The Council, having read and considered with attention the documents and muniments exhibited back and forth in court by the parties, together with taking into reflection everything that deserved any notice and could move their Honors, administering justice in the Name and on behalf of the High and Mighty Lords States General of the United Netherlands, Banishes the detained and summoned Johan Martin Enslin forever from this Land and the jurisdiction thereof; the same having to remain in civil detention, in order to be sent from here to the fatherland by a forthcoming shipping opportunity; with condemnation of the defendant in the costs incurred in this case. The Honorable Independent Fiscal Johan Nicolaas Steven van Lijnden, plaintiff ex officio, against the Junior Merchant of the Honorable Company, the Honorable Johan Fredrik Kirsten, defendant, to see a dictum on the court roll served on account of improper expressions used in his latest written defense, and further in the principal matter to hear the renunciation of further productions. The Adjunct Fiscal Mr. Johannes Andreas Truter, on account of the indisposition of the plaintiff ex officio, thereupon requests, because of the non-appearance of the defendant, default, and that for the benefit thereof a dictum on the court roll with an annex, which he also presented, and said the same mainly had reference to certain improper expressions used by the defendant in his written defense, might be added to the documents, to the end that in deciding this case, such regard might be given to it by the Council as their Honors would judge proper; declaring further, likewise to renounce further productions. The Council grants the request made by the plaintiff ex officio, further keeping this case under advisement for circular reading. The defendant serves reply in writing on the same day. The assistant placed on half-pay, Mr. Willem Kalver, as attorney for the Captain Lieutenant at sea of the Honorable Company, the valiant Jan Breugeman, plaintiff, against the Honorable Independent Fiscal Johan Nicolaas Steven van Lynden, defendant in his official capacity, to see response served to his submitted written claim. The plaintiff requests by petition an extension of time for two weeks. Mr. Johannes Andreas Truter, for the defendant, states that he has no objection against it. The Council approves. 6. Jacob Blankstein, as general attorney of the Lieutenant of the Burgher Cavalry, the valiant Johannes Paulus Eksteen, plaintiff, against the Honorable Independent Fiscal Johan Nicolaas Steven van Lynden, defendant in his official capacity, to hear a request for an extension of time instead of seeing rejoinder served to his submitted replication. The plaintiff presents the following petition: To the Honorable Johannes Izaak Rhenius, President, together with the other Honorable Members of the Council of Justice of this Government. Honorable Sir and Honorable Gentlemen, The undersigned petitioner, as general attorney of the Lieutenant of the Burgher Cavalry, the valiant Johannes Paulus Eksteen, takes the liberty with all dutiful respect very reverently to make known to Your Honors, How the petitioner's principal is in the impossibility of complying with Your Honors' interlocutory order to serve rejoinder today to the replication exhibited in court under date of 23 December of the past year by the Honorable Independent Fiscal, plaintiff in his official capacity; because the petitioner's principal, in order to perform this in proper form, absolutely needs some legal declarations for this purpose; Thus it is that the petitioner turns with all humility to Your Honors, humbly requesting that it may please Your Honors most favorably to grant the petitioner's principal an extension of time until today fortnight, in order then to be allowed to serve rejoinder. The plaintiff presents a petition of the following content: To the Honorable Johannes Izaak Rhenius, President, together with the other Honorable Members of the Council of Justice of this Government at the Cape of Good Hope. The Council grants the requested extension of time and likewise the Petitioner's petition to be permitted, because of his very well-known impoverished circumstances, to litigate pro Deo. The roll having thus far been concluded, the aforementioned Deputy Fiscal Mr. Johannes Andreas Pruter, on behalf of the Independent Fiscal, submitted the interrogatories answered before the Commissioners by Anna Sophia van Elve, wife of the Master Painter of the Honorable Company Jan Oostendorp, together with four additional annexes, making it known that, although by combining the responses of the said Anna Sophia van Elve he could proceed with the extraordinary proceedings already commenced; he nevertheless, on the grounds that she had answered in the negative to various articles presented to her before the Commissioners, deemed it best to proceed in this matter ordinario modo, therefore declaring on behalf of the Fiscal Office to have no objection to the said wife of Johannes Oostendorp being admitted to an ordinary trial and allowed to be represented by an attorney. Wherefore the Council, after examination of the aforementioned submitted documents, having taken note of the declaration of the Officer, has admitted the said Anna Sophia van Elve to an ordinary trial and permitted her to be represented by an attorney. Thereupon, by the aforementioned Deputy Fiscal Mr. Johannes Andreas Pruter on behalf of the Independent Fiscal, a list was produced of all such persons as in the past year 1790 willfully deserted their respective assigned posts and made themselves fugitives, without it being possible, despite whatever effort was applied thereto, to have them overtaken or discovered, requesting therefore that the same, more solito, by public edict and tolling of the bell, might be peremptorily summoned to appear within the next four weeks before this Council, or else before the Commissioners, and to purge and account for themselves concerning the aforementioned willful desertion and abandonment of service, on pain of proceedings being instituted against them according to law in default thereof. Which request was granted to the Officer petitioner. However, Mr. van der Riet, who was of the opinion that the military deserters noted on the aforementioned list ought to be summoned by the court martial established in this government, caused his note to this effect to be recorded. Subsequently, the proceedings initiated ex officio by the Independent Fiscal here, Johan Nicolaas Steven van Lynden, upon and against the burgher Jan George Berends, were brought to the table; which having been deliberated upon; the Council, after careful reading and resumption of the submitted documents, having considered everything that was pertinent to the case and could move Their Honorable Worships, administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, nonsuits the Officer Plaintiff in his claim and conclusion made upon and against the defendant, but with condemnation of the said Jan George Berendse in the costs. In the forenoon, present the Honorable Johannes Izaak Rhenius, President, and all the members, except the Independent Fiscal, Mr. Johan Nicolaas Steeven van Lynden, and the Gentlemen van Echten and de Wet, due to both indisposition and official business. The Secretary of this Council, Willem Stephanus van Ryneveld, ex officio petitioner, against the Independent Fiscal here, Johan Nicolaas Steven van Lijnden, on the one side, and the citizen Jan George Berendse, on the other side, the first-mentioned having acted as plaintiff ex officio and the latter for the defendant and respondent, the parties summoned in order to hear judgment pronounced on their documents and evidence produced back and forth in court. The Council, having attentively read and reviewed all the documents and evidence produced by the parties in court, and furthermore having considered that which deserved reflection and could move their Honors, administering justice in the name 18. past court day, was delayed by about ten minutes in appearing for the petitioner, testifying before your Honors that an intentional omission was by no means the motive of his non-appearance, humbly imploring that this may therefore be considered by your Honors as a sufficient purging of the default incurred through no fault of the petitioner. Whereupon the plaintiff requested that, since all the documents in this trial were drawn up by the aforesaid Adjunct Fiscal, and the Burgher Member of this Council, Mr. Johannes Andreas Truter, is the natural father of the aforementioned Adjunct Fiscal, this may accordingly be taken into regard at the final decision of this case. Regarding which, the said Adjunct Fiscal Mr. Johannes Andreas Truter immediately requested to submit his interests on the next court day. The plaintiff: The Junior Merchant, the Honorable Jan Fredrik Kirsten, plaintiff, against the Honorable Independent Fiscal of this Government, Johann Nicolaas Steven van Lynden, defendant in his official capacity, to see served his statement of interests on the record following his claim exhibited in court. The plaintiff requests by petition an adjournment until two weeks from today. Mr. Johannes Andreas Truter, for the defendant in his official capacity, says he has no objection to this. He further states that it appears therefrom that the defendant has violated two arrests properly and legally placed upon him; that since the defendant is currently at the Cape, the plaintiff in his official capacity has accordingly caused him to be summoned for today, requesting default for the defendant's non-appearance, and that for the benefit thereof, since this matter is liquid, the defendant may be condemned to the fine established by the statutes of India of 50 rixdollars for each arrest, and thus 100 rixdollars for both, with costs. The Independent Fiscal, the Honorable Johan Nicolaas van Lynden, plaintiff in his official capacity, against the burgher Jacobus Stephanus Bruel, defendant, concerning the violation of such arrests as were legally placed on the person and property of the defendant by the former bookkeeper Sieur Menso Blankstein and the assistant Sieur Willem Kolver, the former as attorney of the burgher Sebastiaan Rothman and the latter as attorney of fellow burgher Jan Teunis Mulder, and decreed by this Honorable Council on 9 December 1790, consequently to hear such claim and conclusion as the plaintiff in his official capacity shall make against the defendant, to answer thereto, and further to proceed according to law. 37. to act and proceed as the undersigned Representative shall be advised and find proper. Below stood: Which doing, etc. Was signed: J. N. S. van Lynden. In the margin: Exhibited in Court the 3rd of February 1791. After the reading of which, it was approved to have Captain Lieutenant Breugeman come in, in order to declare his meaning regarding the expressions used in his writing of duplica cited in this memorial, and to give up the author of this writing; whereupon the same, standing inside, having requested that his Authorized Agent, the Assistant Willem Kolver, might be heard in that regard, it was made known by the said Kolver, who by no means denied being the author of the duplica, that with the expressions of: country- and people-destroying cabals and subordinate plotters, he had meant no one else than the sailors who had executed the libel produced by the undersigned Plaintiff. Whereupon it being advanced by the said Adjunct Fiscal that it was very improper to brand a party of sailors with the name of cabal, since the same have no connection or relation to matters occurring on land; 38. the said Kolver thereupon gave in answer that because those sailors in their declaration all speak to one and the same point with premeditated reasons and are therein convicted of untruths by seven consonant witnesses, this rightly causes one to presume a cabal, believing the leader thereof to be the sous-lieutenant, Hendrik Francke, at whose requisition that declaration was given, a subject precisely suited to be able to form such a plot of people who are subordinate under him. That furthermore this Francke, having well realized that if he personally acted against the Defendant in this matter, the costs would then fall upon his head, therefore rather as a casus pro amico has sought to move the Plaintiff to institute proceedings by an untrue denunciation, and that further the aforesaid Sous-Lieutenant Francke, in view of the content of the counter-declarations obtained, being a person who has long since abandoned the character of an honest man, moreover on account of his conduct would rather be culpable than the Defendant in this matter. The said Kolver further requesting that the Officer should state in what manner his Honour obtained the declaration produced by him, and that his Honour may be enjoined to name the accuser. Whereupon the said Officer made known that this demand was not only very improper, but even insulting to the Fiscal Office, wherefore he requested that the Court would be pleased to take this into consideration. Finally, a request was also made by the said Kolver for a copy of the aforesaid memorial, in order to serve his interests thereon, or that otherwise this writing, which ought to be considered as a triplica and thus judged contrary to what is ordained by the statutory laws of the Dutch Indies on the manner of proceeding, may be returned to the Officer. And after it was brought in against this by the often-mentioned Adjunct Fiscal that because this writing did not belong to the principal case, the request of the Defendant therefore went completely against the rules of practice; the said Kolver finally declared that however much the Officer now, without summoning him, Kolver, or his principal thereto in the ordinary manner, had by a memorial and thus in a singular manner renounced further productions; he nevertheless now, leaving the matter to the judgment of this Court, also renounced and requested swift and good justice. From the documents which the undersigned Declarant has the honour to present herewith to your Right Honourable Worships, they will perceive that the aforesaid Meyer, with three other woodcutters, placed by the Master M. discovered a slave youth, who was trying to enter the hut through a narrow window. That he, Meyer, who had hidden himself, thereupon jumped forward and, with a broadsword in his hands, dealt the aforementioned slave several stabs and cuts in order to render him incapable of offense and thus overpower him; but that notwithstanding this, the same slave escaped the hands of him, Meyer, and fled into the forest. That the aforementioned Meyer, upon the arrival home of his mates, reported the incident to them, whereupon two of them followed the blood trail and found the injured slave, who was then discovered to belong to the aforementioned Boss Keunissen and to have run away several days earlier, lying about nine hundred paces from the hut. That Boss Keunissen, having been informed of this occurrence, immediately had the wounded slave transported to the hut, and from there had him fetched the following day to his dwelling, the same having then passed away along the way. In considering these circumstances, it appears to the second undersigned deponent, subject to respectful correction, that the aforementioned sailor Jan Hendrik Meyer cannot be considered to have committed a crime by wounding the aforementioned slave, but on the contrary to have acted in a lawful deed. Wherefore the undersigned, in the name and by order of his principal, making declaration, declares to find no sufficient grounds for any action against the sailor Jan Hendrik Meyer mentioned at the head of this document in the annexed papers, and therefore to consent that the same may return to his assigned post to perform his usual services there. I make known to my Honorable Court of Justice that in the year 1788 I sent a slave named Valentijn of Bengal to Swellendam to Mr. Onkruydt, in order to deliver that slave to the Honorable Court of Justice, due to reproaches from the neighbors that he had stolen from them, as all runaways do, to see if my Honorable Court finds punishment for him; and then, after the passage of one year, my wife went to the provost Matthyssen to inquire what sentence my slave had received, and said Matthyssen gave my wife the answer that no slave of mine had arrived in the jail; and thereupon my wife went to Mr. Ryneveld at the Justice Office to hear the sentence of my slave, and Mr. Ryneveld gave the answer that there was no sentence for my slave; and my wife, being at the Cape in the month of October in the year 1790, had the slave caught in the street, and that the slave then confessed to the Honorable Deputy Fiscal that he had served as a cook in the slave lodge for half a year, whereupon the slave was put in the jail for further investigation. That since the sentence passed against Smit of Dilburg has lawfully and properly attained the force of res judicata. 2nd, and especially, since the final and principal part of that sentence, namely the banishment, is only to take full effect in two years (which execution the Council is by no means able to carry out, NB, upon copies of the trial documents and the sentence rendered thereon); and finally, because in this case no appellant has presented himself, in which event the Council would indisputably be obliged to send over the original documents, since no judgment can be pronounced on copies. That (say I) this Council ought by petition to address the Government here, politely declining the requisition of the High Government at Batavia to send over thither the original documents of the said trial, with citation and extension of the grounds mentioned above, and basing ourselves furthermore 46. upon a similar case that occurred some years ago between that High Government and the Council of Justice at Batavia; with the offer, however, to send over directly to Their High Excellencies authenticated copies of the said trial upon their further requisition. 56. The Court grants the defendant in his capacity the requested copy and a term of four weeks, in order then to serve his answer. The honorable and respected Independent Fiscal of this Government, ex officio Plaintiff, against the burgher Cornelis Brits, defendant, in order to hear such demand and conclusion as the ex officio Plaintiff shall make and take, concerning and regarding the fact that the defendant, without the foreknowledge of the Right Honorable and Valiant Governor, on the 21st of the past month of January, caused a certain Pieter Hes to be arrested by the patrol guard; to answer thereto and further to proceed according to law. The aforementioned Deputy Fiscal Mr. Johannes Andreas Truter, making his demand orally on behalf of the ex officio Plaintiff, states that the defendant, having a few weeks ago gotten into a quarrel with the burgher Pieter Hes on the Boerenplein, then saw fit to pursue the said Hes as far as the patrol guard, and to have the same taken into arrest there without having obtained any prior authorization, concluding that the defendant should for this matter be placed on water and bread for the period of 14 days and condemned in the costs incurred in this case. The defendant advances in answer that the aforementioned Hes had insulted him, the defendant, in a terrible manner on the public street, and that he, the defendant, for fear that the same would depart for the countryside without giving him, the defendant, satisfaction for this, requested the guard to take the aforementioned person into custody. The ex officio Plaintiff persisting with his demand in reply and the defendant persisting with his presented defense in rejoinder, the parties renounce further productions. 57. The Court, having heard the parties, after consideration of that which merited reflection, doing justice in the name and on behalf of the High and Mighty Lords States-General of the United Netherlands, places the defendant Cornelis Brits on water and bread for fourteen days, and condemns him, the defendant, in the costs incurred in this case. The well-mentioned honorable and respected Independent Fiscal, ex officio Plaintiff, against the burgher Johannes Joachim Cheron, in order to hear such demand and conclusion as the ex officio Plaintiff shall come to make and take, concerning and regarding the fact that the defendant, on 22 February last, grossly assaulted a slave of the Valiant Burgher Captain H. O. Eksteen named Jacob of the Cape on the public road; to answer thereto, and further to proceed according to law. The Deputy Fiscal Mr. Johannes Andreas Truter produces a written demand with two annexes. The Assistant Willem Kolver, as general attorney of the defendant, requests a copy thereof and a term of four weeks (as he must obtain some statements from people living outside), in order then to serve his answer. The ex officio Plaintiff states he has nothing against this. The Court grants. 58. Senior Menso Blankstein as attorney of the burgher Marthinus van Noppen, states. Against the Deputy Fiscal Mr. Johannes Andreas Truter, as being qualified to handle the affairs of the Merchant and Landdrost of the Colonies of Stellenbosch and Drakenstein, the Honorable Hendrik Lodewyk Bletterman, ex officio party summoned, in order, instead of seeing rejoinder served to his filed reply, to hear an adjournment requested. Senior Blankstein requests by petition an adjournment until two weeks from today. The party summoned states he has nothing against this, but nevertheless at the same time, since the petitioner in this lawsuit has obtained an adjournment so frequently, to request that this be granted to him on pain of default. The Court grants adjournment on pain of default. The honorable and respected Independent Fiscal, ex officio Plaintiff, against the soldier of the National Depot Hendrik Ernst, and the quartermaster of the Wurttemberg Regiment Johan Christiaan Kraft, defendants, in order in a case of fraudulent practices to hear demand together with the costs. The Captain Auditor the Honorable Gabriel Exter, acting in this matter as Deputy Fiscal, submits a written demand, furnished with six annexes. The first defendant persists with his confession. While the second defendant declares he is innocent. The ex officio Plaintiff requests justice. The parties renouncing further productions. 59. The Court, having read the written demand and conclusion, together with the documents annexed thereto, after consideration of that which merited reflection, doing justice in the name and on behalf of the High and Mighty Lords States-General of the United Netherlands, condemns the first defendant Hendrik Ernst, after being booted by the Officers of Justice, to be subsequently sent to India, with condemnation of him, the first defendant, in the costs and expenses of justice. The Court further orders that the second defendant Johan Christiaan Kraft, who is hereby acquitted, shall be handed back over to his regiment. Petition The assistant of the Honorable Company on deducted salary, Jacobus Vercueil, in his capacity as general proxy for the citizen Jacobus Johannes van den Berg, petitioner, versus The Honorable Independent Fiscal Johan Nicolaas Steven van Lynden, formally summoned to hear a petition for appeal to the Honorable Court of Justice of the Castle of Batavia from such sentence as was rendered against the principal petitioner on 17 February last. To the Honorable Johannes Izaak Rhenius, President, together with the further Honorable Members of the Council of Justice of this Government. With all due respect, the undersigned Jacobus Vercueil, as general proxy of the citizen Jacobus Johannes van den Berg, makes known to Your Honors. The petitioner presents the following: That a lawsuit was initiated against the original petitioner by and on behalf of the Honorable Independent Fiscal Johan Nicolaas Steven van Lynden, regarding which proceedings were recently conducted before Your Honors, and which proceedings, Right Honorable Sir and Honorable Sirs! Same day. 66. after both sides were duly provided with documents and the matter was brought to the point of judicial decision, were adjudicated by Your Honors on the 17th of the last-passed month of February. That however much it might be demanded on the part of the fiscal office in the subject case that the sentence pronounced against the petitioner regarding the fine be complied with under security, and this on the basis of the Instruction for the Court of Holland, Articles 213 and 218, regarding which it is stated by Van Leeuwen in his Roman-Dutch Law, Book 5, Part 25, Paragraph 15 after the middle: All judgments or sentences of lower judges regarding matters of dikes, watercourses, sluices, policies, officer fines, corrections, and others of a similar nature, are to be executed under security, notwithstanding appeal and without prejudice thereto. The formally summoned, however, requested that, if the appeal is granted, the defendant shall then first have to consign the fine imposed upon him. The Council holds this matter under circulation for advice. Whereafter by the aforesaid Adjunct Fiscal Mr. Johs Andreas Truter, on behalf of the Lord Independent Fiscal, was submitted a representation concerning seven slaves belonging to the Burgher Daniel Lombard, reading as follows: Shows with due respect the Independent Fiscal of this Government, Johan Nicolaas Steven van Lynden, That on the 28th of the past month of January there appeared here in the lord's prison seven slaves of the Farmer Daniel Lombard, by name: Emme of the Cape with her children Maggel, Christina, Francina, & Saul, all of the Cape, together with two adult male slaves, named October of Madagascar and Floris of Ceylon. To the Right Honorable and Respected Lords President and Councilors of Justice of the Castle of Good Hope, submitted reply, to serve as rejoinder. 70. 71. October of Madagascar and Floris of Ceylon, Who all, with the exception of the smallest slave child, complained of being treated by their bodily master in such a cruel manner, and that the same had from time to time so overburdened them with beatings and other unpleasantries, that they had finally been forced to take flight together, in order to lodge a complaint against their aforesaid bodily master; while the female slave Emme in particular accused her bodily master that he had for a long time engaged in carnal intercourse with her, the consequence of which had been that from that intercourse two children were born, being the aforesaid Maggel and Christina; adding that her bodily master, notwithstanding this, had so far forgotten himself as to also live in carnal intercourse with her eldest daughter, the aforementioned Maggel, and to impregnate her with the child that she currently carries; which accusation was confirmed not only by the pregnant female slave Maggel, but also by the aforesaid October and Floris. That the petitioner, after having caused the Farmer Lombard aforesaid to be informed of the arrival of his slaves, inquired into the accusations of those slaves, and then found: That, as far as the mistreatment is concerned, there were no grounds from which the petitioner could discover the truth of that allegation with any basis, since one encountered in the statements made not only no external signs of mistreatment, but also no sufficient agreement regarding the manner and other circumstances that naturally ought to accompany such an act. While, regarding the carnal intercourse with the two above-mentioned female slaves, it appeared to him that that accusation, resting solely on the word of four slaves with respect to their bodily master, by whom they moreover considered themselves mistreated, cannot be regarded as sufficient, without further or better evidence, to prosecute the aforesaid Lombard at law for this, especially since he absolutely denies ever having conversed carnally with the aforesaid female slaves. That the petitioner on these grounds, on the one hand, considered that he ought to return the slaves in question to their bodily master, because they were deficient in their accusations; but that he, on the other hand, judged that by returning them he would perhaps expose the aforesaid slaves to the vengeance of their bodily master, who, being aware of these accusations, might easily in a passionate moment make the accusers feel his sensitivity in an impermissible manner; which latter consideration in particular came into account with the petitioner because he has been informed by rumors that the frequently mentioned Lombard seldom sets limits to his passions, and has frequently caused even his wife, who is now separated from him, to experience the effects thereof. Reasons for which the petitioner has deemed it necessary to bring this case to the notice of your Right Honorable Worships, with the humble request that your Right Honorable Worships may be pleased to dispose in this matter by having the aforesaid slaves publicly sold for the benefit of their bodily master Daniel Lombard, or through other appropriate measures, as they shall judge in equity to be proper. the Officer having no sufficient grounds for any action against the aforementioned Meyer, the said Landdrost is authorized, as he is hereby authorized, to cause the cited Jan Hendrik Meyer to return to his appointed post, in order to perform his customary duties there. Whereas, however, Mr. van der Riet, judging that because it appears from the documents that the slave in question received nineteen lashes, and the defendant has therefore committed an excess which can never be ranked among permissible acts, the Officer ought to be enjoined to proceed against the aforementioned Meyer according to style and practice, had his vote recorded in the minutes. After which was read a letter from the Landdrost of Graaff Reijnet, Morits Herman Otto Woeke, dated 21 December 1790, wherein among other things it is reported; that the notification issued by this Council under the date of 16 September of the same year, containing an order to enjoin the burgher Johannes Oberholster, living in the district of Graaff Reinet, Andries Abraham Smit, the cooper Fredrik Otto receiving the below-mentioned pay, and the Bastaard Anthony living with the surgeon Kastrou, who at the requisition of the wife of the burgher Tobias Mynhard, presently provisionally placed on Robben Island, have given depositions, to come up towards the Cape with all possible speed in order to re-examine or swear under oath to those depositions in question, had been received by him, the Landdrost; that in pursuance thereof the aforementioned Oberholster on the 1st and Andries Abraham Smit on the 8th of that month of December had already been directed by the messenger to proceed with all haste towards the Cape; that the first-mentioned had replied that he would do so directly, but that the latter, on account of the impossibility in which he found himself to obey that order, had handed to him, the Landdrost, a letter addressed to this Council and dated 16 December 1790, which letter the said Landdrost had also forwarded enclosed in his dispatch; that further the aforementioned cooper Fredrik Otto had already departed from the district of Graaff Reinet towards the Cape in the month of November in order to maintain his domicile here, and that finally the Bastaard Anthony was to come up immediately with the aforementioned Kastron. Which report having been regarded as communicated; it was further resolved to await the arrival of the aforementioned persons; and then to have their depositions re-examined or sworn under oath. Whereas with regard to the cited Andries Abraham Smit, it is resolved to attach his aforementioned letter of 16 December 1790 to his given deposition for consideration, and thus to let it circulate with the trial documents. Lastly, there was also read the following letter from the said Landdrost concerning the person of David Malan: To the Honorable Johannes Izaac Rhenius, President, together with the Honorable Council of Justice at the Cape of Good Hope. Honorable Sir and Gentlemen! The undersigned having some time ago perceived that a certain David Malan, having been summoned by edictal citation before your Honorable court, and having since that time been hiding himself on the borders of this Colony near the Kaffir country, and that a certain Hottentot Captain named Ruiter Platje, as has been made known to the undersigned, who is said to be an accomplice to the murder committed on the wife of the burgher Rotman at the place named de Honingklip, situated under the Colony of Swellendam, also happens to stay in this Colony; and since the undersigned is unaware of to what extent proceedings have been taken against the aforementioned Malan, and whether a sentence has been pronounced against him, notwithstanding the fact that such vagabonds are very detrimental to the public peace, and the repeatedly mentioned Malan is already, and may in time further become, a very pernicious subject for this Colony and the Kaffirs; the undersigned therefore dutifully takes the liberty to address your Honors, with a respectful request that it may please your Honors to elucidate the undersigned on the one and the other, and to grant to him your Honors' decree for the apprehension of the repeatedly mentioned Malan, so that the undersigned may be able to act and proceed as the requirement of his office demands, in order to deliver such fugitive vagrants into the hands of Justice, so that they may be placed where they belong. 84. van Lynden, plaintiff ex officio Defendant, that a certain extract which his Honour handed to the Honourable President might be read. Opened against the Senior Merchant and Member of the Honourable Council of Policy, as well as Cellar Master of this Government, Mr Jacobus Johannes Le Sueur, defendant, in order to hear such claim and conclusion as the plaintiff ex officio shall judge necessary to make and take against the defendant concerning malversation and improper conduct in his administration and post as Cellar Master, to answer thereto, and further to proceed as is customary in law and practice. Then, immediately hereafter, a written claim furnished with seven annexures, marked from letter A to G, being submitted by the gentleman plaintiff ex officio, his Honour advanced orally: That however much he, the plaintiff ex officio, following the precedent of the proceedings which were conducted some time ago against the first sworn clerk of the political secretariat, Johannes Martinus Horak, concerning malversation in his post, could also have initiated an extraordinary trial against the defendant, since the malversations committed by the defendant even exceeded those of the said Horak, he, the plaintiff ex officio, nevertheless, to show all deference and regard for the status of the gentleman defendant as a Member of the Honourable Council of Policy, to remove all notions of partiality, and to give the defendant the opportunity to be able to answer without hindrance, had preferred to prosecute in the ordinary manner, and thus in the civil way, those proceedings which he, the plaintiff ex officio, had been obliged by oath and duty to undertake against the gentleman defendant. Whereupon, at the further instance of the gentleman defendant, the extract produced by his Honour being read in court, the same was found to be of the following content: Extract 85. Extract of a letter written by the Right Honourable the Gentlemen Directors, delegates to the illustrious assembly of the Seventeen of the United Netherlands Chartered East India Company, to the Governor and Council of the Cape of Good Hope, dated 2 October 1790. We do not doubt that you will have gathered, from the seriousness with which we have dealt with the several matters contained in this our letter, our desire that it be complied with strictly in every respect, and we therefore also expect that you will lack nothing with regard to both speed and completeness in that matter, ordering you to send us, at the latest within three months after receipt of this, your opinions individually on all the considerations and reports, information, and elucidations that are demanded therein, while we also add here again the most emphatic assurance that in default thereof, or if you should fail to comply with the orders contained herein, we shall without any connivance or delay undertake and immediately carry out those effective measures that are in our power to compel obedience to our orders. After the reading of which, his Honour informed the Council: That in the aforesaid most respected letter of the Lords Masters, his Honour was likewise so seriously demanded and ordered to prepare, within three months after receipt of that letter, his reports, considerations, etc. on various different points, and yet had been prevented from doing so until now, because his Honour, shortly before receiving that letter, had gone to the baths to restore his health and had only returned from there a few days ago; that since those orders are so strict that its omission or neglect would rightly incur upon his Honour the highest displeasure of his High Masters, his Honour also considered that no external matters, especially no untimely legal proceedings, should be placed in his way that would prevent him from obeying those high orders as duty requires. That his Honour, for those weighty reasons, found himself obliged to request the Council that this matter might be stayed until his Honour shall have dutifully fulfilled the task assigned to him, with the further declaration that, after the expiration of that time, he will present himself before this respectable bench and then declare whether he will request a copy of the claim or not. The gentleman plaintiff ex officio having been heard on this, submitted in reply principally: That his Honour was surprised to see produced here an extract of a secret letter written by the Lords Masters to the Governor and Council; that his Honour furthermore considered this matter of quite as much importance as the report or opinion to be prepared by the defendant, as the interest of the Honourable Company is so directly concerned in this; that he, the plaintiff ex officio, also had to obey the orders contained in the aforesaid letter within that time, as far as his capacity as Independent Fiscal was concerned, but that his Honour had judged that this work ought not to prevent him from exercising his office on the subject of the gentleman defendant in this matter, in which the interest of the Company is most highly concerned; that his Honour further requested that the gentleman defendant may be ordered to answer within a certain term; and finally, in case the Council might judge what was put forward by the defendant to be of such weight that the matter should be suspended, he, the plaintiff ex officio, in that case found himself obliged to request that the defendant shall be suspended from his respective offices, in order thereby to prevent the further damage which the Honourable Company still continues to suffer daily through the defendant's administration. The defendant gentleman, based on the instruction of the Gentlemen Directors and what has been alleged by his Honor, still persists in his request: 2 The Council, after consideration of matters, grants the defendant's request and thus suspends these proceedings until the order of the Gentlemen Majors, contained in the produced extract of the Letter of 2 October 1790, shall have been complied with by the Defendant; further denying the request made by the Plaintiff in his Official Capacity for the suspension of the defendant. And furthermore, after the pronouncement of this interlocutory order, the gentleman Independent Fiscal made the following denunciation in court regarding this: Whereas the gentlemen have seen fit, notwithstanding my alleged reasons, to proceed to this ruling; so I request that they take it not amiss that I, in my office as Independent Fiscal of this Government, most solemnly protest against both the delay of justice and the nullity of the resolution now taken, leaving the private responsibility, both for this and for the harm that the Honorable Company comes to suffer hereby, to those Gentlemen Members who voted in favor of this, reserving to myself the right to address the Right Honorable and Esteemed Gentlemen in such manner as I shall deem advisable. And I protest against nullity, because I see that the gentleman President, who is interested in this lawsuit and therefore cannot judge upon it as a judge, did not absent himself during the deliberations. Upon which representation the Honorable Esteemed gentleman President declared; that his Honor had not known that he was involved or implicated in this case; that otherwise his Honor would certainly have absented himself during the deliberations about it, while his Honorable Esteemed further reasonably ought to have expected that, as has repeatedly been requested by parties in one case or another, the gentleman Independent Fiscal would have informed his Honor beforehand, either privately or in this assembly, that matters occurred in the proceedings instituted against the defendant in this case which required that his Honorable Esteemed excuse himself from voting, or withdraw from the assembly itself; further declaring to retract now the opinion which his Honor had rendered in this case, and in future time to withdraw himself from the deliberations regarding this. And whereas, after this and that, it was still answered in substance by the said gentleman Independent Fiscal: That his Honor had not wished to commit the indiscretion of recusing the gentleman President or requesting beforehand not to vote in this case, since his Honor expected that the said gentleman President would observe this of his own accord; further adding to the said gentleman President: that from all this it now appeared that a decision had been made without the claim and documents having been read; that if one acted in that manner, one would then act like blind judges, and it would resemble granting favors much rather than impartial justice; and that his Honor finally referred to the abovementioned protest, etc. Thus it was approved, and the secretary was expressly ordered, to keep an accurate record of these statements advanced by the gentleman Independent Fiscal in today's minutes. While furthermore the gentleman Mappa, who, with regard to the interlocutory order made in the aforesaid case, was of the opinion that, since one ought not to obstruct the course of justice, and the manner of proceeding ordered here for observation clearly determines the term of proceedings to be fourteen days; that also the order produced by the defendant gentleman was not directed to or assigned to this Council to be followed; the excuse of the defendant therefore ought not to be taken into consideration either, and he should therefore be ordered either to request a copy immediately or to answer thereto in such manner as his Honor deemed able and permitted to do; had this vote recorded in the minutes. Against 91. The defendant, having heard the same read as his answer, says that, because he knows that the government forbids common soldiers from owning or renting houses in this settlement, he therefore believed he was permitted to deliver wine to the person in question, who came to him dressed in civilian clothes with cash to buy wine, all the more so since the half-aam was delivered to a civilian house. The Burgher Ian hendrik Helberg, defendant, to hear claimed and concluded, in the case of contravention against the edict of the 4th of March 1788, by which the retail sale of wines to common soldiers by private wine merchants is prohibited, the payment of the fine established by that edict; to answer thereto and further proceed according to law. The official plaintiff, accepting the defendant's statement as a confession, further submits in reply that the edict speaks clearly and cannot be made subject to any exception; that since it is thus proven that the defendant sold wine to a common soldier, he, the defendant, has consequently fallen within the terms of the edict; wherefore the official plaintiff persists in his claim. The defendant likewise persists in his answer. The parties renounce further productions of documents. The Council, having heard the parties, after considering that which merited reflection, administering justice in the Name and on behalf of the High and Mighty Lords States General of the United Netherlands, denies the official plaintiff his claim made and conclusion taken upon and against the defendant, with condemnation, however, of the defendant in the costs; provided that the defendant shall declare under solemn oath that he regarded the person to whom he sold the wine in question as a burgher and did not know that he was a soldier; but in the absence of that oath, the Council condemns the defendant Ian Hendrik Helberg to the fine determined by the edict, with costs.
