dated the 30th of November of last year, the same having been principally intended to communicate the arrival of our fellow member Mr. Cornelis Van Der Duijn, as our general and respectful reports regarding that which had occurred in our Council are contained in our letter of the 24th of November prior, to the contents of which we still submit ourselves with all deference, we shall now make a beginning again of bringing before Your Right Honorable Worships, with the utmost respect, that which we deemed ought to come to the knowledge of Your Right Honorable Worships, thus noting at the outset how Your Right Honorable Worships, if it pleases you, will find stated among other things in the specification of criminal cases and proceedings concerning the interest of Your Right Honorable Worships that Ferdinand Salomons of Ghent, provisional quartermaster, Matthijs Meijboom of Rotterdam, Floris van Aart of Gouda, both sailors, all in the service of the Honorable Company and lately stationed on the Tanjongpoura the Kranke, together with Ian Oppe of Grijpskerke and Iacob Hansz: of Sonderen, also sailors in the aforesaid service and lately stationed on the Tanjongpoura the Steijger, together with and alongside a certain Ian Godlieb of Danzig and Pieter Hillebrandsz: of Konigsberg, the first as a sailor on the Kranke and the latter as a quartermaster on the Steijger, but both currently fugitives, on the first of December of the past year, took in among other things at one of the West Side Warehouses into the said vessels various sorts of linens in bales, for the Chamber of Enkhuijsen, all in good condition, in order in order to bring the same to the ship Binnewijsend, then still lying here in the roads, that said Ian Oppe during the loading crossed over onto the Kranke, and having gone below found there the aforementioned Floris van Aart, whereupon the aforementioned provisional quartermaster Ferdinand Salomonsz: immediately followed him, saying to them that after the hatches were closed, they must open the bulkhead and just go ahead, just as after taking in their cargo the hatches of the aforementioned Tanjongpoura were properly locked, and the keys given into the keeping of the commander of the said vessel Binnewijsend, alongside which the said Ferdinand Salomons and the aforementioned Hillebrands had also signed for the receipt thereof, when the same having been warped outside in the afternoon with the said vessels, the said Floris van Aart in the presence of Ian Oppe made an opening in the bulkhead, through which they crawled into the hold of the said Tanjongpoura the Kranke, just as the aforementioned fugitive quartermaster Pieter Hillebrands that very night with two persons known only under the names of Christiaan and Iacob, also having crawled through an opening made alongside Matthijs Meijboom into the hold of the vessel under his charge, the Steijger, opened several sacks, stole a large quantity of linens therefrom, though more out of one bale and less out of another, and stuffed rough and coarse linens in there instead of fine ones, and closed the bales again as best they could, having divided the stolen linens among one another, and having reached the outer shore shore, sold them to Chinese, for which breaking and theft of the Company's goods, primarily the first-named Ferdinand Salomons, who as chief should have prevented the same, but also as an example to others, and especially since these thefts have for some time been committed so grossly and frequently to the great detriment of the Honorable Company that Your Right Honorable Worships have not without reason complained thereof, was punished with death, and the others, namely Floris Van Aart and Ian Oppe, were exposed under the gallows with a rope around their necks, subsequently flogged, branded, and chained in irons for the term of twenty-five years, further Matthijs Meijboom and Iacob Hansz: were flogged and chained in irons for the term of five consecutive years, further the four last-mentioned were condemned to compensate the Honorable Company for the stolen linen, and all to the costs and expenses of justice, there being also executed on the same day by this Council Hendrik Meeuwes of Hamburg, provisional quartermaster, Hendrik Bartelsz: of Groningen, and Theunis De Vrij of Nieuwenhuijsen, both sailors, all in the service of the Honorable Company and lately stationed on the Tanjongpoura the Erikan, who together with the currently fugitive sailor Willem Milkam of Bruges, on the 7th of December of the past year, having also taken in at one of the West Side Warehouses, among other things, one hundred bales of common bleached Guinea cloth, all in good condition, in order to bring the same to the ship Nieuwland for the Chamber of Amsterdam, destined for the fatherland, and for the receipt of which the first-named

The first-named Hendrik Meeuwes, together and along with the master Frans Hans, had signed, and the hatches of that vessel having been locked and the keys thereof given into the custody of the said master, wherewith they had sailed outside that afternoon, whereupon the aforementioned Hendrik Bartelsz and the absent sailor Willem Milkam, with the foreknowledge of the above-cited Hendrik Meeuwes, at night, while the master lay asleep, crept into the hold through an opening which they had skillfully caused to be made in the bulkhead of their vessel so that not the slightest defect could be noticed from outside or inside the hold, opened about twenty-six to twenty-seven packs, stole two pieces of linen out of each, sewed the packs shut again as well as they could, put the stolen linen into sacks, and having subsequently come ashore here, sold them to a certain Chinese, at the price of Three rix-dollars or Two ducatons per piece; but of which linens on 14 December, while they were busy transferring the same from their vessel behind the artillery into a passing prahu, fifty-three pieces of common bleached Guinea linen were seized by the officers of the advocate fiscal; for which theft the first, Hendrik Meeuwes, was punished with the rope around the neck at the gallows, so that death followed; the second, Hendrik Bartelsz, was exposed to view under the gallows with a noose around the neck, after which tied to a post, severely flogged on the bare back with rods, branded, and riveted in chains, in order to labor therein for the term of Twenty-five Years on the Honorable Company's public works without pay, and to remain banished, with confiscation of half of his accrued monthly wages in favor of the Honorable Company; and the last, Theunis De Vrij, tied to a post, severely flogged with rods, and riveted in chains, in order to labor therein for the term of Five Years on the Company's public works without pay, and to remain banished, and furthermore all condemned in the costs and expenses of Justice. Among the matters dealt with in our missive of the date 24 November of the past year, it will already have come before Your Right Honorable, how by this Council, upon the declaration of the Advocate Fiscal regarding our then serving bailiff Barent Felix, it was decided to await the arrival of the assistant Mattheus Bolswaard to investigate what might militate against the repeatedly mentioned Barend Felix regarding the notorious libel which was allegedly brought to light by him, the request of the advocate fiscal to interrogate the said Felix on articles before commissioners from our Council concerning that accusation having also been denied in his regard, for not enough foundation was found for that, and also because of the wrecking of the ship Alblasserdam on which the aforementioned assistant Bolswaart was assigned, the advocate fiscal came to declare that he was not in a position to supply anything further to us for the conviction of the said Felix; however, the advocate fiscal was left free to proceed in the ordinary manner against the said Felix, but nothing further in this regard has been put into effect by his Honor up to now; then, after the repeatedly mentioned Barent Felix had misconducted himself regarding a certain report which he, in favor of the senior merchant Abraham De Clercq and to the detriment of the latter's separated wife Maria Herega, had altered in two essential points after its delivery, the same was also de facto removed from the office of bailiff by sentence of this Council dated 23 November 1735, never to be allowed to serve in such an honorable office again, as Your Right Honorable will be able to verify, if it pleases, from the sentence in the Criminal Roll; it having furthermore been brought to the knowledge of Your Right Honorable at that time how, with regard to the junior merchant Francois De Koning, we had held the request of the advocate fiscal to have the same examined on some articles before Commissioners from this Council in status until our fellow Member Master Jacob van Den Bosch should have answered the articles submitted by the advocate fiscal in the past year; but this having been accomplished shortly thereafter, by sentence dated 15 February 1736 the request in regard to the said De Koning was denied, and the said officer was ordered to proceed further against the said De Koning by civil summons, wherefore the said advocate fiscal on 26 August of this year brought a criminal indictment against the said De Koning for conducting private trade, various calumnies, and committed acts of insolence, and in conclusion thereof demanded that he, De Koning, by sentence of this Council, should be dismissed from office, rank, and salary, furthermore condemned to be sent back to the fatherland at the first opportunity as a harmful and useless subject, together with

3 3639 to a fine of Two Thousand Rijxd:rs for the benefit of the new Dutch church, with costs; against which he, De Koning, appearing on the appointed day, requested a copy and a fourteen-day adjournment to act as he would be advised, which was then granted to him; but when he was summoned by the advocate fiscal to serve his answer, and having defaulted each time, His Honour had already been granted a day for production, on which grounds he, De Koning, was cited by the said advocate fiscal to see production made, he, De Koning, then simultaneously requested and obtained relief from default of answer, whereupon, under benefit of that relief, he served an answer in writing, against which the advocate fiscal persisted for reply; the parties subsequently, on the 5:th of this month, requested a fourteen-day adjournment for production, so that only in due time shall we be able to communicate the outcome of these proceedings to Your Right Honourable Worships. — We had also reported to Your Right Honourable Worships in our letter sent anno passato that on the 19:th of October the former Governor of Ceijlon, Stephanus Versluijs, was granted one month, likewise Joan De Mauregnault the period of three months, and the other defendants, Adriaan Van Hek and Ian Willem Schnee, at their request were granted an additional six weeks to answer, though under default. — And we now have the honour, in continuation of this matter, to communicate to Your Right Honourable Worships that Their High Mightinesses, upon the request made by Roeland Cau, were pleased by resolution dated 18:th November anno passato to require 3640 our advice and consideration as to whether and to what extent the defendant Cau, although sub reatu, could at that time be declared eligible for employment, whereupon on our part on the 2:nd of December following, Their High Mightinesses were served with our thoughts by written memorial, and therein made known to what extent the said Roeland Cau could and might at that time be declared eligible for employment, without however expressing ourselves at that time regarding the further request of him, Cau, so as not to cause any prejudice to either of the respective parties; furthermore, with regard to the said Stephanus Versluijs, on the 23:rd of November 1735 a voluminous answer in writing was served, and alongside it was submitted a register with various documents, and on the last day of the same month an answer in the form of a libel was also submitted by the defendants Adriaan Van Hek and Ioan Willem Schnee, largely referring to the arguments of the answer of the aforementioned Versluijs in so far as it might relate to them, of which the advocate fiscal, upon His Honour's request, was granted a copy and a three-month adjournment to reply thereto; the said advocate fiscal on the 21:st of March of this year brought the case to the Roll both against the cited Adriaan Van Hek and Ioan Willem Schnee, and against the co-defendants Ian Elias van Mijlendonk, Willem Bernard Albinus, and Roeland Cau, and solely persisted for reply against their respective submitted answers, and the matter having been brought by the parties into full conclusion and into a state for judgment, it so happened in the meantime that the said Governor Stephanus Versluijs 3691 came to pass away here, whereupon shortly thereafter the Orphan Masters of this city were summoned to the Roll of our Council by the advocate fiscal to take up the records of the lawsuit, as having under their administration the estate and succession of the said Versluijs, and to proceed further with the advocate fiscal according to the latest retroacta; which incident having been fully pleaded in writing by the said advocate fiscal and the aforementioned Orphan Masters, Their Reverences were ordered by sentence of the 27:th of June to take up the records of the lawsuit and to proceed further with the advocate fiscal according to the latest retroacta, with the costs reserved until the end of the principal case; but finding themselves aggrieved by this sentence, the said Orphan Masters addressed themselves to us by petition on the 13:th of September following, and under many legal citations requested at the conclusion thereof that they might be admitted to revision of the aforementioned sentence of this Council, which was then granted by us so as not to curtail anyone in their rights; but with regard to the co-defendant Ioan De Mauregnault, we are able to inform Your Right Honourable Worships that in his regard, by taking merely a contrary conclusion for answer, the case has already advanced to the stage of reproaches, and having been brought to the roll to reproach under default, at the same time on the appointed day the case against the

the advocate fiscal was brought to the court roll to hear request for relief from the lapse of the terms, and especially from answering, etc., but which, being most earnestly opposed by the said advocate fiscal, and that incident having been fully contested summarily by the parties, the request of the said Mauregnault was denied by our sentence of the 16th of September last, as it stood, without prejudice nevertheless to his right as petitioner to produce such evidence upon relief as he, the petitioner, might deem necessary for his vindication and defense, with condemnation of him, Mauregnault, in the costs incurred herein. Meanwhile, on the 11th of July of this year, the case of the former Political Council members of Colombo was concluded in our Council, after the declaration of the advocate fiscal and the co-defendant Joan De Mauregnault had previously come in to settle the case separately in order to remove all exception of recusal, and it was declared by a separate operative decree to separate the case of the said Political Council members from that of the former Governor Stephanus Versluijs and Joan De Mauregnault. By our sentence dated the 11th of July aforesaid, the said advocate fiscal's claim and conclusion regarding the Political Council members was denied, with offsetting of costs, except regarding the defendant Roeland Cau, concerning whom the advocate fiscal was condemned in the costs of the trial. When furthermore on the 3rd of October the case was again brought to the court roll by the advocate fiscal against the aforesaid Mauregnault to purge as yet the default of reproaches, and further as yet to reproach, he, Mauregnault, on the court day served through his attorney a certain libel, requesting at the end thereof, on the basis of the reasons and grounds alleged therein, that this submission of the advocate fiscal might be struck from the roll as null and inept. Because of the advocate fiscal's indisposition at that time, this was contested by the water fiscal on behalf of the advocate fiscal, and that incident being further fully concluded, the case was then taken under advisement. Whereupon, on the 10th of October following, a certain libelous request was submitted on behalf of the said advocate fiscal, to the end that he, Mauregnault, along with his attorney, might be so corrected on the public roll for their foul, abusive, and slanderous language dashed down with the utmost shamelessness and arrogance in the aforementioned libel, as this Council, according to the exigency of the matter for the maintenance of him, the advocate fiscal, and for the public good, should deem proper in good justice. But before anything was finally decided by us concerning all this, a very comprehensive petition was presented to our Council by the said Mauregnault on the 10th of October, accompanied by various documents, and at the end thereof requested that this Council, taking an equitable reflection thereon, would be pleased ex officio to amend its interlocutory decree of the 26th of the preceding month of September, and as yet admit him to relief from answering, or else under benefit of requeste civile, notwithstanding the state of the trial, allow him to change and amplify his conclusion of answer taken apud acta in such a manner as he should deem useful for the advancement of his good right and for a lawful defense, and consequently to be restored against the omission that he did not do so in due time, as well as relieved of all faults and omissions committed thereto, with committimus and referral to the public roll of this Council. Whereupon, on the 15th of November following, he, Mauregnault, was referred to the roll of this Council to make the last clause of his request by citation and presentation, as then on the 28th following, not only was this done, but it was also brought up to hear request for relief of production pursuant to the previous ruling of this Council dated the 26th of September last, provided he pay the fine established thereto and refund the costs of the delays, and also under benefit thereof to see him, the petitioner, produce such documents and evidence as he deemed necessary for his vindication and defense. This too, both the one and the other, after it was fully concluded by the parties in reply and rejoinder, was taken under advisement. Having informed Your Honorable High Mightinesses in our aforementioned last respectful letter how the detained skipper Adriaan van Der Graaff was admitted to an ordinary trial on the 8th of June of last year, we now have the honor, in continuation thereof, to state that this case having been brought to the stage of judgment on the 6th of June of this year, it was approved by this Council upon the request of the prisoner that the logbook submitted by the advocate fiscal along with the claim, kept by him, the prisoner, on his voyage from the fatherland to this place in the year 1733 on the ship Haeften, along with those of the further evidence ship's

3645 ship's officers of his, the prisoner's, vessel, and that of the third watch of the ship Alsem to be placed into the hands of the present Commander and Equipment Master Hugo Verijssel, alongside certain commissioners and skippers appointed by this Council, in order to examine the same and to serve this Council with a report as to how far the prisoner had acquitted himself of his oath and duty regarding the abandonment of the ship Blijdorp, so that subsequently, in the settlement of this case, such regard might be paid thereto as in good justice would be found proper; but the Advocate Fiscal having declared by written statement that he was unable to obtain the journals of the other ship's officers of the said ship Haaften, and that of the third watch of the ship Alsem, it was subsequently, by further resolution of this Council, thought proper nevertheless to submit the aforementioned kept journal of the prisoner into the hands of the said Commander and commissioned skippers, in order to examine the same against the report of the late Commander and Equipment Master Elias Wargaren and commissioned skippers, likewise produced by the frequently mentioned Advocate Fiscal along with the claim against the prisoner, and furthermore to serve this Council with a report within the time of fourteen days, in the manner stated hereinabove; but which not having been received up to now, there was furthermore presented to this Council by the Advocate Fiscal on the 31st of October last a certain petition, and submitted alongside it a register with various documents, among which was then also found an attestation dated the 9th prior, granted by the comforter of the sick Johannes Martin, who was formerly stationed on the ship Blijdorp, and which his Honor had not been able to obtain sooner, with the request that the same documents might be joined to the case and noted by way of addition on the inventory, in order to likewise take regard thereof in the settlement of this case, without prejudice however to the prisoner's right to challenge these documents by rescription; which request having been presented to the prisoner's attorney, and his declaration and consent having been heard, it was thereupon resolved by this Council to grant the same without prejudice to the prisoner's right; whereupon, furthermore, objections were raised against it on behalf of the prisoner, and general salvations of rights were implored by the Advocate Fiscal on the 5th of this month, and the parties having undertaken to amplify their inventory of documents at the secretariat, we are not able to bring the outcome of this case to the notice of Your Noble High Mightinesses until a further occasion. — A certain specification or account against the estate of the former Governor of Ceylon, Mr. Petrus Vuijst, having been sent by the Ceylon ministers to the Noble High Government of these Lands, and recently, by order of their High Nobles, placed into the hands of the Advocate Fiscal of India, [was] submitted by the said Advocate Fiscal to our Council on the 17th of October last, alongside a petition, concerning the cost of the newly constructed and previously demolished buildings, as otherwise, item whatever was further caused to the detriment and damage of the Honorable Company by him, Vuijst, or through his actions, with the request that the same might be joined to the ongoing lawsuit 3647 concerning the statement of account of the estate of him, Vuijst, and Lady Barbara Wilhelma Gerlings, and that there furthermore be granted to his Honor an edictal citation in communi forma against the aforementioned Lady Barbara Wilhelma Gerlings, residing in Haarlem, both for herself and as mother and legal guardian over her daughter Maria Louisa Vuijst, or otherwise legally and qualifiedly to appear here on the court roll, on such convenient day and hour as this Council should be pleased to determine, in order, regarding the matter of the aforesaid account amounting together to Guilders Ninety-eight Thousand, Four Hundred Forty-three, and Eight stuivers, upon the entire sequestered estate of the aforementioned Mr. Petrus Vuijst, or else the confiscated half, to hear such claim as his Honor would wish to make and take ex officio; Versteeg, and that his remaining estate was immediately handed over to the sequester by the widow of him, Versteeg, because it was rumored that not only was he, Versteeg, in arrears for a considerable sum to the Honorable Company, but also to many others here in this city; whereupon, after the sequester had summoned the known and unknown creditors by edict, the advocate fiscal also appeared, among others. In accordance with what was transacted and resolved in the Council of India on the date of 22 November 1735, the advocate fiscal had been ordered to maintain the right of the Honorable Company to this estate, and acting in that capacity on behalf of the Receiver General Rogier van Alderwereld, he instituted an action against the said estate. As the basis thereof, he exhibited a register with various documents, from which it was said to appear that the said Versteeg—both on account of licenses, lease monies, and seigneurial dues, as well as on account of auction proceeds from four old and decommissioned ships of the Honorable Company, in the months of September and October of last year—having received as cashier for the account of the Honorable Company a principal sum of thirty-four thousand, one hundred and ninety-five, and three-eighths rix-dollars, of which, upon his death, there was said to be a deficit in his administration amounting to twenty-six thousand, eight hundred and ninety-eight, and seven-sixteenths rix-dollars. But which action was contested by various creditors in a written debate, exhibited in our Council on 5 September, in which, among various allegations, the said creditors believe to demonstrate that the advocate fiscal cannot act in this matter for the right of the Receiver General Rogier van Aldewereld, since through the negligence of the said Receiver—who alone was obligated to watch over the country's revenues, and no one else was accountable for them—having not observed his duty in this regard, but having neglected his right, and consequently no action on the part of the Receiver against the estate of the insolvent deceased cashier Pieter Versteeg was admissible. And therefore, they concluded to the end of inadmissibility, and subsidiarily to the dismissal of the claim and conclusion sought by the gentleman in his said capacity against the insolvent estate of the deceased cashier Pieter Versteeg, in the matter of preference over the debating creditors, etc. Thus, we shall only be able to inform Your Right Honorable Worships of the outcome of this case upon a further occasion. And furthermore, Your Right Honorable Worships are hereby informed with great respect that, with regard to the comforter of the sick Pieter Backer, after he was previously permitted to defend his case in the ordinary manner, the claim against the same Backer was finally dismissed by sentence dated 23 May of this year, though nonetheless with condemnation to the costs of the lawsuit. Likewise, the case concerning the chief mate Cornelis Langendam, stationed on the ship Cats—who last year was released from his detention by this Council on personal recognizance—was concluded, and he, Langendam, by sentence dated 12 September last, was declared incapable of ever serving the Honorable Company in any honorable capacity hereafter, and furthermore to be sent to the fatherland as a harmful and useless subject, in order to perform sailor's service for his board during the voyage, together with the costs and expenses of Justice, as Your Right Honorable Worships, if you please, may ascertain from the sentence accompanying this. After which, there arrived here from Banda, according to the contents of the report of the Advocate Fiscal with which this Council had concurred, and which was handed over to Their Right Noblenesses on 16 November of last year, the two forester's assistants, of whom a proper report has already been made to Your Right Honorable Worships in our advices of last year; they being found here to be named Passchier Norbertus Dupré and Jan Jansz van Duffelen, alongside the first-named's slave Cupido of Timor, as having assisted his master therein. These persons were indeed sent up with the documents charging them, but were nevertheless, at the requisition of the advocate fiscal, further and precisely interrogated here, and confronted with Jan Andries Schaland and Evert van der Pol, who were then still in custody, as having been their accusers. But since the said Dupré and van Duffelen were fully in confession, the advocate fiscal, both against them and against the aforementioned Cupido of Timor, served a written criminal indictment on 15 August of this year, and at the conclusion thereof demanded that the two of them here

Which prisoners then also anew, among others, had accused the burgher Barent Schalkers, presently residing here, that he had likewise engaged in the illicit sale of nutmegs at the time when he, Schalkers, in the past spring was assigned as a steward's mate in Banda and was staying there. On the basis of which accusation the advocate fiscal, after their statement was first reviewed in our council on the 16th of August, and they fully persisted therein, came to request the civil detention of the same Barend Schalkers and his slaves whom he had brought with him from Banda. But which request of him, the advocate fiscal, after the aforementioned Schalkers and his slaves were heard orally during the meeting, was provisionally granted only with respect to one of his slaves named Pamo, and it was thereupon resolved to have the said Schalkers summoned in person by the advocate fiscal to be heard on interrogatories. Whereupon subsequently he, Schalkers, being summoned on the 22nd of August following to the roll of this Council to appear in person and to see and hear the request made, when by the said advocate fiscal some articles were exhibited to us with the request that the said Schalkers should be ordered to answer them in truth in the presence of commissioners from our Council forthwith, and at the same time that he, Schalkers, should be ordered to enter civil detention without access of friends and kinsmen until the answering should be concluded, in order to dispose thereafter as this Council in good justice should deem proper. However, concerning this, Their High Nobilities, by their much-respected resolution of date 27 November following, brought over in extract by our aforementioned President, were pleased to decide, among other things, to order the Banda ministers—instead of the requested summons of several other persons to be prosecuted here in court as well—to promptly renew the edicts against the illicit trade in spices found there, and to have them strictly observed by everyone, as well as specially and most seriously enjoining the Governor and fiscal to pay close attention thereto, and to proceed rigorously against offenders without any connivance. Siong Koko, and located at the square on the corner of the so-called grip, residing within this city, were stored, the aforementioned advocate fiscal for that reason also requested of this Council that a commission might immediately be decreed, in order to seize the same nutmegs upon their discovery, and to deliver them to the Honourable Company as having been stolen from it; that after this was immediately decreed, the aforementioned advocate fiscal, properly assisted by commissioners and a secretary, proceeded thither, and then, in the same empty house, recovered a quantity of nutmegs, which subsequently, having been transferred to the Honourable Company's west-side warehouses, were found to consist of 1416 lb of fat nutmegs, of which 1018 lb resulted upon garbling, which are good and new, and 398 lb of old, unusable ones from previous years, entirely eaten by mites and fit for nothing else than to be destroyed by fire in due course; that furthermore, at the same time, at the request of the aforementioned Advocate Fiscal, inquiry was immediately made after the Chinese Siong Koko, and his goods and dwelling were seized, but the same Chinese went missing and has not appeared to this day, whatever efforts were made thereto by the advocate fiscal; his goods having been sold at public auction, and the advocate fiscal, because of his absence, having requested and obtained an edictal citation, both against him and against all claimants to the proceeds thereof, so that when his Honour brought that matter before the Roll of this Council on 15 August, no one appeared regarding it, whereupon his Honour, by virtue of the defaults that had occurred, on the 10 October following, both against the aforementioned Chinese Siong Koko and all those who might believe they had any right, action, or claim to the proceeds of his goods, [demanded] that the defendant by edict, as well as the absconding and defaulting aforementioned Siong Koko, by virtue of the fourth default, should be declared to be in contempt, and consequently barred from all exceptions, whether declinatory, dilatory, or peremptory, as well as from all defenses and legal remedies which he, appearing, might and could have made and taken; and furthermore, that he should be banished from all lands of the Honourable Company without ever being allowed to return there on pain of heavier punishment, with condemnation in the costs of the intendit; and further that all those who believe they have any right, action, or claim to the aforementioned goods should be condemned to institute their actions within the space of six weeks, in default of which they should be declared to be and remain barred therefrom, with the imposition of perpetual silence, and that in such case, the proceeds thereof should be confiscated, to be divided according to custom, deducting what is to be deducted; whereupon on the 17 October aforementioned, the claim of the Advocate Fiscal was granted by sentence of this Council, with this alteration however, that the claimants to the proceeds of the goods, by virtue of the defaults that had occurred, were directly barred from their actions and claims to the same, and perpetual silence was imposed upon them; it being further that by our water fiscal, Master Nicolaas Van Berendregt, on 29 July of the current year, in the presence of commissioners from this Council, thirty-four chests of opium and one empty ditto were seized from the ship d'Anthonia, which arrived from Mallebaar, and subsequently transferred to the Honourable Company's warehouse, regarding which the aforementioned water fiscal, since no one presented himself as owner, proceeded in the case of edictal citation to confiscation in order that the net proceeds be distributed according to custom; so that the same chests of opium, or the net proceeds thereof, were confiscated by sentence of this Council dated 26 September last; subsequently, against the commander of the aforementioned vessel, Dirk van De Velde, and first mate Matthijs Deteloff, a claim was served on 10 October following, and in the conclusion thereof it was moved that they should be dismissed from their respective offices, qualities, and wages, and furthermore condemned in the costs and expenses of justice, which was then also, on the foundation of the successive Placards, and especially by those of 22 January 1680 and 29 May 1683, followed by sentence of this Council, as your Right Honourable Worships may examine at your pleasure in the accompanying sentence. 3660. and other documents, a copy of which was handed to us upon special request on the 21st thereafter, we, namely the Members of this Council who had advised on this matter, have read the same in Council and found therein that he, the advocate fiscal, most forcefully opposed the sentiment expressed in our aforementioned letter to your Right Honorable Worships regarding the ventilated point in question of the Veniam Agendi, and still persevered in his Honor's sentiment in that regard; but since, by minute of the 9th of January of this year held by our Council, it was approved by a majority of votes to leave each Member free to make such defense against it privately and send it to your Right Honorable Worships as they might deem somewhat appropriate for their defense, and furthermore to have a copy of the same document delivered to each Member of this Council, nothing further has occurred among us in this regard; it having appeared to us from your Right Honorable Worships' honored letter dated the 10th of November 1735, the extract of which was presented in our Council, that your Right Honorable Worships have already been pleased to declare therein that the cited second article of the statutes of Batavia, upon which our Member Mr. Jacob Van Den Bosch had based himself, does not apply against a plaintiff who comes in the name of the high sovereign authority, which we shall therefore also allow to serve as our guideline for the future. By our letter of the 24th of November of the past year, repeatedly cited herein, it having already been communicated to your Right Honorable Worships how the advocate fiscal, concerning the settled matters of the former 3661. former Malabar Commander Jacob De Jong and his second, Joan De Roede, was provisionally ordered by the Honorable High Government of these Lands to enter into Revision regarding the point of the Rupees, and also that the same Revision had not been pursued up to that time, we must further inform Your Right Honorable Worships in this regard how, on behalf of the advocate fiscal, on the 10th of October last, a certain resolution of Their High Excellencies dated the 7th of September prior was submitted to our Council, by which it appeared that, upon the alternative request of him, the advocate fiscal, Their High Excellencies were pleased to approve stating the fatalia Revisionis until the first expected letter from Your Right Honorable Worships from or after the Hague deliberations should be received from the Netherlands by Their High Excellencies; which having been received by us for communication, we are not in a position to impart anything further to Your Right Honorable Worships in this regard. to be a matter that, with respect, depended directly on their department, based on the principle that is notorious in law that all appeals devolved from one judge to another, and therefore admission from the superiors, along with the consequences thereof, always had to be requested, for which reason the Council also requested of Their High Nobilities that in the future such supplicants might be referred from there and sent over to this Council, in order for us to dispose of them as we should find proper in good justice; whereupon Their High Nobilities were pleased to resolve by their venerated resolution of the same day to persist in the previous custom according to the prior examples thereof; there having been brought before our Council two bundles of criminal case files, with an accompanying bundle of documents recently sent hither from Mallabaar, in order to serve before our court in the event of appeal here, we, after reviewing the same, requested our President to present the same back to Their High Nobilities, declaring that we were not in a position to be able to dispose of those cases, for reasons that, on the one hand, the delinquents had not also been sent over hither, and on the other hand that the Mallabaar commander Iulius Valentijn steijn van Golonesse, instead of finding himself aggrieved by the sentences rendered there and having the provisional fiscal there, Corijn Stevensz:, lodge an appeal, had constituted himself appellant, not only against the aforementioned criminal sentences, but even moreover against the demand which the provisional fiscal had brought there against these delinquents; whereupon Their High Nobilities were pleased to approve by minute of 14 September to have the aforementioned case files returned to us, together with the excerpt from the Cochim letter concerning this recorded appeal, in order to inform Their High Nobilities in writing of the irregularities and informalities residing in those proceedings for the instruction of the Mallabaar ministers for the future; which we demonstrated in a written representation on the 28th following, that the delinquents, contrary to notorious law, constant usage, and prevailing practice, had also not been sent over, and thereby completely deprived of their lawful defense which they could have made before the superior judge, and which may not be refused, so that the judge, being fully informed of all circumstances and the true state of the matter, may be all the better enabled to proceed with peace of mind to their acquittal or condemnation; besides that one of these delinquents was not a Company's subject, but according to the Mallabaar ministers' own letter a subject of the Cochim king, consequently also not subject to the jurisdiction of this Council, but ought to have been handed over for punishment to the said Cochim king there according to the tenor of the contracts without any further recourse; that furthermore this Council had also noticed that the Mallebaar commander Van Gollonesse, instead of finding himself aggrieved by a sentence of the Council of Justice there and having the provisional fiscal appeal therefrom, had, contrary to all style and manner of proceeding, appointed himself as appellant, not only against the aforesaid rendered sentence, but also moreover against the demand which the provisional fiscal had brought there against these delinquents; the sailor Marcus sement of amsterdam having been sent up to us by the ministers of Amboina, who had been apprehended there for theft committed, and against whom the provisional fiscal there, Ian Kleijn, had made a demand and concluded that he, together with the now deceased sailor Coenraad De Waker, should be brought to the ordinary place of execution and there severely flogged, branded, Coenraad De Waker shackled in chains for five and Marcus sement for ten years to work without wages at Loehoe at the Honourable Company's sago bakery and remain banished; but he, Marcus sement, having only been condemned by the Council of Justice there to be severely whipped and to work without wages for the period of six months on the Company's equipment wharf, with forfeiture of six months' pay a uso, and condemnation in the costs and expenses of justice; for which reasons the provisional fiscal Ian Kleijn was then also ordered by Governor David Ioan Bake to appeal from that sentence before our Council; so that, the appeal having also been properly prosecuted here before our court by the advocate fiscal, the aforesaid Marcus sement was condemned and executed by us in such manner as Your Right Honourable Honours, if it please, may verify from the sentence recorded among others in the register of our papers. Barent Felist, bailiff of this Court, against whom the advocate fiscal demanded on 23 November of the past year, concerning unfaithful conduct committed in his service, that he should be dismissed from office, rank, and salary, to be sent back to the fatherland with the first return ships as a useless and harmful subject, and to perform ship's duty for his board; however, the same was dismissed on the said day by sentence of this Court from the office of bailiff, never to be allowed to serve such an office of honor again, with the rejection of the remainder of the claim. Hendrik Roelofsz of Groeningen, sailor on Onrust, prisoner of the Lord, having been absent for fourteen nights and furthermore having a cutlass found in his possession, was on the 30th of the same month of November, by sentence of this Court, severely flogged with a rope behind the town hall here, riveted in chains for the term of six months, and condemned to a fine of one month's salary pro fisco. Jacobus Bunnegam of Ter Veer, chain-gang convict in the Honorable Company's craftsmen's quarter, prisoner of the authorities, on the 17th of April 1736, for insolence committed against the sentry and physical assault against the person who had supervision over him as a prisoner, was, according to sentence of this Council, brought to the Honorable Company's craftsmen's quarter, and having there been delivered over to the executioner, in the sight of all the chain-gang convicts, tied to a post, scourged with rods on his bare back, branded, and again riveted in chains, in order to labor therein for the term of five years, in addition to his previous banishment, on the Honorable Company's public works without wages, and to remain banished to such place as the Noble High Government of these lands might be pleased to see fit, as well as condemned to the costs and expenses of justice. Lo Boenko, Chinese, sent here with the ship Valckenisse from Cheribon, was on the 18th of April aforesaid, on account of his suspicious wandering, according to 3681 sentence of this Council, riveted in chains for the term of six months to labor on the Honorable Company's public works. Godfried Graadhaan of Straalsom, sailor on Beukestijn, was on the 23rd of May, for absenting himself for five nights and, moreover, having let his ship sail away to Ceylon, according to sentence of this Council, severely flogged behind the city hall here and riveted in chains for the term of six months on the Honorable Company's public works without wages. The Lords Orphan Masters of this city, having under their administration the estate of the deceased former governor of Ceylon Stephanus Versluijs, as such and in that capacity defendants in this case, on the 21st of March last on the roll of this Council it was concluded by the lord advocate fiscal that the lords defendants in their aforesaid capacity should take over the briefs of the lawsuit, and further proceed with the lord ratione officii plaintiff according to the latest prior records; against which it was concluded on behalf of the lords defendants in their capacity to the effect of inadmissibility, and subsidiary to the dismissal of the lord ratione officii's claim cum expensis; and subsequently on the 27th of June last, according to 3683 sentence of this Council, the request of the high lord ratione officii plaintiff was granted, and accordingly the lords defendants in their capacity were ordered to take over the briefs of the lawsuit, as well as to proceed further with the lord ratione officii plaintiff in accordance with the latest prior records, and furthermore the costs incurred hereupon reserved until the conclusion of the principal case; but from which sentence the lords defendants in their capacity were, upon their request, admitted to revision, and subsequently that case is already pending in statu. Subsequently, on the 12th of September last, according to the sentence of this court, the defendant was dismissed from office, rank, and salary; further declared unfit ever to serve the Honourable Company in any position of honour hereafter; furthermore, condemned to be sent from here to the fatherland as a harmful and useless subject, to perform sailor's service for his board during the voyage, with condemnation in the costs and expenses of justice.
