Thursday the 5th of January 1792 Forenoon Ordinary Meeting. Present the Honorable President Oloff Godlieb de Wet and the Gentlemen: Mr. Jacob Pieter Deneijs Iohannes Smuts Salomon van Echten Ryno Iohannes van der Riet Abraham Fleck Hendrik Andreas Truter and Hendrik Pieter Warnecke absent the Gentlemen: Tobias Christiaan Rönnenkamp Gerrit Hendrik Meijer and Jan Fredrik Kirsten the first-mentioned due to indisposition and the latter two due to business. The Attorney Willem Kolver for the burgher fire master Jan Casper Loos, petitioner, versus the interim Fiscal Mr. Jacob Pieter Deneys, respondent, in order to see serve his rejoinder to the submitted replication. The petitioner produces his replication in writing. The officer prosecutor requests inspection thereof and, if necessary, a copy, furthermore renouncing further productions. The petitioner likewise declares to renounce. Whereupon the Court has kept this matter in advice for circulation. The messenger entering reports that the defendant has not appeared. The Deputy Fiscal Mr. Johannes Andreas Truter for the Landdrost of the Colony of Zwellendam Anthony Alexander Faure, officer prosecutor, versus the burgher Gerrit Oosthuyzen, defendant, in order to hear such claim and conclusion as the officer prosecutor shall deem fit to make and take ex officio regarding the mistreatment committed by the defendant upon the fellow burgher Louis Almero Pisanij, to answer thereto and further to proceed as according to law. Wherefore the officer prosecutor requested the first default, with the benefit thereof, and a second citation. The Court agrees. Whereupon by the aforesaid interim Fiscal Mr. Jacob Pieter Deneijs was produced a specific list of the Honorable Company's servants who, during the past year, willfully abandoned their respective posts and have absconded; with the request that these fugitive persons, pursuant to the circular orders of the High Indian Government, may be summoned by edictal citation peremptorily and in person, to appear before this Court within a certain specified time, in order to account for the aforesaid desertion, on pain that upon non-appearance proceedings shall be conducted against them in contumacy. Which request having been taken into consideration, it was approved to have the aforesaid fugitive persons summoned and cited by public edict and tolling of the bell, to appear peremptorily in person before this Court or commissioners thereof within the time of the forthcoming four weeks, in order then to come and purge themselves regarding the aforesaid willful desertion and abandonment of service, on pain as is enacted by the aforesaid order. Lastly, the following memorial was presented by the Deputy Fiscal Mr. Johannes Andreas Truter for the Landdrost of Zwellendam. To the Right Honorable Gentlemen President and Councillors of Justice of the Castle of Good Hope. Shows with due respect Anthonij Alexander Faure, Landdrost of the Colony of Zwellendam. That some weeks ago there appeared at the Drostdy two slaves of the burgher Iohannes Marx, named Valentin of Mozambique and Louis of Madagascar, together with a certain Hottentot woman named Roselyn, complaining about the incessant cruel treatment by the said Marx; the officer prosecutor considered it his duty to investigate these complaints, in order to act against the master according to the findings, or to punish the complainants according to the laws if they had no pressing reasons for doing so. That upon investigation it has become evident to the officer memorialist that the complaints brought by the aforementioned slaves and Hottentot woman are extremely well-founded, and especially the two first-mentioned were so severely battered that the welts caused thereby must terrify anyone who has not entirely cast off humanity, while the sight alone of those marks has convinced the officer memorialist that the same were caused by repeated mistreatments at different times, and cannot with the slightest semblance of truth be attributed to accidental passion; as also according to the testimony of the complainants, annexed hereto under No. 1, 2, and 3, the aforesaid Marx daily delights in similar cruelties and devises new means to maltreat his slaves in a barbarous manner. That the officer memorialist, in view of the extreme cruelty which is evident in this case, finds himself placed under the unavoidable obligation of having to institute criminal proceedings against the said Marx and to that end to cause him to be convened in person before Your Right Honors. Reasons why the officer memorialist hereby turns to Your Right Honors with the humble request that Your Right Honors may be pleased to authorize him, the memorialist, to cause the burgher Iohannes Marx to be summoned to appear in person before Your Right Honors against a certain specified day, in order to hear such claim, or request or requests, as the memorialist serving on the day shall deem fit to make ex officio regarding and on account of the aforesaid committed extreme mistreatment, to answer thereto and further to proceed as according to law. Which having been read along with the three accompanying reports, the Officer Remonstrant was granted a decree of personal summons against the aforementioned citizen Johannes Marx, for such purpose as the same remonstrance dictates. below stood: At Cape of Good Hope, the day and year as above, lower: In my presence, was signed: W: J: van Rijneveld, Secretary 8. In the forenoon, present the Honorable Oloff Godlieb de Wet, President, and all the Members, with the exception of Messrs. Rönnenkamp, van der Riet, Kirsten and Warnecke, who were occupied. Thursday, the 19 January 1792. The Officer Prosecutor produces a written claim accompanied by nine appendices. The prisoners, having heard the conclusion read, say that they do not know that they have done wrong, and request a merciful punishment. The Officer Prosecutor persists in his claim. The Court holds this matter under advisement for circulation. Thereafter, by the Deputy Fiscal Mr. Johannes Andreas Fruter, on behalf of the Landdrost of Stellenbosch and Drakenstein, Mr. Hendrik Lodewyk Bletterman, regarding the Hottentot named Claas, a remonstrance was submitted with a report made by the former Heemraad Ian Roux, reading as follows: The boatswain Fredrik Glandt and the boatswain's mate Fredrik Mentzer, prisoners and defendants in the aforementioned case, on the other side. With due respect, the Landdrost of Stellenbosch and Drakenstein Hendrik Lodewyk Bletterman shows, That on the 23 January of the past year, the former Heemraad at Drakenstein, Ian Roux the elder, brought to the knowledge of the Remonstrant: That 10. That a certain Hottentot named Claas, who was having relations with one of his female slaves, named Anna, and had hired himself out to his son, had come in the absence of the said Roux to his farm located at the Paarl, and had supposedly persuaded the aforementioned Anna to smash the panes of a glass window of the front rooms in the dwelling house and to take wine from that room; subsequently thereafter taking several panes and also putty from a cupboard with glass panes, standing in the attic of the house, with the intention of replacing the broken panes, but that these, being found too large, and with the cutting to bring them to the proper size, were nearly all broken to pieces; over which behavior he, Roux, having punished his aforementioned female slave Anna, the aforementioned Hottentot Claas, who had seen this, took flight, and after having hired himself out elsewhere at the Paarl for some time and secretly kept company with the said Anna, when this was about to be prevented by him, Roux, he, Claas, had also enticed or stolen the aforementioned maid. That he, Roux, having subsequently been informed that the same Anna with the aforementioned Claas had hired herself out elsewhere here at the Cape as a bastard Hottentot woman, the said Claas, when this was discovered, had denied having had relations with the said Anna to the person who was ordered by him, Roux, to take his maid prisoner, whereby he remained free, and the said Anna having been transported to the prison here, he, Roux, subsequently upon his arrival had her punished. That the said Roux, having heard only four days after his return to the Paarl that the aforementioned Hottentot had been seen there, he had given orders to apprehend him, just as he was discovered that very evening on the farm of him, Roux, in an oak forest with the aforementioned female slave Anna, having with him a bag of goods, which he, Roux, assumed had been gathered by them together in order to abscond together once again; he was taken prisoner that same evening by his slaves, whereupon the said Claas at his apprehension allegedly said to the slaves: "You will see what I will do when I get free again"; while he, Roux, has attached to this a memorandum, to which, by reason of the defects appearing therein, not the slightest consideration can be given. which could be possible, proceeded to persuade the same Anna to desert with him, to which, as may be deduced from her conduct, she appears to have shown herself willing and very inclined; for without her inclination toward and willingness with regard to the said Claas, neither the one nor the other would have happened, consequently the same female slave Anna must always be considered to have been the inducing and contributing cause of all that was committed by him, Claas, the Officer Ex Officio, Remonstrant, is therefore also of the opinion that no other or heavier punishment ought properly to be imposed upon the same Hottentot Claas than that which the same female slave Anna had to undergo, the more so since he, by his imprisonment, could already be considered to have satisfied, if not wholly, at least partly, his deserved punishment, however much the Remonstrant, subject to correction, also believes that prudence, in order to prevent all further bad consequences, would require that the said Claas be prevented from ever coming into the aforementioned district again. Wherefore the Officer Ex Officio, Remonstrant, takes the liberty of turning to Your Honorable Worships, respectfully requesting that the imprisoned Hottentot Claas mentioned herein shall be whipped and subsequently ordered never to show himself henceforth in the district of the Paerl or in the vicinity thereof, on pain of heavier punishment. Thus the request made in the aforementioned remonstrance was granted. Subsequently, it was made known by the Honorable Worshipful President that the Burgher Ensign Coenraad Nelson had presented himself to His Honor, requesting that the lawsuit initiated Ex Officio by the repatriated Independent Fiscal van Lynden on and against him, Nelson, might nevertheless be concluded as quickly as possible; His Honorable Worship had therefore inquired into the same lawsuit and had been informed that, since the Major of Artillery Fischer, who answered interrogatories therein at the request of him, Nelson, has been at the baths for a considerable time, his interrogatories could therefore not have been sworn to, for which reason the same lawsuit could also not have been circulated for review. And since the frequently mentioned proceedings, by virtue of this defect, cannot be judged to be in a state to be terminated by a definitive sentence; it was therefore judged necessary for the interest of Justice, and consequently resolved upon the proposition of the aforementioned Honorable Worshipful President, to write to the same Major Fischer at the earliest opportunity, directing him to come hither in order to review and confirm under oath his testimony previously given in this matter. The Council, having seen the summons made, heard the proclamation of the Court Messenger, and considered the contumacy of the defendants, administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, by contumacy banishes all the defendants from this Government and its jurisdiction, on pain of being punished according to their deserts should they at any time happen to fall into the hands of Justice here, with condemnation of the defendants in the costs. 19. The defendant, to purge his default, states that he was lying sick at the baths, and was therefore prevented from appearing. The Prosecutor ex officio declares he has no objection to this purge. and finally fifth, that the poison was indeed placed in the food or drink of the person whom one attempted to kill with it. Regarding these requirements, the Remonstrant, ratione officii, takes the liberty to remark that the surgeons who examined the ingredient cannot declare it to be in fact poison, or that it was of a fatal potency; nor is it established that anyone died from it, any more than that any of the persons who presumed that this ingredient had been administered to them had used an antidote, or that it was indeed administered to anyone; besides that the evidence from which one would wish to deduce a reason why the imprisoned slave Sapio would have proceeded to such an act with which he is charged is so faint and even so ridiculous that the Remonstrant considers it completely superfluous to trouble the attention of Your Honorable Worships with a demonstration thereof. That however much it is on the one hand beyond all dispute that the crime of which the imprisoned slave Supio has made himself suspected by his master, if proven, ought to be checked with some punishment or other; it is nevertheless on the other hand no less certain that the Remonstrant, both because of the defective evidence and other circumstances, is completely unable to demand against the prisoner either torture or, ordinario modo, any corporal punishment. For which reason the Remonstrant ratione officii has deemed it most advisable to bring these matters to the attention of Your Honorable Worships, not doubting that Your Honorable Worships will, according to your equity and enlightened knowledge, make such disposition as Your Honorable Worships shall deem proper. And the same Deputy Fiscal, Mr. Johannes Andreas Truter, further made known, also on behalf of the Landdrost of the colonies of Stellenbosch and Drakenstein, that since the burgher Rudolph Laubscher and Casper Knippe, who is in detention, in the responses to the interrogatories put to them before commissioner gentlemen, came to deny the fact charged against them, the aforementioned Landdrost believed that in case the said Laubscher, who only arrived at the Cape yesterday and has therefore not yet been able to recollect his answered interrogatories, should still persist in the negative, they could be received in an ordinary trial and admitted to appear by an attorney. Whereupon, after deliberation, the Council, after examination of the inquiries made and the interrogatories answered by the aforementioned Laubscher and Knippe, finding the case disposed thereto, consequently received the said Rudolph Laubscher and Casper Knippe in an ordinary trial, with admission to appear by an attorney, provided that the last-mentioned Casper Knippe conducts his defense for the present ex carcere; and all this in case the aforementioned Laubscher persists in his responses; in the absence of which the further declaration of the Remonstrant ratione officii in this matter shall be awaited. From the documents which the Declarant ratione officii has the honor to present to Your Honorable Worships, you will perceive that the widow of the late burgher Barend Beukes, with whom the aforementioned Piet Nant resides, having sent him, Nant, on Sunday the 9th of the recently passed month of October, in the morning, to the farm of her son, the fellow burgher Wessel Beukes, situated on the Karnmelks River, to fetch a flintlock gun in order to have some game shot for the use of her household. He, Piet Nant, arriving at the place of the said Wessel Beukes, met there a certain Hottentot named Valentyn, with whom, after having received a flintlock gun, which he did not know to be loaded, he returned to the farm of the aforementioned Widow Beukes. That the said Piet Nant, having returned and having knee-haltered his horse, took up the aforementioned flintlock gun, which had been taken over on the way by the Hottentot Valentyn and, upon their arrival at the farm of the Widow Beukes, had been placed against the wall beside the kitchen door; and without knowing whether the cock was drawn or rested at half-cock, laid it across his arm, whereupon the shot went off most unexpectedly, with the unfortunate consequence that the wife of him, Piet Nant, being the Bastard Hottentot woman Lis, who at that very moment just happened to step out of the kitchen door, was struck by it under the breast and immediately fell dead to the ground; while the said Piet Nant, extremely terrified by this accident, went directly to the Widow Beukes, wailing, constantly crying out: "O God, I have shot my wife dead!" That the frequently mentioned widow Beukes and her children hereupon, having calmed the repeatedly mentioned Piet Nant down in every possible way, the latter proceeded with two horses to the honorable officer the declarant and informed him of what had occurred. That the officer the declarant, having investigated this matter, it became apparent to him that the aforementioned killing cannot be regarded otherwise than as entirely accidental, and therefore completely unpunishable; the more so since he, Piet Nant, had always lived in extraordinary harmony with his aforementioned wife, and gave evidence of this on the very same day on which the misfortune occurred, as appears from the attached statement of the above-mentioned widow Beukes. On account of the two first-mentioned points, I judge that the trial is defective, and indeed so much so that no definitive sentence can be passed either for or against it; at least and in any case not before these defects are supplemented and remedied by the judge or by his order, for which an interlocutory judgment is therefore required. Concerning the last point, it is true that the lords directors wished that in all cases the trials should be settled and terminated by the Council of Justice, yet it has also appeared to me, subject to correction, that according to the letter of the Fiscal Mr. van Lynden, this matter has already been brought by his Honour to the knowledge and attention of the Most Noble, Great and Respectable Lords Directors, and that therefore, by definitively terminating these proceedings, one would notably anticipate our Lord Masters in their deliberations. I therefore consider it my duty to present these objections that have arisen with me respectfully to the council at present, and I declare, upon resumption of this matter and further consideration, to be of the opinion and advice that, after these proceedings have been brought in forma probandi, the council shall then keep them in statu, until information regarding this has been obtained either from the Lords Directors or from the Lords Commissioners-General, who are daily expected from the Netherlands, and it has been learned that the intention of their Most Noble, Great and Respectable Honours is to conclude this matter by a judicial sentence, whereupon one will then be able to judge and pass sentence on it as shall be deemed proper; and in case the Council should judge that this proposal of mine cannot be adopted, I request that this objection of mine may be recorded in the minutes. And furthermore, Mr. Pruter has also declared, upon further consideration of this matter, to join the opinion of Mr. Fleck and to be of the opinion that the decision of the trial of Mr. Lesueur ought to be suspended. 51 After the sentence was pronounced in the manner aforesaid, the Attorney Kolver requested, on behalf of the defendant, authorization addressed to the secretary of this council for the delivery of authentic copies of all documents that have served in these proceedings; in which request the Council concurred, with the stipulation, however, that the said copies shall be expedited at the reasonable expense of the defendant. The Roll having progressed this far, a memorial was submitted by the aforesaid pro interim Fiscal Deneys, furnished with two annexures, reading 53 the aforesaid memorial as follows: To the Honorable President and Council of Justice of the Castle of Good Hope. Shows with due respect, the merchant and pro interim fiscal, Mr. Jacob Pieter De Neys, That at the end of the month of September last, by the messenger of the Colony of Swellendam, Hendrik van As, there was sent to the Lord's Prison here a slave of the burgher Johannes Crafford, named Louis, whom he had overtaken here in the field near the Leeuwenbil, riding on a horse left behind by him, van As, at Swellendam. That the Memorialist, having investigated the circumstances of this case, has found that the aforesaid Louis, having run away from his master at the time when the messenger van As was at this capital, came to Swellendam, took the said horse there from the stable of the same van As without the knowledge of the household, and subsequently set off with it toward the Cape. That, whereas the intention and the motives that governed the delinquents must serve as a guideline in judging and distinguishing crimes, the Memorialist has further sought to 54 to examine with what intention the prisoner was animated when the aforesaid act was perpetrated by him. Yet that nothing has appeared to the Officer Memorialist from which he could deduce with any certainty what the prisoner's intention was, it being possible to infer from the circumstances only with very slight probability that the prisoner wished to use the horse to facilitate his flight and to get beyond the reach of his master as quickly as possible. That in consideration of this doubt, especially since the messenger van As received his horse back undamaged, the Officer Memorialist takes the liberty of respectfully proposing to Your Honors to restore the above-mentioned slave Louis to his master Johannes Crafford, after subjecting him to an ordinary punishment, provided he pays the costs, or that Your Honors please to make such other disposition in this matter as you shall deem proper. that authorization might be granted to him, the petitioner, to summon and hear the slaves and Hottentots of the said Feit. Which twofold request, after consideration of the matter, was granted to the ex officio petitioner, with the aforesaid promise under solemn pledge, and thus the discharge of the said Feit, to take place before the commissioner gentlemen of this court. Having come before the table again today, the memorial submitted on the court day regarding a certain lampoon found in this village by the pro interim Fiscal Mr. Jacob Pieter Deneys, and held under advisement; therefore, because in the said memorial no reasons appear that might have moved the pro interim Fiscal to propose to the council the alternative request made therein, it was unanimously resolved to further enclose and conceal the said enveloped and sealed defamatory libel under the seal of Justice, and thus provisionally to file it at the Secretariat of this council pending further requisition by the fiscal office, enjoining the ex officio petitioner simultaneously by extract hereof to proceed against the said lampoon principally according to style and practice. At the request of the Deputy Fiscal Mr. Johannes Andreas Priter, acting on behalf of the Landdrost of the Colonies Stellenbosch and Drakenstein, Hendrik Lodewyk Bletterman, it was approved, in view of the impoverished situation of Casper Knippe who is held in detention, to assign him an attorney, and to permit him to conduct his defense pro deo in the proceedings initiated against him, Knippe, by the said Landdrost ex officio, for which the attorney Willem Kolver having then been appointed, the same was called inside and this charge was assigned to him by the Honorable President. All present except the pro interim Fiscal Mr. Jacob Pieter Deneys. Next, proceeding to deliberation on the proceedings initiated by the repatriated gentleman Independent Fiscal van Lynden on and against the burgher ensign Coenraad Nelson on account of a certain visitation and search conducted in the houses of the free blacks Litzon van Baly and Eva van de Caap; the Honorable President beforehand brought to the knowledge of the Council the kinship that exists between His Honor and the said Nelson, His Honor being a [illegible] of the said Nelson, His Honor believing that this relationship did not permit him also to vote as a judge in the said case. Then, it being judged by the Council that, whereas according to local custom the gentleman members, even when related to one or another party in the fourth degree of affinity or consanguinity, have always also pronounced judgment on their proceedings, the kinship between the Honorable President and the said Nelson is therefore also not of such a nature that the Honorable President ought to withdraw from judging this case, the said Honorable President, after having been informed of the council's opinion in this regard, subsequently declared that he would also advise in the aforesaid proceedings of Nelson. Wherefore the Council, having taken in hand all the documents and legal instruments that served in those proceedings, having accurately considered the same and having paid attention to all that served the case and could move Their Honors, without however paying regard to a certain extract from the minutes kept in the burgher extraordinary court-martial here dated 23 February 1791, produced in court by the defendant alongside his written response, in so far as the said court-martial anticipated the judge in the judging of this case and thereby arrogated to itself a jurisdiction that does not belong to it; administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, denied the claim and conclusion made and entered into by the ex officio plaintiff on and against the defendant on 17 February 1791, and consequently acquitted the defendant of the same claim, with condemnation of the ex officio plaintiff in the costs, subject to taxation and moderation by commissioner gentlemen, these costs however not including the annexes of the written rejoinder submitted by the defendant on 18 August 1791, as having no relation to the case principally, and thus being ranked among the superfluous extensions occurring in these proceedings. And yet the gentleman Prieter did not vote in the aforesaid case on account of the dispute arisen between His Honor and the burgher court-martial, of which proper note is also hereby kept. After this were brought to the table the criminal claim and documents submitted by the pro interim Fiscal Deneys on and against boatswain Fredrik Glandt and the boatswain's mate Fredrik Menser, who had been stationed on the Honorable Company's ship Huysduynen; after which claim and documents having been deliberated upon with all attention, the Council, administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, declared the detainees to have forfeited their respective rank and wages, and consequently degraded the same to ordinary sailors at ƒ 9 per month, the ordinary wages of the prisoners and defendants to cease from the day of their detention, with condemnation of the defendants in the costs. 61. documents having served in the proceedings instituted by the Landdrost of the Colonies of Stellenbosch and Drakenstein, Hendrik Lodewyk Bletterman, against the burgher Martinus van Koppen, in the case of his demonstrated disobedience to the honored orders of the Honorable Council of Policy, and having attentively deliberated thereon, the Council, administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, has ordered the said Marthinus van Koppen to appear personally in this court, in order to be sharply reprimanded there in the presence of the plaintiff ex officio regarding his disobedient conduct, with a serious recommendation to carefully refrain in the future from doing anything contrary to the honored orders of the Honorable Council of Policy established by resolution of 13 November 1789, with respect to the farm and its associated water course belonging to the widow of the late former Heemraad Willem Morkel, condemning the defendant in all costs incurred in this matter. Lastly, it was brought to the notice of the Council by the pro interim Fiscal, Mr. Iacob Pieter Deneijs, that His Honor, having absolute need of a certain slave named Ponto, belonging to the farmer Herms Karsten, recently purchased by the same Karsten from Ian Smit of Dilburg, in order to be heard and confronted against the slaves David and Domingo, who are held in custody on suspicion of committed burglary and theft and belong to the burgher Ensign Sebastiaan Valentyn van Reenen, addressed the said Karsten to send that slave up to the Cape; but as this has not been complied with to date, he, the pro interim Fiscal, implored the judicial authority of the Council to obtain the said slave Ponto. And since the interest of justice is most highly concerned herein, it was resolved to write to the said Herms Karsten this very day by express courier on behalf of the Council, ordering him immediately to hand over the aforesaid slave Ponto to the field cornet living nearest to his farm, so that he may be brought up to the Cape without the slightest loss of time and delivered to the aforesaid pro interim Fiscal; this written instruction shall also be accompanied by an open written order to the field cornet living nearest to the repeatedly mentioned Herms Karsten, immediately to send up the said slave Ponto in a secure manner; which written order Karsten shall simultaneously be ordered to deliver to such field cornet as quickly as possible. Taken in hand were the proceedings instituted by the pro interim Fiscal, Mr. Iacob Pieter Deneijs, against the cook of the national battalion, Hendrik Lenner, in the case of mistreatment of the slave February; which documents having been attentively deliberated upon, the Council, having regard to everything relevant to the case that could move their Honors, administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, has dismissed the claim made and conclusion drawn by the plaintiff ex officio dated 11 November 1791 against the defendant, and acquitted the defendant thereof, condemning the plaintiff ex officio in the costs of these proceedings, further ordering that the defendant's slave Februari shall be soundly flogged in the presence of commissioners and subsequently returned to his master, provided he pays the costs and expenses of justice in this regard. When thereafter was also brought to the table the representation regarding the slave Scipio of Bengal, belonging to the Elder Willem Adolf Krigo, submitted on the 2nd of this month by the merchant and Landdrost of the Colonies of Stellenbosch and Drakenstein, Hendrik Lodewyk Bletterman, and circulated for consideration, it was, having considered on the one hand the declaration of the said Krigo that he does not wish to have the said Scipio back on his farm, nor let him come under anyone else; therefore judged and resolved best in this matter to provisionally place the said slave Scipio in the Honorable Company's slave lodge, there to serve on the Honorable Company's public works for his board; nevertheless leaving to his master the right always to claim him back in due course if he so desires. That the said Respected Council of Policy, acknowledging the grounds of the Court Martial, has resolved upon this to place the case in the hands of the Honorable Exponent, with instructions to initiate such proceedings against the repeatedly mentioned Hiebner as he, by virtue of his office and duty, should find appropriate. That he, Wessels, having communicated to the burgher Hendrik Human, both in the month of March and just before the recent harvest, that the Hottentot Gerrit Valentein, then staying with him, Human, owed him, Wessels, some money, and that he would therefore like to see that Hottentot come to him to serve off that money; the said Hottentot Valentein, also eight days before he, Wessels, had gathered his last wheat from the field, having arrived at his field, had said that he had come to serve off his debt. That the Remonstrant, by reason of his office, in order to proceed in this matter with the greatest caution, summoned the aforesaid Charles Naudé to him, as he indeed did not fail to appear on the appointed day, when he, being questioned by the Remonstrant ex officio about the aforesaid case, without showing the least unease, declared that what had been reported by his abovementioned slaves was utterly mendacious, as the female slave Sara had on the 2 February brought 93. into the world a child that had been afflicted with convulsions from birth, which convulsions, increasing more and more, had finally risen to such a degree that the said child passed away the following day in the afternoon, while the female slave Sara had lain in bed from the moment of her delivery until the death of her child: Naudé further adding hereto that he found himself in a position to be able to prove all these circumstances to the Remonstrant ex officio in a satisfactory manner, by statements of those who had been present on his farm before, during, and after the death of the aforesaid child. The frequently mentioned pro interim fiscal, lastly, 102 having also submitted a further substantiating memorial regarding the provisional resolution taken on the 16th of the past month of February concerning a certain defamatory libel found in this town and presently resting at the Secretariat of this Council, the contents of which were: To the Noble and Honorable Lords President and Councilors of Justice of the Castle of Good Hope. Shows with due respect the merchant and pro interim fiscal, Master Jacob Pieter Deneijs, That Your Honorable Worships, on the memorial submitted by the Remonstrant regarding a certain pasquinade found in this town and presented therewith, were pleased on 16 February last to determine and resolve to have the said pasquinade provisionally set aside at the Secretariat of Your Honorable Worships, at the same time enjoining the Remonstrant to proceed against the same pasquinade in principal according to style and practice; Your Honorable Worships, according to the terms of the aforesaid resolution, being moved thereto because the reasons were not found in the memorial which had persuaded the Remonstrant to conclude therein twofold and alternatively, either to the burning of the pasquinade by the executioner or to its being set aside until such time as all hope of discovering the perpetrator shall have vanished. That not only some members of the burgher Council of War, but also of this Council are defamed by the aforementioned pasquinade; whereby that libelous writing, as being directed against regents, meets the conditions to be able to be burned by the executioner's hands, as among other examples can appear from what is found in Zurck in Codice Batavo, heading Pasquillen, section 1, number 6. 2nd. That the perpetrator, notwithstanding all trouble taken, is hitherto still unknown, Moorman and van Hasselt on crimes and their punishments, page 201, teaching: "that if the author or composer of a pasquinade cannot be discovered, the same may in such a case be declared infamous by an executioner and the pasquinade may be publicly burned." could provide such a deed, if necessary even reinforced with a copy of the pasquil, but by that suppression one of the most suitable means to discover the perpetrator of the pasquil would be disabled; for who does not know that it is an extremely rare thing to find two persons in whose handwriting a complete identity exists, without any difference being found in one or another stroke? To which is added: Secondly, that it is of much greater importance for the general good to punish the perpetrator of a libel than the libel itself, which must certainly be deemed to happen when a pasquil is burned, since the deprivation of honor cannot take effect as long as the perpetrator is unknown, as such consists in the opinion which one harbors in one's bosom not against the author of a libel in general, but especially against a specific person known as such; moreover, the declaration of infamy, as long as the possibility of discovery exists, can by no means free society from that harmful member who has made himself guilty of composing a defamatory libel. Thirdly, that although the author or perpetrator of the pasquil in question is for the present still unknown, it can nevertheless not yet be determined that the same will not be discovered; which is why Moorman and van Hasselt, at the cited place, also say: if the maker and composer of a pasquil is not to be discovered, etc., that is, when all hope of discovery has vanished.
