A: Niuter deputy f=l /:in the margin:/ Exhibited in Court on 17 March 1791. — The former bookkeeper Jan Jacob Fredrik Wagener as Attorney for the defendant says that he leaves the applicant's legal request to the judgment of the Council.— The Council grants the appeal to the Honorable worshipful Council of Justice of the Castle of Batavia; thus the original documents that have served in this case, having been authenticated in the presence of the Gentlemen Commissioners, shall be transmitted to the said Council. Whereupon by the Adjunct Fiscal Mr. Johs. Ands. Truter on behalf of the merchant and Landdrost of the Colonies of Stellenbosch and Drakenstein, the Honorable Hendk Lodewyk Bletterman, a representation was exhibited with two reports, which representation reads as follows.— To the Honorable and Worshipful Lords President and Councilors of Justice of the Castle of Good Hope Shows with the greatest respect the Landdrost of Stellenbosch and Drakenstein Hendrik Lodewyk Bletterman, that having come to his knowledge, as subsequently from the attached reports has become evident to the applicant, that the Citizens Mattheus Esterhuisen, Pieter Bezuidenhout, Izaak Bosman the Younger, Gilliam Visage Ary's son, Barend Vry and Pieter Brand as well as a certain Johannes Fredrik Weitsman, notwithstanding the strict orders issued against it, have nevertheless not hesitated to cross the Great River and settle there, and moreover some of them have committed such irregularities as is further evident from the accompanying documents; the applicant considers himself ex officio obliged and inescapably bound to observe the rights of the High Authority in this matter, to which end he turns to Your Honorable Worships, respectfully requesting a Mandate by missive, whereby the aforementioned persons are summoned to appear in person before this Honorable Worshipful Council within a certain competent time; in order to hear such demand or request or requests as the applicant shall see fit to make on the appointed day regarding the aforementioned matter, to answer thereto, and further to proceed according to Law. /:Was written below:/ which doing etc. /:was signed:/ I:s A.s Truter in capacity - /:in the margin:/ Exhibited in Court on 17 March 1791.— Which Representation and Documents having been read, after consideration of that which merited reflection, the summons in Person requested by the Applicant for the citizens Mattheus Esterhuizen, Pieter Bezuidenhout, Izaak Bosman the Younger, Guilliam Visage Ary's son, Barend Vry, Pieter Brand, and the person of Johannes Fredrik Weitsman, and such by Missive, under the Council's great Seal, was granted: All present; except the Independent Fiscal along with the Gentlemen Ronnenkamp and Mappa, the former having absented himself as a party in the following case, and the latter two having departed from the meeting due to pressing business after the conclusion of the criminal cases that were handled: Lastly, the Documents and Muniments having served in the trial initiated by the Independent Fiscal van Lynden, applicant, on and against the citizen Jacobus Bierman, having been brought to the Table; The Council, after careful consideration of all that merited reflection in this matter and could move Their Honorable Worships, administering Justice in the Name and on behalf of the High and Mighty Lords States General of the United Netherlands, condemned the Defendant Jacobus Bierman to a fine of Fifty Rixdollars pro fisco; ordering also the defendant regarding the Bastard Hottentot woman Griet, who is hereby declared released from her servitude to the defendant; with further Condemnation of the defendant in all the costs incurred in this matter, and dismissal of the further Demand. — /:was written below:/ At the Cape of Good Hope, the day and year as above /:lower down:/ In my presence /:was signed:/ W: C: F. 99. Monday the 21st of March 1791. In the forenoon, extraordinary meeting. Present: the Honorable Johannes Izaac Rhenius, President, and all members, except the Independent Fiscal Johan Nics Steven van Lynden and Mr. de Wet. The Honorable President made known in advance to the Council that the Right Honorable Governor, having on Friday evening, being the 18th of this month, through the Secretary of this Council requested of His Honor both an extract from the minutes of the meeting held on the 17th of this month in the case which the Independent Fiscal van Lijnden r. o. has initiated against the Senior Merchant and cellar master, as well as member of the Honorable Council of Policy, Mr. Jacobus Johannes Le Sueur, as well as the claim and documents submitted on the aforementioned date, His Honor had immediately put this before the respective members of the Council by circular inquiry. That, although the majority of the members in that inquiry had been of the opinion that the aforementioned documents ought not to be handed over, His Honor, seeing that 100. the aforementioned Governor had continued most strongly to insist upon the delivery of the extract and copy of the documents, had thought it best to convene this extraordinary meeting on the matter. However, before proceeding to the deliberation, His Honor asked the members whether they would deem that His Honor could continue to advise in the aforementioned proceedings initiated against the Cellar Master Le Sueur, or whether it was understood that His Honor was obligated to recuse himself therefrom or remove himself from the meeting during that deliberation. Whereupon all the members present, except Messrs. Mappa and Truter, declared themselves of the opinion that the aforementioned President will indeed be able to vote in the aforementioned case so long and until such time as the documents shall have been circulated and read, and it has appeared therefrom whether His Honor is mixed up in the trial in such a manner as to prevent His Honor, as President of this Council, from participating in the definitive deliberation therein; the aforementioned Messrs. Mappa and Truter, however, having been of the opinion in this regard that this matter can present no point of deliberation for the Council, since the Honorable President ought to know for himself whether His Honor should advise in the case of Mr. Le Sueur or not; which both gentlemen have had recorded as their votes in the minutes accordingly. Whereafter, 101. Whereafter, having again deliberated on whether or not to deliver the aforementioned extract from the minutes requested by the Right Honorable Governor, concerning the case of the said Mr. Le Sueur, and the copy of the claim and documents of the Independent Fiscal, the meeting, upon consideration of the matters, has still raised difficulties regarding fulfilling the request of the said Honorable Governor in this matter, on the grounds that the Court of Justice is not permitted to make public any cases which have not yet been fully concluded in the principal matter, because an important article placed in the oath of the Members of Justice entails that they promise not to reveal the secrets of the chamber to anyone, and a delivery of those documents would run directly counter to this; it being consequently approved by majority of votes to decline the request of the aforementioned Governor in a respectful manner, and further to order the Secretary of this Council immediately to notify His Right Honorable thereof; with the declaration, however, that the Council is prepared, as soon as this trial shall have been definitively terminated and pronounced, to then furnish a copy thereof to His Right Honorable, should he so desire. While, however, Messrs. Mappa, Fleck, and Truter, who were of the contrary sentiment, had it recorded in the minutes: 102. That they believed that nothing ought to be kept secret from the Honorable Governor as chief commander of this place, and one therefore also ought not to refuse the requested copies; it being at the same time added thereto by Mr. Truter that His Honor moreover held it as certain that the Governor would not request any documents without having the right to do so and being able to base himself upon proper orders or instructions. On this occasion, further consideration was also given to that which was recorded in the minutes of the aforementioned 17th of this month, relative to the expressions used by the Independent Fiscal of blind judges, of favors instead of impartial justice, etc., considered by the majority of this Council to be extremely defamatory; thus the Council has judged not to be able to let this conduct of the Independent Fiscal pass unnoticed, but rather to take such paths as may be suitable to protect this assembly in the future from such insults. Wherefore it was resolved to address the Right Honorable Governor and the Honorable Council of Policy on this matter by memorial, with a very respectful yet no less earnest request that His Right Honorable and Their Honors be pleased to take such satisfactory measures in this regard as they shall judge appropriate for the maintenance of justice in this matter. However, Mr. Mappa, who testified that since the advice given by him in this case of Mr. Le Sueur differs entirely from the ruling made by the Council, he therefore believed he could not interfere with the reflections of the Council upon the expressions of the Independent Fiscal, did not conform to the decision now taken, and was furthermore excused from signing the representation. Likewise, Mr. Truter declared that he did not vote in favor of this decision, but merely requested it to be recorded that on the last ordinary court day, in advising on the case of the said Independent Fiscal versus Mr. Le Sueur, being of the opinion that the defendant was merely granted a term until he should have complied with the strict orders of the Lords Seventeen, in order then to answer the claim of the Officer, he had joined his vote with the majority. The Secretary of this Council, Willem Stephanus van Ryneveld, acting in his official capacity, against the Independent Fiscal here, Johan Nicolaas Steven van Lynden, on the one side, and the burgher Jacobus Bierman on the other side; the former having acted as plaintiff in his official capacity, and the latter as defendant and respondent, both summoned in this matter to hear judgment pronounced upon their documents and proofs produced mutually in court. The Council, after careful reading and 106. and resumption of the documents and proofs submitted by the parties, having considered everything relevant to the matter that could move Their Honors, administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, condemns the defendant Jacobus Bierman to a fine of fifty rixdollars pro Fisco; ordering at the same time the said defendant to allow the Bastard Hottentot Griet, who is hereby declared discharged from her servitude to the defendant, to go unhindered wherever she, as a free person, shall deem fit; further condemning the defendant Jacobus Bierman to all the costs incurred in this case, and dismissing the remainder of the claim. 107. 113. of this Government, Johan Nicolaas Steven van Linden. How he, being compelled in his official capacity to initiate proceedings against the Ensign of the Burgher militia here, Coenraad Nelson, over and regarding the fact that the latter, on his own authority, without any judicial decree or other judicial qualification, had seen fit to inspect and search the houses of two inhabitants in this town, accordingly also had the said Nelson duly summoned to appear on the 17th of the past month of February before this Honorable Assembly; in order to hear, regarding the aforesaid matter, such claim and conclusion as the Informant, the Independent Fiscal, should see fit to make and take on the court day; to reply thereto, and further to proceed as according to law. That the defendant, on the court day, through his representative, the assistant Willem Kolver, requested a copy of the claim and documents submitted at that time, in order to serve an answer thereto in four weeks; in which request the Informant made no difficulty to condescend, because the said representative of the defendant claimed with so much emphasis that his principal necessarily needed that term for his defense, and could not be ready within the usual time. That the requested term having been granted by Your Honors, the said Kolver in his aforesaid capacity, after the expiration of those four weeks, to wit on the last ordinary court day, exhibited in Judicio a written answer, signed by the defendant himself, and provided with seven annexes numbered from No. 1 to No. 7 inclusive. 114. That a copy of this answer and annexed documents having been granted to the Independent Fiscal, the Informant, to serve with a reply today, the Informant would not have failed to summon the aforesaid Nelson for today and to reply more consueto, were it not that in the aforesaid documents, examined by him in copy, he had perceived to his utter surprise matters which he considers himself obliged to present beforehand to this council; because they directly conflict with good order, as well as with the awe and reverence that everyone is obliged to show to the judge and the officer of justice, in which cases it is not practicable for this council to summon the producer of such irregular and disrespectful documents and muniments, because one is then dealing with something that, quoad factum, cannot be subject to any doubt, and quoad jus, seldom suffers contradiction. The Informant has in the first place perceived that among the annexes was found an extract from the minutes of a certain extraordinary military assembly of Burgher officers, held on the 23rd of the last-passed month of February, by which aforesaid act Nelson is not only declared fully qualified to conduct the searches over which he was summoned by the Independent Fiscal, the Informant, but moreover the conduct of the Informant is condemned without any restraint; just as if the court-martial were authorized and entitled to judge and to appraise as it sees fit that which the Independent Fiscal performs ex officio. The Independent Fiscal, the Informant, will never dispute to Ensign Nelson the power to allege in Judicio for his defense all such orders, regulations, and instructions as he, in his capacity as a burgher officer, deems fit and necessary for that purpose; but on the other hand he also believes, 115. that the Burgher court-martial of this town is by no means authorized to decide matters that are litispendent before this Tribunal, of whatever nature they may be, from such orders, regulations, etc.; but that it is, on the contrary, obliged to await what Your Honors shall be pleased to judge concerning the matter, without meddling in the least with the administration of justice; especially because, doing so, an Imperium in Imperio would be established, and the authority of all judicial sentences would be made subject to vilipending and contempt, from which finally nothing else is to be expected but an absolute anarchy, the greatest evil that can ever befall civil societies, for which reason, very wisely in the fourth article of the Instructions and regulations for the Burgher court-martial, the activities of that assembly are restricted solely to the burgher service. But besides this premature and illicit demarche of the Burgher court-martial, the Independent Fiscal, the Informant, further finds himself obliged to present to Your Honors: That in the written answer itself he has seen, with the utmost resentment and indignation, that instead of confining oneself to the means necessary for the defense of the defendant, they have on the contrary forgotten themselves so far as to expose the Independent Fiscal, the Informant, in a scandalous and glaring manner; of which, so as not to copy everything, can serve as samples what is said on pages 258, 259, 260 and 261 of that document, that

116. namely, that the Plaintiff in the case at hand, through reckless, premature, as well as through deceit and subtleties practiced procedures, puts the public peace, quiet, and tranquility in jeopardy, has already in several cases shown not to be alone in such procedures; and which perhaps shall be made to appear even more clearly; and on articles 302, 303, & 304, that the said Plaintiff otherwise in other cases knows well how to limit himself in ample measure regarding the punishments. Expressions, Noble Honorable gentlemen! which, used in respect of an equal, cannot be regarded as anything other than highly injurious and defamatory, and which are therefore all the more striking in this case, because they are used in respect of an acting officer of Justice, who, employed in the name of the sovereign, represents His most High, and for that reason must be respected by everyone, whoever he may be, and whose authority the judge ex officio is always obliged to maintain against anyone who might undertake to make any infringement upon the same, however slight. The said Remonstrant would be unworthy of the trust placed in him by the Lords Masters, and would dishonor the entire Justice of this place, if he did not show himself most strongly indignant over these defamatory expressions, and did not earnestly insist upon a proportionate satisfaction, the more so because the direction and management of the entire Justice is entrusted to him, and he is thus not only entitled, but even obligated to ensure that the same remains preserved inviolate in its full luster. And Noble and Honorable gentlemen! if one could with impunity emancipate oneself in such disgraceful conduct toward one's superiors, what then would be to expect when the litigating persons were of equal rank, and the aforementioned inequality ceased to exist— Finally 117. Finally, the said Remonstrant quietly leaves it to the enlightened judgment of Your Noble Worships whether the counter-conclusion taken in the plea of response does not implicitly contain a counterclaim, when the defendant concludes therein that by judgment of Your Noble Worships there shall be reserved to him an action for atrocious and gross injury against the Remonstrant. Whereby the said Party would not only, in matters pertaining to his office, against the express letter of his instruction, be made subject to the judicature of this council, but also every private inhabitant would be given the liberty to harass him, in the execution of his office, with proceedings in reconvention, whereas nevertheless in cases in which the party acts ex officio, the practice expressly forbids all reconvention against him; see Merula, Manier van procederen, Book 4, title 43, Chapter 6, Number 5. Regarding these unheard-of proceedings of the defendant Coenraad Nelson, the said Remonstrant believes he must and may show himself the more sensitive, because in what was submitted nothing whatever is found that could with any reason be considered offensive; but the Remonstrant, on the contrary, has endeavored, with the utmost composure and in the most civil terms, to present the case in question with the legal means pertaining thereto, without introducing the slightest digression not relating to the matter. From which it appears most clearly that the defendant, together with his counsel, solely out of vexation and obstinacy, have used the defamatory passages cited above and occurring further in the response. The said Remonstrant therefore turns herewith to Your Noble Worships with a respectful and at the same time earnest request that to the Ensign Coenraad Nelson his written response submitted against the undersigned, with the documents annexed thereto, may be returned in court, and that he be ordered to exhibit another response in court within a certain specified time; wherein he shall have to guard himself carefully against all expressions and digressions that do not fully concern the matter, or contain any the least defamation with respect to the said Remonstrant; that furthermore, without prejudice to his right to cite all regulations, ordinances, and orders established for the burgher guard, along with whatever else he deems necessary for his defense, he shall nevertheless have to take care not to add anything to his written response that could in any way seem to contain any preliminary opinion and provisional decision regarding the matter in question; and that consequently the aforementioned Nelson be expressly prohibited from exhibiting again in court the aforesaid extract minutes from the extraordinary meeting dated 23 February last, with a serious recommendation to the assistant Willem Kolver, as pleading before this assembly, to be careful in the future to refrain from submitting writings and documents in which the prescribed regard with respect to this council and the respective officers of Justice has not been completely observed in all parts. Since it pleased Your Honors on 3 February last to place in the hands of the undersigned, acting ex officio here in the affairs of the Landdrost of the Colony of Zwellendam, a copy of a certain petition presented to this Council by the Burgher Stephanus Fouché, tending to obtain payment for a certain slave sent by him as early as the year Ao 1788 to the then-serving Landdrost of Zuellendam, Constant van Nuel Onkruydt, from that 120 person who has kept the same concealed for so long under a cloak, as the petitioner expresses it, and has not presented him before Your Honors, in order to serve as a report on that petition; so the undersigned has the honor, in dutiful obedience to the orders of this Honorable Council, now to present to the same: That it is entirely unknown to the undersigned in his aforesaid capacity for what reason the aforementioned slave was placed here in the Company's prison by the gentleman van Nul Onkruydt, since the undersigned has hitherto never received any written communication from the present Landdrost regarding the petitioner's slave, the reason for which may perhaps only lie in the fact that no evidence was left to him by his predecessors from which he could have deduced that a slave of the burgher Stephanus Fouché was here in the Company's prison or in the Honorable Company's slave lodge. That it is true that the undersigned, when it became known to him that a slave of the petitioner was in custody, might have investigated what the situation was and how it could be concluded, but that this investigation always had to remain within the bounds of a simple inquiry as long as no documents for the furtherance of the matter were handed over to him; because the authorization of the Honorable Political Council to the undersigned in no way imposes the obligation to act for the Landdrost of Zwellendam proprio motu, without being furnished with the slightest information: Furthermore, notwithstanding that the undersigned could always content himself with this, he nevertheless appeals in this matter to the testimony of the present Landdrost Faure, to whom he says he has repeatedly complained that delinquents belonging to the Magistracy of Zwellendam were found in the Honorable Company's slave lodge as well as in the prison, concerning whom no information had been turned over 121 over to him, which complaints were echoed back to the undersigned by His Honor; because it was not well possible for the Landdrost to hand over anything to his representative that had not been placed into his hands by his predecessors. That finally, with regard to the complaints of Fouché against the adjunct fiscal, by which the undersigned considers himself to be meant: concerning this, the undersigned can report to Your Honors in this his capacity that it has appeared to him upon inquiry that the petitioner's slave, having become sickly through his long detention, was placed according to custom in the Honorable Company's lodge, in order to be housed in the prison again after being properly restored to health there; whereby it happened in the past year that the aforesaid slave, through neglect of proper notification that he had recovered, continued to walk about in the Honorable Company's lodge, without those to whom the matter pertains knowing anything about it, at least so far as is known to the undersigned: which also caused the petitioner's wife to find her aforementioned slave in the street in the month of October of the past year; at which time the undersigned could not take it upon himself, on his own authority, to set at liberty a slave who belonged to the criminal prisoners, or to restore him to his master. having deprived of life, the undersigned, in his aforementioned capacity, upon exhibiting two attestations to this Court, had requested and also obtained permission to keep the said Botma in civil detention until such time as reliable word should be received from Graaff-Reinet as to whether such a crime had actually been perpetrated; That the undersigned, having now for a considerable time attempted in vain to obtain any elucidation concerning the aforesaid matter, has now finally been personally informed by the aforementioned Landdrost of Graaff-Reinet, who is currently at this Capital, that the aforesaid S. C. Botma falsely claimed to have murdered the burgher Katenbrink at Graaff-Reinet, since he, the Landdrost, having departed from there only during the current year, left the said Katenbrink at home in good health; and that Botma must have accused himself in that manner either out of derangement or for some other reason; That the detainee himself also, immediately after his detention, revoked his aforesaid confession and claimed that, having fallen into a derangement of mind through excessive love, he had become desperate through the absence of the object of his love, and was thereby driven to that extravagant self-accusation. The undersigned therefore considers himself obliged to bring all this to the knowledge of Your Honours and to declare on behalf of the Landdrost of Graaff-Reinet that, no crime having been committed, he also has no grounds to institute any action, and thus may well consent that the detained burgher Stephanus Cornelis Botma be released from his civil detention, provided he pays the costs. While for the rest he is of the respectful opinion that, however much the repeatedly mentioned Botma might be considered to have misled Justice, he nevertheless ought not to undergo any further correction for it, because his situation, in the judgment of the undersigned, deserves pity rather than punishment. After the reading of which it was approved to release the detained burgher Stephanus Cornelis Botma from his civil detention, provided he pays the costs. Furthermore, it was made known by the said Adjunct Fiscal Truter on behalf of the Independent Fiscal that, when in the preceding week a premature child had been found here on the beach, being, according to the declaration of the Surgeon, a fetus of approximately five or six months, the Independent Fiscal, upon the investigations conducted for this purpose, had discovered that the mother of that fetus was said to be a female slave named Amelia van Bali, belonging to the Company's Cook Denner; that this Amelia, having been heard on interrogatories before Commissioners from this Council, it had then clearly appeared that the said slave Amelia is without any guilt, as the fetus dropped from her on the occasion when she was sitting on the privy to relieve herself; that although the Officer had not the least foundation to proceed against the said Amelia, he nevertheless could not release the said Amelia, having been heard and examined before Commissioners, without the express authority of the Council. Wherefore, in consideration of the aforementioned circumstance, it was approved to return the repeatedly mentioned Amelia, as being without guilt, to her master. Lastly, having resumed the Resolution taken on the 21st of this month, together with the draft representation regarding the Independent Fiscal to be presented to the Honourable Governor and the Council of Policy, it was now further resolved not to submit the aforesaid representation, but to postpone doing so until the matter initiated against Mr. Le Sueur shall be finally terminated. After I, in my capacity as chief ruler of this Colony, had caused to be requested through the Secretary W: S: van Ryneveld from the President of your assembly both a legal statement or authentic copy of the accusations submitted to your assembly on 17 March last by the Independent Fiscal against the senior merchant and cellar master I. E. Le Sueur, as well as an extract of the minutes of the assembly held on that day: it was with the utmost astonishment that I, instead of having this demand that so lawfully belongs to me fulfilled, received a very mutilated extract of the criminal court roll, held at an extraordinary meeting on the 21st following. An extract filled with several et ceteras, and from which it appeared to me that the majority of that assembly saw fit to raise objections to fulfilling this expressed desire of mine, and this without finding alleged therewith the least reasons for this refusal, which is as singular as it is unheard of. Since it now goes without saying that for a Governor, if he is to acquit himself properly of the post entrusted to him, nothing of what happens in the Colony belonging under his authority may be concealed, but he must have knowledge and information of everything. Judicial matters also fall principally under his direction, while no execution of criminal sentences may take effect without his sanction and approval, and even in civil cases no arrest or attachment of persons and goods may be levied without his permission. And finally, in the particular instructions prescribed to me in that capacity by the Lords Directors, Art: 14 expressly commands in clear words: to ensure that no improper or arbitrary acts are committed by any of the Company's servants, of whatever rank or quality they may be, but on the contrary that everyone be held to the strict observance of the Company's orders, regulations, and instructions made or yet to be made regarding their office. Thus, it will require not the least demonstration that one neither can nor may refuse to me, upon my requesting it, a copy of the accusation submitted ex officio in full council and thus publicly by the officer of justice against such a notable servant of the Company, along with the documents relative thereto, and the minutes of what was transacted concerning it, especially in a matter in which I have learned that both the Company's interests and my own honor and reputation are said to be considerably concerned: While I would not dare to suppose that the proceedings held in the Council of Justice could not bear the light of day, Or that that majority of your assembly would presume, in neglect of their duty, to oppose so directly the authority granted to me and the commands of our rulers: I have therefore preferred to ascribe this refusal rather to a wrong interpretation of what was requested by me than to other intentions not very consistent with the notions of the administration of impartial justice, and thus considered it best, before taking any other measures for the maintenance of the authority entrusted to me, to present to you once again distinctly what I desire, with a repeated requisition that it may be complied with as soon as possible. Saturday, the 9th of April 1791. In the afternoon at five o'clock, Extraordinary Meeting. Present: the Honorable Johannes Izaak Rhenius, President, and all the Members, except the Independent Fiscal here, Mr. Johan Nicolaas Steven van Lijnden, and Mr. de Wet. When the Council had assembled this afternoon to review and sign the missive that, pursuant to the resolution taken this morning, is to be dispatched to the Right Honorable Governor in reply to his communication of yesterday, Mr. Carel Mappa, a Member of this meeting, requested after the said review whether, although he could not nor wished to withdraw from co-signing the letter as written collegially, he might nevertheless be permitted to write under his signature "with reservation of his opinion," particularly because the final paragraph of that missive was completely contrary to the advice he had delivered this morning, and he therefore did not wish to contradict himself in one and the same matter; he considered himself unauthorized to make such an offer as was inserted into the missive of this Council upon the requisition of the Right Honorable Governor made under his authority, as he was of the opinion that, while maintaining due respect for the government of this place, the exclusive authority of the aforementioned Governor ought not in this case to be confounded with that of the Honorable Council of Policy. Into which request the Council judged it could not enter, on the grounds that, according to the constant practice in this Court, all signatures made collegially, by Members who had voted in favor as well as against, have been made without any such addition, and thus one ought also in this case to adhere to custom. After which the aforementioned Mr. Mappa requested that the Minutes of this morning might then be annexed to the letter. Which likewise could not be granted. However, the aforementioned Mr. Mappa was granted the freedom, when signing the said missive, to also have such notes made in the minutes as he deemed necessary to serve for his discharge. And he thereupon co-signed the letter under the condition that this restriction of his might be recorded in the minutes. Furthermore, Messrs. Fleck and Truter, who had voted with Mr. Mappa in this matter, having also requested such an entry in the Minutes, the same was also granted to them, and the Secretary was at the same time authorized to issue an extract thereof to Messrs. 137. of this Government, Johan Nicolaas Steven van Linden, defendant, in order to hear a request for an extension of time instead of serving an answer to his submitted claim. The court grants the petitioner the requested extension of time until fourteen days from today. The petitioner presented a petition and submitted therewith an extract from the civil court roll of 18 March 1790 and one from the criminal roll of 17 March 1791, the aforementioned petition further reading as follows: To the Noble and Honorable Lords President and Members of the Honorable Court of Justice of the Castle of Good Hope. Noble and Honorable Lords, The aforesaid Sr. Willem Kolver, as attorney of the [illegible] Coenraad Nelson Junior, petitioner, against the aforementioned Honorable Mr. Johan Nicolaas Steven van Linden, defendant, in order that, whereas His Honor has defaulted, according to the order of the Honorable Court of Justice of the 17th of the newly past month of March, on yesterday's held ordinary court day, pursuant to his made order and obtained request to serve a reply, thereby to hear a request for default. The undermentioned suspended and attached servant of the Honorable Company, Willem Kolver, as attorney of the Ensign of the Burgher Infantry here, 138. here, Coenraad Nelson Junior, shows with due respect: That in the suit initiated by the officium fiscaal upon and against the present plaintiff, before this Honorable Court on 17 March last, the defendant ratione officii herein requested and obtained a copy of the plaintiff's answer and annexes, in order to serve a reply against the ordinary court day two weeks after date, pursuant to the annexes; That the plaintiff on the last ordinary court day, on the ultimate of the newly past month of March, was extremely surprised that the Mr. defendant ratione officii did not pursue his obtained term by having the undersigned summoned modo ordinario as aforesaid, either to serve a reply or instead thereof to hear a request for an extension of the term, which His Honor, according to the adopted manner of proceeding, was indisputably obliged to observe; the more so since His Honor, as appears from his signed citation, caused the present plaintiff to be summoned to answer the claim and further proceed according to law. To do which according to style and practice, one ought, as the principal requisite, to observe that one chiefly conforms to the manner of the roll of such tribunal before which one wishes to proceed, and moreover to behave strictly according to the statutory terms of such courts, which was not observed by the Mr. defendant ratione officii. If one examines for this purpose what is taught in law in this respect, namely: if the plaintiff, after the answer or satisfaction of the matter, defaults in proceeding with the case, default is requested against him, whereby he is barred from what serves for that day, Vide Instructions of the Court, Art. 61 & 121, before the High Council, Art. 254. Yet, Noble and Honorable Lords, it is not the undersigned's intention now to interrupt Your Noble Honors' weighty occupations with futile incidents and requests, but only to help remind them amid their manifold duties that, according to the doctrine of Damhouder, Wielant, Gail, and Merula, such defaults are also granted salvo purge and with reinstatement at the nearest, or otherwise 139. the defaulting party is excused for reasons against it and permitted to remedy the said omission, provided he pays the costs. To which end the undersigned has annexed hereto the exhibit sub No. 3, whereby it will appear to Your Noble Honors at a glance how the undersigned was condemned by Your Noble Honors in his private capacity in the costs of that instance, apparently because, according to the said minute, he did not dutifully comply with the order respectfully requested of and so graciously obtained from Your Noble Honors. However, Honorable and Worshipful Sirs, the reasons upon and for which the decree of apprehension is requested are, in the opinion of the undersigned, by no means of such a nature that the decree of apprehension could be granted upon them, because the aforementioned Mr. Woeke has not justified with any sufficient evidence that perniciousness and harm to the public peace in the person of the said Malan assumed by his Honour; for it would surely be asking too much of his judges to expect them, without the slightest proof and thus on mere conjecture, to simply condemn a fellow human being in civil matters, let alone to proceed to an assault upon someone's person, for which latter measure naturally, according to the simplest rules of law, a crime must have been committed which, being proven, absolutely warrants corporal punishment. Since the reasons, or rather those proofs upon which a decree of apprehension could be requested, are lacking, it follows naturally from this that the judge can decline the granting of such a decree with the highest right; the more so as the undersigned would not gladly wish to decide whether the said Malan, through his disorderly and punishable conduct already known to Your Honors and Worships, merits corporal correction and therefore ought to be taken into apprehension for that purpose. The undersigned submits these his considerations to the most wise and more enlightened judgment of Your Honors and Worships, and hopes hereby to have fulfilled your expectations. In the forenoon present all the Members, except the Honorable Lords President Iohannes Izaak Rhenius and Independent Fiscal Johan Nicolaas Steeven van Lynden, together with the gentlemen Mappa and Kleck, both by indisposition as occupation. The senior merchant and cellar master, as well as Member of the Honorable Council of Policy of this Government, the gentleman Iacobus Johannes Le Sueur; petitioner. Against the gentleman Independent Fiscal here, Johan Nicolaas Steeven van Lynden R:O: respondent: in order to hear claimed and concluded to the giving of a copy of such claim and conclusion as the aforesaid respondent has been pleased to make and take upon and against the petitioner, and further to proceed as according to law, cum expensis. The petitioner, having given to know that although his honor had not been able to comply with the matter imposed on him by the Gentlemen Masters, his honor, since the period of 3 months that was set for it was now expiring, had also not wished to withdraw himself from complying with the Appointment of this Council, therefore requests a copy of the claim and exhibits submitted by the respondent, as well as a term of six weeks in order then to submit replies thereto. Subsequently, there were brought to the table the written criminal claim and documents submitted by the Independent Fiscal on and against the under-cooper Ewerwyn Blang and the deckhand Jan Sadeler, in a case of attempted sodomy; Whereupon, having deliberated maturely and having considered all that merited reflection, the Council, administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, has adjudicated to the plaintiff in his official capacity his claim made and conclusion taken on and against the detainees Everwyn Blang and Jan Sadeler. This meeting having been specially convened to decide upon various documents circulated for reading, which could not be disposed of during the ordinary sessions due to numerous activities. Thus, the criminal claim and conclusion submitted by the merchant and Landdrost of the colony Graaff Reinet Moritz Herman Otto Woeke on and against the detained burger Tobias Meinhardt, though provisionally placed on Robben Island according to the resolution of 16 September 1790, was taken in hand, together with all documents belonging to this lawsuit; whereupon, having deliberated with all possible attention; The Council, having considered all that served the matter and could move Their Honors, administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, has banished the mentioned Tobias Mijnhardt from this country and its jurisdiction forever, as Their Honors banish him from it hereby; with condemnation of the defendant to all costs of these proceedings, and dismissal of the further claim made and conclusion taken by the Officer. After which there were also brought to the table the documents and records that served in the lawsuit instituted by the Independent Fiscal van Lynden on and against the junior merchant in the service of the Honorable Company Johan Fredrick Kirsten in a case of atrocious verbal injury, charged in his official capacity; however, before deciding herein, having considered the request made on the roll on 3 February last by the defendant regarding the member of this Council Mr. Hendrik Andries Truter, and the interests submitted thereupon on the 17th of the mentioned month by the Adjunct Fiscal Mr. J. H. Truter, the Council judged that the mentioned Mr. Truter may indeed vote in this matter. And Their Honors further proceeding to the decision, after consideration of everything that deserved any notice in this matter, administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, have dismissed the claim made and conclusion taken by the plaintiff in his official capacity on and against the defendant; with condemnation of him, the plaintiff in his official capacity, to all costs incurred in this case. Lastly, there was brought to the table the representation submitted on 31 March last on behalf of the Independent Fiscal van Linden regarding the answer with its annexes of the burger ensign Coenraad Nelson, which according to the contents of the provisional resolution adopted thereon, together with the aforesaid trial documents, was circulated among the respective members of this Council; it was now deliberated upon with all attention and agreed to summon to the Council the assistant of the Honorable Company Willem Kolver, who was suspended from pay and who, as the attorney of the mentioned Nelson, produced the written answer, and seriously to advise him in future carefully to refrain from using such expressions with respect to an Officer of Justice in his writings as appear in the same answer of Nelson; Furthermore, dismissing the further request made in the mentioned representation, and notice of this ruling will be given to the Officer representing in his official capacity by an extract hereof, in order to be able to serve with a reply to the aforementioned answer. The same day The Honorable Independent Fiscal of this government, Johan Nicolaas Steven van Lijnden, ex officio plaintiff, against the burgher and farmer Gerrit du Toit, defendant, to hear such claim and conclusion as the Honorable ex officio plaintiff shall think fit to make and take, to answer thereto, and further to proceed as the law requires; on account of and regarding the matter that the defendant did not shrink from, on the 9th of the past month of April, violently assaulting and insulting his fellow burgher Jacob de Villiers Pieterszoon. The Deputy Fiscal, Mr. Johannes Andreas Truter, submits a surgeon's certificate, an account executed by the burgher Jacob de Villiers before the commissioners, and a declaration from the servant of the said de Villiers, and concludes on the basis of those documents; that the defendant, on account of what has been committed, shall be corrected in such manner as this Council in good justice shall deem proper. The defendant says thereto that the case is not as Villiers has stated, as he, Villiers, had set fire to the veld, whereby a portion of the vineyard and trees on the farm of his, the defendant's, father was burned away, and thus much damage was caused. That he, the defendant, thereupon, by order of his father, had gone to inquire whether this veld had caught fire by accident or had been willfully set ablaze, and that upon the defendant's arrival at the farm of Villiers, the latter had immediately approached him in a brusque manner and, with a whip in hand, asked: Do you want to hit me? That he, the defendant, having become enraged at the threats of him, Villiers, had indeed given him two blows, but that Villiers had immediately struck the defendant back; declaring further not to have assaulted the said Villiers and also not to have delivered more than two blows to him with the hand. Whereafter the defendant requested that he might be granted a copy of the documents submitted by the officer, in order to enter his interests thereon. 165. The ex officio plaintiff leaves this to the Council's judgment. The Council grants the defendant a copy of the submitted documents, in order to serve his answer thereto four weeks from today. Next was read a petition from the Honorable Mr. Jacobus Johannes Le Sueur, Senior Merchant and Cellar Master, as well as Member of the Honorable Council of Policy here, reading: To the Honorable President and Members of the Honorable Council of Justice at the Cape of Good Hope Honorable Sirs, With due respect and proper decency, the undersigned, as general attorney of the Honorable Mr. Jacobus Johannes Le Sueur, Senior Merchant in the service of the Honorable Company and Member of the Honorable Council of Policy of this government and Cellar Master here, takes the liberty to make known that on the date of 7 April last, at the requisition of the said Honorable Mr. Le Sueur, a declaration was executed before the Honorable Company's return ship Vasco da Gama, Commander Captain at Sea, the valiant Hans Barends; that the undersigned's aforementioned principal thereafter left no means untried to have that declaration properly re-acknowledged and sworn to in the ordinary manner, to which end the undersigned's principal on the following day had a request made to the Honorable President of this august assembly, that a commission from your honors' midst would be pleased to go on board the abovementioned vessel Vasco da Gama, since it had already received its dispatches and was only waiting for a favorable wind to turn the bow toward the beloved fatherland, in order to have the aforesaid declaration properly re-acknowledged and sworn to before their honors. That notwithstanding all possible effort exerted in that regard by the undersigned's repeatedly mentioned principal, everything was in vain, because the First Court Messenger, Carel Ewald Ziervogel, had the audacity, through his negligence and willful inactivity, to make the order given to him to convene, request, and notify that commission to the gentlemen members of this assembly so far illusory that this commission remained without effect, and an instrument was thereby deprived of a principal requirement. That meanwhile it appears most clearly from the well-mentioned minute that the failure to swear to that declaration is to be attributed to nothing other than the gross idleness of the said Ziervogel, while it is established per consequentiam from the minute that he, Ziervogel, received orders and instructions to request two gentlemen members of this venerable court to proceed at the appointed hour on board the ship Vasco de gama, in order to take the oath on the declaration passed at the requisition of the undersigned's aforementioned principal. Indeed, Honorable Worshipful Gentlemen! This conclusion rests most clearly upon what was set down in the aforementioned minute, namely: that Mr. de Wet, having further learned that a declaration was also to be sworn at the requisition of Mr. Lesueur, declared that he could not attend thereto, which written statement sufficiently confirms that he, Court Messenger Ziervoogel, cannot in any way pretend ignorance that a declaration was to be sworn on board that ship at the requisition of the undersigned's principal, nor could it be unknown to him that this vessel lay ready to put to sea with the first favorable wind, while the undersigned's frequently mentioned principal would otherwise in no way have required of the gentlemen members of this Court the trouble of going on board that ship, as that captain, had he been present in loco, would indeed have appeared before their Honors hora locoque solito; 168. and that the failure to swear to this declaration is to be blamed on nothing other than the negligence (be it willful or thoughtless) of the court messenger, who, from the attached minute, makes it most clearly evident that he was fully aware that in the subject case a periculum in mora truly existed. Represents with due respect the Landdrost of Stellenbosch and Drakenstein, Hendrik Lodewyk Bletterman: That during the representer's absence, on the fourth of the past month of April, there having been delivered to the prison at Stellenbosch by the burgher Jacobus Stephanus Marais his slave Damon of the Cape, he at the same time gave notice that he, Marais, having ordered the aforementioned slave Damon the day before, together with the fellow slave Roos, to put pressed grapes into the brandy kettle, around which stood a bucket of brandy, and then to go work with the other slaves on a clay wall, a short time thereafter the slave Jephta came home and said that, having ordered the aforementioned Damon to go to work, the latter had cursed him, wherefore he, Jephta, had seized the said Damon by the head and hair, and having subsequently released him, the said Damon seized him, Jephta, around the body, threw him to the ground, and having thereupon come to hard blows with each other, he, Jephta, had released the aforementioned Damon again and proceeded to work, when he, Jephta, noticed that a stab had been inflicted upon him from which blood flowed, and that he, Jephta, having asked Damon why he had stabbed him, the latter gave no answer thereto; no inspection of the wound was made at that time because the surgeon declared under oath that the wound did not penetrate and that he found no serious signs. That the representer subsequently obtained a statement from the said slave Jephta, which not only mostly agrees with the aforementioned report, but also that he, Jephta, was already fully recovered by the ninth day, as was also confirmed by the subsequent surgical certificate. can substantiate the request made: that it will therefore not be necessary to make any other remarks thereon, other than only this: that the Lord Independent Fiscal acted against the respondent ratione officii, that he can never be constrained to provide security for the costs of proceedings initiated by him, as stated, ex officio, to maintain the rights of the High Authority: that in the present case he was also condemned not in his private capacity, but ratione officii; and which costs can therefore never be charged to his personal account; that, moreover, all his goods remain behind here, against which anyone having a claim on account of a personal debt is free to proceed, without however troubling the Lord Requiring Party in person with demanding sureties. The parties having thereupon withdrawn, the reciprocal request made was deliberated upon and taken into consideration: that the Council not only has no legal knowledge of the departure of the Lord Independent Fiscal from this Colony, but moreover is also not sufficiently informed whether a Fiscal, according to the orders of the Honorable Company, would be obliged to pay the costs of proceedings conducted by him ratione officii out of his private purse, or whether those costs ought to be refunded here from the Honorable Company's treasury; and thus much less whether this Council would have the authority to order the Independent Fiscal to provide security for the costs incurred on account of proceedings initiated by him, as aforesaid, ratione officii: there being at least no example thereof to be found in the respective rolls of justice. Wherefore, regarding this and to prevent that the Council of Justice might in time come to be held liable for those costs if the necessary attention were not paid to this matter, it was decided to address the Right Honorable the Governor and the Honorable Council of Policy by representation and to request that His Right Honorable and their Honors might be pleased, in the event that the Lord Independent Fiscal van Lijnden should indeed repatriate, to take the necessary measures for the security of the parties still litigating, or else to prescribe to this Council a rule and guideline according to which His Right Honorable and their Honors, in their wisdom, shall judge that the same ought to conduct itself regarding the requested security. While furthermore, upon the aforesaid submitted representation of the requiring party ratione officii, the following decision was granted: The Council grants the requested appeal to the Honorable Council of Justice of the Castle of Batavia; on condition that the original documents which served in this lawsuit, having been legalized at the expense of the appellant before the Lord Commissioners, shall be transmitted to the said Honorable Council of Justice at Batavia. And furthermore, Mr. de Wet, who delivered the following opinion regarding this matter: "I am of the opinion that the appeal shall be kept in statu quo until the address of this Council shall have been disposed of by the government," had his vote recorded in the minutes.
