that the appearer, Christiaan de Kale of Cimpelo, of age, who at the requisition of the pro interim Fiscal here, the Honorable Gabriel Exter, declared the truth to be, that the appearer, who is in service as a servant to the widow of the late Lieutenant-Engineer Pieter Cloete, went to the warehouse of the Council-Master Pieter Laurens Cloete about fourteen days ago, without however being able to state the exact date, and then approached the burgher Johannes Baerends, who was standing on his porch. That the said Baerends spoke with the appearer about these and no other matters, and subsequently said that he bore a grudge against the servant of the said Pieter Laurens Cloete, named Moulin, and that if he should meet him alone on the street, he would beat his arms and legs to pieces; whereupon the appearer answered him that this would not be so easy, and from there went back to the warehouse and warned Moulin of this. That the said Moulin said afterwards that he would go over there, since the said Baerends still owed him 12 rixdollars for 2 half-aams of wine, in order therefore to settle accounts with him, and then went there in person. That when the aforesaid Moulin came out of the house again about a quarter of an hour later, the said Baerends followed closely upon him and, while essentially saying: what a miserable fellow I am?, grabbed him, Moulin, from behind by the hair, pulled him to the ground, and kicked him in the face with his feet for so long until the said Moulin was picked up by Frans Jurgens, brother-in-law, as well as Elisabeth Baerends, sister of the aforesaid Johannes Baerends, both of whom were there at the call of the said Jurgens; the aforesaid Moulin immediately having returned to the aforesaid warehouse with a black and blue kicked face, while the appearer testifies that he only stepped in to prevent further blows in the public street, and not to come to the aid of the said Moulin. Declaring nothing more, the appearer gives as reasons for his knowledge as in the text, being prepared, if required, to confirm the foregoing further with a solemn oath. Below stood: Thus passed at the Cape of Good Hope, the 21st of September 1788, before the Honorable Salomon van Echten and Johannes Smits, members of the Honorable Council of Justice, who, together with the appearer and me, the sworn clerk, duly signed the original hereof. There appeared before us, the undersigned commissioners from the Honorable Council of Justice of this Government, the soldier Christiaan Kale, who, this his foregoing declaration having been read to him word for word, clearly, distinctly, and verbatim, affirmed that he persists therein, with the desire that nothing more shall be added to or taken from it, and has therefore, in confirmation of the truth thereof, in the presence of the burgher Jacobus van Leeuwen as attorney for the burgher Johan George Baerends, spoken the solemn words: So truly help me God Almighty! Honorable Gentlemen, The undersigned, having been summoned to court by the plaintiff in the name of the Sovereign on the date of 27 October of this current year, in order to appear as stated in the citation and in obedience thereto, requested a copy of the claim submitted by the plaintiff in the name of the Sovereign, which, having been granted through the equitable and impartial administration of justice of Your Honors, according to your much respected disposition dated 30 October of this year, finds himself obliged on that account to express his most respectful thanks to the same, as the path was thereby opened to him which naturally leads to the demonstration of the groundlessness of the conclusion drawn by the plaintiff in the name of the Sovereign. For even if the defendant, namely having been aggressed upon and provoked, had offended against a person of an entirely different conduct than the one reported, His Honor would truly not have been able to draw so severe a conclusion regarding the case in question, His Honor having pleased not only to conclude to a fine of 1000 guilders, to be divided among the poor, the church treasury, and the lord plaintiff, but also that the defendant should be placed on bread and water and locked up for the period of three weeks, quasi for this fallen person. had made an introduction concerning the defendant's quarrelsome disposition, which is always inclined to dispute. Having mainly confined himself to the foundation of this alleged violence: Firstly, that while the relator had come to the defendant to settle his account with him, the latter on that occasion saw fit to follow the relator out of the house onto the street. Secondly, that the defendant grabbed him from behind by the hair, threw him down to the ground, and furthermore struck and kicked him with his foot on the head and in the face in such a manner that it was black and blue and the head was completely swollen, and seeks to prove this with the submitted statements. Thirdly, that the defendant consequently made himself guilty of an actual, committed injury and very far-reaching assault. However, in order to expose the groundlessness of the instituted action in full daylight, the said defendant finds himself necessitated, firstly, briefly to premise a bare narrative of the true circumstances from which this dispute arose, and then to let follow a true description of the quarrelsome disposition of the relator. And in the second place, to destroy the claim of the plaintiff in his official capacity, to bring under examination to what extent the same is founded in the laws, and whether the defendant is guilty of the crime of injuries, and on account thereof has rendered himself punishable, whereby the defendant will most respectfully claim the precious attention of your Honorable Worships, to which narrative one will proceed in this manner: That some time ago it happened that the complainant, finding himself in need on a certain occasion, requested the defendant to lend him a shirt. The latter, finding difficulty in consenting to this request, finally allowed himself to be persuaded by the repeated entreaties of the first-named, yet under the express condition that he should return it directly upon his return. Thereupon, the defendant ordered his wife to send one of his better shirts, who, being dissatisfied with this, was finally forced to send a superfine shirt to that applicant, who also received it under the aforementioned condition. That the complainant in this case, seeing the charitable willingness of the defendant to help his fellow man, at the same time also requested to lend him, the relator, a book under the promise of return, with which the defendant was satisfied and had sent the same to him; That the defendant's wife, having sent a request some days later for the borrowed shirt, the complainant, instead of fulfilling his promise and returning the borrowed shirt as fairness required, saw fit to send an old, worn-out shirt, which she, as is naturally understandable, being unable to accept, had returned; That thereupon the same came to the house of the defendant, and having asked for the reason of this return, and having received the appropriate answer thereto, began to fulminate, saying essentially: damn it, what the thunder can I do about that, that is the fault of that damned washerwoman; do you think that she alone has such shirts, I can easily desire better ones. the conclusion taken in this regard, wherein this matter is to be dealt with at large, to be in accordance with the practice or style of the Courts. But much rather one might maintain that this case was presented to his Honour entirely wrongly, as will further appear in the treating of this matter, and will be substantiated with reports. And thus it is not to be wondered at that the Lord Plaintiff, observing this; Art 2, seems to have condemned the defendant as suspect, and guilty of the crime of real injury. That the Lord Plaintiff, respectfully said, ought not to ignore the words which are customary in all impartial courts of justice: audi alteram partem, heard and examined. Which Your Honourable Worships will be able to notice at first sight, positing to that end that the defendant is accustomed to have quarrels, or to fight for nothing, which the Lord Plaintiff seems to impute to the defendant at Art 45, to have been known for that for several years, and thus his Honour seems to be sufficiently convinced himself of the invalidity of his proofs. Yet although the defendant, if it were permitted, would lack no material to answer for the oath concerning that case and perhaps also still justify it on good grounds, he will, in order not to fall into odious matters, refrain from doing so and only reflect: That the Lord Plaintiff contradicts himself, since it is confessed that the complainant came to the house of the defendant for payment of his bill, and the defendant had offered to pay him, as appears from No 2. Thus it is naturally to be understood, Honourable Worshipful Sirs, that the accuser ought to have contented himself with that, without however being qualified to commit such insolences at the house of the defendant. Just as the complainant repeatedly, with the citizen Hermanus Ehlers, and under the least reasons given thereto, has been guilty of kicking and hitting, nay what is more, throwing entire households into turmoil, as appears from No 3. And consequently one ought then to seek the difference only therein: That the complainant is still thus protected, and the defendant has been prosecuted at law upon the slightest presumption. Therefore it must be taken into consideration here that, just as it is a crime of commission to do something unlawful, says the Lord and Master Johannes Voetman in his treatise on crimes, page 2, so it is surely also a crime of omission, says that same gentleman, to permit, namely when one can prevent it, that it be done by others. And consequently a valid proof that the defendant, who was challenged by the accuser in his own house, and annoyed by far-reaching injuries and insolences, throwing the same out of the door, has not made himself guilty of the least crime, much less of a public crime, just as the lawyers state that that in which no open deceit or evil intention is mixed cannot be punished as a crime, leg. 1. ff. ad leg. Cornel. de sicariis, tit. inst. de famili. furt. fec. dicatur. Therefore one shall step down from this first point now to the further consideration of the main grievance and proceed to the second, and reflect: Where the Lord Plaintiff posits at Art 10 that the defendant wished to profit from that occasion; and Art 11, as he had already declared beforehand to bear envy towards the complainant, and in case he, the defendant, would beat his arms and legs to pieces, which merit no refutation. For had the defendant already declared such beforehand, that if he found the same, namely alone on the street, he would beat his arms and legs to pieces, there is no reason why he should have waited for the occasion to execute that pretended threat until the same came to molest him in his house and on his own ground in such an insolent manner, and thus it presents yet again a notorious contradiction. And besides that, the Lord R.O. Plaintiff is indispensably obliged to demonstrate and prove these previously made pretended threats in an admissible manner, according to the general practicable maxim accusatori incumbit probatio et actore non probante reus absolvitur ab illa instantia. ...named witnesses, the sailor Johannes Oostenburg, of competent age, under the below-stated pay, who, at the requisition of the burgher Jan Barends, declared it to be true: That the deponent, who resides with the burgher Frans Jurgen, on the very same day that—as was related to the deponent—the requisitionist was said to have beaten the servant in the wine warehouse of the fire-master C: Kloete, spoke toward the evening with the said servant, named Moulin, in person in front of the door of that warehouse; yet he was then unable to perceive, on the said Moulin, who wore no hat on his head, either on the face or on or before the head, any injury, scratch, or mark whatsoever; the deponent testifying to have seen the aforesaid Moulin on the following day, being a Sunday, passing by the door of the aforesaid Jurgens with two other persons, one of whom was the carpenter Keetel, and to have been greeted by the same Moulin, who properly wore a hat upon his head. Justice of the Castle of Good Hope, present the afternamed witnesses, the slave Svanibal, belonging to the burgher Arend de Waal, who at the requisition of the burgher Iohannes Barends declared it to be the truth: That the deponent, who had been rented out to the burgher Barends, or the requester in this matter, on an afternoon without being able to specify the exact date, was present when a certain Moulin, servant in the warehouse of the Fire Master Pieter Laurens Kloete, having entered the house there, after a great deal of altercation which the deponent did not understand, finally in substance said: "You are a bad fellow, and if you are a man, come outside then"; whereupon the requester immediately followed him to the front of the door, and that said Moulin was thereafter given some thrusts and blows outside the door, without any resistance being offered by Moulin; whereupon his neighbor Jurgens jumped in and prevented the requester from striking Moulin further, who then also immediately went back across the door into his warehouse. That the aforesaid Hottentot woman Dilla, having thereupon inquired of the often-mentioned small Hottentot Hannis as to the cause of the death of the same Hottentot girl Lena, learned from him in the appearer's presence that he, Hannis, had beaten the same Hottentot girl Lena with a lath for breaking the aforesaid small bowl, and thereby among other things caused a hole behind her ear, and that in addition, when his stepfather Wittebooy had come home with the cattle, the same Hottentot girl Lena had on that account received three blows in her side from him with a piece of firewood. The appearer testifying to have inspected the body of the same Hottentot girl Lena together with the aforesaid Hottentot woman Dilla, and to have found that the entire body was bruised and severely battered, and the often-mentioned Hottentot girl Lena had received a wound behind the right ear; the appearer, after having buried the corpse of the aforesaid Hottentot girl Lena with the help of the above-mentioned Wittebooy, Hannis, and a certain Hottentot of Jacobus Rossouw named Stoffel, who had just arrived at the place to search for horses, made all of the foregoing known to the burgher Pieter Ter Blanche upon his arrival at the place of the same Ter Blanche. Appeared the Hottentot Claas of competent age, who, at the requisition of the Landdrost of Stellenbosch and Drakenstein, Mr. Hendrik Lodewijk Bletterman, declared to be true and truthful: That he, the deponent, in the month of December of the past year 1788, after his term of service with the Field-Cornet Pieter Jacobs, residing at the Heer Rivier, had expired, and having then, towards the end of that month, returned to his kraal situated behind the Heer Rivier, upon his arrival there learned from a certain fellow Hottentot named Boebezak that the deponent's sister's child named Leentje had been so beaten and mistreated on one of the cattle posts of the burgher Wouter de Vos by the Hottentot Hannis and his father named Wittebooy, that she died the following day; that this had happened because the said child had dropped a bowl, which was broken as a result. Upon which report, the deponent immediately went to the aforementioned Wouter de Vos and communicated what had occurred; whereupon the latter, having sent his stepson Jacobus Hugo thither, had both Hottentots apprehended and brought to the farm of the aforementioned Wouter de Vos. That they, having then been questioned by the said de Vos as to the reasons for that beating to death, immediately confessed that this had occurred over the breaking of a bowl, and that first Hannis had so battered the child with a lath, and afterwards his father with a kierie, that death ensued. Item 14. If one simply examines the definition of public violence and compares it with the case in question, then one must determine without reservation 15. that the defendants have fallen within the terms of the Julian law of public violence and thus were properly and justly sued criminally. 16. For according to this law, all violence must be punished by which public security can be considered to have been violated in the highest degree, whether such was committed against a public person, by a public person, whether by armed force, or finally with the help of persons summoned together for that purpose. 17. Your Honours can find this definition in Westenberg in his Compendium ad titulum Digestorum de vi publica paragraph 32, together with Law 10 paragraph 1 of the Code on the same title. 18. Simon van Leeuwen, in his Roman-Dutch Law, 4th Book, Chapter 36, paragraph 1 near the end, expands this crime even further when, speaking of public violence in the cited passage, he says: 19. "This crime is actually considered to be committed when someone is assaulted with violence in order to rob him of what is his, whether with weapons or without." 20. The defendants therefore, having by armed force—namely with picks and spades—and with the help of persons summoned together for that purpose, opened a watercourse on another's land, not only against the will and without the consent of the owner, but even against the sentence of Your Honours, Article 21. have also made themselves guilty of committing public violence and must consequently, as such, be punished as an example to others. 22. And this applies not only to the prime instigator Pieter Cilliers Jansz, but also to the other defendants, as they deliberately allowed themselves to be used to assist and help carry it out, and are thus guilty of the same crime. 23. Although it has appeared to the Prosecutor—subject to correction—that the prime instigator Pieter Cilliers Jansz, as the causa movens of all that occurred and who, as far as is known, alone enjoyed the benefits thereof, has merited a heavier punishment than his accomplices. 24. But as to the punishment itself, it is true that it was determined according to written law; 25. but nowadays it is arbitrary, so that it is left to the judge to determine, in a case of public violence, in accordance with the analogy of the law, such punishment 26. as the nature of the matter and especially the confluence of other crimes, as often happens in cases of violence, should come to require. 27. Appeared before me, Willem Stephanus van Rijneveld, sworn clerk at the Secretariat of Justice of the Castle of Good Hope, present the hereinafter named: the citizens Daniel Roux Paulusz and Johannes Bartholomeus de Kruger, both of competent age, who at the requisition of the former deacon of Drakenstein, Senior Daniel Rossouw, declared it to be true: That the appearers, being also the nearest neighbors of the requisitor, having been requested on the first of December last on behalf of him, the requisitor—since it had come to the requisitor's ears that the citizen Pieter Cilliers Jansz, intentionally assisted by several inhabitants, contrary to the verdict rendered by the Honorable Council of Justice, intended to divert the water to his property—therefore to come to the requisitor's farm, in order that, if any acts of violence should be committed by the said Cilliers and associates with respect to him, the requisitor, they might then have knowledge thereof and bear witness. That the appearers then also, on the following day, being precisely one of the days on which the requisitor, pursuant to the above-mentioned verdict, should have use of the water in question, had proceeded to the farm of him, the requisitor, and immediately upon their arrival there learned from him, the requisitor, that Cilliers had sent him word that he would come with friends to dig a trench. That the appearers, on the same morning at about three o'clock, having seen several persons coming from the yard of the aforesaid Cilliers, who immediately proceeded to the land of the requisitor, the appearers then, with and alongside the requisitor's children and the citizen Bernhardus de Vaal as this requisitor's authorized agent, went to meet the aforesaid persons; the said persons consisting of 15 Christians and 24 slaves, which slaves, all being provided with picks and spades, were already upon the appearers' arrival at the place where they found themselves, on a piece of land where the sheaves of the requisitor's cut rye were lying, busy digging a trench. That thereupon the aforesaid de Vaal, having motioned with his hand to the said slaves that they must stop working, which was also done by some of those slaves, and in the meantime the aforesaid Pieter Cilliers and his company, who were then still with the rearmost slaves, having come closer, the citizen Daniel Rossouw Danielsz, stepping forward impetuously, called out to those slaves with a loud voice: What is that there!
