happen that, if this should come to your Honour's ears through someone else, I might become subject to reproaches. I believe that something concerning this must have been written from Calcutta, but what, Heaven only knows. However, the said gentleman, having become displeased, summoned me over this and interrogated me as to what I had represented to my master regarding this matter or other affairs, or in what way his Honour had hindered me. Thereupon I revealed the communicated matter to his Honour, and received from him in reply an inquiry as to whether I had also written about more matters, continually showing himself dissatisfied. Since the state of affairs is known to your Honour, that he fears no one, I nevertheless need not be concerned under your Honour's protection, relying in every respect upon your benevolence. I have no extensive business here in this place. But last year I bought a small quantity of salt, about 2 to 400 Mnds, of which quantity a remainder was left among the people. Putting up with this, I laid out a little again this year, in order thus, between the one and the other, which will be about 1000 Mnds of salt, to obtain it from the suppliers. But becoming aware of the intention of the English to hinder me in the salt trade, I have refrained from all further dealings in that regard, in order to have no trouble with them over such trifles. Nevertheless, I shall find myself obliged to inform your Honour if I should be disturbed in the collection of what I have to claim from the past and the present, and will govern myself according to whatever it shall please your Honour to order. Clercq Whereas previously, under the administration of Mr Sparks, regarding a certain plot of land situated on the north-east side of the Factory, long about two hundred and fifty Cob, with the house of Ram Deeuw, son of the late Ody Ram Saraef, which from time immemorial belongs in ownership to the Company and has been held in its possession, a dispute was raised without cause by the Munshi Sheikh Ghulam Mustafa, I found myself under the necessity of writing about this to Mr Taillefert at Hugli. In the course of time this affair was submitted to the Lord Governor of Calcutta, from where the aforementioned Munshi was also summoned. He thereupon also went to Calcutta, and he received a plain and direct order not to presume anything further regarding that plot of land, just as Mr Sparks was also ordered, after an inquiry had been made, to cause the said plot of land, etc., to be delivered to me; in consequence of which a surat-i-majlis, official record, was drawn up and sent over in copy to Mr Taillefert, which will certainly be kept at the office. Subsequently, Mr Marriott has caused building to take place on that spot, of which I communicated the particulars and received in reply that this would be written about hereafter. Yet, as the said Mr Marriott is again erecting a bankshall, rope-walk, on that spot, and replies to me, who constantly forbid him, that it is English ground, I am obliged to send over herewith a copy of the surat-i-majlis again, and two papers in the Dutch language regarding the house of the aforesaid Ramdeeuw. No. 15 383 After the usual title Translation of a Persian Arzi written to the Right Honourable Lord George Louis Vernet, Director of Bengal, etc., by the Sarkar at Bellazoor, Koensjoe Behariedals, received here on the 23rd of June 1766. Previously I had the honour to write to Your Honour concerning the plot of land on the north-east side of the factory, upon which Mr Marriott has forcibly caused a bankshall to be erected. It still depends on Your Honour whether I shall further oppose this action or let the matter rest, as I shall regulate myself according to the wise orders Your Honour will be pleased to give me. Presently I hear that the said Englishman is arranging to have a declaration drawn up regarding the aforementioned plot. But what will this avail him? Here a little rhyme intervenes, which is to say that however much one seeks to twist the truth, the heart nevertheless seldom lets itself be convinced of lies; in the meantime there is no remedy if one wishes to act unjustly. 384 Relying on your favour, I am engaged in having a sloop built, which I shall certainly send toward you, but that which was sold over there from here in former times yielded an absolute profit, whereas at present on the contrary nothing but loss is incurred, except for this one article, namely salt, of which I buy some annually and can earn a crust of bread. This year even, relying on your benevolence, I have collected a little in order to sell it again, without knowing thus far whether the English will not hinder me, as their tyranny in this matter is at present unheard of. If I then cannot obtain any salt, patience, then the sloop will be dispatched empty to Houglij. If it please you, My Lord, to bring about something to destroy this difficulty, that would be well, as otherwise nothing remains for me but to adapt myself to whatever Your Honour, according to wiser judgement, will find good to command me, as I am bound to submit myself thereto. The agent who is here on behalf of the French Company also has a project for a sloop and trade in salt; my intention is to send mine with that vessel, of which I have the honour to inform you, My Lord. The management of the affairs of the Durbar is presently regulated in this manner: previously there were several merchants and mahajans, or money changers, here, whereas at present nobody is to be found. If there is something to do, there is nobody who, because of the government, wants to trouble himself with trade and the lending of money; and supposing there should happen to be such a person, he does not have the courage in his heart to advance any money, because he would not get it back through the government. Thus it is in all respects with 385 the English that one must address oneself in matters of trade, as they have everything under control and lay down the law to the merchant, and for this reason the affairs that can be conducted with them amicably are the most advantageous; the further circumstances regarding the hope and fear of that nation are known to Your Honour. But to dispute with the British at the government, that is oil on the fire. Everything that is to be settled must come from there, which I have the honour to report for Your Honour's information. The evidence regarding the house and plot of Oederamsaraf, signed by Mr Cartier and other Englishmen as witnesses, I previously had the honour to send to Your Honour, and Your Honour has sent the same back to me, so that it is presently actually in my custody. These past days it was demanded of me by Mr Marriott, with the intimation that the same had been requested by the Lord Governor of My Master the Lord Director, but that My Lord had answered that I had it in hand, and that the Lord Governor had therefore written to his honour to demand the same of me and send it to Calcutta. Making difficulty in doing so, and also having no orders regarding it from Your Honour, I answered that gentleman that I did not have it, but that the paper was with Your Honour. I believe that since some pieces of land belonging to the English and our Company lie mixed together, they are also seeking to usurp this, about which the dispute is. At present the interest of the British predominates, and all people know that this nation uses force; therefore no one dares testify against them, but everyone speaks in their favor. Mr. Marriott has had a declaration prepared and requested from here. That paper circulates concerning the garden of Oederam Saraf, and Your Honour will be able to observe the matter regarding this lot from the transmitted Dutch papers, but I shall inquire into the contents of the declaration. The place where Mr. Marriott has erected a bankshall is separate from Oederam's garden, but the land belongs to the Company. No Englishman has ever laid claim to it or ever had possession of it, but the Dutch pilots built their houses there and made use of it. The signs of those dwellings are still to be seen, but since they were broken up from there, the land has been in the possession of the Dutch Company. All the inhabitants of this place are aware of this, but out of fear they dare not confirm it. E. le Clercq No. 17. 388 Testimony of the truth is required from all inhabitants of Bellasoor who may know anything regarding the case of me, Koenje Beharie Daas, business agent of the Dutch Company, to wit: That a certain piece of land bordering to the east on the house of the late Oederam and to the northeast on the Company's lodge has belonged to the Company and has been in its possession for as long as its lodge has been established here. That recently, through Sheikh Gholam Mohammed Mustafa, servant of the English Translation of Persian Molesereh, official record, drawn up under the seal of the Qazi with the signatures of Monsieur Nesaem een Doen, Kalisjern son of Bleia Noederam, Majes serhenk, Mohammed Hossen Boek, Binos, Ramdeeuw son of the late Oederam, inhabitants of Bellasoor, as witnesses Company, the said lot was handed over to Mohammed Hossen, Mughal merchant, for the erection of a house. 389 That upon my prohibition, the said munshi brought forward that under the administration of Mr. Pledell, or the former English government, this place, having been measured out together with the house of Ramdeeuw, son of Odijra Saraaf, had since passed over to the English Company, and that from that time the duty had been paid by the said Ramdeeuw to the English Company. That since I was not aware of the payment of this duty by the aforesaid Ramdeeuw to the English Company, and this duty was also not customary among the Dutch nor paid to me, I, after having heard this from the aforementioned munshi, summoned him, Ramdeeuw, to me and questioned him about this. That he thereupon added to me that in the time of Father Kees the Pilot, Cornelis van der Claas, he had been somewhat far out of hand, but that at that time the servants of the English had by force measured his dwelling place, which belonged under the Dutch, and in their papers declared it as belonging to the English. That he had made this known to Father Kees, but that the latter, being dangerously ill, was bedridden and thus not disposed to inquire into this case; and that Father Kees, having traded in lime with him, had become displeased with him and had forbidden his coming and going at the lodge, so that he was reduced to the necessity of contributing the aforesaid duty to the English. That subsequently quarrels arose between the English and the Dutch, and Father Kees died, so that the matter remained stalled. Item, that notwithstanding I was appointed since then, he neglected to communicate this to me and also did not know that I would lay claim in this regard again, but that he truly was a subject of the Dutch Company. Item, that the lot upon which Mohammed had recently built also belonged under the Dutch, of which he affirmed he had in his possession the proof handed to him previously by Mr. Coetser, head of the lodge. That having heard this, I made the matter known to my master at Chinsurah, who wrote about it again to the Lord Governor at Calcutta, and that an order was given by this gentleman to Mr. Sparks, who currently holds authority here, to restore the piece of land to me if after an investigation it should appear that it truly belongs to the Company. That after this, Mr. Sparks summoned me to him and questioned me about this, and that I thereupon revealed everything that had happened to His Honour and showed the proofs of Mr. Coetser to the same. No 18 391 To the Honorable William Aldersey On the 14th of the past month, I communicated the receipt of your letter, accompanied by a copy of the complaints of the Gentlemen at Chintsura, on account of my building upon that which they call the Dutch Company ground. While I have had the honor to serve the Noble Company, both under covenants and since I surrendered the same, it is now nearly five and twenty years since I first engaged myself in their service, and strictly speaking, have never since been in any other, it has always been my endeavor to avoid all steps that I thought could give reasonable suspicion to anyone. Enclosed is a declaration signed by the oldest inhabitants here, which clearly shows the manner in which they call the piece of ground on which I have built a shed or Banksall for the people who make my casks. 392 Upon this service, I think it would have been inexcusable in me if I had submitted to the demand of the Dutch Gomasta, approving the same as just, knowing that by such conduct I would surrender the right of the English Company. The people who have signed the enclosed paper are not the only ones who know that the piece of land in dispute has always been recognized to be within the English boundaries; everyone whom I have heard gives the very same account without differing from one another. Several of the Gentlemen who have been chiefs here, whether for their advantage, discretion, or to oblige the Dutch Gentlemen who resided with them, have made some alterations in the boundaries of the two factories. I have therefore enclosed a plan thereof, as good as I have been able to obtain, showing these alterations, and request the liberty to be permitted to inform your Honor of the causes. The probability and equity thereof will be taken into consideration by the President and Council, and by them settled according to what weight they are of. Outside the wall marked A, there were in the time of Mr Cartier several houses of pilots and others, among which was one belonging to Oederam, then the Dutch banyan. The piece of land marked E was a passage from the English factory to the creek side, and a door of the factory was then opened; this was unlocked because the said houses were removed, and a part of the land upon which they stood was taken into the English Factory, which was converted into a garden. The ground marked C, being that which caused the first difference, was given by Mr Cartier to Doctor Marcellius to build upon; that marked D was given by Mr Playdell to Mr Flemming. Everyone acknowledges that before the Munshi Golaam Mustafa 393 Mustafa had charge of Bellasoor, Babatte, which was in 1763, neither the Dutch who resided there, nor the former nor the present Banyans, ever disputed or contradicted the right of the English to the ground on which the house of Ouderam was built. Mr Boddam measured and enclosed it as such; Mr Playdell received dues from it; at that time there was Mr Flemming, who never contradicted it. Mr Burdett and Mr Bristoll, who came after, did the same; there was never any difference before the Munshi and Banyan began, and it was then that the Dutch claim began. All the Herrie houses marked t remain without contradiction to the English; they are fifteen feet from that piece of land which they claim, only a footpath divides it. If the Gentlemen at Chinsura ground their right solely upon the proofs which they have sent us, I must say it appears to me they have proved nothing. The right of Ouderam to the house and garden is beyond doubt; he holds it either from the English or Dutch, neither of them owns the property of the ground, for the Persian document, your Honor will please observe to the President etc., that the names of everyone who signed it who are now here, three being absent, have affixed their signatures as well as the cazi; one clearly states the aforesaid, namely, that the ground in dispute was always held to be English and not Dutch property; and I must further remark that I have reason to suspect that the Dutch Gomasta explained his paper differently from what was written, since Kamidai told me unasked, and so also did Mahomet Hossin, that they had signed a paper of the same contents which the Dutch Gomasta had presented, when he and the Munshi disputed this ground. I requested the Gomasta to see the certificate or writing of security from Mr Cartier, being of opinion that the same would place this matter beyond doubt.

would put in doubt, being, as I suspect, a permit to Mr. Marcelius to be allowed to build there. He said he sent it a month ago to the Governor of Chinsura, but let the writing be what it will, I think that Mr. Cartier could not by his own authority dispose of or manage the Company's lands, or alienate the same, nor would the Dutch accept or request a written permit from him if one were needed at all, the occasion to demand one seems extraordinary, since there was a higher authority as close as Calcutta to apply to. The Gentlemen insist very strongly upon the order of Mr. Vansittart to the Munshi to cease levying tribute on the land, and say that their property was then fully consented to and recognized. I may possibly be mistaken, but I cannot think that it was so intended. It was just at the outbreak of the troubles when this dispute arose; Mr. Vansittart then had matters of much greater consequence to attend to, and upon the representations of Mr. Sparks, who had arrived there first, lived in open enmity with the Munshi, and upon the friendly wording of the Dutch Banyan, whose relation was in his service, and in whom he placed great trust, he consequently believed the latter's account over the former's. Indeed, the Persian writing says that upon this Mr. Sparks called me and inquired into this matter, etc., and accordingly gave his opinion in favor of the Dutch claims; under these circumstances, nothing less than such sentiments were to be expected, but they do not in the least invalidate the original right. That the piece of land upon which Mahomet Hussen built by permission of the Munshi Golaam Mustafa was considered to belong to the English is clearly evident, or he would never have applied to request it where he did. If the Dutch claim had been known to their Gomasta, he would certainly have applied there; he is no newcomer. The circumstances of the land having been considered under constraint, and the reasons that no attention was paid to it then and it went unnoticed for years thereafter, do not mean much. The Dutch are never forgiving on such occasions, nor do they let any unlawful encroachment pass unnoticed. I now have Barrabatte's account, who reports having paid rent for that house from 1754 to 1763. Maaram was the Dutch Banyan before the present one; he gave the same account, and in almost the exact same words when I asked what he knew of the matter. Mr. Summer and Mr. Playdell, having resided here for some time, will likely recall the location and boundary posts of the two factories, and may possibly be aware of some particular circumstances, which my lack of knowledge of the language prevents me from reaching, as well as the fact that many of the old inhabitants have recently passed away who could have helped much to clarify this matter. That just as the villages of Chinsurah, belonging under the district of Arsa; Baranagar belonging under Calcutta; and the bazaar Mirzapur, depending on Buxbunder; have of old been under the obedience of the Dutch Company for the storing of goods from the ships, likewise the gathering of carpenters, smiths, coolies, and other laborers, and for which the established lease is paid yearly; therefore 398 nothing more may be demanded, and the counting of houses and pressing of people and other such things must also be omitted, as they remain henceforth excused therefrom. Banyan would come to me to settle his esteemed accounts with me. The entire matter unfolded in this manner: In the month of March 1764, I engaged this Banyan to purchase 1900 Mos: of salt for me, in order to be sent to Patna. The costs amounted to A„o rop„s 1740. Expenses of the merchandise, vessel hire, and other illicit charges, the said Banyan brought to 1500. Total: Ao Rop„s 3240, which sum, according to his doing, he paid entirely from my money that he had in hand, and yet there remained a balance charged to me of about 40 or 506d=s. All that I did, I could not get to see him, although I even posted people to watch for him at night, to see if I could catch him that way; I was completely exhausted, for within a month my business calls me to Bauleah in the service of Mr. Thomas Forbes. I then requested one Francisco Ribello, writer to the Director at Chinsura, to be willing to take it upon himself, once I had departed, to settle with the fellow, and to investigate the expenses and compare them with other merchants who traded in this branch of commerce, since it was impossible that the same would amount to 90 Per Cent; this was an obvious fraud, so that all doubt in establishing it was removed. Whereupon the Director's Fiscal's Dewan threatened to settle the matter in dispute between me and the Banyan forthwith, when they at last decided and settled that I should pay the Banyan N rop„s 250, and on account of vessel hire 500, making the whole amount 750 arcat rupees, which sum I paid on the 10th of this month in the katsjerry, and requested that they would discharge me from bail and give me liberty to go, in order to recover from the dysentery that I had contracted about 12 days ago. The Dewan said that if I wished to go, I must then sign a paper, which they wrote out in Bengali, stating that I had settled the Banyan's account, and that in the future there would be no further disputes or claims on either side. I answered that as long as I lived, they would not force me to do so. Then the Dewan threatened me that I should go back into the subterranean hole and remain there until I had signed the paper. I was in great perplexity as to what course to take; at last I resolved that I must make myself scarce and depart secretly. I was then in my camisole and cap, and known not even to any of my own people or attendants; I went to Hoeglij, where at two o'clock in the afternoon I took a pansway /:vessel:/ and got away with it to Calcutta, leaving behind everything that belonged to me. Right Honorable Sir and Respectable Councillors, The collective deck officers of the return ships present here respectfully represent that they, the petitioners, having been warned that the Honorable Grand Right-Honorable Lords Directors had seen fit to revoke the license granted to them to purchase themselves, wherever they could obtain them, the goods required for filling their permitted chests, and in place thereof to permit them to fill the same from the Company's cloth warehouse with such goods as were contained in their highly respected orders regarding that matter, had addressed themselves to the Right Honorable Lord Director in order to be able to benefit from that favor. That His Right Honorable having declared to them, the petitioners, that there were no Company goods available with which they could be accommodated, they find themselves in the greatest embarrassment concerning the use of their chests with respect to the great detriment to them, the people, if they must transport the same empty and leave their meager funds lying uninvested without interest. For which reasons they, the petitioners, respectfully turn to Your Right Honorable and Honorable, most humbly pleading that, in order to prevent their loss, they may be permitted to make an open purchase of the goods required for filling their chests. Whereupon the contents thereof were discussed at length, and it was noted that the order of the Lords Majores, by extract from the Fatherland Missive of 21 October 1765, that in case these people wished to fill their permitted chests, they would then have to do so from the Company's warehouse and with patterned cloth, was certainly given in the expectation that the Company would have sufficient in stock to be able to accommodate them therewith; yet, because both with patterned and all other goods, the delivery always proves so meager that it must be considered fortunate if the Company’s own needs are provided for, the same could presently also bear the exception of meeting the petitioners so far as to allow them an open purchase of goods, provided they restrict themselves to patterned cloth, because then in any case the purpose which moved Their Right Honorable to this arrangement—namely to prevent that, concerning the other linens, among the goods of private individuals there should be found such sorts 429 as Their Right Honorable had requested 430 yet not received—would be answered, and no abuses in that regard are to be feared; whereas, on the contrary, the refusal of that request would tend to the considerable prejudice of these people, since they would then take along their funds, which they might otherwise employ with private merchants or foreign nations, and would have to depart with empty chests; and that one also cannot presume that all such persons who are not provided with cash will ever address themselves to the Company, because the surcharges of 22 percent, which must be charged to them both for the advance of the money and the sea risk, and the 15 percent which is ordinarily deducted at the sale, would thereby completely consume the profit that might otherwise be expected; and therefore, for all these reasons, it is decreed by unanimity of votes to grant the request of the petitioners, and thereby to permit the deck officers of the aforementioned return ships for the present to procure their need of patterned cloth elsewhere, nevertheless, and with this restriction, that among these no Sichtermans saijen and sirsiks shall be included, since the Lord Director testified that the Lords Majores, in the requisition of the year 1765, decreed on 12 October 1763, had explicitly complained that what the seafarers had brought along of this sort of goods had sold far more favorably than that of the Company. And in order that this shall not run contrary to the intention of the assembly, it was further resolved to notify the commissioners for the branding of the permitted chests of this resolution by an extract from the minutes, in order that they regulate themselves accordingly at the branding of the chests of the deck officers of the return ships currently departing in coming January. At the muster of this vessel, we found only two absentees; and in place of the Quartermaster Godfried Heuvenaar, who has been transferred to Ysselmonde, the sailor Sweeris Huijsers was appointed, subject to Your Noble Grand Honors' approval, as Quartermaster at 14 guilders per month; and, on account of indisposition, Quartermaster Johannes Tuijt was sent to the hospital.
