Today, 7 January 1789, Appeared before me, Willem Stephanus van Rijneveld, Sworn Clerk at the Secretariat of Justice of the Castle of Good Hope, in the presence of the after-named witnesses, Adam of Mozambique, bondservant of the burgher Pieter Cilliers Jansz., of competent age, who, at the requisition of the burgher Daniel Rossouw the elder, declared it to be true: That the deponent, frequently, without however knowing how many times, had been ordered by his master, after the latter, with various other persons, had caused a ditch to be cut from the place of the requester to the ground of the deponent's master, to breach the ditch in the evening around eight o'clock, and precisely on those days on which, as the deponent knows very well, the requester had to make use of the water, and to divert the water through that recently made ditch to the ground, although the same cannot by any means reach, but hardly halfway, the ground, near a hill standing there; The deponent had then also always done this, until the most recent New Year's Eve, when the deponent, being there again occupied in the manner aforesaid, was taken prisoner by two persons, transported to the place of the requester, and subsequently brought over hither. Attesting that no one there at the requester's did him any harm on that account. Declaring nothing further, the deponent gives as reasons for his knowledge as in the text, being prepared to maintain the foregoing further. Below stood: That this thus took place at the Secretariat aforesaid in the presence of the clerks Willem Bergh and Jacob van de Waereld as witnesses, who have duly signed the original of this along with the deponent and me, the sworn clerk. Honorable Sir, Honorable Sirs, With due respect, your Honors' very humble servant, the undersigned burgher Bernhardus de Vaal, as authorized agent of the former deacon of the Drakenstein congregation, Sr. Daniel Rossouw, makes known: How, by definitive sentence of your Honors passed on the date of 2 February 1788, the dispute in the case of appeal between the undersigned's principal and the burgher Pieter Cilliers Jansz. was decided in such a manner that the appellant Daniel Rossouw may use the water in question four days a week and the respondent Pieter Cilliers only three days, and the latter, note, solely for his place named Zoetendaal, without being permitted to lead the aforesaid water anywhere else. That the undersigned's principal, in dutiful obedience to the judgment of your Honors, from that moment on, on the days determined for Cilliers, namely from Friday morning at six o'clock to Monday morning at the same hour, has let that stream flow unhindered to the place Zoetendaal, with a written offer to restore good neighborliness. However, That since the said Cilliers, having always attempted not to lead that stream to his place Zoetendaal, but to the side or to his ground lying between the two places; as the undersigned has had the honor to submit most respectfully in his written statement of claim in the case of appeal

to bring to the eyes of your Honorable Worships, now seeing that this purpose of his had been frustrated by the said verdict, immediately put into effect everything that seemed possible to render the same verdict illusory, in which, as it seems to the undersigned, he has nevertheless not succeeded. That the undersigned, in the night between 30 November and 1 December of the past year, was informed by a letter from his principal that he had heard by rumor that Pieter Cilliers Jansz., with several of his blood relatives, intended the following morning together to divert that little stream over a flat ridge, straight away towards the property of Cilliers, requesting that the undersigned would come to him that very night to assist him with his good counsel against such wantonness, if the same should be committed. That the undersigned, having thereupon proceeded as quickly as possible to his principal, waited there for some hours in vain for the outcome of that rumor, until in the afternoon, Cilliers informed Rossouw that he, with the friends, would come early the following Tuesday morning to make up his trench. That the undersigned in his capacity thereupon wrote to Cilliers that he and the friends should be well mindful of the consequences of committing hostility on someone's land, while the undersigned would endeavor to guard against such nuisance by appropriate means. That the undersigned, now convinced of the certainty of the undertaking and being unable to obtain a messenger through whom to legally protest against the execution of such a lawless act, requested on his principal's behalf as witnesses to his side the citizens Daniel Roux Paulsz. and Johannes Bartholomeus Kruger, as appears from their concordant declaration given at the secretariat of your Honorable Worships, as well as re-examined and sworn to. That on the aforementioned second of December, being one of the days on which the principal of the undersigned had the use of that little stream, around eight o'clock in the morning several persons came from the property of the aforementioned Cilliers, who immediately proceeded to the land of the principal of the undersigned, and that then the undersigned, with and beside the deponents as well as the eldest son and son-in-law of the principal petitioner, went to meet those people, counting as they approached fifteen Christians and twenty-four slaves, provided with picks and spades; who, arriving on a piece of land of the principal of the undersigned on which the cut sheaves of rye were still lying, immediately occupied themselves with making a trench, according to paragraph 2. That thereupon the undersigned indicated to the same slaves with his hand that they must stop working, which was also done by some of those slaves, they being, as it seemed, convinced among themselves that on another's property they were not authorized to perform anything of that nature, while in the meantime the aforesaid Cilliers and his company, who were still with the rearmost slaves, came closer, at which point the citizen Daniel Johannes Rossouw Danielsz. stepped forward passionately and called out to the same slaves in a forceful voice, what is going on there; stay at work: as appears from paragraph 3. That the undersigned, judging it necessary to demonstrate publicly that the right and power of his principal extended to commanding or forbidding work on his own property, which latter was absolutely the case in the present instance, thus asked those people in substance, friends, who gives you the order to make a trench on the land of my principal, whose order is it, whereupon it was immediately answered by several present there, all of us together, according to paragraph 4. That the undersigned, too firmly assured of the impossibility of stopping this work, and on the other hand not unaware of the lack of authority to oppose the same with force, since in all well-ordered kingdoms and republics this is the task of the supreme authority or the courts of justice, then took out of his pocket the copy of the verdict of your Honorable Worships, and after having read the same to those persons, in substance said to Cilliers, you are acting contrary to the verdict, for the water runs to the farm Zoetendaal, and you are now diverting it aside from your property, continuing further in a commanding tone: I kindly request you all to cease this work on the land of my principal, and to go away, all of you with your slaves. To which the undersigned received as an answer, that we will not do, but we shall make the trench, for it is not your land; Cilliers then still adding thereto in substance, I must have the water according to the verdict of Stellenbosch, whereupon the undersigned then repeated this request two more times, as appears from paragraph 5. That the undersigned, now seeing that he made no progress, found himself in the necessity, as he has already stated, for lack of being able to obtain a messenger, of proceeding with the protest up to three times in this manner: friends, we are standing here on the proprietary land of my principal; I protest in his name against your action as an act of force, and shall bring it in such manner before the eyes of the Honorable Court of Justice; furthermore notifying them of what occurred, with a request to the deponents to give testimony of the truth thereof if necessary, as appears from paragraph 6. That the principal of the undersigned, notwithstanding what has already been stated, has always taken care that the stream of water on the days determined for Cilliers was diverted unhindered to him, Cilliers; but that he, Rossouw, discovered to his deep grief that repeatedly on the days determined for him, the water was diverted during the night to Cilliers, and that finally the malice went so far that on the days determined for Cilliers, that stream of water was also diverted at night into the vineyard of Rossouw, without him, Rossouw, being able to discover who was guilty of that misdeed; then finally fearing whether that might not perhaps be a trick to falsely accuse him, Rossouw, of some wrongdoing, he deemed it necessary to have watch kept by that stream of water at night, in order to discover the perpetrator or perpetrators, and having sent two of his subordinates there for that purpose on the evening of the first of this month, they brought in during the early night, around half past nine o'clock, Adam of Mozambique, slave of the aforementioned Pieter Cilliers, according to whose statement, also annexed hereto and further recollected and sworn to, it appears that he, the deponent, was frequently ordered by his master, in the evening around eight o'clock and precisely on the diversion days of Rossouw, to cut through the ditch and, although that stream of water can hardly reach halfway to the property of Cilliers, nevertheless to divert it thither; that he, the deponent, always did so, until the aforementioned first of January, when he, the deponent, was caught in the act and detained. That the undersigned, considering this intolerable manner of conduct, as the same is placed in a simple yet truthful light, readily understood how this act, to use the very words so often employed by the great Dutch jurist, the President van Bynkershoek, that the question now no longer exists in law but in fact, because, as he says in his treatise on public affairs, volume 2, page 176, it is a delicate matter to deprive anyone in the world of his acquired right; that this deed also seems to belong to that which Damhouder, in his Criminal Practice, chapter 97, number 4, places under public force, and where in chapter 100, number 5, he speaks of private force, he explicitly includes those who, with an assembly of people without weapons, drive someone from his house or land and place themselves in possession thereof; that he further, in chapter 101, number 5, holds all helpers and co-abettors, who have given counsel or deed thereto, equal to the principal; just as also Martinus Casar in his Contemporary Law, book 4, title 15, on interdicts, numbers 20 and 27, speaking of the ejection from someone's house or land, as well as Carpzovius in his treatise on Capital Crimes, volume 1, chapter 37, page 292, numbers 8 and 9, and J. Moorman on Crimes, etc., chapter 10, page 130, number 2, show themselves to be of the same opinion with Damhouder and many other doctors of law; that the act of Cilliers and his companions also runs directly counter to the sentence of Your Honorable Excellencies, the clear letter of which is that he, Cilliers, shall be permitted to use the water for three days, solely for his farm named Zoetendaal, without being permitted to divert the same anywhere else, whereas they, on the contrary, divert that stream of water along a specially made ditch, over a flat ridge, off to the side, to the plot of land for which it was never requested and cannot even reach. That the aforementioned Cilliers, thus having dared to undertake to come with a superior force onto the freehold land of the principal of the undersigned to commit acts which neither he nor the company accompanying him were permitted to do, and thus having encroached upon the right of sovereignty, the principal of the undersigned can now no longer be secure for a single hour in his own house or dwelling. Extract from the civil roll held at the Cape of Good Hope, Thursday the 8th of January 1789. The Burgher Bernhardus de Vaal as representative in this capacity of the former deacon of Drakenstein, the honorable Daniel Rossouw, plaintiff, against the Burgher Pieter Cilliers, defendant, to see served against him a petition with costs regarding the malicious acts committed by him, Cilliers, and his accompanying party, together with many slaves on the second of this month on the property of the said honorable Rossouw; the Burghers Jacobus Retieff, Daniel Bosman, and Francois du Toit appearing for the defendant and legitimizing themselves with a power of attorney passed before the Secretary at Stellenbosch, the honorable Anthonij Faure, by the defendant and also by fellow Burghers Daniel Malan Davidsz, Jan Cilliers Jansz, Andries Bernhardus du Toit, Carel Christoffel Frick, Gabriel Rossouw Gabrielsz, Jan Rossouw, and Francois Roos; and having heard read the aforesaid petition submitted by the plaintiff together with its annexes, advance thereto: that they have committed no violence, nor have they ever had the intention to commit any violence or to harm anyone, but that they, because the defendant is a poor man and the plaintiff, contrary to the judgment rendered by this Court, has withheld even drinking water from the defendant, have consequently assisted him, the defendant, to open the old trench, which has already been there for 40 years and which the plaintiff out of malice allowed to become overgrown with refuse; that they furthermore were not at all on the plaintiff's property, but on Company land, although the plaintiff had sown that land with rye to spite the defendant; the rye, when they opened the trench, having already been harvested; adding hereto that the defendant absolutely cannot do without the water in question without falling into ruin with wife and children, and that this is a crying injustice on the part of the plaintiff, since he does not need the water in question himself and otherwise has enough water to make a living. The plaintiff in his capacity, having exhibited his aforementioned power of attorney, presents a petition furnished with 2 annexes, the same reading as follows on folio 1, 3. The plaintiff in his capacity chiefly argues against this that, regarding the commission of violence, he needs no further proof, since it is already sufficient evidence that the defendants in their capacity cannot at all deny having deliberately proceeded with so many persons and slaves to the place of the plaintiff in order to make the judgment of this Court illusory through the commission of violence; while the defendant has not refrained from saying publicly that he must have the water according to the judgment of Stellenbosch. That furthermore the water in question has always been held on precarious sufferance and that this is proven by the conditions of sale publicly read when the honorable Orphan Masters sold the place Zoetendaal; so that the buyer of the said place Zoetendaal well knew beforehand that no right to the water in question pertained to him, as it had been granted on precarious sufferance to the previous possessor; that although, everything notwithstanding, through this Court granting 3 days of that water to the defendant, a servitude was placed upon the plaintiff's land that had never before been attached to the land, the plaintiff nevertheless was satisfied and strictly conducted himself according to the judgment of the Court, namely by letting the water flow down to the place Zoetendaal; but that the defendant, contrary to the judgment which dictates not to divert the water sideways, nevertheless, assisted by so many men, brought the disputed water to his premises. That it furthermore surprises him, the plaintiff in his capacity, that one of the defendants in his capacity, being Jacobus Retieff, now also insists on the water in question in favor of the defendant, since Retieff himself, having been the owner of the aforesaid place Zoetendaal during the time of Landdrost Bergh, demanded at that time the water from the widow of Gabriel Rossouw, the next neighbor of the principal plaintiff, without making any claim on the water of the plaintiff currently in question; having also himself said during the commission held at that time that he did not have the least right or claim to the water of the plaintiff in his capacity. Persisting therefore in his submitted request. To the Honorable President Izaak Rhenius and the Honorable Council of Justice of this government. Honorable Gentlemen, Whereas the citizen Bernhardus de Vaal, as authorized proxy of the former deacon of the Drakenstein congregation Daniel Rossouw, son of Pieter, had summoned the citizen Pieter Cilliers, son of Jan, for the 8th of the past month of January, and simultaneously presented a petition containing principally a complaint that, notwithstanding the judgment rendered in appeal by this Council on 2 February 1788 regarding a certain dispute that arose between the aforesaid Rossouw and Cilliers over a watercourse, which dictates that the defendant Cilliers shall be permitted to use that water three days a week, note well, solely for his farm Zoetendaal without being allowed to divert it anywhere else; the said Cilliers nevertheless, on 2 December last, being precisely one of the days on which the aforesaid Rossouw was to use the water in question pursuant to the aforesaid judgment, did not shrink from opening an old ditch, even partially across the freehold land of the aforesaid Rossouw, with the assistance of the citizens Daniel Johannes Rossouw, son of Daniel; Jacobus Retief; Francois du Toit, son of Stephanus; Daniel Malan, son of David; Petrus Louw the elder; Jan Cilliers, son of Jan; Abraham Cilliers, son of Jan; Johannes Rossouw, son of Gabriel; Gabriel Rossouw, son of Gabriel; and Daniel Rossouw, son of Gabriel; Charl Marais, son of Jacobus; Jan Minnaar, son of Philip; Jan Ruijgrok; and Petrus Engelbregt, and thereby diverting the water, which ran in a direct line down to the farm Zoetendaal, toward a certain adjacent plot belonging to him, Cilliers; requesting that it may please your Honors to place the aforesaid committed acts of violence into the hands of the Fiscal's office, and to condemn the mentioned Cilliers to restore everything done by him at his own cost and without indemnity, and to pay the costs incurred in this matter. Whereas, on the other hand, it was submitted on behalf of the respondent by the aforesaid Jacobus Retief and Francois du Toit, together with the citizen Daniel Bosman, that they had committed no violence, but had acted in accordance with the judgment, namely by opening and cleaning the ditch which had already run along the plot of the aforesaid Cilliers for 40 years, and which Rossouw had caused to be filled in with bushes and rubbish. Your Honors then pleased, before deciding upon the said submitted petition, to commission the undersigned to conduct an on-site ocular inspection at the contentious location to determine whether and to what extent the parties have acted contrary to the aforesaid judgment rendered in appeal by this Council, and to submit a proper report thereof to your Honors. The undersigned, having assembled on the 28th of the just elapsed month of January to comply with the said resolution taken by your Honors, caused the aforesaid Rossouw and Cilliers to appear at the place in question and asked them by whom and in what respect they actually believed that the aforesaid judgment had been violated. Which was immediately answered by the aforesaid Rossouw, saying that, since the judgment clearly dictates that Cilliers shall only be permitted to make use of the water in question on his farm Zoetendaal, without being allowed to divert it anywhere else, and he, Rossouw—although he also had reasons not to acquiesce in this, as it appears most clearly that the farm Zoetendaal is not entitled to the water in question, both by virtue of the conditions of sale read out by the Orphan Masters at the sale held on 14 March 1770, and also because of the location of the same farm Zoetendaal, which, as can be clearly seen, is not situated on that water, but on the Berg River—had nevertheless, to prevent unpleasant consequences, remained content, and had caused the water to run in accordance with the aforesaid judgment on the set days and in its old ditch in a direct line down to the farm Zoetendaal; yet the aforesaid Cilliers had dared to undertake not only to divert that water sideways and toward his plot contrary to the aforesaid judgment, but to do this, despite the protests of him, Rossouw, on his freehold land, and indeed by forceful hand with the help of 15 citizens and 24 slaves. Against which it was put forward by the aforesaid Cilliers that he had in no way acted contrary to the judgment, but that, on the contrary, since the judgment rendered in appeal fully approved the judgment pronounced in the first instance, only with a change in the days on which the parties should make use of the water in question, and the judgment in the first instance dictates that he, Cilliers, should clean the ditch upwards as far as the dam of Rossouw, he therefore, with the help of such persons as were appointed by him as his proxies and who thus had to represent his interests, had opened the ditch filled in by Rossouw in accordance with the aforesaid judgment of the Landdrost and Heemraden at Stellenbosch, approved in that respect by this Council; and that above all this, besides Rossouw having diverted the water in question into an old ditch which certainly runs down toward the farm Zoetendaal, but which is situated in such a manner that the water, on account of the sandy soil, cannot at all be brought to the farm Zoetendaal, and that even if the water reached that far, it could still not well be used for the vineyard and garden.

opgeleezene koop conditien, geen regt op het water en quaestie toekomt, als ook weegens de situatie van dezelve plaats Zoetendaal die, gelijk het duidelijk te zien is, niet op dat water, maar op de Bergrivier is aangelegd:/ zig egter, ter voorkooming van onaangenaame gevolgen, heeft te vreeden gehouden, mitsgaders het water ingevolge het voorsz: vonnis, op de gezette dagen en deszelfs oude Stoot linia recta naar de plaats Zoetendaal doen afloopen; voorsz: Cilliers nogtans had durren onderneemen om niet alleen dat water Contrarie het voorsz: vonnis ter zijde en naar zijn Erff af te leijden, maar dit onaangezien de protestatien van hem Rossouw te doen op zyn eygendoms land, en wel geweldadiger haud met behulp van 15 burgers en 24 Slaaven. — Waar Waar teegens door voorsz: Celliers weerd ge„ advanceerd, dat hij geen zints Contrarie het vonnis had aangehandeld maar dat hij in teegendeel daar het vonnis in Cas d'appel geveld, wel deegelijk het ter eerster ins tantie uijtgesprooken vonnis approbeerde alleenlijk met verandering der daagen in welke partijen van het water in quaestie zouden moeten gebruik maaken, en 9 het vonnis ter eerster instantie dicteerd dat hij Cilliers de Sloot, opwaards tot aan den dam van Rossouw zoude moeten schoon maaken, dierhalven met behulp van zoodanige perzoonen dewelke door hem tot zijne gemachtigdens waren aan„ gesteld, en dus zyne belangens moesten voorstaan, ingevolge het voorsz: bij deezen raade en dat opzigte geapprobeerde vonnis van Landdrost en Heemraaden aan stellen„ bosch de door Rossouw toegewerkte sloot had geopend en dat boven dit alles, be¬ halven dat Rossouw het water en quas„ tie had afgeleid en een oude sloot welke zeekerlyk wel naar de plaats Zoetendaal afloopt; edog welke zoodanig gesitueerd is, dat het water weegens de zanderige grond, niet alleen geenzints op de plaats Zoetendaal kan gebracht worden, maar dat het water ook zelfs zoo verre gekoo„ men zijnde, als dan nog niet wel voor den wijngaard en huin zoude kunnen geëm„

be employed, the aforesaid Rossouw at the same time, even on those days that are appointed for his use, notwithstanding the aforesaid verdict of Stellenbosch states that he must then still supply as much drinking water to him, Celliers, as shall be feasible for him, nevertheless did not let a single drop of water flow down. Whereupon, it being replied by the aforesaid Rossouw that he completely left it to the judgment of the undersigned whether, in view of the small quantity of the water in question, it could ever be possible for the same to be used by him on those four days a week for moistening his vineyard, while then still letting as much water flow down as would then correspond to the intention of Landdrost and Heemraden, seeing that even all the water on those days on which Cilliers makes use of the same, being diverted into the new ditch to the Erf, in all those three days barely reaches the Erf even once, and for the most part only reaches a distance of about half the Erf of Cilliers from the place of him, Rossouw: so that therein already resides an absolute impossibility for him, Rossouw, if he nevertheless wished to enjoy the very only point that is found in the verdict of Stellenbosch to his advantage, to be able to comply with that part of the aforesaid verdict. Whereupon it was nevertheless pursued by the mentioned Cilliers that this did not take away the fact that the verdict of Stellenbosch, which for that part was approved by this Council, had assigned him drinking water during the time that Rossouw made use of the water for his vineyard, and that he therefore on that account claimed drinking water. The undersigned, noticing that, since each of the parties in his own regard attempted to conduct himself strictly according to the letter of the verdict and thus obstinately continued to hold fast to their arguments in that respect, there was thus as yet no possibility to effect any mediation between them, but that rather the parties with their mentioned continued to insist upon the execution of a verdict which the situation of the places and watercourse in question rendered entirely impossible, therefore thought it necessary to take a precise inspection of everything themselves, in order to then, besides a report of their commission and findings, also be able to supply to Your Honourable Worships those reflections which they would judge most suitable to interpret further the aforementioned verdict in such a manner that, removing all further misconceptions and misunderstandings, it could be strictly maintained. The undersigned then, having proceeded at the request of the aforesaid Cilliers and his authorized agents, first to inspect the new watercourse running from the quitrent land of Rossouw to the Erf of Cilliers, in order to be able to observe towards the place Zoetendaal and towards the quitrent land of Rossouw, very clearly had to see at that time that by the mentioned Cilliers, by leading the water across the Erf and thus a very considerable distance aside from the old course, action was taken completely contrary to the intention which Your Honourable Worships manifested in the aforesaid verdict, since the verdict clearly states: solely to his place Zoetendaal without leading the same aside. Which opinion having been communicated by the undersigned to the aforesaid Cilliers, the same submitted in that regard for his discharge that, while the water during the carrying out of the commission and the pronouncing and delivery of the verdict rendered in case of appeal ran in the new ditch across his Erf, and it is true that by the Council in the verdict it was forbidden to lead the same elsewhere, yet without making mention of the aforesaid watercourse across the Erf, nor making the slightest alteration concerning the same, he had therefore adhered to the verdict, and had not led the water a foot's breadth aside. Which was nevertheless contradicted by the aforesaid Rossouw, saying that this new ditch is an old water drain of some springs coming from the place of the widow Gabriel Rossouw lying above the Erf and running across the aforesaid Erf to the place Zoetendaal, while subsequently by permission a ditch had been made from the Erf of Cilliers to the watercourse in question, which in part crosses the freehold land of him, Rossouw, notwithstanding, however, that the actual course in question had in fact been and remained the old course running straight down from the quitrent land to the aforesaid place Zoetendaal; that at the same time by the verdict of the Council the water had been granted by no means to the Erf, but to the place Zoetendaal; that this being clearly stipulated in the verdict, and at the same time forbidden to lead the same aside, which is to say to the Erf, which has never or ever had any claim to the water in question, or been granted any right in that respect, from which it naturally followed that the water ought to flow in its old course, in a straight line to the place Zoetendaal and not at a right angle across the Erf. In which respect the aforesaid Cilliers nevertheless rejoined that, since of the place Zoetendaal, which was 12 morgen in size, he had sold the homestead with a piece of land to the Burgher Jan Marten Enzel, and had retained for himself four morgen of land with the right that was assigned to him to the water in question, he therefore believed that it was all the same whether he used the water on the place Zoetendaal or on the Erf. The undersigned, having subsequently proceeded upwards along the old course towards the dam, in order to inspect the watercourse and the condition of the dam and the ditch above the quitrent land, then observed themselves that

Achtb: bij het voorsz: vonnis hebben gemonifesteerd daar het vonnis duijdelijk zegd, Eeniglijk tot zyn plaats zoetendaal zonder het zelve ter zyden af te Lijden. – welk begrip de onderget: voorsz: Cilliers meede gedeeld hebbende, bracht den„ zelven, ten dien belangen tot zyne de„ charge in, dat terwijl het water bij het doender Commissie en het slaan en en pronuntieeren van het in Cas. d'appel gevel„ de vonnis, in de nieuwe sloot over zyn Erff heeft geloopen en door de raad, wel is waar bij het vonnis verboden is, het zel„ ve elders heenen te lijden, zonder nog„ taris vande voorsz: waterloop over het Erffmentie, noch nopens dezelve de ge„ „ringste verandering te maaken, hij zig dus aan het vonnis had gehouden, en het water geen stooo breedte ter zijde uytge„ leijd, 't geen nochtans door voorsz: Ros souw: wierd tegengesproken, met het zeggen; dat die nieuwe sloot zoude zijn eene oude waterloos van eenige fontei„ nen koomende vande boven het Erff leg„ gende plaats van de weduwe Gebriel Rossouw en gaande over het voorsz: Erff naar de plaats Zoetendaal terwijl ver„ volgens bij vergunning zoude zijn gemaakt een sloot van het Erf van Cilliers naar de waterloop in quaestie 't geen voor een gedeelte over, het eijgendoms land van hem rossouw gaat, niet teegenstaande egter de eygentlijke loop in queestie in der daat was geweest en gebleeven, de oude loop regt afschietende van het Erffpagtland naar de voorsz: plaats Zoetendaal; dat teffens door het vonnis des raads het water was toegeweezen geenzints aan het Erff,maar aan de plaats Zoetendaal Zoetendaal; dat dit duijdelyk in het vonnis bepaald en teffens verbooden zijnde, om het zelve ter zijden, het geen zeggen wil naar het Erff het welke nimmer of nooijt eene¬ ge aanspraak op het water in queestie gehad heeft, of eenig recht diesweegens toegekend is af te lijden daar uijt dus natuurlijk volgde dat het water in zijnen ouden loop, lijnrecht naar de plaats zoetendaal en niet met een winkelhaak over het Erff behoorde af te vloeyen — Tenwelken opzigte voorsz Cilliers egter regereerde dat daar hij van de plaats Zoetendaal die groot geweest is 12 morgen, den opstal met een stuk Land, aan den Burger Ian Marten Enzel had verkogt, en daar bij voor zig gehouden, Vier morgen Land met het regt het welke hem op het water en queestie was toegeweezen, hij dus Ver„ meende dat het om het even was, of hij het water op de plaats zoeten„ „daal dan wel op het Ertf gebruikte. de ondergeteekendens zog vervol„ gens langs den ouden loop op waarts naar den dam begeeren hebbende, om van de waterloop en de gesteldheid van den dam en de sloot boven het Erfpagtland inspectie te neemen, hebben als toen zelve ontwaard, dat

that the aforesaid Rossouw can never or at no time be in a position, on those days when he would have to make use of the water in question, to let a sufficient quantity of drinking water run off; in which regard, however, Cilliers and his authorized agents submitted for the consideration of the undersigned whether it might not be possible, if the entire watercourse above the quitrent land were deepened, thereby not only to facilitate the water in its course, but perhaps even to open up several springs and thus obtain an abundance of water there; concerning which, however, the aforesaid Rossouw noted that, although this assertion indeed seemed plausible at first glance, that arduous labor was nevertheless of a rather uncertain outcome, since he believed that while the water currently has an unimpeded course, therefore, if any hidden spring should be located elsewhere, the same would by no means emerge any sooner by deepening the ditch; wishing, however, gladly to submit to a careful examination and test in this regard. Now, as the undersigned have themselves examined everything that could merit the slightest reflection with respect to this extensive matter, they would thus also have little difficulty in presenting to Your Right Honourable Worships various remarks which could shed no small light on this matter; but since the commission of the undersigned was decreed solely to inspect whether and to what extent the parties acted contrary to the aforesaid, the undersigned believe they may excuse themselves therefrom; wherefore, passing over these matters in silence, they only take the liberty of assuring Your Right Honourable Worships that everything that occurred between the parties after the pronouncement of the aforesaid judgment had its origin both in the absolute impossibility of complying with the judgment, and in a misconception or misunderstanding by the parties regarding the intention of the judgment itself. As to the first, Right Honourable Worshipful Sirs, namely the absolute impossibility of complying with the judgment, the undersigned believe that this will already have been sufficiently evident to Your Right Honourable Worships from the foregoing; for after all, the judgment rendered in the first instance, which was affirmed by the judgment on appeal, imposes upon the appellant Rossouw the obligation to let as much drinking water run off as shall be feasible on those days when he was permitted to make use of the water in question; while, however, the undersigned testify in all sincerity to Your Right Honourable Worships that the water in question is at present so scarce that, if the mentioned Rossouw wishes to enjoy the benefit which is contained in the aforesaid judgment with respect to him, and which he also ought to enjoy as having been awarded to him by a final judgment pronounced by his competent judge, he can then absolutely let no drinking water run off; which inconvenience, according to the humble understanding of the undersigned, ought solely to be attributed to the fact that the commission of the Landdrost and Heemraden took place in the month of May, a season most unsuitable for judging a watercourse concerning which complaints of water shortage are made in the summer. And with regard to the latter, Right Honourable Worshipful Sirs, concerning a misconception and misunderstanding regarding the judgment itself, it comes particularly into consideration that Your Right Honourable Worships, by the words solely to the place Zoetendaal without diverting the same to the side, have clearly demonstrated your intention and meaning to have consisted in this: that, namely, as is also evident from the nature of the matter in all cases, the water is awarded solely to the place Zoetendaal, and by no means to the adjoining land lying to the side, just as the aforesaid Rossouw also understood it, and consequently caused the water from his dam to flow straight to the place Zoetendaal in its old course. While, on the other hand, the aforesaid Cilliers, believing that since the water ran in the new ditch across the land of him, Cilliers, both at the time of the commission and at the passing of the judgment, and since the aforesaid judgment rendered on appeal makes no mention whatsoever of altering the watercourse, deduced from this that the water had indeed been awarded to him on his land. And in this idea, Right Honourable Worshipful Sirs, the aforementioned Cilliers persisted so strongly that, supported and encouraged by all the

the aforementioned persons who assisted him in opening the ditch which runs in part across the freehold land of Rossouw, could not be convinced by any reasons to the contrary, so that, because of the hateful terms which the parties did not hesitate to utter against each other at every opportunity as a sign of their embittered minds, which not seldom and especially on the part of the authorized agents of Cilliers went so far that the undersigned had to oppose them seriously in this matter in the name of Your Noble Worships, the undersigned already thought that they now had to give up entirely the hope of being able to effect any mediation between them. Meanwhile, after the undersigned had in person examined and investigated everything that could have the slightest relation to the matter in question, and after spending several consecutive hours with the greatest patience listening to the interests of the parties, the undersigned deemed it not unserviceable to convene a session at the house of Rossouw, which lay closest to the place where the undersigned then found themselves, and to cause the parties to appear before them, in order then, upon calm consideration of all that had come before the undersigned in this matter, to see for the last time whether anything could be cleared out of the way, and to bring to an end all that appeared to the undersigned likely to yield in the future an endless source of discord and dispute between the parties and difficulties for this Illustrious Court, which has already been importuned for so long with this matter in its weighty occupations. But as soon as the undersigned had to that end given orders to the court messenger to summon the parties to the house of the aforementioned Rossouw, it was then requested by the aforementioned Rossouw and his children who were present that the undersigned would first be pleased, since among the persons present were some who had not hesitated to relate to these and those that he, Rossouw, had during a previous commission clandestinely filled in a running fountain on his property, to have those same persons point it out, and then also to investigate this in the presence of the parties, since he, Rossouw, believed that his honor and reputation were most highly concerned in this, this being precisely a matter suited, just as he was rejoicing in his gray old age to ask himself as an upright burgher, to bring an indelible stain upon him and his entire offspring, the more so because he, Rossouw, was prepared to confirm the contrary thereof immediately upon solemn oath. However, since this was at once answered in the negative by the aforementioned persons present, with the declaration that they had never spread anything of the kind, nor could they prove it, the undersigned then, for the reasons mentioned hereinbefore, proceeded to the place of the aforementioned Rossouw, and after having first confronted the aforementioned Cilliers and those who had assisted him with their entirely unauthorized conduct in digging over the ditch—which, as can most clearly be seen from the map, runs in part across the freehold land of Rossouw—and diverting the water to the property without consent, indeed even without prior knowledge of the Council, and having at the same time, while they believed they had executed the sentence of Stellenbosch and were therefore not punishable, shown how the execution of a sentence is incumbent upon no one except the judge alone, and that having obtained a sentence in one's favor, one may not put it into execution except with the assistance of the judge, the undersigned then presented to the parties, each separately, both the misunderstanding in which they were regarding the sentence of this Council, and the consequences they had to expect from a further contentious life arising from that hatred which has already taken more than too much root in this land. to live peacefully with neighbours, yes, how very much he had also attempted to maintain this same peace with the aforesaid Silliers principal, he nevertheless, through the ungrateful treatment of the aforesaid Silliers, had been brought into the necessity of conserving his rights, as he, besides many good deeds with which he had attempted to support the mentioned Filliers in his impoverished condition, had previously never ever obstructed the same Cilliers in the use of the water in question, and had always granted him the free enjoyment thereof according to his ability, on the same footing as had been observed by previous possessors, but that the mentioned Culliers subsequently, notwithstanding he had no claim to the aforesaid water, nevertheless had attempted to make himself master of all the water by initiating a lawsuit, that furthermore he, Rossouw, as proof of how much he attempted to avoid quarrels and discord, had already taken the decision to sell his place solely for that reason and to seek a good refuge where he could end his days peacefully and quietly, and that he therefore, reasoning solely from those principles, very gladly wished to do everything in his power to finally help settle this dispute entirely out of the world. While the aforesaid Silliers likewise at the same time testified that he was inclined to this, but that he nevertheless always had to bear in mind that he had a wife and children and was a poor man; proposing therefore to the undersigned two means to help settle this dispute out of the world, namely: 1. That Rossouw should allow him, Filliers, and three persons who assist him, the freedom to deepen out the watercourse by some feet from his quitrent land up to the spring itself, in order to test whether a larger quantity of water might thereby be obtained; adding hereto, however, that even if all the water were awarded to him, he would nevertheless still not be able to find a sufficient subsistence on his Erf and the piece of land withheld from the place Zoetendaal for himself, his wife, and children, but that it would nevertheless be much better and more advantageous for him in his circumstances in case Rossouw should: 2. Buy from him his Erf and the aforesaid small piece of land. The undersigned, having considered these propositions and also having immediately understood that, while the first might perhaps in the future give rise to new quarrels and unpleasantries, the latter would therefore indeed be the only means to entirely remove all further disputes and all further inconveniences, and to bring about the desired peace and friendship between the parties whose tempers had been so incensed against each other; have therefore caused the aforesaid Cilliers to withdraw and called the said Rossouw in alone, and predominantly presented the latter proposition to him. And although the aforesaid Rossouw also at first showed, with by no means unfounded arguments, that just as the said Hilliers cannot find a livelihood on his aforesaid Erf and piece of land, he would likewise have just as much difficulty in drawing such revenues from it for himself as would equate to the interest on the money to be advanced by him for it, the undersigned nevertheless had the pleasure that the aforesaid Rossouw, after having reflected upon it for a little while and having consulted with his children about this, finally, notwithstanding the protests of his said children, declared that, although he indeed did not need the aforesaid Erf and piece of land, he nevertheless, in order to show how gladly he on his part wished to cooperate in the promotion of peace and quiet between him and his fellow citizens, would accommodate himself to it and proceed to the latter proposition; the parties thus having entered into the following accommodation in the presence of the undersigned: Namely, that Rossouw has bought from the said Cilliers as well his above-mentioned Erf as also a certain portion of the place Zoetendaal which he, Cilliers, at the sale of the homestead and a piece of land of the aforesaid place Zoetendaal made by him to the burgher Jan Martin Enzel, had retained for himself, with all the right that belongs to him, Silliers, to the watercourse in question; and all this for the sum of 18500 Ind'i Vat: with such arrangements and conditions as the deed passed thereof on that day before the undersigned and annexed hereto dictates. So that the parties, having settled this their long-lasting dispute in this manner, subsequently have given each other the hand of friendship with many tokens of contentment and pleasure, and each testified that they would forever forget what occurred between them, just and in such manner as if nothing of the like had ever taken place between them. While at the same time all the aforesaid persons who had assisted the mentioned Fillier on the 2nd of December last to open the frequently mentioned new watercourse, testified to the undersigned to have acted therein in an innocent manner without any malicious intent, and even believed to have done a permitted act by acting according to the sentence of Stellenbosch which orders Cilliers to keep the watercourse clean, at the same time requesting the undersigned, while they intended at the earliest opportunity to humbly [illegible] this council in writing

With due respect, your Right Honourable humble servants, the burghers Pieter Cilliers Jansz., Daniel Johannes Rossouw Danielsz., Jacobus Retief, François du Toit Stephansz., Daniel Malan Stephansz., Petrus Louw the elder, Jan Cilliers Jansz., Abraham Cilliers Jansz., Johannes Rossouw Gabrielsz., Gabriel Rossouw Gabrielsz., Daniel Rossouw Danielsz., Charl Marais Jacobus’ son, Jan Minnaar Philipsz., Jan Buijsrogge, and Petrus Engelbregt, show: That the aforesaid Pieter Cilliers Jansz., as owner of a certain farm named Zoetendaal, situated on the Groeneberg, having initiated a lawsuit before the Landdrost and Heemraden of Stellenbosch and Drakenstein regarding a certain watercourse running from the Honourable Company's land alongside the farm situated there belonging to the former deacon of the Drakenstein congregation, Daniel Rossouw Pietersz., that case was concluded by that College and subsequently adjudicated upon the report of the Honourable Commissioners, by which judgment the said Cilliers was also ordered always to keep clean the ditch from his property upwards to the dam. That the aforesaid Rossouw, having appealed that judgment before this Noble Honourable Council, and your Honours having likewise decreed a commission to the farms in question, that case also reached its conclusion, and being definitively determined, your Honours, by the judgment pronounced therein, declared your approval of the judgment of the Landdrost and Heemraden of Stellenbosch, with only this alteration: that Rossouw could make use of the water four days a week and the first undersigned three days, and indeed the first petitioner solely for his farm Zoetendaal, without diverting it sideways, so that the first petitioner thus remained under the same obligation to keep the ditch clean as mentioned above, pursuant to the aforesaid judgment of the Landdrost and Heemraden approved by your Honours. That nevertheless, after the pronunciation of the aforesaid judgment rendered by your Honours, the aforesaid Rossouw, on the grounds that it was therein ordered that the first petitioner may only make use of the water in question for his farm Zoetendaal without diverting it sideways, has diverted the water in question, which for many years had run in a ditch across the property of the first petitioner to the farm Zoetendaal, into an old channel which certainly goes thither in a straight line, yet is eroded far too deeply to allow that water to be of any use to the aforesaid farm Zoetendaal; the said Rossouw subsequently having ploughed over the ditch stretching from his quitrent land to the land of Cilliers and sown it with rye. That the first petitioner, having in the recently passed month of November made known to the other signatories that he was not even provided on his property with the necessary drinking water, the petitioners, moved by pity thereupon—some in their capacity as friends and blood relatives of the said Cilliers, and others on the basis of powers of attorney granted to them, as well as the last-mentioned as witnesses—resolved, just as they have more often assisted and supported him, Cilliers, as a poor and needy man in busy times of harvest and otherwise, thus now also to lend him a helping hand in order to clear the watercourse pursuant to and in satisfaction of the aforesaid judgment. That the petitioners, having also done this without the slightest ill intent, and having dug open the aforesaid watercourse ploughed over by Rossouw, saw arriving there on the spot, to their utmost astonishment, the burgher Bernhardus de Vaal with certain other persons, which De Vaal, acting then in the capacity of agent for the aforesaid Rossouw, protested against this action of the undersigned and called it an act of violence. That this innocent matter was subsequently pushed so far that the said De Vaal, in this regard, after having obtained certain depositions, having caused the first petitioner to be summoned, addressed this, your Honours' formidable Court, by petition and requested that the matter might be placed in the hands of the Fiscal's Office in order to proceed at law against the petitioners on that account. that what they in their simplicity, believing they were complying with the sentence and lending a helping hand to a poor man and blood relative in his labor, had committed, had brought no small displeasure upon your Noble Honors. That the petitioners, being most deeply affected thereby, did not hesitate for a single moment to declare frankly to the well-mentioned Lord Commissioners that they heartily regretted this step taken by them, as they held too much respect for a tribunal that, through the maintenance of unblemished justice and the preservation of every resident in their lawful rights, has acquired so great a luster, as to ever dare to venture upon the committing of acts that would tend to the disparagement of the lawful authority of that illustrious tribunal. The petitioners have, it is true, Noble Honorable Lords, assisted the first petitioner in opening a ditch, through which he was to obtain his urgently needed drinking water; the petitioners having done this in the belief that they were performing not only a permitted, but even a necessary act, since the sentence dictates that Cilliers shall have to keep the ditch in question clean. For, Noble and Honorable Lords! Never could they have supposed that from this so disagreeable a consequence would be drawn, and that they could thereby be considered to have fallen into the bounds of contempt of the judge's authority and to have made themselves guilty thereof. That the petitioners thereupon requested the well-mentioned Lord Commissioners that, since it was clearly evident that this matter was solely to be attributed to the petitioners' simplicity and ignorance, they would not refuse them their protection and intercession, but on that account excuse them before your Noble Honors, just as some of the petitioners also took it upon themselves to humbly beg your Noble Honors' pardon by means of a humble petition on that account. That, however, whereof the Lord Commissioners themselves were eyewitnesses, at that time this so unexpectedly achieved friendship between the parties and the restoration of that peace and quiet between resident parties who had lived in enmity and discord for so long a time, made such an impression on the petitioners that the petitioners gave in somewhat too much to their joy and gladness on that occasion, even to the extreme that some of the petitioners, drinking a glass of wine to each other in an all too generous measure and having toasted the permanence of that friendship, thereby indeed entirely forgot the promise made to the Lord Commissioners, namely to ask this Court for forgiveness at the very earliest opportunity; the petitioners having returned to their places cheerfully and contentedly without any further reflection, in the certain expectation that this matter was entirely settled and everything would be forgotten and forgiven. That the petitioners, however, being unexpectedly summoned by the Right Honorable Lord Independent Fiscal Mr. Johan Nicolaas Steeven van Lynden van Blitterswijk, in order in the case of a repetition of the public crime mentioned to hear the demand, were not a little surprised thereby, all the more when they saw how greatly they had made themselves guilty of neglect of duty by not having fulfilled, in a matter of such great importance, that which they had assured the Lord Commissioners they would effect regarding what had been committed by them. Intendit drawn up and respectfully submitted to the Honorable Court of Justice of the Castle of Good Hope, by and on behalf of the Landdrost of Stellenbosch and Drakenstein, Hendrik Lodewijk Bletterman, Prosecutor ex officio in a criminal case, of the one part, against the burgher Willem van Zeijl, summoned in person, defendant and fugitive, of the other part. The Prosecutor ex officio states, and the truth is as follows: Article 2. That the defendant, who resided with his father, the burgher Adriaen van Zeijl, who is currently banished by sentence of Your Honors, did not hesitate Article 3. to shoot dead in a barbaric manner with a musket a certain Hottentot girl named Antje, Article 4. who, residing with the burgher C. van der Hever, from time to time came to visit her father named Ruijter, who lived with the former on the same farm, Article 5. on the occasion of such a visit, because, according to the assertion of the defendant, she had been found in the sheepfold at night; Article 6. [illegible] Article 7. subsequently causing the corpse to be dragged away in cold blood, Article 8. and thus leaving the same as prey to the birds of the heavens. Article 9. That the Prosecutor ex officio, having learned of this occurrence on the occasion when the aforementioned Adriaan van Zeijl cum suis was heard upon interrogatories, Article 10. addressed Your Honors on 5 February of this year, and having verbally made the matter known, requested a summons in person by official letter against the defendant; Article 11. which having been granted and successively attempted several times in vain, Article 12. the Prosecutor ex officio was permitted to summon the defendant by edict and the ringing of the bell. Article 13. That consequently the defendant, after the preceding ringing of the bell on 8 February of this year, was summoned Article 14. to appear before this Honorable Court on 5 March following, Article 15. in order to come purge and answer for himself concerning the shooting dead of a Hottentot child named Antje, on pain of etc.; Article 16. but not having appeared on the aforesaid day, the Prosecutor ex officio obtained against him the first default, Article 17. with all such benefit as according to law, and a second citation; Article 18. that he, the defendant, was consequently summoned a second time on the 5th of the aforesaid month of March, Article 19. to appear in person on 2 April, at the customary place and hour, for the same purpose as before; Article 20. but the defendant also remained absent at the aforesaid time. Article 21. Wherefore the Prosecutor ex officio obtained against him the second default, Article 22. likewise with the benefit thereof as according to law, and a third citation; Article 23. that the defendant was subsequently summoned again on 2 April in the customary manner, for the same purpose as before; Article 24. but on the day of the hearing having again failed to appear, Article 25. the third default was awarded to the Prosecutor ex officio with benefit as according to law, Article 26. and a fourth citation was ordered in superabundantia; Article 27. which last citation was also properly published, Article 28. and the defendant summoned against today, in order to see the present Intendit verified; Article 29. and also continuing in contumacy, Article 30. the fourth default was granted to the Prosecutor ex officio with benefit as according to law, Article 31. and the same was consequently admitted to serve his Intendit and to request justice thereon, Article 32. as appears from the respective records thereof. Article 33. In order to substantiate this Intendit, it is incumbent upon the Prosecutor ex officio to demonstrate the two following points: Article 34. Firstly, that the defendant has in fact made himself guilty of shooting dead a Hottentot child; Article 35. and in the second place, he ought to examine what punishment the defendant has incurred thereby. Article 36. As to the first, Honorable Lords, Article 37. the Prosecutor ex officio refers to the answers given by the banished burghers Adriaan and Petrus van Zeijl to the questions put to them by the Prosecutor, Article 38. and specifically to the answers given to articles 66 through 71 inclusive by Adriaan van Zeijl, Article 39. and to articles 63 through 70 inclusive by Petrus van Zeijl, Article 40. as well as to the depositions of the Hottentots Ruijter and Andries; Article 41. which four documents are annexed hereto under letters A, B, and D. Whereby it is expressly established that whoever incurs four consecutive defaults shall be held pro confesso, 53. so that the defendant and defaulter is convinced of the crime he committed, 54. whereupon there now remains to be examined the second point: 55. namely, how the defendant ought to be punished for this! 56. That a manslayer or fatal shooter cannot escape death is so well known 57. that one may safely refrain from an extensive demonstration of the truth thereof. 58. If this is so, Noble and Worshipful Sirs, then it is also not improbable that she, by her behavior, gave cause to the defendant's mode of action; 66. the more so since it is certain that someone who at an unseasonable time of night finds herself in a place where she has no business, and where there is something to steal, is, if not convicted, at least rightfully suspected of intending to steal, 67. especially when such a person has already committed multiple thefts, 68. just as the Hottentot woman Antje was considered by most to be fond of stealing. 69. Far be it, however, from the Prosecutor, ex officio, that he would wish to declare the defendant and defaulter free from all punishment; 70. for besides it being a mere pretense of the defendant 71. that he shot dead the Hottentot girl jumping over the kraal wall without knowing who she was, 72. there is, moreover, the unconcerned manner of dealing with the body of that girl, 73. showing that they did not have the least remorse over her loss, 74. but on the contrary seemed to be satisfied Article 75. Says yes. Says that he ordered 12 horses and a cart to be sent to him in order to fetch gunpowder and lead with it from the Cape, to be employed by the Commando against the wandering Bushmen. Article 5. Whether the defendant in person was then also at the Cape with the same cart and horses in the month of August following. Article 6. Whether the defendant in person then also fetched the gunpowder and lead with the same cart and horses; or to what end the defendant employed the same cart and horses. Whether the defendant in person subsequently, upon his repeated request regarding this, was discharged from that post on the 6th of June 1786. To confront the defendant in person and read to him the letter sent by him to the Right Honorable Lord Governor, sent with the burgher Barend Fredrik Lubbe, dated [illegible] 1786, and then to ask the defendant what answer the defendant in person received to that letter. Whether the aforesaid Lubbe, upon his return from the Cape, brought to the defendant in person a soldier's chest with beads and knives purchased by the defendant from the burgher merchant Stadter. Whether the defendant in person, in the month of July following, with both his sons Petrus and Andries van Zeil, together with the burgher Jan Wieser, set out on the journey to Namaqualand, and subsequently across the Great River, and took with him two wagons laden with various goods. Says that there is no Namaqualand, but rather that he went across the Great River, and says that the region calls itself Anni-quas, being the Bastaard Hottentots who migrate thither from time to time; and further as the question dictates. Article 13. Whether the defendant in person, having arrived in Namaqualand, hired some pack-oxen from the Hottentots there, and loaded them with some provisions, and a quantity of beads and knives. Whether the defendant in person supplied the Hottentots Piet Eiland, little Piet Eiland, Piet Namaqua, Andries Ruiter, and Pas, together with the Bastaard Hottentots Paul, Gerrit Stoffel, and Gerrit Deer, partly with firelocks and ordered them to pursue the Bushmen with him and both his sons, together with the aforesaid Wieser, which Bushmen had stolen a large part of the livestock of the burgher Paul Karsten. Whether the defendant in person did not say to the Hottentots at that time that it was not necessary to shoot elephants in order to deliver the tusks thereof to the Honorable Company, and then to each of them a share thereof. Whether the defendant in person continued the journey with the aforementioned persons along the Great River for about a month and a half, the aforesaid Gerrit said he was ill, and that Paul and Stoffel would stay with him to bring him home.
