answer which so aggravates the case that the prisoner can be subjected to sharper examination and to torture, which also appears to have been understood thus by the lords superiors in their honored missive dated 15 July 1718, when their Honorable High Mightinesses there in the preamble come to say: that a judge beforehand must not declare whether a trial shall be ordinary or extraordinary; for all which reasons the undersigned hereby requests that your Honorable and Worshipful Honors may be pleased to condescend to all his aforesaid both lawful and necessary requests, or else take such disposition as they shall in good conscience and in good justice deem proper for a speedy dispatch of the cases, in which he, the undersigned, will readily admit to being otherwise confused and likely to remain so. It having been presented to this Council by the Honorable Lord President Mr Iacob Lakeman how repeatedly the Lord pro interim Advocate Fiscal Mr Nicolaas Iongsma had been recommended to proceed as speedily as possible with the case both against the detained Lord Adriaan Valckenier and against the criminally held hostages Mr Willem Vincent Helvetius and Mr Cornelis Phillips, as appears from the minute held thereof dated 3rd of this month, but that nevertheless until today the said Lord pro interim Advocate Fiscal, notwithstanding diverse exhortations both verbal and in writing, keeps dragging the same along under these and those pretexts and continual requests; wherefore the said Lord President found himself obliged at this time to submit to this Council for consideration that whereas the two last mentioned, Helvetius and Phillips, had already sat secured under supervision of the servants of this Council since the 3rd of October, and the first mentioned had been detained since the 26 November of the past year, whether one ought not from now on to enjoin upon the Lord pro interim Advocate Fiscal a peremptory time to proceed with the cases against the aforesaid three persons, while the said Honorable Lord President came to declare that he would not, or could not, take the aforesaid persons any longer thus upon his Honor's account; and this Council having thereupon fully conformed to the proposal of the said Lord President, it was thought fit to ask the Lord pro interim Advocate Fiscal within what time his Honor would be in a position to bring out the demand both against the detained former Lord Governor-General Adriaan Valckenier and against the hostages Mr Willem vincent Helvetius and Mr Cornelis Phillips, and to come forward therewith; whereupon the said Lord pro interim Advocate Fiscal declared that his Honor could set no time for it, not so much because of the manifold work as because he found himself still very confused in that matter, still referring to the means and ingredients of the petition presently submitted by his Honor against the cited Helvetius, but that his Honor would await the orders of the Council, which he would read with respect, and if possible obey the same, or otherwise lodge his grievance against them; whereupon by this Council, after ripe 2075 ripe deliberation of what is necessary, it was thought fit, in order once to make this important matter proceed to the main issue, to order the said Lord pro interim Advocate Fiscal to bring out the demand within the time of six weeks, both against the detained Lord Adriaan Valckenier and against the hostages Mr Willem Vincent Helvetius and Mr Cornelis Phillips. 2017 Tuesday the 13th of August 1743. Present the Honorable Lord President, item the Lords Councilors and co-opted Members in this matter, except the Lord Coenat. Since it has for some time been noticed by this Council that the pro-interim advocate fiscal, in his successively submitted writings, has come to use many caustic and offensive expressions to the prejudice of the adopted rulings and ordinances of this Council, and the same having now occurred again, to considerable offense, upon the reading and examination of the replication delivered today by the said fiscal against a petition submitted on behalf of Mr. Willem Vincent Helvetius on the 30th of July last; it has been resolved to recommend most earnestly to the said pro-interim advocate fiscal that he show the Council proper respect and esteem in accordance with his duty and obligation, and consequently to restrain himself in the future from using such prejudicial and offensive expressions as well as arguments; which having then also been communicated to His Honor by the Honorable Lord President in orderly terms, the same immediately immediately thereupon declared himself and requested that this Council please look out for another pro-interim advocate fiscal, saying that he can no longer continue in that service because of his weakness caused by the continual troubles; of which declaration and representation it has been resolved for the time being to keep this record. By the petitioner, the following petition was presented to the Council today, with the request as stated at the end thereof. To the Honorable Mr. Jacob Lakeman, Extraordinary Councilor of the Dutch Indies and President, and the other Lords Members of the Honorable Council of Justice of this Castle. Honorable Lord and Honorable Lords, Shows with proper respect to Your Honors and Honorable Lords, Ferdinand de Roy, merchant in the service of the Honorable Company and former commissioner for and over the affairs of the native, that he, now over a month ago, from the civil detention which he had to endure and undergo for the time of more than six months within the Honorable Company's chains, after several prior applications through various petitions, both for obtaining free access and visitations by his, the petitioner's, aforesaid friends, relatives, and acquaintances during his detention detention, as well as for the release of his person from the mentioned civil detention, whether simply on the grounds of his answers given to the presented interrogatories, or else under sufficient security and bail, upon solemn promise and hand-pledge to appear again at all times when required, presented to this Honorable Council a certain request, to the end that the Lord pro-interim advocate fiscal of India, Mr. Nicolaas Jongsma, might be ordered to institute his action, if he should believe to have any against the petitioner, within a certain short and peremptory period of eight or at most fourteen days on pain of default, or else that he, the petitioner, might otherwise, under bail, solemn promise, and hand-pledge to appear at all times when required, or in such other manner as Your Honors and Honorable Lords should please to think fit, be relaxed and discharged from his painful civil detention; that Your Honors and Honorable Lords, ruling upon the aforesaid request some days thereafter, were pleased to grant the latter clause of the same in so far that he, the petitioner, under hand-pledge and solemn promise to appear again at all times when summoned, under penalty of confession and conviction, was discharged from his oft-mentioned civil detention, yet concerning the first clause of the oft-mentioned request, nothing in the least was ruled, according to the rulings made by this Honorable Council on the 16th of the past month; and that the petitioner has since been informed and notified by rumor 2019 that the said Lord pro-interim advocate fiscal has declared, both verbally and in writing to Your Honors and Honorable Lords, that His Honor has not the least ground for any manner of criminal action against or to the charge of the petitioner, which seemed the more acceptable and probable to the petitioner since he is fully reassured, confident, and convinced within himself of having committed nothing evil or punishable, being at the same time no less persuaded that of what his enemies have plotted and divulged with so much cunning, never anything in the least will be able to be demonstrated or proved; wherefore, and since he, the petitioner, by the given solemn promise and hand-pledge does not only continue under the imputation of suspicion, but moreover is also prevented and kept unable to be employed in one thing and another, the petitioner therefore now addresses himself to Your Honors and Honorable Lords with a very respectful request, to the end that he may be discharged from the aforesaid solemn promise and hand-pledge, or else that the oft-mentioned Lord pro-interim advocate fiscal be ordered as yet to peremptorily institute His Honor's action within the time of eight or at most fourteen days, on pain of default. 2020 Tuesday, the 13th of August 1743. Present the Honorable Lord President, likewise the Lords Councillors and co-opted Members herein, except the Lord Coenaas. On behalf of the petitioner, the following petition was presented to the Council on the 30th of July last, requesting as stated at the end thereof: To the Noble and Worshipful Lord, Mr. Jacob Lakeman, Councillor Extraordinary of the Dutch Indies and President, together with the Lords Councillors of the Worshipful Council of Justice of the Castle of Batavia. Noble and Worshipful Lords, Reverently shows Mr. Willem Vincent Helvetius, Ordinary Councillor of this Worshipful Council: That, at the request of the Lord Advocate Fiscal pro interim of the Dutch Indies, Mr. Nicolaas Jongsma, on the 3rd of October of the past year 1742, he, the petitioner, was placed in his residence under 2. the supervision of two of Your Noble Worships' officers and under the guard of two military sentries; and that indeed with an injunction against the alienation of goods or papers; that, moreover, as a consequence of this confinement, the petitioner's wages, board money, and emoluments have come to be withheld; and he has thus been deprived of an annual income of nearly two thousand rix-dollars; that he, nevertheless, by the aforementioned injunction, has been prevented from reducing his domestic establishment and very heavy household in proportion to this diminished income of his, but, on the top of that, has found himself compelled, by providing a free table to the aforesaid officers according to his, the petitioner's, decency and status, to increase the expenses of his household; that he, the petitioner, has thereby been unable to get by on the meager income from his capital, and found himself constrained, three or four months after the aforesaid confinement, to borrow from his brother-in-law, the Shahbandar Zacheus Toezaak, a sum of one thousand rix-dollars, in the hope that the same would last as long as he had expected his, the petitioner's, confinement 2021 was to endure; but that he, the petitioner, through a period of almost ten months having now elapsed in the meantime, has found himself deceived therein; and at present finds himself without cash for the purchasing of rice and other provisions, both for himself and his child and for a great quantity of his slaves, as well as for the maintenance of his house, stable, and garden, and for the payment of some necessary debts incurred; that the petitioner, seeing as yet no end to so long-lasting a confinement and enjoined interdictions, and fearing that a second borrowing of money might be taken amiss by Your Noble Worships, and yet, in the absence of the necessary funds, he would have to see his slaves, and himself together with his daughter, perish from hunger, thirst, and lack of clothing and necessary sustenance; so the petitioner finds himself compelled to petition Your Noble Worships in order to provide therein, and to authorize the petitioner to be permitted once more to borrow an equal sum of one thousand rix-dollars, which he hopes and expects will be sufficient to to last as long as it shall please the Lord Officer to keep him, the petitioner, in the present uncertain state and condition. Noble and Honourable Sirs, The pro interim advocate fiscal of India, Mr. Nicolaas Jongsma, having learned at the last-held meeting—upon his detailed and, as he believes, lawfully and reasonably well-substantiated request for the incarceration of the hostage petitioner—with the greatest astonishment in the world, that the same, without taking regard of the arguments and components, was not only denied, but that he, the rescribent, was also thereby ordered to summon the petitioner to the roll within six weeks in the ordinary manner, and at the same time to bring an action within the same extraordinarily short span of time against the same, as well as against the former Governor-General Valkenier and the suspended advocate fiscal Phillips, without any request ever having been made to that end by or on behalf of any of all the three mentioned distinguished persons, nor anything in that regard having been attempted or complained of in a direct manner; thus the undersigned was at that time so taken aback and thrown off balance, or beyond the capacity of his ordinary, albeit very modest, capability and promptness, that he was not in a state, nor did he deem it advisable for the preservation of his lawful rights and privileges of grievance, revision, or otherwise, upon the requisition of this honourable Council, to declare himself immediately on a certain ridiculous and offensively phrased petition, which very casually at that same moment was brought in and submitted for and on behalf of the petitioner, to the end that your Honours, notwithstanding the imposed interdiction on the alienation of goods, might be pleased to authorise him to borrow a sum of 1000 rixdollars, just as had already, note well, once been done by the petitioner during the hostage detention. The rescribent calls that request ridiculous and offensive, and rightly so, as he believes, without contradiction. For, first, it is ridiculous to request authorisation for something that one has already, according to the confession, done at one's own risk and without authorisation. Secondly, under the outward bait and the semblance of quasi-respecting the orders of your Honours, to express his fear that they might take a second loan amiss, without being concerned about how the first is regarded. Thirdly, the pretense of the hostage is ridiculous and even offensive, as if, in the absence of these funds, not only his slaves, but also he, the hostage, and his daughter would have to perish from hunger, thirst, want, etc., which truly, if it were not in fact an artificial and abominable lie, would be very contrary to the intention of the rescribent, who, according to oath and conscience, regards nothing in the world with more zeal and earnestness than to secure and preserve the hostage and his peers for the righteous punishment which their matchless and capital villainies have deserved; and who therefore has several times, but alas in vain, sought to have the hostage confined in the lord's irons and his goods sequestered, so that the provided food would not be necessary at all, nor would there be any occasion to borrow any money, or to offend the passers-by and stout-hearted people through a so-called strict observance in maintaining hostage detention, namely in an open room facing the public street and unprovided with iron bars for thieves or scoundrels, and often sitting in the evening with half or the whole

whole body outside the door and on the stoop, in everything more resembling a person who receives public company and is only held pro forma in hostage to satisfy a few coins, rather than one who is in fact challenged for capital crimes, and found guilty, yes even in confesso. The rescribent shall furthermore pay not the slightest regard to the false positions in articles 2 and 3 of the aforesaid request, wherein contrary to the truth it is stated, first, that the hostage, at the request of the undersigned, was placed in his house under the supervision of two attendants and two military men, whereas the rescribent never had the slightest thought thereof, but indeed made a request for detention in the Company's irons; just as, secondly, it is also added thereto that instead of simple interdiction, arrest, and sequestration requested by the rescribent and decreed by Your Honorable and Worshipful Court as interdiction of alienation and by no means, as is posited, interdiction of non-alienation, which implies free alienation; and herewith leaving the disposition and resentment concerning such shocking, foolish, and lying requests to Your Honorable and Worshipful Court with complete tranquility, the rescribent shall, below stood, persist for rescription C. After the roll call, it was brought forward by the Honorable Mister President Mr. Jacob Lakeman that on this day the term of six weeks had expired which the gentleman Advocate Fiscal pro interim Mr. Nicolaas Jongsma had been enjoined to by the minute of the 13th of August last, for the submission of the main charges, both against the detained former gentleman Governor-General Adriaan Valckenier and against the criminal hostages Mr. Willem Vincent Helvetius and Mr. Cornelis Phillips, and subsequently the said gentleman Advocate Fiscal pro interim was asked whether His Honor was ready with the aforesaid charges, or if he still required any prolongation for that purpose; whereupon, by the said gentleman Advocate Fiscal pro interim, after upon his question it was said by the said Mister President that regarding his request for dismissal from office made in this Council on the 13th of August last, nothing had as yet been disposed of, but that the same had to be presented to Their High Nobles, to the first it was answered that even though he would have gladly obeyed the order within the prescribed time of six weeks, he would have been prevented therein by his weakness, caused by manifold daily work and persisting continuous difficulties, without further elaborating on this matter or wishing to answer the second part of the aforesaid question; from all of which it is sufficiently to be inferred that the said gentleman Advocate Fiscal pro interim does not intend to obey the orders of this Council mentioned herein above, notwithstanding that his office and duty required him to do so, and thereby has notoriously demonstrated his unwillingness to proceed with the aforesaid case; thus, considering that the same has been kept lingering by him long enough, as well as being held up against all exhortations and ordinances, it has been judged by this Council that it would no longer be justifiable to tolerate his delay any further, and to encumber the detainees with a detention that is far too long, but on the contrary finds itself compelled to provide therein, and therefore has deemed it proper, in order to let the cases of Justice proceed, to which this Council deems itself obliged, to address the Honorable High Government of these lands and to bring the foregoing to the knowledge of Their High Nobles, as well as to request that it may be Their pleasure to provide this Council with another officer who will attend to the cases of Justice with the required promptitude. The deliberation whether a special oath ought to be administered in the aforesaid commission to the Lord Bailiff Hendrik Jacob van Suchtelen, who was appointed by this Council as officer in the case of the Lord former Governor-General Adriaan Valckenier and associates, having been postponed in the minutes of the 8th of this month until a further meeting, and the same now being brought up again for consideration, it was not only deemed very necessary, but it was also resolved to present the draft of the oath, as it has been framed by this Council and is annexed hereto, with all respect to Their High Excellencies for revision, in order that, upon approval of the aforesaid oath, the same be administered to the mentioned Lord van Suchtelen as soon as possible. By the Noble Lord President Master Jacob Lakeman, the following extract was submitted in Council today: Wednesday the 20th of November 1743 Extract from the General Resolutions of the Castle of Batavia, taken in the Council of the Indies on Tuesday the 15th of October 1743: Along with a minute from the Council of Justice of this Castle dated the 11th of this month, the draft of a special oath having been submitted for revision and approval, drafted by Their Honors to be taken with the approval of this Government by the Bailiff Hendrik Jacob van Suchtelen as nominated officer in the cases of the former Governor-General Adriaan Valckenier and associates, it was resolved to approve the mentioned oath, as well as to let the taking thereof take effect, and to give notice of this decision to Their Honors. 2837 Wednesday the 20th of November 1742 Present the Honorable Lord President, likewise the Lords Councilors and co-opted Members in this matter Today, by or on behalf of the former and currently detained Governor-General Adriaan Valckenier and the held hostage Mr. Willem Vincent Helvetius, there has been presented to this Council a certain ample petition containing in substance a grievance concerning the protracted duration of the proceedings and the conduct held toward them from time to time in that regard by the former acting Advocate Fiscal Mr. Nicolaas Jongsma, along with several alternative requests made therein, namely: that, on account of the long duration, they might be released from their detention and hostage under pledge and promise to appear at all times when summoned under penalty of being held as confessed and convicted, or else on juratory caution, or at least on such sufficient fidejussory caution as this Council should find appropriate, and that as a consequence thereof, the granted attachment and interdict against the alienation of the goods and papers might be lifted and discharged; but in case this should not be granted to both or either of the petitioners, that the officer might then be enjoined to submit to them within the space of six weeks the action he believed he had against them, and further to admit them to their defense, or that the said officer should otherwise have to discharge them and let their goods follow freely, without any conditions or under such conditions as this Council should deem necessary. After the reading thereof, and upon the contents of the same, the Lord Bailiff Hendrik Jacob van Suchtelen, currently functioning as officer in this matter, having been heard and asked how far he had advanced with this case, and whether he was in a position to declare against what time he believed he might have his claim prepared, the said Lord Bailiff thereupon declared that he would not be in a position to do so within six weeks due to the multitude of papers, but that he would endeavor to do his duty so as to be ready within approximately two months and to bring the claim against them, striving nevertheless, in case he should be able to do so sooner, to come forward with the same. Whereupon it was resolved by this Council, instead of deciding upon the alternative requests, to recommend the said Lord Bailiff to proceed as quickly as possible with the cases of the detained Lord and that of the hostage, and to bring a claim against them. That the petitioner was subsequently, at the instance of the same aforementioned officer, heard on interrogatory articles in February 1743, and thus only two months thereafter, 12. And that he later confirmed the same under oath. 13. That further, up to the present day, it being nearly twenty-one months since his arrest at the Cape of Good Hope, 14. And over 12 months since his return here, 15. As well as not far from 12 months after the aforementioned judicial detention, 16. That the gentleman Fiscal Jongsma also proceeded further against the petitioner by conducting inquiries, without any other effect, up to now, than that the gentleman officer pro interim, after various of his requests for incarceration were denied, 8 knew not how to employ anything against the second petitioner 39. except only a very savage, bitter rescript, in no way compliant with people of knowledge and judgment, presented to Your Honorable Worships on 13 August last, 40. against the petitioner's (who, as well as His Honor sub reatu, ought to be safe under the inviolable safeguard of Justice from all injuries) very simple, slight, though entirely respectfully drafted petition presented on the 30th preceding; in which rescript His Honor, without any investigation, declares in court ex propria conscientia 42. to have gotten through the center. 43. That finally, 44. notwithstanding that upon this it had been ordered by Your Honorable Worships to this officer (so greatly rejected and suspected by both petitioners in the beginning of these proceedings) on that same 30 July 45. to formulate the principal claim against the petitioners ordinario modo within 6 weeks, 46. And furthermore, after the expiration of this appointed time, on 10 September past, an offer was made to prolong that pre-fixed time (if he so required), 48. by this gentleman officer, 49. - 49. That over and above this charter, it was further granted and conceded on 14 March by the Lady Maria van Bourgondien to the provinces of Holland, Zeeland, and Vriesland as an everlasting privilege, article 37, 211. that prisoners must be brought to trial within three days after their apprehension, 212. or in default thereof, that the burgomasters and schepenen by a majority of votes after the aforesaid three days may release them from the aforesaid prison without forfeiture. See Eduard van Zurck, Codex Batavus, title Imprisonment, page mihi 352, paragraph 4, note 1. That also in accordance with these inviolable privileges, the regents of Dordrecht wrote to the States of Holland in the year 1660 regarding certain of their imprisoned citizens, that failing to obtain any information against their citizens, they would release them, 215. as can be seen in the resolutions of the aforementioned High and Mighty Lords States dated 23 January of the cited year. 216. That the same is likewise established by the charters of Zeeland, article 22. 217. that finally the petitioners, upon these established solid grounds, have deemed that they ought no longer to remain silent, but without any concern regarding these fiscal conducts, to be permitted to bring their lawful grievances before your honorable court of justice, in the confidence that your honors will not withhold from your petitioners the enjoyment of those privileges for which the Netherlanders, and among them the well-known ancestors of the first petitioner, have zealously guarded, and made no hesitation to take up arms, principally against the Spanish government, in maintenance thereof, and for eighty consecutive years to risk their life and property; the more so since your honors have already declared the petitioners' case to be of such a nature that the officer will have to institute his pretended action therein by ordinary procedure, and for that reason the opportunity and power due to the petitioners ought also to be granted without further delay, in order, after obtaining disclosure of the evidence gathered against them, to make the necessary preparations for an ordinary defense, and to obtain information to their exoneration which may perhaps now still be gathered here or there; the second petitioner repeating here, as a particular basis for the requests to be made below having special reference to his person, according to the aforementioned examination of these proceedings as a point of much note: that it has pleased your honors to reject the alternative request made against him, the second petitioner, by the former fiscal for bodily apprehension or absolute civil detention, and only on the 3rd of October 1742 to grant against him, petitioner, a provisional civil detention until further disposition; that subsequently, after the examination of him, petitioner, had ended and further fiscal inquiries were made, further requests were made by the former officer against him, petitioner, in token of his irreconcilable bitterness, not merely once but several times, for confinement in the state prison; the same nevertheless having been found by your honors to be ungrounded and were denied, and nothing else was left to the officer with respect to those fruitlessly sought imprisonments than to pour out, on the 13th of August 1743, with deep sighs, a theatrical and entirely enthusiastic alas; that the petitioner therefore also deems that he may now hope, after this detention, which although only provisional has nevertheless lasted for more than 13 months, to be released from it at last by further disposition of your honors.
