The attorney Vercueil, acting today with permission of the Honorable President for the parties of the attorney Wagener, who has been prevented from appearing due to the sudden death of his child, submits a written rejoinder with two annexes. The defendant ex officio requests inspection thereof and, if necessary, a copy in order to act in this matter as he shall be advised. The Honorable Plaintiff ex officio produces a written claim together with an inventory of various documents and concludes as at the end thereof. The prisoner requests mercy. The Fiscal pro interim Mr Jacob Pieter Deneys, Honorable Plaintiff ex officio in criminal cases, on the one part, against Baatjoe of Bugis, slave of the burgher Jacob Poges, prisoner and defendant in the aforesaid case, on the other part. The Council, having read the aforementioned written claim together with the documents attached thereto, and after consideration of that which merited any reflection, doing justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, condemns the defendant Baatjoe of Bugis to be taken to the place where criminal sentences are customary to be executed, and there delivered to the executioner, tied to a post, and severely flogged with rods on the bare back, furthermore to be riveted into chains, and to be confined on Robben Island for the period of ten consecutive years, in order to work there on the Honorable Company's public works, with condemnation of the prisoner in the costs and expenses of justice. would sacrifice, they are nevertheless unable to do so, because they have no family or good acquaintances at the Cape to furnish for them those moneys that will be required for the continuation of the trial; and That the aforementioned detainee Ionk, through his long detention and the accompanying harsh season, is so impaired in his health that one must not without reason fear that an even longer detention for that pitiable object will be very harmful and detrimental. Reasons why the Suppliant turns to your Honorable Worships, with a humble request that it may be of your Honorable Worships' benevolent pleasure to grant the two first-mentioned, namely the aforementioned Dyssel and his wife, to plead their case pro deo before your Honorable Worships' tribunal, and that they, on account of their poverty, may be served by the undersigned without stamps or any other payment; while the Suppliant, without any fear of self-interest and purely out of philanthropy, has taken on their case, being also unable, both on account of the general scarcity of money and through the numerous disbursements that he has already had to make in other cases, to furnish the costs of the trial to them. And that the often-mentioned Ionk may now be accommodated in his pitiable circumstances, either that he be placed in the Castle or elsewhere, or else provided with some bedding and warm clothing, in order by this remedy to prevent that he should perish in his detention, because that pitiful object is forced to take his night's rest on the bare ground and rocks, or that your Honorable Worships may be pleased to dispose concerning his person in such a manner as your Honorable Worships, according to your well-known equity, shall deem proper; at the bottom stood: which doing, etc.; was signed: I: I: J: Wagener, admitted attorney; in the margin: Exhibited in Court on 19 Iuly 1792. Which having been read, and having heard thereupon the Adjunct Fiscal Mr Johannes Andreas Truter, who acted herein for the Officer of Justice, he requested a copy of the submitted answer in order to reply thereto; and further declared, with respect to the presented petition, that he completely left the petitioners' request to the judgment of this Council, merely adhering to the grounds that he adduced on the occasion when the detainees were admitted to an ordinary trial, and upon which he requested from this Council that the defense of the detainee Hendrik Ionk might take place ex carceres. The representative persists in his request. The Council grants the Officer of Justice the requested copy to serve for a reply. Furthermore, disposing upon the submitted petition, the Council grants the first-mentioned petitioners Iohan fredrik Rykes Dyssel and his wife Cornelia van Saven their request, on account of their impoverished situation, to be served pro deo. Furthermore, with respect to the grievances of the petitioner Hendrik Ionk, it has been commissioned to the pro interim Fiscal Mr Iacob Pieter Deneys to make a request, in the name of this Council, as soon as possible to the Honorable Worshipful Lord Commander, that once again, according to custom, there may be furnished on the part of the Company for the lord's prisons the necessities that are required for the covering and preservation of the prisoners, from which the detainee Hendrik Ionk shall then also have to be provided, as is required for the preservation of his health. And on this occasion having also taken into consideration how the duty of the judge himself also entails seeing to the good treatment of the prisoners, which among others also appears in the Criminal Ordinance of the year 1570, article 39, which article, however, is not held in observance here and has fallen into disuse; it is thus now, upon the proposal of the Honorable Worshipful Lord President, unanimously resolved and established that henceforth the Fiscal's office and the Commissioned Gentlemen serving according to their turn in commissions shall, at least once a month, have to examine the prisons here accurately and proceed therein conformable to the prescription contained in the mentioned 39th Article of the Criminal Ordinance, so that, upon finding that any omission is committed or negligence takes place concerning the proper cleaning of the prisons or the good treatment of the prisoners, this may be provided for by appropriate means in such a manner as shall be deemed proper to attain the intended objective, namely to make the prisons serve not in the least for punishment, but solely for the custody of the prisoners. Which report was approved to be sent for perusal among the respective members together with the aforementioned petition, and thus to keep the request of the aforementioned Abraham van de Caap still under advisement. Whereafter the same acting fiscal made known that, upon received report that the burghers Johannes Steidler, Jan Lodewijk Bek, and Meyer, in the night between last Sunday and Monday, the 15th and 16th of this month, were taken into custody and transferred to the Castle on account of acts of violence committed against several persons; his Honor, having approached the Honorable Commander, requested and also obtained from his Honor that the same arrested persons might remain in detention until he, the acting fiscal, should have informed himself on the matter; that he then also immediately took four statements before the Commissioners, which he also produced and from which it appears that the first-mentioned Johannes Steidler did not hesitate to attack diverse persons with his saber, and among others attempted to force his way with violence into the house of the burgher fire master Jan Michiel Sadi, as well as committed several acts of wantonness. For which reason he, the acting fiscal, found himself obliged to request that the aforementioned Johannes Steidler, by judicial disposition, may be kept in civil detention and the representative of the public prosecutor be qualified to hear him on interrogatories before the Commissioners; as well as to provisionally release the remaining arrested persons in order to deliberate further regarding the proceedings to be instituted against them. Which having been deliberated upon, the Council, after consideration of the aforementioned preparatory inquiries taken, consented to the request made by the representative of the public prosecutor with respect to the first-mentioned Johannes Steidler; with the added order that the aforementioned Jan Lodewyk Bek and Meyer must also remain in their arrest until they likewise shall have been examined and heard before the Commissioners. Further being brought to the table, the proceedings instituted in a criminal case by the Landdrost of the Colonies of Stellenbosch and Drakenstein Hendrik Lodewyk Bletterman, in his official capacity, upon and against the burgher Rudolph Jacobus Laubscher and the detainee Casper Knippe; thus the Council, after consideration of all that merited any reflection in this matter, doing justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, condemned the first defendant Rudolph Jacobus Laubscher to be placed on bread and water for the period of eight days and further to pay to the prosecuting officer a fine of one hundred rds, - further the second defendant and currently still detained Casper Knippe to be banished forever from this country and the jurisdiction thereof; he, the detainee, consequently to be sent to Europe on the first occurring opportunity; with condemnation of the defendants in the costs of this trial, and dismissal of the further claim made with regard to the first defendant Rudolph Jacobus Laubscher. The representation submitted on the last ordinary court day with respect to the burgher Servaas de Kok by the Landdrost of the Colonies of Stellenbosch and Drakenstein Hendrik Lodewyk Bletterman, and since circulated along with the documents produced therewith, being now brought again to the table; it is, considering that an officer of justice ought to know for himself how to conduct himself in the exercise of his office, not only that, but also that this Council can in no way advise an officer in a matter concerning which they might possibly have to pass judgment as judge, thereupon granted the following order: The Council, having read with surprise the representation and request made therewith, enjoins the presenter to do and act in this matter and all other cases as the duty of an officer of justice requires of him. All present except the acting fiscal Mr. J. Deneys. Hereafter were also brought to the table the criminal proceedings instituted by and on behalf of the acting fiscal Mr. Jacob Pieter Deneys, in his official capacity, upon and against the prisoner Pieter Rosier, concerning which, having been deliberated with all attention, the Council, after careful consideration of all that merited any reflection, doing justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, condemned the prisoner Pieter Rosier to be brought to the place where criminal sentences are customary to be executed, there to be delivered to the executioner, his eyes blindfolded, and kneeling before a heap of sand, the sword struck over his head, and subsequently to be banished forever from this country and the jurisdiction thereof, with condemnation of him, the prisoner, in the costs and expenses of justice. 231 General, the provisions, etc. have at the same time seen fit to approve likewise the aforementioned instruction for Commissioners from the Council of Justice, and consequently to declare it adopted, solely with etc., and also decided that etc. and that in the same manner, as soon as possible, there shall be furnished to the aforementioned Commissioners from the Council of Justice, for their information and strict observance, a copy of the aforesaid instruction drafted for them, as the same has now been established by their High Nobles, etc. However, if through the introduction of the aforesaid instruction a complete dissolution of the aforesaid College, as it is currently composed, has now also become necessary, in order that it may be created anew, on the footing as determined by the first and second articles of that instruction; It is therefore likewise approved, etc. all, however, so far as concerns etc., subject to the further approval of the most highly esteemed Commissioners-General, at whose express desire it has on this occasion been further decided and determined that at the head of this College, as well as in all other Commissions from the Council of Justice, both in presiding and in voting, the order shall be observed according to which the members composing the same Commission have their seat in the College of Commissioners of the Council of Justice and in the said Council respectively; which order shall likewise be observed in voting in 232 in the Council of Justice itself. to determine to what extent the defendants crossed the aforementioned river with any malicious intent, and further to proceed as in accordance with the law to the extent that the placcaat of 16 June 1774 may consequently be applied to them; concluding therefore generally that the defendants shall be punished in such manner as this Council, according to the exigency of the matter, shall deem proper in good justice; with costs. The attorney Wagener, assisting the defendants in this matter, submits in response to the allegations: that the defendants are completely ignorant of the government's placcaat, and found themselves compelled by the severe drought, if they did not wish their livestock to perish from want, to move to certain tracts of land where some grazing could still be found; that they never entered into any cattle bartering and also never crossed Bruins Hoogte or the Gamtoos River; that furthermore, they committed no violence or disorder against anyone of the Hottentot nations, much less mistreated or insulted any of them. In proof whereof, the defendants submitted a sworn statement by the burgher Willem van Reenen and the apothecary of the Württemberg regiment Christiaan Eisenloks, who recently found themselves in those regions during an overland journey and conducted a thorough investigation on this matter among those nations and the Hottentots residing in those parts: on the basis of all of which the defendants concluded to the dismissal of the claim, with costs. The Honorable Prosecutor, rejecting only the plea of ignorance, leaves the matter further to the judgment of the Council. Furthermore, the parties renounce making further submissions. Upon examination of the documents submitted by the parties, it being taken into consideration by the Council that the defendants live so far inland and thus rarely appear at this main settlement, and consequently could indeed have been ignorant of the content of the placcaat; it was therefore, and in view of the fact that the contrary has been proven regarding the mistreatment of the Hottentots which, according to the statement made to the Honorable Prosecutor, was allegedly committed by the defendants, deemed fit to seriously admonish the defendants to remain on the loan farms held by them from the Honorable Company, without ever venturing beyond the boundaries established here by the Government; and likewise never to cause any annoyance or injustice to the Hottentot nations in this country, much less to mistreat them in any way; sentencing the defendants, however, to pay the costs incurred in this matter. Which decision having also been presented to the defendants in the most emphatic terms by the Honorable President, they declared that they would conduct themselves strictly in accordance with it. After the court roll had proceeded this far, the Fiscal pro interim, Mr. J: P: De Neys, presented a petition on behalf of the slave Francies of Mauritius, belonging to the Sea Lieutenant Laurens Janssen, who is on half-pay, the contents of which were as follows: Right Honorable and Honorable Sirs! Respectfully shows Mr. J: P: De Neis, merchant in the service of the Honorable Company and Fiscal pro interim of this Government: That late in the past month of June it was reported to the Fiscal's office by the Sea Lieutenant Laurens Janssen, who is on half-pay, that one of his slaves, named Francies or Francois, had confessed, in the presence of the bookkeeper and garrison writer Andries Muller and the assistant Dignus de Vlaming, who is on half-pay, that two years ago, at the house of the Lieutenant Engineer Michiel Dominicus Barbier, who has departed for the Indies and was previously his master, he had dealt a blow to the head of a newly arrived Madagascar or Mozambique slave of such nature that the latter died the following day, adding that this supposedly took place on the occasion that the aforementioned newly arrived slave, sitting at the hearth, had broken an earthenware pot. That the said Prosecutor, having subsequently caused the repeatedly mentioned Rigter to come to the Cape once more, in order to confirm his given report under oath in the presence of his slave Paul and to test whether it would be possible in this manner to convince him, but that all in this matter ended fruitlessly, as the imprisoned slave fully repeated his responses, given so long before, upon the verification thereof before the Commissioners, without adding or subtracting anything thereto, as may appear to Your Honors from the prisoner's responses annexed hereto. That when the Prosecutor takes into consideration that the statement was made by the prisoner's master, who suffers a considerable loss through the public punishment of the prisoner, and in whom all suspicion of falsehood or vindictiveness falls away and ceases, because he would have lacked no means to have his own slave severely punished, while he furthermore could have secured his person by riveting him in chains and alienating him; then he is very much inclined to hold himself convinced that the imprisoned slave Paul truly and intentionally laid hands upon his master. Yet that the Prosecutor, on the other hand, taking into consideration that the burgher I: G: Rigter, being subject to the usual human frailties, the possibility nevertheless always remains that he, whether blinded by passion or by turning his face away, could not properly perceive whether the blow was dealt accidentally or indeed with intent, the more so because the blow was received by him on the back part of the head, and thus at a moment when his face was turned elsewhere; so he, the Prosecutor, believes, under respectful correction, that this case, through the testimony of the prisoner's master, by no means ceases to be doubtful; and that it would always serve as a bad example and run diametrically against law and reason if one, upon the mere word of a master, however much strengthened by oath, and even assumed to be true and truthful, were to condemn to death a slave, who nevertheless never ceases to be a human being. That prudence therefore commands the Prosecutor to bring this delicate matter to the cognition of Your Honors, and in all respect to propose to the same to place the slave Paul of Batavia, on account of the aggravating circumstances that militate against him, and of which his master seems to hold himself completely convinced, provisionally on Robben Island, until such time as some further evidence regarding this matter may be discovered. interim fiscal has caused to be requested whether His Honour would be pleased to place the aforementioned Izaak into the lord's prison and to have the validity or groundlessness of his complaints investigated. That notwithstanding this request, that bastard continues to walk free and, as the petitioner is informed, occupies himself with calumniating him, the petitioner, in every way, so as thereby, if it were possible, to cause injury to the petitioner's honor, good name, and reputation, and to avenge himself upon his master. That since the same Izaak was not only raised in the house of the petitioner's parents and with the petitioner, but also, as appears from the extract annexed hereto from the list of registered bastards, being properly entered, is resident with the petitioner, from where he, according to the issued placcaat, in order to prevent all irregularities and disorders, may not depart without proper consent, he has not hesitated to commit these outrages against the petitioner. So the petitioner, very respectfully turning to Your Honorable Worships with the prayer, that it may favorably please the same to enjoin the fiscal office to place the aforementioned bastard Hottentot Izaak into custody, and that the complaints made by him may be properly investigated, and in case the same are found groundless, he, Izaak, may then be punished according to his deserts and sent back to the petitioner with a stern recommendation to guard himself carefully against such irregularities in the future; which doing, etc., was signed: P. Which having been read, the fiscal pro interim, Mr. Jacob Pieter Deneys, requested that, as this matter related to the daily domestic operations of the fiscal office, a copy of the submitted petition might be granted to him, in order to elucidate the Council in that regard. When the parties subsequently were about to withdraw, a request was further made by the aforementioned van Breda that Mr. Fruter might stand down. Upon which request Mr. Fruter declared to the Council that His Honour had no personal dispute with the aforementioned van Breda, and therefore also considered that he could not be recused as a judge by him, since it appeared in more than one place from the minutes of this Assembly that His Honour, on account of the well-known dispute with the Burgher Military Council, had indeed of his own accord abstained from voting in all matters concerning that Military Council, but that such had never occurred in all other cases concerning the individual members of the Military Council, nor had it been demanded of His Honour; declaring nevertheless now to excuse himself from voting on the aforementioned petition. Yet, however much the Council agreed with this declaration, it nevertheless took into consideration that someone may well, and even on good grounds, consider it necessary to recuse one of the judges, but that the dignity of the judicial office would be greatly compromised if, on such an occasion, a recused member who is not a direct party or immediately involved in the matter were required to stand down and therefore to vacate his seat in the Council. Wherefore it was resolved to call the aforementioned van Breda back inside and to inform him that his request to have Mr. Pruter stand down from the meeting cannot be granted. That the undersigned, as obliged in his capacity and also accustomed on occurring occasions to protect such creatures, devoid of self-defense, against oppression and persecution by ill-minded persons, considered it necessary to conduct a careful investigation upon this complaint, as to whether the complainant might not have engaged himself in the service of the aforesaid van Breda for a specified and not yet expired term, in order, in that case, to make him return to his service after proper correction; to which end the undersigned, having requested from the secretary of the burghery, C: P: Slotsboo, an extract from the register of registered bastard Hottentots, could not have this request fulfilled by the said Slotsboo; because his predecessor, I: H: Vermaak, had not yet handed over the register of the bastards to him and was at that time not present at this capital, but at his farmstead at the Ronde Boschje. That the undersigned did not fail, immediately after receiving this answer, to have the petitioner van Breda notified by the court messenger that the bastard Hottentot Izaak in his service had complained, but that for the reason just stated, the matter could not be settled, which was answered by van Breda by requesting the undersigned that the said Izaak might be placed in the lord’s prison, without having taken the least trouble to come and elucidate matters to the undersigned. That in the meantime the requested incarceration could not be complied with by the undersigned, because the aforesaid bastard Hottentot did not accuse the petitioner of anything that could yield the undersigned any action against him, and thus could by no means be regarded as an accuser from whom in due time satisfaction could be demanded for any false accusation, and who could consequently fall into the terms of having to undergo any punishment, which was also the reason why the undersigned did not immediately have the said bastard Hottentot taken into custody upon the lodging of his complaints. That the undersigned, notwithstanding that he had left the bastard Hottentot Izaak in his natural freedom in such a way that he could always be found, nevertheless continued to investigate whether, pursuant to the burgher registration books, longer service could be claimed from him by the repeatedly mentioned van Breda, which having finally been effected after the return of the former Secretary Vermaak, the undersigned summoned van Breda to appear before him in order to confer with him about the findings of the investigation conducted. However, that upon this, a petition was immediately presented by him, van Breda, to your Honorable Worships, and a speedy investigation having been ordered by your Honorable Worships, this was also duly carried out, whereupon from the account given by the aforesaid Izaak before the Gentlemen Commissioners in the presence of the petitioner, it became apparent to the undersigned that his complaints are entirely consistent with the truth, as van Breda materially contradicted nothing of what was set down in that account. Subsequently was read a representation from the aforementioned pro interim fiscal Mr. Jacob Pieter Deneys regarding the imprisoned slave Damon of Bougies, belonging to the burgher ensign Sebastiaan Valentein van Reenen, of the following tenor: To the Right Honorable the President and Councillors of Justice of the Castle of Good Hope Right Honorable Sirs, With due respect, the undersigned merchant in the service of the Honorable Company and pro interim fiscal of this Government, Mr. Jacob Pieter Deneys, shows: That in the month of May recently past, it was brought to his attention that a certain slave named Arend of Bengal, belonging to the Commissioner of Marital and Petty Legal Affairs, the Honorable Jacobus van Reenen, had been wounded; who, having been cured of his wounds and being fully convalesced, has declared before Commissioners from this Council, according to his given account, annexed hereto with all respect under no. 1, that for about five months now, without being able to specify the exact time, along with the fellow slave Damon of Bougies, belonging to the burgher ensign, the manly Sebastiaan Valentein van Reenen, in a warehouse belonging to his the informant's master, serving under the supervision of a servant, and also keeping his residence there, on a certain evening went to sleep together with the said Damon, and that very early in the morning unexpectedly, he was awakened by severe pain which he felt at the neck, and for that reason let out a loud shout or scream, at which moment the said servant came rushing in and asked him what that meant and what ailed him, whereupon he, firmly imagining that the same servant had awakened him with some blows, out of fear of receiving more blows on the bare body tried to put on his jacket lying close at hand, when he noticed that he was wounded, and the blood was running down his body, for which reason he called out to the aforementioned servant that he was wounded; the said wound, according to the surgical certificate of the burgher surgeon Johan Wilhelm Semler, attached hereto under no. 2, consisting on the right arm of a crescent-shaped wound one and a half inches long and a quarter inch deep, on the left arm of half an inch long and half an inch deep, besides, as the informant says, a cut on the neck, of which the said surgical certificate, however, makes not the slightest mention, while it was subsequently found that the said slave Damon had absented himself from there and could not be found; he, the informant, testifying that although he could not suspect otherwise than that he had been wounded by that slave, he nevertheless had always been very intimate with him and never had any quarrel; That subsequently, the said slave Damon of Bougies, being interrogated before Commissioners, has confessed to recognize the knife shown to him, and with which according to all appearance the aforementioned Arend was wounded, as his own, and which he used daily; that on a certain morning, when he was awakened by the servant to begin his usual work, wishing to cut through a candle, he had fallen with the same upon the said slave Arend, but that he had not stabbed him, and that it thus must have been caused by accident, namely by his fall, most expressly, stoutly, and firmly denying to have wounded him deliberately or with premeditation, as appears from his given answers to the interrogatories put to him, which the Ex Officio Remonstrant has the honor to present to your Right Honorable under no. 3; Yet, however much the suspicions that he, Damon of Bougies, must have wounded the fellow slave Arend are not to be dismissed, the Ex Officio Remonstrant nevertheless finds great difficulty, for lack of the necessary evidence, in proceeding against him and concluding for any punishment, the more so because the aforementioned Arend himself is not in a position, since those wounds were inflicted upon him in his sleep, to state or specify in what manner and by whom he was wounded, and yet it is of too great consequence to let such cases pass unnoticed, or to set the imprisoned Damon of Bougies at liberty; For which reasons, the Ex Officio Remonstrant takes the liberty of addressing your Right Honorable, and respectfully proposing to you whether it would not be most advisable to place the detained Damon of Bougies on Robben Island, in order, without longer detention of the same in the Prison, to see if anything further can be discovered, so as to proceed then with greater success against the prisoner in the case of the wounding committed; beneath stood: doing which, etc.; was signed: J: P: Deneys; in the margin: Cape of Good Hope, the 30th of August 1792. Furthermore, there being submitted by the Deputy Fiscal Mr. Johannes Andreas Truter, on behalf of the Landdrost of the Colonies Stellenbosch and Drakenstein Hendrik Lodewyk Bletterman, a memorial of the following content: Shows with due respect the Landdrost of Stellenbosch and Drakenstein Hendrik Lodewyk Bletterman: To the Honorable, the President and Councillors of Justice of the Cape of Good Hope. That having been sent to him the attached report of inquest, signed by the burghers Francois Houbert and Daniel Roedolph du Toit, from which it appears that a Hottentot woman named Pyke was found strangled with a neckerchief at the Doorn River, and that a certain bastard Hottentot Titus was regarded as the perpetrator of this; the petitioner immediately sought to gather information concerning this case, and to that end sent the necessary letters; That in the meantime the same bastard Hottentot, having been brought into custody at Stellenbosch and interrogated by the petitioner, absolutely denied having any part in the murder, adding that he did not know on what ground the accusation brought against him rested; That the petitioner, in the hope of receiving some intelligence regarding this, and that those who have knowledge of the case would duly present themselves, sent the aforesaid bastard Hottentot towards the Cape, in order, as soon as the information should be received, to have him interrogated on the fact in question before the Commissioners; That some time after the bastard Hottentot Titus had arrived here in the Company's prison, a runaway slave of the burgher Hendrik Loef, named Bastiaan, was also taken into custody, who, during the customary punishment for his desertion, confessed and also subsequently repeated that not the aforesaid Titus, but he, Bastiaan, had deprived the Hottentot woman Pyke of life, and that consequently a false accusation had taken place with respect to that bastard; That, however much through this confession the proof had become more and more necessary, nevertheless all further elucidation failed to materialize, so that the petitioner found himself unable either to proceed toward acquittal against the bastard Hottentot Titus or toward condemnation against the slave Bastiaan, since for both the one and the other further indications were required, which had to be obtained not from the mutual confessions, but solely from further declarations; That the petitioner, having finally decided to have an act provisionally framed of the confession of the said slave Bastiaan, had him appear before the Commissioners, whereupon he discovered to his utter surprise that the same, far from acknowledging himself guilty of the aforesaid murder, on the contrary testified to knowing not the least bit about it, and to having made that confession solely out of fear of lashes, following what had been related to him by the Hottentot Titus; That therefore, since the latter also continues to persist in the negative, the petitioner in this doubtful case could not proceed without receiving some further light regarding what happened; while in the meantime the detention serves as a notable hardship for the aforesaid Titus and Bastiaan; especially since in this case no one can be specially summoned to give testimony of the truth, seeing that only the Field Cornet Jacobus Petrus Viljoen made a report of the body found; Wherefore the petitioner considers it his duty to turn hereby to Your Honors, and in all respect takes the liberty to propose to the same to instruct the aforesaid Field Cornet by letter on behalf of the Council to state before the Commissioners from this Council upon what grounds the accusation against the aforesaid bastard Hottentot Titus rests, in order thus to proceed further as shall be deemed advisable according to the findings; the petitioner requesting that the same Titus may be placed on Robben Island until the investigation shall be concluded, and the slave Bastiaan, as one of the most notorious runaways, may be returned to his master shackled in irons, under the condition of delivering him into the hands of Justice upon first demand. To the Honorable and Respected Gentlemen, President and Councilors of Justice of the Castle of Good Hope having been produced in the aforementioned capacity a representation concerning the slave Moses, belonging to the burgher Petrus Retieff, the contents of which were: Shows with proper respect the Landdrost of Stellenbosch and Drakensteyn Hendrik Lodewyk Bletterman That he, pursuant to the resolution of this Honorable Court attached hereto under No. 4, passed upon the report submitted by the undersigned on the 6th of the recently passed month of July, concerning the slave Moses belonging to the burgher Petrus Retief, having gathered the necessary evidence and examined the aforementioned slave before the Gentlemen Commissioners upon the complaint of the fellow burgher Daniel Johannes Rössouw, now has the honor to produce to Your Honors under Nos. 5, 6, 7 and 8, four depositions, together with the interrogatories answered and confirmed by that slave under No. 9, from the responses given to which it will be evident to Your Honors that the accused completely denies the accusation set forth in the report under No. 1, namely of having been very insolent, having resisted, and having drawn his knife; while moreover, as will have appeared to the Gentlemen Commissioners, he is scarcely able to express himself in an intelligible manner, and therefore cannot well be considered to be in a position to have shown any insolence in words to the said Rossouw. That furthermore, from the aforementioned depositions attached hereto under Nos. 5, 6, 7, and 8, it has appeared to the Honorable Representant that some private dispute between the aforementioned Retief and Rossouw gave cause to the vehement pursuit of the aforementioned accusation, and that for this reason, prudence ought to be observed as much as possible, in order not to make the aforementioned slave Moses the unfortunate victim thereof; especially since his demeanor on all sides seems to exhibit the most genuine marks of innocence; and in the opinion of the Honorable Representant, there is no sufficient evidence at hand to punish him. Reasons for which the Honorable Representant hereby turns to Your Honors, with the respectful proposal to restore the slave Moses to his master, the burgher Petrus Retief, upon payment of the costs; reserving to the same the right to take such action regarding the compensation of costs and damages as he shall be advised. Lastly, Attorney Wagener presented, as special attorney of Hester Helena Smit, wife and general attorney of the burgher Johannes Marx, the following petition: To the Right Honorable Oloff Godlieb de Wet, President, together with the other Honorable Members and Councilors of Justice of this Government. Right Honorable Sir, Honorable Gentlemen, Shows with due respect Your Honors' very humble servant, the attorney Jan Jacob Fredrik Wagener, in his capacity as special attorney of Hester Helena Smit, wife and general attorney of her husband, the burgher Johannes Marx. How two malicious slaves belonging to the aforementioned Johannes Marx, named Louinus and Valentyn, made a complaint to the Landdrost of Zwellendam, Mr. Anthony Alexander Faure, as if they had been mistreated, which has resulted in the said Johannes Marx being summoned by letter to appear in person before Your Honors' bench. Thus the Council, after examination of the documents and vouchers produced on the 5th of January last by or on behalf of the mentioned Landdrost, has declared this case compoundable and subject to settlement; with that stipulation, however, that the slave Louis shall be legally sold for the benefit of his master Johannes Marx, without ever again being allowed to come into the power of him, Marx, or his family; the settlement to take place before the Commissioners. Hereafter were brought to the table the memorial and accompanying vouchers submitted at the last ordinary court day by and on behalf of the merchant and Landdrost of the colonies of Stellenbosch and Drakensteyn, the gentleman Hendrik Lodewyk Bletterman, concerning the slave Moses, belonging to the burgher Petrus Retief, and since then circulated among the respective members for reading; Concerning which documents, now having been maturely deliberated, after consideration of everything that deserved any remark regarding this, the following decree was granted upon the one and the other: The Council qualifies the Landdrost to return the slave Moses to his master Petrus Retief; the costs incurred in this matter must be paid by the burgher Daniel Johannes Rossouw. Furthermore, the gentlemen Meyer and Truter having brought to the knowledge of the Council that when there had appeared before their Honors the burgher Johannes Jacobus Wuid on the one hand, and the fellow burgher Joachim Daniel Hiebner on the other, the first mentioned in order to swear to such declaration as was given by him in the proceedings of the Office of the Fiscal and the defendant Hubner; mentioned Hebner had on that occasion requested that the aforesaid Wuid should not be admitted to taking the oath, for reasons that he, Wuid, was alleged to have made himself guilty of a fraudulent way of acting, namely by appropriating to himself a horse which belonged to someone from whom he had alleged to have purchased the same, while however upon closer examination it had appeared that this purchase had never existed, and that their Honors, having suspended the taking of that oath, had deemed it necessary to implore the approval of this Council hereon; Thus, considering that in law no regard can be paid to unsworn depositions, and it was open to the defendant Hiebner to challenge the aforesaid declaration according to procedure, it was approved to authorize the Commissioners to proceed with having the oft-mentioned deposition sworn.
