Coromandel Bengalese Linens sale of Amboina riveted in irons, also sentenced to the fine of one month pay pro fisco et cetera. Jan Jansz of Nieuwerkerk, cook in the Company's hospital, prisoner of the lord for committed great excesses, was on the 5th of March aforesaid, according to sentence of this Council, banished as a useless and dangerous subject from all cities, forts, and places belonging under the jurisdiction of the Honourable Company, never to be allowed to return there, upon penalty of heavier punishment, further ordered to be sent to the island of Edam until the departure of the first return ships, in order to serve there for his food for that long, with condemnation in the costs and expenses of justice. Claas Jansz Olij of Hoorn, young sailor on the Binnewijsend, prisoner of the lord, was, for injuring himself, on the 26th of the frequently mentioned month of March, according to sentence of this Council, condemned as a useless subject to be sent from here to the fatherland, in order to perform ship service for his food during the voyage, with condemnation in the costs and expenses of justice, but the same came to pass away here in the Honourable Company's prison on the 1st of August 1738. Simon Jansz van de Vijver of Amsterdam, chain gang worker in the Honourable Company's artisan quarter, prisoner of the lord, was on the 26th of the aforesaid month of March, for breaking his chain, according to sentence of this Council, brought here to the Honourable Company's artisan quarter, and there being delivered to the executioner, tied to a post, severely flogged with rods on the bare back, and riveted back in the chain, in order to serve out his previous banishment there, with condemnation in the costs and expenses of justice. The seized forty-eight pieces of elephant tusks, weighing together eight hundred thirty-five pounds, which were discovered at sea by the officers of the vessel Watervliet among the goods, as was alleged, of the chief surgeon Albertus Hesseling who died on the outward voyage, and upon arrival here in the roads, by order of the Advocate Fiscal, were removed from on board by the bailiff of this Council on the 27th of November 1737, and brought into the Company's warehouse at the Water Gate; in this case, on the 2nd of April of this year, by sentence of this Council, against all unknown and non-appearing claimants, the fourth default was granted ex superabundanti, and for the benefit thereof, deprived of all their right, action, and claims which they might have and claim to have had on the above-mentioned seized forty-eight pieces of elephant tusks, with the imposition of perpetual silence, furthermore the just mentioned forty-eight pieces of elephant tusks confiscated, so that the net proceeds thereof, deductis deducendis, shall be distributed ad usus. Jacobus de Rooij of Rotterdam, citizen here, prisoner of the lord, and petitioner of appeal, with the clause of relief regarding the lapse of time and improper prosecution of this appeal; in this case, by the Bailiff of this city, Pieter Boekestijn, for bigamy and whatever else pertains thereto, on the 15th of August 1736, in the first instance by written criminal demand it was concluded that he, the prisoner, should be brought to the ordinary place of justice, and there being delivered to the executioner, with two distaff heads above the head tied to a post, severely flogged on the bare back with rods, and further banished for the period of ten consecutive years to the place where the court of this city should see fit, with condemnation in the costs and expenses of justice; subsequently on the 17th of July 1737, by judgment of the Aldermen of this city, the demand of the officer was adjudicated, and the prisoner condemned to be brought to the place where criminal sentences are customarily executed, and there being delivered to the executioner, with two distaff heads above the head tied to a post, severely flogged on the bare back with rods, and further banished for the period of ten consecutive years to wherever the Noble High Government of these lands shall please to find good, with the costs and expenses of justice; furthermore declares the contents of articles 30, 31, 32, 33, 34, 48, 49, and 50 of the reply, item articles 59, 60, 61, 62, 63, 64, 65, 66, 67, and 68 of the rejoinder, as well as articles 133, 134, 135, and 136 of the reproaches, submitted by the prisoner Jacobus de Rooij and his now deceased attorney Petrus Bernardus Meijer, to be offensive, absurd, and impertinent, and condemn the prisoner to immediately strike out and cancel all the same articles at the public roll hearing with his own hand, et cetera; against which the prisoner, having entered himself as appellant before this Council, subsequently on the 21st of August following had conclusions made on the roll of this Council for nullity or correction of the above-mentioned criminal interlocutory order, and that this Council, doing that which the judges in the first instance ought to have done, would dismiss the criminal demand and conclusion of the plaintiff in the first instance made and taken there against the prisoner, and absolve the prisoner and petitioner thereof, with the costs of both instances; and on the 16th of April of this year, after this case had been fully litigated by the parties and brought into state of judgment, according to sentence of this Council the judgment in question was confirmed, and

Theodocus Wilkens of middelburg, chain-gang convict in the Honorable Company's artisanal quarter, the sovereign's prisoner, has according to the sentence of this Council dated the 23rd of April aforesaid, for the breaking of his chain, been brought here into the Honorable Company's artisanal quarter, and there, in the sight of all the chain-gang convicts, having been delivered to the executioner, tied to a post, severely flogged with rods on the bare back, and riveted back into the chain, to work therein for the period of one year beyond his No. 33 3670 his previous banishment without wages, on the Honorable Company's public works and to remain banished, with condemnation in the costs and expenses of justice. Januarij of Bengal, chain-gang convict in the Honorable Company's artisanal quarter, the sovereign's prisoner, for the breaking of his chain, according to the sentence of this Council dated the 14th of May of this year, was behind the city hall here severely flogged with rods on the bare buttocks, and riveted back into the chain, and further condemned in the costs and expenses of justice. Coromandel Bengal textiles sale of Mr. Versluijs, in satisfaction of a certain appointment of this Council containing a sentence to furnish bail in the sum of fifty thousand rix-dollars, were exhibited and handed over to this Council, which request having been denied, and on the contrary their Reverences having been ordered to deliver to the secretary of our Council, under proper receipt, such ten thousand rix-dollars as were paid and satisfied by the bailiff of this city, Pieter Bokes, in satisfaction of a certain bond which, according to a separate receipt, had been paid and satisfied to the aforementioned Mr. Versluijs; after which the aforementioned Orphan Masters, by petition on 17 September of the same year, having repeatedly requested of this Council under many allegations the obtaining of the aforementioned debt instruments under proper receipt, as well as that their Reverences No. 33 3678 might be released from the aforesaid consignment, with an offer to this Council to have withheld from the estate of the aforementioned Mr. Versluijs, until the conclusion of the principal case, an equal sum of money, or otherwise to place an attachment on the funds that were held on deposit with the Honorable Company on behalf of their Reverences' college, which two-part request having likewise been denied by this Council, the aforementioned Orphan Masters some time thereafter requested by petition to be admitted to a review of the aforesaid orders, so that their petitioners were also admitted thereto by apostille of 20 February of this year, and subsequently, on 2 October last, upon the further request of their Reverences to the end that it might please this Council Coromandel Bengal textiles sale of to elucidate to their petitioners, or order against whom the said case in event of review would have to be prosecuted, it was disposed that they should prosecute this case against the secretary of this Council as sequester, and summon the same in the aforesaid capacity to the roll of this Council, as indeed took effect on the 30th of the said month of October; whereupon on 9 October of this year, according to the sentence of this Council and the adjunct reviewing commissioners, it was declared that an error resided in both orders in question, and correcting the same, the requests of the gentlemen petitioners in their capacities were granted; consequently ordering the defendant as sequester to deliver, under proper receipt, to the gentlemen petitioners in their capacities, all No. 33 3679 all such aldermen's acknowledgments, debt instruments, and papers, among which are also included the surety bonds executed by Jan Hendrik Ducaijlar, former alderman, and Evert Lanius, vendue master of this city, on the dates of 9 June 1734 and 26 June 1736, as he still had in his custody on behalf of the estate of the said Honorable Mr. Versluijs, provided that the petitioners in their capacities, in place of the aforesaid aldermen's acknowledgments, debt instruments, papers, and surety bonds, leave a sum of fifty thousand rix-dollars with the Honorable Company until the conclusion of the principal case, and provide proof thereof to the sequester; furthermore, the aforesaid Du Caijlar and Lanius shall then be discharged from their respective executed surety bonds, and it is further ordered that the consigned fine for review Coromandel Bengal textiles sale of be refunded to the gentlemen petitioners in their capacities, with compensation of the costs of the lawsuit incurred in both instances. 3685 Cupido of Bugis, slave of the burgher Appolonius van Hoogstraten, and a chain gang worker in the Honorable Company's craft quarter, prisoner of the authorities, was, on the 19th of the month of November, pursuant to the sentence of this Council, severely flogged with rods on his bare buttocks behind the city hall here and riveted back into the chain for breaking his chain and absconding, to work therein and remain banished for the term of one year, beyond his previous banishment, without wages on the Honorable Company's public works, with condemnation in the costs and expenses of justice. Cornelis Los, burgher of this city, defendant, regarding excessive private Coromandel and Bengal piece goods and the sale of private trade in coffee beans. In this case, on the 26th of November last, pursuant to the sentence of this Council, such sixty-four picols, being the remainder of one hundred and thirty-one picols of coffee beans, as were retrieved in the presence of Commissioners from this Council both from the Tanjongpura, The Thief of Cuyck, and in the dwelling of the defendant and the burgher Mattheus Hoogstraten, and delivered into the Company's warehouses, were confiscated, in order that the net proceeds thereof, deducting the customary deductions, be distributed. Furthermore, the defendant was condemned, pursuant to the placard dated 5th March and published the 10th of April 1726, to pay from the monies already consigned with the secretary of this Council the quadruplum of the aforementioned one hundred and thirty-one picols of coffee beans, amounting to the sum of three thousand one hundred and forty-four rixdollars, also to be distributed in the manner aforementioned. The further or otherwise claimed was denied. Furthermore, it was ordered that the surplus consigned amount, to the sum of one thousand four hundred and sixteen rixdollars, be returned to the said defendant under proper receipt. However, the attorney Dusseldorp was condemned to strike out the 34th, 35th, and 36th articles of the defendant's submitted rejoinder on the public roll with his own hand as offensive and irrelevant to the case, and on that account both he and the defendant were each sentenced, in addition, to a fine of fifty rixdollars for the benefit of this Chamber, together with the defendant in the costs of the suit. This trial, on account of the multitude of papers, will only be able to be dispatched at the next opportunity. Barend Samlant, bookkeeper in the service of the Honorable Company and former secretary of the Orphan Chamber at Colombo; first defendant and hostage, now appellant with the clause of relief against the lapse of time and undue prosecution of this appeal. In this case, on the 31st of July 1733, on account of inexcusable neglects, bad faith, and prejudice to the interests of the orphans committed in his aforesaid function, the Colombo Fiscal Cornelis Danielsz. van der Hoeven served a written criminal claim against the defendant and hostage in the Council of Justice there, and in the conclusion thereof concluded that the defendant and hostage should, by definitive sentence of the aforementioned Council, be condemned: firstly, to restore the missing assets of the late Honorable Lodewijk Hoepels, Sergeant Christiaen Scholts, the insane Chief Surgeon Ian Verbrugge, and the Merchant the Honorable Martin Kalkberner, all in accordance with the report of the commissioners of the 18th of March of this year, and, in the event of inability to fulfill the same, according to the valuation and moderation of the judge; and furthermore, that the defendant and hostage should be declared forfeited of and unworthy to hold the least or slightest dignities, and consequently be brought to the ordinary place of execution, there delivered to the executioner, tied to a post, severely flogged with rods, and banished forever from the aforementioned island to such place as the judge, subject to the approval of the high government there, should be pleased to decree, furthermore in the costs and expenses of justice. discharged, while his legal action regarding the bond of the free burgher Hermanus vanden Bosch, executed to his benefit in the amount of rd:s four hundred, was reserved, with compensation of the costs of the trial, against which the said defendant, now petitioner, having appeared before this Council as appellant, subsequently on the first of October of this year, caused to be concluded on the roll of this Council, firstly for the ratification of the obtained relief, and furthermore demonstrated to this Council that, through the violent and iniquitous proceedings conducted against him for the duration of four consecutive years on Ceylon, he was reduced to such a destitute, impoverished, and deplorable state that he was thereby deprived of all means to be able to bear or pay the expenses of the appeal and the proceedings that were to arise therefrom, for which, and more reasons alleged therein, he, praying this Council, might be favorably exempt from the fine of the frivolous appeal, and the attorney Dusseldorp might be enjoined to serve him, the petitioner, in this matter pro deo, which by this Council (after the advocate fiscal of India had consented thereto) was also granted, and the relief regarding the lapse of time and undue prosecution of this appeal obtained by the petitioner from the Noble High Government of these lands was ratified according to its form and content, concluding principally in his submitted written claim for nullity or correction of the judgment in question, and that this Council, doing that which judges in the first instance ought to have done, should deny the amplification of the conclusion of claim made and taken against the petitioner, as well as the claim itself, completely absolving him of the one and the other, as well as discharging him harmless from the detentions or so-called bodily confinements in which he was successively placed and held, both with and without everything, first from 26 June until 24 November 1733, subsequently from 29 December of the same year until 5 January 1734, and finally from 24 June 1735 to the present date, with reservation of his action for injuries, costs, damages, and interest already suffered or yet to be suffered through these enormous and vexatious proceedings as well as through the unlawful seizure, the inventorying, and sale of his goods, to institute the same wherever and however it is appropriate, also making a claim for costs regarding both instances; the parties having fully pleaded regarding the request made by the defendant, now petitioner, to be discharged from his civil detention, and on the same day by disposition of this Council, the petitioner was discharged from his civil detention under a hand-pledge and promise nevertheless to appear again in court at all times when summoned sub poena confessi et convicti, after which this case on 26 November of this year, having been settled principally according to the sentence of this Council, the judgment in question was altered, and ruling anew here in appeal, the latter proceedings concerning the amplification of claim were annulled as informal and unsustainable, therefore denying the conclusion of amplification of claim made and taken on Ceylon against the petitioner, furthermore reserving to the petitioner such action for damages and interest already suffered or yet to be suffered through these proceedings as well as through the seizure, inventorying, and sale of his goods, to institute the same wherever and however it is appropriate, though nevertheless also leaving reserved to Francina Pieris such action regarding the estate and inheritance of the late junior merchant Martin vander Burg as she believes to have in that regard against the petitioner, to institute it directly here before this Council, as should be advised, furthermore approving the further content of the interlocutory order in question, and declaring the petitioner not to be aggrieved thereby, as well as discharging the petitioner from the hand-pledge and promise made to appear at all times when summoned sub poena confessi et convicti, and the lord advocate fiscal was condemned, as he is involved in this matter, in the costs of the trial incurred regarding the amplification of claim, but the further costs of these proceedings, both in the first and in this instance, were compensated, for reasons moving the Council thereto. held under advisement, whereupon on the 10th of October following, it was made known by the advocate fiscal by libel that mauregnault on the roll of the 3rd aforesaid had accused his Honor that his Honor began to take more and more pleasure in tormenting him mauregnault somewhat, as well as delaying him with frivolous cavils and chicanes, or to further deprive him, if possible, of his defenses, of which people seemed to be afraid, etc. Since it was as clear as the sun at noon from the pleadings and slanders uttered by him mauregnault to the insult and humiliation of him advocate fiscal in full Court, in the sight and hearing of the attorneys, which having recently been strictly forbidden by this Council, he mauregnault, no less than other practitioners, could not be ignorant thereof, he advocate fiscal, having been absent on the aforesaid day due to indisposition and consequently at that time unable to make any request in that regard, was compelled to request, both for the preservation of his honor and the dignity of his office and for the restraint of this and other slanderers, to reflect upon this when disposing of this incident, and accordingly to correct both the aforesaid mauregnault and his attorney according to the exigency for their foul slandering, which was held under advisement, whereupon the defendant having addressed himself by petition to this Council on the 15th of November following, but with regard to the last member having been referred to the public roll, he summoned the Lord Fiscal, plaintiff, on the 28th of the same month to hear the request that he petitioner, notwithstanding the state of the proceedings, might so amplify and alter his conclusion of response taken apud acta as he should deem useful for the furtherance of his good right and for a lawful defense, and therefore to be restored against the default that he had not done so at the proper time, as well as relieved of all faults and omissions committed therein, and also to hear requested, in accordance with the previous ruling of this Council of the date 26th of September 1736, relief of production, provided that he pays the fine set therefor and refunds the costs of the delays, as well as under benefit thereof to see him petitioner produce such documents and proofs as he should believe to need for his excuse and defense; against which the exception of Res Judicata having been proposed by the advocate fiscal, and mauregnault having replied in the principal case, as well as answering against the aforesaid exception of Res Judicata having concluded to the rejection thereof, the advocate fiscal by way of duplica in the principal case requested that the aforesaid mauregnault, on account of the sharp, foul, and scandalous expressions set down in the first-mentioned reply in the principal case, might be corrected, either with an imprisonment on bread and water for the time of eight days, or with a heavy pecuniary fine, or otherwise as should be found to belong in good justice, and further persisted by duplica, the matter concerning the request for amplification of the conclusion of response and relief of production was fully argued by the parties and held in a state for judgment; but upon further resumption of the same matter, it having been perceived that the just-mentioned exception of Res Judicata was not yet fully argued, the parties were ordered by interlocutory sentence dated the 9th of January 1737, instead of ruling on the mentioned exception of Res Judicata and the further mutual requests dated 3rd of October and 28th of November 1736, to first fully argue the same exception on the next court day; so that the mentioned advocate fiscal, in accordance therewith, brought this onto the roll on the 16th following, and it being fully argued by the parties, the case in that respect was then de novo held under advisement; subsequently it was determined by this Council on the 23rd of the same month of January by sentence concerning the aforesaid mutual requests and exception of Res Judicata to admit the same exception, and consequently the first member of the petitioner's made request was rejected absolutely, but with respect to the second member rejected for the present, and he mauregnault was ordered to bring the same onto the roll of this Council on the next court day; as well as on account of such indecent, foul, and odious scandalous and slanderous expressions, both in his submitted libels and uttered and set down on the public roll, condemned to a fine of five hundred rixdollars for the benefit of the council chamber, with special interdiction from using such expressions and foul scandalous language in the future, upon pain of arbitrary correction, and condemnation in the costs incurred both with respect to the mutual requests and the proposed exception; Surat Coromandel Bengal note granted, without at that time entering into the merits of whether revision had a place in this matter, but rather regarding the continuation of which revision, upon the request of the advocate fiscal, made in writing to the Noble High Government of these lands, after the advice of the council had been demanded thereupon by Their High Nobles, he, Mauregnault, by resolution of Their aforementioned Nobles dated 26 February 1737, was assigned a peremptory term of one month on default to present his petition for revision, and, upon obtaining the said revision, was ordered to pursue it within fourteen days on the roll of the council, as well as to address Their High Nobles within the same time, after the same should be fully pleaded, to request adjunct revisers, on pain of Number 33 sale of 3701 the pain that, in default thereof, his entered revision would be declared deserted; whereupon the same Mauregnault, having submitted on 27 March the petition to be admitted into revision, then, after the oral declaration of the advocate fiscal had been heard and it had been maintained by His Honour that the specified time of one month had expired by being one day too late, was declared by apostil of that date to be peremptorily barred from his request for admission into revision; but from which request he, Mauregnault, having been relieved by Their High Nobles on the 29th of the said month of March, submitted a certain libel to the council on the following 3rd of April, and submitted therewith an Surat Coromandel Bengal an extract from the minutes of what was transacted and resolved in the Council of India on the aforementioned date of 29 March, requesting at the end of the same libel to be admitted into revision under benefit of the obtained relief, and that the same might be joined to the case as a verdict, which was granted to him, Mauregnault, and he, then also being admitted into revision, brought the case in that capacity before the roll of the council on the 19th of June to see and hear served the statement of claim, advancing then in his libel alongside the petition for revision new facts and a request for correction of the advocate fiscal as should be found to be appropriate in law and good justice; whereupon against the revision itself, by the advocate fiscal, exception Number 33 sale of 3702 exception tibi non competit revisio and of homologation was proposed, as well as concluded for admission of the same accordingly, or otherwise that he, the plaintiff in revision and respondent to the exception, should be declared inadmissible in revision, at least uti procedit; furthermore, that in so far as the same conclusion should be struck off by the executioner on the public roll and in the presence of the plaintiff, etc.; and furthermore, that incident having been fully pleaded by the parties and a ruling requested, the same was taken under advisement regarding the newly raised facts and the proposed exception; whereupon on the 10th of July, by sentence of this council, the first clause of his conclusion was maintained in statu, but he, Mauregnault, was ordered to strike off the second clause of the same on the public roll; furthermore Surat Bengal Coromandel furthermore the proposed exception of inadmissibility and of homologation was rejected, and the request for striking off made by him, Mauregnault, as well as the further mutual requests made upon and against one another, were denied, and the parties were further ordered to plead the case in revision, so that on the 17th of July the case was also pursued and brought to the roll by the advocate fiscal to see served the main statement of defence in revision; and after contrary conclusion had been taken by the advocate fiscal, this case in revision having been brought in statu on the 24th thereafter by the parties, it was subsequently, by sentence in revision dated 19 December of the past year, understood that errors resided in the abovementioned sentences dated 26 Number 33 sale of 3703 26 September 1736 and 23 January 1737, and the same errors having been corrected, the request for relief from the lapse of the terms, and specifically for defence, made by the plaintiff on the date of 5 September of the past year upon and against the gentleman, the defending officer, was granted; accordingly, the plaintiff was admitted into relief for defence, provided that he pays the fine standing therefor and reimburses the costs of the delay; and furthermore the plaintiff was discharged from the fine of five hundred rixdollars imposed upon him by the aforementioned sentence of 23 January, and it was ordered that the consigned fine for revision be returned to the plaintiff, with compensation of the costs incurred in this instance, for reasons; 3704 respondents in this matter, it was concluded by the advocate fiscal on the 21st of March 1736 on the roll of this council that the gentlemen respondents in their aforesaid capacity should accept the attachments of the lawsuit, and further proceed in accordance with the latest retroactive records with the ratione officii plaintiff, against which, on the part of and on behalf of the gentlemen respondents in their capacity, having been concluded to the effect of inadmissibility, and subordinately to the dismissal of the ratione officii claim, with expenses, and the same subsequently on the 27th of June following, pursuant to the sentence of this council, the request of the gentleman ratione officii plaintiff was granted, and accordingly the gentlemen respondents in their capacity were ordered to accept the attachments of the lawsuit, and to proceed further in accordance with the latest retroactive records with the gentleman ratione officii plaintiff, and further the costs Luwaaten Coromandel Bengalese incurred hereupon reserved until the end of the principal case, but from which sentence the gentlemen respondents in their capacity, upon their honors' request, were admitted into revision, and the case subsequently having been put in state, the said sentence was thus also confirmed in this case on the 4th of March 1737 and declared to contain no error therein, in consequence whereof the said orphan masters, having accepted the attachments of the lawsuit on the 20th of the same month, the advocate fiscal, on the 8th of May following, by virtue of the letter from the honorable most worshipful Gentlemen Seventeen dated the 3rd of September 1735 and the resolution passed thereon in the Council of India on the 23rd of July 1736, in relief of the criminal claim served in court on and against the original defendant Stephanus Versluijs on the 2nd of March 1735, No. 33 sale of 3705 after the said orphan masters had consented thereto, was admitted, whereupon he, the advocate fiscal, under the benefit thereof, served an amplification of the same claim and conclusion and submitted alongside it a register with several documents, concluding at the end of that amplification that over and above that which was claimed, the orphan masters in their aforesaid capacity should be condemned by definitive sentence to furnish and pay to the Honorable Company such sum of 147946 Carolus guilders, 3 stivers, and 4 pennies, as the late first resident of Kilkare, Reijnier Helmont, upon his death on his administration, as the remainder of a greater sum according to the latest forced account of the 17th of November 1735 submitted in the lawsuit, Coromandel Bengalese cottons submitted, had remained in arrears, and that with the damages and interest thereof, with expenses; of all of which the orphan masters, serving on that day, having obtained inspection, if necessary a copy, and a day within six weeks, on the 14th of August of the past year an answer in writing was served against it on and on behalf of their honors, and at the end thereof it was concluded to the effect of inadmissibility and subordinately to the dismissal of the fiscal's claim, with expenses, whereupon, against that as well as against the submitted answer of the late Mr. Versluijs, the advocate fiscal having persisted for reply, and their orphan masters for rejoinder, the documents previously submitted were further held as produced, subsequently general reproaches and salvations of law were mutually implored, and thereupon here in the accepted No. 33 sale of 3706 at the secretariat of this council to serve as an inventory of the documents. Bengalese Coromandel Senior merchant of this Castle, defendant in this case, it was moved on the 18th of June of this year by the advocate fiscal concerning private trade against him, defendant, that by sentence of this Council he should be dismissed from office, rank, and salary, and moreover be condemned in the costs; against which, having answered on behalf of the defendant and moved for dismissal cum expensis, this case was subsequently brought to a state for judgment. Whereupon, by interlocutory sentence of this Council dated the 26th of November of this year, the lord advocate fiscal was ordered to demand, through the ordinary course of justice, from the lord orphan masters of this city, as having under their Reverences' administration the estate and succession of the late senior merchant and chief cashier Jan No. 33 sale of goods 3708 Jan van Zandschot, and to furnish to this Council an authentic extract from the book of the said senior merchant van Landschot of the credit and debit concerning the origin of the debt of the defendant herein, together with the closing balance of the account arising therefrom in the sum of 70590: 14 rixdollars, with reservation of the costs until the conclusion of the case in chief. Thus, by virtue of the said interlocutory sentence, on the 3rd of December following, the lord advocate fiscal summoned on the roll of this Council not only the lord orphan masters in their aforementioned capacity, but also the said Theeling; whereupon, on the day of the hearing, fourteen days having been requested on behalf of the lord orphan masters to take counsel, as well as Coromandel Bengalese goods as well as on behalf of the said Theeling, having declared that he could not make himself a party thereto, the requested fourteen-day adjournment was granted to the lord orphan masters. Jan Hilgers, member of the esteemed college of the lords heemraden of this city's environs, having special power of attorney and authorization from Mrs. Euphemia Engelbert, widow of the late Mr. Diderik van Domburg, in his lifetime governor and director of Ceylon, in that capacity plaintiff and appellant with the clause of relief in this case, it was concluded on the 18th of June 1737 by written demand by the Ceylon fiscal Martin Weier—concerning the fact that the cashier Johannes Jacobus Cruse, by order of Mr. Domburg, had received in the Company's small money treasury at Colombo, contrary to the express prohibition of No. 33 sale of 3709 their High Excellencies the High Indian Government, clipped and demonetized money, etc.—that the original defendant in the first instance, as widow, administrator, and heir of the late Mr. Diderik van Domburg, governor of Ceylon, should by definitive sentence of the Council of Justice there be condemned to pay and satisfy to the Honourable Company such sum of twenty-eight thousand three hundred ninety-three rixdollars and fifty-three light stivers as set forth in the aforesaid claim, cum expensis, or for such other purpose, etc. And subsequently, on the 17th of December 1737, by judgment of the Council of Justice at the aforementioned place, the claim and conclusion were granted, consequently condemning the original defendant in the aforesaid capacity Coromandel Bengalese to in the aforesaid capacity, to refund and actually pay to the Honourable Company a sum of twenty-eight thousand three hundred ninety-three current rixdollars and fifty-three light stivers—the rixdollars calculated at 60 light stivers—and this as compensation and satisfaction for the damage that had been done and caused to it by the receipt of a considerable sum of sixty-one thousand eight hundred nine and a quarter rixdollars in clipped and demonetized payments into the great cash room there during the administration of the original defendant's deceased husband, the governor of Ceylon, Mr. Diderik van Domburg, with condemnation of the original defendant in the costs of the lawsuit. to send over there and, in the manner aforementioned, to bring under oath against the widow Domburg, provided that beforehand an authentic copy thereof was handed over to her in due time and legally cited and intimated, in order to be able to submit counter-questions if advised to do so, the said advocate fiscal was not refused this, so that the said documents, together with our requisitorial letters, were immediately dispatched thither. Ioan de Roode, former senior merchant in the service of the Honorable Company and alderman of this city, Petrus Albertus van der Parra, junior merchant, and Adriaen van Ravestijn, bookkeeper in the aforementioned service, as having the charge and power of attorney of the Jewish merchant and resident at Cochim, De Sima Sambon Rotenburg, native of Frankfurt am Main, according to the power of attorney executed on 4 March 1738 before the sworn clerk Gerrit van Dorpen and witnesses at Cochim, thus and in that capacity defendants in the case of appeal with the clause of relief against the undue levying and prosecution of this appeal. In this case, by the junior merchant and former fiscal of Malabar, Corijn Stevens ratione officii, against the original defendant Samson Rotenburg regarding the chartering of the Company's vessel Proostwijk with contraband goods, when the same had departed as a passenger with the aforementioned vessel and had thus arrived back at Cochim, on 8 February 1737 there, a written criminal claim was served, and at the conclusion thereof it was demanded that by definitive sentence he should be declared to have incurred such penalties as the placards and statutes of the High Indian Government of Batavia, as well as of the aforementioned Commandery, did dictate, and that in consequence thereof the seized five thousand imperial thalers sequestered in the Company's warehouse should be declared confiscated, one half for the Honorable Company and the other half for the fiscal, together with, in addition, a fine to be divided at the discretion of the judge, one half for the leper house outside the city of Cochim and the other half for the fiscal as above, with costs, or for such other purpose as the Council of Justice there might deem and find appropriate for the maintenance of the Company's trade. Subsequently, on 27 August 1737, according to the sentence of the Council of Justice at Cochim, the claim and conclusion made and taken by the above-mentioned fiscal Corijn Stevens upon and against the original defendant was rejected as not being sufficiently supported and substantiated by clear and convincing evidence, and it was thereupon ordered that the sequestered chest and the cash found therein, to the amount of a sum of five thousand silver imperial thalers, be returned and handed over to the defendant as his own lawful money, and that the said defendant should be free to institute his action and claim against his wrongful accuser, the merchant and Mocha resident Willem van den Berg, if he should be so advised; furthermore, the said Willem van den Berg was condemned in all the costs and expenses of justice incurred and fallen during this lawsuit. Against which sentence the said fiscal Corijn Stevens, having constituted himself appellant to this Council, and on 30 July of this year, through the advocate fiscal of India, as replacing in office the repeatedly mentioned Malabar fiscal Corijn Stevens ratione officii, against the defendants in their ascribed capacity on the roll of this Council, concluded firstly for the validation of the obtained appeal with the clause of relief against the undue prosecution of this appeal; furthermore, serving a written claim in the case of appeal, concluding at the end of the same for the nullity and correction of the sentence in question, and that this Council, doing that which the lords judges in the first instance ought to have done, would be pleased still to adjudicate the claim and conclusion made and taken in the first instance upon and against the original defendant, with the costs of both instances. Whereupon the attorney Hartman, for and on behalf of the said defendants in their qualified capacity, (after he had consented to the requested validation) requested a copy of everything, and a period of four weeks to act as he should be advised, which was also granted to the said Hartman, the above-mentioned Van der Parra having been discharged from this case at his request by disposition of 5 November; and this case having been brought on the roll on the 3rd of this month in order still to purge the default of answer and further to answer, the attorney Van Vliet, on behalf of the remaining defendants in their qualified capacity, then requested an extension of this term for the duration of one month on account of the voluminousness of the papers, which was also granted to him after the lord advocate fiscal had consented thereto. The above-mentioned lawsuits, the conclusions taken in the respective claims, their termination, and the pending litigation, with regard to their contents, have been briefly cited in substance here above, in so far as they agree with the criminal roll of the Council of Justice of the Castle of Batavia and the proceedings held. The extract from the minutes of what was transacted and resolved in the Council of India, dated 10th December of the past year, accompanied by a copy of a petition with its original annexes presented and exhibited on that same day to their High Excellencies by the advocate fiscal Mr. Adrianus Bergsma, and upon which this council has been ordered to declare itself, having circulated for review among the members of the Council of Justice of the Castle of Batavia, insofar as they have functioned as judges in this matter, and having now been brought back inside for the adoption of what is necessary and required; Mr. Willem Vincent Helvetius read out and handed over his individual remonstrance and defense with its annexes against the above-mentioned copy petition of the advocate fiscal. Whereupon, the sentiment of the remaining members being requested, Mr. Pieter Hendrik Schook and Mr. Pieter Willem Lammens concurred with the above-mentioned defense, insofar as it concerns the matters that occurred and were settled in their presence and attendance, and Mr. Jacob vanden Bosch distinctly regarding everything; but Mr. Theodorus van Reverhorst, Mr. Cornelis Phillips, and Mr. Reijnier Stapel declared that, whereas the passing of the resolution by which the secretary of this council was authorized to act against the Orphan Chamber in the case of revision was adopted by a majority of votes, and their honors were of contrary sentiment, they still persist therein, being of the opinion that, if a party had to be assigned to the Orphan Chamber in this case, this ought to have been the advocate fiscal, as representing the right of the high authority, and not the secretary of this council; likewise, for that reason, not being able to substantiate the contrary, but leaving it to the accountability of those who, by majority, issued the disputed order of the 4th of October 1737. And it is further resolved to present these minutes, together with the remonstrance of Mr. Willem Vincent Helvetius cited herebefore with its annexes, to their High Excellencies in fulfillment of their respected orders contained in the aforesaid resolution. Having been read today before this Council a certain request in the form of a missive alongside its annexes, brought here from Ceylon these days and written to this Council by the Reverend Minister there, Henricus Pakens, dated the 10th of January of this year, wherein his Reverence grieves that the noted appeal from the sentence rendered there by the Council of Justice in Colombo in his case against Andries Francisco Chittij, Coromandel Bengali had been rejected there, with a request to this Council to be admitted into appeal, and to that end also to arrange with the Noble High Government of these lands that the papers of that trial may be requisitioned from there; it was resolved, after ripe deliberation on the necessary matters, to grant the Reverend Suppliant a writ of appeal with the clause of relief, inhibition, and compulsoir, and likewise to request the Noble High Government of these lands to order the Council of Justice there that the aforesaid writ be properly served according to its form and content upon the aforesaid Andries Francisco Chittij; No. 38 Sale of 3723 served; that furthermore the papers concerning the trial in question, evangelized in original, be sent over here along with the same writ and report at the first opportunity; and that those of the said Council, if they wish to concern themselves with this case or make themselves a party therein, shall appear here before this Council on the appointed court day, or send their authorized representatives, to give reasons for their aforesaid opposition, and further to proceed with the aforesaid Reverend Pakens as is lawful. and damages that the said Francisco might have already suffered through the detention of his person; that the petitioner, finding himself aggrieved in the highest degree by the aforementioned sentence, did record his appeal thereof to this Council within the proper time, and subsequently requested in Court that the said recorded appeal might be granted, but that the above-mentioned Council of Justice at Colombo had seen fit on 9 August 1737 to reject that recorded appeal with condemnation in the costs of that incident; and that the petitioner, having the greatest interest in having all the documents used in the aforementioned lawsuit sent over here, and the case further examined and determined by us, could therefore find no other way than to address himself to us (as he stated), requesting for that purpose our provision. So it is that we, having considered everything and having found no reasons why a writ of appeal with the clause of inhibition, relief, and if necessary compulsory production should not be granted to the petitioner, hereby resolve to request the Honorable High Government of these lands to order the government of Ceylon to ensure that the above-mentioned Andries Francisco be duly summoned to appear or send an authorized proxy on 6 May of the upcoming year 1739 before this Council, in order to see the aforementioned sentence annulled and invalidated by us, or at least amended and corrected, to sustain the same as his counsel shall advise, and likewise to answer to such request as the petitioner serving on the day of hearing shall make to be relieved against the improper prosecution of his aforementioned appeal; and having heard the party, to see the petitioner provided by us against him with such remedy of justice, and also of grace (if needed), as shall be found appropriate, and further to proceed as is lawful; with notice to those of the aforementioned Council of Justice of the Castle of Colombo to appear likewise on the said day or to send an authorized proxy, if they deem fit and insofar as this case concerns them; with further orders, under penalty of a certain large forfeiture to be incurred to the contrary, that the aforementioned defendant and notified parties shall not attempt or innovate anything to the prejudice of the aforementioned appeal, and if anything has been attempted or innovated, to repair the same immediately and without delay and to restore it to its first and proper state; and furthermore, if necessary, to order those of the repeatedly mentioned Council of Justice of Colombo to send over here at the first opportunity the papers belonging to the lawsuit in question, authenticated in the original; and in case of opposition regarding the just-mentioned compulsory production, to summon the opposing parties to appear likewise on the aforementioned day or to send an authorized proxy before this Council, to state the reasons thereof, to answer to such claim and conclusion as the petitioner for the aforementioned purpose shall wish to make and take, and further to proceed as is lawful. It having been discussed repeatedly by the noble gentleman President and members of this Chamber concerning the poor condition of the estates of various persons who happen to appoint the Orphan Chamber as executors of their estate, so that upon accepting the same one is very much apprehensive whether they are sufficient and can serve to satisfy their creditors, the more so for the present time wherein real property daily falls and declines in value, besides it furthermore happening sometimes that this Chamber remains in doubt for two or three years whether some estates are solvent or insolvent when the deceased have any matters outstanding in the fatherland, as a clear example is evident regarding the estate of Miss Deliana Blesius in her lifetime, widow of the late Water Fiscal Leonard Weijer, Jan van Landschof, and various others of modest extraction, this Chamber finds it impossible to advise declaring such estates insolvent so long as the same does not become fully apparent to them, considering the honored resolution of your High Nobilities, taken in the Council of India under date of the 9th of August 1688, very expressly dictates that in case any estates are left behind in the aforesaid manner, of whose sufficiency one might doubt, that then, in order to preserve the reputation of the deceased, they shall be held sufficient for so long until the contrary becomes apparent, in which time their Reverences are then bound for conscience sake, to halt the heavy interest which excessive capitals drag along (and in the aforesaid time come to diminish the estate noticeably), to pay off something in deduction to various creditors, in order, if it were possible, to maintain the estate and the dignity of the deceased, when it then happens that the estate must truly be declared insolvent and handed over to the sequestrator, and this body to that end addresses itself to such court of justice under which the estate falls, the gentlemen judges by their disposition order that the orphan masters must return all the monies which have been paid under caution de restituendo, again in No. 33 Coromandel Bengalese Sale of

3734 to collect and to deliver in cash to the sequestrator, as can be seen from the disposition rendered by the Reverend Board of Aldermen of this city on the surrender of the insolvent estate of Reijnier de Roos, annexed hereto for the honored consideration of Your High Nobilities. This Board having then considered that this prerogative is not otherwise expressed in their instructions than in article 47, comprising the delivery of the monies of missing orphans, they have nevertheless intended to conduct themselves according to the content of the aforementioned disposition, and to release no more monies except under the aforementioned security. When certain persons appeared here and there who came to object to this Board as if their Honors could make no laws and had as yet neither authority nor qualification for this, the orphan masters were frequently brought into the utmost embarrassment to release their monies securely. And having taken into consideration that the clause in case of cautie de restituendo is null and void ipso jure, as well as of no force or importance if the estate is found sufficient and solvent; and on the other hand, being found insolvent, it must enjoy the law drafted for insolvent estates, whereof under the title of desolate estates, article 16, it is said that whoever wishes to take up any monies allocated to him by preference or concurrence, shall first have to provide good and sufficient sureties to restore the same, if it should afterwards be found to be proper. Yea, Yea, even this privilege is granted by Your High Nobilities to the respective Secretaries of Justice under the title Sentences and Executions, article 24, reading thus: the monies proceeding from executed goods shall be collected by the bailiff and messenger respectively, and shall at all times be delivered by the Secretary to whom it belongs, de restituendo, within the time of precisely six weeks after the sale. Wherefore this Board, in order to prevent damages which their Honors might otherwise have to undergo even in their private persons through the delivery of the monies without security, as recently happened to the retired members of the estate masters regarding the estate of the Chinese Captain Lim Isoenqua, have thought fit, unanimously resolved, and deemed best to address themselves hereupon to Your High Nobilities, with the humble request that by the favor of Your High Nobilities it may be permitted to this Board to release no monies to estate creditors other than under cautie de restituendo, in the manner as such is permitted and ordered to the Board of Estate Masters by their instructions, article 12, where it is said: the goods being distributed as aforesaid, the said estate masters are ordered to pay pro rata to the creditors from the proceeds as well as from collected debts and other ready monies, provided they provide sufficient cautie de restituendo, in case more creditors should come forward afterwards; and article 13: whereafter the remainder shall be divided and distributed among the lawful heirs according to the laws drafted on the matter of intestate succession, provided that they shall likewise, as aforesaid, be bound to provide sufficient security, in order that this Board not only be freed from damages, but also with all vigilance, according to the tenor of their sworn oath, to preserve the right of the widows and orphans in good conscience. High Noble Commanding Lords To His High Nobility the Right Honorable, Highly Esteemed Lord Adriaan Valckenier, Governor General, as well as the Right Honorable Lords Councilors of the Netherlands East Indies. The President and members of the Council of Justice of this Castle, having received an extract from the minutes of what was handled and resolved in the Council of the Indies on the date of the 4th of the past month of July, accompanied by an authenticated copy of a certain petition presented to Your High Nobilities by the Lords Orphan Masters of this city, tending to the effect that it might be granted to Their Reverences, just as to the Estate Masters, to pay out no monies to estate creditors other than under cautie de restituendo, but concerning which it has pleased Your High Nobilities, before disposing of the principal matter, to obtain the advice and opinion of this Council as to how far the paying out of such monies under the aforesaid security to estate creditors is legally admissible and can stand; this Council shall have the honor, serving as advice to Your High Nobilities, to state: That, regarding how far it is legally admissible and can stand to pay out any monies to estate creditors not otherwise than with cautie de restituendo, the same is directly and entirely contrary to all laws and received practice, both in the Netherlands and in these lands, since it is notorious and well known that no creditors or legatees, in whatever case it might be, are bound or obligated, upon receiving their debt monies or legacies when the estate of the deceased is solvent and sufficient, to have to provide any security before the receipt thereof; for such has never been granted and conceded in the Netherlands to anyone other than the Chambers of Desolate Estates, and in these regions by statutory laws to the Secretaries of Justice as curators and sequestrators of desolate and insolvent estates, see the Statutes of Batavia under the title of Desolate Estates, article 16, as well as under the title of Sentences and Executions, article 24, and especially what is to be noted in this matter after holding the hearing of preference and concurrence, as well as the decision of the judge following thereupon, as can be seen in Professor Voet, ad titulum Digestorum qui potiores in pignore vel hypotheca habeantur, number 10; all the more because this Council considers that the Lords Orphan Masters, entering into an estate of a deceased, are not and cannot be recognized as anything other than administrators and executors of the will of the deceased, as well as resolvers of his estate, representing him in all things, and therefore having no more or greater right than the deceased would have had or could have claimed while still alive, or than those whose goods they administer; nemo enim plus iuris in alium transferre potest quam ipse habuit. Furthermore, it appears quite strange to this Council how Their Reverences, by the means of their petition, can posit being apprehensive that several estates remain in doubt for two to three years whether the same are solvent or insolvent, whenever the deceased have any outstanding matters in the Fatherland, as it has pleased Their Reverences specifically to allege the estates of Deliana Blesius, widow of the late Water Fiscal Leonard Weijer, and Jan van Landschot, and several others, since it is surely all too notorious and well known that Their Reverences, by the good care of Your High Nobilities in the resolution dated 9 August 1688, are not only fully covered, but even shown the way how and in what manner Their Reverences shall have to conduct themselves in such and similar estates, both for the maintenance and security of themselves and for the greatest decency of the deceased, namely: That the first acceptance thereof shall have to take place by the Secretary of the Orphan Masters or Estate Masters under whom the estates may belong, in the presence of two commissioned members, with prior knowledge and order of their respective presidents, when everything in the house of mourning shall then first be inventoried by them, and the matters of the funeral of the deceased must be arranged in the most thrifty manner and as soberly as the condition of the deceased can possibly permit; which being accomplished, then the mentioned Secretaries, as soon as may be feasible and before proceeding to
