1825 to give an opening, by chance without bringing any proof, to a notorious and convincing proof that people intended to proceed without the least formality otherwise customary in law, we shall not need to give your Right Honorable Worships any idea of the contempt into which the first College of Justice here has now been brought, to such an extent that we have been in an internal conflict whether we should not be compelled to resign our offices, as being too delicate to see ourselves described with such bloody expressions, and to have to declare that we were thereby rendered incapable of discharging our entrusted post to the peace of the public and to our own satisfaction; yet trusting that your Right Honorable Worships will now adopt an entirely different view and grant us the justification that we proceeded according to the constitution of affairs and the circumstances of the times, as well as having executed the resolution of the Honorable High Government according to the true intention of the words taken in their context, we have made no difficulty in persevering in the administration of Justice and in continuing to perform our duties, being reassured within ourselves that we proceeded with the requisite circumspection regarding those conducted proceedings. As for our domestic affairs and the condition of the College, we find ourselves obliged in that regard to bring to the knowledge of your Right Honorable Worships how our Extraordinary Member Mr. Philippus Rochus Kien came to pass away on the 30th of March, and that subsequently our fellow Members Mr. Bernard Iacob Dellafaille, Mr. Pieter Willem Lammens, and Mr. Theodorus Polijcarpus Woijt, after having given prior communication to us, addressed themselves to Their High Excellencies and there requested their release 1926 to the Netherlands, but that they had not obtained this, their requests having instead been referred to your Right Honorable Worships in order to await a disposition thereon, which they then also hope to obtain to their satisfaction at the earliest opportunity. Furthermore, our President first gave us verbal notice, and it subsequently also appeared from Their High Excellencies' resolution, that Mr. Iacob Van Den Bosch, upon his strong urgings after eighteen years of service, was discharged from the Council of Justice and, with retention of quality and salary, was appointed Commander of Bantam. Thus we hope that it will please your Right Honorable Worships, although Senior Merchant Mr. Gerard Van Brandwijk Van Blokland, who recently arrived here from Amboina, has been added to us by Their High Excellencies as an assumed Member, to reinforce in due time through your Right Honorable Worships' wise foresight with capable subjects this College, which, besides the imprisoned Mr. Willem Vincent Helvetius, is deprived of two permanent Members. Just as it is also further brought to the communication of your Right Honorable Worships how the pro interim advocate fiscal Mr. Nicolaas Iongsma declared to us on the 29th following, and upon the question put by the President whether he still persisted in what had been declared in the Extraordinary meeting, namely concerning his discharge from his office, declared that he wished the Council would be pleased to look out for another fiscal, since, as he came to allege, on account of his weakness he no longer found himself capable of it due to the continuous and persistent difficulties; we shall, subject to favorable interpretation, not enter into who might be the cause of this, but only communicate to your Right Honorable Worships that, in order to prevent 1927 further difficulties, which have more than once been cleared out of the way by the President, we found ourselves obliged to concur with the resolution of the Extraordinary meeting taken previously on the 10th, to the end of addressing Their High Excellencies and respectfully requesting the same to provide the Council with another pro interim advocate fiscal; as indeed the said pro interim advocate fiscal was also discharged from that office by Their High Excellencies by resolution of the 17th following, with retention of his rank but with cessation of salary, and the ordinary affairs were provisionally assigned to the water fiscal Mr. Johan Hendrik Van Panhuijs, who presently performs both those offices. 1928 Specification of the criminal cases concerning the interest of the Honorable Company that have been settled, are pending judgment, and are still under litigation since the 7th of November 1742. Julij of Boegis, slave of the Honorable Company, prisoner of the lord, was on the 9th of January of this year, for clipping a piece of linen, according to the sentence of this court, severely flogged behind the city hall here with rods on the bare buttocks, and for the period of two consecutive years chained in irons ad opus publicum in the Honorable Company's artisanal quarter here, and furthermore condemned to pay the costs and expenses of justice. Mochamat Slimin, Buginese soldier in the service of the Honorable Company, last stationed at the field redoubt Tanjongpoura, prisoner of the lord, was, for inflicting a wound upon the gunner Adriaen Roelofsz: of Stokholm, according to the sentence of this court dated the 17th of January aforesaid, banished for his entire life to such place as the Noble High Government of these lands shall see fit, with condemnation in the costs and expenses of justice. Hendrik Keijsenaar of 's Gravenhage, sailor on the brigantine De Onagtsaemheijd, prisoner of the lord, was on the 23rd of January aforesaid, on suspicion of having committed manslaughter upon the Mardijker Barend, according to the sentence of this court, banished for the period of five consecutive years from all cities, forts, and places falling under the jurisdiction of the Honorable Company, without permission to return therein during the aforesaid time on pain of heavier punishment, and furthermore condemned to pay the costs and expenses of justice. Jan de Roode, former senior merchant in the service of the Honorable Company and vendue master of this city, Petrus Albertus van der Parra, junior merchant, and Adriaan van Ravesteijn, bookkeeper in the aforesaid service, acting by power of attorney and authorization from the Jewish merchant and inhabitant of Cochin de Sima Samson Rotenburg, native of Frankfort on the Main, according to the power of attorney executed on the 4th of March 1738 before the sworn clerk Gerrit van Dorpen and witnesses at Cochin, and in that capacity defendants in an appeal case with the clause of relief against the improper lodging and prosecution of this appeal. In this case, the junior merchant and former fiscal of Mallabaer, Corijn Stevens, acting officially, brought against the original defendant Samson Rotenburg, concerning the chartering of the Company's vessel Proostwijk with contraband goods when the same departed as a passenger with the aforesaid vessel and thus arrived again at Cochin, a written criminal claim on the 8th of January 1737 there, concluding at the end thereof that by definitive sentence it should be declared that he had incurred such penalties as the ordinances and statutes of the High Indian Government dictate, and that pursuant thereto the seized and sequestered in the Company's warehouse 19129 sequestered 5000 imperial thalers should be declared confiscated, one half for the Honorable Company and the other half for the fiscal treasury, along with, in addition, a fine at the discretion of the judge, to be divided one half for the leper house outside the city of Cochin and the other half for the fiscal treasury as above, etc., or for such other purposes as the Council of Justice there might judge and deem appropriate for the maintenance of the Company's trade. Subsequently, on the 27th of August 1737, according to the sentence of the Council of Justice at Cochin, the claim and conclusion of the aforementioned Corijn Stevens made and taken upon and against the original defendant were denied, as not being supported and substantiated with sufficient, clearly apparent, and convincing evidence; and it was therefore ordered that the sequestered chests containing cash to the amount of a sum of 5000 silver imperial thalers should be returned and delivered to the defendant as his own lawful money, and furthermore that the defendant should be free to institute his action and claim against his wrongful accuser, the merchant and Mocha resident Willem van den Bergh, if he sees fit, furthermore condemning the said Willem van den Bergh to all the costs and expenses of justice incurred and arisen during this trial. Against which judgment the said fiscal Corijn Steevens having made himself appellant to this council, the advocate fiscal of India, substituting in his official capacity for the aforementioned Malabar fiscal Corijn Steevens, officially summoned the defendant on the 30th of July 1738 in

in his ascribed capacity, concluded before the roll of this Council, firstly, to the confirmation of the obtained appeal with the clause of relief against the lapsing of the prosecution of this appeal; furthermore, serving as a written claim in case of appeal, it was concluded at the end of the same to the nullity and correction of the judgment in question, and that this Council, doing what the judges of the first instance ought to have done, might still be pleased to adjudicate the claim and conclusion made and taken in the first instance upon and against the original defendant, with the costs of both instances; whereupon, by the procurator Hartman, for and on behalf of the defendants in their said capacity, after he had consented to the requested confirmation, a copy of everything was requested and a period of four weeks to act as shall be advised, which was also granted to the said Hartman; but by a disposition of 5 November 1738, the aforementioned van der Parra was discharged from this case at his own request; and the case having been brought to the roll on 3 December thereafter in order to purge the default of an answer and still to respond, a continuation of one month regarding this term was then requested by the procurator van Vliet, on behalf of the further defendants in their said capacity, on account of the volume of the papers, which was also granted to him after the advocate fiscal had consented thereto; which proceedings having then subsequently advanced to the term of reply, a stay of the same was requested by the then advocate fiscal Mr. Adrianus Bergsma and granted to him on 21 January 1739, until such time as the required papers from Malabar should have been sent hither, which until that time having had no effect, the advocate fiscal Mr. Cornelis Phillips on 2 December 1739 requested by petition a continuation of the above-mentioned granted stay, or indeed, so far as might be necessary, a new stay of these proceedings until such time as the commissioners who departed for Mocha, Corijn Steevens and Ian Marcus, who had been appointed by the Noble High Government of these lands to inquire into the unaccountable conduct of the Mocha residents, and especially regarding the considerable scheming and messing of the original defendant and required party in this case, the under-merchant Samson Rotenburg, should have returned; which continuation was opposed by the procurator van Vliet on behalf of the defendants and required parties in their said capacity; that incident subsequently having been duly contested by the parties, this Council, before ruling in this matter, ordered the advocate fiscal to submit such extract of the missive from the fatherland dated 10 September of the past year of which mention was made in his submitted petition; which interlocutory order having been satisfied on 9 December following, and the aforesaid extract having been submitted, the requested continuation of the stay of these proceedings obtained from this Council on 21 January 1739 was further granted, until such time and as long as the aforesaid Mocha commissioners Corijn Steeven and Ian Marcus should have returned to this place and completed their commissions; after whose return, the granted and continued stay having also been lifted on 13 June 1742 at the request of the gentleman in his said official capacity as plaintiff and petitioner, this case was further fully written, and thus finally brought to a state for judgment; when, on the 30th of the last passed month of January, according to the sentence of this Council, the judgment in question was altered, and having been ruled upon anew here on appeal, the claim and conclusion made and taken against the original defendant at Cochin was denied, and it was accordingly ordered that the sequestered chest and the cash found therein to the amount of a sum of five thousand silver keijser daalders should be returned and handed over again to the original defendant; furthermore, leaving the original defendant free to institute his action and claim against the merchant and Mocha resident Willem van den Berg, in such manner as shall be advised; further, the costs of the lawsuit incurred both in the first and in this instance were compensated, for reasons moving the Council thereto. Arij Helmke of Bremen, sailor on Diemermeer, prisoner of the lord, according to the sentence of this Council dated 13 February last, for being absent for two months, and moreover having let his ship sail away to the fatherland, was severely whipped behind the town hall here, and ironed in chains for the period of six months to public works, furthermore condemned to the fine of one month's wages for the benefit of the treasury, with costs. Jan Hendrik Eck of Riga, blacksmith on Ouruss, prisoner of the lord, for being absent for one month, on the 27th of the above-mentioned month of February, according to the sentence of this Council, was likewise ironed in chains as above for the period of six months, and in addition condemned to the fine of one month's wages for the benefit of the treasury, with costs. Nicolao George of macedonien, free merchant and passenger of the Manila ship the S:e anna, and his servant Augustijn of malacca, free person, the lord's detainees, were on the 12:th of June aforementioned, for importing opium, according to the sentence of this Council, the first-mentioned banished for life from all lands, cities, forts, and places belonging under the jurisdiction of the Honourable Company, without ever being permitted to return therein, on pain of heavier punishment; furthermore, the seized four chests of opium confiscated, in order for its net proceeds, after deducting what is to be deducted, to be distributed as customary, and in addition the first detainee condemned in the value of the same opium to be distributed as above, as well as in the costs and expenses of justice, but the latter detainee is released from his detention free of charge. Eldert Eggerts of amsterdam, sailor on the chaloup toppenburg, the lord's prisoner, for being absent for over a month and, moreover, having let his assigned vessel sail away to Lampong, was, according to the sentence of this Council dated the 18:th of June last, condemned to be severely flogged with a rope's end behind the town hall here, and to be shackled in chains for the term of six months in the Honourable Company's artisan quarter for public works, together with condemnation in the costs and expenses of justice and in the fine of one month's wages for the fiscal, cum expensis; but, on account of his indisposition, ordered first to be brought to the Honourable Company's hospital here, in order to be cured there. Iohannes Treijfburger, resident of this place, defendant in this case, against whom the lord pro interim advocate fiscal Mr Nicolaas Iongsma on the 9:th of July last, for having attempted to smuggle in four male slaves named Topenning, Lama, Toaga, and Labe, all of macasser, through the boom of the large river at this place, concluded by libelous demand to the end that, by definitive sentence of this Council, the aforesaid male slaves should be declared confiscated, in order for their proceeds, after deducting what is to be deducted, to be distributed as customary, and the defendant furthermore condemned in the value of the aforementioned bondmen, or else in such penalty or fine for the fiscal as this Council, in proportion to the defendant's offense and to the deterrence of others, should deem appropriate in good justice, cum expensis; and subsequently on the 16:th thereafter, according to the sentence of the aforementioned Council, the litigated male slaves were confiscated, in order for their net proceeds, after deducting what is to be deducted, to be distributed as customary, with dismissal of the further claim, and condemnation in the costs of the lawsuit. Legoor of bliton, Mardijker and convict in chains in the Honourable Company's artisan quarter, the lord's prisoner, was, for breaking his chain, on the 16:th of July aforementioned, according to the sentence of this Council, severely whipped behind the town hall here, and shackled in chains again in order to serve out his previous banishment therein, together with condemnation in the costs. Lim Loenko, Chinese merchant, the Lord's hostage, having engaged in private trade in tin, on the 30th of July last, according to the sentence of this Council, such 3391 lb of Banka tin, or 27 1/25 piculs, as was recovered and seized in the Chinese Campong by a kaffir, is confiscated, the net proceeds of which, deductis deducendis, are to be distributed as customary; furthermore, the hostage is condemned to be placed for the term of eight days in a dark prison on water and rice, with rejection of the further claim, and condemnation in the costs incurred herein. Lim Sekong, Chinese merchant, the Lord's hostage, having engaged in prohibited trade in tin, according to the sentence of this Council of the aforesaid date, such 5115 lb, or 4 29/25 picots of tin, as was recovered and seized in the river outside the Utrecht Gate by certain servants of the provisional Fiscal Advocate, is confiscated, the net proceeds of which, deductis deducendis, are to be distributed as customary; furthermore, the hostage is condemned to be placed for the term of eight days in a dark prison on water and rice, with rejection of the further claim, and condemnation in the costs incurred herein. Ni Hoekong, former Captain of the Chinese here, and his brother Ni Li Enkong, both the Lord's prisoners and defendants in this case; on the 22nd of August 1742, by the provisional Fiscal Advocate Mr Nicolaas Jongsma against the prisoners on the principal matter, a written criminal claim was anew submitted, and at the conclusion thereof it was demanded that the first prisoner, Ni Hoekong, should be taken to the ordinary place of execution and there delivered to the executioner, to be bound upon a cross and broken on the wheel alive from below upwards, furthermore while still living, his body opened, the heart torn out therefrom, and struck against his face, subsequently his head chopped off with an axe, and the torso divided into four quarters, the head to be placed on a stake, and the four quarters hung on four gallows-forks or half-gallows and left as prey for the birds of the air, in such places as this Council should deem fitting, with confiscation of his goods to be distributed as customary; that furthermore the second prisoner should be banished from here forever to such place as the Noble High Government of these lands should understand to be proper, and further both condemned in the costs and expenses of justice; and after the prisoners, upon their request, were admitted to an ordinary trial, and were served by procurators, and fully briefed, on the 6th of August last, according to the sentence of this Council, the first prisoner Ni Hoekong was condemned to be banished from here for the period of twenty-five consecutive years to such place as the Noble High Government of these lands should please to see fit; furthermore, the second prisoner Ni Li Enkong is released from his detention, with rejection of the further or greater claim, and condemnation of both prisoners in the costs of the trial, for reasons moving the Council thereto, however from which sentence the first prisoner Ni Hoekong has entered into revision. Arij Helmke of Bremen, sailor on Santa Jacoba, the Lord's prisoner, having been absent for nine nights, and having moreover let his ship sail away to the fatherland via Ceylon, was on the 27th of August last, according to the sentence of this Council, sent from here to the fatherland as a useless subject, in order to perform ship's service during the voyage for his board, and furthermore condemned in the costs incurred herein. Arnoldus Warnerus van Diepe, chief surgeon in the service of the Honorable Company, known, together with all other unknown and non-appearing claimants to such twenty-two, being a part of forty-nine head of bondservants, as were smuggled in and detained on the 9th and subsequent days of the past month of August, both at and within the boom of the great river outside this city, and also made known by the published and affixed notices, thus being summoned and intimated by edict. In this case, the advocate fiscal pro interim of India, Mr. Nicolaas Iongsma, on the 6th of August last, concluded on the roll of this Court, both against the known and unknown claimants, on the foundation of the placcaat of the 2nd of December 1740, as well as the 2nd article of the Statutes of Batavia, under the title of Shahbandar and License Master, that the bondservants made known upon presentation and the affixed notices should be confiscated, to be distributed according to custom after deducting what is to be deducted, and furthermore that the defendants should be arbitrarily corrected, and accordingly so punished, on the 17th thereafter, upon testimony of his inability to comply with the said sentence, the last clause of the said condemnation was executed upon him, the defendant, or mulcted as this Court in good justice should find appropriate, cum expensis; and furthermore, with respect to the other unknown and non-appearing claimants, requested the first default and a second citation by edict; against which the defendant Arnoldus Warnerus van Diepe, having served a formal written answer, and alongside it submitted ten secretarial deeds of conveyance, to show that the bondservants known by the said deeds of conveyance truly belonged to him, the defendant, for which reason he concluded in the property of the same to the end of inadmissibility, and in the alternative to the rejection of the said claim, cum expensis; furthermore, this case being completed between the parties, the gentleman advocate fiscal pro interim, on the 17th of September last, against the unknown and non-appearing claimants, since no one had appeared upon the fourth citation, requested the fourth default ex superabundanti and for the benefit thereof, as well as on the foundation of the reasons and grounds alleged in the claim and reply against the aforesaid van Diepen, that the owners of the aforementioned slaves, as contumacious persons, should be deprived of all right and claim which they might think to have had to the same, with the imposition of perpetual silence, cum expensis; together with principally making a claim by way of intent, he so concluded ex officio, claiming that the remaining 22 head of bondservants, except 2 female slaves who had died in the Lord's irons, should be declared confiscated, in order that the male slaves over fourteen years of age, pursuant to the latest order of Their High Noble Lordships, be turned over to the Honorable Company at the customary price, and such, along with the proceeds of the others, after deducting what is to be deducted, be distributed according to custom; whereupon on the 24th of the said month of September, according to the sentence of this Court, to the gentleman plaintiff ex officio against the non-appearing claimants was granted the requested fourth default, ex superabundanti, and for the benefit thereof declared them to be contumacious, and therefore deprived them of all right, action, and claim which they might think to have had to the remaining 22 head of bondservants, with the imposition of perpetual silence, and further ruling on the principal matter, dismissed the claim and conclusion made and taken on the roll of this Court by the known claimant Arnoldus Warnerus van Diepe for the reclamation of his brought-in ten head of bondservants, therefore confiscating the same alongside the other bondservants who might still be living of the aforementioned number, in order that the male slaves over fourteen years of age, pursuant to the latest order of Their High Noble Lordships, be turned over to the Honorable Company at the customary price, and such, along with the net proceeds of the others, after deducting what is to be deducted, be distributed according to custom. Nero van boegis, Nicolaas van Surmevent, and Orandatie van boegis, all slaves of the Leper House on the island of purmerent, prisoners of the state, were, on account of robbing the poor box on the island there, pursuant to the sentence of this Court of the date 23rd of November aforesaid: the first prisoner was condemned to be brought to the ordinary place of justice and there delivered to the executioner, to be punished with the rope around the neck at the gallows so that death ensues, subsequently his dead body to be brought to the outside place of execution and there left as prey to the birds of the air, with condemnation to the costs and expenses of Justice; however, the same died on the 30th of August prior, in the Honorable Company's irons; furthermore, the two last prisoners were acquitted of the fiscal's demand and consequently both discharged from their detention. Ian Philip Smit, of munister, soldier in the service of the Honorable Company and last stationed at Cheribon, prisoner of the state, was, on the 23rd of November aforesaid, on account of the wounding and thereby caused death of the fellow soldier Pieter Herbert, pursuant to the sentence of this Court, brought to the ordinary place of justice and there delivered to the executioner, punished with the sword over the head; furthermore, banished for all his life from all cities, places, and forts belonging under the jurisdiction of the Honorable Company, without ever or at any time being allowed to return therein, upon pain of heavier punishment, with dismissal of the further demand and condemnation to the costs and expenses of Justice. Hendrik Baat of hamburg, quartermaster, Lourens Iansz of flensburg, and Willem Lugter, of gouda, both sailors, and all stationed on the Tanjongpura guardhouse, were, on account of the stealing of coffee beans, on the abovementioned 23rd of November, pursuant to the sentence of this Court, brought to the ordinary place of justice and there delivered to the executioner, the first-named being first exposed under the gallows for a period of time with a noose around the neck, furthermore, together with the other prisoners, tied to a post, severely scourged with rods on the bare back, and on top of that the first branded, as well as all riveted into irons, therein Hendrik Baat to labor for the period of ten, and Lourens Iansz and Willem Lugter each for the period of five consecutive years, without wages on the Honorable Company's public works and to remain banished, with dismissal of the further demand and condemnation to the costs and expenses of Justice; however, the last prisoner Willem Lugter died on the 18th of November prior, in the Honorable Company's irons. Aarnout Luijmee, junior merchant in the service of the Honorable Company, Jan Samuel Lem, citizen of this city, and Wan Lacamana, lieutenant of a company of Malays, defendants in person regarding private trade in opium and linens. In this case, the pro interim fiscal attorney, master Nicolaas Jongsma, submitted a claim in writing and thereby concluded that, by definitive sentence of this court, the proceeds or the value of the sold and traded goods should be confiscated, consequently condemning the first and second defendants each to pay the sum of five thousand and sixty rixdollars, being the total of the goods traded by these defendants, and further the first and last defendant each to the payment first of a sum of three thousand eighty-six and one quarter, and then further of a sum of eight hundred and twenty rixdollars, of which one half to the sum of four hundred and ten rixdollars rests with the secretary of this court, in order that all these monies be distributed according to custom; furthermore, the first defendant to be dismissed from office, rank, and salary, and declared unfit ever to serve the Honorable Company again; furthermore, all three defendants to be fined by way of arbitrary correction, the first with a fine of five thousand, the second of one thousand, and the third of five hundred rixdollars, or as much more or less as this court, in proportion to each person's offense, to deter other such illicit traders, pernicious to the precious interests of the Honorable Company especially in these days, should deem appropriate according to good justice, with costs. Whereupon, after the first two defendants were released from personal appearance and permitted to appear through procurators, by procurator Rom for the first and by procurator Cras for the second, as well as the third defendant himself, after receiving copies, on the 30th of January of this year, both by written answer and orally, concluded to the effect of inadmissibility, and subsidiarily to the dismissal of the lord plaintiff's or prosecutor's claim, with costs; thus, this case having been fully written up to the re-rejoinder, and furthermore the parties having considered produced the documents already submitted herein as well as those produced anew under the benefit of relief, parties have thus proceeded with objections and refutations, and finally on the 20th of August last this case became ready for judgment. —

These cases are pending litigation. Ian Decker of Calomsoog, chief mate, and Ian de Boekel of amsterdam, third mate, both in the service of the Honorable Company and recently stationed, the first on the yacht Christina Sophia and the latter on the sloop de talmetij, the lord prisoners and defendants in this case. Against the prisoners, the pro interim fiscal advocate of the Indies, Master Nicolais Iongsma, concluded by written claim on the 1st of May of this year regarding the crime of extortion that, by definitive sentence of this court, they should be dismissed from office, rank, and salary, further declared disqualified, to be sent to the fatherland as useless and harmful subjects, and each fined six months salary for the treasury, and that furthermore this court should order the extorted chests of tea to be returned to the owners. Whereupon, the procurator van Vliet having been constituted by the prisoners, he requested inspection, if necessary a copy of everything, and a period of fourteen days to act as counsel should advise, and at the same time requesting that the prisoners and defendants be provisionally released from their prison. Whereupon it was determined by this court, before disposing of the aforementioned requests made on behalf of the prisoners in this matter by the said procurator van Vliet, to order the pro interim fiscal advocate to have the Chinese who were on board the Company vessels, and the crew who brought the prisoners with the boat to the junks upon their approach, examined thoroughly as quickly as possible. Subsequently, on the 5th of November last, after an extension in this matter had previously been requested and granted on account of the severe indisposition of the repeatedly mentioned procurator van Vliet, procurator Olij, appearing in order to answer for the prisoners and defendants, concluded to the effect of inadmissible, and in the alternative to dismissal of the claim and conclusion made, with costs. Parties having further persisted for reply and rejoinder, and a period of fourteen days having been requested for production of documents, on the 3rd of this month of December, procurator Waals having been ordered by this court to serve the prisoners pro deo in this matter instead of the deceased procurator van Vliet, he, Waals, requested a fourteen-day extension because he had newly entered into this case. Cornelis Roos, chief mate in the service of the Honorable Company, presently stationed on the vessel Cornelia, defendant in this case. Against the defendant, regarding the mistreatment of the soldier Gerrit Hungelman, the pro interim fiscal advocate of the Indies, Master Nicolaas Iongsma, concluded by written claim on the 9th of July last that, by definitive sentence of this court, the defendant should be condemned to pay to the said Gerrit hungelman for the loss of the sight of his left eye a sum of five hundred guilders, or as much more or less as this court in good justice should understand to be proper, and further condemned to a fine of six months salary for the treasury with expenses. Whereupon, on the day of the hearing, since the bailiff reported that the defendant had been properly summoned but had not appeared, the first default was granted against him, and a second summons, whereupon, on the 16th of the said month of July, the case being brought back onto the court roll, the defendant, then appearing, requested a copy of everything and a period of fourteen days to act as counsel should advise, just as he on the 30th thereafter, after he had constituted the procurator Rom in court to take charge of his case, also served an answer in writing, and alongside it submitted a register with various documents. Further, the parties having persisted for reply and rejoinder, and Master Johan hendrik Van Panhuijs, the water fiscal, provisionally attending to the ordinary affairs belonging to the office of fiscal advocate and having replaced in this matter the former pro interim fiscal advocate of the Indies, Master Nicolaas Iongsma abovementioned, having deemed produced the documents already submitted in this case and therewith renounced further production alongside procurator Rom for the defendant, and re-examination of witnesses having been requested by the plaintiff, the parties subsequently, on the 12th of November last, requested opening of the inquiry on the court roll, and a period of fourteen days for challenges to witnesses, and likewise on the 3rd of this month requested another fourteen days.

1950 Jan Philip Glissenberg, under-merchant, and Hans Vaageldaal, former ship's master, now burgher, Jan Dirk van Clootwijk, ship's bookkeeper, Dammus Dammusz van den Briel, chief mate, Marcus Andriesz, boatswain, all in the service of the Honorable Company, recently arrived here with the ship De Lagepolder from Palembang, jointly defendants in this case, the acting advocate fiscal of India, Mr. Nicolaas Iongsma, having on 30 July last made a formal written demand against the defendants concerning the mistreatment of the ship's carpenter Claas Pietersz, to the end that the defendants should be condemned by definitive sentence of this Council: Firstly, the first defendant Hans Vaageldaal to compensate and pay to the said and grievously mistreated Claas Pietersz, for the pain, suffering, unjust punishment, loss of health endured, and a forced confession serving as a mock pardon, a sum of four hundred rixdollars; further, that he, Vageldaal, be sent from here to the fatherland as an unruly and insolent subject, and the four last defendants be suspended for the period of six months from office, rank, and salary; further, that they all together should also be condemned to pay one year of salary, or the value of whatever each has earned or might yet earn in his aforesaid former or present capacity, for the benefit of the fiscal, with costs. On which day, following the bailiff's report that the fourth defendant had departed via Bengal for the fatherland and the fifth defendant had left for Japan, it was understood that note thereof be kept, but to the attorney Olij on behalf of the first defendant and to the second defendant at his request was granted a copy of all documents, and a period of fourteen days to do as they should be advised; and the third defendant, appearing in court, declared that he did not know what he was to do in this case, as he had been brought into it through the insolence of the first defendant, therefore concluding for inadmissibility and in due course for the dismissal of the claim and demand made, with costs; further, the acting official plaintiff having persisted in reply with respect to the third defendant, and the third defendant in rejoinder, a period of fourteen days was granted to the parties for the submission of evidence; and subsequently these proceedings, with respect to the first defendant Hans Vageldaal, advanced to the stage of submission of evidence, and with regard to the defendant Jan Dirk van Clootwijk to the stage of the inventory of documents, as well as regarding the defendant Dammis Dammisz, on the part of the acting official plaintiff on 5 November last, the documents already submitted in this case were held as produced and further production was thereby renounced, as was also done on the part of the defendant, whereupon verification was granted to the acting official plaintiff. Michiel van der Crap, junior merchant in the service of the Honorable Company, appellant in an appeal 1951 with the clause of relief regarding the lapse of time and improper prosecution of this appeal, in this case on 18 March 1740 the fiscal at Gamron in Persia, Jean George Schemming, made a formal written demand against the appellant, in a case of alienation, before the Council of Justice there in the first instance, to the effect that he should be dismissed from office, rank, and salary, and also declared unfit, and should furthermore be sentenced to pay without delay, for the full discharge of the parties, in cash the value of the 175¼ lbs of old copperware still missing, under further forfeiture in ready money, namely six months of salary for the Batavian deaconry poor and six ditto for the fiscal, with costs; further, that within the time of three to four days after the ruling, with his necessary baggage, he should transport himself on board the ship Steenhoven lying at anchor in the roads there, to remain there until the ship or ships depart, and subsequently to sail toward Batavia in the aforesaid condition for the further disposition of Their High Excellencies, the Noble High Indian Government of these lands, or otherwise, or all such as the Council of Justice there should find to be proper in justice and equity; further, after this case had been answered orally by the first defendant, now appellant, on 14 April following, according to the sentence of the frequently mentioned Council of Justice, the defendant was condemned, firstly, to be dismissed from office

office, rank, and salary, also declared disqualified, likewise to pay in ready money the amount of the still missing old copper work, being 175¼ lb, subsequently in a pecuniary fine, also to be paid in ready cash, of six months' salary for the diaconate poor and six similar ones for the fiscal, the Honorable etc., against which sentence the defendant, now appellant, upon his arrival here at this capital, having purged his default, appealed before this Court, and subsequently on 6 February of this year had Attorney Olij enter conclusions on the roll of said Court, firstly for the ratification of the obtained relief, further for the nullity or correction of the sentence in question, and that this Court, doing that which should have been done in justice in the first instance, would deny the claim and conclusion made and taken there against the appellant, acquit him thereof with the costs of both instances, and furthermore reserve to him such actions for costs, damages, and interests as he had already incurred and suffered as well as might still suffer; whereupon the interim advocate fiscal of India, Mr. Nicolaas Jongsma, having officially substituted for the aforesaid Persian provisional fiscal Jean George Schemming, consented to the requested ratification, and further requested a copy of everything and a fortnight to act as he should be advised, which was also granted to him; whereupon the aforesaid interim advocate fiscal, on 24 April of the same year, having brought this case to the roll, in order before answering to make a request, he also, after various allegations made more broadly contained in his aforesaid request, finally concluded therein that the proceedings held by the Court of Justice at Gamron and the sentence following thereupon should be declared null and informal, and that furthermore it should be reserved to him, the interim advocate fiscal, to institute, in the name and on behalf of the high government de novo, such action against the appellant in the case of appeal, or against whom he should deem appropriate, as he should believe to pertain to him by virtue of office and duty; further, on 25 June last, after Attorney Olij had consented on behalf of the defendant to the request of the interim advocate fiscal, the aforesaid proceedings held in the first instance before the frequently mentioned Court of Justice at Gamron were, according to the sentence of this Court, annulled as informal and untenable, and therefore the officer ratione officii, defendant, and respondent was ordered to institute de novo before this Court such action against the appellant in the case of appeal as he should believe ex officio to belong to him, and furthermore the costs incurred hereupon were reserved; whereupon the frequently mentioned interim advocate fiscal on 13 August of this year served upon the defendant a claim in writing, and in the conclusion thereof demanded that the defendant, by definitive sentence of this Court, should be dismissed from office, rank, and salary, and further sentenced to be deported from here to the fatherland with one of the first departing ships as a harmful subject, and further for the benefit of the party who was actually injured and entitled thereto, to the restitution and payment of the still missing 175¼ lb of copper works, and finally to a fine of one hundred rix-dollars, half pro fisco and the other half for the diaconate poor of this city, cum expensis; to which the defendant answered in this case, and the parties submitted reply and rejoinder, and having requested a fortnight to produce on both sides, the parties on the 3rd of this month considered as produced the documents already submitted in this case, and further on the side of the defendant there was produced a register with various documents, whereby further production was renounced and verification was requested, which was also granted to him after a copy thereof had been allowed to the Honorable officer, plaintiff. Furthermore, it having been made known to the assembly by the Lord Director-General in the name and on behalf of His Honour, that His Honour, whatever effort he had made to receive a true and sound report of the strength of the Chinese rebels who are still to be found at Bacassij, Talock Sanna, as well as thereabouts in the sugar mills, had not yet been able to succeed therein, since one reported that they were easily 10000 men strong and others again that their force consisted of only 5 to 6000 heads, etc.; His Honour declaring that by all these varying reports deviating from the truth he was brought into the uttermost uncertainty, and proposing to the honourable members whether it would not be most highly necessary that, in order to get behind the truth of matters, the Council of Justice of this Castle be ordered to proceed according to the customs of war with a certain Javanese sitting in the Company's irons, who had fought desperately on the side of the Chinese in the latest action at Poelo Gadong, and while stumbling in flight was overtaken and apprehended; likewise the Chinese who, according to a report in that regard by the commissioner to and over the affairs of the native Ferdinandus de Roij, was overtaken in the forest of Tsilemba by the troops of the Buginese Captain Totanga, and according to the assertion of the combined officers had been present at the aforesaid action, notwithstanding that he denies the same; and in case they do not wish to confess voluntarily, to put them at once to torture without form of trial, to discover whether one might thereby arrive at the truth; it was approved and resolved to adopt the proposal of His Honour, and to order Their Honours to proceed with the aforementioned Javanese and Chinese in the aforesaid manner with the utmost speed. In accordance with the orders of Your Noble High Esteems, we shall hereby bring before your eyes all that has successively occurred in this our assembly since the aforesaid date, and first of all how, notwithstanding that since our aforesaid last respectful letters a considerable time of nine months had elapsed before this separate dispatch was prepared in accordance with the request of Your Noble High Esteems, and we had for that reason expected, nay, almost firmly assumed that we would be able to communicate to Your Noble High Esteems that the proceedings against the former Governor-General Adriaan Valckenier and associates would, if not far advanced, at least have seen the main claim brought forward; yet we must declare to our particular regret that, notwithstanding all 1961 all efforts made, and numerous exhortations, as well as even written orders, this case has been kept dragging on under various pretexts as well as frivolous evasions by the former Advocate Fiscal pro interim, Mr Nicolaes Jongsma, and further neglected through his notorious unwillingness to proceed with it; so that, in order not to leave the persons unchallenged any longer through the caprices of this prosecutor pro interim, contrary to all customs and legal order, we were obliged to address ourselves to the Noble High Government of these lands, and at the same time request that another prosecutor be appointed in place of this one, who had even possessed the insolence, on an occasion when he was reproached by the President for certain offensive expressions, to declare to our faces that we could look for another prosecutor, as we shall further explain in detail to Your Noble High Esteems in the continuation of this letter, beginning with regard to the then hostage Ferdinandus

Ferdinandus De Roij set down, that just as was already brought to the notice of Your Noble High Mightinesses in our last, with how much surprise the declaration made by that officer regarding him, De Roij, came before us, he, notwithstanding that he had been recommended at that time to observe his office and duty, moreover on the 22: June, on the occasion that the said De Roij came in writing to request that his case might be proceeded with as speedily as possible and that he be released from his detention, immediately came to make an unsolicited declaration of having no action against the said De Roij, notwithstanding that we had already, on the basis of the documents gathered, judged and declared that an action lay therein to his charge, and consequently ordered him to institute it against the said De Roij; yet we were in no way able to be satisfied with such a mere verbal declaration, but ordered him to do so in writing, just as he also then did on the 29:' thereafter, but again so simply, and without bringing forth anything for the exculpation or discharge of the said De Roij, that we again thought fit to further order His Honour to set down in writing the reasons why he believed, on the basis of the produced documents, that he had no action against the said De Roij, in order to see whether any more light could be obtained concerning this obscure matter, and thereby pass to the sentiment of that officer, supplying His Honour at that time also with some papers which he had already on the 27:' December 1742. been ordered by the Noble High Government of these lands to request: after which, indeed on the 9:' July following, the said pro interim advocate fiscal did come forward with the ordered reasons, but instead of these containing anything fundamental, and demonstrating the innocence of the aforementioned De Roij, and our being moved thereby to declare the same likewise innocent, we have on the contrary found the same to contain nothing other than insinuations and reproaches of the persons whom he had, six months previously, placed into our hands as irreproachable and valid evidence, as well as gathered at his requisition, without giving any further disclosure, much less ever having declared previously that he could institute no action against the said De Roij, but only that he believed he did not have sufficient foundation to request incarceration or detention against the same, and merely requested to be equipped with the orders of the Council, as an undeniable proof that this officer was at that time of a different opinion than afterwards, when he came to make that suspicious declaration, so that in view of all the foregoing it was judged by us that an absolute unwillingness or a notorious connivance of this officer resides herein, and we consequently found ourselves compelled to let that case stand still for so long, and to decide upon the request of the said De Roij, who, after being interrogated on articles for more than five months, had sat without further claim, and had in the meantime requested to be released under hand pledge, and after the said pro interim advocate fiscal had been ordered to supply this Council as soon as possible with the proofs upon which he had set down his aforesaid positions and insinuations, to release him, De Roij, from his detention under hand pledge and promise to appear again at all times when called upon, sub poena confessi et convicti, and that until such time as an able man for the continuation of the same should have been obtained, to whom one could with peace of mind entrust this case, for the reason that the water fiscal Mr: Johan Hendrik Van Panhuijs had been excused in the case of Mr. Valckenier and associates, and the citizen officers serving at the time were somewhat mixed up in it, just as we, in order to conclude this case in its context, can also communicate to Your Noble High Mightinesses that the same has been assigned to the present bailiff Hendrik Jacob van Suchtelen for continuation, of whom we hope and trust that the same will be attended to with candour and zeal, and brought to an end. — Wherewith, with permission of Your Noble High Mightinesses, we shall proceed to the further criminal proceedings of the former Governor-General Mr. Adriaan Valckenier, as well as those of Mr: Willem Vincent Helvetius, and Mr: Cornelis Phillips, and in that regard must also say that until now, since our last letters, virtually nothing has progressed concerning it, for although the pro interim advocate fiscal did indeed make a request on the 3: July to have two commissioners appointed in order to be able to have recollected under oath all such documents as His Honour had already nine months previously against the aforementioned persons

had gathered, and we have not been able to condescend thereto, nor found that matter disposed to it, but on the contrary have once again enjoined the said advocate fiscal pro interim to proceed as quickly as possible with the case, both against the said detained gentleman, and against those held as hostages; furthermore, that we, pursuant to the communication by the resolution of the Noble High Government of these Lands of the 18th of July, on the very same day at the request of that officer, in the presence of Commissioners, caused to be seized and inventoried such goods, silverware, cash, and jewels as were permitted by the Cape Ministers to the former Governor General Adriaan Valckenier to bring hither with him. Thus it would well have been to be wished that the said advocate fiscal pro interim had applied himself, in accordance with our repeatedly made exhortations, to proceed to the merits with the cases both of the detained gentleman Adriaan Valckenier and against the criminal hostages Mr. Willem Vincent Helvetius and Mr. Cornelis Phillips, and had no longer delayed himself with making any further requests. Nevertheless, on the 30th of July, his Honor appeared yet again for the fourth time with an ample petition tending essentially toward the incarceration of Mr. Willem Vincent Helvetius, without however submitting any new or further evidence to his charge; whereupon we saw fit, without taking any regard of the impertinent arguments and ingredients thereof, to persist in our disposition of the 25th of March of this year, already sent to Your Noble High Mightinesses, and further ordered him to summon the hostage Mr. Willem Vincent Helvetius ordinario modo to the Roll of this Council; on which occasion our President came to submit to the Council how the said advocate fiscal pro interim had repeatedly been enjoined to proceed as expeditiously as practicable with the cases both of the detained gentleman Adriaan Valckenier and with those of the hostages Helvetius and Phillips, but that his Honor nonetheless dragged them out under these and other pretexts and continuous requests, and that the said President had therefore found himself obliged to present this for consideration to this Council, since his Honor no longer wished to take the further delay upon his own account. Whereupon we saw fit to conform with that proposal, and consequently to ask of the advocate fiscal pro interim within what time his Honor would be in a position to bring forward the formal claim against the said persons; whereupon his Honor declared that he could set no time for this, adding thereto that this was not so much because of the vast amount of work, but rather because he still found himself very confused in those cases, further referring to the arguments and ingredients of the aforementioned submitted ample petition against Mr. Willem Vincent Helvetius; but that he, the advocate fiscal pro interim, would await the orders of this Council, and read them with respect, and if it were possible for him, obey them, or else lodge his grievance against them. After which, in order finally to cause these important matters to proceed to the merits, we further saw fit to order the said advocate fiscal pro interim to bring out the formal claim, within the time of six weeks, both against the detained gentleman Adriaan Valckenier and against the hostages Mr. Willem Vincent Helvetius and Mr. Cornelis Phillips, as appears from the Minute kept thereof accompanying this. However, in the meantime the hostage Mr. Willem Vincent Helvetius having come forward with a request to the end that this Council might be pleased to qualify him to raise at interest the sum of One Thousand Rijxdaalders for his necessary maintenance, and the advocate fiscal pro interim having requested, before disposing thereof, that the same might be placed in his hands in order to declare himself thereon, the same delivered to us against it a quite offensive rescript, filled with biting and wanton expressions to the contempt and mockery of the adopted dispositions and orders of this Council. We could by no means let this pass unnoticed, but after the request had been disposed of and the requested qualification had been granted, we made our resentment in that regard known to him in decent terms, and enjoined him to show the Council proper respect and esteem as a subordinate officer according to his duty, and prohibited him from using such wanton and offensive expressions and arguments anymore in the future; whereupon the same immediately came to declare and request, very insolently, that we might be pleased to look out for another advocate fiscal pro interim, pretending at the same time to be unable to continue any longer in that office because of his weakness, caused by the continuous troubles—which, however, if such were true, we nevertheless deem to have been caused by his own doing and stubborn caprices.

to have been caused, and which surely would have been prevented if he—who, according to the Instruction of the year 1650 and further orders from your Right Honourable Lordships under 1 November 1709 and 13 December 1741, was obliged to obey the orders of the Council—had complied with them somewhat better, had not opposed them, much less applied himself to being absolute master of the administration of Justice, until finally our patience, after more than too much accommodation had been exercised for the sake of these important matters and the lack of capable subjects, ran out, and we could no longer handle them with such an unwilling officer, on the 10th of September following found ourselves compelled to address the Noble High Government of these Lands and to bring to the knowledge of their Right Honours how, the period of six weeks having expired that was enjoined upon the pro interim advocate fiscal Mr. Nicolaas Iongsma by Minute of the 13th of August last for bringing forward the principal charges, both against the detained gentleman, the former Governor General Adriaan Valckenier, and against the criminal hostages Mr. Willem Vincent Helvetius and Mr. Cornelis Phillips, and the President having asked the said pro interim advocate fiscal whether he was ready with the aforementioned charges or whether he still required some extension of time for that purpose, and that the said pro interim advocate fiscal, after having been told by the Lord President in response to his question that nothing could be decided concerning his request for dismissal from office, made in this Council on the 13th of August last, but that the same had to be presented to their Right Honours, had answered to the first that, even though he would have wished ever so gladly to obey the order within the prescribed time of six weeks, he would have been prevented from doing so by his weakness, caused by manifold daily work and constant, continuous difficulties, without explaining himself further in this regard or wishing to answer the second part of the aforementioned question; from which it could sufficiently be inferred that the said pro interim advocate fiscal did not intend to comply with the orders of this Council mentioned above, notwithstanding that his office and duty required this, and thereby notoriously showed his unwillingness to proceed with the aforementioned case, such that we, considering that the same had been dragged out by him long enough already, and had been delayed contrary to all exhortations and ordinances, judged that it would no longer be justifiable to tolerate its delay any further and to encumber the detainees with an all too long detention, therefore respectfully requested their Right Honours to provide this Council with another officer who would attend to the matters of Justice with the requisite promptness. Whereupon, on the 24th following, it was communicated to us by the President that the said pro interim advocate fiscal Mr. Nicolaas Iongsma, pursuant to a resolution of their Right Honours of the 17th preceding, had been dismissed from the ordinary meeting, and that it had been left to us to allow such a person to officiate in the case of the former Governor General Adriaan Valckenier and associates as we should judge could be employed for that purpose with sufficient peace of mind. to observe, and to prosecute according to oath and duty, and to communicate this to His Honour during the meeting, who then also took the same upon himself with readiness, declaring that he would employ everything that could be contributed by him in the service of justice; after which, it having been further deliberated by us whether one could let His Honour suffice with the oath taken before Their High Nobles as Bailiff, or rather have him take a special oath for this separate commission, as has been done in former times, it was understood at that time to postpone this until a further meeting and deliberation, but nevertheless in the meantime to order the retired pro interim fiscal advocate Jongsma to prepare as soon as possible the transfer of the papers having any relation to this matter, in order to be able to have the same transferred thereafter to the said Bailiff, but on the eleventh following, having been further deliberated by us whether one also ought to administer a special oath to the same in the prescribed commission, we have not only judged this to be necessary, but also understood to present the draft of the oath, as it was framed by this Council, with all respect to Their High Nobles for resumption, in order that, upon approval of the prescribed oath, to have the same taken as soon as possible by the said Bailiff; whereupon on the 16th following it was communicated by our President that the draft of the oath, which according to our resolution of the 11th of this month was presented for resumption to the Noble High Government of these Lands, had been approved by Their High Nobles, so that we have not neglected to have the aforementioned Bailiff Hendrik Jacob van Suchtelen immediately take the prescribed oath into the hands of our President. Furthermore, we find ourselves obliged to bring to the knowledge of Your Right Honourable, that on the 30th of March of this year, our Extraordinary Member Mr. Philippus Rochus Kien passed away, and that on the 20th of August following, our Ordinary Member Mr. Jacob van den Bosch was discharged from this Council, and appointed Commander of Bantam at his request, subject to the retention of his rank and salary, and also that our co-opted Member the Senior Merchant Carel Coenat, because of his acquired employment, was likewise discharged from this Council, and at the same time in his place was appointed the Senior Merchant Mr. Gerrit van Brandwijk van Blokland, who recently arrived here from Amboina, who then also a short time thereafter took and obtained a seat here in this assembly. Lastly, we must also communicate hereby to Your Right Honourable, that on the 20th of November on behalf of the former, and presently detained, Governor-General Adriaan Valckenier, and the hostage Mr. Willem Vincent Vincent Helvetius aforementioned, there was presented to us a certain ample petition containing in substance a vigorous complaint regarding the lingering conduct of the proceedings, and the behaviour held toward them from time to time in that regard by the former pro interim fiscal advocate Mr. Nicolaas Jongsma, and furthermore some alternative requests, namely that, because of the long duration, they might be discharged from their detention and hostage-holding upon solemn pledge and promise nevertheless to appear at all times when summoned under penalty of being held as confessed and convicted, or else on juratory caution, or at least on such sufficient fide-jussory caution as this Council should find appropriate, and that as a consequence thereof the granted arrest and interdiction against the alienation of goods and papers might be lifted and discharged, but in case both, or either one of them, might not be granted such, that then the officer might be enjoined to state to them within the time of six weeks the action that he might deem to have against them, and furthermore to admit them to to their defence, or that said officer would otherwise have to discharge them, as well as to allow their goods to follow freely, without any or else upon such conditions as this Council should deem necessary and appropriate; whereupon we, after exact resumption, and the received oral declaration of the Bailiff Hendrik Jacob van Suchtelen as presently functioning as officer in this matter, who had declared not to be capable of it in even six weeks, because of the multiplicity of papers, but that he would endeavour to exert his diligence to be ready within approximately the time of two months, and to bring the demand against them, but in case he might become capable of it sooner, to come forward with it, have found fit, instead of disposing on the aforementioned alternative requests, to recommend the said Lord Bailiff to proceed with the matters of the detained gentleman and that of the hostage as quickly as possible, and to bring the demand against them.
