large sum out of compassion for the orphans of the deceased, but that they were aware that the same was unjust and made this waiver in order to cloak their other claims; these appellees cannot admit that the appellants' present claim is right and just, for it lacks the slightest shadow or glimmer of justice; for all the reasons set down herein, and for the reasons stated by these appellees in their case before the honorable Court of Justice, and because the appellants have failed to support their claim, these appellees very humbly request that the aforesaid judgment of the honorable Court of Justice may be ratified and confirmed by this honorable Court, and furthermore that the appellants may be assessed with added costs for their vexatiousness, with such further relief and permission as this honorable Court shall see fit to grant. The answer of the Reverend John Philip Fabricius, Missionary of Vepery, and John Calland late of Madras merchant, Executors to the Estate and Effects of Charles Lewis Hagemeister deceased, late Junior Merchant in the service of the East India Company of Holland, appellees, to the petition of appeal of the said East India Company of Holland, by their agent Daniel Bartholomeus Truter, appellants. These appellees do admit, that the appellants filed their bill of complaint by their agent the said Daniel Bartholomeus Truter, in the honorable the Mayor's Court against these appellees, on or about the twenty-seventh day of April, which was in the year one thousand seven hundred and sixty-two, for the amount of thirteen thousand two hundred and fifty pagodas as Executors to the Estate and Effects of the said Charles Lewis Hagemeister deceased. These appellees do admit the appellants have set forth the proceedings had in the said honorable the Mayor's Court, but as the said appellants have been pleased to relate the same in some parts different from the proceedings, these appellees do conceive it necessary to recite so much of the matter, as to put it in that true light in which the said honorable the Mayor's Court hath judged it, by their impartial decree. And these appellees further say that they have examined the books of the said deceased Charles Lewis Hagemeister and cannot find the said Estate to be any way indebted to the said appellants the sum of eight thousand seven hundred and thirty-two florins eight stivers and eight pence, for sundry articles of provisions purchased for the use of the garrison of Bimilipatnam. These appellees do object to this article, as they conceive the same evidently appears to be purchased by the order of the Chief of that settlement, and who is to be answerable to the appellants for such an overcharge, and not the deceased's Estate; and the sum of two thousand eight hundred and eighty-five florins seven stivers and eight pence, said to be by the appellants for a deficiency of seven thousand five hundred and eighty-one and a half pounds of Tesseral cotton: these appellees do object to this article, as the same were used as bulwarks for the walls and batteries of the said garrison of Bimilipatnam at the time of the blockade of that settlement, and by the special order of the Chief, and doubtless to save the appellants a much greater loss, which these appellees conceive doth justify the deceased's conduct and indemnify his Estate from the demand made by the appellants for the same, as what the deceased did was for the good of the service and by the Chief's order. The sum of twenty-seven thousand and eighty-three florins and nineteen stivers, for cotton alleged by the appellants to be damaged through the negligence of the deceased: these appellees have and do deny that this loss was owing to the remissness of the deceased, but say it must be attributed to the want of more commodious places than straw houses to put or keep such a valuable and perishable commodity in, which is liable to damage on the least wet getting to it. Besides, the said cotton might have laid many years in the said straw houses, or have been damaged before the deceased came to Bimilipatnam, and it is probable it might have gotten damaged during the blockade. of more proper repositories than straw houses, or in the Boekade, and which loss these appellees presume the appellants must bear, as it doth not appear that the said cotton was damaged through any fault or negligence of the deceased; the sum of twenty thousand two hundred and thirty one Florins five stivers and eight pence, for a third part of the appellants with submission conceive, as this is an extraordinary charge to demand from the said deceased's estates, debts he never contracted, and which might probably have been entered into many years before the deceased came to that settlement, and which doth demonstratively show the illegality of the appellants' demand. These appellees having finished the recital of such matter in their answer, as they with submission conceive is pertinent to their case and as succinctly as possible. These appellees admit that the appellants put in a replication to their answer, confirming their bill of complaint, and these appellees admit they filed a rejoinder to the same, and that issue was joined and all the other necessary proceedings had therein, until the same came to a hearing, and that the honorable the said Mayor's Court were pleased at the hearing of the cause to dismiss the appellants' bill with costs, and which equitable decree of the honorable the Mayor's Court, these appellees hope, will be confirmed by this honorable Court, as their judgment was formed from a diligent attention to the whole regular process, besides the deceased's discharge from the appellants' service, and these appellees presume the exhibits produced by the appellants are of no efficacy, as they are only extracts from their own proceedings, and therefore cannot be admitted as evidences in their own cause, nor can the attestation of their secretary add any validity to them as he was never sworn before a person disinterested in the cause, and properly authorized to administer an oath to him; These appellees cannot admit that the appellants have made it appear, that the said deceased Charles Louis Hagemeister hath made any overcharge in the article and provisions for the garrison of Bimblipatnam, nor do they see any just reason for such a demand; these appellees hope that the resolution of the appellants and their president and council of affairs on the coast of Coromandel will not sway this honorable court in an affair, that hath not altogether the appearance of truth or equity, and therefore it is presumed that it will not have the approbation of this honorable court. These appellees presume the honor and credit of the appellants in this matter is not to be considered as equity hath the preeminence of them. These appellees cannot admit that the appellants had no by-ends in view; if this was true, how came they to relinquish such a great part of their demand at the hearing of the cause? This question these appellees have here taken the liberty to answer: it was not out of lenity to the orphans that induced them to make these relinquishments, but as the same were unreasonable and too obvious, and to give a sanction of equity to their other demands. These appellees cannot admit that the appellants' said overcharge of provisions is founded on motives of justice; surely it cannot be deemed an act of justice and lenity to sue the estate of the deceased, and beggar his orphans for a fictitious debt, and which is not supported by one single evidence, and for which reason the decree of the said the honorable the Mayor's Court, specially respecting to the fallacious demand of an overcharge in the provisions, is given on solid and mature consideration, and which decree these appellees hope will be confirmed by this honorable court, as no error in judgment doth appear by any arguments of the appellants. These appellees further conceive that the appellants' honor and credit was not to be as judgment of the honorable the Mayor's Court; these appellees cannot admit that the deficiency or loss of the cotton is proved to all intents and purposes, as these appellees never acknowledged the said loss to be owing to the remissness of the deceased, and which matter is truly related, for in fact, the same were really used as bulwarks for the walls and batteries of the garrison of Bimilipatnam and by the special order of the chief of that settlement as before said. Besides, the appellants had only straw houses for the reception of this valuable and perishable commodity, and these appellees further conceive, as these appellees have denied that the loss was owing to the negligence of the said deceased, it was the indispensable and necessary business of the appellants to prove it was owing to the deceased's remissness that this loss did accrue or proceed from, and which if it had been true it is presumed they would have done. they say that their using the said cotton as bulwarks for the walls and batteries of the said garrison of Bimilipatnam was highly necessary for the defence of that settlement at the time of the investment, and to save the appellants a much greater loss, and as it was done for the good of the service and by the special order of the chief of Bimilipatnam the appellants must bear it, and not the deceased's estate as aforesaid, these appellees further say they are extremely sorry the appellants are so suspicious and have so mean an opinion of their own servants in alleging they have relied upon the deceased's words too much, else they did not know what a great quantity of cotton there was or ought to be, this is repugnant to reason, to imagine that gentlemen who were sent to survey or inspect into the stores to be delivered over by the said deceased should sign to a notorious falsity or palliate the affair by a favourable representation when it were their interest to discover the deceased's fault to the appellants, and it is probable one of them was appointed successor to the deceased's employment, these appellees do conceive that the declaration of the surveyors is of sufficient force, and of such validity, as to indemnify the said deceased's estate from any demands of the appellants on that head, these 650 these appellees say they cannot admit that the appellants have relinquished so great a part of their debt out of compassion to the deceased's orphans, but as they were conscious the same were very unreasonable, and to palliate their other demands they made these relinquishments, these appellees say they cannot admit that the appellants' present demand is just and equitable, for the same hath not the least shadow or glimpse of equity, for all the reasons herein set forth, and for the reasons given by these appellees in their proceedings had in the honourable the Mayor's Court, and because the appellants have failed in supporting their demand, these appellees do humbly pray that the said decree of the honourable the Mayor's Court may be ratified and confirmed by this honourable court, and further that the appellants may be taxed with additional costs for their litigiousness with such further and general relief in the premises as to this honourable court shall seem meet, was signed William van Well, attorney for the appellees. Right Honourable Sir and Sirs, Copies of the petition of appeal, and the reply thereto dedicated to the Governor and Council there, in the case between the Dutch Company and the executors of the estate of the deceased junior merchant Hagemeister, having been forwarded to us by the attorney-at-law at Madraspatnam, we therefore have the honour to present those writings as such, with a copy of their accompanying letter herewith in all deference to Your Right Honour's attention. From the said attorney we have, upon our express demand in accordance with Your Right Honour's honoured intention and desire, furthermore also received such a letter, a copy whereof with a translation thereof we nevertheless also take the liberty to respectfully offer enclosed herein to Your Right Honour, containing the following information, namely: that the time permitted, in case of any decision by the Court of Appeal, to appeal to England, is one month from the day on which that decision was made; that in case of such an appeal, it will be necessary to provide security No. 54 to provide security for the interest and costs that might run on account of such an appeal; that this suretyship must be furnished by persons of means on behalf of the Company before one of the judges of the court, and completed with the clerk of appeals here; that the expenses of that appeal will be considerable, and to plead the case on behalf of the Company it will also be necessary to appoint someone in London, to whom such papers as might be necessary for that purpose must be sent; and that current money will also be necessary to conduct the case there. We therefore remain awaiting Your Right Honour's esteemed instructions on this matter, so that, having dutifully observed and considered the same, we may satisfy them. No 58 657 6 Extract from the Resolution Taken in the Council of Coromandel at Nagapatnam on Friday the 1st of September 1769 Pursuant to the orders sent from here to Pallicat by letter of 29 June, in conformity with what was decided at the session of the 26th preceding, the chiefs there communicated by their letter of 25 August last that the Court of Appeal at Madras, being the Governor and Council, to which an appeal had been made from the judgment pronounced by the Mayor's Court of Justice in the lawsuit of the Honorable Company against the testamentary executors of the estate of the deceased Junior Merchant and former former Secunde of Bimilipatnam Carel Lodewijk Hagemeister, having confirmed it, thus the Honorable Company had also lost there, the said chiefs therefore requesting orders on how they should further conduct themselves in this regard, since it was now up to the Honorable Company either to abide by those decrees and pay all the costs incurred by the executors, or to appeal to England, for which, as stated, and mentioned in the aforesaid Resolution of this table of 26 June as well as in the chiefs' letter of 27 May, one had a month's time, and that if it suited the interest of the Honorable Company, security had to be posted for the interest and the costs in case the appeal should fail, and that said surety would have to be provided by wealthy persons, on behalf of the Honorable Company, before one of the judges of the Court; furthermore that the costs of that appeal would be considerable, and in order to prosecute the case it was also necessary to appoint someone in London to whom 658 the necessary papers had to be sent, along with the required remittances of money for the expenses; and to that end the attorney John Sykes had requested to be provided with the necessary instructions and some cash for the continuation of that matter, but if one did not incline toward that appeal, it would then require providing him with remittances for the settlement of the expenses which the Honorable Company still owed, amounting to a few fanams less than sixteen pagodas, as well as the costs on the side of the executors, the total of which the attorney had not yet been able to state; wherefore this was taken into deliberation, being on the basis of what was remarked and the motives alleged therewith in the Resolution of 28 March of this year, and what was written by their High Mightinesses the Honorable High Indian Government at Batavia in their most esteemed letter of 31 May 1763, especially concerning the poor institution and grounding regarding some of the articles included under the claim, and for that reason already causing apprehension of an unfavorable outcome of that lawsuit for the Honorable Company, and thus could give cause to desist from prosecuting that matter in Europe, as has now indeed become apparent: And since there are many reasons that may be firmly established that if the case were appealed to England, the judgment will be confirmed, to the greater detriment of the Honorable Company, and thus good money would be thrown after bad, it was approved and agreed to desist from all further prosecutions, thus leaving the matter at rest, as well as to inform Their High Mightinesses of this; it being furthermore agreed to write to the aforesaid chiefs of Pulicat that, since the legal costs paid on the side of the executors will in all probability be substantial, one would therefore wish to see the itemized account thereof before the restitution takes place, with authorization to let the attorney have the remaining expenses of the Honorable Company, which according to his statement will still amount to about 16 pagodas. Right Honourable, Valiant Sir, Pursuant to Your Right Honourable Valiance's orders, in order to respond to the question raised by the Lords Principals that the alleged brittleness of the European gold seemed somewhat strange due to differing reports, on which account the reasons had to be given why the gold shipped from Europe was less suitable for minting pagodas that are presently being minted than for those which were struck previously, it serves to state that it is to be understood in no other way than that when the assay was reduced from 19 carats 2 2/5 grains to 18 carats 5½ grains, one had to use more copper or alloy for this reduction for this reason, and that it was difficult for the minters to mint or stamp the pagodas, as several cracked under the dies; also, the minters repeatedly came with complaints that they suffered losses on the minting, which did not occur in former years because Indian gold was brought in then, with which the European gold was mixed, whereas on the contrary the small amount that arrives now is indeed needed for the indispensable three-figured pagodas; for which reasons and to prevent complaints from Your Right Honourable Valiance, it was requested to be allowed to use mattam of 2½ pennyweights for alloy, which was done solely in order to make the Honourable Company's pagodas circulate undamaged and in good condition 667 without any hindrance; wherewith I hope to have complied with Your Right Honourable Valiance's command, and so I take the honour, with much respect, to subscribe, below stood, Right Honourable, Valiant Sir, Your Right Honourable Valiance's humble and obedient servant, was signed, C:s Pietersz:, in the margin, Nagapatnam, the 12th of September Anno 1769. 18 October On 20 February from Malacca a sloop arrived named Seda Sinang, belonging to the Moor Moetoe Mara Chitti, laden with powdered sugar, arrack, and rattan, and on 17 April departed again to the north. 12 April arrived here in the roads a two-masted French ship named Jeron Sundelff from Bengal, bringing wheat, commanded by Captain Johan Arispon, and on the 18th of this month departed again to the north.
