...noticed in our aforementioned of 22nd August, so that for the rest we must now await how those matters will first be settled in Spahan, and subsequently here; as well as gladly learn in due time what will finally fall to the share of the old merchant. The first signatory takes the liberty of sending to Your Honours, under flying seal and No. 5 for perusal, such humble letter and enclosures as serve as an answer to the highly respected letters of the Honourable, Worshipful Orphan Masters at Batavia concerning the estate of the late junior merchant Jacob Schorer, with the humble request to let that packet be forwarded on a suitable occasion to the said respective addressees. We thank Your Honours most humbly for the good recommendation to Batavia for the relief of the 118 lb of Malacca tin imposed upon us, on which account the said first resident would gladly have directed a petition to the aforementioned High Excellencies; but since he considers it fair to await beforehand the venerated reply from Your Honours concerning this, he has not dared to undertake to cause that High Government a too premature trouble; but shall keep that dutiful submission reserved until that time, should such be required. How a good appearance can unexpectedly turn out to a bad effect is daily experienced in many matters, just as a new example occurred to us recently concerning the already contracted powder sugar at 13 mamoodies the maund of 25 lb, which had almost changed masters upon delivery and would have been out of our house; the buyer, who was minded to have it weighed off, fell almost as suddenly dead as he fell ill; so that we may count it as our great fortune that the delivery did not precede the death, otherwise we would have obtained payment with great difficulty, or possibly not at all; considering that this man seemed outwardly solvent enough, but was essentially insolvent. It is a year ago that we did not have the honour to make known to Their Right Honourable Excellencies their state in this place, upon which, however, as we believe, very much depends. Serves for further respectful reply to Your Honours' highly esteemed letter of 30th May, received per the Adriana, that we shall take the compliance therewith and the contents of its respective enclosures to heart with all candour, constantly striving to show our gratitude for all such passages and approvals of our actions in the service of the Honourable Company as we have the fortune to encounter both in Your Honours' venerated letters and extract resolutions, etc. First: No. 33. For the 200 mamoodies received by him at your place, we have credited Your Honours' office, and after this date our cash for the remaining 400 mamoodies belonging to his agreement, since this man, through manifold urgings, caused us to resolve to advance him those monies for his necessities, or the purchase of dates in stock; and as we know him to be an honest and settled man who has no intention of failing in his duty, we hope to have done so much the less wrong in this, nor to have caused Your Honours any displeasure. ...in the Bengali, Coromandel, or other manner, nor does any sovereign remedy for restoration present itself; for where there is no longer any circulation of money, the soul or trade must soon depart from the body, that is, commerce. This illness is principally caused by an excess of provisions or trade goods, wherewith this poor bride finds her stomach or warehouses far too overloaded. But in order to reason here no longer in hieroglyphics, we shall in a few words make it known that the English and the French have this year engaged in trade in such a manner that it is entirely impossible for upright and profit-seeking merchants to behold these pernicious examples without sensitive vexation, and far less to follow them, as the accompanying price current under No. 6 will cause Your Honours to experience with astonishment that they sell off various goods which, according to our estimation, cannot even fetch their purchase prices, let alone yield so much profit that they can maintain themselves or prepare for new shipping ventures to resume the journey hither with the upcoming monsoon. We, for our part, because of our daily experience, can hardly think or expect such a thing, but rather expect to see some return to their principals with a bucket on their head, as is heartily to be wished as a well-deserved punishment. The reasons presented are also the true cause that we have been so considerably thwarted in our trade, and, so to speak, have been able to dispose of nothing, indeed not even the remainder of our cassas, seeing that these competitors continually cut the ground from under us by lowering their prices, and lure the few merchants who are still here from our residences into theirs. We shall have to continue to look upon this with sorrow for as long as we have to trade in the same assortments at the same time with them. It is nevertheless to be hoped, and at the same time to be believed, that the state of trade will not long remain in the present calamitous condition, considering that the merchants from Baghdad, Mosul, and Diyarbakir will soon have to depart for their quarters, and will certainly much rather carry our goods with them than their money; moreover, Shushtar, Hoveyzeh, and Dorak will likewise have to be provided with goods, as we know from experience to be customary every year, and on those occasions we flatter ourselves that the scales and bales will indeed be set in motion again. At least we do not lose heart, and shall spare no effort to convert our goods into money, of which Your Honours may rest assured. Thirdly, the maintenance of inviolable hospitality, especially regarding our own persons, and consequently over our domestic servants, interpreters, brokers, money changers, and all such further servants belonging to us or depending upon us, principally consisting in this: that they may not, without our special permission or voluntary surrender, be apprehended, fettered, nor thrown into prison, much less directly or indirectly forced to contribute to any poll taxes, burdens, or servitudes that may otherwise be imposed upon subjects. Fourthly, that the rulers of Bassora, whether Pashas, Musallims, Kayas, Qadis, Muftis, and other high or low officials, shall always be obligated to grant us good, swift, and concise justice with respect to all such debtors about whom we might present our complaints and interests to their Lord Regents, so that the Honourable Dutch Company, or those appointed here on its behalf, may remain free from all harmful bankruptcies or financial losses. Choromandel Bengal sale of being, this Council altered the judgment in question on the 26th of November following, annulled the latest proceedings concerning the extension of the claim, denied the conclusion thereof, and reserved for him, Samlant, his action for damages and interest, and likewise reserved for Francina Pieris her action, if she should believe she had any against him, Samlant, regarding the estate of Martin van Der Burg, to institute it anew before this Council as should be advised; further approved the remaining contents of the ruling in question, discharged him, Samlant, from the solemn pledge and promise made to appear under penalty of confessing and being convicted, and condemned the advocate fiscal, as the party involved, in the costs of the lawsuit incurred regarding the extension of the claim, but compensated the remaining costs both in the first and in this instance. We have received, through Their High Excellencies, the High Government of these lands, an extract of Your Honourable Worships' dispatch dated 17th of September 1737, and seen thereby that Your Honourable Worships do indeed agree in the same opinion with this Council, namely that appeals from the outer trading posts are requested with more propriety from this Council than from Their High Excellencies; but because it had been requested there from all times, as there generally had to be a relief against the lapse of the fatal dates for appeal, and that this dispute was not of such great importance as to make a change in that ancient custom on account of it, and it Choromandel Bengal sale of was better and easier for the parties as well as for both colleges, Your Honourable Worships had wished to leave this on the old footing. And there has furthermore been delivered to us an extract from the minutes of what was negotiated and resolved in the Council of India on the 17th of June 1738, whereby Their High Excellencies, before Choromandel Bengal finally disposing of a certain request of the present ambassadors of the King of Bantam for the release from chains of two Bantenese women by the names of Sariba and Wadon, who were sent from there hither over four years ago now, and were still found as such here in the quarters, but who, according to the contents of the re-examined confessions, were female slaves of a Malay by the name of Intje Diban and the Chinese Intje Kiok, from whom they were said to have been stolen as children and transported from here to Bantam, ordered the advocate fiscal to summon by edictal citation all those who might believe they had any action or claim upon the aforesaid two female slaves, upon penalty of confiscation, in case sale of such reclamation should not yet have been made; whereupon the advocate fiscal proceeded by edictal citation against the aforementioned Intje Diban and Intje Kiok, as well as against all unknown claimants, and no one having appeared, further served a statement of claim, whereupon the same women Sariba and Wadon were confiscated for the benefit of the Honourable Company by sentence dated the 3rd of September of last year. In our last advices to your Right Honourable Worships we had the honour to make a report concerning the seized coffee from the Tanjongpura De Kuijkedieff, and alongside this that the same coffee beans had been sold and delivered by the burgher Cornelis Los, residing here at the square, to the repatriated skipper Bijland, and that upon investigation made it was found that he, Los, some time ago had bought 190 picols of coffee beans from a certain Chinese named Soeij I- Enko, and of these had sold 82 picols to the said skipper Ian Bijland at six and a quarter rixdollars each picol, as well as out of fear had hidden forty picols with his neighbour, the fellow burgher Appolonius Van Hoogstraten, who did not know that they were coffee beans, whereupon the said Cornelis Los, together with the skipper Ian Bijland, shortly thereafter paid the fine set for it, being the fourfold value thereof, at four times six rixdollars each picol, namely Cornelis Los for 190 picols, rixdollars 4560, and the skipper Ian Bijland for the 82 picols, rixdollars two thousand, according to the edict of the 5th of March 1726, this having been followed by the advocate fiscal serving a criminal demand in writing against the same Cornelis Los on the 26th of March of last year, and at the end thereof concluded that by definitive sentence of this Council, the sixty-four picols of beans, more fully mentioned in the demand and declaration of the junior merchant and administrator at the Water Gate Aarnold Vollenhoven, made known in the register under No 2, should be declared forfeited, in order that the net proceeds thereof, deductis deducendis, be distributed according to custom, cum expensis; whereupon on behalf of the defendant an answer in convention and demand in reconvention was served, and at the end thereof concluded that by definitive sentence of this Council, the advocate fiscal Mr Adrianus Bergsma in reconvention should be condemned to allow and permit that to the plaintiff in this case be cleanly and unburdened restituted the amount of fourteen hundred and sixteen rixdollars, mentioned in article 55 of the answer, and paid by him provisionally in excess for the fine of the quadruplum fixed by the edicts on the private coffee trade, in case of contradiction also making a claim for costs, whereupon subsequently this case was brought forward by the advocate fiscal against the said Los on the 14th of May following for splitting of the demand in convention and reconvention, as well as, pursuant to his declaration that he had nothing against the demand in convention, having made an answer in convention instead of taking a contrary conclusion, to hear request for condemnation thereon, cum expensis, the same request having been settled by both parties, whereupon by this Council, instead of disposing of the parties' disputes, the advocate fiscal was ordered, under benefit of relief, to amplify his taken demand in convention pursuant to the edict of the date 5th of March 1726 with relation to the fine of the quadruplum likewise enacted therein, which on the 21st of May following was put into effect by the advocate fiscal, and then served an amplification of demand, and at the end thereof concluded that he, Los, over and above the

3640 Right Honourable, in our last, imparting with much respect how the case between the Orphan Masters as administrators of the estate of the deceased former Ceylon governor Stephanus Versluijs, and the secretary of our Council, was ready for judgment in the case of revision, when on 14 December 1737 we perceived, with the utmost astonishment from the extract delivered to us from the minutes of what was transacted and resolved in the Council of India under date of the 10th prior, alongside the accompanying document presented on that same day by the advocate fiscal to the Honourable High Government of these lands; that the said advocate fiscal had in his document informed their High Honours that, because the surety of 50,000 rijksdaalders posted by the deceased Ceylon governor Stephanus Versluijs was for the benefit of the Honourable Company, this Council was not competent to appoint anyone at its discretion to guard the rights of the sovereign authority in these lands in this matter etc., and on that ground requested that he, the advocate fiscal, be maintained in his office, and that the said proceedings in the case of Revision be annulled and quashed as informal, furthermore that the Orphan Masters be ordered to prosecute this case against him, the advocate fiscal, and also to permit and endure all this, and that meanwhile the final disposition or settlement of this case in Revision be stayed; which document and accompanying papers their High Honours, before ruling on the request made therein, had the goodness to place into the hands 3641 of this Council, so that our interests could be served against it, but at the same time ordered not to proceed with the Revision of that case until furnished with further orders from their High Honours; thus, on account of the voluminous nature of these papers, it was decided by us not only to circulate them, but also to allow each member of this Council individually, or in combination with one or more members thereof, the freedom to put their written counter-arguments on paper separately, and subsequently present them to their High Honours, and meanwhile to commission three members from our Council to humbly request their High Honours that it might be their pleasure to suspend the dispatch of the aforementioned petition and appendices to Your Right Honourable Honours until the departure of the tea ship, in order to be enabled to prepare what is necessary in that regard, and thus to be able to send the one accompanied by the other through their said High Honours to Your Right Honourable Honours; which was also favorably granted by their High Honours and has already taken effect; whereupon their High Honours, by resolution of 28 March of last year, delivered in extract to our Council, were pleased to leave the case in question undecided and to refer it to the decision of Your Right Honourable Honours, to whom the mutual papers regarding this matter would be sent in copy, and in the meantime to have this Council, together with the adjunct revisers, simply proceed with the noted and already concluded revision, in view of the fact that their High Honours had already ruled on two different occasions on the request of the Orphan Masters for the appointment of adjunct revisers, without the advocate fiscal having raised any difficulties against it with either their High Honours or this Council, or having entered his interests as he ought to have done, but instead came forward with this at the very last, after everything was disposed toward settlement; whereafter it followed that their High Honours, by resolution dated 26 August thereafter, appointed the present Receiver General Ian Meijn as reviser in place of Governor Jacob De Iong, who had departed for Amboina; so that this case was finally settled, and in Revision it was understood that error resided in the rulings of the Council, and in correction thereof, to grant the requests of the gentlemen petitioners in their capacities, and consequently to order the sequester to deliver up to their Reverences, under proper receipt, all such aldermen's acknowledgments of debt, promissory notes, and papers, among which are also included the sureties executed by Ian Hendrik Ducaijlar, former alderman, and Evert Lanius, vendue master of this city, dated 9 June 1734 and 26 June 1736, as he still had in his custody concerning the estate of the said Mr. Versluijs, provided that the gentlemen petitioners in their capacities, in place of the aforesaid aldermen's 3643 acknowledgments of debt, promissory notes, papers, and sureties, shall leave a sum of Fifty Thousand rijksdaalders with the Honourable Company until the end of the principal case, and furnish proof thereof to the sequester, furthermore discharging then the aforesaid Ducaijlar and Lanius from their respective executed sureties, and ordering that the consigned fine of Revision be refunded to the gentlemen petitioners in their capacities, with compensation of costs, in the manner as Your Right Honourable Honours may observe from the sentence delivered in the case of Revision on 9 October of last year, which comes to Your Right Honourable Honours in copy among our papers now departing; the advocate fiscal having, in the principal case on 8 October prior, merely persisted by libel for replica.

Coromandel Bengal reply, and by the Orphan Masters as a rejoinder, while a fortnight was requested by the parties for the production of documents, but that term having expired, the parties considered the documents already submitted in this case as produced, subsequently pleaded general objections and reservations of rights, and thus on 3 December of the past year this case reached the state of judgment, we shall proceed to its settlement as soon as practicable, and respectfully forward our final verdict to Your Noble High Mightinesses at the earliest opportunity. Regarding the case of the merchant and former Fiscal of Colombo Joan De Mauregnault, we can now inform Your Noble High Mightinesses that, pursuant to the sentence of this Council dated 19 December 1737, with benefit of relief on No. 33 sale of 3644 8 January of last year, he served a voluminous written answer, and alongside it submitted a register with various documents, and at the end of the aforesaid answer concluded that by definitive sentence of this Council, firstly the inquiry conducted by Fiscal Cornelis Van Der Hoeven Dirksz on Colombo against the defendant, the documents obtained by the Governor-Elect of Ceylon Mr. Diderik Van Domburg after his exclusion from the Government of the city of Galle, and the investigation newly undertaken here by the Extraordinary Officer Mr. Jacob Lakeman, the documents of which have been submitted to the trial, may be declared informal, inept, and therefore null and void ipso jure, and that secondly the claim and conclusion made and taken by the Advocate Fiscal of India Mr. Adrianus Bergsma, insofar as made on and against the defendant, may finally be dismissed as inadmissible, and he be acquitted thereof, with costs, or to such other end as this Council might find to be in accordance with law and equity, whereupon on the day of the hearing the Advocate Fiscal requested a copy of everything, and a term of three months after receiving it in order to reply, and on 26 March thereafter petitioned that, on account of his severe indisposition and other reasons alleged therein, the requested term of three months to reply might be suspended or that it should only be calculated to commence on the first of May following, which request of the Advocate Fiscal, No. 33 3645 after the aforesaid Mauregnault was heard thereon and—although testifying that he could find very weighty grounds of contradiction against the means of that petition—nonetheless consented to it in order to prevent animosities, was granted by this Council, whereupon this case subsequently being brought onto the court roll to reply on 6 August following, the said Advocate Fiscal then requested another term of three months, which was likewise granted to him; whereupon further, on 8 October of last year, the Advocate Fiscal persisted by libel for his reply, and he, Mauregnault, for his rejoinder, furthermore a fortnight was requested by the parties for production, and on the term of production the documents already submitted in this case were held as produced, subsequently general objections and reservations of rights were pleaded, and finally on 3 December this case was brought to the state of judgment, so that we shall not fail to deliver our final verdict thereon as soon as practicable and settle that case, and respectfully inform Your Noble High Mightinesses of its outcome at the earliest opportunity. Furthermore, we must bring to the knowledge of Your Noble High Mightinesses how the Orphan Masters of this city, having under their Reverences' administration the estate and succession of the late cashier of the Company's treasury Ian van Landschot, in that capacity had the former Senior Merchant of this Castle and Governor-Elect of Coromandel Ian Herman No. 38 3646 Theeling summoned to the court roll on 15 January of the past year for payment of a considerable sum of thirty-nine thousand six hundred thirty-nine rixdollars and thirty-six stuivers, the remainder of a larger amount, as the same Theeling, per balance of account amounting to seventy thousand five hundred and ninety rixdollars and eighteen stuivers, was still indebted to and in arrears with the aforementioned estate of the cited Landschot, and as the foundation thereof submitted a certain closing balance of debit and credit dated 2 October 1737, as well as a notarial notice of 27 December following, served on the said Theeling by the notary Petrus Dobbelaar and witnesses on behalf of the Orphan Masters, from which it appeared that he, Theeling, fully acknowledged the said debt, but at the same time claimed to be unable to satisfy it for the present, due to the damages he had suffered both from the loss of ships and the considerable loss on the purchase of tea, the said notice being submitted by their Reverences to base the provisional judgment thereon, whereupon we, being unable to let such pass, deemed it proper by minute of that date to place an authentic copy of both into the hands of the Advocate Fiscal in order to perform his office and duty, so that the aforementioned officer shortly thereafter addressed the Noble High Government of these lands, requesting there that the said Ian Herman Theeling, who at that time had already been elected Governor of Coromandel, might be detained here in order to bring him to justice before this Council, No. 33 and

However, to our utmost astonishment, we saw by an extract from the minutes of what was transacted and resolved in the Council of India on the date of the 30th of December Coromandel Bengal sale of December 1738, delivered by our President on the 5th of this month, that the Orphan Masters, instead of awaiting our sentence in this matter, thought fit to address themselves by a so-called representation to their High Noble Lordships, with the request to be relieved from the delivery of the extract for which the advocate fiscal, in the manner mentioned above, had caused their Reverences to be summoned, notwithstanding that no condemnation had yet been laid against their Reverences, but only that the advocate fiscal had been ordered by interlocutory decree to demand the same from their Reverences through the ordinary course of justice; and that nevertheless their High Noble Lordships, without taking our advice, as has indeed happened in other cases, and after our President, notwithstanding his protestation made, had to remain outside, relieved and exempted the said College from submitting such an extract upon the citation of the advocate fiscal, No. 33 3649 fiscal, or from making any disclosure thereof, and also agreed to deliver to their Reverences an extract of that resolution, in order to stand therewith before this Council upon further citation; and whereas this was judged by this Council to tend greatly to the obstruction of justice, and also runs contrary to the permanent successive orders of Your Right Honourable Lordships, we therefore thought fit on the same day, in order to use as much accommodation and moderation as could in any way be devised on our part, to submit a remonstrance to their High Noble Lordships in that regard, and thereby to represent our grievances with great respect, as well as to request the necessary redress concerning the same, and in the meantime Coromandel Bengal Sale of to stay the proceedings of the advocate fiscal against the Orphan Masters by an interlocutory sentence until further disposition, as Your Right Honourable Lordships, if it pleases you, will be able to verify from the copies of both accompanying this; after which, on the 23rd of this month, it was thought fit by their aforementioned High Noble Lordships to persist in their resolution of the 30th of December of the past year, and to send our submitted declaration, just as that of the Orphan Masters, in copy to Your Right Honourable Lordships, in order to await thereon Your Right Honourable Lordships' esteemed approval and elucidation, which we shall then also await with great longing, and in the meantime keep the case against the Orphan Masters stayed until then. Council with the notary Petrus Dobbelaer in his stable, and empty warehouse situated and located under the wall, and at the square here, intercepted 877 small ingots of lead, weighing together by rough calculation over 20000 lb, and subsequently transferred to the Company's boeiers, and on 23 April following, a claim was served in writing against the said notary Dobbelaer, and concluded at the end thereof that the same 877 small ingots of lead should be declared forfeited, in order that the net proceeds thereof, after deducting what is to be deducted, be distributed according to custom, and furthermore that he, Dobbelaer, in addition, by way of arbitrary correction, be condemned to a fine of Two Thousand rixdollars, half for the Honorable Company and the other half for the treasury, this case currently still being pending. Whereas the advocate fiscal of the Indies, Mr. Adrianus Bergsma, replacing in office the Colombo fiscal Dirk Stokvis, who had replaced in office the previous fiscal Martin Weijer, has been summoned in appeal before our Court of Justice as defendant by the burgher Captain of the Cavalry here, Ian Hilgers, having power of attorney and authorization from Euphemia Engelbert, widow of the Ceylon governor Diderik van Domburg, and that case had already been recorded by claim and answer, upon which the advocate fiscal addressed this Council by petition, making known therein that the cashier at Colombo, Johannes Jacobus Cruse, shortly before and after the publication of the Placcaat of 26 April 1735 there, whereby the old and clipped currency of double and single stuivers, as well as all other current coins, were declared bullion, and the expenditure and receipt thereof under whatever pretext it might be was prohibited to each and everyone, nevertheless successively received in the petty cash on account of the Honorable Company from the said defective coin a considerable sum of 61809¼ rixdollars, both from the coast boatmen in payment for the areca nut etc., and by way of exchange for good current pagodas, the deficit in weight found thereon, each calculated in its kind, amounting to a principal sum of 28393.53 rixdollars; that the aforementioned cashier Cruse, having been taken to court by the Colombo fiscal for the reimbursement thereof, was absolved therefrom, for reasons that he had demonstrated to the satisfaction of the court, not only that he had had to receive the aforementioned defective currency on the order and express command of the late governor van Domburg, under whom alone the daily cash fell, and on whose order and warrants issued for that purpose the cashier administered it, but even that he had sought his own benefit in an irresponsible and fraudulent manner, contrary to oath, honor, and duty, even in the exchanging of good and current pagodas for such defective money; that the previous Colombo fiscal Martin Weijer had employed those original pieces of evidence in these proceedings against the original defendant, the widow of Domburg, and had submitted them according to the register alongside the claim in the first instance; and that the said fiscal had based many assertions in his claim thereon, which in the view of the advocate fiscal were also decisive in this matter; it was nevertheless the case that he had not had these documents and evidence re-examined afresh against the original defendant, the widow Domburg, which nevertheless, according to the law and established practice, in order to be valid, necessarily ought to have happened, the more so because the original defendant, in the 82nd article of the claim in case of appeal, raised an exception thereto, and for those reasons rejected them as utterly reproachable; wherefore the advocate fiscal resolved to petition this Council to be permitted to withdraw the aforementioned pieces of evidence in original, leaving authentic copies in their place in the case file, with the request to write to the Ceylon Government to effect as soon as possible that the said pieces of evidence be brought into probatory form against the original defendant, the widow Domburg, nevertheless leaving the original defendant or (as this Council shall deem fit) the plaintiff free to request the High Indian Government within the period of eight days for the transmission of his cross-interrogatories, if he wished to submit any, in order to examine, administer oaths to, and swear the witnesses on the same alongside the aforementioned interrogatories and statements; and that should he fail to do so, the conduct of the aforementioned re-examinations before the Judicial Council of Colombo would nonetheless proceed; furthermore, that these proceedings should be stayed until such time as the same inquiries should have been sent back; which request of the advocate fiscal having been placed in the hands of the aforementioned Ian Hilgers, he submitted an answer against it and concluded for rejection with costs; whereupon that interlocutory matter having been fully pleaded by the parties, the request of the advocate fiscal to withdraw the aforementioned documents, in order that they be sent to Ceylon for re-examination, was granted by this Council, and the proceedings on the principal matter stayed until such time as the aforementioned inquiry should have been brought into proper probatory form against the original defendant, the widow Domburg, and arrived here; and whereas the said advocate fiscal has requested of us by further petition letters requisitorial, to the end that the aforementioned documents be sent to the Council of Justice

to be sent to the Justice there, and in the aforementioned manner to cause the same to be placed under oath against the widow Domburg, provided that authentic copies thereof were first delivered to her in due time, and that she be judicially summoned and served, in order to be able, should she be so advised, to submit counter-interrogatories against them, we could not refuse this to the said advocate fiscal; accordingly, the said documents together with our letters requisitorial were immediately sent thither, with the request to effectuate the same as soon as practicable, and then to send them back to us again. There having also been brought before our Council the lawsuit in case of appeal of the Jewish merchant and inhabitant of Cochim Desima, Samson Rotenburg, and the former fiscal of Mallabaar Corijn Stevensz: which latter, upon the accusation of the merchant and Mocha Resident Willem van Den Berg, on the 8:e februarij 1737 had concluded by criminal claim against the said Samson Rotenburg that he, on account of freighting the Company's vessel Proostwijk with contraband goods, when he had departed as a passenger on the aforesaid vessel to Mocha and had returned as such back to Cochim, should be declared to have incurred the penalties of the Ordinances and statutes of the High Indian Government, as well as of the Commandment of Cochim, and that in consequence thereof, the Five Thousand imperial dollars seized from the ship Proostwijk and sequestered in the Company's warehouse should be declared confiscated, one half for the Honourable Company and the other half pro fisco, together with, in addition thereto, a fine at the discretion of the Council there, to be divided, one half for the Lepers' house there outside the city, and the other half pro fisco, with costs, or for such other purpose as the Council there might judge and deem proper for the maintenance of the Company's trade; which claim and conclusion having been rejected by the Council of Justice at Cochim by sentence of the 27:e augustus 1737, and it being ordered that the sequestered chest with Five Thousand imperial dollars should be handed back to him, Rotenburg, with reservation of his action against his wrongful accuser the above-mentioned Willem van Den Berg, the aforementioned fiscal Corijn Stevensz: appealed from the said sentence to our Council; and the advocate fiscal of India Mr. Adrianus Bergsma, acting for him in office, served a written claim against the attorney-in-fact of the original defendant here, the alderman Ioan De Roode, the junior merchant Petrus Albertus van Der Parra, and the bookkeeper Adriaan Van Ravenstijn, and concluded that the claim in prima instantia should be adjudicated with costs; of which copy and a term of six weeks having been granted to attorney Hartman for the qualified defendants, the cited van Der Parra was meanwhile, upon his own request, discharged from this case by disposition dated 5:' November last, because he did not wish to meddle with this matter, so that the same is now still pending as lis pendens before our Council against the two remaining attorneys-in-fact. Regarding the instruction for this Council and the respective officers ordered by Your Noble High Mightinesses, we can presently inform Your Noble High Mightinesses that the members who are appointed thereto have been daily occupied therewith since the month of May of last year, and have already advanced so far that the same will shortly be completed, which to our regret could not have happened sooner, as the draft instruction already prepared by the late Mr. van Gaesbeecq had to be entirely altered and enlarged upon review, we wish hereby to assure Your Noble High Mightinesses that as soon as the same is made ready, we shall also not fail to present it to the Noble High Government of these lands for review, and cause the salutary aim of Your Noble High Mightinesses to take effect. The first two named, for hiding in another man's house, and the last two, for concealing another Coromandel Bengal goods sale of man's slaves in a locked chest, pursuant to the sentence of this Council, dated the 8th of January of this year, were severely flogged with rods on the bare buttocks behind the town hall here; the first prisoner banished for all his life to the place where the Honorable High Government of these lands shall see fit, never to return here, on pain of heavier punishment; the second prisoner sent to the place where his owner shall see fit; and the two last No. 33 3663 prisoners each shackled in chains by their owner for the period of two consecutive years, with condemnation to the costs and expenses of justice. Pangerang of Malabar, chain gang worker in the Honorable Company's artisans' quarter, prisoner of the state, on the 22nd of the aforementioned month of January, for breaking his chain, pursuant to the sentence of this Council, was severely flogged with rods on the bare buttocks behind the town hall here, and shackled in chains again to serve out his banishment therein, and furthermore Coromandel Bengal goods sale of condemned to the costs and expenses of justice. Lourens Jansz of Amsterdam, sailor on Abbekerk, prisoner of the state, for twenty nights of absence, and that in addition a knife was found in his possession, on the 29th of the aforementioned month of January, pursuant to the sentence of this Council, was severely flogged with a rope's end behind the town hall here, and sent as a useless subject from here to the fatherland, to perform ship's duty for his food during the voyage, and condemned to the costs and expenses of justice. The Chinese Teng Long, summoned by edict, and No. 33 3664 also an absentee and defaulting party in this case, on the 19th of February of this year, by way of intentit, for smuggling in the Company's nutmegs, the Advocate Fiscal concluded that the aforementioned Teng Long, by virtue of the defaults obtained by him, the Advocate Fiscal, against the aforementioned Teng Long, should be barred from all exceptions, declining, dilatory, as well as peremptory, as well as from all defenses and legal remedies which he might otherwise have made and taken in this matter, and furthermore that he, the defendant, by definitive sentence of this Council, should be banished forever from all lands, cities, and forts falling under the jurisdiction of the Honorable Company, without Coromandel Bengal sale of ever being allowed to return therein on pain of heavier punishment, with confiscation of the defendant's goods, and condemnation to the costs of the trial.
