The Officer Plaintiff by way of reply puts forward that the reconciliation between the defendant and the said Pisany has no bearing on the action of the officer, as the deed was committed on the public roads, for whose safety he is obliged ex officio to watch, and therefore persists in his claim. The defendant, by way of rejoinder, says that the incident arose not so much from malice aforethought as from his quick-tempered nature, and requests that the Council be pleased to take his impoverished situation into consideration, otherwise leaving this matter to the Council's judgment. Beating with whatever instrument it may be always leaves contusions; no mention is made here of mortal wounds or fracture of the ribs, with severe hemorrhages or other accidents that could result in death. It is possible that through the prolonged holding of the unfortunate man on the ground, the beating or falling on the ground disturbed his brain, or else, by the bursting open of small blood vessels, the extravasated blood poured onto the meninges, compressed the same, and obstructed the reflux of fluids, whereby strokes can be caused and result in death; the same may have been of a weak constitution, fainted, inspiration remained arrested, and thus caused death. Also, through the strong circulation and overheating, the thirst that followed thereupon, and the rapid drinking of cold water, he may have lost his life. Thus it appears difficult to us to declare the blows alone or directly to be the cause of death. The Council, having read the written demand of the officer with the documents relating thereto, after consideration of matters, administering justice in the Name and on behalf of the High and Mighty Lords States General of the United Netherlands, condemns the defendant Ian van der Groen, by reason of his young years and simplemindedness, to be stretched over a bench indoors and chastised with birch rods on the bare buttocks by the servants of Justice, the Council further condemning the said defendant to the costs, with dismissal of the further demand of the officer, yet with the added declaration that the defendant's monthly wages have been suspended since the day of his detention. Subsequently, having read a petition of the aforementioned pro interim fiscal Mr. Iacob Pieter Deneys, together with an annex, reading: To the Honorable and Venerable Lords President and Councillors of Justice of the Castle of Good Hope. Shows with due respect the merchant and pro interim fiscal Mr. Jacob Pieter De Neys: That upon the first discovery of the perpetrators of the burglaries and thefts committed consecutively in this place since the year 1790, when the detained slaves, David of Sorobao, belonging to the burgher ensign Sebastiaan Valentin van Reenen, and Philis of Batavia, bondsman of the burgher ensign Dirk de Iong, were reported to the Honorable Submitting Officer as having knowledge and being complicit, the Honorable Submitting Officer immediately had the same taken into custody with the utmost caution, in order that they might be submitted, as found warranted, to their deserved punishments along with the others. However, that the first-mentioned David, having been heard upon articles before the commissioner lords from Your Honorable Venerables, utterly denied having any knowledge of the committed break-ins and thefts, and furthermore declared that the knife handed over by him to the free black Ioseph, with which the murder was suspected to have been committed on the person of Hendrik Bremeyer in the night of 11 and 12 April 1790, was given to the said Ioseph to return to his, the defendant's, fellow slave Dominga, from whom he had borrowed it for slaughtering; this having taken place, as he further states, because the said Ioseph passed as the father of the slave Dominga, and he, David, coming from the countryside at the time, had no time to hand the knife in person to the owner himself, who likewise needed to use it for slaughtering. That, furthermore, the slave Philis, accused as an accomplice in the burglary and theft at the Orphan Master Pieter Laurens Cloete in the night between 19 and 20 September 1790, is not burdened by any indications whatsoever in the world, and his accuser, Dominga aforesaid, having not persisted in the accusation, the Honorable Submitting Officer deemed himself incompetent to hear the same upon articles, and thus, as it were, compel him to testify against himself. That these two slaves, therefore, however much some confusion shines through in the replies of the first, nevertheless cannot with any grounds be submitted to criminal proceedings, the Honorable Submitting Officer deemed it his duty to bring these circumstances to the knowledge of Your Honorable Venerables, in order that the same slaves may by judicial decree be returned to their bodily owners as innocent; or that Your Honorable Venerables may please to dispose otherwise in this regard as you shall judge in good justice to be proper according to the nature of the case. order to determine whether the prisoners shall make their defense in detention, or whether they shall be released therefrom upon hand-promise, since the aforementioned article is phrased in general terms, namely: "That if there should appear so little evidence of the innocence and harmlessness of the prisoners, We will that, all questions postponed and put aside, the sitting judges shall understand to release and discharge him, it being an error to let him think that the honor of Justice consists in releasing no one, which rather lies in giving a good, prompt, and upright judgment, unto acquittal or condemnation. And if the crime does not wholly and fully appear after the inquiries and diligence performed in that regard, but that there is only dispute or doubt, if the case and matter is not too severe, the prisoners shall be released upon bond or bail, fidejussoire or juratoire, according to the quality of the persons and the crime: confining the same or otherwise ordering as the case and matter shall be found disposed, forbidding all officers to release or discharge any prisoners without a decree or order of the judge or judges." While he, the Attorney General, further declared it to be his view that in the present case no difficulty can be caused by the fact that the imputed acts require corporal punishment, since, as Van Leeuwen states in his notes on the said article 33, even in capital and corporal cases, where the proofs are not such that the prisoners can be put to rigorous examination, the prisoner may also be released without bail and solely upon hand-promise to reappear in court at all times when summoned, sub poena confessi et convicti. He, the Attorney General, nevertheless believed that the release regarding the last prisoner, Hendrik Jonk, is subject to considerable difficulties, since he is fully in confession regarding his desertion. Yet, since one is nonetheless indebted to the petitioners for the said Ontong having fallen into the hands of Justice, and thus having been deprived of the opportunity to continue that prominent role which, as is known to your Honorable Worships, he has played in the burglaries committed successively since the beginning of the year 1790, to the considerable insecurity of the good inhabitants; the undersigned imagines, under respectful correction, that in this singular case some deviation from the mentioned strictness could well be tolerated, and thus the above-mentioned reward of 200 Ducatons be issued to the petitioner, in order thereby in the future to encourage the vigilance of the inhabitants to apply themselves to the discovery or apprehension in similar cases, in which each and every one is so directly interested in the discovery and everyone's safety is imperiled, this having in the present case the less difficulty because the reward is offered to him who discovers the perpetrator or perpetrators in such manner that they fall into the hands of Justice and are convicted of the deed, both of which points, taken in a broad sense, the petitioners have satisfied; the latter having indeed followed from elsewhere, yet always requiring the concurrence of the first, namely that the perpetrator had fallen into the hands of Justice. The undersigned nevertheless submits these his considerations to the more enlightened judgment of your Honorable Worships and respectfully trusts thereby to have complied with your esteemed intention. The prosecutor ex officio submits a written criminal claim, provided with six annexes. The prisoner, having heard the conclusion of the claim read, requests pardon. The prosecutor ex officio persists with his claim. The Pro Interim Fiscal Mr. Jacob Pieter Deneijs in a criminal case, on the one part, contra Iuny of Macassar, slave of Hendrik Denner, cook appointed to this Castle, prisoner and defendant in the aforementioned case, on the other part. The prosecutor ex officio produces against the prisoner a criminal claim in writing, and submits alongside it a register of three annexes. The prisoner has nothing to bring against it. The Council holds this case for circulation of opinion. Which being deliberated, it was approved to have the said Hendrik Jonk served pro Deo by the attorney Wagener, who shall be given notice of this by extract hereof. Subsequently, there was submitted in Council by the Pro Interim Fiscal Mr. Jacob Pieter Deneys a letter received by his Honor today from the Landdrost of the Colonies Stellenbosch and Drakensteyn, of this content: Honorable Sir, Upon report received the evening before yesterday from the valiant Lieutenant Rudolph Cloete: that one of his slaves, having gone to search for missing cattle, was said to have found the corpse of a European lying in the dunes; I, on account of my indisposition and the uncertainty whether that corpse might be situated under this jurisdiction or under that of the Cape, sent thither yesterday morning the former chief surgeon P. Whereupon subsequently some altercation having occurred between the petitioner and the said Rossouw, too elaborate to relate here, the consequences thereof have been that the repeatedly mentioned Rossouw claimed that the said Moses of Mozambique had resisted him and drawn a knife, with the threat of making this known to the Landdrost, just as the said Rossouw also put this into effect on the 16th of this month of June and addressed himself in that regard to the Landdrost of Stellenbosch, Mr. Hendrik Lodewyk Bletterman. Yet, Honourable and Respected Gentlemen! Since it must be apparent in all respects that the said Rossouw took this step solely out of spite and was probably also afraid that the petitioner would lodge a complaint against him, Rossouw, with the Officer on account of the mistreatment inflicted upon his slave, and as he was very well aware that the said slave Moses could speak no Dutch and thus could not have expressed himself in any insolent terms, his aim can consequently be regarded either as a means to avoid the prosecutions that the Public Prosecutor might bring against him, Rossouw, in the subject case, or had as its object to cause the petitioner heavy expenses out of intentional hatred, over and above the danger in which he would place the petitioner if his slave Moses with his sick body were placed in custody, and, should he unhappily come to die in prison, would cause no small loss. nowhere to obtain fellow slaves, from which it is rendered somewhat probable that the same, while the burglary at the house of his master occurred, slept at home; which, however, can never be considered as sufficient proof that the detainee may not have been outside the house during that night, even if one adds thereto the declaration of his master, the aforementioned Mr. Meyer, who testified to the Remonstrant that the detainee was at home on the evening before the burglary and also appeared the morning thereafter coming out of his usual sleeping place: besides that by all of this it is by no means proven that the detainee during the burglary at the frequently mentioned citizen Abraham de Haan was elsewhere than in loco delicti. That by the aforementioned evidence, consequently, little is subtracted from the force of the accusation, especially with regard to the latter case, and thus the question still remains whether and to what extent the naming of accomplices is capable of convicting the one named, or at least bringing him to a stricter examination; concerning which the Officer Remonstrant is of the opinion that the naming in the present case is capable of providing sufficient grounds neither for the one nor for the other; and this especially because, as will have appeared to Your Worships from the demand against the detainee’s accusers aforementioned, the detainee must be considered as one of the principal causes of the discovery of the housebreakings committed, of which circumstance his accusers having had knowledge, on that account are also not free from falling under suspicion of having harbored some hostile malice against the same: wherefore the repetition made so shortly before receiving their punishment also deserves little consideration in this regard, as perhaps owing its birth to that very presumptive hostility: for, as Matthaeus de Criminibus, Book 48, Title 16, Chapter 3, Number 16 correctly observes, "some are not abandoned by wickedness before they abandon life." Yet, however much this accusation therefore cannot be considered sufficient to finally condemn the detainee, or to bring him to a stricter examination, it nevertheless appears from the other side no less certain that he, the detainee, has thereby been brought under vehement suspicion, and the judge rendered unable to pronounce a final judgment for the absolution of the same, the less so because from the detainee’s own avowal made against his accusers prior to the accusation, and annexed to the aforementioned demand, it is apparent that he had knowledge of the housebreaking committed at the citizen Jan Cederlouw, and concerning it always observed a deep silence, for which silence alone the detainee has incurred an extraordinary punishment. Wherefore the Officer Remonstrant takes the liberty of addressing Your Worships, and respectfully proposing to the same whether it would not be most advisable provisionally to place the detainee, Damon of the Cape, on Robben Island, in order to test, without his longer detention in the prison, whether anything further can be discovered, so as then to proceed with success against the detainee in the case of the committed housebreaking; or else, in the absence of further proof, to make him undergo a condign punishment for his silence. 194 slaves who resist Christians and Europeans by force of arms always require corporal punishment, and in the here-annexed, recollected, and sworn report of the burgher Daniel Iohannes Rossouw, the slave mentioned more broadly in the aforementioned request is said to have drawn a knife he had with him; it has therefore appeared to the undersigned that, by leaving the same slave at liberty any longer, an occasion might very easily be given for him to absent himself, and thereby evade the punishment which, in case of further conviction, must follow him, toward the satisfaction of which corporal punishment the interposition of the petitioner could avail little, indeed nothing at all. That the undersigned, considering the simple-mindedness and dullness of the aforementioned slave, which became evident to him and the Gentlemen Commissioners from this Council at the swearing-in of the report delivered by the said Rossouw, cannot indeed hold it to be impossible that some spitefulness, as the petitioner expresses himself, took place in the accusation, but that the sworn report, delivered by a burgher of good name and reputation, added to the lack of any grounds on the part of the petitioner, forbids the undersigned to defer so far as to set the slave in question entirely at liberty; especially because, the truth of the report being presupposed, one ought not to fear further consequences without foundation. Wherefore the undersigned, subject to respectful correction, is of the opinion that the petitioner's slave Moses of Mozambique ought to be taken into apprehension, and the petitioner ordered to submit without any delay to the officer the grounds upon which the arguments posed by him in the petition are resting; so that proceedings against the same slave may be conducted with so much speed that the imprisonment will not cause the slightest prejudice to his well-being: the outcome of this procedure being likely to establish the well-foundedness or groundlessness of the accusation, and thus it can also then be determined whether on that account any action lies against the repeatedly mentioned Rossouw, either for the officer or for the petitioner himself. Wherewith the undersigned, trusting to have satisfied the esteemed intentions of your Honorable Worships, respectfully submits this as information and considerations. After the reading of which, it was resolved to grant on the mentioned petition as apostil: 195 The Council, having read the considerations and the report of the Landdrost of Stellenbosch and Drakenstein, declares itself unable to grant the request of the petitioner, and grants to the Officer apprehension of the slave Moses of Mozambique, with orders to effect the necessary investigation concerning him as soon as possible. and documents having served the proceedings initiated by the Deputy Fiscal Mr. Johannes Andreas Truter, being expressly qualified according to the resolution of 2 February last to replace the Fiscal office in this matter, against the burgher Jan Theunis Mulder on account of atrocious verbal injury; which having been maturely deliberated upon, the Council, administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, has condemned the defendant Jan Theunis Mulder to declare, in this court of justice, after the ringing of the bell, with open doors, on his bare knees, his remorse and regret over his conduct, and further to beg forgiveness of God, Justice, and the pro interim Fiscal Mr. Jacob Pieter Deneys if he wishes to be present, and furthermore to pay to the plaintiff ex officio a fine of Two hundred Ducatons; with the condemnation of the defendant Jan Theunis Mulder in all costs incurred in this matter, and dismissal of the further claim of the officer. Lastly, the Honorable President communicated to the Council that the Landdrost of the Colony of Stellenbosch and Drakenstein, Hendrik Lodewyk Bletterman, had notified His Honor that, upon the report of two slaves of the burgher Johannes Gideon Louw, alleging that one of their fellow slaves, named Louis of Mozambique, had been beaten on the 20th of the past month of June by the said Louw in such a manner that the same Louis died a few moments thereafter, he, the Landdrost, had proceeded on the 23rd following to the place of the said Louw, situated on the Berg River, and had there caused the corpse of the said slave Louis to be viewed by two Heemraden and examined by the Surgeon Cornelis Ernestus Ponty; which Heemraden had declared that externally, just as the Landdrost himself had found, they had discovered or found not the slightest sign of ill-treatment on the corpse; while the Surgeon had also testified to have discovered not the slightest contusion, much less any mortal wound on it, and that the death of the said slave Louis was caused by some sudden seizure; that the Landdrost, having inquired there for what reasons and in what manner that slave had been punished, had learned that his master, the said Joh.s Gid.n Louw, had given him some blows with a sjambok on the buttocks for stealing flour, the marks of which were visible at the post-mortem examination, without even having chastised him according to his deserts because of the busy work of plowing and sowing; and that the said Landdrost further requested to know whether he might return the mentioned slaves, who reported the punishment and the death of their fellow slave Louis, at the request of their master, after they had undergone a correction in front of the prison; the aforementioned Honorable President having deemed that he could by no means do anything in this matter as President, but had to present the same to the Council. Whereupon, having deliberated, it was resolved to authorize the Landdrost to return the said two slaves to their master without punishment, since their complaint was by no means devoid of all grounds, and also to order him to do them no harm on account of this.
