And declared: That the official plaintiff having been furnished with an extract of a resolution taken in the Council of Policy on Thursday the 24th of July of this year, with an extract attached thereto from the report of the special commission submitted in the case of the first sworn Clerk at the Political Secretariat, Johannes Marthinus Horak, along with several documents serving thereto, it has appeared therefrom to the official plaintiff that the aforementioned defendant, defaulter and absconder, did not hesitate, setting aside his bounden duty and sworn fidelity, to collect funds of the Honorable Company over several years in a very far-reaching, unauthorized manner, and to employ them for his own benefit; such that the said defaulter and absconder has not only defrauded the Honorable Company of the considerable sum of 18001 rixdollars 22 stivers by transferring real estate before the lord's dues were properly paid into the Treasury, but has also sought to enrich himself through the collection and embezzlement of overdue recognition monies, of which, however, the sum chargeable to him cannot yet be fully determined, as other Clerks also signed for the receipt, and this amount will only be able to be established upon further investigation; apart from what may yet be found, in the ongoing investigations of the above-mentioned Commission, to have been likewise embezzled by him in the delivery of cattle instead of cash payment; that the said defendant, defaulter and absconder has consequently rendered himself fully guilty of forgery and theft of the Country's funds, which is properly called peculatus; and thus this matter has been placed into the hands of the fiscal's office, in order not only to act against the person and property of the said defaulter and absconder, but also to investigate to what extent the other Clerks are guilty, in order likewise to institute action against them; that the official plaintiff then, in accordance with the facts and the state of the remaining circumstances, without any loss of time, at an extraordinary meeting of this Right Honorable Council, of

having requested and obtained bodily apprehension from the Council, 16 directly sought and applied all measures to gain possession of the person of the defendant, defaulter, and absconder, 17 but the defendant, defaulter, and absconder having already absented himself, and the Right Honorable Plaintiff having given notice thereof to Your Honorable Worships, 18. upon his further request it was granted 19 that the defendant, defaulter, and absconder be summoned by ringing of the bell and public edicts, to appear in court on the next upcoming court day, in order to come purge and answer for his malversation and committed theft, upon penalty that, in case of neglect thereof, proceedings will be taken against him according to law. So that, as the defendant, defaulter, and absconder did not appear on the appointed day, 21. default was granted against him, with such benefit as ought to follow according to law, and a second citation, 22 which being duly served, the defendant, defaulter, and absconder still did not appear on the designated day, 23 and further was granted by this Council the second default with the benefit thereof according to law; 24 that further by a third citation the defendant, defaulter, and absconder being duly summoned as before, 25 and likewise not appearing, finally the third default was granted, 26 by virtue of which the defendant, defaulter, and absconder was declared barred from all peremptory exceptions, defenses, and other benefits, and the Right Honorable Plaintiff was instructed to submit his claim; 27 in order to see service of which claim the defendant, defaulter, and absconder, for greater certainty, was summoned today for the fourth time, 28 and he likewise having failed to appear, the Right Honorable Plaintiff now has the honor to submit this his claim. Read today was the report submitted by the committee for the investigation of the damage caused to the Honorable Company by the former first sworn clerk at the Political Secretariat. From which report it appeared that the former first sworn clerk at the Political Secretariat, Johannes Marthinus Horak, regarding the deficit of the sums of money expressed in the report, has in an extreme manner made himself guilty of malversation and theft of the Company's moneys; thus it was approved and resolved, so far as the findings regarding this matter are concerned, to place an extract from the aforesaid report into the hands of the Fiscal Office with the documents relative thereto, in order to institute such proceedings both against the person and property of the said Horak as the nature of the matter requires; as well as to investigate regarding the other sworn and ordinary clerks at the Political Secretariat appearing in the documents, to what extent they might also have made themselves guilty of any fraud or malversation, and therein likewise to act ex officio according to the findings. From the extract of Your Honorable Worships' highly revered resolution dated 4 April of this year handed to us, having become aware that the former first sworn clerk at the Political Secretariat, Johannes Marthinus Horak, through extreme negligence and carelessness, had so far exceeded his duty, as not only to grant transfers and conveyances of various real properties, which from time to time were sold, without prior payment of the lord's dues into the Honorable Company's treasury; but that he, moreover, in the ordonnance books, had marked the overdue recognitions on various cattle posts given out on loan, either in part or in full, as settled, which, however, had likewise not been paid or brought into the aforesaid treasury. and Your Right Honorable Sirs were therefore pleased to deem it fit expressly to commission the undersigned, through the confrontation of both the protocols of the executed transfers of immovable property and the ordinance books of the loan places against the cash books of the Honorable Company, accurately to investigate all the items of the lord’s right and loan moneys which have been neglected to be paid to the Honorable Company, in so far as the said right ought to have been paid, and the recognitions of the places wrongly booked by the aforesaid Zorn as having been settled, yet not found brought into the Honorable Company’s cash; with further orders to compile all such items together into a general list and account, and subsequently to deliver it to Your Right Honorable and Worshipful Sirs. The undersigned, in dutiful compliance and execution of what was committed to them as aforesaid, immediately upon receipt of the said resolution, having in the first place taken in hand the examination of the books or protocols of the transferred immovable property, since the month of December of the year 1778, when the said Zorn was appointed as first clerk, until the day that he was suspended from his aforesaid post; have, upon an exact confrontation made of the deeds of transfer against the cash books, come to discover that the Honorable Company, on account of sold immovable property, has in general been curtailed and prejudiced in the lord’s right by a considerable sum of ƒ55017:8, or 18339, 8 rixdollars, as appears from the list formed thereof and annexed hereto under letter A; wherein is pertinently made known, not only on which folios the deeds of transfer were recorded in the books, with the addition of the years and dates thereof, but also the names of the respective sellers and buyers, together with what the ceded and transferred property consisted of, as well as for what prices the same were conveyed, and how much ought to and should have been paid for them in lord's right. Having proceeded thereafter with the confrontation of the books in which all the places granted in loan are registered, against the aforesaid cash books; it has become evident to us, after the one as well as the other were likewise searched and checked in the most accurate manner, that in the cited loan books, not only by the repeatedly mentioned first clerk Zorn, but also by several other sworn and ordinary clerks currently serving or formerly stationed at the political secretariat, very many annotations were recorded and signed by them, according to which the persons noted therein, both on account of renewals and arrears of recognition moneys, would have paid altogether to the Honorable Company a considerable amount of 24660 rixdollars; of which, however, according to the records kept of the daily receipts in cash, nothing has come in; while Your Right Honorable and Worshipful Sirs, from the summaries of the specific list letter B also submitted herewith, which is arranged in the same manner as the one mentioned before, citing the names of the farmers who would have made payment of the recognitions for the cattle loan places held by them, and how the said places are named, will be able, if pleased, to observe by which clerks the above-mentioned annotations, of which some, however, were found unsigned, were made; and for how many months of renewals and arrears, as well as up to what sums each of them has signed. And although this commission entrusted to us extended no further than to the person of the first sworn clerk Zorn, we have nevertheless deemed that we should not omit to bring also to the knowledge of Your Right Honorable and Worshipful Sirs all that we have come to discover to the charge of the other clerks in the present case; so that each of them, in their accounts, will have to show and demonstrate to what extent they, whether with or without intent, have rendered themselves culpable and liable in that regard, or not. The undersigned must furthermore set down, with respect to the annotations of the places whose arrears were settled in cattle delivered at the Honorable Company’s outposts: That the receipts which must be granted thereof by the respective overseers of the said posts are only partly available at the political secretariat, and that there are also some arrears, both in money and livestock, without proper notification of how many months of the one and the other were paid; so that we have found ourselves obliged to stay and suspend the investigation regarding that matter until one shall have obtained from the cited overseers the general lists of all the cattle which has successively been delivered at their respective posts for the aforesaid purpose over the past ten years; in order that those lists, subsequently being confronted with the aforesaid annotations, we may then be able to make a further report of our findings to Your Right Honorable and Worshipful Sirs. Only an ordinance of this document, annexed under Letter A, has come into our hands, which was signed by the Honourable Governor and granted to the chief sailmaker Cornelis Mol for the payment of the lord's right to the amount of Rds 87. 24 on account of a house and erf bought from the burgher Ch: Ifland for ƒ10500, and for which he has also received the transfer; the said Mol having assured us that he handed over the aforementioned amount to the said Lorak to deliver the same into the treasury, which, however, as List Letter A demonstrates, was not done. On the other hand, we have obtained some further light regarding the loan registry entries indirectly pocketed by the repeatedly mentioned first clerk Lorak, as it has appeared to us from two receipts issued under his own signature, annexed hereto under Letters D and E, that he proceeded to acquit the farmers Douwe Gerbrand Steyn and Marthinus Els—the first-mentioned for six years, and the last-mentioned for twelve years and three months—of recognition monies that they owed on their therein named abandoned cattle farms; but which receipts, as they were not issued by the cashier, are therefore by no means acceptable or valid, so that not the slightest doubt remains whether he has made himself guilty of more other such malversations. We furthermore include under Letters G and L, in addition thereto, a private declaration by the fellow farmer Johannes Liebenberg, according to which he handed over to the said Lorak a sum of Rds 44 in satisfaction of his arrears; as well as an autograph note or account from him, Lorak, of such Rixdollars 376 as the court messenger Claas Jacob Claaszen, for the account of Oltman Ahlers, as aforesaid, handed over to him; and finally a small memorandum written by Lorak himself, wherein he seems to have noted for memory that he has taken in receipt from Lucas van Vooren for three years' arrears Rds 72, and from Evert Potgieter for a cattle farm taken upon ordinance Rds 24; all of which aforementioned entries, just as little as those which have been extracted in large numbers from the ordinance books and all together brought up on List Letter B, have been paid into the treasury of the Honourable Company. The Honourable President having communicated to the convened members that His Honour had caused this extraordinary meeting to be arranged at the requisition of the interim fiscal here, the Honourable Gabriel Exter, the said interim fiscal thereupon appeared in council; who verbally made known that yesterday, by extract resolution of the Right Honourable Governor and Honourable Council of Policy, an extract was placed in the hands of the fiscal office from such report as was submitted to the well-mentioned Council of Policy by the committee appointed by the said Honourable Council of Policy for the investigation of the damage inflicted upon the Honourable Company by the former first sworn clerk at the Political Secretariat, Johannes Marthinus Lorak, together with and alongside all the documents relating thereto; to the end of initiating such proceedings, both against the person and goods of the said Lorak, as the nature of the matter required, as well as to investigate with regard to the other sworn and ordinary clerks at the Political Secretariat appearing in the documents, to what extent they might also have made themselves guilty of any fraud or malversations, in order then to act therein ex officio likewise according to findings. That the said interim fiscal, since he found this matter so constituted that he maintained in the first place that he must secure the person of the mentioned Lorak directly, therefore requested a decree by virtue of which he would be authorized to cause the repeatedly mentioned Lorak to be taken into apprehension. Which request having been deliberated and taken into consideration that the said Lorak, by the aforementioned resolution, is already himself considered as someone who has made himself guilty of malversation and theft of the Honourable Company's monies, and there thus remains not the slightest doubt regarding what was committed as well as with respect to the perpetrator himself: it was therefore approved to grant the requested apprehension of the said fiscal, and likewise that he should immediately proceed with the court messenger to the house of the mentioned Lorak to bring this decree to execution, while in the meantime the council would remain assembled to await the outcome hereof, and in order, in case the rumours that have already spread, namely that the mentioned Lorak had absented himself, should be found true, to be able to take such further measures as the circumstances of the matter should require. malversations and theft committed against the Honorable Company's funds; in such manner that the well-mentioned, Honorable and Valiant Lord Governor and the Honorable Members of the Political Council, to the end that the matter be further investigated as required by the circumstances, and to proceed in law both against the person of the aforesaid Zorak and his property for the indemnification of the Honorable Company, had placed that matter in the hands of the Fiscal Office: Wherefore he, the Fiscal pro interim, requested that this Council would grant him an order of apprehension against the person of the aforesaid Johannes Marthinus Gorak; which was granted to him, and that he, the Fiscal pro interim, having obtained the apprehension in bodily form and being duly assisted, searched for the said Zorak at his dwelling house, but received the answer from his wife that her husband had ridden into the country, but that she was expecting him at any moment; so that he, the Fiscal, this morning having proceeded thither again, did not find the said Zorak, and was told by his wife that her said husband had not returned; so that from this, as well as according to common rumor, it appeared abundantly clear that he has either absented himself or become a fugitive: Wherefore the said Fiscal pro interim requested that the repeatedly mentioned Zorak may be summoned by public ringing of the bell and edictal citation, in order to appear before us within a certain appointed day and to answer for the malversations and theft committed by him, on pain that upon non-appearance proceedings will be taken against him according to law. Right Honorable, Valiant Sir, and Honorable Sirs, With due respect and in all submissiveness, your Right Honorable and Honorable Sirs' most humble servant, the undersigned First Sworn Clerk at the Political Secretariat, Johannes Martinus Horak, shows: That the petitioner, having already served since the year 1763, first provisionally and subsequently as Clerk at the aforesaid Secretariat, was thereupon appointed in the year 1778 as First Sworn Clerk there, one of the most difficult and laborious posts in the Company's service in this Government, as is abundantly known to your Right Honorable and Honorable Sirs. Thus, the petitioner, already from his earliest youth over a span of twenty-five years, especially the last part in which he served in his present office as First Clerk, has spent his best years in a most arduous, indeed almost slavish, service for the Company, in which the petitioner, notwithstanding the most apparent danger to which his health and constitution were daily exposed by a continual sedentary lifestyle, as your Right Honorable and Honorable Sirs may see from the accompanying declaration of the burgher surgeon Casper Schorneijtelen, nevertheless continued: Firstly, for reasons of special personal obligation to the late Secretary Mr. Bergh, to whose faithful care, as a second father, the petitioner owed his early upbringing, and to enhance it further, not to withdraw his help and assistance in his advancing years, already worn out by labor in the Company's service, in a service for which he himself had trained the petitioner; Secondly, spurred on by a prevailing personal ambition to be and remain, as long as it was at all possible, in the service of a worthy Company, of whom the petitioner was like a foster child, and from which he continuously enjoyed his only livelihood and maintenance, without ever having had, like some other servants, one or another private means of subsistence, and for which the ceaseless, heavy duties of the Secretariat left few spare moments; However, with the firm intention, upon the passing of the said Secretary Mr. Bergh, to request my discharge from the service of the Honorable Company, and to spend my remaining days in a private life and find another means of subsistence for my modest family. All this, the petitioner believes, is sufficiently known to your Right Honorable and Honorable Sirs, as well as the reasons why the petitioner nevertheless stepped back from this intention of his when it pleased your Right Honorable and Honorable Sirs, shortly before the death of Mr. Bergh, to entrust the weighty post of Secretary to Mr. de Wet, and to favor the petitioner with the promise and assurance of another office in due course, better suiting the petitioner's temperament and bodily constitution. In that certain and joyful prospect, the petitioner has thus continued until now in the service as First Sworn Clerk, performing the same with untiring diligence and zeal, sometimes at the expense of his health, to the best of his ability, without having been able to direct his thoughts to the misfortune that pursued him and was about to strike him. At an approaching moment when the petitioner could entertain the surest and most well-founded hope for the improvement of his condition and earthly fortune, as the sole fruits of twenty-five years of difficult labor, he must learn, to his only grief, that however much he had always applied himself in observing all the duties of his service, it had nevertheless been discovered and found that during the elapsed time of ten years in which the petitioner served the Political Secretariat as First Clerk, various transfers and conveyances of sold immovable property had taken place, of which the moneys for the lord's dues had not been paid into the Honorable Company's treasury, and furthermore that the recognition moneys of various loan farms, according to the notes in the ordinance books at the Secretariat, had likewise not been received into the Honorable Company's treasury. where the warrants must be prepared and dispatched, and for which the petitioner, as first sworn clerk, could and should be held responsible, had to take the resolution to authorize the Council of Justice of this government to seize and place under sequestration all of the petitioner's goods and effects, in order to recover therefrom the damage and the loss that the Honorable Company would otherwise come to suffer thereby. What shall or can the petitioner now produce in this matter for his excuse and justification? Nothing else, Right Honorable, Strict Lord and Honorable, Respectable Gentlemen, than that he, pleading solely for your most undeserved favor and goodness, must as sincerely as openly confess and acknowledge his guilt, and that these are all the consequences of a mistaken course of action and inexcusable negligence and carelessness of his own on the one hand, and a too careless trust on the other. Yet it is fully known to Your Right Honorable, Strict and Honorable Respectabilities how, during those years of the petitioner's service as first mentioned clerk, the volume of work and the affairs of the Company at the secretariat, as the first and principal department of this government, especially since the last war until now, have expanded and increased daily to such an important extent. All those voluminous resolutions, letters, and other retroactive records at the secretariat from that time onward demonstrate this in the clearest and plainest manner; just as it is sufficiently evident from other papers concerning private instruments, deeds, etc., which must be prepared and dispatched solely at the secretariat, how greatly and vastly these same affairs have likewise increased and multiplied for a first sworn clerk. The petitioner's unceasing labor in his service having thus become from day to day more difficult and heavier, without having the help and assistance of anyone else, particularly in the final years of the life of the late secretary Bergh, when his honor, as though worn out by continuous labor and struggling with bodily ailments, left the petitioner to bear almost the entire burden of the daily direction of the secretariat alone. Thus, he was at times overwhelmed with affairs and unable to bestow upon all daily occurring private matters, which must be dispatched from the secretariat and which properly belong to the department of a first clerk, all that attention which might otherwise have been required of him; having at times in these urgent circumstances been compelled to entrust various matters to others. It is true, Right Honorable, Strict Lord and Honorable, Respectable Gentlemen, that the Company, neither through the petitioner's erroneous administration of matters entrusted to his office, nor through his placing careless trust in others, nor for any other reasons and causes which he has already attempted to put forward for his excuse, cannot nor ought to suffer the slightest loss; or that the petitioner would attempt for one moment to call into question the right that the Company has to claim fair compensation from anyone through whose carelessness or neglect of duty it might suffer any loss. Far be it, Right Honorable, Strict Lord and Honorable, Respectable Gentlemen, that he should attempt to make grievance or complain about his unhappy fate, which has befallen him solely through his own fault and doing. He only hopes and expects, through the representation of all his interests in this matter, to obtain from Your Right Honorable, Strict and Honorable Respectabilities that special grace for an unfortunate person, that consideration and pity toward him, which depend solely upon the undeserved goodness of Your Right Honorable, Strict and Honorable Respectabilities, and for which he is humbly begging Your Right Honorable, Strict and Honorable Respectabilities. Although the petitioner now truly fears having occupied the precious attention of Your Right Honorable, Strict and Honorable Respectabilities too much and too long, he nevertheless judges that Your Honors will favorably deign to consider the circumstances in which the petitioner finds himself, and of what weight and importance it may be for him to present everything that he believes could merit any gracious reflection with Your Right Honorable, Strict and Honorable Respectabilities. doing so, who, for the salary they draw from it, have had to expedite the warrants and register the payment of the recognition moneys, without any secretary or first clerk having ever interfered with that work, except only that the first clerk was obligated to record in the books the sealing of the receipt and of delivered cattle for arrears of recognition, and likewise, upon the abandonment of the loan places, the cancellation thereof, or in extraordinary cases, whether in the event of disputes arising between the possessors of those loan places, or on other special occasions, when by order of the respective governors one or another note had to be made and kept in the aforementioned warrant books; that this manner and method of administration over the repeatedly mentioned warrant books continued until one or two years before the death of the Secretary, Mr. Bergh; when His Honour saw fit to make such changes in that regard, that while the booking of the warrants for the granting of the loan places remained on the old footing, the registrations of the paid arrears would henceforth have to be signed by the petitioner as first clerk, as has indeed happened since, both by the petitioner and by the clerks who were subsequently added. Although the petitioner might now, from a demonstration of the manner and method in which the commissions for the country folk in expediting both the warrants for their loan places and those for the arrears were ordinarily attended to and executed, deduce and present the possibility that has existed, that very often and especially in such pressing circumstances of time, in which the petitioner, as already stated, almost as if overwhelmed by manifold circumstances concerning other matters relating to his service, had to keep all his attention fixed solely upon the same, some abuse could have been made of his misplaced trust in this matter; and although he could once clearly convince Your Right Honourable and Honourable Sirs thereof, yet all this will certainly not be able to serve as his excuse, for he ought to have paid attention with greater diligence to all such matters in which the interest of the Company was so deeply concerned: only the petitioner begs that on this subject it may be favorably taken into regard by Your Right Honourable and Honourable Sirs, that, whereas the observation and administration of the so often mentioned warrant books of the loan places, for so long a time before it was entrusted to the petitioner as stated, was always entrusted to the ordinary clerks of the secretariat, and principally to the eldest of them, of whom however none are any longer in service; whether and to what extent the petitioner can be held accountable for committed misuses and abuses for which others have signed and thus made themselves responsible; nevertheless submitting himself in this matter also to such a decision as by Your Right Honourable and Honourable Sirs, according to the nature and circumstances of the matters themselves, for the interest of the Company as well as for the prevention of all disadvantageous consequences which could still further aggravate the petitioner's unhappy fate, shall in accordance with Your highest customary equity and justice be found to be proper. In what manner will the petitioner now finally and at last be able to make that restitution to the Company which he fairly and rightfully owes to it! It is true, Right Honourable Sir and Honourable Sirs! The petitioner's goods, effects, and meager possessions have been judicially attached and are under sequestration: but if these meager possessions of his, furthermore still encumbered with private debts, were to be executed upon in further legal prosecution and sold publicly in the customary manner, especially in these present times of a generally prevailing shortage of money here in this place, the consequence thereof will surely bring nothing other than a total ruin for the petitioner and his innocent wife and children, without his perhaps even then being able to cause the Honourable Company ever to receive its due; Thus, wholly powerless of himself and unable, the petitioner, in these his unhappy and distressful circumstances, will therefore need the help and assistance of his family and relatives, as well as other good friends, who have offered, in case Your Right Honourable and Honourable Sirs are pleased to take all this into consideration, and to grant the petitioner time and deferral for the satisfaction of that which the Company can rightfully claim from the petitioner in compensation for the damage that it would otherwise suffer through his negligence and omission of duty, then to provide the necessary security for the satisfaction: The petitioner therefore most humbly begs that everything that may in any way serve for his exculpation and for the mitigation of his unhappy fate may be taken into most favorable regard, and that it may be of Your Right Honourable and Honourable Sirs' goodness and pleasure to grant the petitioner forgiveness for his committed faults, in consideration of his many years of service

The petitioners solely beseech Your Right Honorable, strict, and Honorable, Respected Sirs in the most humble manner, yet to be pleased to take into regard what disastrous consequences an error and mistaken course of action by the first petitioner have already brought in their train. Since he, firstly, living in a time in which he could imagine having the surest hope for the improvement of his condition and earthly fortune, as the sole fruits of twenty-five years of difficult labor in the service of the Company, had to see himself deprived of one of the foremost and most lucrative offices in this government, such as the secretariat of Policy with its appurtenances; to which he otherwise fairly might have come closest in prospect to be favored therewith by Your Right Honorable, strict, and Honorable, Respected Sirs. All this the petitioners most respectfully submit to the consideration of Your Right Honourable, Valiant and Respected Sirs, and how oppressive and dishonouring it must be considered for all of them and the rest of the families, that multitude of critical reflections and objections which are born from contemplating the uncertain outcome of a legal action that, after all this, might still follow. Wherefore they most humbly beseech Your Right Honourable, Valiant and Respected Sirs that, for all those cited reasons, forgiveness for his committed faults may be granted to the first petitioner, and that his unfortunate affair may be settled politically, without any further scandal, in such a favourable manner as Your Right Honourable, Valiant and Respected Sirs, according to the nature and the circumstances of the case itself, in accordance with Your wise judgment, shall deem possible to happen, and for which the petitioners pray God that He may incline the hearts of all of Your Right Honourable, Valiant and Respected Sirs. That in the meantime the assistant Quist Mollerstroom, standing known on the list drawn up by the said gentlemen Commissioners for himself and the sworn clerk, the Honourable Diemel, already for a sum of approximately ƒ 12000, has come to absent himself from here, of which the Prosecutor in his official capacity, under correction, thinks he can have all the less doubt because the Council of Justice of the Castle of Good Hope, the aforesaid Mollerstroom was not found when summoned by the court messenger and also did not appear, and the said messenger, having been sent again after some days to obtain further information, received the answer in person from the absent man's wife, as in the attached report; that she, to her regret, is ignorant both of the whereabouts and the return of her husband. The well-mentioned Fiscal therefore requests that the above-mentioned fugitive persons may be peremptorily summoned in person by public ringing of the bell and Edictal Citation, to appear before us, or commissioners from our College, within a certain specified number of days, in order to answer for their willful desertion and abandonment of service, on pain of proceedings in contumacy being taken against them according to law in case of non-appearance. Wherefore the Council, having considered the request of the well-mentioned Fiscal, and in pursuance of the drafted Circular order of their High Excellencies, the gentlemen of the High Indian Government dated 20 August 1753, has approved and deemed it necessary for the maintenance of Justice to summon and cite the above-mentioned fugitive persons by public Edict and ringing of the bell, as we do summon and cite them hereby, to appear peremptorily in person in our council chamber here within the time of the four upcoming weeks, to come and purge and answer themselves before our court, or commissioners from the same, for the aforementioned willful desertion and abandonment of service, on pain that, in case of neglect thereof, proceedings in contumacy will be taken against them according to law. Article 1: And stated: 2 that on the first day of this year, a certain slave named October of Mosambique, belonging to the defendant in this case, appeared at the pillory, 3 and there showed some scars, 4 caused, according to his statement, by the mistreatment of the defendant; 5 That the ex officio plaintiff, having been informed of this, immediately had the aforementioned slave examined by the Second Chief Surgeon, 6 and then found that his buttocks were partially stripped of epidermis from behind, 7 and that several flayed stripes were visible on his back, 8 As appears from the accompanying Surgical Certificate, under Letter B; 9 That this course of action, the circumstances of which can be learned in detail from the accompanying Report, 10 given by the slave October before gentlemen commissioners from this Honorable and Worshipful Council, 11 and to which the ex officio plaintiff refers for the sake of brevity, 12 can by no means be deemed to belong to domestic punishments, 13 but on the contrary falls squarely under the terms of mistreatment, 14 so strictly prohibited by the statutory laws of India, 15 See Title of Slaves or Bondspersons, after the middle; 16 the ex officio plaintiff has deemed himself obliged 17 to convene the defendant before Your Worships, 18 in order that he may be corrected by Your Worships for this act according to its merits.
