302 Thus it was approved to hear the court messenger Ziervogel on this matter, who indicated that he had summoned the attorneys Wagener, de Vaal, and van der Poel, believing that they held a power of attorney for all the defendants in this case, without having known that attorney Vercueil was also acting in this case. The Right Honorable Plaintiff, before making his claim, requests that the defendant may be ordered in person to answer such interrogatories as shall be put to him on behalf of the Right Honorable Plaintiff. The defendant says it is well, but I request an eight-day postponement. The Council meanwhile grants the attorneys in their capacity the requested copy, to file a rejoinder or else renounce within two weeks from today. The interim fiscal Mr. Jacob Pieter Deneys, Right Honorable Plaintiff, against the person of Johannes Jacobus Heijdler, defendant, in order, pursuant to judicial decree of the last ordinary court day, to appear in person to hear such claim or request or requests as the Right Honorable Plaintiff shall see fit to make against him, the defendant, concerning and on account of the fact that he did not hesitate to incite some of his fellow citizens to seditious movements, on the occasion that the citizen Petrus Rens was placed in civic obedience, to answer hereupon and upon the appurtenances thereof, and further to proceed according to law. 303 The Council orders the defendant in person to answer before the Honorable Commissioners such interrogatories as shall be put to him on behalf of the Right Honorable Plaintiff. The deputy fiscal Mr. Joh. Ands. Truter, who acts in criminal matters for the Right Honorable Plaintiff, having indicated that when this matter was civilly initiated by the former Heemraad Cloete, he privately advised therein, therefore requests to be excused from serving herein now, and that it may please the Council to qualify attorney Wagener to produce the documents sent over by the Landdrost of Stellenbosch and to observe the terms for him in this case. The Council approves the qualification of attorney Wagener. The merchant and Landdrost of the Colonies of Stellenbosch and Drakensteyn, Hendrik Lodewyk Bletterman, Right Honorable Plaintiff, against the citizen Servaas Daniel de Kock, defendant, in order, in the case of assault committed against the slaves of the former Heemraad of Stellenbosch, the Honorable Hendrik Cloete, on the public roads, to hear the claim, to answer thereupon, and further to proceed according to law. Wagener, in accordance therewith, submits a written claim alongside five exhibits. Attorney de Vaal, assisting the defendant in court, says that he can adequately prove the defendant's innocence according to law, and requested, to minimize costs, that the claim may be read aloud and the matter thus settled summarily. Wagener declares that he does not possess sufficient knowledge of the case in question 304 and requests that the defendant proceed according to the ordinary style of procedure. De Vaal persists with his request. The Council grants the defendant's request to answer orally. Attorney de Vaal, having heard the claim, presents in response that the defendant's innocence is apparent both from the claim itself and the attached exhibits, as the responses of I. I. Swart to article 17 show that the slaves of Cloete drove the sheep of the defendant out of their pasture. That the defendant, having gone there for that reason, was insulted by the slaves of Cloete, as appears from article 14 of the same interrogatories, and that the defendant consequently struck them several blows with a cane. That the defendant's innocence is furthermore apparent from the answer to the question in article 30, wherein the interrogated person says that he can safely take the oath for his answers, but not for the questions. Wherefore the attorney for the defendant concluded for the dismissal of the claim with costs, and that the right may also be reserved for the defendant to initiate such an action against the denunciator as he shall be advised. Wagener, replying for the Right Honorable Plaintiff, says that the defendant not only molested the slaves on the public roads and scattered the cattle, but additionally committed hostilities at the dwelling house of the widow Badenhorst, and thus persists with the submitted claim. The attorney for the defendant, for the rejoinder, refers to the answer to the aforementioned interrogatories, article 25, from which it appears that the defendant only knocked at the house of the widow Badenhorst and asked if she was at home, and upon the answer of no, departed again, persisting further with his answer. 305 having heard the defense of the defendant, after deliberation of the matters, administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, condemns the defendant Servaas Daniel de Kock to a fine of ten Ryksd.s for the benefit of the Diaconate poor at Stellenbosch, with a serious recommendation to carefully guard himself against such conduct in the future; the Council further condemning the defendant in the costs incurred in this matter. The Deputy Fiscal Mr. J. A. Truter for the Honorable Official Plaintiff, produces an account of the slave Willem van de Caap, together with a sworn statement of the burghers Hendrik Vlok and Johan Christoffel Germenshausen, and a surgical certificate from the second Chief Surgeon Jan Godlieb Mader, and making his claim verbally, says that from the aforementioned submitted documents it appears that the defendant did not hesitate to strike the slave Willem van de Caap, belonging to his, the defendant's, mother who is now also present in court, with a spade or shovel in such a manner that his right arm was found upon examination to be smashed to pieces. The merchant and Landdrost of the Colonies Stellenbosch and Drakensteyn, Hendrik Lodewyk Bletterman, Honorable Official Plaintiff, against the burgher Jan Radyn, defendant, to hear the claim made verbally in this matter, that he, Sr. Radyn, struck and smashed the right arm of the slave Willem van de Caab, belonging to his father the burgher Jurgen Radyn, with a spade to pieces; to answer thereto and further to proceed as is lawful. And since such outrages cannot 306 pass unremarked, but on the contrary ought to be effectively redressed, he, the Honorable Official Plaintiff, has therefore deemed it his duty to summon the defendant before this Council. Concluding that the defendant Jan Radyn, by definitive sentence, shall be condemned to such punishment as this Council, according to the exigency of matters, shall judge proper in good justice. The attorney Wagener, assisting the defendant in court, says in answer that from the documents produced by the Honorable Official Plaintiff himself, it appears that the slave Willem is an insolent fellow who resisted the defendant, who is the son of his master; producing further, in order to show the Council yet another example of the insolence of the aforementioned Willem, a private statement from the burgher Lieutenant Albertus Johannes van der Poel; concluding, on the basis of all this, for the dismissal of the claim, with expenses. The Honorable Official Plaintiff replies that the insolence of the slave Willem can offer no motive, nor give the defendant any right, to maim him, and clearly persists in his claim. Wagener, for duplica, advances that the slave Willem, through his insolence, was the cause that the defendant intended to deal him a blow on the back with the spade or shovel he had in his hands, but that he, intending to ward off that blow, was thereby hit on his arm; that there is even found a contradiction in the surgical certificate and the account of the frequently mentioned slave Willem, as it is stated in the former that the arm was broken, and in the latter that it was crushed; but leaving this for what it is worth, he merely remarked further that if the witnesses Vlok and Germenshausen had not been present at the incident, the often mentioned slave Willem would probably have assaulted the defendant. The parties persisting in what they have put forward, renounce further submissions. The Council orders the defendant to have the submitted private 307 private statement officially executed and sworn before the secretary's office, further keeping this matter under advisement. Thereafter the pro interim Fiscal Mr. Jacob Pieter Deneys produced in Council a memorial with six annexes, the contents of which were: Shows with due respect the merchant and pro interim Fiscal Mr. Jacob Pieter Deneys: That from the accompanying documents it has become evident to the Honorable Official Remonstrant that the carpenter Carel Emmerik, discharged from the service of the Honorable Company, did not hesitate, on the 25th of the recently passed month of August, to purchase from the gunners Johan Michiel Gillis, Emanuel Hoekener, and Anthon August Dyke, presently detained in the Lord's prison for the theft of three stinkwood planks, the very same stolen planks, for a price and in a manner which, as well as the time and manner in which the delivery thereof occurred, should have sufficiently made him aware that the planks sold to him had come into the hands of the sellers by no permitted means, but on the contrary must necessarily have been stolen by them. 308 That the Officer Demonstrant, being unable for that reason to view the said Emmerik as anything other than a receiver of stolen goods, finds himself under the unavoidable necessity to uphold the rights of the High Government in this matter, and most respectfully to request Your Honourable Worships to grant him, the Officer Demonstrant, bodily apprehension of the aforementioned person of Carel Emmik in the said matter, in order to proceed criminally against him on that account, following a prior interrogation, as shall be found to be appropriate in good justice. After the reading of which and consideration of matters, the following decree was granted thereupon: The Council qualifies the Officer Demonstrant to have the carpenter Carel Emmerik, dismissed from the Honourable Company's service, taken into apprehension. The said Fiscal pro interim, Master Jacob Pieter De Neys, in compliance with the provisional resolution of 30 August last taken in respect of the slave Damon belonging to the burgher ensign Sebastiaan Valentyn van Reenen, having today produced in Council a declaration of Jan Diederik Brander, servant employed by the burgher Jacobus Arnoldus van Reenen, 309 duly confirmed and sworn; as well as a minute kept before the Commissioners regarding the examination whether any sign of the cut which the slave Arend stated in his account to have received on his neck might be discovered, reading as follows: Saturday the 22 September 1792 Present: Messrs. Johannes Smuts and Abraham Fleck. When the aforementioned Commissioners were sitting for the purpose of taking interrogatories at the requisition of the Fiscal's office, their Honours first caused Arend of Bengal, bondsman of the Commissioner of Civil and Matrimonial Affairs Jacobus Arnoldus van Reenen, to be brought in, in order, pursuant to the Council's resolution, to examine whether any sign was to be discovered on the neck of that slave of the cut which he stated in the account given by him to have received there: at which examination the Commissioners did indeed very distinctly observe on the neck of the aforementioned Arend a small mark as if from a cut caused by some sharp instrument, while their Honours also reflected, with regard to the nature of that cut, running diagonally downwards from the left to the right side, that if the repeatedly mentioned Arend lay on his back, turned slightly towards 310 the right side, he could then, in such a position, at the places stated by him, have simultaneously received the said wounds by the fall of one and the same instrument, in such manner as is evident. consideration of everything concerning this that merited further reflection, the following interlocutory sentence was pronounced in this matter: The Council, finding this case as yet not in a state to be definitively determined, places the respondents J: F: Dyssel and Hendrik Jonk on Robben Island, and orders the respondent Cornelia van Saven not to leave the Cape under penalty of apprehension, the Officer Prosecutor being enjoined meanwhile to initiate the appropriate proceedings with the utmost speed on and against the still fugitive Fredrik Dyszel the Younger. The defendant persists, on the grounds that he must summon witnesses for the next court day. The Council grants copy and a term of four weeks, to serve an answer at that time. After which, by the interim fiscal Mr. Jacob Pieter Deneys, with the submission of the documents and muniments relative to the extraordinary proceedings initiated against and concerning the detained carpenter Carel Emmeriks, it was made known that his honor, having heard the said Emmeriks before Commissioners on interrogatories, and finding on account of his given responses this matter not disposed to proceed extraordinarily against him, his honor might well permit that the said Emmeriks be admitted to an ordinary trial and allowed to appear by attorney, requesting at the same time that he, on account of his impoverished situation, may be served pro deo, and that an attorney be assigned to him for that purpose. Which request having been taken into consideration, the Council has condescended therein and thus admitted the detainee Carel Emmeriks to an ordinary trial, as well as permitted him, while making his defense from prison, to appear by attorney, to which end the attorney Wagener was assigned to him to serve him pro deo. The undersigned sworn Clerk, by order of the Honorable Lord President, brought to the Gentlemen Members of the Council for reading the following: Extract Resolution taken in the Council of Policy in the Castle of Good Hope, on Thursday, the 18th of October 1792. Having been received and circulated among the respective Gentlemen Members of the Council for reading and resumption, a missive from the Gentlemen Commissioners-General dated the 16th of this month, whereby Their High Nobilities—since it has been brought to Their highest notice that the Council of Justice of this government thought fit, by a certain apostille in the beginning of the year 1789 granted by them on the petition of Hendrica Ianssen, wife of the burgher Ian Smit of Dillenburg banished to Robben Island, to permit the petitioner or the aforementioned Ian Smit of Dillenburg, on account of such part of the sentence pronounced against him on the 22nd of November 1787 whereby he, Smit, was banished for five years to Robben Island, to compound with the Independent Fiscal of this Government, Mr. Iohan Nic.s Steven van Lynden van Blitterswyk, 324 and after the said composition to take up residence at this Principal Place to administer his affairs until the expiration of the time of his aforementioned confinement; and that the aforementioned composition was subsequently settled before Commissioners from the aforementioned Council for the sum of six thousand Rixdollars—request with the greatest speed all the documents concerning the proceedings held against the aforementioned Smit in the aforementioned case, and the cited composition with the consequences and attachments thereof; so it is that, in order to dutifully comply immediately with the just described request of the Gentlemen Commissioners-General, on the proposal of the Honorable Lord Commander, it was unanimously resolved by all the Gentlemen Members to demand from the Council of Justice, as is hereby demanded, to send to this Council in originali as soon as possible all the mentioned documents relating to the trial against and the composition with the frequently mentioned Ian Smit of Dillenburg, in order to enable this Council to supply the mentioned documents with all respect to Their High Nobilities at the earliest opportunity. 329 Cornelia van Saven, the citizen Fredrik Dyssel the younger, and the wagon driver Hendrik Ionk, who had been stationed at the Honorable Company's post De Schuur, had not hesitated, on the 18th of March last, first cruelly to mistreat the citizen Jacobus Minie and subsequently to beat his father Carel Minie to death in an utterly inhumane manner at the place of the said Ian fredrik Rykes Dyssel; the Officer of Justice considered it his duty to proceed, properly assisted, to the place where the crime had been committed, in order to conduct an inquest on the body of the slain Carel Minie, and further regarding the perpetrators, to exercise his office in such a manner as he should judge proper for the furtherance of good justice. That the Officer of Justice, having arrived at the aforementioned place, found the citizen Iacobus Minie truly mistreated and his father beaten to death, and therefore, after a summary investigation, attempted to take the perpetrators into apprehension, in which he also succeeded regarding the old Dyszel, his wife Cornelia van Saxen, and the wagon driver Ionk, which persons were subsequently sent toward the Cape and were brought to trial before Your Honorable Excellencies. However, that it was not possible for him at that time to get hold of the aforementioned citizen Fredrik Dyssel the Younger, who indeed played the principal role in this sad event; while even all efforts applied since that time have turned out to be fruitless; as the same Dyssel the younger, according to reports, has gone inland and carefully avoided all occasions that could have caused him to fall into the hands of Justice. Whereafter the same Deputy Fiscal, representing the Landdrost of the Colonies of Stellenbosch and Drakensteyn, gave notice that Mr. van der Riet, as Deputy Secretary of the Orphan Chamber, had addressed him in order to have handed over to the Orphan Chamber one male slave and two female slaves belonging to the citizen Albert Nel, who recently died intestate, against whom the said Landdrost had proceeded officially concerning the mistreatment of his wife; this trial, however, having remained undecided and the aforementioned slaves, being the accusers, having been placed in the Honorable Company's slave lodge; that he, the Deputy Fiscal, as far as the male slave is concerned, had not been able to comply with the desire of the Orphan Chamber, because he has since absconded; but that regarding the female slaves, who are currently still in the lodge, he hesitated to hand them over before having learned the pleasure of the Court in this regard, because the Orphan Chamber, administering the estate of the said Albert Nel, will sell the female slaves in question to the highest bidder, and thereby might possibly render illusory the dispositions which by this Court might perhaps be deemed necessary to take concerning the same female slaves, as having accused their master that he had caused the death of his wife; with the further request to be provided with the Court's order in this matter. It was made known to the council by the Honorable President that His Honor today, having received an extract resolution taken in the Honorable Council of Policy on the 30 of the recently passed month of October, together with a copy of a missive written by Their High Nobilities the Lords Commissioners General over the Netherlands Indies and Cabo de Goede Hoop on the 27 prior, with respect to the proceedings conducted here against the person of Jan Smit van Dilburg, and the composition entered into with the same, to which Honorable Council of Policy it was written; His Honor therefore, for the resumption and immediate compliance with the orders contained therein, had deemed it necessary to convene this extraordinary meeting at once. The aforesaid Extract Resolution, with the missive attached thereto, having been read and found to be of the following contents: Extract Resolution, taken in the Council of Policy in the Castle. 334 f 335 Tuesday the 30 October 1792 The Lords Commissioners General, having requested and received from this council all the documents regarding the proceedings conducted here on behalf of the fiscal office against the person of Smit van Dilburg and the composition entered into with the same, having taken the trouble to examine the same, and in doing so, to review and examine the aforesaid prominent matter in its entire context and true state of affairs. And the council subsequently having had to suffer the sensible displeasure, regarding that subject, of receiving the day before yesterday, the 28 of this month, an express missive from Their most mentioned High Nobilities, written on the 27 ditto prior, whereby Their High Nobilities, after succinctly setting forth Their most findings in this matter, express their astonishment that this government, in this case in which the Council of Justice, persuaded by the fallacious arguments used thereto by the Independent Fiscal Johan Nicolaas Steven van Lynden van Blitterswyk, Castle of Good Hope, on Blit 336 Blitterswyk, has so palpably exceeded its power, has made no use of the power entrusted to it to oppose and stop such; and further, after ripe and very serious consideration of this case /: of which Their High Nobilities say that it were to be wished that the past records of a body such as the Council of Justice in this Government had never yielded any example :/, declare the disposition of the Council of Justice of this Government dated 2 April 1789, containing authorization for the aforementioned Independent Fiscal van Lynden to be allowed to compound with the person of Jan Smit van Dilburg concerning the confinement of five consecutive years on Robben Island imposed upon him by sentence of 22 November 1787, as well as the act of composition itself, mentioned in the minutes of the said council of 6 April following thereupon, to be in themselves null and void, with the added order that the same shall therefore be canceled in the minutes of the aforementioned Council under both of those dates and this disposition of Their High Nobilities noted in the margin of the same; that furthermore, by the Independent Fiscal of this Government, Mr. Johan Nicolaas Steven van Lynden, there shall be refunded to the person of Jan Smit van Dilburg, his authorized agents, or Heirs, all that shall have been enjoyed by him by virtue of the aforesaid composition; 337 and in view of the impossibility that the sentence of the Council of Justice, insofar as the just-mentioned Smit is condemned thereby to a confinement of five consecutive years on Robben Island, can still be fulfilled; that the just-mentioned Smit van Dilburg shall immediately be taken to Robben Island, in order to remain confined there until the expiration of the aforesaid confinement, which shall be with the end of five consecutive years, to be calculated from the day of the pronunciation of the often-mentioned sentence, and that the further contents of the same sentence, concerning the banishment of the aforementioned Smit van Dilburg for the term of his life from this Land and the jurisdiction thereof, shall subsequently be strictly executed. From the examination which we found ourselves obliged to make of the documents regarding the proceedings conducted here on behalf of the Fiscal's Office against the person of Smit van Dilburg, and the composition entered into with the same, sent to us by your Honors by missive of the 20th of this month, upon our requisition of the 16th preceding, it has appeared to us that the said matter took place in this manner: That the aforementioned Ian Smit, having been summoned in person pursuant to a decree of the Council of Justice here, dated 26 July 1787, regarding the matter that he was said to have deliberately made himself guilty of the execution of a false declaration, was subsequently placed first in civil custody and, upon another decree of the aforementioned Council dated 15 November following, into criminal imprisonment, after a request from the accused's wife, that the offense committed by him might be declared civil and composable, was rejected on the same day. That subsequently, by the pro tempore fiscal of that time, Gabriel Exter, a demand was made in a criminal case against the said Ian Smit and concluded for flogging and a lifelong confinement on Robben Eyland, but that the Council of Justice, by its sentence of 22 November 1787, rendered upon the confession of the detainee, declared the same to be infamous, and further condemned him to a fine of one thousand Rixdollars to be divided according to custom, and confined for the time of five consecutive years on Robben Eylande, together with, after the expiration of the said five years, banishment for the term of his life from this country and the jurisdiction thereof, with condemnation in all the costs of the trial, etc. That the aforementioned wife of the said Ian Smit subsequently, in the beginning of the year 1789, addressed herself by petition to the Council of Justice, with the request, as the petitioner expresses herself therein, that the punishment imposed upon her husband by the aforesaid sentence might be reduced and the Independent Fiscal authorized to compose with the same regarding the further punishment for the execution of the aforesaid sentence; that this petition, having been placed by apostille of 2 April 1789 into the hands of the Independent Fiscal Mr. Iohan Nicolaas Steven van Lynden van Blitterswyk, in order to serve with his considerations thereon, and having been complied with by the aforementioned Fiscal, the Council subsequently, by a further apostille on the aforesaid petition, granted the request made therein to the extent that her husband, the aforementioned Ian Smit van Dilburg, was permitted to compose with the aforementioned Independent Fiscal regarding such part of the frequently mentioned sentence as by which a confinement of five years on Robben Eylande was imposed upon him, Smit, and after the said composition, for the administration of his affairs, to take up residence at this principal place, with the understanding nevertheless that he would not only not be allowed to carry on any burgher trade, nor be regarded as a burgher, but also, as is further stated therein, since he, Smit, by the said sentence of 22 November 1787, was at the same time banished forever from this Government and the jurisdiction thereof, he would have to be sent away from here after the expiration of the aforesaid five years; while furthermore the Fiscal's Office was authorized, during the stay of the said Smit at this place, to have a close watch kept on his conduct here. However, that the then President of the Council, Iohannes Izaak Rhenius, was of the opinion that the aforesaid request could not be granted to the petitioner, but that the petitioner ought to be referred to the government of this place, in order to request from the same that her petition, insofar as it concerned the release of her husband from his confinement on Robben Eyland, might be transmitted with the support of the said government to the High Indian Government in Batavia, and made this his view evident by a reasoned opinion inserted in the minutes of the Council of Justice of 2 April 1789. 342 between van Blitterswyk on the one hand and the aforementioned Jan Smit of Dilburg on the other hand, an agreement has been entered into according to which the said Smit was to pay and deliver to the aforesaid Fiscal in three months' time the sum of six thousand ryksdaalders of eight and forty stuivers, it being recorded therein that this period having he Smit also promised to conduct himself quietly and properly, as well as thanked the Gentlemen Commissioners for the mitigation granted to him, but without it being expressed therein what that favor or mitigation actually consisted of, which may perhaps also have given occasion to the misconception in which the aforementioned Smit, as appears from a petition presented by him to us, seems to have traded, as if the same also extended to the perpetual banishment imposed upon him. This is the true state of an affair of which it were to be wished that the records of a Body such as this of the Council of Justice in this Government had never furnished any precedent, an affair of such nature and importance that however much the High Government of the Indies already appears to have taken an interest in it, we nevertheless deemed it necessary, without awaiting the outcome thereof, immediately to take such measures whereby the laws may be restored their impeded effect, Justice its offended prestige, and the High Authority its violated authority without 343 delay. The principle laid down by the President Rhenius as the foundation of his opinion, "that a definitive sentence once delivered and pronounced according to law cannot and may not be revoked, altered, amended, increased, or diminished by that same judge who pronounced the condemnation and whose office, through the pronunciation of the sentence, immediately ceases in respect of the adjudicated case"—this principle, we say, is so clear, simple, and resting as well on sound reason as on the very first and generally known grounds of law, that it appears incomprehensible to us by what reasons the Members of the Council of Justice could have allowed themselves to be carried away so that, losing sight of the same, they lent a hand to a composition whereby one sees a confined exile appear free and unhindered before the eyes of his fellow citizens, in order, after he shall have passed the most severe part of his punishment, as it were without punishment, in the midst of society, to subsequently undergo once again that part whereby he must be removed from the same forever as a harmful and dangerous fellow member—a matter which clashes so strongly with all notions of law, propriety, and good order that it is, we repeat it, incomprehensible how so many judges could have allowed themselves to be persuaded to lend a hand to it against the reasoned opinion of the President. Indeed, we can hardly deem it possible that they took into consideration the sophisms by means of which the Independent Fiscal van Lynden attempted, in his opinion of 27 March 1789, to recommend that composition, but the insufficiency of which shows itself as if of its own accord upon the very first examination. For as regards the unfortunate and moving consequences which in such cases always rebound upon the wife or family of the condemned, the advanced years to which this man had already climbed, the awareness that he had previously not engaged in other crimes, and the probability that he would not in future allow himself to be used for new ones—these may, even in the course of a criminal trial, be considered as nothing other than arguments to arouse pity (if indeed it can be true that gray hair approaching the grave, when it premeditatedly stains itself with crimes, deserves more pity than thoughtless youth); they may have not the slightest influence on the verdict of the judge where the crime is proven and the law speaks clearly; they were moreover, as well as several other reasons adduced in the aforesaid report to make the committed crime appear lighter, already in existence during the examination of the case and even considered, but then also already judged insufficient by those same judges to declare the offense civil and composable, as appears from the decision of the Council of 344

345 of 15 November 1787, taken upon the petition submitted for that purpose, indeed one may trust that all such consideration was given to it by the judge as it might have deserved, when in the final sentence the punishment, in comparison with the claim of the fiscal office, was so considerably mitigated, as appears from what was cited hereinbefore; and how could such arguments then serve now, we shall not even say to justify an act for which the Council of Justice at least had no power or authority, and which was truly an infringement upon the sovereign Authority, for whose inviolate preservation it ought in the first place to have watched, but even, that authority being assumed for a moment, to be regarded as plausible grounds to remit or mitigate the most notable part of the imposed punishment. And concerning what was further adduced by Fiscal van Lynden, that this act was supposed to have been justified by a precedent, consisting in this: "that at the time of the last-waged war, a general reduction of the years of their banishment had been granted to all the exiles confined on Robben Island, and thus indeed a pardon or mitigation of the punishment imposed on them by the judge had been granted to them"? Ought not the Council of Justice not only to have understood the heaven-wide difference that existed between that case and the present one, the former having been an act of the government in a critical moment 346 and urgent necessity, done to increase or strengthen the means for general defense against a formidable and hostile attack; but also to have investigated and examined that same case in all its circumstances, whereupon it would very soon have discovered that, presented by Fiscal van Lynden entirely erroneously and in a false light, it ought rather to have served to deter it from similar acts than to make the same appear to it as lawful. It is indeed true that on 2 April 1781 your Honours resolved to have a promise made to the European exiles confined on Robben Island, that in case they should conduct themselves faithfully and properly at the places where they would be employed, they would then be relieved of their further banishment, and that not only, as is added in that resolution, "in order to still have some service from these people on the ships or elsewhere, where it might be deemed best to place them, but also not to be embarrassed with their custody"; but it is no less true that this disposition of yours, having come to the knowledge of the High Government of India, was disapproved by it in its missive of 11 October 1782 in the following emphatic manner, the said government saying therein literally: "We must now note having been very displeased not to have perceived in any of your letters the result of your resolution dated 2 April 1781, concerning the retrieval of the exiles on Robben Island, just as it has also surprised us to find added thereto a promise of release planned by that same direction to the European convicts, in case of good behavior at the place of their destination, since the granting of such public pardons and releases went beyond your 347 power and authority, and only a promise of recommendation could have been made to us, upon which we, in the present circumstances of the times, according to the nature of the crimes, would have given all equitable consideration." And since it is impossible that the aforementioned sentence of the Council of Justice, insofar as the aforementioned Smit was thereby condemned to a confinement of five consecutive years on Robben Island, can be fully served any longer: that the aforementioned Smit of Dilburg shall immediately be transferred to Robben Island, there to remain confined until the expiration of the aforementioned confinement, which shall be at the end of five consecutive years, counting from the day of the pronouncement of the aforementioned sentence, and that the further contents of the same sentence, concerning the banishment of the aforementioned Smit of Dilburg for the term of his life from this country and the jurisdiction thereof, shall subsequently be strictly executed, whereby this matter shall be concluded, and notice thereof shall be given by us to the High Government of India, to the end that the original documents belonging to the aforementioned proceedings shall be sent back here by them. 353 Under submission of two declarations, one passed by the sailor Daniel Blom and the other by the burgher Iohan Hendrik Genade and the sailor David Leonard, the honorable official plaintiff makes his claim verbally against the defendant presenting herself before this council, in the following manner: From the documents that the honorable official plaintiff has the honor to produce to your honors, it appears that the defendant has made herself guilty of the retailing of wine bought from private wine merchants, without permission of the general lessee. The honorable official plaintiff has caused her, the defendant, to be summoned before your honors concerning this contraband trade and concludes that she shall be condemned to the fine of ƒ1000 stipulated by the general proclamation, and in case of inability to pay, that the defendant shall be condemned to be placed on bread and water for the space of fourteen days, with costs. The defendant, assisted by the attorney Vercueil, requests a copy of the submitted documents, in order to serve her answer two weeks from today. That Captain Lieutenant Hendrik Weehmeyer, assigned to the Honorable Company's ship Makassar, as appears from the annexed declarations and further documents, has not shrunk from conducting private trade, notwithstanding the strict orders issued against it, and successively offloading several picols of coffee beans from the aforementioned vessel, which was partly laden with that product for the Honorable Company; whereby the honorable official petitioner sees himself brought under the unavoidable obligation to initiate criminal proceedings against the said Hendrik Weehmeyer and to that end have him summoned in person before your honors. That, seeing that the aforementioned Cornelia van Saxen has presented herself almost daily at the house of the petitioner and, shedding tears, has made known that she could no longer find her necessary sustenance at the Cape, and as an old and decrepit person could not earn her living by the work of her hands; that furthermore, the little she still left behind on her farm in the Colony of Zwellendam was placed under the supervision of a person who would be paid for this monthly out of the estate; she was therefore reasonably fearful of being plunged into the utmost poverty, and that the little she still possesses in the world would be entirely lost, with an urgent request that the petitioner, as her attorney assigned by Your Honorable Worships, would inform Your Honorable Worships of her pitiable circumstances; so the petitioner respectfully turns to Your Honorable Worships with a humble prayer that it may graciously please Your Honorable Worships that the aforementioned Cornelia van Saxen may be released on bail under solemn pledge, under pain of confession and conviction, and that she be permitted to go out to the country to her dwelling place, in order to have her farm worked under her supervision, and by that means to avoid and prevent the extreme poverty and want that she currently suffers.
