court day, or the last day of March, to serve a reply, pursuant to the court roll held by this Honorable Court, and which request was granted to the aforementioned Independent Fiscal. That the respondent, as appears from the annexed extract from the court roll, at the extraordinary session of May 14 just passed, was informed that the gentleman prosecuting officer, instead of fulfilling on the prescribed court day his made and obtained request, namely to serve a reply against the said answer, on the contrary, on the last day of March just mentioned, instead of summoning the respondent in the ordinary manner before Your Honors, without the knowledge of the respondent, and consequently in a very singular manner, contrary to the respondent's conclusion of answer, exhibited a statement in this Honorable Court, a manner of proceeding that is entirely unheard of and directly contrary to the rules of practice. For by law it is certain that in cases consisting of facts, parties are entitled to plead by claim, answer, reply, and rejoinder, as is taught in the manner of proceeding in the cities and in the countryside, article 15, and in the notes there. Now it is certain that the prosecuting officer, prior to submitting that statement, without the knowledge and privity of the respondent himself, neglected that which the principal of the respondent in the first instance before Your Honors among other things caused him to be summoned for, namely to proceed according to law. All this was arranged by the gentleman prosecuting officer in such a way as to deprive the respondent of a proper defense against the said statement, whether orally or in writing, which has nevertheless been granted to him by the immutable law of nature. Furthermore, the gentleman prosecuting officer has thereby in no way complied with that end to which he, along with the respondent, is indisputably obligated to conduct himself, according to the statutory terms of this respectable bench. For indeed it is taught in law that whoever wishes to involve someone in a lawsuit in order to obtain satisfaction for what he understands is due to him, must do so with good order and with circumspection, and therein follow the style and manner of proceeding observed before the court or tribunal where he wishes to act. For by law it is evident that in the order and manner of the administration of justice one must follow the style of the place where the action is brought, as is taught in the first article of the manner of proceeding in justice in general. Moreover, the gentleman prosecuting officer, as appears from the aforementioned extract dated May 14 of what was resolved by Your Honors upon his statement, was given notice, with a special appended order, in order now to be able to serve a reply to the aforementioned answer. To which order it appears that the prosecuting officer has paid very little heed, while he has now managed to practice a manner of proceeding entirely to the prejudice of the respondent's good right. While the prosecuting officer himself requested and obtained permission to serve a reply, and was thereafter ordered by Your Honors, the gentleman prosecuting officer, instead of proceeding according to style and practice, to which he was indisputably obligated by law, to the conclusion of the case in question according to his made request, thought fit to have the principal respondent summoned today, in order, instead of serving a reply, to hear renunciation of further productions, certainly because the gentleman prosecuting officer by that practice sought to cut off the way to demonstrate the invalidity and groundlessness of his purported action on the foundation of law. That the respondent, for the preservation of his principal's property against such an impracticable manner of proceeding, finds himself obligated to protest, while the respondent further leaves it to the choice of the gentleman prosecuting officer whether he is inclined to serve a reply fourteen days from today, in which case, if he is then required to do so, he will make such request to Your Honors at the prescribed time as he shall be advised. But in case the gentleman prosecuting officer should not be pleased to incline thereto, the respondent will, with the permission of Your Honors, consider the statement submitted by the prosecuting officer on March 31 of the current year as a reply, and very respectfully request Your Honors for a copy thereof, in order to serve a rejoinder against it fourteen days later. While the respondent lastly takes the liberty to declare that he cannot renounce at present, as he still has very much to bring forward against the claim of the gentleman officer, and has obtained the necessary evidence for that purpose after submitting the answer.

180 The petitioner in office continues to persist in his renunciation, and directly against the protest of the requisitioned court, will not have any counter-notation made, as he very gladly wishes to grant the court the pleasure, if it finds pleasure therein and wishes to proceed by force, to submit a rejoinder, though not to the submitted memorial, because it is not only not a replication, nor can it be regarded as such, but even belongs to another lawsuit; just as the Council, for those reasons, has already raised objections against granting a copy thereof to the defendant, the petitioner in office still requesting that no copy thereof may be granted to the court. Whereupon request was also made by the said Jacques, whether, since rumors exist that the Independent Fiscal will repatriate in the near future, his Honor may therefore be ordered, before his departure, to provide surety for the costs of this lawsuit; and that also the petitioner in office, in the very same manner as happened to him, the requisitioned party, on 18 March 174 in the case of Jan Godlieb Mader versus Johannes Holkmeyer /concerning which he at the same time produced an extract from the civil court roll/, may be condemned in the costs of this instance. The Council grants the court's request, namely to submit a rejoinder: granting furthermore to the said court a copy of the memorial submitted by the petitioner in office and attached to the lawsuit for his perusal; furthermore, in the memorial to be presented to the Honorable Governor and Honorable Council of Policy regarding the surety to be provided by the Independent Fiscal pursuant to the decision taken above, mention shall also be made of the request made by the requisitioned party. The Adjunct Fiscal Mr. Johannes Andreas Truter, qualified to handle the affairs of the Merchant and Landdrost of the Colony of Zwellendam, Mr. Anthony Alexander Faure, plaintiff in office against the burgher Gideon Joubert, son of Gideon, defendant, to the end of hearing, on account of ill-treatment committed in a kraal of the Hottentot Captain Keeste, such demand and conclusion as the plaintiff in office shall think fit to make and take against the defendant, to answer thereto and further to proceed according to law. The messenger, entering, reports that the defendant has not appeared: Wherefore the plaintiff in office requested the first default with the benefit thereof and a second citation. The Council: granted. 181 The plaintiff in office produces a written demand, supported by four annexures. The Adjunct Fiscal Mr. Johannes Andreas Truter, acting in office for the Merchant and Landdrost of the Colonies of Stellenbosch and Drakenstein, plaintiff in office in a criminal case on the one side against Jochem of Mandaar, Telemachus of Mallabaar & Sephta of Bengal; the first-named belonging to Under-Sheriff Matthysen, the second to the messenger Godfried Gabriel Hauptfleisch, and the last-named belonging to the widow of the late elder Daniel Rossouw, prisoners and defendants in the aforesaid case on the other side. The prisoners, having heard the conclusion of the demand read, say they request a merciful punishment. The plaintiff in office continues to persist in his demand and requested justice: 182 The Council holds this case for circulation in advisement. The roll having proceeded this far, a memorial was submitted by the aforesaid Adjunct Fiscal Mr. Johannes Andreas Truter, on behalf of the Independent Fiscal, and with respect to the soldier Johan Christoph Hitzrood, accompanied by an annexure executed by the slaves Philander and January, bondsmen of the burgher Ensign Sebastiaan Valentyn van Reenen, which memorial reads as follows: To the Honorable and Respected President and Council of Justice of the Castle of Good Hope: Shows with due respect the Independent Fiscal of this Government, Johan Nicolaas Steven van Linden: That on the 7th of this current month of June, it was brought to the knowledge of the Fiscal's office by the Ensign of the burghery Sebastiaan Valentyn van Reenen, that he, having discovered that one of his slaves named Philander of Madagascar had made himself guilty of stealing some silver spoons and forks at his house, had caused the said Philander to be placed in the public prison, with the request to be allowed to have that slave punished on that account. 183 That the slave Philander, upon this permission being obtained, was punished in the customary manner, and during the punishment confessed that, besides the aforesaid spoons and forks, he was also complicit in the theft of six gold buttons and a shoe buckle, which buttons and buckle he, at the request of his fellow slave Rosina, had pawned with the soldier Johan Christoph Hitzrood stationed in the National Garrison, adding that his fellow slave January of Boegies was fully aware of this latter theft and subsequent pawning; just as the latter also made no difficulty in confessing this fully. That the memorialist in office, informed of these circumstances, immediately, with the prior knowledge of the Honorable President, caused the aforesaid soldier Hitzrood to be questioned as to whether and how the pawning of the aforesaid gold buttons and shoe buckle had taken place with him; whereupon the same Hitzrood having seen fit to answer in the negative, the memorialist in office furthermore had his room sealed, likewise with the prior knowledge of the Honorable President, in order, in case he should be guilty of fencing the aforesaid stolen goods, to deprive him of the opportunity to conceal the same goods and thus evade a judicial investigation. The memorialist in office having deemed himself all the more obliged to this because he may perhaps find himself, through such an investigation, in the position to make some discovery concerning the numerous burglaries currently taking place.

Reasons why the aforesaid claimant now turns to your Honors, with a respectful request that your Honors please commission two members from among your midst, in order, together with the claimant, to investigate whether any discovery concerning the aforesaid or other stolen goods could be made in the dwelling of the aforesaid soldier Iohan Christoph Hitzrood: and in case anything of that nature should be discovered, the claimant further requested your Honors' authorization to take the said Iohan Christoph Hitzrood into apprehension, in order to initiate the necessary proceedings against him. underneath stood: Doing which etc. was signed: I:s A:s Prueter, Deputy Fiscal. In the margin: Exhibited in court on 9 June 1791. Which memorial having been read, the request made therein was granted; the aforesaid inspection shall have to take place immediately after the conclusion of this meeting. Furthermore, the said Deputy Fiscal produced on behalf of the Landdrost of the Colonies of Stellenbosch and Drakenstein, Mr. Hendrik Lodewyk Bletterman, a memorial of the following content: To the Honorable, Worshipful Mr. Johannes Izaak Rhenius, President, together with the other Honorable Members of the Honorable Court of Justice of this Government. 185. Honorable, Worshipful Sir and Gentlemen. The Landdrost of Stellenbosch and Drakenstein, Hendrik Lodewyk Bletterman, represents with great respect: That on Saturday the 7th of this month, in the evening, through a certain Hottentot Piet de Jager, by a letter dated the 1st prior thereto from the burgher Hendrik Albert Feit, in which was contained a so-called private statement from the burgher Iohannes Louw Jacobusz, it was communicated to the memorialist that a slave boy belonging to him, Feit, had died, whom he had punished some days before, or, as he explains himself, had given a flogging because he had caught him having stolen and roasted a sheep, and that he had requested the abovementioned Louw, who had also come, to inspect that boy and the place where the sheep was roasted; that the memorialist could also learn all this from the bringer of that letter, as he had been present there; the memorialist then also questioned the said Hottentot de Jager regarding both the one and the other, whereupon he claimed that this slave, named Hector, had been a sheep herder and, having been beaten on the buttocks with a sjambok by the aforesaid Feit over the stealing and roasting of a sheep, had died the third day thereafter; and to the question of when he, the Hottentot de Jager, had ridden from home, having answered the Monday before; the memorialist, because the account of the said Feit as well as the statement appeared too clean and unsuspect, and it was very suspicious that the said Feit, who formerly, when shooting dead a small Hottentot for a hare, knew what he had to do, had not summoned Field-Cornet Gideon van Zeil, who lived a day's ride on horseback from him, to inspect the corpse; 186. feigned to the said Hottentot de Jager to have already been better informed of the case the Thursday before, and presented the impossibility that a slave could die from a slight punishment on the usual place, barring unexpected accidents; whereupon the said de Jager came to say substantially: "Now that I see that the Master knows the matter better, I shall also tell the truth, but then the Master must also see to it that I am not also beaten to death or mistreated by Feit, for out there so much happens that the Master here knows nothing about," thereupon giving the following account: That he, Piet de Jager, together with his wife Sara having supervision over the farm of the burgher Daniel Lambregts, having brought to the farm of the said Feit on Thursday eight days before, or the 28th of the recently passed month of April, some trousers and shirts made by his said wife for the slaves of the aforesaid Feit at the request of his wife, and for which he, de Jager, had also always been paid, it was told to him then by the aforementioned Feit that he had punished his sheep herder named Hector over the stealing, roasting, and hiding of a sheep from

That the mentioned Feit immediately upon his return home, having ordered both above-mentioned Hottentots and slaves to bring the aforementioned Lestor home, they also immediately went thither, and a short time later had brought the mentioned Lestor home dead, whereupon the corpse, by order of the mentioned Feit, was placed in the sheep-herder's cottage and the same was closed up. That the following day, or on the Saturday thereafter, the burgher Johannes Louw, living not far from there, having arrived at the place at the request of the aforementioned Feit, the same was requested by Feit to view the corpse of his slave boy Lestor, to whom he had given a small hiding over the stealing and roasting of a sheep, and who had died the evening before; as well as the place where the stolen sheep had been brought and hidden by the aforementioned Lestor, which having been done by the mentioned Louw, the same had also testified to having discovered no mortal wound on the said corpse, after which the corpse was buried by order of the mentioned Feit. 190 is summoned to appear in person before this Honorable Court on Thursday the first of September of this year, at nine o'clock in the morning, in order to hear such claim and conclusion, as well as request or requests, as the prosecuting officer shall deem fit to make and take against him, to answer thereto and further to proceed as by law required. Below was written: Which doing, etc. Was signed: H: L: Bletterman. In the margin: Exhibited in Court at the Cape of Good Hope, on 9 June 1791. After which reading and resumption of the annexed supporting documents, the Council's decree was granted to the prosecuting officer to summon the burgher Hendrik Albert Teil in person before this court; and this summons shall also, in accordance with the request made to the said Landdrost, take place by missive under the Council's great seal against the first of September next. Whereafter, furthermore, the Council was informed by the aforesaid Deputy Fiscal in his aforementioned capacity that report had been made to the said Landdrost that some money had been stolen from a chest belonging to the burgher Fredrik Kannemeyer, among which was a piece of paper currency of 40 rixdollars, and that the said Landdrost had immediately given the necessary orders so that, in case anything of this theft might be discovered, 191. the necessary information could be supplied to him in good time. That thereupon there had been sent to him, the Landdrost, by the former messenger at Stellenbosch, Ernst Fredrix Sautsman, a piece of paper currency of 40 rixdollars, which had been brought to him, Sautsman, for exchange by a certain female slave Sabina, belonging to the former Chief Surgeon of the Company's Hospital, Pieter Domus. That the said Landdrost had thereupon immediately summoned the same female slave before him and questioned her as to from whom she had received that piece of money of 40 rixdollars, something unusual for a slave! Whereto she had first answered that that piece of money had been sent to her by her husband living at the Cape, but that this having been found to be an untruth, she had subsequently answered to the Landdrost, when she was interrogated de novo by him, that she had received the aforesaid piece of money from the burgher Hermanus Combrink's slave, named Batjoe. That when the slave Batjoe was then heard, he declared that he had indeed had a piece of money handed over to the female slave Sabina by one of his fellow slaves, in order to buy a blanket for it; but that the value thereof was minted at only 5 rixdollars, and not at all 40 rixdollars as Sabina had maintained. That thereafter the said Landdrost, maintaining from all this that the aforesaid female slave Sabina might perhaps have knowledge of the committed theft, had caused the same Sabina along with the slave Batjoe to be taken into custody; and had at the same time instructed him, the Deputy Fiscal, to request the Council's approval for the aforesaid apprehension. Which representation having been deliberated upon; the request of the officer was granted. The same shall, however, have to proceed with the prosecution against the aforesaid slaves with all possible speed. Subsequently were read two petitions, the one from the burgher Jan Smit Jurriaansz: and the other from the burgher Jacobus Johannes van den Berg, tending to obtain veniam agendi, in order to summon the honorable Independent Fiscal van Lynden before this Court of Justice, and to make a claim against him for the provision of security before his departure for Europe, on account of the costs already incurred, or in case of appeal still to be incurred, in such proceedings as were instituted by the said Honorable Fiscal ex officio against the aforesaid Smit and van den Berg, and are currently still pending on appeal before the Honorable Council of Justice of the Castle of Batavia. However, considering that this Council, pursuant to the resolution already taken today regarding the security to be posted by the honorable Fiscal, is to address itself by representation to the Right Honorable Governor and the Honorable Council of Policy, it was therefore resolved to grant merely as apostil on the aforesaid petitions: That the request made is taken under advisement, while, however, in the aforementioned representation, the Right Honorable Governor and the Honorable Council of Policy shall also be informed of the petitions of the applicants. On the occasion of the Council having assembled to review the minutes kept yesterday in the civil roll, regarding a certain petition submitted by the Senior Merchant and Dispenser, as well as Member of the Honorable Council of Policy, the honorable Willem Ferdinand van Reede van Oudtshoorn, concerning the conveyance of the house of the honorable Independent Fiscal, the following written advice was at the same time submitted by the honorable van der Riet: "That whereas we, by the declaration of the honorable van Reede van Oudtshoorn made yesterday, are in a more or less satisfactory manner informed of the departure of the honorable Independent Fiscal from this Government, under the executive power and protection of the honorable Governor against the protest of the honorable Council Members, we should furthermore at the same time take care that the fine, for which the honorable Fiscal compounded with the burgher Jan Smit of Dilburg before delegated Members of this Council to the amount of eighteen thousand guilders, Indian Valuation, be properly secured, in order to recover therefrom the reimbursement of that sum, in case the honorable gentlemen of the High Indian Government, who have requested from us the original documents that served in that lawsuit, might see fit to decide upon it."

Thus I am of the opinion, that we de facto should depute two gentlemen members from our assembly, in order to, properly assisted, summon the mentioned Independent Fiscal whether he is inclined amiably to deposit into the hands of the Sequestrator of this Council, or into the Company's Cash, the aforementioned sum of f 18000 in cash, or in securities, and if the mentioned Fiscal is unwilling to comply with this, then to address ourselves this very day to the government here, and by means of a memorial make known and detail in brief how the case occurred, as well as that we, as interested parties in this matter, do not consider ourselves qualified to act, with the request to Their Honors to ensure, before His Honor's departure from this Colony, that he dutifully pays the aforementioned sum, and in case Their Honors should unexpectedly not decide upon our request before His Honor's departure, then to reserve the right to respectfully protest by a subsequent memorial against all damages that might result therefrom for us, with a further declaration of not wishing to remain liable for the consequences that might flow from this. Which having been read, the Honorable President declared that, since His Honor had not voted in the case of the aforementioned Jan Smit van Dilburg, but on the contrary had caused His Honor's sentiment against the resolution taken by this Council on 2 April 1789 to be recorded in the minutes, His Honor would consequently not concern himself therewith now, whilst furthermore also the gentleman van Echten, as not having been present on the aforementioned 2 April 1789, and the gentlemen Fleck and Pruter, having only taken their seats in this Council after that date, likewise excused themselves from this. Whereafter, at the request of the remaining gentlemen members, it was approved to have the Independent Fiscal firmly asked by two Commissioners assisted by the sworn Clerk, whether His Honor was inclined, before His Honor's departure from here, to provide sufficient surety regarding the abovementioned case of Jan Smit van Dilburg. The gentlemen van der Riet and Fleck then, assisted as above, having performed this commission while the meeting was still in session, subsequently reported that the Fiscal had answered Their Honors to that question: that His Honor believed he could pay nothing in the case of Smit van Dilburg, nor provide any surety, because His Honor according to his instructions had compounded upon the decree of the Council of Justice and with the satisfaction of the parties; that His Honor supposed he was in a country of justice, and by no means in a country where the knife is put to someone's throat; that His Honor, arriving in Europe, would address the Gentlemen XVII, and that those Gentlemen would then see that His Honor had departed in a legal manner; that His Honor had no goods to deposit regarding the abovementioned sum of 6000 rds.; that His Honor had already needed this money for consumption in his household, and that if this were to proceed, His Honor would then be obliged to provide surety for all fines enjoyed by him. And thereupon the same gentlemen Rönnenkamp, Smuts, Meyer, de Wet, and van der Riet decided to present the below representation regarding the aforementioned matter to the Right Honorable Governor and the Honorable Council of Policy. Respectfully show the undersigned Tobias Christiaan Rönnenkamp, Johannes Smuts, Gerrit Hendrik Meyer, Hendrik Justinus de Wet, and Ryno Johannes van der Riet, Members of the Honorable Council of Justice of this Government: That by Hendrika Jansen, wife of Jan Smit van Dilburg (which Smit by sentence of 22 November 1787, among other things, was confined for the term of five years to Robben Island and condemned, after the expiration of that term, to remain banished forever from this Government and its jurisdiction), on 26 March 1789 a request was made to the mentioned Council: "Whether the Independent Fiscal might be authorized to compound with her aforementioned husband Jan Smit van Dilburg over the further punishments in execution of the mentioned sentence, to the end that the petitioner might end the remaining few days of her life with her husband in rest and peace, etc." That, it being decided by the Council of Justice aforementioned to place that request into the hands of the Independent Fiscal of this government, Johan Nicolaas Steven van Lynden, previously sent hither by the Most Honorable Lords Directors, in order to provide His Honor's considerations thereon, the mentioned Fiscal did then, on the 31st following thereupon, submit an ample and reasoned writing containing the aforementioned considerations required of His Honor.

required Considerations, and wherein his Honor has declared himself to be of the opinion: that considering the advanced years of the petitioner and her husband, and also the damage that would presumably arise to their joint estate by a perpetual separation from each other, the request made in said petition, in this Singular Case, could be granted, after granting special authorization and recommendation to the fiscal office, in order that, whenever said Jan Smit of Dillburg shall have appeared here again, a precise and watchful eye be kept and caused to be kept on his manner of conduct and behavior. To which advice, dated 2 April of said Year 1789, is added a resolution, whereby Jan Smit of Dillburg was permitted, regarding such part of the sentence pronounced against him on 22 November 1787 as imposed upon him, Smit, a confinement of five years on Robben Island, to compound before the Commissioners with the aforementioned Independent Fiscal, and following said composition, to take up residence at this principal place for the administration of his affairs, with the understanding nevertheless that said Smit shall not only not be allowed to conduct any civic trade, nor be regarded as a citizen, but also, since he, Smit, by said sentence of 22 November 1787 was likewise banished forever from this government and its jurisdiction, he shall have to be sent away from here upon the expiration of the aforementioned five years, whilst further the fiscal office has been authorized during the stay of said Smit at this place to cause a precise eye to be kept on his conduct. Honorable Sir and Gentlemen! Humbly shows the Landdrost of Stellenbosch and Drakenstyn, Hendrik Lodewyk Bletterman. That the Burgher Michiel Casparus Laubscher, on Sunday the eighth of the past month of May, brought to the knowledge of the Remonstrant that his slaves May of Batavia and Damon of Madagascar on the Friday beforehand at noon, the first-mentioned with his permission to go search for so-called kukumakrankas for the children of him, Laubscher, and the last-mentioned to go to the vineyard, where the said Damon has the supervision, to which aforementioned end the first-mentioned slave May had turned away from the aforementioned Damon at a certain distance from the house. That he, Laubscher, with the Burgher Stephanus Jourdaan the elder, who was with him, having ridden on horseback into the field in the afternoon to hunt, had heard from a distance behind the house some shouting and crying out to him, Laubscher, and looking around, had perceived that the aforementioned slave May was held by the hair by a certain Hottentot named Hendrik living with the Widow Stephanus Sebastiaan Walters, the mother-in-law of him, Laubscher, whereupon he, Laubscher, proceeding thither, had called out to the said Hottentot to let the youth go, and that Hottentot choosing not to do so, he had added to the same, rascal, if you do not let him go, I shall shoot you dead, also making a motion as if he were cocking the hammer of the gun; which the aforementioned Hottentot Hendrik seeing, had thereupon let the aforementioned May go, after which he, Laubscher, brought both the Hottentot Hendrik and his slave May to the house, fettered them, and subsequently transported and delivered them to the prison in Stellenbosch, because the aforesaid Hottentot accused the said May of having wounded him with a knife. That the aforementioned Hottentot Hendrik, against the testimony of the above-mentioned Laubscher, related: that he was in hire to the above-mentioned Widow Walters and on the aforementioned Friday having gone to the farm where the Hottentot woman Sara, with whom he kept company, was staying, in order to assist the said Sara, who was sickly, in the washing of the goods belonging to the said Widow Walters, had met on the road not far from there the aforementioned slave May, whom he, Hendrik, having seen by the said Sara, had for that reason asked him what he was doing by the maid; and the said May having answered: looking for kukumakrankas; he, Hendrik, had said, how is it that you can always search for kukumakrankas when the maid is here? Whereupon the said May is said to have asked whether he, Hendrik, carried bottles, and at the same time, with a knife he had in his hands, inflicted five stabs upon him, Hendrik, namely three on the head and on the arms, and one in the left side; whereupon he, Hendrik, caught the said May, who had thrown away the knife, by the hair, and thus had transported and delivered him to the aforementioned Laubscher. That the Remonstrant immediately thereupon having had the said May and Hendrik examined by the appointed former Chief Surgeon of the Honorable Company, now Burgher Surgeon Petrus Franciscus Melchior Briers, and having the wounds on the same examined, the same as well as the Remonstrant discovered various stabs in the shirt of the said May down to his body, and a cut between the thumb and the first finger of the left hand, and understood from the said May that the same had been inflicted upon him by the aforementioned Hottentot Hendrik, who, out of jealousy regarding the sickly Hottentot woman Sara of the Widow Walters, meeting him, May, on the road, had asked what he was doing by the maid, and he, May, having answered that he had not been with the maid, but was going to search for kukumakrankas for his master's children, the same had thereupon attempted to kill him, May, by multiple stabs with a knife; and which he, May, parrying, and the said Hendrik thereupon throwing away the knife and having seized him by the hair, he had discovered that the said Hottentot Hendrik was wounded, without being able to say how the same had come by it, unless he, May, had struck the said Hendrik on the head and elsewhere with a stone, whereas no other wound was discovered on the said Hottentot Hendrik by the aforementioned Surgeon than that slight wound on the right side, notwithstanding that the same maintained that he had received the same along with four others; and from which discovered wounds both the aforesaid Hendrik and the said May, according to the report made by the said Briers, were already completely recovered by the eighth day thereafter; as all this can be seen at large by Your Honors, if it please you, from the annexed account, declaration, and Surgical Certificates. matter and subsequently to the mutual injury, the petitioner would have had no hesitation in causing the jealousy so far presumed between a bastard Hottentot and a slave to cease between the said May and the Hottentot Hendrik by means of a somewhat severe domestic punishment, to be undergone both by the said May and by the aforementioned Hottentot Hendrik, and subsequently returning the said slave May to his master, provided he pays the costs, with further orders to the said Widow Wolters to dismiss the aforementioned Hottentot Hendrik from her service and have him depart from that district, as the undersigned believes it would be very harsh that an inhabitant should have to risk one of his most valuable slaves on account of the possibly misplaced jealousy of a bastard Hottentot; the petitioner nevertheless deemed it safest and most advisable for himself to give the necessary disclosures of all this to your Honorable Worships, so as, on the one hand, to take care that crimes do not go unpunished, and, on the other hand, that against this no heavier punishments are imposed than the laws and circumstances of the case make necessary. Wherefore the petitioner takes the liberty of turning to your Honorable Worships, with the humble request that your Honorable Worships may be pleased to approve the proposal made by the petitioner, and accordingly to declare that the Hottentot Hendrik and the slave May named herein, after first having been domestically punished, the former shall depart from the district where he currently finds himself, and the latter shall be returned to his master, provided he pays the costs; or else that your Honorable Worships may be pleased to provide for this matter in such other manner as your Honorable Worships, according to the circumstances of the case, shall find and judge to be proper. to depart, His Honour left yesterday afternoon per the ship Beverwyk thither, and the authority of this Government, by high command of the well-mentioned lords Masters, fell into the hands of the Secunde and first Administrator, the Lord Johannes Izaak Rhenius, who today as such took his seat in our assembly. The mentioned Lord Rhenius, by his appointment as Commander, being no longer able to hold the presidency in your assembly, we have therefore resolved to let the Member of our Council, the Lord Oloff Godlieb de Wet, Senior Merchant in the service of the Honourable Company, provisionally act in that presidency, who thus upon receipt of this shall have to be recognized and respected by you as such. — Having been informed that the Lord Independent Fiscal of this Government, Johan Nicolaas Steeven van Lynden, with the mentioned ship Beverwyk has undertaken the journey to the Netherlands; we have therefore deemed it necessary to give immediate orders that the functions of his office be performed by some capable person, and for the performance thereof have appointed the Member in your assembly, Mr. Jacob Pieter de Nys, until such time as the High-Born Lords Masters shall have further and finally disposed regarding the filling of both the offices of President in your College and Independent Fiscal. — Wherewith, after greetings, we remain /:was written below:/ Your good friends /:lower:/ By order of 216 the 217. of the Honourable and Respected Lord Commander and the Council /:was signed:/ G: F: Goetz, First Clerk /:in the margin:/ Done in the Political Assembly in the Castle of Good Hope, the 29th of June 1791. 221. a memorial of the following content To the Honorable, Venerable Sir Oloff Godlieb de Wet, President, to„ gether with the further honorable Council of Justice of the Castle of Good Hope. Represents with due respect the pro interim Fiscal, Mr. Jacob Pieter de Nys. That on the 17th of the past month of June it was reported to the fiscal office by the Free Black Abraham van de Kaap that a slave of the burgher ensign Sebastiaan Valentyn van Reenen had offered for sale at his house a gold watch, which upon investigation was found to be the same that some time ago was stolen at night with violence from the former Commissioner of civil and matrimonial matters, Sr. Jan Meinderts Cruywagen. That hereupon, on behalf of the fiscal office, the aforesaid slave of the burgher Ensign van Reenen, named Domingo van Boegies, was immediately taken into custody, who, upon being questioned whether he had not offered the aforesaid watch for sale to the Free Black Abraham, and from where he had obtained the same, very candidly acknowledged having offered the watch for sale, adding that he had received the same from the bastard Hottentot Casper, serving as a coachman with the master C. Brand, 222. to sell for 10 or indeed for 8 rds. and to dispose of it. That the bastard H. Casper having hereupon been taken into apprehension, thought fit in the beginning stubbornly to deny and disavow everything, so much so that instead of avowing that he had handed over the watch to Domingo, he dared on the contrary to maintain that he had not presented it to Domingo, but that the latter had presented the same to him to sell in the tavern, but that he had absolutely refused all of it. That as the same Casper, until after the late ordinary court day, continued to persist in this his denial and dissimulation; the slave Domingo, who thereby constantly remained under suspicion of having obtained possession of the watch, as being a res furtiva, in an unlawful manner, therefore on that account also had to be kept in custody, in order that, in case he were found guilty, he would receive his well-deserved punishment. However, that after repeated examinations, the often-mentioned Casper Jans has come so far in confessio that he confessed to have truly handed over the aforementioned gold watch to the slave Domingo, to be sold for his benefit for 10, or indeed for 8 rds., with the express addition that he, Casper, had not 223. stolen it; thus the memorialist considered to have sufficient grounds at hand to restore the just-mentioned Domingo to his master: in which, however, he did not wish to proceed on his own authority, since inquiries have already been obtained before commissioners from this honorable Council, and therefore this case must be deemed to have come to the cognition of Your Honors, where both the absolution and condemnation ought to remain referred to the judgment of Your Honors. The memorialist therefore turns to Your Honors with the humble request that you may be pleased to qualify him to restore the slave Domingo to his master, the Burgher Ensign S. The roll being largely completed, there was produced by the aforementioned provisional fiscal Mr. Jacob Pieter de Neys a note of the following content: By order of the Honorable Independent Fiscal, the Honorable Company's packet boat De Vlyt, lying at anchor in False Bay, having been inspected by the undersigned, the following goods and chests, having been imported privately, were removed from the same and delivered into safekeeping to the resident there, Mr. Brand, namely: 1. 2 packages with linen without mark 2. 6 canassers of sugar 3. 3 leagers of arrack 4. 1 large eight- to five-foot chest 5. 1 small eight-foot sailor's chest Below stood: Done in False Bay, the 8th of June 1791. Shows with due respect the Landdrost of Stellenbosch and Drakenstein, Hendrik Lodewyk Bletterman: That on the 9th of July of this current year, by a certain soldier of Württemberg, named Steuer, who, as a servant of the lessee Fredrik Kannemeyer, retails wine and other drinks for him in the village of Stellenbosch by the small measure, it was made known to the petitioner that, having gone out at 9 o'clock in the morning of that day to attend to his affairs, after first having locked his chest and pushed to the house door, upon his return he had found the padlock of his chest broken, and further, upon investigation, had missed from it eighty-nine rixdollars in paper money and twelve rixdollars and three schellingen in silver specie; adding that among the missing paper money was a piece of forty rixdollars. That the petitioner immediately caused notification to be given to all trading inhabitants of the village that, in case a piece of paper money of 40 rixdollars should be presented by any suspicious person, either for exchange or to buy one thing or another with it, the necessary notice thereof must be given to him, the petitioner, at the earliest opportunity, in order to investigate whether perhaps in this manner it could be discovered by whom the aforementioned moneys of the soldier Steuer had been stolen. That this notification was indeed of such consequence that a short time thereafter, by the former messenger Faustman, there was sent to the petitioner a piece of paper currency of 40 rixdollars, which had been presented to him by a female slave of the former chief surgeon Domus, with the request to be allowed to know the value thereof. That the petitioner, having thereupon questioned the same female slave, named Rosetta of the Cape, from whom she had received the piece of money presented by her to Faustman, received the answer that the same had been given to her by her so-called husband, being a slave of the burgher Pieter Lans living at the Cape, named Batjoe. That the necessary investigations concerning this having been made on the part of the petitioner, it appeared to him that by that slave Batjoe a piece of money of that value had never been given to his concubine, and that he did not even bear the least knowledge that his concubine possessed a piece of that value. 243. money of 40 rxd. had received, but that she had not obtained the same from him, but from a slave of the burgher Hermanus Combrink, named Sangoor, who with it in the name of his fellow slave Batjoe of Boegies had come to her, to buy with the same, at least for a part thereof, a blanket. That the said Batjoe of Boegies, whom the Officer, because he confessed to have sent a piece of money to Rosetta, had transported under arrest Capewards, hereupon having been heard on interrogatories before Commissioners from this Honorable Court, did indeed acknowledge that he had delivered a piece of money to the said female slave through his fellow slave Sangoor, to buy for a part thereof a blanket; but that the same piece of money was not stolen by him, but had been found on a bridge near Stellenbosch: the slave Sangoor moreover testifying that he had received the piece of money delivered to Rosetta from Batjoe for the value of five Rixdollars, while Rosetta nonetheless maintains that she received from Sangoor the very piece which was presented by her to Faustman. That therefore this whole matter lies buried in deep darkness, and the Officer has no sufficient grounds to make any further steps against the said Batjoe; and this the less, because no evidence whatsoever is to be found that the prisoner, at the time that the soldier Stever missed his money, was in or near the bakehouse of the baker Kannemeyer. 244. That indeed the said Stever states an incident which is alleged to have taken place some time before between him and the prisoner, but that besides the denial of the said prisoner, and the singularity of the testimony of Stever, it cannot without absurdity be deduced therefrom that the accused must just therefore be regarded as the thief of the missing money; not to mention the uncertainty whether ever so much money was missed, and whether Stever did not perhaps use that money, probably belonging to his master, for himself. That this at least is certain under correction, that the Officer, without further proof, can undertake nothing against the imprisoned slave Batjoe, in which case it would be a hardship to keep the same in his present detention; while on the other hand, as the Officer respectfully trusts, it is likewise evident that no sufficient ground can be drawn from the circumstances to expect any further clarification with success, in which case equity seems to demand that if what has already been proven is not judged punishable, the slave should as much as possible remain preserved for the benefit of his master. Reasons wherefore the Officer hereby addresses Your Honors, with the respectful request that Your Honors may be pleased to qualify him to restore the imprisoned slave Batjoe to his master, with orders to hand him over into the hands of Justice at all times in case the Officer might obtain any further elucidation in this matter; 245. and that Your Honors may be pleased to dispose regarding the female slave Rosetta, who on account of her pregnancy could not be transported Capewards, in such manner as they shall judge proper. Thus, after reading and reviewing that petition on the last session day, it pleased Your Honorable Worships, on the grounds that in such an event a court messenger in the performance of his duties ought to take care that no one suffers any prejudice through his doing, negligence, or inactivity, before taking a final decision herein, to order the said court messenger to appear before the Commissioners, in order to be examined regarding his conduct and the delay committed in this matter, and there to present his defense. The undersigned, having then acted in accordance with this resolution, caused the said court messenger Ziervogel to appear before them, and presented these grievances to him, as well as asked him for what reasons he had not in this case observed his duty with that vigilance which the urgency of the matter required. Whereupon the same brought forward in his exculpation: that on the morning of 8 April he had received orders from the first sworn Clerk of the Political Secretariat, George Fredrik Goetz, to request the Commissioners whether Their Honors would be pleased to attend in order to have an affidavit, passed at the requisition of Mr. Goetz, sworn to on board; that he, having thereupon betaken himself to Messrs. van Echten and Mappa, the first-mentioned gave him as an answer that on account of indisposition, and the latter on account of manifold occupations at the Political Secretariat, they were unable to attend thereto, — Of which he immediately made a report to the said Goetz, adding that he had been to the first-undersigned and had learned that he had ridden out to the country. That he subsequently at two o'clock in the afternoon received from the said Clerk of this Council, Johannes Daniel Karnspek, the note annexed hereto, containing an order: 1st: to request two burger members, in order to attend at the swearing of the affidavit; 2nd: to order a Company's boat from the Equipment Master for half past two o'clock, to convey the Commission on board; 3rd: to appoint Valkenburg, in order to be present at that swearing. That he immediately betook himself to the houses of the Honorable Members, and also without any loss of time, indeed at three o'clock in the afternoon, gave notice by missive to the said sworn Clerk of his findings, substantially as expressed in the draft also annexed hereto. That he thereupon not only received no further orders, but moreover, having met the aforementioned sworn Clerk in the street and asked whether he still had to perform anything in this matter, received the answer: No. That he subsequently at half past nine o'clock in the evening was summoned to the Secretary of this Council, and there received orders to request the first-undersigned, who in the meantime had returned to the Cape, in the name of the Honorable President, to go on board the following day as early as possible for the purpose aforesaid; That he then also sought out the first-undersigned and the Equipment Master Cornelissen, and after the time was set by the undersigned for six o'clock the following morning, took care that everything for that Commission would be ready by the appointed hour, but that on the following day he learned that the aforementioned ship Vasco de Gama had put to sea that very night. The Honorable Mr. President having made known that His Honor had convened this meeting expressly to decide upon some circulated lawsuits, there were first taken in hand the criminal claim and conclusion presented by the Landdrost of the Colonies of Stellenbosch and Drakenstein, Mr. Hendrik Lodewyk Bletterman, in his official capacity, upon and against the slaves Joachim van Mandaal, Telemackus van Mallebaar, and Sephta van Bengaalen, the first-mentioned belonging to the Undersheriff Hendrik Matthysen, the second to the messenger Godfried Gabriel Hauptfleisch, and the last-mentioned to the Widow Daniel Ronouw; over which documents having maturely deliberated, and having noted everything that merited consideration, the Council, administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, has condemned the prisoners and defendants to be brought to the place where criminal sentences are customary to be executed here, and being delivered over there to the Executioner, the two first-mentioned, Joachim and Telemachus, to be fastened to the gallows with a rope around their necks and exposed to public view, furthermore with and alongside the third prisoner, Sephta, to be tied to a post, severely scourged on their bare backs with rods, branded, and after having been riveted into chains, to be sent to Robben Island, there the 1st and 2nd prisoners, Joachim and Telemachus, to remain banished for the term of their lives, and the third prisoner for 25 years, with condemnation of the defendants in the costs and expenses of justice. 257 the High and Mighty Lords States General of the United Netherlands, condemns the defendant Anna Sophia van Elve to a fine of Two hundred Ducatoons, for the benefit of the plaintiff ex officio; she, the defendant, being furthermore required to appear in person before the Council to be sharply reprimanded for the harsh treatment of her slaves and informed that, whenever she should again commit any mistreatment against her bondservants, the right to keep bondservants will then be forfeit to her; and the Council further condemns the defendant Anna Sophia van Elve in all the costs incurred in this matter. The Secretary of this Council Willem Stephanus van Ryneveld, petitioner ex officio, against the merchant and fiscal pro interim here, Mr. Jacob Pieter de Nys, as having replaced in office the repatriated Independent Fiscal Lord Johan Nicolaas Steven van Lynden on the one side, and Anna Sophia van Elve, wife of the Master Painter of the Honorable Company Johannes Oostendorp on the other side; the said Lord van Linden having acted as plaintiff ex officio in a case of committed mistreatment, and the aforesaid Anna Sophia van Elve having acted in the same case as defendant and respondent, the parties required herein to hear judgment pronounced upon the documents and muniments reciprocally exhibited in court. 260.
