1360 For the prosecution Whereas the Honorable Cornelis Rietveld, provisional Fiscal of this Directorate, by virtue of his office, has demonstrated by petition to the Honorable Council of Justice: That the fugitive sergeant and former garrison writer George Suiker had dared for some consecutive years, upon receiving money from the Company's treasury for disbursement to the garrison, to account for more monthly than he actually paid out to the men, and that he thereby embezzled from the Company a considerable amount of fourteen thousand one hundred sixty-six guilders and four stuivers, as clearly appeared from a written statement from the pay office submitted by him, the petitioner by virtue of his office, With the request that, given the absence of the aforesaid Suiker, there may be granted to him, the petitioner by virtue of his office, a citation by edict with the ringing of the bell, to the end that he appear within a certain peremptory period before their Honors' tribunal aforesaid to answer for the aforementioned fraud and his desertion, under penalty that upon non-appearance against him, the defendant, proceedings shall be taken as found proper according to the laws of the land and good justice, And this request having been granted by the decree of their Honors dated the twenty-third of this current month, So it is that I, Cornelis van Bemmel, Court Messenger of the aforesaid Council, by order and authorization of their Honors, have summoned, as I summon by this public edict, after the preceding ringing of the bell, the aforementioned sergeant and former garrison writer George Suiker to appear in person before the repeatedly mentioned Honorable Council on Saturday the sixth of April next, or if that is not a court day, the very next court day, in the morning, and there 1361 there to answer for the fraud committed and the desertion following thereon, under penalty that upon non-appearance of him, the defendant by edict, proceedings shall be continued by default from fourteen days to fourteen days, as is customary according to style, Done, after the preceding ringing of the bell, inside the Fort at Hoegli in Bengal, the twenty-fifth of February Ao. 1765 signed: C:s van Bemmel, Court Messenger Extracted from the criminal roll of the Council of Justice of this office. The Honorable Cornelis Rietveld, Fiscal of this Directorate, formal petitioner of edictal citation and plaintiff, against George Suiker, sergeant in the garrison and writer of the troops stationed here, summoned party and defendant. To purge the second default and to appear in person before this Court after all, and there to answer for the rogue piece committed by him regarding the Company's monies and the desertion that followed thereupon, on pain of being held confessed and convicted. The Court Messenger Vonck declares under the oath taken at the commencement of his service that the citation was properly affixed to the gate of the Lodge, but that the defendant has not appeared. The formal petitioner of edictal citation and plaintiff requests therefore against the defendant the third default and a fourth citation ex superabundanti, with admission to serve next with an indictment. Your Honors will see that the defendant by edict mentioned in the heading hereof is guilty of an egregious rogue piece, 3. namely, 4. of theft of the Company's monies, 5. as he for some years, monthly by warrant, entered and received more 6. than was disbursed to the military men. 7. For the easy achievement of this theft, 8. he took advantage of the custom previously maintained in debiting the military men for the monthly pay received by them, 9. which was done solely according to the receipt roll, 10. and which receipt roll was always drawn up 11. according to a list which he, at the end of the month, 12. delivered to the pay office, 13. containing how much each man was entitled to receive. 14. But the warrant, which remained in his possession in the petty cash after the receipt of the money, 15. was always considerably larger than what the receipt roll, drawn up according to his list, 16. in fact contained. 17. This was, according to the Extract Resolution under Letter A, discovered by chance, 18. whereby it appears that he confessed this roguery to the Captain Commandant Zinner, 19. and pretended to him that he had done this by order of the previous Commandant Von Staaden. 20. However this may be, he was arrested upon this, 21. but found an opportunity to violate his arrest and escape by flight, 22. and effort has been made in vain to get him back from the Calcutta administration, 23. as the applications made thereto have not been answered at all. 24. Since then, at the request of the official plaintiff, it was investigated at the pay office how much the stolen property amounts to, and for how long this villainous act has been committed, and it was discovered that this already began in the year 1755 and lasted until the end of August 1762, in which time the defendant by edict, in the aforementioned fraudulent manner, has embezzled from the Company a considerable amount of ƒ. 14166: 4:-, to be seen in detail in the statement signed by the pay bookkeeper under Letter C. And whereas it is the duty of the official plaintiff, in his capacity as officer of justice, to institute action against all evildoers, he, on account of the flight of the aforementioned Zuiker, requested and obtained from Your Honorable Worships a citation by edict under the ringing of the bell, which citation, to be found in copy under Letter G, on the 25th of February last was duly published by the court messenger from the steps of the city hall and subsequently affixed to the gate of the lodge. And it appears from the same that the defendant by edict was summoned to appear on the 6th of April, or, if that is not a court day, on the following court day, to answer for the fraud committed by him and the desertion that followed upon it, on pain that in case of non-appearance, proceedings against him would continue by default from fourteen days to fourteen days, as is customary according to style. However, whereas on the first court day after the affixing of the edictal citation, being the 6th of April aforementioned, the messenger reported to the court roll that the defendant had not appeared, the official plaintiff obtained the default, and for the benefit thereof bodily apprehension, if he might be overtaken, and otherwise three successive citations from fourteen to fourteen days, as appears from the minute under No. 1. And on the second court day, again no one having appeared, there was granted to the official plaintiff the second default and a third citation; just as also on the third court day, on account of the non-appearance of the defendant by edict, there was granted the third default and a fourth citation ex superabundanti, with admission to the official plaintiff to serve an intendit on the next occasion, which citation was also duly affixed by the court messenger to the gate of the lodge. And since the defendant by edict has not appeared but stayed away, he ought to be held pro confesso; see Van Alphen's Papegay, chapter 29, page 562, paragraph 2; and thus to be declared guilty of the punishment enacted against theft and forgery or fraud, which, in proportion as the fraud is great and another is harmed thereby, must be increased according to the judge's discretion; all the more because he who harms someone in a fraudulent manner is presumed not to have the least fear of divine or worldly laws, since fraud indicates an evil and deceitful heart that has banished all fear of a future state, and seeks to be unconstrained by all laws tending to good order and discipline; not to mention that in this case the crime of perjury is paired with all the previous misdeeds, if one reflects upon the oath by which a servant of the Company is bound to his lords and masters, namely to be true and faithful to them; also the punishment for theft is aggravated according to the duration the crime was committed, and according to the circumstances is often extended to the punishment of death, regarding which the judge's discretion in matters where fraud and falsehood take place, without regard to any ordinance, has the supreme decision, as it is impossible to find specific punishments for all the different degrees of fraud, besides the fact that the circumstances are not always one and the same. The acting fiscal of this direction, the Honorable Cornelis Rietveld, petitioner ratione officii of an Edictal Citation and prosecutor, Against George Suiker, Sergeant and former garrison clerk from the garrison here, Defendant by edict and fugitive in the matter of theft of the Company's monies and subsequent desertion. The Council, having attentively reviewed the documents of the trial submitted by the petitioner ratione officii and prosecutor, and having considered everything that was to be considered in this matter, administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, adjudicates the demand and conclusion made and taken by the petitioner ratione officii and prosecutor by intendit, and accordingly grants against the defendant by edict and fugitive, on account of his non-appearance, the requested fourth default, declares the same, for the benefit thereof, to be barred from all exceptions, whether declinatory, dilatory, or peremptory; furthermore condemns him, the defendant by edict, as well as fugitive and defaulter by contumacy, as he is hereby condemned upon approval of the Right Honorable Director George Louis Vernet, to remain banished for all his life from the jurisdiction of the Honorable Company, on pain that if he is ever found within it again, he shall be punished with the rope around the neck, such that death follows. Per the ships Bleiswijk and Schagen To the Noble, Right Honorable Directors, representing the General Dutch East India Company there Noble, Right Honorable Gentlemen! Due to the slow arrival of the linens, we have with difficulty been able to get sufficient cargoes ready for the two now departing ships; however, in that predicament we have proceeded to supply 155 packs that were still lacking to fulfill the requisition of gerras, with just as many packs of salempores, as those linens differ only slightly from the others in length, and we have furthermore, in order to bring the cargoes as close as possible to eight tons of gold, as far as the shortness of time permitted, sent on these ships some packs of the most popular assortments of which the requisition had already been fulfilled, of which the profitable sale, as we hope, will justify our conduct. On the delivered cargo of the ship Bleiswijk, only minor shortages were found, and we refer in that regard to our Resolution of 21 December, which accompanies this in extract. As for the defects found on this vessel, those are known from the Report submitted at the session of 1 October last by the commissioned captains; the same having been fully repaired, and the ship properly put in condition for the voyage, as evidenced by the declaration of the ship's officers attached hereto. The captain Klaas Stuiver, having requested on 21 December, as appears from our Extract Resolution of that date, by petition for some provisions and necessities for the voyage home, this was granted to him, and among others: 2 heavy ropes, and 2 heavy anchors, as well as 1 coir rope, all lost according to declarations. We have had the honor to inform Your Grand Noble Lords by our respectful letter of the 7th of November last that we intended to dispatch the ship Schagen at this time. We have also succeeded in fulfilling this; yet it has not been without great difficulty that we have been able to provide that ship and Bleiswyk with sufficient cargoes, for the slow delivery of linens, not enabling us to meet the demand completely for all articles, we were obliged, in order to bring the cargoes to the value of about eight tonnen of treasure, to proceed to supplement 155 packs that were still lacking in the Gurrahs with d /8 with salempores, and furthermore to have prepared several more packs of the most sought-after assortments of which the demands had already been fulfilled; which we hope will, just like the others, yield good profits. Regarding the delivered cargo of this ship, we refer to the accompanying extract of our Resolution of the 24th of December, into which the findings are incorporated. Furthermore, the vessel has been properly repaired of the defects mentioned in the report of the examination, inserted in our decision of the 28th of October last, and according to the declaration of the ship's officers, which is also transmitted herewith, found fully capable of undertaking the voyage. Also, upon the petition of the skipper Klaas Arriens, likewise to be found in our Resolution of the 24th of December, various necessities and provisions were granted for the homeward voyage, among which also 2 heavy mooring hawsers, which according to declarations have been lost; we being able, regarding the alterations among the ship's crew, to refer to the transmitted copies of acts. The Bookkeeper Abraham Roghe, having been discharged by the High Indian Government over this Directorship to the Netherlands, is sailing over with this vessel, passage having also been granted, upon recommendation of 1393 of the Calcutta Governor Lord Robert Clive, to Mr. Mendez Baillie, for which the freight and the board money have here been properly paid into the treasury. 1396 Duplicate Patria Deputies to the Assembly of the Seventeen, representing the General Dutch Chartered East India Company, at the presiding Chamber of Amsterdam To the Honorable High and Mighty Lords Directors Honorable High and Mighty Lords The manifold occupations with which we were overburdened in dispatching three ships having caused us to neglect issuing a draft to Mr. James Amyatt for a sum of thirty thousand Sicca Rupees, which we had previously promised him to accept; we, in order not to break our word and considering that this money was still needed, have accepted the same and issued drafts for it upon Your Honorable High Mightinesses, payable to Messrs. George Clive, Ynyr Burges, and James Amyatt in London, or their order or assigns, for forty-three thousand, six hundred and fifteen guilders, seven stivers, and eight pennies, amounting at the usual 7/13 percent to the aforementioned sum of thirty thousand Sicca Rupees; as appears from the copy of the draft enclosed herewith, of which, on the occasion of the English ship currently departing, we could not fail to give Your Honorable High Mightinesses proper notice, in the hope that our omission will be favorably excused and the draft will be honored with payment in due time. On the same occasion, we did not wish to fail to inform Your Honorable High Mightinesses that the return ships Blijswijk and Schagen, dispatched by us on the 12th of this month, together with the ship Welgelegen, which is destined for Batavia by way of the Coromandel Coast, already put to sea safe and in good condition on the 17th, and we hope that these vessels will convey their valuable cargoes expeditiously. An error having been made in the calculation of the packing of the coarse linens sent with the ships Scholtenburg and Kattendijke upon the invoices, which was not discovered until today; we did not wish to fail, on the occasion of the departure of the French Company ship La Douce, to give notice thereof to Your Honorable Grand Mightinesses; also enclosing herewith an invoice whereby that which was overcharged to Your Honorable Grand Mightinesses' Chamber is properly credited.
