3 December 1772. It was resolved to persist in the resolution of the first of this month. plead in judgment, whether this procedure could in any respect be made excusable, by their pretext, as if among the goods of the Broker, whose arrest vilely violated the right of a free Nation to the utmost, some others had been hidden, of people who did not directly fall under the protection of the Honorable Company; since in such a case, the aforementioned British would have been obliged to reclaim those goods in a proper manner, whereupon they would have been returned to them upon finding of the truth, without it being permitted to them to bombard the Lodge, to occupy it, to inspect it, and finally to plunder the goods therein, upon pure conjectures that among them there might be goods of the Nabob or others, which they had never reclaimed and consequently could not have been refused to them; while both from the declaration of the Factors and from the Broker it was evident that no goods of the Nabob were in the Lodge. Thus it was thought fit to persist in all parts with the resolution of the 1st of this month, and 3 December 1772. and to dispatch the protest noted there, and now further corrected. And consequently to order the Broach Factors repeatedly this very day to dispatch at once in writing the protest noted in the aforementioned resolution, without letting themselves be held up any longer by any negotiations or promises, which we indeed see with these gentlemen are lighter than smoke itself; to which end they will be sent again the draft further corrected by the Director, with orders to amend the same according to the opportunity of the time and what has occurred since, and especially to take care that the mistreatment of the Broker Gokeldas, and the shooting to death of the two Sepoys on the 15th of November on the occasion of them conveying a letter to the English camp, be made known according to truth; since the Meeting has reflected not without displeasure that, as appears from the resolution of the 26th of November, in the Daily Register sent over by the Factors their death is recounted, whereas the last received letter from the same servants indicates that they were merely shot at, which would denote no small carelessness, were it not in some measure made excusable by the numerous difficulties they have had to undergo. 3 December 1772. The said servants further indicating that it appears not improbable to them that the Broker, contrary to their given orders, had secretly brought some goods into the Lodge, belonging to this or that one of his good friends outside the protection of the Honorable Company, among his own, in order to be protected there from the plundering of the soldiers, and of which they have always remained ignorant until now; if he cannot even now bring this against the English to color their acts of violence therewith, to take the Broker immediately into arrest upon his arrival here, in order to discover the truth of everything the better from him. 397 The 8th December 1772 robbed the Brother of the Broker of his Turban and Cummerbund, as also the Two other Sepoys, thereafter drove us away and shot at us, Killing the two Sepoys who had gone with us. All of which we declare to have thus happened, being prepared if necessary to confirm the same with an Oath. Thus attested in the Dutch Factory BrootChia the 5th December Anno 1772 /:was subscribed: was signed:/ Moesafferchan Doewanjie and Mhamet Azem /:in the middle:/ /:was signed:/ Egidius Meijer — We the undersigned declare each in particular and together, at the requisition of the junior merchant and head of this Factory Cornelis van Citters Aarnoutszon and the Bookkeeper and second Egidius Meijer, as well as out of love of the truth to be true and truthful, how the English Troops, when the same on the 18th of the past month November in the afternoon at about 10 o'clock had taken the city by storm, marched past the Dutch Lodge, shot heavily with their small arms at the same, the said requisitioners being forced a short time thereafter, for the preservation of their lives and those of us all, to open the gate of the Lodge, the same then being entirely filled with their troops, who treated them very brutally amidst a multitude of abusive words, another Party coming again in the evening towards eight o'clock, who searched the Lodge from bottom to top, and left a guard there, with the explicit order to let no one whosoever out of the Lodge; further we have seen that on the 27th Messrs. Marlij and Machenzij came into the Lodge, and broke open the Warehouses by force and searched the goods, sealing three of the Warehouses which were Company's Goods, those of its subordinates, as well as [illegible] funds, and left sentries before the same to guard them, taking the brother of the Company's Broker with them to the Durbar, and set another guard in the lodge, who was commanded to let no one go in or out of the same without first being searched; further that on the 29th the said gentlemen came again and took a multitude of goods out of one of the Warehouses, which we heard the broker say were his, and had them brought to the Durbar; and finally that we also 398 The 8 December 1772. Production of a Declaration concerning the unserviceability of 4 pieces of studding-sail booms and a jibboom heard that the head mentioned in the beginning of this repeatedly ordered the aforesaid Broker not to store any goods, of whomever it might be, other than his and the further subordinates of the Company in the Lodge, that the said Broker promised to comply therewith, and when he had brought the goods in there, he said that they were all his, and there was nothing in them but clothes, books, and coppersmith works. Ending herewith this our attestation under Declaration of containing the pure and upright truth, and therefore always being prepared to confirm the same further under Oath. We the undersigned officers of the Company's ship Welvaaren, Declare at the Requisition of the master of the aforementioned vessel Arij Franzz. that during the voyage from Batavia to Souratta have carried away overboard, namely 2 pieces of Studding-sail booms, and another 2 ditto which are entirely rotten and unserviceable, as well as the jibboom which is cracked in 3 places and also unserviceable.
