Present the Honorable Lord President, item the Lord Councillors and co-opted members in this matter, except for Mr. Kien due to indisposition, and Mr. Vonglaan being on a mission to Cheribon. Today, a certain petition having again been presented by the hostage Ferdinandus de Roij, wherein he requests that those whom he, the hostage, separately listed, consisting of the Commander and Master of Equipage Hendrik Opmeer, the junior merchants Cornelis van der Hoop, Jan Louis de Win, and Casper Rudolff Brunner, might be granted free access and entry to him, the hostage, the Lord pro interim Advocate Fiscal has declared thereon that he referred to that which he had dictated on the 25th of this month regarding another request made by him, De Roij, which stands noted in the minutes of the aforesaid date, of which this note is kept. Today, the petition below was presented to the Court by the hostage Ferdinandus de Roij, requesting as stated at the end thereof: To the Honorable Lord, Mr. Jacob Lakeman, Councillor Extraordinary of the Dutch Indies and President, together with the other Lord members of the Honorable Court of Justice of this Castle. Honorable Lord and Honorable Lords. Ferdinand de Roij, merchant in the service of the Honorable Company and former commissioner to and over native affairs, shows to Your Honors with due respect that, having been taken as a hostage into the Honorable Company's custody on the 27th of December of last year by order of Your Honors, and having been held therein until today, first for some days without and subsequently with access by his wife and child, as well as his uncle by marriage and relative the burgher Ingen Haag and his wife; after having been interrogated and having answered a multitude of articles and interrogatories at the requisition of the Lord pro interim Advocate Fiscal, he has, by two distinct petitions, requested the release of his person from the mentioned hostage, even if under bail or handfasting, or else to be relocated in custody to his house; however, since both of those requests have been denied him by Your Honors, and he, the petitioner, is deprived and bereft of all company, both by the severe indisposition of his wife and the numerous occupations of his above-mentioned uncle and relative, he therefore takes 1974 the liberty herewith to address Your Honors once again with a very humble request, to the end that those good friends and acquaintances who might wish to visit him in this his sad circumstance may be granted free access and entry to him, the petitioner. Today, a certain ample petition having been presented to this Court for and on behalf of the Right Honorable Lord Governor-General Gustaaff Willem Baron van Imhoff, the Honorable Lord President, Mr. Jacob Lakeman, immediately excused himself from giving his advice regarding this matter, because he had been the general attorney of his said Right Honor and had previously also made a similar request to the Court and had been excused at that time. Haksteen, qualified sworn clerk. No. 3 1976 Monday the 17th of June 1743. Present the Lord Councillors and co-opted members in this matter, the Honorable Lord President being excluded. On the occasion of a certain petition presented to this Court on the 14th of this month for and on behalf of the Right Honorable Lord Governor-General Gustaaff Willem Baron van Imhoff, it now being taken into consideration how his said Right Honor came to request at the end of the same, among other things, an attachment on all goods, movable and immovable, actions and credits, however named and wherever situated, belonging to the former and currently detained Governor-General Adriaan Valckenier; and that this had also already been requested and obtained here from the Court on the 22nd of December 1741 by his Right Honor's attorneys, the late Lord Ordinary Councillor Mr. Nicolaas van Berendregt and associates, but that before that decree had been executed, an appeal for revision had been entered at the registry in an unauthorized manner by one of the attorneys of the said Lord Valckenier, being the currently detained Mr. Willem Vincent Helvetius, together with the fact that this interposition was subsequently declared to have been made properly and within the due time, and accordingly the execution of the attachment granted at that time was suspended; that

that furthermore the aforementioned authorized representatives of the aforementioned Mr. Valckenier, upon a presented request, were granted revision in communi forma, without the same having been prosecuted up to now; that also the time for revision according to law is well determined at two years to pursue such, but it being considered that the same stay and revision was granted, and forced through with violence by a majority of votes by seven judges who afterwards, according to the letter of the Gentlemen Masters, were declared partial and suspect judges in the case of the former Governor-General Adriaan Valckenier with the consequences and attachments thereof, and moreover one of the same, being Mr. Cornelis Phillipstans, is criminally held hostage; and besides that Their Right Honorable Excellencies have been pleased to declare with great emphasis everything that the aforementioned Mr. Valckenier did in respect of the arrest and the subsequent sending off of the Gentlemen van Imhoff, de Haase, and van Schinne, as null, void, and of no value, just as if such had never happened; so it is then also, in consideration of what is stated above, unanimously understood by this Council, without taking regard of the stay of the execution of the arrest granted at that time and the writ of revision, to dispose, for the time being upon the request of the Right Honorable Mr. Petitioner, summarily in such manner as in good justice should be understood to belong; in witness of what is stated above, it was approved to have this minute recorded, in order to serve as the charge wherever and however it might be required. It is understood, before disposing of the request of the Right Honorable Lord Governor-General Gustaaff Willem Baron van Imhoff, delivered on the 15th of this month, to send the Secretary of this Council to the detained former Governor-General Adriaan Valkenier, in order to ask him whether he had any objection to the fact that the Extraordinary Councillor Mr. Nicolaas Crul were nominated and qualified to attend to his rights against the Right Honorable Mr. Petitioner in this matter. By the Procurator van Vliet, on behalf of the Right Honorable Mr. Petitioner, the following request was presented to the Council on the 15th of this month, and alongside it submitted a register with various documents, requesting as at the end of the same request. To the Honorable, Respected Gentlemen, My Lords of the Council of Justice of the Castle of Batavia. Honorable, Respected Gentlemen! Shows with great respect Gustaaff Willem Baron van Imhoff, presently reigning Governor-General, that on the 6th of December 1740, then being an ordinary member of the assembly of the High Government of these lands, constituting the representative sovereign, and occupied in his function in the aforementioned assembly, together with the entire body of the aforementioned High Government of these lands, by the violent, despotic, and tyrannical orders of the then Governor-General Adriaan Valckenier, had to see himself assaulted by a troop of armed men, who were subsequently found to have been soldiers of the garrison of this place, who, without one being able to know whether it was aimed at murder, robbery, manslaughter, or something else, made themselves master of the aforementioned assembly hall in such a manner that the ordinary form of government, thereby losing its appearance, honor, and respect, as well as its power and stature, the undersigned and two of his fellow councillors, against whom the outcome showed this entire evil plot was aimed, were finally forced to bow under that violence, to endure all shame, insult,

scorn, insult, and also all damage which it should please the resentful governor and so-called Captain General, who has now set himself up as sovereign, to inflict upon her. Having then had to undergo, in this defenseless condition, following the violence done to the entire assembly, first a public violation of their character by their disarming, thereafter a criminal arrest and ignominious abduction by armed soldiers, subsequently a no less ignominious detention in their houses without access from anyone other than those specially permitted by the tyrant, and finally a disreputable transport to the Netherlands in a manner that, in the eyes of the world, was as scandalous as it was abominable, and whereby, above all the shame, disrespect, disparagement of their eminent character, and other detrimental consequences, nearly irreparable damage to his property was also inflicted among others upon the petitioner; the Governor-General Valckenier taking everything upon his own account and responsibility, and even cutting off all ways and means for him to properly put his private affairs in order, by a prohibition on all notaries passing any instruments for the petitioner and his then fellow-councillors. Now, just as concerning the first matter, namely the violence done to the assembly and its members, the injured government did not fail to properly protest against these acts of violence and to consider those proceedings null, informal, and without effect, so also, with respect to the latter, namely the damage suffered thereby, the petitioner did not fail to be immediately on his guard, and upon his departure for the Netherlands to leave behind for his attorneys a distinct account of everything he could provisionally calculate at that time, with orders to look after his rightful claims, at least in that respect, as soon as the violence should cease to such an extent, with the anticipated relief of the aforementioned Valkenier from the government, that one could at least catch some breath again and dare hope to get the dispute decided through the ordinary legal ways and means between a man and his neighbor. In such manner that the aforesaid attorneys also did not fail to present that account, together with a petition for attachment upon the property left behind by the just-mentioned Valckenier, to this council shortly after his departure on the 22nd of November 1741; but, whether those precautions which Your Honors perhaps considered necessary at the time were not observed therein, or whatever the reason thereof may have been, the outcome did not answer expectations, since the requested provisional measure was denied, until the petitioner's attorneys, resuming the matter in the month of December of the same year 1741 by a further petition substantiated with various documents, finally obtained the aforesaid attachment, but with no more effect than the first time, seeing that the attorneys of the aforementioned Valckenier managed to make use of and help themselves, with very detrimental consequences for the petitioner, to all sorts of frivolous, unfounded, and far-fetched exceptions and evasions; first bringing to light a so-called antidotal petition, filled with a multitude of unsound assertions, although it came into the world later than the request made for the petitioner, as the date indicates; and thereafter, in the execution of the decreed attachment, interjecting an extraordinary revision with a statement in the form of a protest made at the secretariat of this council, in which they brought forward various allegations speaking of appeals, which are of no effect regarding the matter in this case; and finally, by all these completely unfounded agitations, as it appears in every respect to the petitioner, managed to bring it so far that Your Honors, by a minute of the 23rd of December, declared that revision properly interjected, and also continued the suspension of the attachment, and the matter has subsequently remained at that point, so that the rightful claim of the one who has already from all sides

However, since his affairs in the Netherlands, through God's goodness and the righteous favor of the Right Honourable Gentlemen Directors, have taken a completely different turn, and the petitioner has already been restored in integrum by the aforementioned Honorable Gentlemen to such an extent that he now finds himself present here and in a position to personally prosecute his just claims against the former Governor-General Valckenier before Your Honours, he therefore requests Your Honours' equitable attention, reflection, and decision regarding the following positions upon which his request shall be founded: Firstly, Your Honours are requested to consider in this matter that the case of Mr. Valckenier regarding the assault of 6 December 1740 is twofold: the one concerning the gentlemen specifically wronged thereby, and the other concerning the government. The latter is the right of the offended sovereign, which is prosecuted before the judge by the one who is ex officio bound to maintain the rights of the same. The first is the wronging of distinguished private individuals, who, above all other actions, are also entitled to an action for injury and compensation for damages. 2) The decision of the one does not depend on the other, and the latter action even has nothing in common with the first. For suppose Mr. Valckenier had not committed an offense in this, he nevertheless, by beginning with the execution, committed a nullity which eo ipso entails a restitutio in integrum. And suppose Mr. Valckenier indeed had something against the gentlemen van Imhoff, De Haze, and van Schinne, he nevertheless, through the improper handling of the matter, rendered it null and void, and is consequently bound to the restitution in integrum before anything further can take place between him and the aforementioned gentlemen. 3) This nullity is contained within the case itself and does not need to be decided, because the laws of the land, which clearly enough forbid all ways of violence; The orders of the Company, which permit nothing of a sovereign, arbitrary, or despotic disposition, even in the very slightest matters; the bypassing of the ordinary judge, who is the only one through whom all disputes must be decided; or otherwise the representative sovereign residing in the High Government of India, who, if matters are so constituted that the ordinary judge could take no notice of them, is then the only one to establish order upon all occurrences; and finally the very oath upon which Governor-General Valckenier entered into the exercise of his office, and which thus ought to be the foundation of all his legitimate and usurped authority, unanimously decide that in this matter a nullity has been committed with respect to those specifically interested therein, which is so great that it eo ipso also now renders everything that followed from it and was built upon it powerless and of no value. 4) But the decision of the Right Honourable Gentlemen Directors in the Assembly of Seventeen, the lawful deciders of all political disputes, places the matter in an even clearer daylight, according to the attached three extracts from Their Honours' secret letters of 23 September and 13 December 1741, as well as 21 April 1742, concerning this matter. And nothing more forceful can be devised to declare a matter null and void than the wording which Their Honours employ in that regard, as Your Honours will discover at a glance, when they say that they consider this case as if it had never happened. 5) Just as this decision is in itself lawful, having been rendered in a political case, politically treated, and submitted for decision to Their Honours, so it is moreover also absolute, and so absolute that regarding this specific case between Mr. Valckenier and the three gentlemen, it can permit no further examination or dispute of matters, except in its entirety and ab initio after all the effects of the nullity have first been satisfied, which principally also

Likewise, the restitution in pristinum statum and consequently also the resulting compensation for damages, since this nullity and cassation of everything that had been done in that matter thus far, has flowed as if from the sovereign himself, inasmuch as the Lords Directors, by virtue of their delegation, exercise jurisdiction herein, and on that account have also frequently exercised the rights of the sovereign himself in granting reliefs as well as otherwise, as has appeared among other cases from the passage concerning the disapproved pardon granted to Jochim Paulusz in the year 1731 or 1732, the readmission in case of appeal of Mattheus Castella and N: N: Wijnbergen on Ceylon, and on many other occasions; so that this annulment of the proceedings does not permit entering into controversy here on this matter at all, except only insofar as the execution of the nullity must still take place here before the ordinary judge; 6. Not to mention above all this that Mr. Valckenier and his party have already beforehand submitted themselves to the decision and consequently must also acquiesce therein: Valckenier on the one hand when, on the occasion of the well-known so-called political recollections before Your Honorable Worships himself, he declared that he was not disposed to treat the matter otherwise than politically, and on the other hand when in a hundred places in the writings sent to the Netherlands he requests the decision of the High and Noble Lords Principals thereon; his party when, in that so-called antidotal petition, they allege as one of the principal arguments against the attachment on his goods requested at that time that the matter upon which the action for compensation is grounded must still first be decided, in these words: "And if one now considers what debt in this case is the basis and foundation of the loose edifice of the Noble Lords Petitioners in their said capacity, one will have to admit that for the present one is and will remain here in great uncertainty concerning this pretension, as long as the deportation (which is alleged to have been the cause of suffered damages, etc.) has not yet been ventilated before the Noble, High, and Honorable Lords Seventeen, to whose judicature this delicate point has been left, or has been decided by Their Noble and High Worships." 7. Since Their Noble and High Worships have now not only decided this point, declared the matter as it occurred to be null, void, and of no value, and completely annulled it with all the consequences and appurtenances thereof as if it had never occurred, but have also already completely effected, as far as was in their power, the resulting restitutio in integrum itself, and, insofar as it was not within their department, have ordered the Fiscal of India to care for their interests here while the undersigned and his co-interested parties were absent; therefore one continues to look forward to Your Honorable Worships as the judge of the place for the remainder, not in order to still unravel before Your Honorable Worships whether and to what extent that remaining part of the complete restoration of the undersigned ought still to take place, since the same is a consequence of all the rest, and naturally follows from the nature of the matter and what has already preceded in the Netherlands; 8. But because that which now still remains, namely the compensation for the suffered damages, consists in human estimation, wherein the undersigned might be excessive in his claiming, and his opposing party unreasonable in not properly satisfying him in that regard, consequently this is a point of controversy in which the decision of the judge is required; 9. of the past year, and the 20th of this month, executed before Notaries Willem Boon in Rotterdam and Johan van Visvliet, together with witnesses, here in this city, being exhibited herewith under numbers 1, 2, and 3: that the petitioners' highly mentioned principal was on 6 December 1740, with and alongside His Honour the Highly Noble and Respected Lord Gustaaf Willem Baron van Imhoff, at that time also ordinary councilor, and presently ruling Governor-General of the Indies, and the Right Honourable Lord Elias de Haze, likewise at that time ordinary councilor of the Indies, president of the college of aldermen of this city, and colonel of the Batavia militia, by violent, despotic, and tyrannical orders of the former Governor-General Adriaan Valkenier, without the slightest reason, placed under arrest in a completely unlawful and violent manner, shortly thereafter in an ignominious and precipitate manner at risk of life taken aboard the ship Watervliet, and subsequently dispatched to the Fatherland, whereby, as can very well be understood, he was not only harmed in his Honour's person in the highest degree, but was also damaged in his prosperity and temporary property to such an extent that, both on account of loss and suffered damage as well as otherwise, he has to claim a considerable sum of money from the above-mentioned Lord Valkenier, for which reason the petitioners' well-mentioned principal in said capacity has therefore not only urgently requested the highly esteemed Noble Lord of Berendregt, the aforementioned Lord Mr. Nicolaas Iongsma, and the first petitioner, to maintain His Honour's right here against and upon the person and property of the repeatedly mentioned Lord Valkenier, but moreover by the aforementioned deed specially authorized them to institute and prosecute His Honour's action and claim on that account before this respected council, with such comprehensive mandate, power, and authority as can by law be granted and required. Yet, since it is unknown to the petitioners in their capacity how they should presently regard the person of the former Governor-General Valkenier, and whether he himself or someone else on his behalf shall have to be their opposing party in this matter, they are hereby compelled to address Your Honours with a humble request that it may please Your Honours to indicate to the petitioners who shall be their opposing party in this matter, and subsequently to set a date for the same to receive and hear the claim in the case of account from the petitioners in their capacity for compensation of costs, damages, interests, etc., to debate the same claim, if they find it advisable, with the petitioners, and subsequently to bring that lawsuit to a conclusion so that Your Honours may pronounce judgment thereon. And finally, that it may likewise please Your Honours, in any event, provisionally to grant an attachment upon all property, movable and immovable, actions and credits, of whatever name and wherever situated, belonging to the mentioned former Governor-General Valkenier on behalf of the petitioners in their capacity, in order to find therefrom in due time toward the end of that lawsuit the compensation for the very important damages of their principal, with letters rogatory to the Noble Court of Holland, Zeeland, and West Friesland, in order to be able to execute the aforementioned attachment within the jurisdiction of the mentioned courts, also in the Netherlands. 1987 Saturday the 29th of June 1743. Present the Honorable Lord President, also the Lord Councilors and assumed members in this matter. The acting advocate fiscal, Mr. Nicolaas Jongsma, having today submitted to this council a certain extract from the general resolutions of Batavia Castle, taken in the Council of India on the 5th of February 1740, accompanied by a copy of a report previously submitted by the former commissioner of native affairs, Ferdinandus de Roij, to the former Governor- General Adriaan Valckenier, also an extract of the general resolution of the 5th of April 1740, requesting that a record thereof be kept. Thus, after examination of the said papers, it was judged by this council that regarding the above, this record should be kept as evidence in due course, because the same are now, and that after the delivery of the written declaration of the said acting advocate fiscal, brought before the eyes of this council, notwithstanding that by minute of the 27th of December 1742, his honor had already been ordered to withdraw them. Finally, upon a report from the merchant and commissioner for and over native affairs, Ferdinandus de Roij, submitted to the Lord Governor- General, but sent inside by his Honor for decision, having learned that by the servants of the said commissioner in the rivers of Bacassij, Packies, and Bougin, without passes and permission notes, there were overtaken and seized eleven Chinese and 6 native vagrants, recorded on a nominal list, it was, after consideration of what is necessary, approved to have them transferred to the Company's craftsmen's quarters, in order to, conformable to the edict issued in Anno 1730 against such vagrants, being shackled in chains, be sent with the upcoming return ships of the first shipment for one year to the Cape of Good Hope, and until their departure to let them work here that long on the Company's public works, with the exception of one Javanese named Wangsa Derpa, alias Mocko, who was also found among them, but in the past year broke out of the chains to which he was condemned by sentence for 20 years by the Council of Justice at Samarang; it being understood that he is to be handed over to the Advocate Fiscal of India, Mr. Cornelis Philips, and likewise a Chinese named in that report, Oeij Taijko, for attacking the guard with which those vagrants were being transferred to the kampongs for security, is to be handed over to the Landdrost Justinus Vinck, in order to institute their action against those vagabonds. Subsequently, by the Chinese Ti Heenko, Lim Kin- ko, Nio Tongko, Lim Hoijko, and Limtingko, as surviving kin of the fellow Chinese Nio Laijko, Nio Boenko, Te Diakdong, Kie- ko, Lauw Kongko, Nio Sietko, Qua Pinko, Lim Khangko, Lim Longko, Lim Tjangko, and So Hoetko alias Poehoedieuw, having shown by petition and five notary attestations submitted alongside it, that their aforesaid kin, who by the servants of the commissioner for and over native affairs were seized in the uplands as vagrants, and already according to what was resolved on the 5th of February last, according to the order, shackled in chains to be sent for one year to the Cape, are not vagrants, but that they all worked on their lands for a living, and out of ignorance did not obtain a permission note from the aforesaid commissioner, according to custom, and therefore at the conclusion thereof requesting that they be relieved of their banishment, as well as released from the chains and permitted to reside here as before, it is, after consideration of what is necessary, and for the reasons appearing from the produced notarial attestations that those people truly worked on the lands mentioned therein, and thus cannot well be considered as vagrants, decided to release the aforesaid Chinese for this time from their shipment, as well as to release them from the chains, and grant them residence here, provided they furnish themselves with such a note as is granted by the First Secretary of this government by order of the same. 1990 To his Excellency The High Noble, Most Honourable Lord Adriaen Valckenier, Governor- General of the Dutch East Indies High Noble, Stern, Most Honourable Lord, Your Excellency having been pleased to order the undersigned Commissioner for the Affairs of the Native to dispatch some armed vessels to the rivers of Baccassij, Packies, and Boengin, and further eastward, for the detection and apprehension of Chinese and other nationalities who reside and wander about there without passes or permission slips, the undersigned has the honour hereby to bring to Your Excellency's knowledge in all submission that six vessels, each manned with seven men under the command of the Balinese Lieutenant Abdul Mockmin Babandam, were sent on the 28th of the past month to the above-mentioned rivers for that purpose. Of these vessels, one returned on the third of this month, bringing along a party of Chinese and other diverse nationalities, among whom one was discovered to be a convict who had broken out of his chains, condemned by the Council of Samarang and sent over in order to serve 20 years on the Public Works in the Honourable Company's Craftsmen's Quarter, named Wangsa Derpa, nicknamed Macko of Samarang, according to the name list that the undersigned has the honour to present in all humility for Your Excellency's consideration. Furthermore, the undersigned informs Your Excellency with due respect that, because his blockhouse could not 1991 suffice to lock up all the apprehended persons together, he was forced to distribute them among the captains of the kampongs, whereupon a party of Chinese formed a mob and did not shrink from attacking the guard with curses and threats. The principal of these mutineers, named Ong Taijko, having been seized, is now sitting in the blockhouse of the undersigned, having attempted in such manner to deliver his comrades. Wherefore the undersigned wishes to obtain Your Excellency's respected orders in this matter, how he shall act in this regard, while he remains with deep respect. 943 Mr. Valckenier intends to claim; wherefore the well-mentioned Noble Mr. De Haze has requested the petitioners in their capacity and by the aforementioned deed specially qualified them to institute and prosecute his Honour's action and claim on that account against and upon the person and property of the above-mentioned Mr. Valckenier before this Honorable Council, with such comprehensive mandate, power, and authority as may be legally granted and required. And since it is unknown to them, the petitioners, in what manner they must presently regard the person of the former Governor-General Valckenier, and whether he himself or perhaps another on his behalf shall have to be their opposing party in this matter, they are compelled to address Your Honours hereby with the humble request that it may please Your Honours to indicate to the petitioners who shall have to be their opposing party in this matter, and subsequently to appoint a day for the same to receive and hear from the petitioners in their capacity a statement of claim in the matter of an accounting for the compensation of costs, damages, and interests, etc., to debate the said claim with the petitioners in their capacity should they deem it advisable, and subsequently to bring that suit to a conclusion so that Your Honours may pronounce judgment thereon; and finally that it may likewise please Your Honours, in any event, provisionally to grant an attachment upon all property, movable and immovable, actions, and credits, of whatever name and wherever situated, belonging to the said former Governor-General Valckenier, for the benefit of the petitioners in their capacity, in order to obtain therefrom in due course, at the conclusion of that suit, compensation for the very substantial damages of their principal, with letters requisitorial to the Noble Courts of Holland, Zeeland, and West Friesland, so as to be able to execute the aforesaid attachment under the jurisdiction of the said Courts in the Netherlands as well. Upon request made today to this Council by the provisional Advocate Fiscal of India, Mr. Nicolaas Jongsma, that two members might be nominated as commissioners in order to have re-examined under oath all such documents as his Honor had already obtained some months ago against the former Governor-General Adriaan Valckenier, as well as against the civilly detained Mr. Willem Vincent Helvetius and Mr. Cornelis Phillips; so it was, after consideration of what was necessary, understood by this Council that the matter is as yet not disposed thereto, but nevertheless approved once again to recommend the provisional Advocate Fiscal to proceed as speedily as possible with the case against the said detainees and persons in civil detention. 1999 To the Noble Lord Mr Jacob Lakeman Extraordinary Councillor of Dutch India and President Together with The other noble members of the Honourable Council of Justice of this Castle Noble Lord and Honourable Lords: The Advocate Fiscal pro interim of India Mr Nicolaas Jongsma, having been ordered by Your Honours and Worships' order of 29 June, which he only received on the 3rd of this month, to set out in writing the reasons why he considered and had already declared, both in writing and orally, that he had no cause of action, nor could institute one, against Ferdinandus de Roij, who was detained ex officio by Your Honours and Worships, finds himself compelled, while adhering to his respectful protests against it, to state beforehand that this order appears to him very inconvenient and no less difficult, not so much because of the duties he has ratione officii and which are currently appearing very manifold and pressing, as because on the one hand a negative a negative is not really capable of proof, and it has therefore also become a constant rule in law that no proof is incumbent on him who denies, Digest 22.3 on proofs, while on the other hand it will be impossible to comply with the order of Your Honours and Worships without the undersigned reproaching the inquests (which were actually begun and convened at his requisition and generally per modum inquisitionis legitimum, though not to the charge of the detainee), and effectively defending the innocence of the detainee. Yet since the latter will after all not accord ill with what was said in Voet ad titulum Pandectarum on accusations, number 20, at the end, namely that it is of the utmost importance to the state that the innocent do not perish, or that the conscience of the judges be not deceived through ignorance and suppression of facts into deciding anything contrary to what the nature of their office requires; see also Ordinance on the Style of Criminal Practice, article 24; J. van Leeuwen, Censura Forensis, part 1, book 2, chapter 12, number 2, where it is also taught that the prosecutor must not conceal what serves to relieve the defendant; and since it has moreover pleased Your Honours and Worships to order as aforesaid against the undersigned's most respectful protest, the Fiscal, in order to show that he willingly and reasonably wishes to be obedient as the lesser party, even though it were somewhat hard and against his inclinations, will first of all: This means as much as that it is properly the duty of the one who asserts, and not of the one who denies, to prove that there is, for example, a cause of action. Namely, that the common welfare is most highly concerned that the innocent do not perish, and that the consciences of the judges are not misled through ignorance or concealment into committing something that is contrary to their office. And that is so true, says the great criminalist Carpzovius, qu. 114, no. 62, that a witness who deposes without sufficient reason for his statement is deemed to depose not as a man, but as a beast, as is applicable to almost all those interrogated, and in particular to the Chinese Lim Sionko, Tan Iko, Sou Soeseeng, and others, as furthermore appears from the underlined words in all the accompanying inquests. While deliberating upon the Bengal Directorate, upon requesting some papers that were to serve for that purpose, it was not only noticed that various Company papers were not to be found at the Secretariat here, but also that, according to the incoming reports, several of them had been taken by the former Governor-General Adriaan Valckenier and had gone missing upon his departure for the Netherlands; thus it was approved to recommend the Council of Justice of this Castle to appoint special commissioners at once so that, together with and alongside the special commissioners of this Government, they may demand from the said Lord Valckenier and investigate among his papers those that belong to the Company, in order to have them restored again to the aforementioned office, and at the same time not only to have the inventories of his goods as they were sent over from the Cape, but also all other papers related to his case, delivered to the said Council of Justice, for reasons as stated in the Resolution. Shows with due respect: Mr. Nicolaas Jongsma, Advocate Fiscal of India pro interim, that on the 3rd of October 1742 he found himself necessitated by petition to this Honorable and Worshipful assembly, with exhibition of certain interrogatories answered by the merchant Henrijs Abbis and associates dated the first of the same month, respectfully to make known that it appeared as clear as day therefrom that the currently merely hostage Mr. Willem Vincent Helvetius had made himself guilty of an inhuman massacre of a large quantity of both healthy and sick and disabled Chinese, who, under favorable permission and safeguard of the high authorities of these lands, had their residence in the hospital of that nation; that therefore the undersigned, having taken into consideration that in case the aforesaid answers should come to the ears of the said Helvetius, he might easily, out of consciousness of guilt, resolve thereby to save himself in one way or another by flight, and thus escape the well-deserved and inevitable penalty of death, had resolved to request Your Honorable Worships as speedily as possible bodily apprehension, or at least, in case of unexpected refusal thereof, absolute hostage-holding; but that this Council, disposing upon the aforesaid request, had been pleased provisionally only to grant hostage-holding at the house of the delinquent, under the supervision of a bailiff and a clerk, and this until further disposition and without access of strangers, but by no means of friends and so-called nephews and nieces; which, communicated at that time to the undersigned, appeared very surprising, and it being considered by him that, notwithstanding the request of incarceration, even of ordinary detention in the Company's irons, was refused, the crime was nevertheless of such a nature and so capital that an inventory and sequestration of the goods ought necessarily to take place; on that ground, on the aforesaid day, he urged it in writing, but obtained nothing other or further than an interdiction to the hostage from alienating any of his goods or papers under such penalty as this Council should deem appropriate. That furthermore the hostage, having been examined on articles at the requisition of the undersigned on the 7th of January of this year, and having duly confirmed the same, he, the Fiscal, on the 19th thereafter, and that for the second time, had found himself necessitated to make known to Your Honorable Worships, among other things and again in writing, that the hostage had sought to disguise the aforesaid atrocious and heaven-defying massacre, with regard both to the matter and to his person, under the pretext that he had only, upon the request, or rather challenge or reproach, of others (who were already dead or fugitive), as if he, the hostage, would otherwise appear to be afraid, found himself present there, and had merely behaved as an innocent spectator; but that this, in the opinion of him, the Fiscal, was entirely improbable and in fact untrue: improbable because it was not to be believed that Hackenberg or Mennick, who supposedly had made these taunts and challenges, would have had the boldness to dare

would dare take it upon themselves to use such expressions against the detainee, he being a person of so much higher rank than they, a brother-in-law, a confidant and minion of the ruling governor-general, nay what is more, a man who, according to the testimony of the said governor-general in the presence of the commissioners van den Bosch and van Reverhorst during the answering of his articles by way of discourse concerning the arrest of the three Noble Lords Councillors and other matters, was extolled so highly that he fully declared that if he had not had his brother-in-law, the aforementioned Helvetius, he would not have gotten through it or carried everything out, not to say that the detainee was quite bold enough and of such a nature that he would far sooner have dismissed these rogues, or as later appeared, these two dishonorable scoundrels, with a very prompt and impertinent, or indeed pertinent, answer than have consented to such an unnatural expedition; that over and above all this, the detainee himself confessed that he had been present when the governor-general gave the order, so to speak, to clear the aforementioned hospital; that he, in the company of the aforementioned Hackenberg and the shahbandar Hoesak, who openly admitted his fear, went into the back quarters of the castle and came to those who, according to the claims of the detainee, were to execute this bloodthirsty commission; it was also, in the opinion of the undersigned, untrue that he, the detainee, as he claims, contributed nothing to that massacre, since the contrary was proven and shown clearer than the midday sun from the repeatedly mentioned interrogations of Abbis and company, not only that he (as his own confession to article 26 also entails) stood by with a drawn cutlass, being a true murderous weapon, but also that he himself stabbed and wounded Chinese; that, moreover, his, the detainee's, answers were untrue and fabricated with respect to many circumstances, among others where he comes to pretend that the late inside regent Liefhoud allegedly showed not the slightest difficulty or concern for his people on account of the orders given, but rather on the proposition and consideration made to him by Munnix, but that Liefhoud, thinking better of it while smoking a pipe of tobacco, raised difficulties, subsequently made the Chinese come forth through his own people, and thus delivered them to the slaughterhouse; whereas to the contrary it appeared from the aforementioned interrogations that one could not see which of this bloodthirsty triumvirate, the detainee, Hackenberg, or Munnix, held the primary command; that Liefhoud, upon their arrival, became very dismayed at first sight and subsequently remained so; nay, that he was ordered by the gentlemen to make the Chinese come forth, and that he, Liefhoud (whose hair had undoubtedly stood on end, and whose heart had been stricken with compassion for his inmates as well as with horror at the approaching cruelty), had said while lamenting: if you want to murder the people then have them brought outside the house, because I cannot watch it, and then the people can see how it is done; the petitioner further indicating in the aforementioned request that the frequently mentioned interrogations of Abbis and company, without any other corroborating evidence, much less a confession from the detainee, had appeared so powerful and valid to Your Honors and Worships that they were pleased to decree the aforementioned detention in his own dwelling based on them (by no means, as the undersigned maintained and still maintains, out of consideration for the crime, but possibly out of consideration for the rank and character that the detainee held so unworthily), and would undoubtedly, above all other considerations, have granted a bodily arrest if the further crimes at that time, namely on 3 October 1742, had been as clearly proven and even confessed as have now come to light, both through the papers sent back from the Fatherland of the former governor-general Valckenier and the detainee's repeated confession, containing among other things: that he had not only been conscious of, and a veritable accomplice to, the most damnable villainy and highest abuse of power, which was carried out on 6 December 1740 by the currently detained governor-general Adriaan Valckenier to the irreparable injury and detriment of the illustrious assembly of the High Nobilities, of the most precious person

2011 person of the chosen Lord Governor-General Gustaaff Willem Baron van Imhoff, and his High Honour's companions in fate, indeed even to the near total ruin of this precious colony, always considered and also in fact being the most precious jewel in the crown of the United Netherlands State; and which aforementioned villainy, as could be gathered from the coherence of the responses and the aforementioned confessed and known incapacity and even cowardice of the said Valckenier, would never have been carried out without the aid and the very malicious, but by no means incapable and therefore so much more dangerous nature of the pernicious, detained hostage, and of the honour, oaths, and God-forsaken Major Hendrik Duurveld, who through a death untimely for Justice had escaped the righteous punishment of the secular judge; to say nothing of the so-called manifesto or despotic and seditious writing, which was drafted by the hostage (NB according to his own confession) with full knowledge of to what end, and which the said former Governor-General, in the assembly of Their High Honours on that fatal and terrible 6 December, under the clash of arms, had caused to be read aloud as a prelude to the premeditated and damnable arrest. That also from Article 57 et seqq. of the hostage's answered articles, Your Honours and Worships could be reminded of: 1. The drafting by the hostage of a multitude of points serving for queries and insinuations to the notified municipality; in a word, of the entire handling and execution of everything that could give any semblance of legality to the most unlawful action in the world. 2. The most abominable and punishable deed of the hostage, perpetrated through the drafting of a certain secret letter in two volumes to the High Honourable, Grandly Respected Gentlemen XVII, abridged, and that, as the hostage claims, at the request of his Governor-General and brother-in-law; just as if the request to be an accomplice to a crime, voluntarily accepted and carried out, could bring any excuse, or diminish the punishment in favour of the drafter of this letter, which is filled with palpable lies, most atrocious injuries, scandalous slanders, calumnious and God-forsaken expressions and insinuations; and that principally to the detriment and dishonour (were it possible) of a person who, as the entire world knows, had merited entirely the contrary, to such an extent that it appeared incomprehensible to the undersigned how all of it could have arisen in the brains of a wicked person who was not entirely ruled by Satan; and who considered that, in the event it were not necessary to preserve the aforementioned letter for some time yet as evidence and corpus delicti, the same ought, at the very first opportunity, to be burned with fire by the executioner upon a scaffold, to demonstrate and portray what its drafter and signatory had to expect in due time. For all of which then, and more other reasons to be found in the aforementioned request, the undersigned at that time, or on 19 January last, declared that he found himself obligated by his oath, honour, and office, in order to prevent the evasion of a well-deserved punishment, to request de novo from Your Honours and Worships imprisonment together with arrest, inventorying, and sequestration of the property. However, since the same was at that time denied for the second time for the present, notwithstanding the written remonstrance and the further request of the undersigned dated 25 March of this year, containing that he namely could not have comprehended the reasons for it, unless Your Honours and Worships might have been moved thereto because they had not had sufficient reading of the aforementioned missive, or because the often-mentioned former Governor-General had not yet been heard and had not confessed to the partnership and the hostage's complicity therein or in the arrest undertaken and executed on 6 December, etc. etc.; yet, since even those two reasons also ceased to apply, and this hostage could and had to be considered tanquam de criminibus capitalibus convictus or confessus, the undersigned had found himself compelled for the 3rd time to insist upon it. However, since Your Honours and Worships have yet again or for the third time denied the undersigned's request, or actually persisted with their disposition of 19 January, he will readily confess in this regard to be almost at his wit's end and unable to understand the reasons why all of this has happened. Surely, in his opinion, it cannot be in regard to the crime, as its punishment is beyond doubt corporal and capital (consequently imprisonment being necessary), and if not capital and corporal, the perpetual and continuing hostage detention is utterly absurd.

2012 women, doctors, nobles, or other persons from imprisonment would be absurd and unjust. Nor can the status that the hostage previously held bring about any reduction of punishment whatsoever, or alter the nature of the offense. They are much more worthy of punishment, says Emperor Theodosius, Book 8, Code on Bishops and Clergy, to whom very much honor was conferred by our command; with which the great criminalist Carpz: pr: Crim qu. 2. No. 13 agrees, where he says: I pass over the fact that those placed in high rank, according to the opinion of some, are to be punished more severely than others, and one is to be judged so much the more severely the greater the rank in which he was prominent, and by his example others might more easily be provoked to similar deeds. If one wishes to say that the hostage, although the crimes are capital and he has even confessed to the weightiest among them, ought nevertheless, in respect of his status, to remain exempt from the infamy of prison, one will be able to be convinced of the contrary by thousands of cases, both here and elsewhere, and even recall that persons whose status is not even to be compared with that of the hostage have been placed in prison here and everywhere, examined from there upon articles, brought into court, and condemned. And if one were still not satisfied with examples, one could be convinced by what is so applicably stated by the same Carpzov, question 111, No. 39 and following, and established as a rule of law, that all defendants indiscriminately, on account of a committed offense, must be handed over to custody, that is, to prison; and in numbers 40, 41, and 42: I know indeed that commonly honorable women, clergy, doctors, nobles, and other illustrious persons are excepted, who are commonly said to be exempt from imprisonment, provided the committed crime is not most enormous, but in truth, usage and custom have clearly established the contrary, and any persons indiscriminately can be imprisoned; and certainly because the principal purpose of imprisonment is this, lest the defendant flee and crimes remain unpunished; I do not see by what reason they can be exempt, unless someone were to say that regarding the punishment of crime, respect must be had for these persons, which nevertheless would tend against the safety of the state, which commands that punishment be inflicted upon criminals, Law 51.2, Digest on the Aquilian Law. Now to conclude with: Those, says Emperor Theodosius, who hold the highest offices of honor must be punished the most severely. For the reason that others are easily incited to follow the example of distinguished people, and that for this reason these latter must be punished so much the more severely. That all persons without distinction, if the crime warrants it, must be placed in prison; it is true that, in case the crime is not weighty, distinguished women, clergy, scholars, nobles, and other notable persons are commonly excepted from this, but that contradicts customs and practices, and truly, because the principal purpose of prison serves no other end than that the accused should not flee or the crime go unpunished, I do not see why the aforementioned persons should be exempt from it; unless someone, note well, would wish to maintain that one should use distinction of persons in the punishing of crimes, which nevertheless would be highly contrary to the welfare of the country, which requires that scoundrels be punished.

not to mention that those few Doctors of Law who make an improper distinction between the incarceration of distinguished and common persons only concede such in the case of crimina leviora, which is entirely inapplicable to this matter; whereas the prosecuting officer, the petitioner, has contributed his utmost to urge for incarceration in proportion to the crimes committed and the confessions made, and Your Honours and Worships, notwithstanding this, have not been able to come to that decision, he, who is very willing and, where possible, inclined to obey Your Honours' respected dispositions, has provisionally let the matter rest there and sought to take another path for the expediting of the proceedings, not only against this hostage, but also against the detained former Governor-General and the fellow hostage Mr. Cornelis Phillips, respectfully requesting to that end on the 3rd of this month of July the nomination of two commissioners (since none were at hand or commissioned) in whose presence could be re-examined and brought in forma probanti all such documents as the undersigned had already obtained some time ago against the three aforementioned persons, and this especially and among other things because the undersigned at the aforementioned time was not in a position to take an inquest with that freedom and authority that befits an officer, as has appeared not only from the resolution of Their High Excellencies dated - - - - concerning a false accusation of rigorousness and cupidity against the undersigned, but most particularly also from the fact that certain suspect council members managed, on the 2nd of November 1742, by sub- and obreptitious means to obtain from Their aforementioned High Excellencies that the undersigned may not or cannot in any ordinary cases draw up preliminary informations without prior knowledge of the judge, which is contrary to the privileges of all his predecessors and therefore, together with and besides other unpleasantries, has served to bring about such a great decline in his office and has vexed him to such a degree that he wishes with all his heart that he had never, ever accepted this hateful office, or else may be liberated from it as soon as possible, so that his weak memory and frail physical constitution may not become entirely incapacitated or ruined.
