Right Honourable Sir and Honourable Gentlemen. The defendant humbly requests to be excused from answering the articles, or else to be granted a copy before being required to answer. However, if the same points happen to be directed against her husband, then to be excused from the responses, as she has no complaints against her husband, and if the account given to the prosecutor may have given cause for this, the defendant declares that it occurred through ignorance, as such was not her intention, for she holds every respect for her husband up to this very moment — (:was signed:) E: Malan /:in the margin:/ Exhibited in Court on 4 September 1788. — The Prosecutor thereupon declares to be very surprised, that whereas /: a messenger had come to him in the name of the defendant only this morning, and had made known that the defendant had out of innocence and ignorance indeed denied having made her complaint concerning the desertion of her husband to him, the Officer- Prosecutor, yet that she now regretted such, and that she also intended to confess this in full Council and to ask pardon on that account, desiring only to be excused from answering the articles, the defendant nevertheless, by her aforementioned submitted statement, seems to adhere once again to her previous sentiments, and he further leaves the request made by the defendant to the Council's judgment. The defendant answers to both points that she is innocent, and that she had indeed given notice to the Officer-Prosecutor of the situation of her husband, but had not at all complained about her husband, saying further that she had not given notice to the Officer-Prosecutor as Landdrost, but had merely spoken to him about it in private. Against Mrs. Elisabeth Malan, Wife of the burgher Cornet David Malan David's son, called on the other side, in order to hear the demand and conclusion, to answer in full session to such articles as shall be presented to her by the Officer-Prosecutor. The Council, taking the proposal made by the defendant into consideration, and at the same time ruling upon the representation submitted by the Officer-Prosecutor and its annexes, grants the aforementioned Officer a writ of edict against the burgher Cornet David Malan, David's son, with a term of four weeks. — After which, by the said Wife of David Malan, David's son, the following petition was presented. — To the Right Honourable Johannes Isaak Rhenius, President, as well as the Honourable Members of the Council of Justice of this Government. - Right Honourable President, Honourable Gentlemen. The undersigned, finding herself in the utmost necessity to turn with due respect to Your Honours, for the reason that the husband of the undersigned, the burgher Cornet David Malan, David's son, had requested by posting placards to hold a voluntary auction on the 18 of this month, and notwithstanding that, as the undersigned maintains, he rode out shortly beforehand, presumably having received some messages from his cattle posts, or some other impediments which he wished to conceal from the undersigned. — The undersigned, having no doubt of the return of her husband, and because the auction had been arranged with the mutual consultation of herself and her said husband, she thought to let it proceed, or indeed intended to await the final moment or her husband's return, so as to be able to cancel it at any time, even if the auction clerk and messenger were already on the scene. That to her utter surprise, the undersigned had to experience that an interdict against the proceeding of the auction was placed by the Landdrost, and presumably, upon his representation submitted to Your Honours, her estate was taken under Judicial Sequestration, whereupon the inventory was taken by honourable commissioners from this honourable Council. — than . 6

The undersigned cannot fathom what gave rise to all this, but it may be that one or other party of anxious sureties made very unfounded and needless difficulties concerning the state of the estate and the absence of her husband. However, the undersigned takes the liberty of demonstrating to Your Honorable Worships in the clearest manner the groundlessness of their contention; from the attached deeds of the creditors of this estate, it will be evident to Your Honorable Worships that they make not the slightest difficulty regarding payment, but are willing to leave their principal sums with the undersigned, so that this supposition cannot stand. Regarding the absence of her husband, the undersigned will briefly say that she, subject to correction, trusts that one cannot judge thereof before and until he returns. Indeed, what reasons could be found, since the undersigned quietly trusts that her husband has not made himself guilty of any matters to make himself a fugitive or to save himself by flight, and who then shall in the least doubt his return, for, be it said with all respect, he who has done no evil needs to fear no evil. The undersigned will spare taking up Your Honorable Worships precious attention with further remarks, the more so because she trusts that all the aforementioned will be evident to Your Honorable Worships and Your Honorable Worships will also make no difficulty in leaving the estate to the administration of the undersigned, since the creditors agree to let the principal sums continue under the undersigned, and she moreover is still prepared to provide sufficient security for her administration, and will intervene for this with her sureties, the Reformed Church having also agreed to let the principal sum in the estate continue; for which reasons the undersigned most respectfully requests that it may please Your Honorable Worships to release her estate from sequestration, and that she, the undersigned, according to law and equity, because her husband is not present, may be permitted during his absence to be able and allowed to administer her affairs herself, as she shall find useful and permissible for the benefit of herself, her husband, and children. Underneath stood: Which doing etc. Was signed: E: Malan In the margin: Exhibited in Court on 4 September 1783: Which having been read, and the officer having been heard on its contents, the same advanced that, as regarded the request made for the lifting of the sequestration, he fully concurred therein, the more so since the criminal court roll of this Council, for some years past, or rather since the disputes between the aforesaid David Malan and his wife have existed, showed manifold proofs of the licentiousness of the slaves and the misfortunes and irregularities resulting therefrom, just as one would now also, if they were still to remain without direction or supervision, have to fear those same and possibly more disastrous consequences; while he, the Landdrost, nonetheless believed the matter to be so constituted that above all nothing of the communal estate in this case ought to be alienated by the wife of the said Malan. All of which having been maturely deliberated upon and everything worthy of consideration in this matter taken into account, the following apostil was granted on the said petition of the aforesaid wife of the Cornet David Malan Davidsz: The Council, having read this petition and considered its contents, and having heard the proposal of the officer, lifts the sequestration made and hereby qualifies the burghers David Malan the elder, Stephanus Malan, Jacob Malan, and Jan Andreas Grundeling, to administer, pursuant to their offer, together with the petitioner, the estate possessed by her in community with her husband, until the end of this matter; provided, however, that they first provide sufficient security both for the proper administration of the estate and that in the meantime nothing thereof be alienated or encumbered, and execute a formal deed thereof, permitting

110 Member of this Council Mr. Ryno Johannes van der Riet, appearing due to the indisposition of the Officer Plaintiff, submits a written claim furnished with 3 annexes, concluding as stated at the end of the same. The defendant, for her answer, says that her husband himself is the cause of her downfall, having abandoned her during the late war, when during the most expensive times she had to pay dearly for a room, without supporting her as every husband is obligated to do, so that she was driven to it by necessity; while her husband furthermore crept into bed with his own female slaves and Hottentot maids, and had beaten and mistreated her, requesting that the Council please take these circumstances into consideration in her favor. The Officer Plaintiff persisting in his claim for replication, and the defendant for duplication, renouncing further productions. The Council, having read the written criminal claim and conclusion submitted by and on behalf of the Officer Plaintiff upon and against the defendant, and having considered everything that served the matter and could move Their Honorable Worships; administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, condemns the defendant Susanna Petronella Beyers, after having sat on water and bread for the period of fourteen days, to be exposed before the church door on the first Sunday thereafter, both morning and afternoon, with a letter upon her chest on which shall be written adulteress, with condemnation of the defendant in the costs and expenses of justice, and dismissal of the further or otherwise made claim and drawn conclusion of the officer. The Fiscal pro interim, the Honorable Gabriel Ester, Officer Plaintiff on the one part, against Susanna Beyers, wife of the burgher Johan Godlieb Joohn, defendant on the other part, to hear claim and conclusion made pursuant to the Resolution of the Honorable Worshipful Council of Justice dated 27 August 1788 in a case of committed adultery, to answer thereto, and further to proceed according to law. Permitting the Council, however, the aforesaid qualified persons to sell the country's produce to the best advantage of the estate, provided proper account is kept of everything. The ditto 111 The Messenger, entering, reports that the defendant is not present. The aforesaid Mr. van der Riet, due to the indisposition of the Officer Plaintiff, requests, on account of the non-appearance of the defendant, the third default with the benefit thereof, and to be allowed to serve the intendit in fourteen days. The Council grants the Officer Plaintiff the requested third default, and for the benefit thereof, debars the defaulting and absconding defendant from all peremptory exceptions and defenses as well as other benefits which, appearing, he might have availed himself of in law, and furthermore a fourth citation ex superabundanti ad quatuordecim to then serve the intendit. The Messenger, entering, makes report that the defendant has not appeared. The aforesaid Mr. van der Riet, for the Fiscal pro interim, requests, on account of the non-appearance of the defendant, the second default with the benefit thereof, and a third edictal citation against fourteen days from today. The Council, due to the non-appearance of the defendant, grants the Officer Plaintiff the requested second default with the benefit thereof, and a third mandate by edict against two weeks from today. Hereafter, by the assistant of the Honorable Company Jacobus Vercueil, properly authorized on behalf of the wife of the burgher Jan Smit van Dillenburg, confined to Robben Island, the following petition was presented: The assistant of the Honorable Company Gust Mollerstroom, who was stationed at the Political Secretariat, defendant in person and for the second time on the other part, in order to purge his first default and furthermore still to come and answer for the second time regarding his committed malversations and theft. The aforesaid Fiscal pro interim, the Honorable Gabriel Ester, Officer Plaintiff in a criminal case on the one part, against the former first sworn clerk at the Political Secretariat, Johannes Marthinus Horak, defendant in person in the aforesaid case on the other part, to purge his first and second default, and furthermore as on the first part to come and answer regarding his committed malversations and theft. 114 For the Interim Fiscal that the Prosecutor Officer, having been informed by the former Bookkeeper Mr. Petrus Albertus van der Riet at the beginning of this month of September that gradually over a short period of time 11 silver spoons, 5 ditto forks, and 3 knives with similar handles, as well as one small and 2 large salvers, had gone missing from him, the Prosecutor Officer could not fail to make this known immediately as far as possible, so that upon notice of such silverware, information thereof might be given to him; that following this, the burgher Johan Hendrik Smit informed the Prosecutor Officer the next day that he had bought the aforementioned silver from a certain Werkstad, and the latter from a soldier of the Battalion, whereupon the Prosecutor Officer decided to place both the one and the other of those persons provisionally under civil arrest, and furthermore to take the necessary information regarding the matter. That pursuant thereto, and from the statement given before the Commissioner Gentlemen and the general inquiry made, the corpus delicti is fully established, and that the above-mentioned soldier Johan Hertel, who nonetheless insists absolutely that he found this silver, must in all respects be guilty of the theft thereof, or indeed be the perpetrator himself; thus the Prosecutor Officer found himself necessitated to act ex officio against the said Johan Hertel in the aforementioned case. has fallen significantly behind with cattle, to such an extent that the petitioners saw no chance of fully satisfying all their creditors, and have already been pursued by some, indeed to such a degree that their estate was executed, whereby the same came into the hands and administration of Your Honourable Worships, which step is the most desperate that could happen to the petitioners in their lifetime, and whereby they both found themselves in the utmost turmoil of emotional passions, when the Honourable Commissioners, assisted by the same, inventoried their goods; first, by the female petitioner here at the Cape in the absence of her husband not only failing to receive them properly, but out of an extreme confusion inflicting several evil and impermissible insults upon the said Honourable Gentlemen; and in that fury making some incorrect reports to her husband the petitioner upon his return home, which, added to the petitioner's already extreme agitation, brought him still further and almost to a frenzy, so that he received the said Honourable Commissioners with no less coolness during the inventory on his farm, and yielded to them in their official capacity; regarding all of which the petitioners were summoned before Your Honourable Worships at the last court session, the matter being found by Your Honourable Worships to be so aggravating that Your Honourable Worships placed the same in the hands of the Fiscal pro interim, whereby the petitioners anticipate nothing other than being afflicted with a criminal action in their already calamitous state. While at the same time a missive from the burgher Johannes Andreas Grundeling was delivered to their Honors there, whereby he excused himself for not being able to be present at the taking over of the estate, but declared nevertheless that he was satisfied with whatever would be performed by their Honors; just as the aforesaid Stephanus Malan also verbally assured their Honors at that time that the said Grundeling was prepared, whenever he had to sign a deed, to proceed immediately towards the Cape for that purpose. The Council, having read the written claim and conclusion of the ex officio Prosecutor together with the documents produced therewith, and having also paid attention to everything that served the matter and could move Their Honorable Worships; administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, sentences the defendant Mentor of Mozambique to be soundly scourged by the Caffres and to be judicially sold for the account of his mistress, with condemnation in the costs and expenses of justice, and dismissal of the further or other claim made and conclusion drawn by the officer. The Pro Interim Fiscal here, the Honorable Gabriel Egter, ex officio Prosecutor in a criminal case, on the one side, against Mentor of Mozambique, slave of the widow of the late burgher Willem Versfeld, prisoner and defendant in the aforesaid case, on the other side. After the closing of the roll, the burgher Lieutenant Jonas Albertus van der Poel appeared before the Pro Interim Fiscal in the Council, making known that his wife, on account of indisposition, was unable to appear in person and thus to comply with the order made upon his petition presented at the last meeting, but that he, however, both for her and for himself, begged pardon of this Council and the Commissioner Gentlemen for the insult done to them, adding the testimony that everything occurred with a confused head caused by the accumulation of disasters, and an earnest request that this might also be forgiven him for that reason; while in the future he would not only guard against such insult, but also take care to show all those who are placed over him such respect as his duty demanded of him. Upon which declaration, the said van der Poel having been further seriously warned by the Honorable Worshipful Lord President to conduct himself very strictly according to this testimony made by him in full Council, or that otherwise one would counter his impudence with such efficacious means as the laws have established with regard to such refractory and malicious inhabitants, the same thereupon departed again from the meeting. And furthermore, there being brought to the table the representation submitted at the last meeting by the Pro Interim Fiscal with respect to the country people who are to give a declaration in the case of the former First Sworn Clerk at the Political Secretariat Johannes Martinus Horak and Assistant Möllerstroom, and held under advisement until today; it was therefore deliberated thereon and at the same time taken into consideration the manifold inconveniences of summoning all the same country people, many of whom reside in the far distant district of Graaff-Reinet, within a certain fixed term, whether by the judicial subpoenas requested by the ex officio representative or otherwise hither; considering that thereby not only much time would be lost, and thus the payment of the questionable moneys from the estates of the said Horak and Möllerstroom into the Honorable Company's treasury would be greatly delayed, but even the country would be made unsafe by a summon of so many residents, and exposed to the robbery of the Bushmen and otherwise; while in addition the aforesaid estates would also have to bear heavy costs on this account; for which reasons it has been judged best and resolved in this matter to send to the three respective Landdrosts of the outer districts copies of the aforesaid list produced in Council of such country people who have handed over their overdue recognition moneys to the sworn or ordinary clerks at the Political Secretariat, of which, however, no moneys have been received into the Honorable Company's treasury, and at the same time the

to write to the Landdrosts of the Colonies Zwellendam and Graaffe Reinet, to summon as soon as possible, in accordance with the aforesaid list, all the country people residing in their district to their drostdies, and there to have depositions taken at the requisition of the Fiscal's office, as well as to have the same depositions sworn to before commissioned Heemraden, provided however that this authorization with respect to the aforesaid Drostdy Swellendam shall not be drawn into any precedent for the future, but must cease immediately after the holding of these inquiries; whereas with respect to the Landdrost of Stellenbosch, notification shall only be made, because it is almost the same to the country people whether they come to make depositions at the aforesaid drostdy, which is scarcely five hours from this capital, or here, to send Cape-wards both the persons listed on the aforesaid list who are found on the occasion of the impending Burgher Exercise and weapon inspection at his drostdy, and also to write to the inhabitants living under his district to come up here as soon as possible to give depositions; and the necessary notification will be issued on behalf of this Council to the inhabitants living under the Cape district for that purpose; whereas in the meantime, of the persons who must give testimony regarding the Lord's Right: because most of them reside here at the Cape and in the vicinity, their depositions must also be taken here at the requisition of the Officer of Justice. — Lastly, the Honorable President communicated to the Council: that the Fiscal pro interim here, the Honorable Gabriel Exter, had brought to His Honor's attention that the burgher Pieter Heinkes, having punished his female slave Louisa of Mallebaar in an unduly severe manner, he, the Fiscal pro interim, had on that account settled with the same Heinkes for a sum of 200 Rixdollars; but at the same time it being reported to the Council by Messrs. van Echten and Smits that their Honors had duly inspected the aforesaid female slave and then found that she had been mistreated in an inhuman manner, such that not only her buttocks from behind, but also the thighs on both sides up to the groins, revealed diverse holes, to such an extent that their Honors testified never to have witnessed the marks of such an excessive mistreatment; while their Honors were also informed that, notwithstanding the aforesaid cruel mistreatment, the Fiscal pro interim had nevertheless seen fit to send the aforesaid female slave back home to the said Heinkes after the settlement: it was therefore, after deliberation on this matter, approved to provisionally consider the aforesaid settlement as not done, and to order the Fiscal pro interim to have the same female slave brought back at the very earliest, as well as to summon him, the Fiscal pro interim, to appear in Council at the next meeting and to be heard on this matter. — Below stood: At Cabo de Goede Hoop, day and year as above. had given notice, and the same female slave had already been inspected by the gentlemen commissioners, had betaken himself to him several times and requested him, out of consideration for his impoverished circumstances and to prevent heavy expenses, not to involve him in a lawsuit; that he, the pro interim Fiscaal, on that account, and because of the repeated entreaties of the said Heinkes, had allowed himself to be persuaded to settle this matter with him for 200 Ryxds, and the more so because the said female slave, who was insolent by nature and had thereby given her master much cause for displeasure, had not died from the mistreatment, and also that the Instruction of the Fiscaal permits a composition not exceeding the sum of 200 Ryxds without a decree of the judge being required for such a composition; while he, the pro interim Fiscaal, moreover had indeed returned the often-mentioned female slave to the aforesaid Heinkes, but under the express condition that he must sell her as soon as possible. Which matter having been deliberated upon, it was noted that, although the said pro interim Fiscaal, pursuant to the 13th article of the Instruction of the Fiscaals, is permitted to settle by composition such fines and breaches as do not exceed the sum of 200 Ryxds, the far-reaching mistreatment by the aforesaid Heinkes can nevertheless never be placed among those breaches intended in the aforesaid article of the just-mentioned Instruction; since such mistreatments certainly belong among those crimes regarding which the correction, according to the finding of the facts and in proportion to the mitigating or aggravating circumstances, can be extended by the judge himself even to a corporal punishment, so that no officer can or ought to be granted that power and authority, when he merely settles his fine up to the aforesaid sum of two hundred Ryxds and no higher, thereby to impede the judge or deprive him of the power to counter the cruelties of a master with respect to his slave through a judicial sentence, and to let such unfortunate victims of the malice of their masters experience that justice which they may reasonably expect from the impartiality of a neutral judge. However, having taken into consideration in this regard the impoverished circumstances of the aforesaid Heinkes, the insolence of the just-mentioned female slave, and also that the same female slave is not without hope of being completely healed and restored from the blows inflicted upon her, even so that there remains no fear that her health will have to suffer the slightest impairment thereby: thus, for these reasons, the aforesaid composition has been approved by the Council for this time, without consequence however for the future, with this express stipulation nevertheless, that the said female slave must be sold as soon as possible by the aforesaid Heinkes, either publicly or privately, on the condition that she may never again come under the power of him, Heinkes; the pro interim Fiscaal also being required to ensure that a proper transport of the said slave is passed at the secretariat of this Council under the aforesaid condition; while it was also deemed fit to instruct the said pro interim Fiscaal henceforth to conduct himself strictly according to his aforesaid Instruction regarding compositions, and by no means to make the same applicable to such offenses as those for whose composition, as also in this case, the decree of this Council is unavoidably required. After which, the documents and records having been brought to the table that served in the lawsuit initiated by the pro interim Fiscaal upon and against Gerrit Blikman, surgeon of the ship Dregterland, residing here, defendant in criminal proceedings, the Council, after consideration of everything that merited reflection and could move their Honors, administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, denied the plaintiff in criminal proceedings his claim made and conclusion taken upon and against the defendant, condemning however the defendant, for reasons their Honors had thereto

Whereupon by the aforementioned Mr. van der Riet in his aforesaid capacity, request was likewise made, and since he was informed that the writs dispatched by letter under the Council's seal on the 7th of February last for the summoning of the burgher Louis Cotzee and his wife Johanna Pienaar, as well as the burghers Philip Potgieter, Johannes Jansz van Rensburg, and the wife of the burgher David Botha, were not delivered to the Landdrost at the aforementioned residency, and the same would thus apparently have gone missing, that the aforementioned persons might now be cited de novo, for the purpose as laid down in the aforesaid summonses except the aforesaid wife of the burgher David Botha, who, having meanwhile been at this capital, had already given a declaration, and this on a term of five months reckoned from today: which request is granted to the aforesaid acting officer. Subsequently appeared in Council the above-mentioned burgher Louis Cotzee, making known that he, having kept himself in person at this capital ever since the 24th of January last until now, in expectation that the proceedings which had been initiated on and against him by the pro Interim Fiscal here, the Honorable Gabriel Exter, on account of the affair of the Landdrost of Graaffe Reinet, Morits Herman Otto Woeke, would make progress, has had to experience that, although he had already answered before the delegate gentlemen to the interrogatories presented to him on behalf of the officer, the said pro Interim Fiscal nevertheless delayed these proceedings to such an extent until now, that he, Cotzee, having to remain continually at the Cape and spend his money here, came to suffer much damage thereby: with the request that this matter might nevertheless be proceeded with as soon as possible. Deliberation having been held on which altogether reasonable request, it was resolved to enjoin the pro Interim Fiscal to proceed without any further delay with the prosecution of this trial, which has already been placed in his hands for more than eight months now, in such manner as the nature of this case comes to require. How he, the petitioner, on the last court day attempted, by humble request to Your Honors, to obtain a suspension regarding the edictal citation by the Landdrost of Stellenbosch and Drakenstein, ex officio, against the petitioner's son, David Malan, Cornet of the burgher cavalry at Stellenbosch aforesaid, on the grounds that according to the law, whoever it may be, even the irrational animals ought to have their defense, which originates from divine and natural law, as is taught in the Mosaic laws, Exodus 21 verse 13, and the aforesaid defense should not be taken from the irrational animals, much less from man, as is taught in Carpzovius Criminal Practice, part 1, title 28, number 3, and part 3, title 105, number 23, and according to the Utrecht Consultations, part 2, consultation 125, a defendant in person, even though bodily apprehension has already been decreed against him, NB, may through an attorney propose his dilatory exception, and in such a case the officer cannot request defaults; and by Mr. Simon van Leeuwen in his Criminal Process, part 2, number 2, it is clearly taught that someone who is a fugitive, having been summoned in person and not appearing, may through an attorney, against the requested defaults of the officer, give reasons for his remaining away and make any request, whether to propose dilatory exceptions for postponement, etc., and it is there very clearly stated and especially permitted when a father comes to speak for his son and a son for a father on behalf of the summoned party; with which having now demonstrated that an accused always ought to have his defense, which according to the law cannot be taken from him; and having demonstrated by the law just mentioned that the petitioner's said son, on account of his distant absence, must be ignorant of what is being undertaken against him by the ex officio Plaintiff, and consequently in no state to think of or about his defense, and thus according to the course of the roll of Your Honors, on account of his ignorance, is deprived of everything. To the Honorable Johannes Isaak Rhenius, President, together with the other Gentlemen Members of the Honorable Council of Justice of this government. Honorable Sir and Gentlemen. In compliance with your Honors' highly esteemed resolution granted on the 30th of the recently passed month of October upon the petition submitted on the same day by the elder of the Zwartland Church, David Malan the elder, as father, and Elisabeth Malan, as wife of the fugitive Cornet of the Burgher Cavalry at Stellenbosch, David Malan, David's son, and of which a copy was delivered into the hands of the undersigned, in order to serve his considerations thereon within the period of fourteen days; the undersigned will take the liberty to remark beforehand: That when, upon reading the said petition, he observed that what was cited at the beginning thereof from the designated criminalist Carpzovius was entirely misapplied to the present case, he deemed it unnecessary, on account of the short time allotted, to occupy your Honors' attention with a detailed argument thereon, but rather to proceed immediately to his considerations; while he nevertheless fully acknowledges that the bonds of nature from a father to his son and a wife to her husband, and vice versa, impose the obligation to employ every means for their rescue and preservation. And as the undersigned in the first place believes that the terms by which the aforementioned David Malan, David's son, was summoned were expressly fixed by your Honors at four weeks, so that he would not be able to pretend any ignorance of that summons, nor of the crimes charged against him therein, the undersigned conceives that the course of these proceedings cannot well be departed from, unless well-founded reasons intervene which, by law, make any suspension, however slight, necessary. For the examination of such reasons, the undersigned believes he will find occasion, by demonstrating in the second place: that the reasons upon which the petitioners believe their request should be taken into consideration cannot afford sufficient grounds for granting the 139 same. If one only examines the course of the proceedings from the beginning down to the present day with the slightest accuracy, one will find that, immediately at the beginning, the petitioner declared to the delegated Commissioners from this Honorable Council that her husband had departed for his cattle farms situated in the district of Graaff-Reinet in order to attend to his affairs, and that she was also expecting him from there daily; and thereafter, as the undersigned believes, even attested to this in this Honorable Council, either orally or in writing. The petitioners can certainly not deny either that they have made every effort, in a direct or indirect manner, to bring the proceedings initiated by the undersigned in his official capacity to the knowledge of their son or husband; they did, after all, dispatch a certain Warnick with a slave and two riding horses in hand to the aforementioned district for that purpose in the past month of September, and very likely also with the objective of inducing him to return; besides which the undersigned, for his part, already in the month of August, on two different occasions, in view of the then presumptive absence of the Landdrost of Graaff-Reinet, Mr. Woeke, gave notice of these matters to the secretary of that colony, and on the 10th of September aforesaid, upon dispatching the edictal citation, at the same time requested him that, in case the fugitive David Malan, David's son, together with the woman Sara Zegelders, named in the lawsuit, should appear in the aforesaid district, he should cause them both to be arrested and sent up. If, therefore, the said Malan resides on his cattle farms or anywhere else in the aforesaid district, then it is indeed beyond all dispute that he cannot pretend the slightest ignorance of the proceedings initiated against him by the undersigned. And if one assumes the contrary, then it remains an undeniable truth that he is a fugitive, and then it is proven as clear as day that the request made by the petitioners ought not to be taken into the slightest consideration. Finally, the undersigned considers it his duty, for the refutation of Question 28, No. 3 of Part 1 of Mr. Carpzov's Practica Criminalis—cited so absurdly and futilely by the drafter of the petition, as it deals with the entire question of self-defense and wherein that consists, together with the consequences thereof—to present, as briefly as he can in the third place, the reasons why it is utterly impossible that a defendant may be assigned to a criminal who is absent, as the aforementioned Carpzovius teaches throughout Praxi Criminali, Part III, Question 105: 1st, because the defense must be completely ignorant of the crime committed by the absentee; and how can he then defend his case? 2nd, because it is of principal importance to the judge to obtain from the mouth of the criminal the confession and circumstances of

140 to learn from him regarding his crime, in addition to which comes the demeanor, expression, and gestures of the criminal, from which not infrequently much can be deduced. II. That the defender, even if he has already pleaded, cannot undergo the sentence to which the criminal might be condemned, and thus thereby the dignity of the Council would be violated and the entire sentence rendered illusory. However, Your Honorable Worships are requested, with your usual attention, to pay particular heed to No. 29 of this same question, in which Your Honorable Worships will most clearly perceive that it is indeed permissible for a criminal who is absent, even in criminal cases, to be assigned a procurator or defensor /:defender:/, who may state the reasons for the absence of the guilty party and defend his innocence, so that the absent person is not condemned but the sentence is postponed, if the judge shall have approved those reasons as correct /:the contrary of which has already clearly been shown above in the second place:/. In so far, a defender may indeed be granted to the absent criminal, but not as far as the main cause is concerned, nor that, even if his submitted excuses were correct, the absent party could nevertheless therefore be acquitted. And such a defender must then submit these reasons for the absence of the criminal before the Litis Contestatio. Furthermore, Your Honorable Worships are requested to turn your eyes to No. 81, 82 of this same Quest. CX, in which Your Honorable Worships will find that a father, for his son who is criminally accused of a manslaughter, may not only appear for his interests, but may also intervene as the defender and excuser of his absent son. For which opinion our Carpzov cites various doctors there, yet from the following number it appears that later this opinion was somewhat departed from, so that a father may indeed present and demonstrate the defense and innocence of his absent son, but that he may not take his absent son's case upon himself, nor put himself in his place, nor act in an ordinary trial as defender of the criminal and answer to the accusation, so that, namely, by the sentence and the staff pronounced against the absent party, justice would thus not be frustrated. After which reading it was resolved to place the action, under which the burgher Louis Kotze comes to lie in case of accused adultery, likewise into the hands of the pro interim Fiscal, in order to proceed in this regard on and against the aforesaid Kotze in such manner as he shall find proper ex officio. Furthermore, it was reported by the court messenger that the wife of the burgher Stephanus Fauche was present before the Council Chamber, he having been summoned in person against today by missive under the council's seal, pursuant to the decree issued upon the memorial submitted here on the date of 21 August last by the pro interim Fiscal; who testified that her husband had received the summons, and that she, holding a power of attorney from him, would defend his case; but whereas the mentioned Fauche has been summoned criminally in person, and thus cannot let any representative act for him in this matter; it was therefore resolved to dismiss the aforesaid wife of Fauche, and to issue a second citation against the mentioned Fauche to appear in person before this council three months from today, or indeed on the 5th of the coming month of February, and this on pain of bodily apprehension. But taking into consideration herewith that this case could not be brought onto the roll because no certificate of the service of that citation was sent by the Landdrost of the Colony of Swellendam, notwithstanding that this was so explicitly commanded to him, and that this is moreover not a single instance that such negligence of the aforesaid Landdrost has come before the Council, but that through his inattention in this matter the course of justice has already repeatedly been impeded and confusion caused; as among other instances several examples took place only recently, on the occasion that, upon the own requisition of the same Landdrost, a summons by missive was requested on 12 June last by the member of this Council, the Honorable Ryno Johannes van der Riet, against that burgher Carel Sterrenberg, as well as with respect to the summons issued under the 29th of May last against Susanna Holtshausen, wife of Jacobus Steyn Jacobusz, both of which persons appeared on the appointed day, without any report of the service of those citations ever having been received; it was therefore decided to make known once more to the mentioned Landdrost by missive the Council's fair indignation and displeasure over this conduct, and to hold before him very earnestly that if such negligence should come before this Council once more, then such measures will be taken as are suitable to compel him, the Landdrost, to the better observation of his duty. Pursuant to a missive dated 2 October last, received by me from the Right Honorable Council of Justice, containing a list of names of such persons who have paid their arrears of recognition money to the First Sworn Clerk and the Assistant at the Political Secretariat, Johannes Marthinus Horak and Quist Mollerstroom, and of whom such as might be present here at the recently concluded burgher military drill, and all others who fall under the jurisdiction of Stellenbosch and Drakenstein, ought to be sent Cape-wards by me; I have the honor to communicate in the most humble manner to Your Right Honorable that of the persons made known on the aforesaid list, only two were present here at the burgher military drill, both of whom were also ordered by me to proceed Cape-wards in order to give a declaration on account of the abovementioned; while of the rest, all whose places of residence could with any possibility be found out by me have been notified in writing to be present at the Cape for the frequently mentioned purpose on a certain day determined according to the proximity or far distance of their places of residence, of which a list having also been drawn up by me, I take the liberty of presenting to Your Right Honorable herewith, whereby I have at the same time made known those already known to me to be deceased and one banished. The Secretary Mr. Neethling continually being indisposed (as I have been informed), and because many of the summoned people will probably not know to whom they must report at the Cape, I have taken the liberty to address them all to Mr. Ryneveld; to the rest falling under this jurisdiction, I shall not fail to make the necessary written notifications as soon as I shall have found out their places of residence or stay, regarding which, however, great difficulties arise, because some of them have their names stated incorrectly on the list, and others again, according to the names made known on the list, cannot be found out to this day. Thursday the 27th of November 1788. In the forenoon, present the Honorable Johannes Isaak Rhenius, President, and all the Members, except Mr. Mappa due to indisposition. The Merchant and Landdrost of the Colonies of Stellenbosch and Drakenstein, Mr. Hendrik Lodewyk Bletterman, ex officio Plaintiff in criminal matters, of the one part, against The Cornet of the Burgher Dragoons at Stellenbosch, David Malan, son of David, Defendant in person, of the other part; in order to clear his First and Second defaults and in person to purge and answer for his malicious desertion, the abduction of a female slave, and committed adultery. The Messenger, entering, reports that the Defendant is not present. The Member of this Council, Mr. Ryno Johannes van der Riet, acting on behalf of the Merchant and Landdrost of Stellenbosch and Drakenstein, Mr. Hendrik Lodewyk Bletterman, requests, in view of the non-appearance of the Defendant, the third default with the benefit thereof, and furthermore that the Defendant and fugitive be declared precluded from all declinatory, dilatory, and peremptory exceptions, defenses, and remedies that he might otherwise have been able and permitted to put forward had he appeared, and furthermore a fourth summons by edict and superabundantly against six weeks from today; in order then to see an Intendit served with the verification thereof, as well as to hear sentence pronounced thereon, with notice. The Council grants the ex officio Plaintiff the requested third default, and further the benefit thereof, precludes the Defendant, defaulting and fugitive, from all peremptory exceptions, remedies, and defenses, as well as other benefits which he, appearing, might have somewhat availed himself of in law, and furthermore grants a fourth citation superabundantly against six weeks from today, to see an Intendit served with the verification thereof, as well as to hear the sentence pronounced thereon, with notice. The Burgher Jacobus van Leeuwen as attorney for fellow Burgher Jan Barendse, Plaintiff, against The Burgher Daniel Hiebner, Defendant; in order, upon his submitted answer, to hear renunciation of further productions. The Member of this Council, Mr. Ryno Johannes van der Riet, due to indisposition of the ex officio Plaintiff, renounces further productions; the Assistant Jacobus Vercueil, as attorney for the Defendant, says that he likewise renounces and leaves the matter to the judgment of the Council. The Council holds this case for circular review in advice, after the statements have first been re-examined and sworn. The pro interim Fiscal here, the Honorable Gabriel Exter, Plaintiff, of the one part, against Jan Barendse, Defendant; in order to serve an answer to his submitted claim. Van Leeuwen produces his written answer, furnished with annexes. The Member of this Council, Mr. Ryno Johannes van der Riet, due to indisposition of the ex officio Plaintiff, acting for the same, says that he renounces further productions. Van Leeuwen requests to add some more evidence to this trial, stating that he will then likewise renounce. The ex officio Plaintiff advances in response that the Defendant has had enough time and has even already obtained the statements, and has been sufficiently capable of properly equipping himself: requesting therefore a forfeiture of evidence. The Council orders the Defendant to deliver his evidence to the Judicial Secretariat within 24 hours: further holding this case in advice after the re-examination and swearing of the reports and statements that have served herein. The roll having proceeded thus far, it was brought into consideration to the Council by the Honorable President whether one should now proceed to the sentencing of the proceedings, already circulated and read by the respective Members, instituted by the pro interim Fiscal against the former First Sworn Clerk of the Political Secretariat, Johannes Marthenus Horak and August Mollerstroom; or rather, in consideration of the fact that the Officer is currently still busy obtaining the necessary statements pursuant to the resolution taken by this Council on that date, and that these documents absolutely ought to be added to the trial before the sentencing of these two cases, and that one ought to wait some time longer for this: it has therefore been judged best to suspend the sentencing of these two cases until all the statements to be obtained have been properly re-examined and, as far as possible, sworn, produced in the Council, and circulated with the trial among the respective Members. to move, so the Council, administering Justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, has condemned the prisoner April of Bengal, as their Worships condemn him hereby, to be brought to the place where criminal sentences are customary executed here, there to be handed over to the executioner, and after having stood exposed under the gallows with a rope around his neck, tied to a post, to be severely whipped on the bare back with rods and thereupon branded, as well as to remain banished for the term of his life to Robben Island in order to work on the Honourable Company's public works, with condemnation of the prisoner in the costs and mis-en-cause of Justice, and rejection of the further claim made and conclusion taken by the officer. underneath stood In the Castle of Good Hope day and year as above lower / present with me / signed J G S: van Ryneveld sworn Clerk. — Thursday the 11th of December 1788 In the forenoon present the Worshipful Lord Johannes Isaak Rhenius president, and all the Members except for the Lord Mappa by indisposition. The Burgher Jacobus van Leeuwen, as general attorney of the fellow Burgher Johan George Baerends petitioner. The petitioner requests orally to be allowed to obtain and bring into forma probanti such evidence, and subsequently to submit it to the council, as he believes he will still be able to secure for the defense of the case of his principal. — The pro Interim Fiscal the Honourable Gabriel Exter respondent to hear the request. — The respondent advances thereupon that the petitioner has had him, the respondent, summoned in an entirely incompetent and improper manner: since, while in the case of the aforesaid Barends renunciation has already taken place, and thus this summons ought to be considered to have occurred in a new case, he should therefore have had to request veniam agendi, and at the same time express in the Citation what his request would entail; claiming that this prerogative belongs to him as an officer of Justice, requesting therefore satisfaction over this improper conduct of the petitioner. — Van Leeuwen enters against this that he did this with not the slightest bad intention, and furthermore had obtained permission from the Worshipful Lord President, as well as believed that, while he came to make this request in the pending lawsuit between his principal and the respondent, he therefore had no need of veniam agendi from this council, nor to express his intended request in the citation: persisting therefore as above. — The Council, after consideration of the matters, reprimands the said petitioner Jacobus van Leeuwen for the informal manner in which he proceeded in this, and at the same time grants the request made by the said petitioner with regard to the evidence to be obtained by him. — The above-mentioned Pro Interim Fiscal the Honourable Gabriel Exter officer of the court Plaintiff in a Criminal Case on the one part.
