesaid Du Plessis to remain in civil detention in the meantime. Furthermore, the read-out claim ad torturam of the Landdrost of Stellenbosch and Drakenstein against the Hottentot Styn having been brought to the table, and after deliberation having taken place thereon, it was approved and understood to order the officer first to have the interrogatories of the said Steyn already exhibited in court reconfirmed, and subsequently to hear him on further articles. Thereafter, the read-out proceedings instituted by the Fiscal pro interim the Honorable Gabriel Exter on and against the Naval Lieutenant Buisonje and the Keulenaar were brought to the table; whereupon the Council, having maturely deliberated thereon, and having considered all that pertained to the matter and could move Their Honors, doing justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, awarded the prosecutor taking action his full claim. to present the truth of the matter to your Honorable Worships, in the hope and trust that your Honorable Worships will make no objection to declaring this matter civil and composable. May it please your Honorable Worships to be informed that the petitioners, having traveled up to the Cape in the month of September of the past year, had a coat stolen from the wagon at the Steenbras River where they had outspanned. Having arrived on their return journey at the outspan place at the Bot River, they were warned by one of their boys that a Hottentot, who was there with a slave boy, had a stolen coat on his shoulders. The petitioner Hendrik Beukes addressed the said Hottentot and demanded the coat from him, who at first completely denied having stolen the coat, but upon being convinced by the petitioner's boys that it was that same coat, gave the said Hottentot a few blows with a small lath that the petitioner had in his hand. Thereupon, he immediately admitted having stolen the coat, and that the slave boy, whom he called his father, had ordered him to do so. In the meantime, the said slave had approached the petitioner Isaak Beukes, who was busy inspanning oxen, and addressed him with very far-reaching impertinence in order to excuse himself from the said theft. The petitioner, holding the oxen with one hand, delivered a blow to the ear of the said slave with the other hand, whereby the said slave fell to the ground. Having stood up again without complaining of anything, and after speaking a few more words to him, the petitioner, he went away, without the petitioners being aware that any injury or harm had come to the said boy, either through the blow or through the fall, as the burghers Hendrik and Jan Groenewald, who were present there, must also testify, as the petitioners trust. That in the month of October, the petitioners having arrived in Stellenbosch, were informed that the said slave boy's arm had been broken, and that due to some accident it had resulted in consequences that caused the said boy to die from it, over which the petitioners, as mentioned before, find themselves prosecuted in a criminal proceeding by the Officer Prosecutor. And since this crime is entirely unknown to them, the petitioners, yet it could be that the arm of the said slave boy was broken either through the blow of the petitioner Isaak Beukes or through his fall, or whether this misfortune befell the said slave on his journey home, as he was still approximately two days from home, as the petitioners must primarily think, though unknown to them, since the said boy complained of nothing to the petitioners. And since the petitioners, by extreme necessity, are needed on their farms and cannot remain here at the Cape except at extraordinarily heavy cost and damage to the petitioners, seeing themselves moreover duped by expensive and unfortunate proceedings for the petitioners, to prevent which the petitioners take the liberty of turning to your Honorable Worships, with the most humble request that it may please your Honorable Worships to declare the unfortunate accident in which the petitioners find themselves, because of its intervening circumstances, civil and composable, and to authorize the Officer Prosecutor to settle with the petitioners in the presence of the Gentlemen Commissioners from your Honorable Worships regarding the penalties and fines established against the commission of such crimes, or else that your Honorable Worships may be pleased to dispose otherwise, as your Honorable Worships shall deem proper after a judicial investigation into the unfortunate accident, wherein the petitioners see themselves suspected and brought without their fault and completely unknowingly. 36. in the month of May of the same year, after the petitioner had ridden on horseback to his cattle post named het groote bosch, situated on the Gous river and held in loan from the Honorable Company, in order to look for water there, the first-mentioned, as was customary in such far-distant districts, had taken his gun with him. That when they arrived near the aforesaid cattle post, they encountered on that occasion a Hottentot named Fredrik, who was grazing off the grass with his herd of cattle in the field adjoining the aforesaid post. Which provided the arrested person with well-founded reasons to ask the said Hottentot for what reasons he had come to graze off the grass there at that place, about which some exchange of words arose between them concerning the legality of the possession of the said place; while in the meantime the petitioner's second son, Jacobus Ludovicus, had gone to drive that cattle back, and consequently had left them alone there at the place. That at that moment the aforesaid Hottentot, who had repeatedly dared to attack people, namely Jacobus Botha and Pieter du Preez—which the petitioner, if required, would also be able to prove to the satisfaction of the court—also assaulted the petitioner's arrested son, and with a stick or kirri which he had with him wanted to beat in his brains, he being pounced upon so suddenly that, being very alarmed and seeing no means to save his life in such a wilderness by flight, and in that astonishment and confusion of mind, in order to strike fear into the attacker, he discharged the gun he held in his hands and mortally struck the aggressor. That this incident was subsequently reported by him directly to the competent judge, the Merchant and Landdrost at Swellendam, the Honorable Constant van Nult Onkruijt, and that he was not summoned for it by writ until about 20 March last, to appear before this Illustrious tribunal, in obedience to which, he having then appeared before Your Honorable Worships, 37. the Honorable Prosecutor ex officio had requested and obtained on the roll that the petitioner's aforementioned son should be heard articulately regarding the aforementioned matter, per verbum credit vel non, with the result that bodily apprehension was decreed thereupon. Which causes the petitioner to presume that the same, on account of his unconsidered answers given, seems to have been aggravated by some indications; and indeed mainly that, because the laws teach that when manslaughter is established, the accused must properly prove the claimed self-defense. Which laws in particular—in a country originating for the most part from a barbarous, wild nation—are not only not well practicable, but are also subject to various exceptions, as can be soundly deduced from common sense. And in order to demonstrate the same, the petitioner takes the liberty most respectfully to remind Your Honorable Worships of the unheard-of murders by that monster of nature, an executed person, Jaho de Poere; if he had once fortunately been struck down or shot dead by the first person attacked, would the lives of several worthy inhabitants not thereby have been saved? Has not the so frequent sad experience, alas, taught only too much how many a worthy inhabitant has been attacked by such birds of prey and robbed of their cattle and lives, and should one then, in case of self-defense, each time be burdened with proof, Noble Worshipful Sirs? Surely not. And in the second place, the petitioner presumes, with all due respect, that the same laws only prescribe such requirements in places where one usually has or can have evidence at hand among civilized peoples, and a dispute takes place between equal parties, which in this case can never with reason be sustained to take place or hold true. When Your Honorable Worships will be so exceedingly kind as to take into serious consideration the place where the petitioner's son was attacked, which will be found 38. to be a far-distant wilderness where one rarely has or can have witnesses. And what person will be found, Noble Worshipful Sirs, who, being murderously attacked without reason with a club or kirri in hand, and placed in danger of losing his life, sees himself at that moment complete master of his judgment, let alone that he would be able to remember what the laws require in such occurrences. However, in order nevertheless to comply with the aforesaid requisites, the petitioner takes the liberty, with Your Honorable Worships' most favorable permission, to inform the same with the highest respect to be true and veritable: that the often-mentioned Hottentot belongs to that class who are accustomed to attacking people. Just as he has dared to attack the aforementioned Botha and the burgher Pieter du Preez, and to throttle the latter's throat, and that in such a manner that—had he not been rescued by the fellow burgher Louis Holtzhausen—he apparently would have had to leave his life at the place; which the petitioner offers to Your Honorable Worships to prove according to the style of the law, if required. Wherefore the petitioner trusts in this respect, with good foundation, to be able and permitted to invoke the well-known legal axiom stating: Nam semel malus semper presumitur malus praesertim in eodem genere militiae, caput Semel, de regulis juris in Sexto. 39 who thereupon, intended to bash his brains in, was attacked by the same with the aforesaid kirry in hand, without him being able to save himself by flight, considering it is well enough known to everyone how the aforesaid Hottentots are trained even to throwing with such kirries, and know how to hit people, to which is added that when they have first approached people so closely that they have them within the reach of their kirries, there is no means of escape at hand for such persons without exposing themselves to the utmost danger of losing their lives, as is known to everyone. For which reason the petitioner's son, justly fearing to lose his life in case he attempted to save himself by flight, and who, in this agitation and confusion of the senses, by means of self-defense, discharged his gun in order to terrify the said Hottentot, who pressed on all the more vigorously, and possibly hit the same aggressor as he thus pressed on furiously. That now, Right Honorable Gentlemen, the aforesaid turning away must indeed be considered with good reason as a causa seu actus immediatus of the shot fired in the aforesaid agitation, and possibly to intimidate the said Hottentot in his rage, is evident, and since he pressed on all the more vigorously and was hit from the front by the petitioner's son, this provides clear proof of his furious aggression, and from this it may be presumed that the petitioner's aforesaid son had no animum dolo malo offendendi, but rather necessarie defendendi, and consequently had no intention of doing evil. For it is beyond dispute in law that everyone is permitted, not only in defense of his life, but also of his body, to run through the assailant or threatener who approaches with a knife or gun, since the fighter or threatener is understood in law, by reason of his threats, to have killed himself rather, as the legal scholars concerning this matter 40. treat of aggressors; see Dutch Consultations and Opinions, part 2 and 3, Consultation 40, no. 3, 4. Therefore, it will indeed require an object of your Right Honorable wise considerations whether in this case the confession made ought not in all fairness and equity to be accepted as a whole, which the petitioner trusts from the equity of your Right Honorable will be understood as such in this case. Since the petitioner's often-mentioned son communicated the incident in such good faith directly to the competent judge already mentioned hereinbefore, and having been summoned concerning the same before this illustrious tribunal, also appeared in person at the appointed time, whereby in law all bad suspicions that he might be guilty of anything, according to the unanimous opinion of so many accredited doctors of law, are eradicated; see Julius Clarus, Practical Questions, question 25, number 24, compared with Menochius, De Conjecturis, book 819, number 21. All the more so because it is notorious in law that in case of doubt, an honorable man not known for quarreling, having stabbed another to death, is understood according to the doctrine of the Doctors to have done the same by reason of self-defense; see Dutch Consultations, part 2 and 3, Consultation 40, no. 6, page 35; and consequently the same, under correction of your Right Honorable's more enlightened judgment, is sufficiently proven. And established on that ground, that a manslaughter by means of self-defense, committed by accident, in agitation, or at least without intent, consequently is not only not punishable under the ordinary penalty of the Lex Cornelia de sicariis, but rather the perpetrator is fully acquitted, since defense is jure naturali, as is taught on solid grounds in Carpzovius's Treatise on Capital Crimes, part 1, chapter 28, no. 1, 2, 3, page 203. That the petitioner, recognizing on the basis of the grounds presented that his arrested son is not guilty of any crime, was therefore necessitated to turn to your Right Honorable with the most humble and respectful request that it may please the same to release his aforementioned son under hand-pledge 41. and sufficient bail, in a sum to be arbitrated by your Right Honorable, upon the said confession and defenses, and subsequently to admit him in the ordinary manner to appear by an attorney and plead his case, or if your Right Honorable should hesitate therein, taking into consideration his so lengthy detention, to dispose otherwise as your well-known prudence and equity shall deem proper. There was submitted by Mr. Ryno Johannes van der Riet on behalf of the Landdrost of Swellendam the following memorial: — To the Right Honorable Johannes Isaak Rhenius, President, and the Honorable Council of Justice of this government. — Right Honorable and Honorable Sirs, Shows with the greatest respect the undersigned, qualified by the High Authority of this country to attend to the affairs of the respective countryside officers, That he, the memorialist, some weeks ago requested of Your Honors, while producing the proofs concerning and against the burgher Petrus Johannes du Plessis, in order to obtain regarding him such provision of justice as he, the memorialist ex officio, in order properly to uphold the right of the high authority and according to the letter of the Criminal Ordinance, conscientiously thought proper. That however much the memorialist ex officio had flattered himself, since it was fully evident that the above-mentioned person had made himself guilty of crimes which, according to the laws and placards of the country, placed him in the terms of having to be criminally sued and apprehended, that Your Honors would have granted to the memorialist ex officio such provision of justice as was in accordance therewith, Your Honors had nevertheless thought fit to grant the memorialist ex officio no other disposition than by virtue of which the said person could be taken into civil arrest. In the forenoon, extraordinary meeting, present the Honorable Johannes Isaak Rhenius, President, and all the members except the gentlemen Maasdorp and Van der Riet due to indisposition. Having come before the table the documents and proceedings, read in turn by the respective members, initiated by the Landdrost of the Colony of Swellendam, the Honorable Constant van Nult Onkruydt, against the burgher Petrus Johannes du Plessis: the same having been maturely deliberated upon, and everything that warranted any reflection having been weighed with all possible attention, as well as regard having been paid to all that served the matter and could move Their Honors, doing justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, the defendant is confined to Robben Island for the period of five consecutive years, as he is confined hereby, in order to be transported away from here after the expiration of the aforesaid five years, with condemnation of the defendant in all the costs incurred in this matter, and dismissal of the further or otherwise made demand and conclusion taken by the officer. Whereupon was produced by the Honorable President a letter from the Landdrost of Stellenbosch and Drakenstein, the Honorable Hendrik Lodewijk Bletterman, addressed to His Honor, reading as follows: 46. Right Honorable Sir, Already in the month of August 1786, a musket having been sent to me by the Field Corporal in the Bidouw, Frans Lubbe, with the communication that he had caused the same to be taken from a Hottentot named Wessel Caro, because he was held suspect of having shot dead an ox, I was informed on the 12th of October thereafter by the burgher Carel van der Merwe, son of Isaak, that the above-mentioned Hottentot had stolen a musket from his cattle herders, being two Hottentots, the said Van der Merwe subsequently having come to me again the year thereafter, namely on the 16th of October of the past year, and the same musket, among several others, having been shown to him, he immediately recognized the above-mentioned as his own, which I returned to him, just as that same afternoon the burgher Arnoldus Vlok complained to the undersigned that one of his slaves accused the above-mentioned Hottentot of having administered poison to him, though the said slave had recovered again, without any probability of that accusation being able to be deduced by the undersigned from the aforesaid story told. That subsequently on the 2nd of January of this year the said Van der Merwe informed me in writing that for some time continuously, from various local residents there during the night time, one and then also two sheep having been stolen, the above-mentioned Hottentot was held very suspect in that regard, and now upon received information that the same was staying again in the Bidouw with a certain Jan Matthys Kok, the said Field Corporal Lubbe was notified of this and requested to see to capturing that vagrant, whereafter on the 8th of April last the aforesaid Hottentot Wessel Caro was also sent to the undersigned by the said Field Corporal Lubbe, with the request that the same might be banished elsewhere, because 47. because he was a vagrant and had no fixed place of residence, and was held suspect of cattle theft; he, the Field Corporal, in case the aforesaid Hottentot were set at liberty again, would no longer be able to perform his duties, because the men who had been commanded for the capture of the same Hottentot had declared that, since the same Hottentot had already some years ago been captured on account of presumed cattle theft, yet had then escaped again, they did not wish to go out in vain time and again after such robbers, and endure cold and hardship day and night in the field. And as on the one hand hitherto, of all the accusations lodged against the said Hottentot, besides that of the musket, not a single such proof has come into my hands to this day, upon the foundation of which criminal proceedings could be instituted against the said Hottentot with any good success, on the other hand, by reason of the probability of the presumptions lying against him, it would be no less inadvisable to give the same the opportunity again to come into the aforesaid districts, and consequently to set the said Hottentot entirely at liberty, I have, according to the multiple available examples thereof, of which shortly before the assumption of my present post a similar case as with the said Hottentot took place here, thought it best to propose to Your Honor whether the said Hottentot, with an iron ring on one of his feet, could be handed over to the burgher Frans Roos, who has made a request to that effect in those environs, to serve him thus provisionally for food and clothing, so that the same may be released from his imprisonment here.
