to proceed to the sale of the goods, they shall be obliged to present to their board the state of the estate, namely the funeral expenses, and furthermore the debts of the estate which shall certainly be known, insofar as they have been capable of casting doubt upon the sufficiency of the estate, and against this set all the assets found present, outstanding debts, etc., so that it may then be examined by the same board whether such estate, being converted into money, would be sufficient or not, in the first case to proceed to the sale of the goods and the further administration thereof, but in the latter case to desist therefrom from that hour onwards, and to hand the same over to the respective Courts of Justice as a notorious insolvent estate. The argument made by their Reverences by petition concerning articles 12 and 13 drafted for the instruction of the estate masters regarding the security de restituendo established therein cannot come into consideration here in the very least, since the same has been entirely derogated and abolished by the aforementioned resolution of your High Nobilities; this council considering in any event that if such a request according to the express words ordained to the estate masters in the 12th article, namely to make payment to the creditors pro rata, were granted to the gentlemen orphan masters, it would then absolutely result therefrom that in such a case one would have to confer upon the orphan masters a right of judicature over insolvent estates, and that in order to pronounce sentence between the creditors and the estate after summary proceedings had been held, and likewise to judge on concurrence and preference, which judicature would then at the same time also have to be evoked from the Council of Justice and the aldermen of this city, directly conflicting with the Batavian statutes under the title of insolvent estates. might lay down, that it should then still have to be made, it being otherwise especially to the detriment, that under the subject of Bengal their Honorable High Mightinesses had noted from a certain extract from the salary ledger of Bengal of the year 173¾ folio 169 that there the custom was to pay notarial bonds with preference before other personal debts, which their Honorable High Mightinesses believed to be very improper and nowhere customary in law, so that the same, as a corrupt and evil practice, ought henceforth to be abolished. Thus this Council has deemed it their duty to present to your High Honors that, with regard to the first concerning the Company's precious spices, this Council has repeatedly raised difficulties in absolutely sentencing the buyers and illicit traders to death, and punishing them equally with spice thieves, since by two different placarts issued on behalf of the high authority here, the same has been left to the discretion of the judge, as in the one dated 9 October 1655 it is specifically established that those who are found to have transgressed by buying up and transporting spices, without any connivance, grace, or dissimulation of whatever quality or condition they might be, as an example to all fraudsters and thieves of the Company's resources, besides confiscation of their goods, or also ships and vessels with which it might have been attempted to transport the stolen goods, shall be punished in body and life, according to the exigency of matters; and in that dated 24 May 1689 that such persons shall only be punished in body or life according to the exigency of matters. Regarding now the last mentioned extract concerning the noted preference observed in Bengal, this Council cannot refrain from submitting to your High Honors that indeed in the fatherland before the year 1665 notarial bonds and aldermen's acknowledgments containing general collateral held preference on movable property before personal debts; yet, it having been found that this tended to the considerable prejudice of the public revenues, the Noble High and Mighty Lords States of Holland and West Friesland, by proclamation of 5 February 1665, resolved and established that from no bonds, general or special, whether aldermen's acknowledgments, notarial bonds, or others, howsoever they might be named, any preference, whether on immovable property, tithes, or rights, might be enjoyed, except in so far, and for as much as, the fortieth penny thereof at the time of the passing of the aforesaid bonds had been paid for the benefit of the common weal; which, however, appears to have been enacted at that time solely and for no other reason than for weighty reasons for the necessary service of the country, because through that penalty which was placed on the notarial bonds and aldermen's acknowledgments on which no fortieth penny had been paid, the revenues of the country were considerably benefited. But since such does not take place in these lands where no 40th and 80th penny is paid, and also such appears to have been noted by your High Honors from old times on account of the evil consequences and detrimental results for the good inhabitants of this colony, who through such means would notoriously be deprived of their property by a party of natives, to whom, for the maintenance of their household, one must entrust his money here for a decent interest. Therefore also in the Batavia statutes under the title of notaries it was established that the Chinese would have to pass their bonds and acknowledgments of debt before a secretary or notary, and moreover by general resolution of the Castle of Batavia taken in the Council of India under date of 20 August 1672 it was resolved that according to ancient custom aldermen's acknowledgments should have preference before all notarial bonds, and among notarial bonds the older before the younger, and further before all other private bonds, even if the same were attested by signature with three witnesses, and furthermore were properly incorporated into the Batavia ordinance book; so that the courts of justice here and throughout all of India have always followed this in passing their sentences in cases of preference and concurrence, and it has been introduced from the earliest times of this colony; aside from and besides that the aforesaid proclamation of their Noble High Mightinesses cannot have the least agreement with the constitution of these lands, both because of the great inconveniences which would notoriously arise therefrom to the ruin of this colony, which is currently in a bad enough state, and would truly come to arise principally through the nature of the native, who generally being of a bad character and full of evil practices, would not fail to put the same into operation and make use of it in a deceitful manner, especially when such persons, laden with a party of debts and convinced of the insolvency of their estates, by the passing of notarial, and the granting and antedating of private bonds and instruments of collateral as otherwise, could even pursue their advantage in such a manner to the prejudice of lawful and other creditors, notoriously to the violation of the privilege that the good inhabitants have obtained through such notarial acts or aldermen's acknowledgments by virtue of the local laws of these lands, so wholesome in the manner mentioned hereinbefore, which were established for no other purpose by the statutory laws.

3749 Monday the 8th of October 1736. — Extract from the Register of Resolutions of the High and Mighty Lords States General of the United Netherlands. There was read at the assembly the petition of Godefredus Stolts, married to Hester du Buisson, formerly widow and sole universal heir of the late Joh:s Hend:k Carnak, stating that the late aforesaid Joh: Hend:k Carnak had resided for a considerable time as chief surgeon in the service of the East India Company at the Cape of Good Hope, and in the year 1708 intending to repatriate and to fetch his aforesaid wife in order to establish their residence at the aforesaid Cape, had for that purpose given in custody and entrusted his goods and effects, which he possessed there, to one Michiel Leij, free burgher there, and thereupon had departed for these lands; that the aforesaid Carnak, having arrived at Amsterdam still in the aforesaid year and finding himself indisposed there, by his testament passed on the 25th of October 1708 before the notary Michiel Servaas and certain witnesses, had instituted the petitioner's aforesaid wife as his sole and universal heir, and had also confirmed the same with his death; that some time afterward the petitioner had entered into the state of matrimony with the aforesaid Hester du Buisson and had learned from her that in the possession of the aforesaid Leij were the goods left by the aforesaid Carnak in his custody; that he, the petitioner, subsequently had traveled to the Cape aforesaid, and had there requested that the aforesaid Leij would restore the aforesaid goods to him, but with no other result than that the aforesaid Leij had attempted to stall the petitioner, and thus from time to time had demanded of the petitioner proof that his aforesaid wife was the heir of the aforesaid Carnak and that she had lived in community of property with him; the petitioner requesting, for reasons alleged in the aforesaid petition, that their High Mightinesses may be pleased to write to the Councils of Justice at Batavia as well as the Councils of Justice at the Cape of Good Hope, to finally settle the aforesaid matters which had been kept dragging on for so long. Whereupon, deliberation having been held, it was approved and agreed that a copy of the aforesaid petition shall be sent to the Directors of the East India Company at the presiding Chamber in Zeeland, and that they be written to send such orders, both to Batavia and to the Cape of Good Hope, that good, summary, and prompt justice and expedition of justice may be administered to the petitioner. The Orphan Masters and the aforesaid Court of Justice should not rather leave the assembly free as being unable to vote in this matter because of the votes given by Their Honors over the same in their colleges, in order to step outside during the deliberation. And after this had been approved, and the said Mr. van Schinne, on the foundation of the homeland order in the letter of 1 November 1709, protested against stepping outside as President of Justice, and maintained that not only was the right of a President thereby prejudiced, but also that the said representation was too premature and did not belong to or before this government, but indeed before the Court of Justice, with a request that, in case it should be disposed of, the passages cited therein might first be looked up and examined. And thereupon the aforesaid contention was likewise put to the question and judged that the aforesaid matter indeed belonged to this government and ought to be requested of the same, and for that reason the Orphan Masters could not have addressed themselves anywhere else either, and subsequently the passages cited in that representation from the letter of this government to the High and Noble Gentlemen Seventeen of 30 November 1716 and the answer received thereto from Their Right Honorable Worships by letters of 8 October 1717 concerning a certain inventory of the estate of the deceased skipper Ian Maillard were also read out at the same time according to custom before the deliberation, and the said gentlemen having then, at the request of the said His Honor, stepped outside and left the assembly free, it was, after consideration of what was necessary, approved and agreed, for such reasons as are to be extended in the resolution, Bengalese turn No. 33 Sale of Coromandel to exempt and discharge the Orphan Masters from handing over, upon the citation of the Advocate Fiscal of India, the demanded extract from the private books or accounts of the hereinbefore mentioned deceased Head Cashier van Landschot, or from making any disclosure thereof. Wherefore it was at the same time agreed to have an extract of this decision delivered to Their Reverences, in order to stand therewith before the Court of Justice upon further summons. well-known iterative orders of the Noble Highly Esteemed Gentlemen Seventeen, agreeing with the good maxims of all well-policed governments, the highly important occupations of Your High Excellencies are from time to time increasingly interrupted by diverse persons and especially by the aforementioned College of Orphan Masters with matters that should strictly pertain only to justice, the administration of which has successively been commended to our Council, which manner of proceeding can have no other aim than that one seeks, through authority as well as otherwise in a political way, to obtain that which ought not to be obtained otherwise than by way of justice and by an orderly administration of law, the harmful consequences which might result from this for the future we shall leave to the wiser deliberations of Your High Excellencies, who, to prevent the same, have already all too often pointed out the proper way to such importunate petitioners and not long ago to their Reverences themselves, when a grievance was lodged by them and nullification demanded of two rulings of our Council concerning the surrender of certain papers regarding the estate of the late Noble Lord Versluijs. That what the Orphan Masters have now again implored relief for from Your High Excellencies in the aforementioned representation is notoriously of such nature that it should not have been, and still ought to be, decided otherwise than through ordinary No. 33 sale of Coromandel [illegible] ways of justice, will be clearly evident if it is merely considered that the obligation or non-obligation to furnish the extract, as our Fiscal has concluded in court, has become a question of law and a judicial dispute before us between them and their Reverences, which, having been introduced before us, consequently cannot and must not be dealt with and decided anywhere else, and that their Reverences have as yet been condemned to nothing nor has anything been enjoined upon them, and they consequently need or can request no relief at all, at least for the present. This, having been briefly stated, will appear all the more evident when on the one hand it is observed that it is the Gentlemen Orphan Masters themselves who, having under their administration the estate of the aforementioned deceased head cashier Landschot, have summoned the former First Senior Merchant of this castle Ian Herman Theling to satisfy an excessive sum of money as the balance of a final account, and that they have not only submitted this extract but also (however unnecessarily, having an admitting defendant) have added thereto with special emphasis a certain insinuation from which the Council had to form strong presumptions and gain occasion to believe that the said debt resulted from a very strictly forbidden private trade, and that their Reverences, therefore, being the sole cause of all that followed, could and should have foreseen that the Council, bound by oath and duty to watch over the welfare of the Company, would have the necessary investigation conducted in this regard, and also that for the conviction of the said Theling no better proof could be found than the whole of that which had been produced against him by extract, and when on the other hand it is examined how we proceeded thereon with the utmost moderation and circumspection, and no grievance whatsoever regarding their maintained secrecy was inflicted upon the Gentlemen Orphan Masters; for after our said Advocate Fiscal was enjoined to perform his office and duty regarding the aforementioned Ian Herman Theling, and we, the case having reached the stage of judgment, found upon examination of the trial that their Reverences had declined, upon the aforementioned officer's petition, to supply the extract in question authentically from the books of Landschot, we indeed judged that without further information and documents we could not for the present condemn the said Theling, nor, after what was already charged against him, completely absolve him, and therefore deemed the aforementioned extract entirely necessary, but the College of Orphan Masters was never absolutely, directly or indirectly ordered No. 33 sale of Coromandel ordered to give the same, as it appears to us to have been understood by them and subreptitiously and obreptitiously presented and dished up to Your High Excellencies, but our interlocutory sentence of the 26th of November last, annexed hereto, simply instructs the Fiscal to demand that extract from their Reverences through the path of justice and to supply it to us (namely, if he could reach and obtain it through that channel), so that this operative part does not in the least or most affect or injure them, and thus no relief can be granted to them from it, as such extraordinary means and remedy are available to and remain for no other than one who has bound himself to something or might already be held to something that aggrieves him and for which no redress can be obtained through the ordinary ways which were abundantly open to their Reverences, even if they had already been condemned (which, however, was by no means the case). incompetence, or, wishing to debate the merits of the case itself before us, to be able and permitted to allege by way of answer (as they were also evidently obliged to do by taking a day and engaging before us as judges) all such reasons, motives, and defenses with which they would desire or have deemed themselves able to debate the petition or the conclusion and to demonstrate their lack of obligation regarding what was required. Whereupon their opposing party, replicating against this, would also have brought in his interests, and they, having further advanced in the rejoinder whatever might still be serviceable to them, with full knowledge of the case, we would have proceeded to a dismissal or adjudication as found appropriate. And had such a sentence turned out to the disadvantage of their Reverences, the aforementioned ordinary path (namely of revision) would in that case have stood open for them to take subsequently; and only when that was concluded would it have been the time to lean toward such extraordinary remedies, if indeed they could have any place, as people have now seen fit to employ far too prematurely and without yet feeling any grievance, and whereby we are manifestly defamed in an odious manner by orphan masters, as though no proper, equitable justice would have been done to them by us, and people therefore did not trust our decision on the grounds of defense, whereas to our knowledge we have nevertheless given no ground for suspicion, and whereas the power remains with Your High Noble regarding us, after we have already rendered sentences, upon suspicion that things might go ill, to demand reasons for our decisions and proceedings for the sake of elucidation and reassurance. We flatter ourselves that if we had been fortunate enough to have had the above-mentioned memorial of their Reverences placed in our hands, as on previous occasions, in order to bring forward our considerations regarding it, Your High Noble, through what has been deduced hereinbefore and what further could have been framed against their Reverences' reasonings as well as for the destruction thereof, would perhaps not have been inclined to adopt the aforementioned resolution. And for this reason, we also hope that, upon this remonstrance, by altering the said decision, their Reverences will still be turned away with the request made by them (as the matter completely pertains to justice), and be ordered, upon the further citation of the advocate fiscal, to defend themselves or answer before us as they shall see fit, to the end that this dispute may thus be settled by us with full knowledge of the case as we shall find proper, and that we may further become able to terminate the principal lawsuit, which due to this incident must remain undecided, because we were forced to stay the aforementioned incident between our aforementioned fiscal and their Reverences pending our further disposition. In this confidence we could now safely conclude, but since it has further come before us from the extract of the minutes containing the aforementioned resolution of Your High Noble that, after a previous round of questioning, it was deemed fit not to admit our president to vote in the aforementioned case, but to make him step outside the assembly during deliberations on the same, we cannot refrain from addressing our complaint to Your High Noble in this respect most reverently, as we, subject to correction by better judgment and as we believe on good grounds, are completely of the opinion that the presidents of our council, although not being political members, not only may and must appear and take their seat in Your High Noble's assembly, but moreover, in matters of justice and related and applicable thereto that come before Your High Noble's table, may give their sentiment and advice, as well as have a casting vote, as this can be found virtually verbatim in the dispatch of the Lords Masters dated 1 November 1709, especially when that which is ordered there concerning the president is compared with that which their Noble High Mightinesses had enacted a little further with regard to the presiding member. To which is added that this was also the understanding of Your High Nobles yourselves, who permitted the aforementioned various things to the late President Mr. Cornelis van Gaasbeecq, yea even in judicial matters as far as the signing of the resolutions, and thereupon received complete approbation through the letter of the Lords Seventeen of 33 August 1732. would have to stand outside and remain deprived of voting. Against this, a distinction cannot operate between matters in which a vote has already been cast in the college of our Council by the president, or others; for, apart from the fact that this exception is nowhere discovered in the letters from the Fatherland nor elsewhere, if it were adopted, those cases would also have to be excepted in which the president might subsequently have to vote in our college, and in that manner the mentioned seat and concluding vote would practically never take place, and the intention of the gentlemen masters would almost always be defeated, since virtually no matters of justice or related thereto can occur before Your Excellencies without having been before our Council or being subject to devolution to it, and the president has consequently advised on it or is due to do so. To all of which is added that the mentioned distinction would run diametrically opposed to the sentiment that Your Excellencies conveyed by letter of 21 October 1735 to Coromandel, namely that at the outer stations the members of the Judiciary who simultaneously hold a seat in the Council of Policy must remain seated and retain a concluding vote when dispositions are made concerning reliefs and even remissions against sentences that have already been pronounced by the Council of Justice. The principal reason for this resides in the fact that, although two votes thus appear to be conceded to them and might also be said to belong to our presidents, there nevertheless exists this notable difference between the two: that the vote given in the Judiciary is solely judicial, or serves between contending parties for the decision of a pending lawsuit, and the vote that comes into play in Policy tends toward the maintenance of the jurisdiction and the honor of their College, as well as the progress of the ordinary paths of justice, or toward mere political decisions, which are very widely different from one another. Let alone that, in the present case, our president in our Council has thus far simply voted only on whether the fiscal should be ordered to demand from the gentlemen orphan masters, through the proper channel and in the service of Justice, the entire account of which an extract had already been produced to us; and that before Your Excellencies a question was ventilated concerning the very act of giving it or not needing to give it, and thus concerning something entirely different, which ought to have been brought before us and would then have been decided once the proceedings initiated for that purpose by the fiscal had been completed and made ready. So that the aforementioned president, who even happens to be a political fellow member of Your Excellencies and has not yet voted on the point of deliberation at Your Excellencies' table, with all due reverence in any case ought, in our opinion, to have remained seated and likewise to have voted. Wherefore we conclude, in this expectation, that what has been put forward here will not be taken amiss, but may be taken into some consideration on further occasions in the future. Saturday the 24th of January Anno 1739. Friday the 23rd of January 1739; Presentibus omnibus The Noble Lord President of this council, Mr. Isaac van Schinne, having brought into the council the following Extract from the minutes of the proceedings and resolutions in the Council of India: A remonstrance from the Council of Justice of this castle having circulated among the gentlemen members and now returned for disposition, against the request made to this government by the Orphan Masters of this city in a document dated the 30th of December of the past year, which resolution had been communicated to their honors in extract, it was, after it was understood upon the proposal of the Lord Director-General to request the Lords Presidents van Suchtelen and van Schinne to remain outside during the deliberation, and the said Lord van Schinne having in the meantime testified to leave such to the judgment of the government and to their pleasure, the said gentlemen having then stepped outside, it was approved by a unanimity of votes, after consideration of what was necessary, to persist in the aforementioned resolution of the 30th of December past, and to send the prescribed declaration of their honors, just as that of the Orphan Masters, in copy to the High Noble Lords Seventeen in order to await their Noble High Mightinesses' honored pleasure and elucidation. Beneath stood: agrees. Was signed: G.s Cluijsenaer, secretary. So it is, after resumption thereof, understood not only to have the same inserted into the memorial of this council, but also to attach a copy thereof to the proceedings, and in the meantime to keep the suit or rather the instance of the Lord Advocate Fiscal against the Lords Orphan Masters suspended until such time as the orders and elucidation of their Noble High Mightinesses the Lords Principals concerning this shall have been received by this council.
