283 and at the same time to the first undersigned a patent from the President and Council of Bombay, dated the 8th of March 1769, by virtue of which he was, in the name of the Noble English Company, appointed Captain of one of the infantry companies of the said place, serving for the guarantee and defense of the Castle and Island of Bombay, belonging to His Majesty, as well as of all the establishments or factories subordinate thereto, proof that he was never in the service of the Mughal, as he also declared that he had never resided in the Castle, much less fled from it, but from a house rented by him in the city. And being now informed by your letter that the said John Chambers was allegedly employed in the defense of the Castle, by virtue of which you wish to inform us that we would be incompetent to grant the said protection, we do not wish to deny that the possession of the Castle gives you a great share in the direction of this city, but we can in no way concede how this possession could cause the servants and soldiers of the English Company, whom your President and Council at Bombay see fit to send to perform their service in the Castle of Surat, to cease to be subjects of His Majesty the King of England; whereas it is equally certain that no soldier can be said to have changed sovereigns because he happens to be placed by his superiors for an interval in this or any other garrison, or indeed that all military men remain equally subject to their sovereigns even if they were lent for some time to some other power, without our needing to refer in this matter to our farmans. For, notwithstanding that they could decide nothing in a purely national dispute, namely whether we could grant to a British subject in service at Surat the protection of the States of the United Provinces, the latest farman nonetheless dates from the year 1729, a time at which the Mughal certainly could not yet presume that the Noble English Company would, by force of arms 30 years later, make themselves masters of the Castle at Surat. However that may be, Gentlemen, regarding this dispute which you currently maintain according to your interests, and however certain we are that the impartial world will justify our position, we cherish altogether too much the good harmony that currently exists not to testify that we would not have granted any protection to this person 284 Surat, this 24th of August 1776. in case you had previously informed us that he had fled, and you had solicited us not to protect him, although he absented himself shortly thereafter from our wharf, and we consequently find ourselves unable to comply with your instance. In reply to your letter of the 23rd of August, we had already prepared on the 24th following the answer which we have the honor herewith to convey to you, and which contains our true sentiments regarding the protection granted to Mr. John Chambers. And since the translating of such letters, as well as the duplicate copying, usually takes up much time, we have in the meantime, while this was being carried out, caused your Honors to be informed yesterday morning by a deputation To the Right Honorable Mr. Robert Gambier, Esquire, Presiding at the head of the Council for all the affairs of the Noble English Company, and Governor of the Mughal's Castle and Fleet of Surat. Your Honors, Gentlemen, have therefore very badly understood our meaning when you considered this declaration of ours, which had only the preservation of good harmony as its objective, to arise from a conviction of the impropriety of granting protection (of which expression your Honors make use in your last letter of the 24th of this month) to Mr. John Chambers, whom your Honors there call an officer in the service of the Mughal, whereas your Honors previously described him as employed by your Honors in the defense of the Castle; since we have never intended, by such a friendly declaration, to call into question in any respect the right which the Republic of the United Netherlands has, alongside all sovereigns, to grant its protection to the subjects of other powers, or in any way to concede that we had stepped beyond the rules of that right when we granted the protection of the Netherlands State to Mr. John Chambers, a born subject of Great Britain, and who demonstrated by his commission to be an officer in the service of the Noble English Company for the defense of His Britannic Majesty's Castle and Island of Bombay, as well as all establishments or factories subordinate thereto. would be, to grant any protection to those whom the English Company, as occupiers of the Castle, employs for the defense thereof, and that your Honors' greater power seems able to maintain this sentiment, continually threatening us with it, this is yet a sentiment that will never be acknowledged by any impartial person, and we think that what was advanced in that regard in our letter of the 24th is sufficient; however, Gentlemen, even if we were to agree for a moment that the Surat Castle was now an exception to the General Rule, as it indeed never was, when many still well remember that we formerly maintained your Honors against the power of that very Castle and granted the protection of the Netherlands Company to some of its servants, in what manner is it indeed possible for us to guess who is employed for the defense of that Castle and who is not, if your Honors do not inform us thereof immediately upon the flight of someone from that Castle; We believed we had to say this in our defense, and for the rest shall also gladly endeavor to avoid all that could disturb the good harmony, and with these sentiments also quietly await such measures as your Honors might take. You have therefore, Gentlemen, misinterpreted our intention when you considered the said declaration, which had no other purpose than the maintenance of good harmony, as proceeding from the conviction regarding the impropriety of granting protection—an expression you were pleased to use in your last letter of the 24th current—to Mr. Jan Chambers, whom you name there as an officer in the service of the Mughal, whereas you previously described him as employed by you in the defense of the Castle; because we have never intended to call into the slightest doubt the right which the Republic of the United Provinces has, as does every sovereign, to grant its protection to the subjects of other powers, nor in any way to avow that we departed from the rules of this same right when we granted the protection of the State of the Netherlands to Mr. Jan Chambers, a native subject of Great Britain, who moreover proved by his commission to be an officer in the service of the noble English Company for the defense of Bombay Castle and Island of His Majesty the King of Great Britain, as well as for that of all other establishments and factories subordinate thereto. 289 Surat 25 August 1774 Even if we were to admit for a moment that the Castle of Surat is an exception to the general rule, which has never been the case since many people still recall that we previously maintained and granted the protection of the Company of the Netherlands to several of your gentlemen against the forces of this very Castle of which you are now the masters, how then is it possible for us to guess who is or is not employed for the defense of this same Castle, if you do not inform us ipso facto when someone flees from there? We felt obliged to allege this for our defense, and we shall furthermore endeavor, equally with you, to avoid anything that could ruin our good harmony, and with this sentiment we shall always await in tranquility whatever measures you may be pleased to take. The 4th of January Anno 1774. The 4th of January Anno 1774. Two vessels are planned for Brootchia. After this, the Lord Director made known the request of the suppliers for vessels to collect some linens lying ready at Brootchia, whereupon it was agreed to comply with that request, and to plan for that voyage the smalschip De Jonge Petrus, together with the open horri De Merwe, as well as to have the aforementioned gifts, along with the annual writing materials and medicines, conveyed over at the same time. Next, the Lord Director informed the assembly that, although His Honour had been in negotiations with the Company's brokers from the very beginning when the Company's ships Beemsterswelvaaren and Westerveld arrived at this roadstead regarding the sale of the cargoes brought by the aforementioned vessels, they had nevertheless delayed for a long time in making an acceptable bid. They alleged, with regard to the sugar, that on account of the very considerable supply brought both here and to Bombay by private English ships, it had fallen greatly in price and there was no prospect of any increase at hand; and in respect of the Japanese copper, that the heavy import of Swedish copper from England made it difficult, and with the prices paid for it, it could offer no favorable prospect; while regarding the purchase of the spices, they had declared they wished to remain exempted, both on account of the large remainder still residing in the warehouses and because of the well-known low demand for those articles, which could forecast nothing for them but loss and disadvantage. However, seeing at last that His Honour had also entered into negotiations with various other merchants of this city, and fearful that through the threat made by His Honour—as if he intended to have notices posted and sell the goods to the highest bidder—they might find themselves excluded from the purchase, which would not a little harm their honor and credit, they had yielded and made the following bid for the remainder of the merchandise of 1772/3: The camphor, the maund: Rops 65: — : — The quicksilver, the maund: 160: — : — And for the latest arrival: The spices, the previous year's prices. Although His Honour declared he could not refrain from making known his apprehension that all delays could not but be disadvantageous, considering firstly that a ship from China as well as another two to three with sugar from Batavia are still expected, whereby a price reduction is certainly to be feared; and secondly, that not only for that reason it must be disadvantageous, but also that the brokers would then neither wish nor be able to hold to the bid they have now made, because they still have the opportunity to dispatch a considerable quantity of this merchandise, whereas a longer delay would put them out of condition to do so. All the members, likewise judging the aforementioned prices to be very acceptable and the reasons of the Lord Director indisputable, therefore unanimously voted for the sale in the manner prescribed above. However, before proceeding formally, it was deemed good to summon the brokers into the assembly in order to test whether they might still be persuaded to some increase. While they did not doubt that this would have to be fully acknowledged by the Governor and the entire assembly, when taking into consideration that not a single merchant in the entire city could be found who would be able to match, let alone exceed, their offer without his total ruin. And since everyone was completely convinced of what was posited by them, and thus in no way any increase was to be hoped for, it was approved and understood that the adjacent merchandise, being the spices, the Japan copper, the tortoiseshell, and the powdered and candy sugar, were to be relinquished at the aforementioned offered prices; though for the aforementioned reasons, the camphor, the quicksilver, and the vermilion were to remain unsold and kept in the warehouses until further orders from Their High Mightinesses.
