363. filed, renouncing further productions. Attorney Kolver, representing the registered burgher Marthinus Byleveld, requested that he be permitted to add several more exhibits, obtained by him, to the proceedings to respond to the filed answer, to hear renunciation of further productions. The Officer Requiring declared to have no objection against this, provided that the registered party files no further written pleadings therewith. The Council granted the request of the registered party to be allowed to add several more exhibits to the proceedings. The Officer Claimant in the matter: The acting fiscal Mr. Jacob Pieter Deneys, Officer Claimant in a criminal case on the one side, against the burgher Marthinus Janse de Bruin, defendant in person by edict on the other side, to purge his first and second default and still to purge and answer for the committed manslaughter on the fellow burgher Lambertus Paulsen. The Officer Claimant, since the defendant has again failed to appear, requested the third default with the benefit thereof, and a fourth summons ex super abundanti, to be allowed to serve an intendit fourteen days from today. The Council, in view of the non-appearance of the defendant, grants the Officer Claimant the requested third default, and for the benefit thereof, bars the defaulting and absconding defendant Marthinus Jansse de Bruin from all peremptory exceptions, bars, and defenses, as well as other benefits that he might have used had he appeared, and further grants a fourth summons ex super abundanti ad quatuordecim. The Officer Claimant produces a written and criminal claim alongside an inventory of documents and six exhibits, concluding as at the end of the same. The prisoners and defendants, having had the conclusion read to them, persist in their confession. The Officer Claimant requests justice. The acting fiscal here, Mr. Jacob Pieter Deneys, Officer Claimant in a criminal case on the one side, against the slaves Joseph, Patientie, and October; the two first mentioned chattels of the Lord of Rheede van Oudshoorn, and the last of Attorney Jacobus van Leeuwen, prisoners and defendants in the aforesaid case on the other side. The Council holds this case in advisory deliberation. 365. This matter having thus far concluded, the said acting fiscal submitted a petition to the Council furnished with seven exhibits, which petition reads as follows: To the Honorable and Respected President and Members of the Court of Justice of the Castle of Good Hope. Shows with due respect the acting fiscal Mr. Jacob Pieter Deneys: How, in the night between the 19th and 20th of July last, two officers of justice named Claas Angerbeek and Dirk Hendrik Decker, making their customary rounds, having arrived at a certain already partly demolished small house standing behind the Castle near the Koehoorn battery, and since they heard some noise inside the same, positioned themselves, the first mentioned at the window and the second at the entrance of that small house with the intention to open the door and to investigate who was inside. 366. That while the latter was busy trying whether he could open the door, a slave youth, dressed in a grey jacket, unexpectedly jumped out of the window and immediately attacked the first mentioned officer Claas Angerbeek, inflicting two wounds upon him, one in the lower abdomen and one in the left arm, the unfortunate consequence of which was that Angerbeek, having been transported to the hospital, died within a few hours from the wounds he received, after having first given the statement annexed hereto under No. 1 before Commissioners. That in the meantime, as soon as his partner was wounded, the officer D. H. Decker pursued the aforesaid slave youth and dealt him several blows with the bare saber, and while, notwithstanding the wounds caused thereby, the same nevertheless attempted to resist and was already wrestling with him, Decker, the latter picked up a stone and dealt him such a heavy and painful blow to the head that he fell into a faint. That Decker hereupon returned to the aforesaid small house and, not finding his partner C. Angerbeek there, returned to the slave youth wounded by him, but finding the same lying motionless, proceeded to the Cape, 367. in order to render the necessary help to the wounded man, and subsequently to be able to fetch the injured slave with some other officers of justice. That consequently, after his partner had been transported to the hospital, having returned with two of his fellow officers to the place where the injured slave had been left lying, he, to his astonishment, no longer found him there, notwithstanding every effort made jointly by them to track him down. That subsequently, a month later, or on the 19th of August last, there was brought to the government prison as a runaway a slave youth of the burgher Jacob van Rheenen, named Ontong, on whom, upon inspection, several wounds were found, which, as may further appear from the comparison of the documents annexed hereto under No. 2, 3, and 4, show very great resemblance to those which, according to the report of the officer of justice Decker, were presumably inflicted by him upon the slave who stabbed his partner Angerbeek. That moreover, the clothing of the slave Ontong also appeared to correspond with the attire of the slave injured in the aforesaid manner by the repeatedly cited officer Decker, without the latter, however, having been able to affirm that he, Ontong, is the same person who wounded the abovementioned Claas Angerbeek and was struck down by him, Decker.

That the respectfully appearing party, on the basis of the cited indications, having repeatedly interrogated the aforementioned Ontong on articles regarding the aforesaid deed before the gentlemen delegates from this Council, the same not only absolutely denied being guilty thereof, but even denied all circumstances that might provide any further indications, alleging the wounds discovered on his head and elsewhere to have been inflicted upon him by six or seven slaves with a steel instrument and picked-up bones near a certain butchery, and that at 7 o'clock in the evening. That however much one may, perhaps not without reason, suspect the same Ontong of being guilty of the aforementioned murder from this uncertain statement, added to the other indications, the respectfully appearing prosecutor nevertheless judges, subject to respectful correction, that the indications and circumstances in the case at hand, even if one adds thereto the suspicious countenance of the same Ontong, are not sufficient to conclude to torture; because, taken all together, in his opinion, a full half-proof can never be deduced or arrived at, as the ordinance on the style of proceeding requires of him; at least the respectfully appearing party judges the present case to be so doubtful that prudence, which must be his guide especially in criminal matters, does not permit proceeding for the present to a step whose consequences for the sufferer are irreparable, and which exposes him, the respectfully appearing party, in such a case to making himself guilty of injustice; the appearing party believing that in all cases it is safer to absolve ten and more guilty persons than to condemn one innocent person. Whereas, however, the circumstances do not fail to militate against the accused, and it might perhaps happen that one or another circumstance were to be discovered whereby the respectfully appearing party might be enabled to continue his proceedings; he therefore takes the liberty to turn hereby to Your Right Honorable, and respectfully to propose to the same that, since a longer detention would involve a substantial punishment for the accused, provisionally, until something further is discovered, to place him on Robben Island, whereby, considered as a slave, not the least injury is inflicted upon him, and justice in the meantime remains able, upon further discovery, to have him receive his punishment. Which representation and documents it was deemed proper to hold in advice for further circulation. Subsequently, the Deputy Fiscal, Mr. Johannes Andreas Truter, on behalf of the Landdrost of the colonies Stellenbosch and Drakenstein, submitted a representation equipped with two annexes: The said representation being of the following content: To the Right Honorable Lord Olof Godlieb de Wet, President, together with the other gentlemen members of the Honorable Court of Justice of the Castle of Good Hope. Respectfully shows the Landdrost of Stellenbosch and Drakenstein, Hendrik Lodewyk Bletterman: That on the 23rd of May of this year, two newly arrived Mozambique slaves were brought into the Public Prison at Stellenbosch, who a few days previously had absconded from their master, the burgher Johannes Gerhardus du Toit, and had taken with them their only child, estimated to be seven months old, which child was found lying completely naked and decapitated in the Wemmershoek Mountains beside a footpath by fellow burgher Pieter Jacobsz Danckert. That, since it appeared from the circumstances that the aforementioned two newly arrived slaves ought to be regarded as the cause of this atrocious deed, the respectfully appearing party deemed it his duty to gather the necessary information regarding it, in order to convict them of the deed and, being convicted, to have them receive a deserved punishment. That the respectfully appearing party to that end also instituted all possible inquiries, but that it was only granted to him to obtain the documents annexed hereto, from which it only appears in general that the aforementioned child was decapitated in an inhuman manner, and that the same was found in that situation at a place near or around which the footprints of the above-mentioned slaves were discovered. That furthermore, on the basis of those obtained inquiries, the necessary interrogatories having been formed by the respectfully appearing party, in order for the said newly arrived slaves to be examined thereon before the gentlemen delegates from this Honorable Court, the said interrogatories were consequently also repeatedly put to the interrogated parties for answering by means of translation. Yet that the gentlemen delegates, by reason of the doubt that continually accompanied the translation, have constantly felt scruples of conscience about proceeding with having answered the questions drafted on behalf of the respectfully appearing party.

to proceed with the articles proposed by the petitioner, given that the respective translations differed noticeably from one another, notwithstanding that the two interpreters used by the undersigned were the best he had been able to obtain. That in the meantime, these circumstances placing the petitioner in no position to take any further steps in this matter, he the petitioner finds himself brought under the unavoidable necessity of giving the necessary notification thereof to your Honorable Worships, so that the same, either by provisionally returning the aforesaid slaves, as highly suspect, riveted in chains, to their master, provided he pays the costs, or in some other manner, may devise such measures as shall be deemed most consistent with justice and equity. After reading of which and consideration of the motives alleged therein, it was approved to qualify the petitioner to provisionally return the two Mozambique raw slaves mentioned in the same memorial, as highly suspect, riveted in chains, to their master Gerhardus Johannes du Toit, provided he pays the costs, with the additional order that they must remain with the said du Toit until such time and while the said slaves shall have mastered the Dutch or some other frequent language through which they can be properly examined, and in this manner some further light can be obtained with certainty in this matter. Further, it having been reported to the council by the gentlemen Kirsten and Reyer that their Honors had attended the settlement between the pro interim fiscal Mr. Jacob Pieter Deneys and the former Commander of the hooker vessel Sterreschans, Jan Valkenburg, and that the same Valkenburg had undertaken to pay to the aforesaid pro interim fiscal a sum of Two thousand Rixdollars at 48 stivers each, this settlement was confirmed with the council's approval. Below stood: At Cape of Good Hope on the date as above. Lower: In my presence was signed: W J v Ryneveld Secretary. In the forenoon, present the Honorable Worshipful Mr. Olof Godlieb de Wet, President, and all the Members, except the gentlemen Sonnenkamp and Kirsten due to occupation. Thursday, 22 December 1791. Attorney Jan Jacob Fredrik Wagener for the cook at the national Battalion here, Hendrik Denner, plaintiff, Against the merchant and pro interim fiscal Mr. Jacob Pieter Deneys, prosecuting officer, defendant, in order to see rejoinder served upon his submitted reply. Whereof attorney Vercueil, acting for attorney Kolver, who acts for the defendant in this matter, because of an accident that befell the said Kolver yesterday evening whereby he was prevented from serving his parties today, requested a copy in order to rejoin or renounce four weeks from today. The prosecuting officer requests thereupon that the defendant may be ordered to rejoin or renounce fourteen days from today. The Council grants the defendant the requested copy, in order to rejoin or renounce fourteen days from today. The pro interim fiscal, Mr. Jacob Pieter Deneys, prosecuting officer, plaintiff, Against the Burgher Tobias Louw, defendant, to hear such claim and conclusion as the prosecuting officer shall judge proper to make and take, on account of the far-reaching ill-treatment committed by him, the defendant, upon the sergeant of the national Battalion Jacob Schram, as well as upon the discharged soldier Sebastiaan Franzen, to answer thereto and further to proceed as according to law. The prosecuting officer submits a written claim provided with five annexes. The defendant, assisted by attorney van Leeuwen, stated thereupon: "The people committed disturbances in my house and therefore I had them put out of the house." The defendant further requesting a copy of the claim and pieces, in order, while he the defendant resides in the outer districts, to serve answer six weeks from today. 378 that she, the petitioner, having subsequently departed from there, went once again to the aforementioned Deputy Fiscal and made known how she had seen His Honor's promise, that the Hottentots would be punished, come to naught, to which His Honor answered that he had not known she, the petitioner, was guilty of the alleged crime of her husband, and subsequently, to secure her, the petitioner's, two Hottentots, namely Adriaan and Andreas, in the jail from 6 October until 24 November; and thus to deprive her, the petitioner, of this, her sole assistance, and to expose her to the prey of anyone, as has become evident. That she, the petitioner, finally departed on foot from there back to the countryside with her son, and was attacked in such a manner by evil people in the dark night, without knowing them, however, that all their goods and clothes were demanded by them, which they then, for the preservation of their lives, directly surrendered; and in consequence, she, the petitioner, not only finds herself in a sickly condition of life, but, through the lack of those Hottentots, is compelled to expose the oxen attached both outside and inside the case during that time to the lamziekte prevailing in this place, as she, the petitioner, has already lost two to the aforementioned disease, and has until now been delayed from continuing her journey; and although she professes to be ignorant and innocent of all the alleged, not yet proven crimes of her husband, she nevertheless must see herself and her goods, indeed even a wagon and twelve oxen belonging to her son, who in this case, whether her, the petitioner's, husband is guilty or not, attached, as appears under Sub La & 1B3; and after this attachment was made from 12 October to the date of this document, neither she nor the person on whose farm she finds herself and her goods have been attached, has up to this day been properly cited, complained against, and summoned at the first court day, whereas it is said, and again, if the attachor has not brought in his attachment on the first court day, the matter would thereby be dismissed and done with; see Simon van Leeuwen, Roman-Dutch Law, Book V, Part VII, Page 551, and the Dutch Consultations and Advices, Page 7, in the extract from the Compost Book of the City of Amsterdam, f. 75; and again, it must be considered that all attachments, made both on persons and on goods, must be complained against on the very next court day, and the attached party properly summoned to that end, at the place where the jurisdiction is founded, or otherwise the attachment is void, and the attached person released. would have addressed the Honorable Worshipful Council of Policy regarding and on account of the fact that the petitioner's husband, together with and alongside some other inhabitants of this Country, had seen fit, notwithstanding the placards issued against it, to cross the boundaries of this Colony with their cattle and settle there, as well as to cause nuisance to the nations residing in those regions in their quiet possession; that the said petition having also been presented, the respondent thereupon obtained an order from the said Honorable Worshipful Council of Policy to proceed against the defendant according to the laws of the land; pursuant to which order the respondent is thus compelled to proceed toward confiscation for the benefit of the Honorable Company against the cattle found in the possession of the petitioner. That these proceedings must not be prosecuted against the petitioner but against her husband, who has already been summoned by missive, yet thus far has not seen fit to appear. And that for this reason the petitioner shall by no means be able to depart from here unless she first posts security for the cattle she has with her, so that if confiscation should be decreed, the necessary recovery may be found upon it. The petitioner persists in her request. The Council grants the request made by the petitioner, namely to return to her husband, provided she first posts sufficient security for the value of the cattle found in her possession, to the satisfaction of the officer. The Deputy Fiscal Mr. Johannes Andreas Truter, for the Prosecutor ex officio, requested, before making his claim, that the defendant in person, by interlocutory disposition, be condemned to answer before the gentleman delegated members of this tribunal to such interrogatories as shall be put to him on behalf of the Prosecutor ex officio, and that at the same time authorization may be granted to him, the Prosecutor ex officio, likewise to examine upon interrogatories before the delegated gentlemen the soldier Casper Knippe, who is in civil custody and is involved with the defendant in one and the same matter. The defendant in person has nothing to object to the request of the Prosecutor ex officio. That the said Jonas, Ontong, and October consequently having been taken into custody and examined before the gentlemen Commissioners from this Honorable Worshipful council, far from making any confession, on the contrary have largely denied even the aforementioned circumstances, declaring that they never had remained together later than until eight o'clock, having otherwise known how to palliate those circumstances of which they saw themselves fully convinced by the said petitioner in such a manner that the same could operate not at all to their disadvantage. That the said petitioner on that account seeing himself for the present destitute of sufficient grounds to pursue sharper proceedings against the aforesaid prisoners, deemed it necessary to bring this matter to the knowledge of Your Worships, in order that it may be disposed of by the same in this regard as deemed fit; as it appeared to him, the petitioner, that the demeanor of those slaves, however much they sought to avail themselves of the negative, must be held as exceedingly suspect, as the gentlemen commissioners having served at the examination will, if necessary, be able to confirm. Year, it has been brought to the knowledge of the official petitioner: That he, Nel, having traveled to the Cape in the month of October of the year 1789, and having then left his children under the supervision of a certain Gerbrands Zoetelieff, who served him as schoolmaster to his children, had returned to his residence in the month of November thereafter. That he, Nel, subsequently in the month of February of the thereupon following, now passed year 1790, having again traveled Capewards with all his children, it appeared to him on the way as if his daughter Rachel Elisabeth, procreated in marriage with his first wife Cornelia van Jaarsveld, at that time not yet 13 years old, was pregnant, whereupon he, interrogating this daughter of his about it, she had utterly denied it; but that he, Nel, having arrived at the place of his mother-in-law, the widow of the late citizen Wm van Jaarsveld, situated at Riebeeks Casteel, this same aforesaid daughter of his, upon various questions from her grandmother, had finally confessed that the citizen Louis Coetzee, married to Martha van Wyk, being the sister of her stepmother Christina Magdalena van Wyk and thus her uncle by marriage, under various promises and assurances as well that she would not become impregnated, during the absence of her aforementioned father, had carnally conversed with her, from which she had indeed become pregnant. That he, Nel, having thereupon returned to his residence, his aforesaid daughter Rachel Elisabeth was subsequently, at the beginning of the month of July, delivered of a daughter. That the same Nel, both through the indisposition of his aforesaid daughter as well as the child, and the winter season that followed upon it, having not been able to provide the necessary reports on all of this together with his daughter any earlier than in the recently passed month of November, the official petitioner has also not been able to bring this matter to the knowledge of your Honors any earlier; while he, in support of what has been set forth hereinbefore, takes the liberty of referring to the contents of the reports annexed hereto, from which he trusts it is sufficiently apparent that the above-mentioned Louis Coetzee has made himself guilty of the crime of adultery, which crime the official petitioner likewise believes ought to be punished and opposed in the most rigorous manner. Friday the 30th of December 1791. In the morning, extraordinary meeting, present the Honorable Oloff Godlieb de Wet, President, and all the Members, except the gentlemen Rönnenkamp, Meyer, van Echten, and Kirsten, both by occupation and indisposition. Having been presented by the pro interim Fiscal, Master Jacob Pieter Deneys, a memorial, to which are annexed four enclosures, the said memorial reading as follows. To the Honorable and Respected Gentlemen, President and Council of Justice of the Castle of Good Hope. Respectfully shows the merchant and pro interim Fiscal, Master Jacob Pieter Deneys. That the boatswain of the Honorable Company's ship Huisduinen, named Fredrik Glandt, has not hesitated, without the slightest authorization, contrary to his oath and duty, to alienate some cordage from the aforesaid vessel, and subsequently to have it delivered by the boatswain's mate assigned to that vessel, Fredrik Menser, and this to the boatswain Ian Matthys belonging to an English ship lying in the roadstead, the Duc of Clarence, who also appeared on board the ship Huisduinen on last Monday evening around 7 o'clock, accompanied by the burgher Carel Moses, in order to receive the purchased cordage and, under cover of night, to have it transferred to the said English ship. That when they were busy with the shipment at about 9 o'clock and had already delivered a part of the sold cordage into a boat lying off the bow, the commanding lieutenant L: d: Aubry, on the commotion caused thereby, rushed over and prevented further shipment, while he, having given the necessary notice of what occurred to his Captain the next day, the latter placed the matter into the hands of the officer, and subsequently handed over to him the said boatswain Fredrik Glandt and the boatswain's mate Fredrik Menser, together with the boatswain of the aforesaid English ship and the burgher Carel Moses, which latter two, having been found aboard the ship by Lieutenant L: P: Aubry upon the discovery, had also been taken into custody. That the officer, having made inquiries into the aforesaid fact as far as circumstances allowed, found that the boatswain and boatswain's mate of the ship Huisduinen are truly guilty, the first of alienating, and the second of shipping the cordage specified further in the aforesaid and accompanying documents, and that furthermore the burgher Carel Moses indeed had some knowledge of that transaction, without however having lent a hand in the shipping, as can further be shown to Your Honors from the four enclosures annexed hereto. That, as the nature of the crime committed may well result in a corporal punishment, the officer is respectfully of the opinion that the aforesaid boatswain and boatswain's mate ought to be kept in detention, in order that the punishment may not in due course become illusory, while it has appeared to him regarding the burgher Carel Moses and the boatswain of the English ship the Duc of Clarence that they may be released, especially since, even if considered as accomplices, as the officer presumes, they cannot be made subject to any corporal punishment. Wherefore the officer turns herewith to Your Honors with the respectful request that the apprehension of the boatswain Fredrik Glandt and the boatswain's mate Fredrik Menser may be approved by the judicial authority of Your Honors, in order to be able to commence, if required, procedures with ropes against them, and that furthermore the aforesaid boatswain of the English ship the Duc of Clarence lying in the roadstead, together with the burgher Carel Moses, may be released from their detention and set at liberty; or that Your Honors in this matter may please to dispose otherwise as you shall deem proper. The Council approves the apprehension of the boatswain Fredrik Glandt and the boatswain's mate Fredrik Menser; releases the person of Carel Moses from his detention; but for the present holds the request made with respect to the boatswain of the English ship the Duc of Clarence, Jan Matthys, in abeyance. After which were brought to the table the criminal claim and documents exhibited by the aforesaid pro interim Fiscal, officer ex officio, upon and against the slaves Ioseph, Patientie, and October, the first two being the bondsmen of Mr. William Ferdinand van Rheede van Oudshoorn, and the last belonging to attorney Jacobus van Leeuwen. David Kuuhl, and the latter belonging to the burgher Johannes Rosterd, the same having also been deliberated upon with all attention, the Council, administering justice in the name and on behalf of the High and Mighty Lords States-General of the United Netherlands, has condemned the prisoners Parla of Madagascar and Cesar of Mozambique to be taken to the place where criminal sentences are customary to be executed here, and there delivered to the executioner, each tied to a post, severely scourged with rods on the bare back, and, having been branded thereon, subsequently to be riveted in chains and banished to Robben Island for the period of ten consecutive years; with condemnation of the prisoners in the costs and expenses of justice, and dismissal of the further claim made and conclusion taken by the officer. Furthermore, there were also brought to the table the criminal claim and documents of the said pro interim fiscal against the slave Philander of 398. Bengal, belonging to the burgher Lodewyk Heering; about which the Council having deliberated with all accuracy, their Honors, administering justice in the name and on behalf of the High and Mighty Lords States-General of the United Netherlands, have condemned the prisoner Philander to be taken to the place where criminal sentences are customary to be executed here, there delivered to the executioner, tied to a post, and severely scourged with rods on the bare back, to be riveted in irons for the period of one year, and subsequently sent back to his master; with condemnation of the defendant in the costs and expenses of justice. While furthermore having attended to the intent with the documents annexed thereto, exhibited by the frequently mentioned pro interim fiscal on ordinary session day against the absconded burgher Marthinus Janssen de Bruin, the Council, having taken into account the contumacy of the said defaulter, and 399. on all that merited reflection, administering justice in the name and on behalf of the High and Mighty Lords States-General of the United Netherlands, has banished the mentioned Marthinus Janssen de Bruin by contumacy from this country and the jurisdiction thereof; as their Honors ban the same therefrom for all days hereby, on pain of being punished according to deserts should he, the defaulter and fugitive, come to infringe his banishment; with condemnation of the same in all the costs incurred in this matter. The remonstrance submitted on the 8th of this month by the frequently mentioned pro interim fiscal Master Jacob Pieter Deneys in regard to the imprisoned slave Ontong of Macassar, belonging to the burgher Jacob van Rheenen, alongside the muniments attached thereto, having been read around by the respective members and now taken into deliberation, it has been noted in this regard that, 400. on account of the vehement suspicion militating against the prisoner Ontong of being the one who, in the night between the 19th and 20th of July of this year, inflicted a mortal wound upon the servant of justice Claas Angerbeek, and at the same time was struck down by the fellow servant Dekker, necessity in this case absolutely requires some further perquisitions in regard to the 33rd article of the interrogatories put to the prisoner before the gentlemen commissioners, in which the prisoner, being asked on what occasion he visibly sustained the wounds on his head and elbow, stated: that at seven o'clock in the evening he was attacked near a certain tavern by six to seven boys, who had thus wounded him, the prisoner, with a steel instrument and also with picked-up sheep bones; without him, the prisoner, however, providing any indication near which tavern this was supposed to have happened to him, whereupon one would then have been able—since it is not to be presumed that a similar attack by six to seven slaves could have occurred without making much noise—to have the necessary information gathered in that regard. Therefore it has been approved to demand of the honorable remonstrant to make an exact investigation into this point, and subsequently to provide this Council with further report.
