to hold this matter under advisement for the present. Which having been read, it was approved to hold this matter: Furthermore, the following was brought before the roll by the said Mr. van der Riet, acting in his capacity for the merchant and Landdrost of the Colony of Zwellendam, Constant van Nult Onkruyt: The reporting officer, having been informed that a certain Carel Sterrenberg is said to have spread rumors here at the Cape that he brought the widow of the late burgher Ferdinand Hartsenberg to the Cape as a prisoner, and also delivered her to the officer into criminal detention, as well as with some circumstances that he was certain that the said widow had a share in the murder of her husband, of which he, Sterrenberg, has assured the public in such a manner that it is already adopted and recounted by everyone as an established truth, whereby the reporting officer finds himself in no small embarrassment, since Your Right Honorable Worships are as yet not sufficiently convinced either of the participation in the murder of her husband nor of the murder itself, thus the reporting officer considered it most advisable to have the said Sterrenberg summoned to the Secretariat of Justice in order to give testimony of the truth regarding his knowledge in this matter; but since he has already gone out to the country, and the pretense of having brought the said widow up under arrest and having delivered her into criminal detention is completely contrary to the truth, the reporting officer therefore judges it best, in order to stop such deceitful talk (since the widow came to the Cape voluntarily with her own wagon) and for the elucidation of justice regarding his knowledge that the said widow might have a share in the murder of her husband, to request of Your Right Honorable Worships a summons by letter under the seal of the Council, in order to give testimony concerning the rumors he spread, and in the event that he might have fabricated the one as well as the other, to then hear such criminal demand and conclusion as the reporting officer shall see fit to make and take upon and against him, to answer thereto, and further to proceed according to law. Whereupon, having deliberated, the following disposition was made: The Council authorizes the officer to cause the burgher Carel Sterrenberg to be summoned by letter under the Council's seal, in order to give testimony of the truth regarding that which he has spread here at the Cape concerning the widow of the late burgher Ferdinand Hartsenberg. While further by the said Mr. van der Riet, in his aforementioned capacity, the following was also read out: The reporting officer takes the liberty of bringing to the knowledge of Your Right Honorable Worships that yesterday late in the evening he received here from Swellendam, under escort of the substitute, the servant of the murdered Hartzenberg; that this man, in an extra-judicial interrogation, has fully confessed to having committed the manslaughter, and that because he maintained an affair with the wife of Hartzenberg, a quarrel had arisen thereover between him and the deceased while they were alone, as also that the wife of the deceased had given him cause to commit that scandalous deed; thus the reporting officer has provisionally had him, Meyer, placed in one of the civil detention rooms, in order to prevent all difficulties that could result from the escape of that man; thus the reporting officer has judged it his duty, in accordance with the style of proceeding in criminal cases and the ordinance on criminal justice, to give Your Right Honorable Worships the necessary notice within 24 hours, and to request Your Right Honorable Worships' approval thereon; the reporting officer intending, once he, Meyer, shall have been interrogated, to make further application for criminal apprehension according to the findings of the case, and likewise regarding the accused wife to request of Your Right Honorable Worships such decree as the circumstances of the case shall require. And the conduct of the reporting officer being ratified with the Council's approval, it was hereupon approved to keep the said person of Meyer provisionally in civil custody. Thursday the 19th of July 1788 In the forenoon, present the Honorable Johannes Isaak Rhenius, President, and all the Members, except Mr. van Echten due to indisposition. After the Honorable President had made known to the assembled Members that this meeting had been convened at the express request of the Member of this Council, Mr. Ryno Johannes van der Riet, acting in his capacity for the merchant and Landdrost of the Colony of Zwellendam, Mr. Constant van Nult Onkruyt: The said Mr. van der Riet, in his aforesaid capacity, presenting a deed of confession made before the commissioners by the burgher Barend Meyer, who is still sitting in civil arrest pursuant to the resolution taken during the session of the last meeting, together with an account of Elisabeth Voslo, widow of the late burgher Ferdinand Hartsenberg, and also a statement of two slaves by the names of April and Cupido belonging to the said widow Hartsenberg, requested bodily apprehension of the said Barend Meyer, and likewise to be permitted to question the mentioned Elisabeth Voslo on such articles as had been drawn up for that purpose by him, the reporting officer, with the further addition that the commissioners might be authorized to also cause the said Elisabeth Voslo to be apprehended upon the interrogation to be conducted, according to the findings of the case. 60. confessed to having struck the temple of the head; to have taken the life of the aforesaid Hartsenberg, but also at the same time plainly declared that he immediately revealed this matter to his wife, and then agreed with her to conceal this and to pretend that her husband had ridden to the Burgher Ceele; while furthermore it also appears from the said confession that the mentioned Meijer, during the lifetime of the aforesaid Hartsenberg, had relations with his wife, and thus all circumstances, like among others the contradictory account of the same Elisabeth Voslo, also yield very aggravating presumptions both concerning her and the said Meyer. Thus, upon the request made by the officer, the following decree was granted. - The Council grants the prosecutor in office the requested apprehension regarding the Burgher Barend Meyer, as well as the request made to be permitted to hear Elisabeth Voslo, widow of the late Burgher Ferdinand Hartsenberg, before the delegated Gentlemen, on such articles as have been drawn up to this end by the prosecutor in office: at the same time authorising the delegated Gentlemen, in case the said Elisabeth Voslo should come to confess the deed, to then also be able to take her into apprehension. Furthermore appeared in council the Fiscal pro Interim here, the Honourable Gabriel Egter, giving to know: that he, the petitioner, pursuant to the decree obtained from this Council dated 10 August of the year 1786, having caused the burgher Hendrik Lodewik Lies to be summoned in person, in order to hear, on account of committed street violence, such criminal demand and conclusion, or request or requests, as the said Fiscal pro Interim in office shall make and take against him, the defendant, to answer thereto and further to proceed according to law: this matter however, on 24 August of the said year, upon the request made by the said Lies by petition for this purpose, was declared composable, and that composition had also taken place before the delegated Members from this Council, in the following manner, that he, Lies, namely, had undertaken before the delegated Gentlemen to pay 75 Rds: — of which, to the soldier of Meuron named Pauli who had been injured by him with a stone, for suffered 87. pain and suffering, 25 Rds would be handed over; that he, the Fiscal pro Interim, subsequently having been compelled, in order to summon de novo the said Lies who, notwithstanding all amicable interpellations, nevertheless remained unwilling to pay, he, Lies, at his appearance, had behaved so exceedingly insolently that it was deemed good by this council to place him on that account for 14 days on water and bread. — That the said Lies, besides not having brought up to now the aforesaid sum of 75 Rds, of which he, the Fiscal pro Interim, had already delivered the stipulated 25 Rds from his private purse to the aforesaid Pauli, moreover since that time having behaved very irreverently and obstinately with regard to him, the petitioner, he, the petitioner, had nevertheless always been willing to overlook that in order to prevent unpleasantries. That the said Lies with his brazen undertakings had however gone so far that the day before yesterday, when the petitioner was at the drill of the Wurtemberg Troops on the square, he had not shrunk from intentionally shocking him, the petitioner, at first by turning back and forth several times with the hand and hat on the head almost against the body of the petitioner and spitting down before him, but that also, notwithstanding he, Lies, had been told by the same petitioner in a friendly manner that he should refrain from further insolence, or that such measures regarding him would be taken as are deemed serviceable for the security of the public roads and similar public places, neither this polite admonition, nor the presence of the Captain-Lieutenant van Kervel, with whom he, the petitioner, was in conversation, nor the presence of the other bystanders, had been able to restrain him, Lies, from placing himself right in front of the petitioner, and defying him with various mocking and taunting remarks to such a degree, that he, the petitioner, although having until now overlooked everything with calm so as not to expose himself to hateful encounters in public, had finally been forced to have him, Lies, placed in civil arrest. 62 that while he, as a public person, ought to be protected from such insults, it might therefore please this Council to take such satisfactory measures herein as, according to the nature of the matter, should be found proper. However, before proceeding to a final decision on all this, it having been approved by the Council to have the aforementioned Hendrik Lodewyk Sies enter, in order to answer for himself regarding the complaints of the aforementioned acting Fiscal, or to put forward his interests, the aforementioned Hendrik Lodewyk Sies, appearing in the meeting, did not hesitate, to the utmost surprise of the Council, without paying attention to the questions that were put to him concerning the aforementioned matter by the Honorable President in very friendly terms, to strike the table repeatedly with his hand, and essentially answering nothing other than that he paid attention to no man in the street, to address the aforementioned acting Fiscal forcefully, essentially, that he would surely find him, further stepping before the acting Fiscal with a very angry countenance and asking him in an impertinent and snappy manner whether he had anything to say against his person; so that from the aforementioned indecent conduct of the aforementioned Sies, added to what is taken into consideration against him regarding his previous insolent behavior, the well-foundedness of the complaints of the aforementioned acting Fiscal being fully confirmed, it has, in consideration that the aforementioned Sies is entirely and in every respect a harmful and dangerous subject both for the Colony and its good inhabitants, therefore and in order to take the shortest path, been unanimously resolved to address by petition the Right Honorable Governor and Honorable Council of Policy, with the request that it may please His Right Honor and their Honors to cause the aforementioned Hendrik Lodewyk Sies to be re-enlisted into the service of the Honorable Company in conformity with his obtained letter of freedom, and indeed to deal further with him as His Right Honor and their Honors shall judge serviceable for the interests 63 interests of this Colony. below stood At Cape of Good Hope the day and year as above lower in my presence signed C: L: Neethling Secretary. 65 The Prosecutor ad interim here, the Honorable Gabriel Exter, serving the office of the Plaintiff in a criminal case on the one part, against the slave Januari of Macassar, belonging to the burgher Frans Hilgers, prisoner and defendant in the aforementioned case on the other part. The Plaintiff serves a written demand provided with annexes. The defendant, having heard the demand read, says he has not deserved that punishment. The Plaintiff persists in his demand and the conclusion drawn thereafter and requests justice, renouncing further productions. The Council holds this matter under advisement for circular reading. The roll being concluded thus far, the report held under advisement from the last meeting of the Prosecutor ad interim was taken in hand, regarding the Corporal Jan Klepson condemned by this Council, and in his regard the written declaration given by the First Chief Surgeon of the Honorable Company's Hospital here, concerning which it has been taken into consideration that the said Klepson, who is now judged by far not in a state to undergo the punishment imposed on him by this Council, being sent away from here as unfit, would not only possibly be exposed to a sudden death by the cramped and meager shipboard life, but could also infect others on board with his contagious disease; wherefore, to prevent both, it has been approved to place the said Klepson on Robben Island until further orders. Thursday the 17th of July 1788. In the forenoon present the Honorable Johannes Isaak Rhenius, President, and all the Members, except for the Honorable Mr. van Echten due to occupation. While the Council was convened in an extraordinary meeting today to review and sign the sentence of the slave January, the Honorable President presented to the table a certain representation already circulated among the respective members, along with annexed documents, from the Senior Merchant and Cellar Master, as well as Member of the Honorable Council of Policy, the Honorable Mr. Jacobus Johannes Le Sueur, concerning the soldiers Bernhard Christiaanse, Jan Bernhard Koningswinter, and Johannes Kuipers, who were previously placed on Robben Island but returned from there upon obtaining further indications. Concerning these persons, the said Honorable Mr. Le Sueur, in the mentioned representation, because of the dubiety that still existed regarding this matter, submitted for consideration whether, since the Most Noble Lords Seventeen have pleased to notify the government here that the Most Well-Born Lord Baron van der Linde tot Blitterswyk has been appointed as Independent Fiscal for this government, who was to be expected here shortly, it might therefore not be best to leave the pursuit of this case postponed until the hoped-for safe arrival of the well-mentioned Lord Fiscal, and in the meantime have the persons of Koningswinter and Kuypers return again to their previous confinement on Robben Island; yet giving in consideration with respect to the aforesaid Christiaanse whether, to prevent all correspondence between him and his aforementioned comrade Koningswinter, it would not be most advisable to place him separately from the other. Having deliberated upon the contents of the said representation and documents, it was approved and understood, for the reasons set forth in detail therein, to suspend this case until the expected Honorable Independent Fiscal shall have arrived here. The aforesaid three detainees, however much the Council also considers it very necessary not to place them together, nevertheless, on the grounds that there are no facilities here to keep them separate in any other convenient and secure manner, shall therefore be sent together again to Robben Island. Before the Honorable President communicated to the assembled members that His Honor had convened this extraordinary meeting at the express request of the Fiscal pro interim, the Honorable Gabriel Exter, the said Fiscal pro interim appeared in the Council, who orally made known that yesterday, by extract resolution of the Right Honorable Governor and the Honorable Council of Policy, an extract was placed in the hands of the Fiscal's Office from such report as had been submitted to the well-mentioned Council of Policy by the committee appointed by the said Honorable Council of Policy to investigate the injury caused to the Honorable Company by the former First Sworn Clerk of the Political Secretariat, Johannes Marthinus Horak, together with and alongside all the documents relating thereto, in order to initiate such proceedings against both the person and goods of the said Horak as the nature of the matter demanded, as well as to investigate regarding the other sworn and ordinary clerks of the Political Secretariat appearing in the documents to what extent they might also have made themselves guilty of any fraud or malversation, in order to act therein likewise ex officio according to the findings. That the said Fiscal pro interim, since he found this case constituted in such a manner that he maintained, in the first place, that he must directly secure the person of the said Horak, therefore requested a decree by virtue of which he was authorized to have the frequently-mentioned Horak taken into apprehension. Having deliberated upon which request and taken into consideration that the said Horak, by the aforesaid resolution, is already himself considered as someone who has made himself guilty of malversation and theft of the Honorable Company's money, and thus not the least doubt remains regarding either the deed committed or with respect to the perpetrator himself: it was therefore approved to grant the requested apprehension of the said Fiscal pro interim, and likewise that he should immediately betake himself with the court messenger to the house of the said Horak to carry this decree into execution, while in the meantime the Council would remain convened to await the outcome hereof, in order that, in case the rumors that have already spread, namely that the said Horak might have absented himself, should be found true, such further measures may then be taken as the circumstances of the case might require. The undersigned pro Interim Fiscal shows with due respect: That although the same was also ordered, pursuant to the resolution of the Council of Policy of the 26th of July recently passed, to investigate whether and to what extent several clerks of the same Political Secretariat, who signed for the receipt of recognition moneys without such having been duly delivered into the Treasury, have made themselves guilty of fraud, and furthermore to proceed against them as the requirement of affairs dictates, the Official Memorialist, however, due to a lack of the statement of those persons and sums received, which yet remain to be determined more closely upon the continuing investigation of the Honorable Commissioners qualified for that purpose, has not yet been able to proceed to this further examination. The Council, having heard the request made by the right honorable plaintiff, and furthermore having considered all that served the matter and could move their Honorable Worships, declares the maker, writer, and poster of the said infamous libel to be dishonorable and infamous, with the reservation that, whenever this scoundrel might fall into the hands of justice, he shall be punished according to his deserts; furthermore, a copy of the aforementioned slanderous writing shall be burned publicly on the scaffold in the presence of a judicial committee by the executioner. Which sentence was also approved to be made known to the public from the balcony of this Castle to the tolling of the bell in the presence of the full Council, and subsequently to be carried into execution as aforesaid. While it is further also understood that, in order to be able to convict the perpetrator should he be discovered in time, the other copy of the said pasquinade shall be filed under the Council's seal at the secretariat of of Justice. The undersigned, by order of the Honorable Worshipful Lord President, brought to the reading of the respective members a missive from the Landdrost of the colonies Stellenbosch and Drakenstein, Mr. Hendrik Lodewyk Bletterman, containing a report that Elisabeth Malan, wife of the burgher Cornet David Malan, had informed him, the Landdrost, that her husband, with whom since he, according to her statement, had been caught consorting with the female slave Sara belonging to the burgher Jurgen Radyn, had held no carnal conversation, departed on Monday night the 11th of this month from their dwelling located in Hottentots Holland, and took with him a quantity of powder and lead, together with some bedding and two riding horses, and that that very night the aforementioned female slave Sara had likewise absented herself; while the said Elisabeth Malan had also added that from what her husband had previously often said to her, she presumed that he would have gone to the banished burgher Carel Kruger; and it having been proposed by the undersigned, also in the name of the well-mentioned Honorable Worshipful Lord President, to the respective members whether, since the said Malan, through this his desertion and committed adultery, has made himself subject to justice, and with respect to the estate possessed in common between him and his wife, seeing that inevitably a division and distribution of it will have to take place, the necessary precautions ought to be taken; one might therefore deem fit not only to order the Honorable Vendue Master on behalf of the Council, since the wife of the said Malan, who currently has no legal persona, is unqualified in the absence of her husband to alienate any goods, also for that reason to suspend the voluntary sale otherwise to be held on next Monday 78. at the place of the said Malan, but whether one might not also use the precaution of commissioning the two Honorable Members of this Council, who are currently on committee not far from Hottentots Holland, to have all the goods of the oft-mentioned Malan provisionally inventoried in the presence of the Landdrost of the said district, who acts in this as the officer of justice: it was, upon considering the one and the other, deemed that the circumstances of this matter, added to the discord that had already existed between the said Malan and his wife, which at the very least would have resulted in a separation between them, make this precaution absolutely necessary, and it was therefore also decided by the majority to conform entirely with the sentiment of the Honorable Worshipful Lord President; consequently, to grant the gentlemen commissioners the necessary authorization for this performance, and also to communicate the Council's intention through the sworn clerk to the Honorable Vendue Master: of this resolution, the necessary notice shall as soon as possible be given to the gentlemen commissioners and also, in so far as it concerns the officer, to the said Landdrost at Stellenbosch. 79 The Landdrost of Stellenbosch and Drakenstein, referring to the contents of his letter dated [illegible] of this month addressed to the Honorable President, in which he declared that as soon as any sufficient proof of the two crimes mentioned in the aforesaid letter had been obtained, of which the first consisted of the crime of squandering committed by the burgher cornet David Malan Davidsz, while the latter crime consisted of a desertion along with the theft committed of a female slave belonging to the burgher Jurgen Radyn, he, the Landdrost, would then institute such action against the said Malan as the nature of the matter demanded and the laws should dictate; That on Saturday the 16th following, having received into his hands Your Honors' letter of the 15th preceding, he saw from it that by the commissioner gentlemen who were then present in Stellenbosch, the joint estate of the aforesaid Malan and his wife was to be provisionally inventoried in the presence of him, the Landdrost; which same commissioner gentlemen, together with him, the Landdrost, also proceeded to the place of the repeatedly mentioned Malan, on which occasion the wife of the said Malan denied the disclosure made by her to the Landdrost, and protested against the inventorying of her estate. That whereas the denial of the wife of the said Malan regarding the aforesaid communication made to him, the Landdrost, placed him in the necessity of immediately proceeding to obtain the necessary evidence, he also to that end obtained three statements, which he produces herewith and, referring to the contents thereof, requests this Honorable Court with due respect to examine the same, and that it may then please Your Honors to declare whether, on the basis of what is set forth therein, a decree may be granted to him, the Landdrost, by which he is authorized to summon the aforementioned David Malan Davidsz in person, to appear before this Honorable Court fourteen days from today, 80 in order to hear such demands, conclusion, or request or requests as he, the Landdrost, shall then make and take, and further to proceed according to law. Adding hereto at the same time that he, the Landdrost, regarding the conduct exhibited by the wife of the mentioned Malan, refers to the report to be made by the commissioner gentlemen who had served to record the goods of the repeatedly mentioned Malan. After which presentation, the gentlemen Van der Riet and De Wet made known that Their Honors had properly carried into execution the resolution taken by this Court dated the 15th of this month, and thus had the estate of the aforesaid Malan inventoried, but that Their Honors had also drawn up, and simultaneously produced, a record or minute of what had transpired with the wife of the said Malan on that occasion, reading as follows: Monday the 18th of August 1788. Messrs. Ryno Johannes van der Riet and Hendrik Justinus de Wet, commissioner members from the Honorable Court of Justice at the Cape of Good Hope, in the presence of the Landdrost of Stellenbosch and Drakenstein, Mr. Hendrik Lodewyk Bletterman, having proceeded to the place of the burgher David Malan situated in Hottentots Holland, and pursuant to the orders obtained by Their Honors from the aforementioned Honorable Court, having presented the purpose of the commission to his wife, she thereupon gave as an answer that, because she could not express herself well, she had put her answer in writing, thereupon handing over to the said commissioner gentlemen a certain unsigned document, the contents of which in principal entailed that she could not give her consent in the absence of her husband (who had without doubt ridden to his farm, and was expected any day) that her estate should be inventoried, the more so as she did not know that her husband had made himself guilty of a criminal deed and also had never complained about him elsewhere, at the same time requesting the protection of Mr. De Wet as father of the burghers in that regard, finally wishing to be unaccountable for all claims in this respect; which mentioned document having been returned by the aforementioned commissioner gentlemen to the aforesaid wife, and it having been added to her in reply that if she believed herself to be prejudiced, she could address herself in this regard to the aforementioned Honorable Court, and that Their Honors notwithstanding, pursuant to the aforesaid order, would proceed with the inventory, and she being subsequently asked whether she was inclined amicably to give a statement before Their Honors upon the requisition of the aforementioned Mr. Landdrost Bletterman, in such manner as His Honor should come to demand, regarding what had been communicated by her to His Honor concerning her husband, she thereupon made known that she was in no way inclined to give such a report or declaration, because nothing had been disclosed by her to the said Mr. Landdrost, but in case the Honorable Court of Justice should come to demand such from her, she would then declare according to the truth. The aforementioned commissioner gentlemen subsequently proceeded with the inventorying, and after the performance thereof having presented the same to her for signature, she initially showed reluctance to sign the same, however after many cavils, and after the mistaken idea she formed of it had been pointed out to her, she finally proceeded to do so, under protest nevertheless, of not having signed for the inventory but indeed for the stated debts. 82 After which reading, deliberation having been held on the request made by the aforesaid Landdrost and the documents submitted at the same time, the following ruling was made thereon. The Council, keeping under advisement for the present the request made by the officer representing the public prosecution with respect to the burgher Cornet David Malan Davidsz, enjoins the officer to obtain as soon as possible, and especially from the wife of the said Malan, such further evidence as may serve to support this case, in order that it may subsequently be disposed upon the request of the officer representing the public prosecution as this Council shall deem proper. And after the pronunciation of this resolution, the said Landdrost requested the Council's qualification to be permitted to examine the wife of the frequently mentioned David Malan in plenary session on such articles as had been drawn up for that purpose by him representing the public prosecution, which request was granted to the said Landdrost on account of the singular circumstances accompanying this case. The Member of this Council, the Honorable Ryno Johannes van der Riet, acting herein due to the indisposition of the Fiscal pro Interim, requests, on account of the non-appearance of the defendant, the second default with the benefit thereof and a third edictal citation against two weeks from today. Whereupon the just-mentioned Honorable Mr. van der Riet, for the Fiscal pro Interim, served a written memorial, tending to obtain a decree on account of the far-reaching, atrocious insults inflicted by the burgher Stephanus Fouché upon the Heemraden at Swellendam, Daniel du Plessis, Jan Andries Holtshausen, and Jacobus Steyn, alongside the secretary Menso Blankenstein in their respective offices, by virtue of which the officer representing the public prosecution might be qualified to cause the aforesaid Stephanus Fouché, because of the remote distance of his residence, to be summoned in person by letter under the Council's seal against a certain term to be prefixed, in order to hear such criminal claim and conclusion, request or requests, as he, the officer representing the public prosecution, would wish to make and take in the aforesaid matter upon and against him, Fouché, to answer thereto and further to proceed according to law. With due respect and most humbly, Yda Margaretha Adleda, wife of the former First Sworn Clerk at the political secretariat, Johannes Marthinus Horak, gives to know: That since the petitioner's husband had always flattered himself with that certain hope that his affair would be settled politically, he was therefore also never prepared for such means of defense as might now be of use before the Honorable Council of Justice. That he also remained in that firm confidence until, some time ago before his case was handed over to Justice, he had to learn by rumors that he was to be taken into custody, and his affair handed over to Justice, and that he would be prosecuted by the Fiscal. That he, therefore, at that moment and altogether unexpectedly seeing himself threatened with a criminal action and imprisonment, and having been advised by good, trusted friends to provide for his safety, and seeing himself then directly disabled from any means for his defense, was thus forced to keep himself retired. dared to appear before the Court of Justice to clear himself of all that has been laid to his charge, and of that which might yet be brought against him, but on the contrary has declared more than once, and even desired, that his case had rather been concluded judicially, when he would then have been able to consider all those means which might have served for his defense. That he therefore may not be considered as someone who has willfully made himself guilty of flight, since he could otherwise have done this long ago with the utmost safety, for which he had already seen himself in complete freedom for circa four months, without ever having been forbidden by anyone not to absent himself from the Caab. That the undersigned, as his wife, not knowing herself where he is to be found in order to be able to give him notice of the citations issued to him on behalf of the court, and being fearful of the detrimental consequences thereof, must therefore see herself compelled to address the council. And that the undersigned, unaware and innocent of the act with which he is accused, and having nothing else in hand than those two copies of petitions, one submitted by himself and the other by the family to the Honorable Council of Policy, therefore surrenders the same to this Honorable Council with a humble request, on the one hand, that favorable consideration and regard might be given to those means appearing therein for the mitigation and lightening of his punishment. While the petitioner, on the other hand, hereby also takes the liberty of submitting to Your Honorable's consideration how she now finds herself in that deplorable circumstance which could ever or at any time befall any mortal, as the petitioner, concerning the matter in which he is faulted, previously had not only never or at any time had the slightest knowledge or awareness, but even not the least suspicion of whatever kind, she has thus with this accumulation of disasters fallen entirely unexpectedly and abruptly, and the petitioner therefore also trusts on that ground to be able to find some succor and comfort with Your Honorable, from whom proven evil indeed receives its punishment, but innocence and blamelessness are on the other hand also protected. P7 8 have noted, or signed with their hand, betook themselves to the Honourable Company's Treasury and conducted a precise examination there, just as it also immediately appeared to them from that examination, that of some all and of others indeed the greatest part of the items stated as unpaid and acknowledged by the said commissioners in their report or in the note submitted therewith, had been paid in the Treasury. Now the undersigned asks, yet under deference and with fitting respect for the high dignity of Your Honourable Worships, whether in a matter of such great importance, wherein the total ruin of an entire family, an innocent blameless wife and children is also involved, double accuracy, double prudence ought not to have been the guides of those who were charged with this so weighty investigation, and whether thus, pursuant to their estimate, the petitioner's entire estate should immediately have to be monetized, whereas it is yet more than probable that of those enormous sums which were placed on the account of the petitioner's husband, just as with the other acknowledged clerks, many will be found paid in full in the Honourable Company's Treasury, as the petitioner's unfortunate husband, before his departure, testified to the petitioner under the most solemn assurances that the sum which he took to himself, both in lord's rights and recognition monies, on account of the scarcity of ready money prevailing here, to employ the same for the payment of the expired debts on his house and the alteration of the same, and yet afterwards, in better times, to pay again in cash into the Honourable Company's Treasury, that the same did not amount to more than at the highest taken 70 to 75,000 guilders, at the same time warning the petitioner, in his absence, absolutely not to proceed to any further payment, but in all cases to protest against it, as he had never ever enjoyed the same: While the undersigned, if it were however insisted upon, 88 would immediately, because this is a matter that concerns her so in particular, have to protest and request that commissioners from Your Honourable Worships, upon whose report, after all, justice is always done by the Court, might examine and verify the aforesaid gamekeeper's book and treasury books further and with the required accuracy, as well as that there be summoned and heard before Your Honourable Worships all the persons from whom the petitioner's said husband is known to have received monies on behalf of the Honourable Company. Above all this, Right Honourable Worshipful Sirs, the undersigned still understands that when proceedings were instituted against her property, the undersigned, whether as the attorney of her husband, or for herself privately, on account of the absence of her said husband, ought to have been summoned by the officer to hear demands and conclusions for payment of a significant sum on behalf of the Honourable Company, or else to see execution decreed thereon, whereupon the petitioner would have been able to put forward her interests, and at the same time make such remonstrances and requests as she would have deemed serviceable in her case, considering the undersigned now being aware and assured of the magnitude of the sums of money enjoyed by her husband, can by no means, at least if she does not wish to see herself, however much she recently obtained a considerable sum from her father by inheritance, reduced to the uttermost poverty, be indifferent with respect to the tantum which one would wish to exact after this. humbly, that Your Honourable Worships may be pleased not only to put into effect those means which are required to secure Your Honourable Worships with regard to the increase of the sum which is due to the Honourable Company from the undersigned's estate, so that not the least doubt remains thereof, in such a manner that Your Honourable Worships and the undersigned can rely upon it, but that even if Your Honourable Worships unexpectedly cannot resolve to postpone the sale of the petitioner's estate until then, it may nevertheless please Your Honourable Worships to grant the petitioner permission to withhold from her said estate—while the petitioner is assured that the estate will yield more than all claims amount to—for her comfort and assistance, according to her choice, some of her faithful slaves who have always served so well, as well as some necessary household furniture inevitably required by her. Which request being granted, the contents of the aforementioned petition were subsequently maturely deliberated upon, and taken into consideration that while the Council knows very well that the duty of a judge is to maintain unblemished justice at all times without respect of persons, and this Council has also always striven with the utmost care to act in all respects according to its oath and conscience, they therefore need not be animated or urged thereto by anyone, just as in granting the parate execution on the estate of the said Storak the precaution pleaded for by the petitioner has already been employed. While after consideration of all matters, it is granted by apostil on the aforementioned petition: The Council, having read this petition and considered its contents, grants the last part of the petitioner's request, namely to withhold, according to her choice, some of her slaves and highly necessary household furniture, provided that if the estate upon sale should presumably not yet yield as much as the claims filed against it amount to, the petitioner shall then immediately provide proper security for the shortfall; the Council rejecting the remainder of the request. Finally, it was made known by Mr. van der Riet, acting ex officio in the matters for the merchant and Landdrost of Zwellendam Constant van Nult Onkruijt, that the burgher Ferdinand Hartzenberg, who recently lost his life, having died intestate and left children, he therefore deemed that estate to have fallen to the Orphan Chamber of this place; which was accepted as notified by Mr. Rinnenkamp as secretary of the Orphan Chamber. After the Honourable President had communicated to the respective members present that His Honour had convened this meeting at the express request of Elisabeth Malan, wife of the burgher cornet at Stellenbosch David Malan Davidsz: the said wife of Malan then appeared in Council, requesting by a certain memorial that her estate might be released from sequestration, and that she be left the freedom to act and deal with the joint property of herself and her husband as she should see fit: but in the same writing, besides some other sharp expressions, there also being found at the close a passage whereby the said wife of Malan, in case her request should not be granted, declared to protest both against the procedure held in this matter and against the consequences and appurtenances thereof, adding that she would in no way be responsible for the loss and damage to result therefrom, and the Council being very indignant at this impertinent conduct of the aforementioned wife of Malan, it was therefore decided to grant as disposition thereon: The Council, returning this so-called Memorial, orders the petitioner to make her request by a proper, decent petition in form against the next court day, omitting the passage of protest, finding such to be very irreverent with respect to the respect due to the Council. 92 Shows with due respect the Landdrost of Stellenbosch and Drakenstein, Hendrik Lodewyk Bletterman, That on Tuesday the 12th of the recently passed month of August, in the afternoon around four o'clock, having been brought to the knowledge of the petitioner by the burgher Isaac de Vlaming that he had been requested by the wife of the burgher Cornet David Malan Davidsz. to make known to the petitioner in her name that her husband, the aforementioned Malan, had during the past night absented himself from the domicile and taken with him his flintlock musket, powder and shot, together with a bolster, two pillows, some clothing, two thongs and two riding horses, and also that the female slave of the burgher Jurgen Radyn, from the kloof-maker De Vos, where she had been given as a wet nurse, had likewise made herself a fugitive during the same night; the said Mrs. Malan having requested through him, De Vlaming, to be informed by the petitioner how matters now stood with the imminent public auction, and whether the notices by which the sale to be held on the 11th of August aforesaid had been appointed should not now be torn down; the petitioner, for reasons to be set forth hereafter, having replied in substance to him, De Vlaming: "But De Vlaming, what business of yours is it to meddle in other people's affairs?" and in order to make him leave, having also asked whether he had a power of attorney; to which he testified "no", adding: "I have done nothing more than what Aunt Betje asked of me, and misfortunes may come of it"; upon which the petitioner, asking him, De Vlaming, why he thought such a thing, he answered thereto: "God knows, or God only knows, for the Gentleman will certainly hear of it later"; so that the petitioner finally told him, De Vlaming, that even if he had a power of attorney, he could not accept such a commission from him, since the matter was of very great importance and the woman herself ought to come. That 93 That the following day, in the forenoon around eleven o'clock, the petitioner, having gone to the building being constructed for the Colony's mills, shortly thereafter was told by one of the orderly riders, who had sought the petitioner and now found him: that Mrs. Malan had arrived at the drostdy with her horse wagon, urgently needing to speak with the petitioner; the petitioner then also immediately hurried thither, and upon his arrival before the door found the aforementioned wife of the above-mentioned Malan, named Elisabeth Malan, and her brother-in-law the Heemraad Cruywagen seated on one of the benches conversing with one another; whereof the latter having departed, the first-mentioned Mrs. Malan came into the petitioner's house, into one of the front rooms, and sat down there. That the petitioner was informed in substance by the aforementioned Mrs. Malan that before yesterday during the early night, between the 11th and 12th aforesaid, she had heard a noise, but since it had happened many a time that her husband had gone out in the evening and come home at night, she had thought that he might then have come home, but when she got up in the morning and learned that no wine had yet been given out for the servants, she first had her son knock on his chamber door, and this having been done repeatedly without obtaining any answer, she had the door opened from the inside by pulling open one of the windows from outside, and then found that her husband had absented himself; and upon inspection discovered that he had taken with him his flintlock musket with his bandolier, powder and shot, together with a new pair of trousers and two pillows, and also subsequently learned that he had likewise taken with him two riding horses from the stable and two thongs from the slave house, and also that the female slave of the said Radyn had likewise absented herself during the same night, wherefore she had not wanted to wait any longer to make the matter known first to the petitioner and then to the Cape, while she also requested to know whether her imminent public auction

That the narrator, already since a year ago, had continuously been secretly informed by various persons that the offensive conduct which the said Malan was maintaining with a certain female slave Sara belonging to the burgher Jurgen Radyn, and which not only was said to have consisted in carnal conversation with that maid, but even that that maid was said to have expressed to the wife of him, Malan, that she had conceived one of those children by her husband; whereupon between him and his wife not only daily quarrels had arisen, and he had also frequently mistreated her, but even that he was said to have gone so far out of bounds as to betake himself on a certain night to the place of the aforesaid Radyn, at which place he was said to have been caught and chased away by the wife of the aforesaid Radin upon, in, or under the bed of the same maid; and that the wife of him, Malan, having been informed of this, was said immediately thereupon to have desired to go to Stellenbosch and from there towards the Cape, in order to wait for him there, whether he would want to separate from her upon certain conditions, but in the event of his remaining behind, to proceed against him to that end, from which, however, upon the advice of a relative and other friends, she was dissuaded. to institute such action against the said Malan as the laws might dictate, and that mainly for the reason that the said woman, as the narrator had been informed indirectly on different occasions, had repeatedly made complaints to various people about the outrageous and offensive conduct of her husband and the abuses he frequently inflicted upon her, and had even fled from him, and finally had taken the firm resolution to separate from him; yet each time she was not only reconciled with him again, but had also, as it were, withdrawn all her complaints. That the narrator, meanwhile firmly trusting that the said Mrs. Malan would have fulfilled the promises she made to the narrator, nevertheless found himself disappointed therein, because he was informed by the commissioners who arrived in Stellenbosch the following day at sunset; that although they had heard something by way of rumor regarding the desertion of the said Malan, they were nevertheless not aware that anything at all had been brought to the attention of the Honorable President of this assembly by the aforementioned Mrs. Malan on the day before their departure from here; so the narrator only continued to wait and see whether he would be informed on behalf of the said Radyn that his slave had also gone missing on that same night, which then happened shortly thereafter. That the representant, quickly perceiving from the behavior and the further account given to the representant by the said de Vos, that those who are aware of the principal matters of the case regarding the aforesaid Malan would attempt to obscure the truth, just as he was informed at that very same time that also the above-mentioned J.
