264. The former Bookkeeper of the Honorable Company, Jan Jacob Fredrik Wagener, as attorney for the Burgher Gerrit du Toit, applicant, against The merchant and Fiscal pro interim, Mr. Jacob Pieter Deneys, respondent: to declare whether his Honor is inclined to adopt the merits of the lawsuit initiated ex officio on 26 May last by the Independent Fiscal recently departed from here, the Honorable Johan Nicolaas Steven van Lynden, on and against the principal applicant, and consequently to proceed in accordance with the latest retroacta, or whether his Honor might be inclined to renounce and abandon the same; but in case his Honor pleases to adopt the aforesaid merits and make himself a party, then principally to witness the service of a written answer to the claim made on 26 May last by the said Honorable Independent Fiscal on and against the principal applicant. The attorney for the applicant makes the request as in the presentation and at the same time submits his written answer, equipped with three annexes. The Fiscal pro interim, adopting the merits of the lawsuit, declares himself a party; further requests inspection and, if necessary, a copy of the case documents and a term to further declare whether his Honor will serve a reply, or else renounce further productions. The Council: fiat. The same day. 265. Thereafter, the documents and muniments having been brought to the table that served in the lawsuit initiated ex officio by the Fiscal pro interim, Mr. Jacob Pieter Deneys, on and against the person of Louis Anthony Hippolite de Verneuil, the matter was deliberated upon with all attention; and the Council, after considering everything that merited reflection and could move their Honors, Administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, condemned the prisoner Louis Anthony Hippolite de Verneuil to be brought to the place where criminal sentences are customary to be executed here, to be handed over to the executioner there, and being tied to a post, to be severely scourged with rods on the bare back, with this inscription above his head: Forger; further, to remain banished for ever and ever from this Government and its jurisdiction, with condemnation in the costs and expenses of justice. The prisoner will meanwhile be placed on Robben Island to remain there until a shipping opportunity arises for deportation. However, Mr. Ronnenkamp excused himself from voting in the aforesaid case, on the grounds that his Honor was implicated in the aforesaid proceedings of the said Verneuil, as a forged letter was also handed to his Honor, upon which he, Verneuil, in fact received Two hundred and Fifty Piasters. 266. 267. Subsequently, the Fiscal pro interim, Mr. Jacob Pieter Deneys, brought to the knowledge of the Council that for some time two slaves belonging to the burgher Johannes Joachimus Theron had been sitting in the Lord's prison, who, having run away from their master, had thus been captured and taken into custody; and that however much the said Theron had been repeatedly warned that he should redeem those slaves, he nevertheless had remained unwilling to do so up to now; wherefore his Honor requested whether it might please the Council to fix a time within which the said Theron shall be obliged to redeem the aforesaid slaves from the tronk, and failing that, to authorize him, the Fiscal pro interim, to then have the same slaves judicially sold for the benefit of their master. Which request having been deliberated upon, it was 268. decided to authorize the Fiscal pro interim, in case the said Theron has not redeemed his aforesaid two slaves from the Lord's prison within the period of fourteen days counted from today, to then have the same judicially sold for his benefit. Present: the Honorable Oloff Godlieb de Wet, President, and all the Members, except Messrs. Ronnenkamp and Truter due to indisposition. In the following cases, Mr. de Neys, being Fiscal pro interim and therefore a party, retired from the meeting. To the Right Honorable Worshipful Lord Oloff Godlieb de Wet, president, together with the other gentlemen Mem- bers of the Honorable Worshipful Council of Justice of the Castle of Good Hope. —. Shows with due respect the pro interim fiscal Mr. Jacob Pieter Denys. That among other prisoners, upon the present applicant's ap- pointment here in the company's prison, there was found a certain Cannoneer named Roeloff de Leeuw, who by the auditor military had been handed over to the fiscal office, in order to be brought to trial for committing theft, at the place of this bur- gher Iohan Gustaf Volmar, where the said pri- soner had been residing as a servant. That from the information gathered by the repatriated Lord Independent Fiscal concerning this matter, and left to the present applicant, it has appeared to the same that the aforementioned Volmar held the aforesaid Cannoneer suspected of having stolen from his bed- room about One hundred Rixdollars in paper money, among which a piece of Sixty Rixdollars, just as he, Volmar, also reported the same as such, first to the auditor military and subsequently to the fiscal office. That the present applicant, also on the basis of that information, which upon the first resumption already appeared to him of little value, caused the aforementioned Roelof de Leeuw to be examined before gentlemen Commissioners from this Council, in order to investigate whether from his answers perhaps any further light might be shed upon the matter in question; the present applicant being the more moved to this because the prisoner Roelof de Leeuw had offered for exchange here in a certain tavern, Het Lammetje, a piece of Sixty Rixdollars, after the aforementioned theft at the place of Volmar had been committed. Yet that from these same answers there appeared to the present applicant no sufficient grounds to conduct any further proceedings, even in processu ordinario, although the fiscal office for a considerable time has been troubled by manifold complaints concerning the irregular con- duct of the prisoner, and especially concerning his un- ruly manner in chastising the slaves of those with whom he served as a farmhand. — That however much the prisoner, on that account, can and ought to be considered a harmful subject for this Colony, the present applicant nevertheless judged that no use could be made thereof in this matter: since in this subject case, even of the corpus delicti, there are no sufficient proofs available to be able to proceed with success in the commenced proceedings against the same. —. Honorable Lord and Gentlemen The Landdrost of Stellenbosch and Drakenstein, Hendrik Lodewyk Bletterman, shows with due respect: That about two years ago, upon repeated complaints from certain inhabitants in the village of Stellenbosch that a certain Bastard Hottentot woman named Lea, in service to the burgher Johannes Josephus Albertyn, kept up with his slaves at night during the absence of the said Albertyn and gave rise to all kinds of disorders, and upon the complaints lodged by the said Albertyn that the aforementioned Lea, through her bad behavior, was almost the cause of a fight between his slave boys, the memorialist at that time, both upon the request made in this regard by the said Albertyn and to prevent further mischief, deemed it best to have the said Lea removed from the village. That a few days thereafter, the Heemraad Eduard Wium having brought to the notice of the memorialist that the aforementioned Lea, not knowing where to go, had been taken in by him and that he would also keep her at his residence outside the village, to which the memorialist consented. That subsequently, on the eleventh of the month of June of this year, the wife of the burgher Martinus Byleveld, having lodged complaints with the memorialist that the husband of the abovementioned Lea, being a certain Hottentot David, whom she had permitted to come to the aforementioned Lea in the evening and stay the night, did not deign to greet her upon his arrival, and also demanded that the back door of her dwelling house should remain open at night, and when she would not tolerate all this, the aforementioned Lea wished to leave her, with a request to order the aforementioned David to stay out of her house, the memorialist thereupon told the said wife of the said Byleveld that he believed this to be the same Lea who, upon various complaints of certain villagers and especially of the said Albertyn, had been ordered to go outside the village and never be allowed to enter it again, while also having expressed his surprise that the said Lea was in her house, whereupon she departed, and the memorialist subsequently having conferred with the said E. Wium about this, the latter first stated to the memorialist the reasons and the conditions why and upon which he had, out of compassion, given the said Lea to the wife of the said Byleveld; and that, now believing she no longer needed her, he now requested to demand the said Lea back from the said Byleveld, which the memorialist stated he would very gladly see, as otherwise justifiable reasons for dissatisfaction would be given to the other villagers. That the conduct maintained by the aforementioned Byleveld must naturally have the consequence that, in whatever case and however much necessity might require it, conducting a judicial investigation of a slave or Hottentot by the officer of justice will always have to depend on the arbitrary behavior and insolent conduct of such persons as the aforementioned Byleveld, and thus the ordinary course of justice will be obstructed; against which the petitioner considers himself bound to the utmost to guard, and to employ those means which the seriousness of the matter comes to require. Mader, having attended the inspection, reported to the respectfully undersigned Remonstrant, after examination, that the wound was extremely dangerous and could very easily result in the death of the wounded man, as was indeed the unfortunate consequence, that he passed away on last Sunday, or the 23rd of this month, from the wound he received, which upon post-mortem examination was judged to be absolutely lethal. While the wounded man, as far as his weak condition permitted, testified at intervals that the wound had been inflicted on him by the aforementioned Marthinus Jansse de Bruin with a sword while walking, without any prior quarrel or disagreement, and without any cause or reason having been given thereto from the wounded man's side, 316. he, Paulsen, having always lived in close friendship with the said de Bruin; as all this can be evident to Your Honors from the accompanying inspection report and surgical certificate, as well as from the declarations of the citizens Johan Lucas Gertenbach and Johannes Jacobus Andriesse, who arrived at the scene of the wounding, without them, however, knowing how to give any circumstances of great importance. That the respectfully undersigned Remonstrant, not considering himself authorized on his own authority in the present case to apprehend the delinquent, without any delay brought the matter to the knowledge of Your Honors by circular inquiry, and requested their decree for apprehension, in case Your Honors might find the matter so disposed. Which decree the respectfully undersigned Remonstrant then also immediately obtained; and accordingly, already between six and seven o'clock of the abovementioned 20th of this month, and thus two hours after obtaining knowledge of the deed, dispatched the necessary orders for the arrest of the delinquent. There was, after examination and consideration of the documents attached thereto, granted to the Officer Remonstrant an edictal citation, whereby the mentioned burgher Marthinus Jansse de Bruin, under the ringing and tolling of the bell, in the customary manner, shall be summoned to appear in person before this Court within the next fourteen days for the purpose aforesaid, on pain that, in default thereof, proceedings will be taken against him according to law. Subsequently, a representation was submitted by the Deputy Fiscal Mr. Johannes Andreas Truter on behalf of the Landdrost of the Districts of Stellenbosch and Drakenstein, the gentleman Hendrik Lodewyk Bletterman, with regard to the burgher Rudolph Jacobus Laubscher and the person of Casper Knippe, reading: To the Honorable Worshipful Sir, Oloff Godlieb de Wet, President, together with the further Gentlemen Members of the Honorable Court of Justice of this Government. That on Thursday the 6th of this month, a certain elderly slave named David of the Cape, personal property of the burgher Gerrit Badenhorst currently residing in Europe, brought to the knowledge of the Remonstrant: That 318 319 That seven or eight months ago, a certain Casper Knippe having been appointed as overseer by the former heemraad at Drakenstein, Adriaan Louw Adriaansz, and the burgher Lybrand here, on the farm or homestead of the aforementioned Badenhorst, the same had made no orderly arrangements regarding the farming, neither at the beginning nor thereafter; but continuously indulged himself in drink, so much so that he had since bought about five to six leggers of wine from different persons, and drank it all up, both by himself and with other persons arriving there from time to time, and even sold some of it to slaves. That subsequently, at the beginning of the month of June of this year, on a certain day, without however being able to determine which, a foal about one and a half years old having been bitten by the wolf, the above-mentioned Knippe had not punished the horse herder on that account at that time, but did so two months ago on a certain Sunday evening, when he, Knippe, having given him, David, and the other slaves up to six beer glasses of wine and having drunk along each time, and thereby having become intoxicated together, ordered the slaves to seize and hold the aforementioned January, intending to punish him; but that the slaves having all run out the door in drunkenness, the aforementioned Knippe 320 Knippe had himself grabbed the aforementioned January, who however managed to escape from his hands and, together with the slave Anthony, nicknamed the little one, whom Knippe had also threatened to punish without the slightest reason, then ran away. the said brother Rudolph having said that they should stop beating him, as otherwise an accident might result from it; the same Rudolph, however, cared as little about this as the said Knippe, but on the contrary continued beating him until about half past nine o'clock at night, and having repeatedly asked the said January where the food had come from, to which that slave at first answered, but afterwards, through utter exhaustion, was no longer able to answer, and shortly afterwards, when the aforementioned January was to be helped up from the ground and brought into one of the rooms, it was found that he was already deceased. That the Remonstrant, on the following day, namely on the 7th of this month, betook himself to the place of the aforementioned Badenhorst, and there, in the presence of commissioned heemraden, the dead body of the said January was inspected by the former Chief Surgeon of the Honorable Company, currently burgher surgeon Petrus Franciscus Melchior Briers, and subsequently visited and examined, upon which it was found that the entire body from the back down to below the buttocks was covered with welts inflicted with a blunt instrument, and from which a multitude of contusions alone had led to his death, as Your Honors will be able to observe in greater detail, if desired, from the documents annexed hereto, including the inquest report and surgical certificate. That the Remonstrant, subject to correction, believing that the ill-treatment committed by the aforementioned Rudolph Laubscher and Casper Knippe on the aforementioned slave January and the premature death of the same slave January caused thereby ought to be addressed by legal means, felt obliged to arrest the aforementioned servant Casper Knippe, and having arrested him, the Remonstrant finds it necessary to make the required request to Your Honors both for the approval of that arrest and for the initiation of the necessary proceedings against the aforementioned Rudolph Laubscher. Wherefore the Remonstrant turns to this Honorable Council, respectfully requesting that Your Honors be pleased to approve the arrest of the person of the aforementioned Casper Knippe made by the Remonstrant ex officio, and furthermore to grant a decree by virtue of which the Remonstrant in his official capacity shall be qualified to summon the burgher Rudolph Laubscher to appear in person before this Honorable Council on a certain day to be determined, in order to hear, on the appointed day, together with and alongside the aforementioned Casper Knippe, such criminal claim and conclusions, or defenses and requests, as the Remonstrant in his official capacity shall see fit to make and take against them, to reply thereto, and further to proceed as is customary in criminal cases. Which Remonstrance, with the ten appendices annexed thereto, it was resolved to keep in advice for reading. After which the same Adjunct Fiscal, in the aforementioned capacity, further made known: that on 13 March of this year a slave had been brought up at Stellenbosch as a runaway, who was not only unable to give any indication whatsoever as to who his master was, but moreover spoke a language which, despite all efforts made, could not be understood by any of the regular interpreters at Stellenbosch, the Landdrost having employed to that end, in addition to the caaffers, also all slaves in the Village who bore any resemblance in appearance to the brought-up slave; that the Landdrost had also not failed, immediately after the same slave was brought to the jail, to notify the Deputy Sheriff Matthysen thereof, so that, if anyone should address themselves to him concerning such a slave, they might be directed to him, the Landdrost; but that up to this day no one had claimed that slave. That meanwhile the imprisoned slave was declining in strength daily and had already become completely stiff from prolonged sitting. Wherefore the said Landdrost thought it necessary to address this Council, requesting that the aforementioned unknown Slave may be sold judicially, and the proceeds resulting therefrom, after deduction of costs, be deposited with the Secretary of this Council, until such time as the owner of the same shall come forward. In the following case, the Honorable President did not officiate on account of affinity with the petitioner. The Attorney Willem Kolver, for the Senior Merchant and Member of the Honorable Council of Policy, as well as Cellar Master of this government, the Honorable Mr. Jacobus Johannes Le Sueur, petitioner, against the interim Fiscal Mr. Jacob Pieter Deneis, formal respondent, in order to see serve, in further support of the submitted answer, a memorandum of adstruction. Kolver presents a memorandum of adstruction, with three annexes, and requests that the same may be added to the documents. The formal respondent, submitting an extract from the criminal court roll of 15 September last, states that the Council not only granted the petitioner permission merely to add certain annexes obtained by him to the documents, but that in this matter the right to further submissions has also already been renounced in court, though for the rest he leaves the request entirely to the Council's judgment, remaining persistent in his made renunciation. The merchant and Landdrost of the Colony Graaff Reinet, the gentleman Moritz Herman Otto Woeke, formal prosecutor in a criminal case, on the one hand, acting against the Hottentot woman Sara, prisoner and defendant in the aforesaid case, on the other hand. The prisoner, having heard the conclusion taken against her, said in response: "God is great. God help me, I have killed my children." The formal prosecutor persisted with his claim and requested justice. After the parties had stepped down, the Honorable Lord President communicated that the aforesaid Deputy Fiscal, in his official capacity, had informed His Honor that among this case was a statement that had been sent to him unrecollected, and that he, in order not to expose the prisoner to any longer detention, had heard her before the commissioners on interrogatories and had drawn up the claim. And furthermore, upon examination of those submitted documents, among which was found not only an unsworn statement by the burgher Matthijs Bogens dated 20 January 1789, but it also appearing that the deed was already perpetrated in the year 1788, and thus now more than three years ago, and came to the knowledge of the Landdrost Woeke, as Officer, it was therefore deemed fit to have the Deputy Fiscal Truter re-enter and to ask him for what reasons the aforesaid statement—which, proving the corpus delicti, is of very great importance in the trial—was not sworn to, and why this matter moreover has dragged on for so long. Yet, since the first duty of the Landdrost Woeke, as an officer of Justice, entails seeing to it that crimes perpetrated within his magistracy are investigated without delay, accurately, brought to the knowledge of the judge, and consequently punished according to the laws; that the unfortunate delinquents are by no means vexed by protracted proceedings and imprisonments, but are brought to trial in due time; and that the required care is taken by him, the Landdrost, that the inquests obtained to the charge of the accused are sent over hither recollected and sworn to according to the regulations; indeed, that this has been so seriously enjoined upon the said Landdrost repeatedly, both in the directives of this Council of 2 April and 1 October 1789, and in a resolution of the Honorable Council of Policy dated 13 April 1790. That it has nevertheless appeared to the petitioner, from the extract resolution of the said highest Council, that the gentleman interim Fiscal was instructed to investigate whether the accusations brought against the petitioner by the court-martial were of such a nature that a trial must and can be instituted against the petitioner, and that in such case the petitioner would have to remain here until that matter were fully settled. That the petitioner has also actually perceived that the gentleman interim Fiscal intends to institute an action ex officio against the petitioner. The roll call having ended, the pro interim Fiscal Mr. Jacob Pieter de Neys produced a document of Considerations on the petition submitted by the Master of the Honorable Company's hooker ship Sterreschans, H: recht, yesterday, the same document being furnished with six annexes, and of the following content: To the Noble Honorable Lord Oloff Godlieb de Wet, President and Senior Merchant in the service of the Honorable Company, as well as the further Gentlemen Members in the Honorable Council of Justice. The undersigned pro interim Fiscal, pursuant to and in compliance with Your Honorable's honored resolution of the 8th of this month, having examined the petition of Jan Valkenburg, formerly stationed as Master on the permanent hooker ship the Sterreschans, tending to have the matter about which the petitioner considers that an action would be moved against him on behalf of the Fiscal Office, declared civil and compoundable by Your Honorable's judicial authority; thus the undersigned now has the honor, dutifully obeying the aforementioned resolution, to present to Your Honorables, annexed hereto under numbers 1, 2, 3, 4, 5 and 6, six annexes, of which the first two were transferred by the Burgher Military Council to the Noble Honorable Council of Policy and subsequently placed into the hands of the undersigned, while the other four were gathered by him ex officio. From these annexes it will appear to Your Honorables that the petitioner, at the time he commanded the aforementioned hooker ship, and specifically on the occasion when he found himself with his vessel in Saldanha Bay in the month of February of this year, delivered to the captain of a French merchant ship lying anchored there at the same time various goods, which belong under the designation of equipment goods and provisions; all of which is specified in the documents annexed hereto. Furthermore, it appears particularly from the private declaration of Captain Dupin, and some of his subordinate officers, that the aforementioned goods and effects were truly sold by Master Valkenburg for such prices as are expressed in the listing of those goods, without the said Dupin, together with his associates, any more than the deponents of the other declarations, having determined whether the equipment goods and provisions sold and delivered in the manner aforementioned belonged to the hooker ship the Sterreschans, or whether the same were the Master's own property; although it is true that the Sub-Lieutenant Jan Seybels Elders, upon confirming his declaration annexed hereto under No. 4, testified that the boat sold by the petitioner Valkenburg to Captain Dupin belonged to the hooker ship the Sterreschans, yet on the other hand, the petitioner's brother, at article 14 of the interrogatories put to him, annexed hereto under No. 5, declared that this same boat was by no means the ordinary ship's boat, giving as reasons for his knowledge that a boat of six oars belongs to the ship the Sterreschans, while the one sold was constructed and planked for nine, while the deponent under No. 3, being the Lieutenant of that vessel, Johan Jacob Carstens, declares not to know whether the provisions belonged to the Master Jan Valkenburg, or rather to the Honorable Company. The undersigned, thus finding the matter situated, has then further examined the report mentioned by the petitioner in his petition and annexed hereto in copy under No. 6, from two Sea Captains, expressly commissioned by the Noble Honorable Lord Governor van de Graaff, from which it has appeared to him that the hooker ship the Sterreschans, on the 13th of May of this year, and thus after it had returned from Saldanha Bay to this roadstead, was inspected by the Sea Captains J: Bakker and De Muller, and both the state of the equipment goods themselves and the inventory were properly examined, and indeed in such a manner that the commissioners made not the slightest difficulty in candidly declaring that at the time everything was found complete according to the inventory. The undersigned therefore considers that the petitioner is always in the circumstance of having acted contrary to the interests and intention of his masters, and that he thus, with however much confidence one has sought to bend and palliate this by the arguments of his petition, can never consider himself as entirely unpunishable, however much the undersigned must also acknowledge encountering a very great obscurity and uncertainty regarding the determination of an adequate punishment in the laws known to him, which, as can be gathered from the aforesaid, flows from the obscurity with which the nature of the act is surrounded. Having thus presented the principal circumstances as much of law as of fact, it remains finally to determine whether the case in question is compoundable, yes or no. The mentioned Professor Voet expresses himself thereon in this manner: "To which public prosecutors, although in the previous century it was forbidden that they might settle regarding any crime, whatsoever named, because thereby not only were the innocent very often exposed to extortions, but also such people were as if enticed to commit crime, as those who by settlement would pay not with their skin but with their money or purse, according to the ordinance on justice of King Philip of the year 1570 Article 13. 358 Master Jacob Pieter Deneys had complained to His Honorable Worship that the convening of inquests at the requisition of the Fiscal Office had for some time now had to be postponed and suspended purely and simply because no Commissioners from the Company's side could be received in place of Messrs. Ronnenkamp and van Echten, who have been prevented by indisposition from serving in their months and performing the duties as Commissioners. Thus, considering the necessity that provision ought to be made in this matter in order to enable the Fiscal Office, whenever its inquests can be held at the proper time, also to make the required haste with the proceedings of criminal defendants, who would otherwise be tormented by lengthy imprisonments, and thus to cause the work of Justice to proceed properly; it was resolved, on the proposal of the well-mentioned Lord President, to request and instruct one of the honorable members on the Company's side in the Council, henceforth at each last ordinary meeting of those months following which Messrs. Ronnenkamp and van Echten, according to their turns, will have to serve as Commissioners, to perform the duties of Commissioner in their places if the said Messrs. Ronnenkamp and van Echten cannot serve due to 359 indisposition. Provided however that, in so far as all the honorable members from the Company's servants should also themselves be prevented therein, whether by indisposition or other legitimate causes, a Member of this meeting from the burgher side may then assist in the Commissions in their place, with the scheduled sessions or Judicial Commissions properly having to be announced the day before the appointed time, unless necessity should require that, de facto, some Commission or other that can brook no delay should have to take place, which the honorable Members will have to accept on such occasions. While lastly, also on the proposal of the well-mentioned Honorable Worship, the Lord President, it was approved to add to the appointments in civil cases, pursuant to which parties are referred before Commissioners for the purpose of agreement or settlement, the names of such Commissioned Members as 360 shall serve therein, of which appointments copies will be handed to Parties, or those interested therein, in order to apply therewith to Commissioners who are thus appointed, so as to terminate their dispute quickly, and the gentlemen Commissioners shall also be held responsible for this. Wagener argues against this that it is indeed true that on the last court day, upon submitting his answer, he stated he renounced further productions, but that this was done by him in the belief that the official prosecutor would not serve with a reply in this minor case, and therefore persists in his request.
