Honorable, Valiant Sir, Since the heavy burdens that the trading post of Ketsmandvi has had to bear in recent years without notable profits cause it to pass for a liability to the Company, I shall, in compliance with your Honor's esteemed request, take the liberty to demonstrate clearly, and as I hope, satisfactorily to your Honor, that matters are quite different; and that said place is not as disadvantageous for sales as it appears, but can very well make up for its expenses out of the greater profits than those obtained on the spot, with the surplus profit of a pleasant little capital. To the Right Honorable and Severe Lord Louis Satleserz, Extraordinary Councilor of the Netherlands Indies, as well as Director and Commander-in-Chief of this Directorate. Right Honorable and Severe Lord, Since the heavy expenses which the trading post at Kets Mandue has had to bear in recent years without any notable profits have caused the same to be regarded as a burdensome expense for the Company, I shall, in compliance with Your Honor's esteemed requisition, take the liberty to demonstrate clearly, and as I hope, satisfactorily to Your Honor, that the situation is entirely different; and that this post is not so disadvantageous for sales as it appears, but can very well make good its expenses from the greater profits than those obtained in loco, leaving an excess profit of a pleasant capital sum. If the troubles which the Company has had since the financial year 178 5/6 with the prince of Kets had not obstructed the Company's trade in that realm, a good profit would have been obtained, provided that all goods petitioned for by myself and the then second-in-command Carel Hen in our requisitions dated 5 September 1755 and 16 January 1756 could have been sent. For on the four articles, namely powdered sugar, sappanwood, lead, and spelter, which apart from the spices and the Japanese copper bars were the only ones fulfilled out of the 88 kinds of diverse requested merchandise, and which cost ƒ28588:1:— at purchase, ƒ28438:5:8 or roughly 99¾ percent was profited that year. This I mention merely in passing and as proof of what was just said; proceeding now to prove that the expenses are amply made good by the greater profits. To do so, I shall first explain the course I have pursued. Agreed J. den Kinkn, Clerk In his respective capacities: Daily in the morning from seven to eight o'clock to speak to everyone who has something to request or propose to him, Sundays along with other feast or church days only excepted, regarding matters that can suffer delay until the next day. Then, as well as in the morning between eleven and twelve o'clock, and indeed in pressing cases even at all hours of the day, to receive reports from the Fiscal concerning judicial matters, from the Warehouse Master and the Dispenser concerning what has occurred and been performed in their administration, from the Master of the Equippage concerning the ladings of the ships, and from the Invoice Keeper regarding what concerns the work of his department. He must also take care that regarding all fines and forfeitures the ordinances made thereon are observed, and especially that which is contained in the Instruction of the Governor-General and Council for the Senior Merchants of Batavia Castle and the Chief of the General Pay Office of the 22nd of September 1665. As President in the Council of Justice: Whenever a Political Council meeting is announced on a day that a judicial meeting should, or to his knowledge is scheduled to be convened, to address the Director to consult together at what hour it may conveniently take place. To take care that the court pleadings are held and conducted according to style and practice, and therefore, according to the Resolution taken in the Council of India on the 23rd of June 1732, the Director, for the preservation of supreme authority competing to him in a lesser degree by virtue of his commission by representation of the sovereign, must not be withheld the necessary knowledge, especially concerning criminal cases. The President shall not receive or enjoy, directly or indirectly, any gifts or presents, nor profit from any matters, however small they might be, from anyone who he knows has, or apparently will have, any lawsuit or legal claim before the Council of Justice, both before and after the rendering of the judgment. Well understood that however under this shall not be included edible food or drink in such quantity that it can be consumed within two or at most three days, the acceptance or rejection of which is left to the conscience of the judge. And in so far as His Honor might have received any other gifts from any good friends or other persons who he afterwards learned had any lawsuit before the Council of Justice, which His Honor at the time of receiving the said gift had not known, or who afterwards might obtain any lawsuit before that court, he shall be bound to inform the Council thereof and to disburse the received gifts, or the value thereof, for the benefit of the poor. His Honor shall be bound, with the Council of Justice, whenever there are parties on the court roll, to hold a fixed roll-day once a week, namely on Thursdays. Or also at his house, in case of indisposition or, in extraordinary matters wherein it is not necessary to hear parties. Yet when calling an extraordinary meeting, His Honor shall be bound to give notice thereof to the Director in person, or in case of illness, to have it given by the Secretary of Justice. His Honor shall, barring lawful impediments, always be the first to appear in the meeting, together with the Secretary, or in case of his indisposition, the First Sworn Clerk, in order to examine the court rolls. And if His Honor himself might not be able to appear, he shall have the members pre-notified thereof by the Messenger precisely at the announced hour or earlier. The President shall have the preeminence and authority to summon the other councilors to him in the ordinary meeting room of the Council of Justice regarding all matters concerning justice, as often as he shall see fit. Whenever upon probable proof an arrest is requested, and there is periculum in mora, or no time to convene the Judicial Council, he may grant the same, to be properly entered on the nearest court day, which in such case must be held within twice twenty-four hours, or sooner. All judgments or decrees, whether definitive or for any interlocutory provisions, both in civil and criminal matters, must not be resumed by him alone, but in full Council. as he shall deem proper according to oath and duty, and to draw up for that purpose all writings and memoranda that shall serve thereto. Therefore he shall not be permitted to refuse to institute action against those who have committed an offense, unless it be for evident peremptory reasons, which in that case he must allege and concerning which it pertains to the Judge to decide. It being also of his special department to collect outstanding debts and, when it is deemed necessary and expedient by the Director and Council, to take the legal course for that purpose. He must also, when requested and ordered by the Judge, maintain all cases concerning poor and miserable persons, without demanding any fee therefor. Except in cases which such persons have obtained by way of assignment or cession, with which he shall not meddle. When he intends to join himself to one of the parties, he must do so before conclusions are taken before the Judge. Consequently, when cases in which he has joined are delayed, he shall nevertheless be obliged to proceed against the opposing party for the right of the High Authority. When the fiscal wishes to excuse himself from serving in this or that case by reason of warranty, he shall first have to address the Judicial Council and give notice of the cause for which he thinks he may be excused. And subsequently the Judicial Council must notify the Supreme Commander of the same. That officer shall generally, in the exercise of his office, do everything that may serve the honor of justice and the conservation and preservation of the right, authority, and highness of the Sovereign and the Company, without sparing anyone, provided that he remains within the limits set for him. The parties with whom he shall have joined shall not be permitted to make use of any writings, pieces, or muniments before and until he, the fiscal, shall have had inspection thereof. In the absence of the President of the Judicial Council, upon plausible evidence, to grant arrest when there may be danger in delay or no time to await his return, but otherwise not, and further in such manner as described under the Title of the President. Yet the same must take place at the respective secretariats or other offices where they reside, and with the prior consent, order, and maintenance of the Director, who shall also have to provide him from them with the necessary authentic extracts for the service of justice. Must also keep strict supervision over the buying and selling of pay accounts, and if he only has vehement or probable presumptions, without proofs, that such has occurred or is about to occur, to give notice thereof to the Director and the Secunde, but otherwise to proceed against the guilty parties according to the orders. 25. To draw up specific toll lists of the merchandise imported and exported by private individuals, and to send a copy thereof annually with the ship departing for Ceylon to the Honorable, Highly Esteemed Gentlemen Masters. 26. To prevent and counter to the utmost of his ability all smuggling or frauds and curtailments of the Lord's rights, as well as to collect immediately, or cause to be collected by the court messenger, without respect of persons, the Company's and the Moorish toll on private goods, to keep accurate books thereof, and to render an account thereof three times a year, namely at the end of August, the end of December, and the end of April, or as often as the Lord Director requires it. 27. Being required in this regard to take care that goods coming in from outside are declared at not less than 20 percent below the market or most recent sale price at the Company, and outgoing goods for no less than the Company is accustomed to clear its own through toll. 28. And furthermore, generally to keep a watchful eye that the Company is in no way defrauded in the matter of the coolies and other native servants whom it hires or otherwise employs. 29. Upon the arrival of any ships, the Fiscal shall investigate how matters stand with their cargo, whether they actually have on board that which, calculated in volume and weight, could and should have been laden therein, and what space or room might be remaining therein, and especially whether any goods and merchandise belonging to private individuals might be found therein. 55 30. And if so, to seize the same and bring them ashore; further to inventory them and proceed to the confiscation thereof, following which he shall have to inform himself exactly, both through personal inspection and from the officers and common seamen. 31. Furthermore, it shall also principally be his concern to pay attention to private trade, whether carried on by the servants of the Honorable Company stationed in or arriving at Suratte, or by the freemen being subjects or dependents of the Honorable Company, contrary to the edicts there, especially in cloths, opium, and other wares and merchandise in so far as the latter is also forbidden, proceeding against the violators and abettors thereof according to the Articles of War, as well as the laws and statutes of the Honorable Company, to confiscation, deportation, or other punishments established therein. 32. He must nevertheless be careful that no one suffers any nuisance, violence, or extortion by his subordinates under the pretext of collecting tolls or otherwise, as tolerating or conniving at such would be just as punishable as if he had directly made himself guilty thereof, the Fiscals being no less bound to the censure of the laws than other servants, according to which they must also be treated and judged. 33. And the Fiscal shall, from the net profit realized upon the sale of such seized private goods and merchandise, enjoy the exact half, in order to give from it a proper bounty to the informant for further encouragement, without distinction or limitation, however large the sum may be, with a fourth part of the remaining half to be enjoyed by the poor. 34. But in all fines and penalties, the provisions of the former ordinances shall be observed and complied with, and specifically that which is contained in the instruction from the General and the Council for the Senior Merchants of the Castle of Batavia and the Merchant of the Pay Office of 2 September 1665 regarding this matter.

Whenever any Company servant is prosecuted on account of extortion, oppression, or other cases of that nature, the Fiscal shall always be obliged to proceed as well, whether towards confiscation, indemnification, or compensation, with costs, damages, and interests on the monies counted out to the Company upon bill of exchange or assignation. 36.
