650 To the Honorable, Respected Sir George Louis Vernet, Director of the Bengal Directorate, together with the Members of the Political Council of this Office. Honorable, Respected Sir and Esteemed Councilors. The undersigned Pay Bookkeeper, having been handed the extract of the Homeland Pay Memorandum dated Amsterdam, the 10th of September 1767, attached hereto in copy and received directly from the Netherlands, in which some information is required from here concerning the following persons, has the honor to report in that regard: That Johan Joost Saul of Altenbauwen still continues in this directorate as a burgher. That Ernst Striets of Hamburg, although having arrived per the Huis te Manpad in the year 1760 according to the muster roll of that vessel kept here, it does not appear therefrom, nor from other pay papers, whether he was placed on one of the return ships or on other ships, so that one has reason to maintain that he will have absented himself from the Honorable Company, all the more because the pay bookkeeper at that time, apparently out of ignorance, for that reason gave him no entry in the pay books of the year 1763/1764. That Jan Cornelisse of Amsterdam, according to the muster roll of the Vrouwe Elisabet Dorothea dated the 7th of February 1760, departed with that vessel for Batavia. That Jaques Riviere of Straatsburg, already during his lifetime, pursuant to the disposition of the Respected Council of Justice of this Office dated the 26th of June 1762 and the minute of the 3rd of July following, both annexed hereto in authentic copy, had an attachment placed on half of his pay on behalf of the estate of the late Junior Merchant Trembley, and that at his decease he had earned and maintained to his credit in the pay books an amount of f 263, which monies were received from the Honorable Company's treasury by the sequestrator on a warrant from the Honorable, Respected Sir Director on behalf of the estate of the said Tremblay, which the sequestrator subsequently, as well as the estate of the aforesaid Riviere, properly accounted for in the pay books of the year 1765/1766, and paid the remainder of the estate of Trembley into the Company's treasury, according to estate accounts, inventories, and further papers relative thereto, which were sent as annexes to the aforesaid books according to order and custom, and are thus to be found therewith. And That the estate of Jeremias Jan Kingma was also properly accounted for by the sequestrator according to the tenor of the frequently mentioned pay books of the year 1765/1766, and the order in that regard was observed in all respects, except that the native creditors here, on the basis of the resolution passed in the Political Council of this Office under date of the 21st of July 1761 upon a petition submitted by the sequestrator (this in extract attached), obtained their payment pro rato under security de restituendo. Your Honors' very humble servant Jacob Eijlbracht, as sequestrator administering the insolvent estate of the Junior Merchant Jean Jacques Baptiste Trembley, makes known with the deepest respect that he, petitioner in his capacity, as appears from this annexed appointment of Your Honors dated the 12th of this month, has obtained against the bookkeeper and provisional first unpacker in the cloth hall, Jacques Riviere, a condemnation to the payment of three hundred and sixty Arcot rupees, with the interest of three-quarters of a percent per month since the 27th of September 1760 until the actual payment, which the said Riviere properly owes to the estate, but that he, petitioner, upon both his friendly and judicial admonitions, has not been able to obtain more than two hundred rupees of the principal. Therefore, since the petitioner in his capacity sees no chance of obtaining it, considering the debtor is devoid of means and burdened with considerably more debts, and it is nevertheless highly necessary for the estate to take everything that one can, so to speak, only get, he very humbly requests an attachment on half of the gratuity that, according to the Homeland Extract Dispatch of the 17th of October 1754, was granted to the servants of the cloth hall on the trade of linens, and has not yet been paid out to Riviere.

have positively ordered that henceforth all insolvent estates of Company servants shall be sent over to the Netherlands and settled there, which order, however, does not well appear to have place here in this country in case there are native creditors among them, because those people, being ignorant of our laws in case of insolvency, have no conception of any preference, nor know of any other satisfactions than pro rata distributions, and also have no one whom they could appoint in Europe to look after their interests; and therefore, if one wished to carry out the aforesaid order here in this country and remit the estates to Europe, they would complain most vehemently about injustice and would then address the Moorish Government, which would therefore find no hesitation in immediately prohibiting such, and in any case compelling the Company to satisfy 657. all such complaining creditors, as wishing to acknowledge no other laws besides those of Indostan, whereby the Company would be exposed to many vexations and harassments, and would even run great danger of ultimately having to pay its servants' debts; and that one therefore in such a case may indeed, or rather must, depart from the aforesaid orders from the Fatherland, however positively the same may have been given, the more so since the Lords Principals, out of similar considerations, were pleased by letter of 17 7ber 1737 to grant authorization, in case the Bengali creditors, when they cannot recover their arrears from the estate of the Company's servants, should attack the Company itself, to be permitted to depart to that extent from the general order, and in that case to prefer them before the European creditors; and therefore it has been approved and agreed to authorize the said sequestrators, after all known and unknown collated: D Franke creditors of the aforesaid estate shall have first submitted their claims, for which they shall be properly summoned, to draw up a pro rata distribution of the proceeds of the said estate and thereafter to pay off the native creditors under obligation of restitution in case any unknown creditors should subsequently appear, but to send whatever shall remain after their payment to the Netherlands for the benefit of those entitled thereto, as well as to act henceforth on this same footing in all similar cases. /:below was written:/ Agrees with the Resolution Hoegli the 29 9ber 1768. /:was signed:/ Iacob.
