Linens Bengalese Coromandel the Council of Justice itself would be pleased to demand, in order that, after the receipt thereof, disposition could be made concerning it according to equity, and to send the same in that manner to the Orphan Chamber. Without, in this petition, to which a copy of the petition previously presented to the Council of Justice was also annexed, engaging in any other means than those that had to serve as the foundation of the motion to obtain the decree; for, besides that the submitted copy could allow the said High Mightinesses at first glance to judge whether it was so unfounded, indeed so infamous, calumnious, and irreverent with respect to the judge as moderate people would have to presume of a document that had been torn to pieces on a public court roll; so it was also, as was demonstrated by us verbatim to their High Mightinesses, not yet the time for us to enter into a further justification of the torn petition before we could do so completely, Number 33 Sale of guilders 3568 and with propriety, after obtaining the decree that had been pronounced against it. And besides that, we had not yet come to a final decision whether our complaints and grievances, together with the request for reparation and satisfaction that necessarily had to follow therefrom, should be presented to the Honorable High Government here, or rather whether we, under the favorable approval of their High Mightinesses, in order to avoid further troubles that arise repeatedly between the Council of Justice, now with the Reverend College of Aldermen, then with the Orphan Chamber, then with the Estate Masters, and then with others; since the said Bench of Judicature now seems to be pregnant with maxims of sovereign authority in these regions, should turn directly to the illustrious assembly of your High Honors; although it was preliminarily sufficiently clear from our petition to the High Government that we were much more inclined to take the latter course, Linens Coromandel Bengalese disposition could be made in such manner as their High Mightinesses might find necessity to require: which was even more than our request entailed, since that, provisionally, tended only to obtain the decree. Thus, to our unspeakable regret, we have been condemned here without having been permitted any defense; indeed, we were even kept in the dark regarding what was charged against us, and can therefore only fence in the dark against it, as the saying goes; having no other comfort left than that this is still submitted to the further decision of Your Right Honorable Worships, and that the defense of our, as we believe, very just and equitable cause will not require so much circumlocution or so much time as the Council of Justice has seen fit to employ, even with postponement of the order of the Honorable High Government, because otherwise it would be impossible for us to bring anything forward in this regard for the present; since the aforementioned minute resolution of Their High Excellencies, which is also sent to Your Right Honorable Worships among the appendices hereof, could only be delivered to us on Monday, the 6th of the currently running month, after its resumption in the Council of the Indies, and we consequently have had barely three times twenty-four hours of time to prepare this our humble letter to Your Right Honorable Worships prior to the dispatch of the Company's papers; for which reason there are all the more grounds for us to request a favorable indulgence if this is not in every respect in such neat order as we would otherwise wish. Linens Coromandel Bengal However, before and prior to proceeding to the further concise justification of our conduct and to making our humble request to Your Right Honorable Worships, we shall not pass over the contents of the writing submitted against us by the Council of Justice, although a copy thereof was refused to us, entirely in silence, so that certain points that appeared most conspicuous to the president of this chamber while attending the resumption of the same, or that he generally still remembers thereof, may be touched upon and refuted here in passing, in order to allow Your Right Honorable Worships to judge the good or bad quality of the remainder, which has not come to our knowledge. However, in order nevertheless to be more thoroughly informed as to what truth there was to the words he, De Mauregnault, was accused of having uttered regarding the Orphan Chamber, our president took the trouble to sound him out privately on this matter, and obtained in reply from him No. 33 & Sale of 1 that, by way of grievance over the decision to circulate the case files, he had merely said in company, and even to the Extraordinary Councillor of the Indies and President of Justice Mr. Isaac van Schinne, that he did not believe the Orphan Chamber, consistent with its oath and duty, would be able to sit still in this matter, but would apparently employ the necessary means against it; which utterance sounded entirely different and could merit little surprise from the mouth of a man who, of fifteen years he has spent in these regions, had already been involved for seven in this hateful lawsuit, and had been so tossed about therein by arrests, imprisonments, and accumulated obstacles, as is known to the public world, and therefore had a thousandfold reasons to long once and for all for an end to affairs with open arms.

Linens Coromandel Bengal That he, for his part, has presented only a concise petition for this purpose, without demonstrating therein the conflict between the ruling of the Council of Justice regarding the circulation of the trial documents and the laws and orders in the manner we have done collegially, is a matter that concerns him and not us. This deserves all the less surprise because, if he had placed himself in this matter on a parallel with us, even though his right was as good as that of the late Mr. Versluijs, something else would certainly have befallen him from which a man of decency must recoil, given that we, as a public board, have already been treated in such an unprecedentedly insulting manner. However that may be, it is nevertheless certain that, even if it were true, contrary to our previous sincere affirmation, that we had communicated with him as an interested party in this matter, or even made use of his pen as a legal expert, No. 33 and sale of 3566 such would not be an illicit act for a board that must employ legal practitioners in all proceedings. Nor would he, De Mauregnault, in any way deserve to be depicted so hatefully for this, in direct contradiction to the favorable testimony given to him by the Council of Justice itself in a writing solemnly delivered to the Honorable High Indian Government shortly after his release from custody on August 24, 1734. For it never matters whose counsel and pen one employs, but rather whether it is a lawful and equitable cause that is intended thereby. Consequently, in our humble judgment, we have in no way deserved such harsh and injurious treatment on account of some private displeasure that might now again, for one reason or another, be conceived by the Council of Justice against the frequently mentioned dismissed fiscal of Colombo. Thus, the Council is again a witness in its own cause, indeed such a witness against whom all means of reproach have been cut off from us by the withholding of its declaration. be considered; that the said court had consequently treated us very gently, indeed below the demerits of the case; citing thereto an example that occurred here in the year 1725 on the occasion of a dispute between the respective colleges of aldermen and the Orphan Chamber here, which was decided to the disadvantage of the latter by the Right Honourable Supreme Government in its resolution of 15 January 1726, and from which it has been inferred, or alleged, that the aldermen at that time took into consideration whether one should, on account of their disobedience and irreverence toward the judge, have the president and members of the Orphan Chamber seized as hostages during their meeting, at the place where they were in session, until a certain order of the aldermen should be satisfied. We answer this in turn with a declaration that our Chamber is just as much a college for the administration of the estates of minors and Linens Coromandel Bengalese and foreign estates, indeed even to administer justice between parties regarding them in some cases concerning orphans, as the Council of Justice is to exercise a general jurisdiction in civil and criminal proceedings over the Company's servants. 3571 Now, as regards the refusal of the condemnatory decree to our Secretary, concerning which the President has informed us, as has also subsequently appeared from the minute resolution of the Honorable High Government, that the Court of Justice had supplied some reasons in its document; regarding that, we shall merely testify in passing that we are well assured that those pretended reasons will not, nor could they, have aimed at anything other than such domestic corrections and minor monetary fines as are indeed imposed in chambers by some courts of justice upon their own subordinates, whether attorneys or others, for some misbehaviors and transgressions. Noble Honorable Lords, With due respect, the Orphan Masters of this city of Batavia, as testamentary executors of the estate of the late Noble Lord Ordinary Councillor of India and former Governor of Ceylon, Stephanus Versluijs, and having been judicially ordered in that capacity to assume the continuation of the lawsuit pending between the Lord Advocate Fiscal of India and his aforementioned Honor, make known: That the same Lord Versluijs, on the 10th of July 1732, by order of the Noble High and Honorable Lords Directors in the Meeting of Seventeen, having been removed from his aforementioned distinguished charge, was from that time under indictment, and underwent a rigorous investigation into his conduct and actions in Ceylon, which, after having continued for several consecutive months and having finally reached completion, was also followed by his departure to this city of India, where he arrived as early as January of the year 1733, and his case was likewise handed over to Your Honors by virtue of the orders of the aforementioned Meeting of Seventeen. That since that time, the same Lord Versluijs, during the preparatory proceedings against him, both outside of and under arrest, has had to endure and suffer in an unheard-of manner for over two years, namely until the 2nd of March 1735, when by the present Lord Advocate Fiscal of India, Mr. Adrianus Bergsma (who had entered into the proceedings a few months prior), a written claim was first served against his Honor and the former Colombo council members, against which the said Versluijs, in November thereafter, already brought in his defense by means of a detailed answer, accompanied by many documents submitted alongside it. That, time having been taken by the Lord Advocate Fiscal to reply, and the proceedings meanwhile being continued against the other council members (among whom was also included the 3587 former Fiscal Joan de Maurignault), the frequently mentioned Lord Versluijs, on the 27th of February 1736, died from this world due to obvious heartbreak and chagrin, since he could not look forward to any end to the affairs for a long time yet; having previously entrusted the administration of his estate by testament to the Orphan Masters, presently petitioners herein, who indeed made every possible effort, on account of the passing of the Lord Versluijs (whereby all charges against his Honor seemed to have lapsed), to extricate themselves from the proceedings, and likewise to regain possession of the fifty thousand rixdollars, or the value thereof, which had been surrendered into sequestration by his Honor in place of or in fulfillment of the bond judicatum solvi imposed upon him by sentence of the 9th of June 1734; however, without having succeeded in their attempt in that regard, because by two final interlocutory rulings they first saw themselves compelled to accept the continuation of the lawsuit, as well as to proceed according to the last retroacts, and subsequently also to transfer the aforementioned fifty thousand rixdollars into the Company's treasury for the benefit of

Coromandel Bengal and to the end that the matter would remain settled in chief there; that these respective decrees having been properly complied with, the orphan masters subsequently endeavored to pursue the proceedings with all diligence and zeal, as much as was in their power, which also resulted in the fact that these proceedings, together with those of the merchant and former fiscal of Colombo Ioan de Maurignault—the case of the other council members who had found themselves entangled and included in it from the beginning having already been settled separately by Your Honorable Worships on 11 June 1736—were finally concluded and brought to a state ready for judgment under the date of 31 December of the past year 1738, or a broadly extended time of between six and seven years after the late Mr. Versluijs fell into accusation and into so many sorrowful difficulties; so that the orphan masters, on account of all the aforementioned, could not have expected otherwise than a speedy termination of these protracted proceedings, and a prompt execution of justice, in order, on the one hand, to be enabled to withdraw the considerable amount of fifty thousand rix-dollars, which until that time had to remain in the Company's treasury without interest, aside from the sale of No. 33 sale of 3588 the estate, and on the other hand, also to give the required notification regarding the outcome of the case, which is of such great importance to the heir and other distinguished blood relatives of Mr. Versluijs, to the orphan masters at Middelburg, who were likewise called by testament to the further administration of His Honor's estate and the guardianship over the minor heir in the Netherlands; but that, when finding the most reason to flatter themselves with this, the orphan masters were most unexpectedly informed how it had pleased Your Honorable Worships to resolve and take a decision to circulate the lawsuit among all the gentlemen members, each individually, for review and reading, and thus to draw the case once again into a protraction of which virtually no end is to be expected for all eternity; for aside from the fact that the immense quantity of documents of which this concatenated lawsuit consists would require a year and a day for such an individual perusal, it also follows that at the slightest change, whether by unforeseen deaths or promotions among the above-mentioned gentlemen members, the case would have to begin anew, and such a large pile of papers would have to be reviewed and examined again by the gentlemen who Bengal Coromandel might be chosen to fill the vacant positions; without even speaking of the inconveniences that could further follow from this regarding the loss of notable documents of the case, both through unforeseen accidents of fire and others almost inseparable from loose papers that must pass through many hands, and also of the widely extended time that, even if the case unexpectedly could be terminated by Your Honorable Worships within one or two years in the aforementioned manner, would still be impending if a revision of the sentence were to be sought, and if both the newly arrived members of the court and the adjunct revisers, following the previous example, were then also to claim to take such a separate review of the documents at everyone's own home; whereby it would consequently be destined that, just as these proceedings have already outlasted the life of the late Mr. Versluijs, they could also easily outlast that of his minor heir. Which matters the orphan masters in their aforementioned capacity find themselves obliged to represent to Your Honorable Worships with the required modesty, that under correction, such is not proper; but, on the contrary, in three respects is diametrically opposed to all laws, to the prevailing Dutch practice, as well as to the fundamental and foundational laws, and the special orders of the Company in these regions. The canon laws in this regard are also very elegant and notable when one hears them provide that it is fitting to equity and justice to terminate the disputes of litigants with a swift judgment, chapter 2, on judgments and res judicata, since the purpose of a judge ought to be to put an end to lawsuits, chapter 3, on fraud and contumacy. Indeed, the most renowned jurists consider brevity itself to be one of the essential parts of justice, so that a judge, according to the excellent address of the French President Du Vair delivered at the opening of the Chamber of Justice at Marseille in the year 1597, page 214, ought to take no more time to settle a case than is due to him, because he otherwise makes himself guilty of the damages and inconveniences that this causes the parties. All of which especially finds its application in cases that are brought criminally, and therefore affect the honor and reputation of an accused, indeed even in some way of his heirs and descendants, regarding which the statutory laws have explicitly provided in the final law, Code, that criminal questions must be terminated within a certain time, that criminal cases ought to be terminated within two years, and not be extended to longer times on any occasion. Bengalese Coromandel even if a thousand separate points of accusation might be brought against someone, it is much easier and fraught with no less difficulty for a judge, after the matters have been investigated each in its order, to decide whether such a person is guilty or innocent, and also whether there is a defect of evidence, or that he ought to be acquitted for some other lawful cause, than that an extensive civil matter, over which sometimes twenty and more years have been pleaded, together with the exchanged documents having expanded almost to infinity through the chicanes and legal controversies that commonly occur therein, could be definitively settled. Indeed, so much could still be said on this subject that the Orphan Masters must once again restrict themselves in this regard; since from the little that has been brought forward concerning this, it is already more than abundantly clear and manifest enough how directly the disposition of Your Worships in question, in this second respect, also runs counter to the prevailing Dutch practice. And that in the third respect, the same is most of all in conflict with the radical and fundamental laws, as well as the special orders of the Honourable Company in these regions, stands completely beyond contradiction. Firm No. 33 sale of 3592 firm; for, not only has the entire administration of justice on the model of Dutch practice been violated here, even to the extent that the criminal ordinance of the year 1570 was expressly prescribed for observance by the Right Honourable Principal Lords in their letters more than once, whereby everything contained above from that practice again finds application in this matter in its full extent, and must make everyone understand that the circulating of whole case files has crept in solely through corrupt practice or abuse, and that only in matters of incomparably less complexity or extent than that of the late Mr. Versluijs here; but moreover, according to the Instruction for the Governor-General and Council of the Indies, resolved in the Assembly of the Seventeen on 17 March 1632, article 2, it constitutes a fundamental law that the said High Government should especially ensure and give orders to that end that principally criminal cases may be terminated as soon as practicable and that summary justice and prompt dispatch of justice be done to everyone, so that people in the Netherlands might remain free of complaints; which has since been ordered several times by reiteration by the Assembly of the Seventeen, and among others 4 Coromandel Bengalese others in a very significant manner by general missive of 17 December 1690, stating that whereas complaints came before them repeatedly about the lengthiness of the proceedings, whereby various persons who had come to Batavia were kept lingering, which caused the people to be consumed and fall into distress, the High Government should ensure that such persons might obtain summary justice and prompt dispatch of justice, as well as make the necessary provision that such matters and complaints might no longer come before the Assembly. Indeed, with special reference to the present proceedings, and with mention of the name of the late Mr. Versluijs, a similar order was even issued from the Netherlands by letter to the Right Honourable High Indies Government of 31 October 1733, all as striking and convincing proof that the Orphan Masters are most solidly grounded, as well as no less obliged by virtue of their office, to make their rightful grievances concerning a resolution of Your Worships that runs so completely counter to these fundamental laws and reiterated commands. And although, pursuant to those very laws and orders, they could have properly addressed themselves to the Honourable High Government No. 33 sale of 3593 Government, to request such provision for the execution thereof as has been expressly imposed upon and commanded to their High Honours, they have nevertheless preferred to turn first to Your Worships, because as yet prompt dispatch of justice has not been directly denied to them, in which latter case alone the laws dictate, and from the same, among others, it has been demonstrated by the Imperial Councilor A. Most Honorable Lords, The president and members of the Orphan Chamber of this city represent with the utmost reverence that, as testamentary executors of the estate of the late Lord Ordinary Councillor of India and former Governor of Ceylon Stephanus Versluijs, of blessed memory, they found themselves obliged on Wednesday the 18th of this month, by the enclosed petition, not only to make their complaint to the Honorable Council of Justice of this Castle regarding the fact that it had pleased the same to take a resolution to circulate the proceedings, pending between the Lord Advocate Fiscal and his aforesaid Excellency, after they had finally reached the state of judgment in December of the past year within the excessively broad timeframe of between six and seven years, among all the members of its court for separate reading and review; but also to demonstrate with a proper modesty and substantiation what damages the heir, alongside the entire family of the Lord Versluijs, was to suffer hereby; as well as how very contrary such a manner of proceeding was, both to written laws and prevailing practice in general, and to the fundamental laws and orders of the Honorable Company in particular; indeed, that it seemed to bring about nothing other than a protracted delay and postponement, to which an end could never be envisioned; besides the further notable inconveniences which were to be expected therefrom, No. 33 3597 and which necessarily forced the Orphan Chamber, in its aforementioned capacity, to protest for the preservation of the rights of those to whom they must account for the estate; as well as, upon all those and other grounds (the force and lawfulness of which will immediately be evident to your Excellencies from the tenor of the petition itself, and for the further justification of which it is still the time now), to request that their Honors would be pleased to alter the aforesaid disposition regarding the circulation of the documents, as well as to grant a speedy execution of justice in the proceedings according to laws, practice, and orders. Which petition, having been signed by the secretary by order of the president and members, and having been brought in as such on the aforementioned day, they had, as having done only that which their duty inevitably required and which could free them in the future from the charges of an impermissible negligence by the interested parties, expected nothing other than that the Council of Justice, noticing its notorious error, would take a fair and lawful disposition thereupon. But it has been so far from that, Most Honorable Lords, that on the contrary, the said court was pleased, on its ordinary court day of the day before yesterday, to summon the aforementioned secretary before the public bar in the presence of all attorneys and other people, as well as not only to cause a decree to be pronounced, filled with terms tending to the utmost shame, contempt, and prostitution of the Orphan Chamber, indeed such that it was impossible to depict with sufficiently natural colors the insults that it included everywhere, but also to proceed to that extreme of tearing the aforementioned petition to pieces before his face, and thus committing an act toward a board headed by an Ordinary Councillor of India, of which these regions and perhaps the entire civilized No. 33 3598 civilized world have never yet provided an example. For, besides that it has never been in use before any court, and especially not before the Honorable Council of Justice or the Worshipful Board of Aldermen of this city, to pronounce apostilles or dispositions on petitions against which contradiction or an exchange of pleadings applies on the public roll, and such was therefore in this regard visibly treated in such a manner so as to make the affront to the president and members of the Orphan Chamber the more glaring, scandalous, and sensitive, an even more enormous and unheard-of deed was also put into effect regarding this; namely, that when their secretary, after hearing the said decree, requested an authentic copy thereof in order to be able to report it clearly to his masters, this was completely refused under the pretext that it was a domestic matter. And in that manner it was also arranged to cut off and prevent finally all inquiry that notoriously had to follow upon such an unparalleled assault, as well as the complaints or redresses that were to be brought in and requested against it by the orphan masters, whether by way of policy or justice: thus condemning a board established by an equal sovereign as the Council of Justice itself; indeed, affixing such a consequence of infamy and indelible stain to it, without being willing or daring to grant it the act of condemnation, which, far from resembling a domestic matter, was (as said) proclaimed on the public roll in the presence of everyone, and therefore according to no law, right, practice, or order can or may be refused to anyone, indeed not even to a vile slave against whom it might lie, much less to a public board, since it is, on the contrary, one of the essential parts of No. 33

Since news has long since arrived concerning the delivery of our humble reports dated 1 October and the appendix of 1 November of the past year, dispatched to Your Right Honourable Lordships, we shall, under your highly esteemed benevolent interpretation, dispense with sending a copy thereof at present; and further, in order not to give a needless recitation of past matters, take the liberty to enclose herewith the copy of our latest missive, charted per the ship D' Adriana to Gamron, dated the last of the recently expired month of September, wherein Your Right Honourable Lordships, if it please you, will find detailed a general account of what has passed concerning both trade and other circumstances affecting Your Right Honourable Lordships' worthy interests in this region. From that copy, it will also become apparent to Your Right Honourable Lordships what the miserable state of trade is at this place, as well as the extraordinary scarcity of money by which it is caused; so that it is in truth astonishing how we, under those lamentable circumstances, have still been able to gain for the Honourable Company in this concluded financial year of 1737/8 a net capital of ƒ30455:19:8; which then, added once again to that which we showed the last time, or in our aforementioned humble missive, to the amount of ƒ258794:19:—, together with the said ƒ30455:19:8 makes a total amount of ƒ289250:18:8, which has been produced during the latest five financial years that the Merchant, [illegible] particularly the considerable changes at the Supreme Indian Council through the untimely demise of His Excellency, the High and Right Honourable [illegible] Bengal, and First Resident Gutchi, administered this office. Your Right Honourable Sirs, the Honourable, Valiant, Highly Esteemed Lord Governor-General of the Dutch East Indies Abraham Patras, of highly praised memory, and the new election occasioned thereby for Governor-General of the Dutch East Indies, fallen upon the illustrious and widely renowned person of His present High Excellency Adriaan Valkenier, whom God preserve. In which manner we have complied with Your Honours' respected orders on this subject, or the execution of the ceremonial inauguration of our aforementioned noble Lord Governor-General, we hope that it will appear to Your Honours' satisfaction from the original resolution dated 6th July last drawn up among us here, enclosed herewith under No. 2; furthermore, that Your Honours will be pleased to exercise generosity by graciously passing the expenses incurred for that purpose to the amount of w.s. 810:— or f344:5:—, see the specification No. 3, as they could not well have been less. The supply of old copperware seems to have decreased very much for some time; partly because the places from which it must come cannot deliver it so abundantly for the present; and secondly, because its prices have now dropped in a low market, or to 53 and 52 mamoodies the 27 lb, in all likelihood and as we can also observe, because such profits are no longer made on it upon transport as before, since so much is carried annually from Europe to Bengal, Madras, and Surat on the English Company's ships that these crude lumps and pieces cannot compare in esteem with those cast cakes, although it might well be that after smelting and refining, this copper in itself may be found to be of a much better quality than the European; but of that we cannot reason with any proper foundation, as the true knowledge thereof is far beyond us. And even if we were ordered de novo to collect old copper, we would find ourselves greatly embarrassed in executing it, due to the strict limitation contained in Your High Honours' highly respected order in the extract from the Batavia requisition dated 30 September 1737, where galley-ware is explicitly prohibited, whereas most of what is sold here consists of such burnt-out kitchen utensils, and the seller would never allow one to separate those from the other pieces and only accept the best; so that to leave entirely off it, in our humble opinion, will be for the best, so as not to offend against the formidable orders of the said High Government.
