123 Masters have deigned to order us to state what the reasons may be that make the annual re-laying of the roof tiles necessary; and whether, by coating them, these expenses could not be saved, after which we shall have the honor of waiting upon Your High Excellencies more closely concerning this point, being only able to report to Your High Excellencies that this is likewise a custom throughout all Surat, even among the lowest classes of people: Concerning now the renewal of the stone staircase, and the palisade to the length of 325 feet, both outside and in front of the north-east mole of the Company's wharf, we request Your High Excellencies, in highest elucidation, to be informed that before the same wharf was provided with a heavy stone wall on the side of the river, and without which it would have been swallowed up many years ago by the force of the monsoon; there was situated adjacent to it a water staircase, which was common to all people, and was used by the heathens and Moors as a washing place and for the practice of their religion; and that when the government finally, and after many repeated instances, was induced in Anno 1753 to grant its consent to enclose the aforesaid wharf with a stone wall as written above 124 and thereby protect it from a complete washing away, it could not be moved thereto under any other condition than that the aforementioned staircase should be relocated at the Company's expense and henceforth be kept in a good state; on the north-east side of the said wharf, against the outer or small mole, as it was then constructed there to the satisfaction of the government, being above the ordinary water: [illegible] stairs, or 30 steps high; Meanwhile, this staircase, because the currents dragged away more and more of the ground on this side and shifted practically the entire riverbed, indeed undermined a part of the castle, the repair of which has cost the English considerable sums, and thereby also swallowed up; the ground of a small house that had been purchased for the Noble Company in Anno 1767 by the late Councillor Extraordinary of the Indies Senff (His Honor) as appears from the entry in the resolution of the 29th of September of the same year, for a secret purpose, and indeed principally, as we trust, to prevent thereby the numerous disputes between the English and our soldiers, as well as the numerous desertions, as this small house had previously served as a low tavern, gradually undermined without the depth of the river allowing us to notice the same sooner than when it subsided 2 years ago, when, through 125 the use of divers, we were informed that not only was this staircase completely hollowed out from below, but that in addition, the current had already penetrated so far under the large mole on this side, upon which the house of the second stands, that one could easily navigate beneath it with a small boat, and thus ran a very great danger of collapsing within a short time; this compelled us to consult with the engineer on this matter, who formed the plan thereof that we had the honor to offer Your High Excellencies by our letter of the 19th of April 1772, along with an annexed new calculation. While we were awaiting Your High Excellencies' orders regarding this, we had taken all possible precautions to preserve this staircase from further subsidence, yet an extraordinarily high discharge of water brought about not only that it subsided completely, but also simultaneously took away the entire road on the north-east side up to the front of the gate of our wharf; at the same time carving out such a depth on the side and along this staircase, that the engineer had to change the plan, since building a wall after one would first have had to dam off an entire stretch along the river and subsequently pump it dry, would have cost infinitely greater sums, and thus wishing then to proceed with the renewal of the stone staircase merely by placing a palisade 126 in front of it, in order to protect it from further subsidence, such was hindered by the Nawab, and this ruler added to all his gathered demands of the 11th of February 1773, inserted in our resolution of the 24th of the same month, this further outrageous accusation: that we had purchased the aforesaid small house and had secretly caused the ground thereof to be dug away, in order to obstruct this road or passage, subsequently demanding to restore the same to its former state, and which demand also brought about that we, in order to remove all trouble, had to resolve, after we had first obtained permission from the English and subsequently also from the Nawab, as appears from our resolutions of the 15th and 23rd of July 1773: to have the palisade built nearly to the height of the former passage, having the same sloped and filled up to fully 269,500 square feet, as well as renewing the stone staircase: And all these adversities, added to yet another, namely that when we were in the middle of the work and before one had yet had time to bring the current beams and piles properly into alignment and provide them with land ties; an unforeseen high flood caused many of them to crack, burst, and drift away; as well as bending and pushing inward so many, that the repair thereof has likewise caused great expenses and occasioned that

that the costs of this important and indispensable work have greatly exceeded the estimate, and together with the expenses incurred on it during this bad monsoon when the stones and earth with which it was filled repeatedly sank away again, because the bed of the river is not so level that the revetment boards or planks could close up uniformly, amount to a considerable sum of 68702 1/3 Rops according to the specification itself approved in our meeting of 28 September and attached hereto in copy, together with the report that the English engineer to whom the direction of that work was entrusted sent to the first signatory for his justification, and on whose basis principally, joined with the continuous supervision of the undersigned Director and of the master attendant, as well as our own personal knowledge, that everything that happened as set forth in the aforesaid engineer's justification consists in truth, even though we are very much convinced ourselves that such an expenditure in these days cannot be anything other than very unpleasant, we have been unable to make any difficulty in approving the said specification, very respectfully requesting Your Right Excellencies to favorably pass the same for write-off, as we may assure them that we have kept all possible attention fixed upon this work in order to prevent useless expenditures. The auction debt of the free merchant Boucard amounting to f 5510:2: having already been charged to the Malabar Government by our letter of 10 October 1774, in order to be paid there by the Fiscal and former Surat auction master Van Harn, we have also by our resolution of the 15th of this month imposed upon those suppliers the reimbursement of what was found deficient at the Coast on the cargoes of the Wilhelmina as well as of Westerveld and Beemsters Welvaaren; and henceforth the statements of charges shall be submitted by the trade employees to the pay bookkeeper according to Your Right Excellencies' pleasure. The displeasure that the expenditure for the Bombay Commission caused Your Right Excellencies has deeply affected us all, and we are moved with sincere sorrow on that account, in particular the second Huysken upon reading Your Right Excellencies' letter during the admonition that we gave him on behalf of Your Highnesses expressed to us his sincere regret in that regard, with a declaration of his readiness to obey Your Right Excellencies' ever-venerated orders, if only a month's postponement might be granted him in order to collect the sum to be reimbursed by him, and a request to permit him to attend upon Your Right Excellencies with his humble report in that regard, in order to demonstrate thereby that although he must confess with sincere contrition and humbly asks forgiveness in that regard, that he erred in retrospect when he charged all his excessive expenditures and expenses to the Company, he nevertheless had to make them and many unavoidable expenses, and that he never undertook the return journey by the overland route for his own pleasure but out of absolute necessity, while he requested us very sincerely to assure Your Right Excellencies that in all this he never had any evil intention to prejudice his masters, and still less that he would be capable of mocking the sacred oath; which being agreed to by us, we subsequently resolved on the 15th of this month in the disposition on the invoice debits, in obedience to Your Right Excellencies' pleasure, to cause to be paid into the treasury at once by the aforesaid second the sum of Rops 10718:18; and further by the members of this meeting who by secret resolution of 6 January 1773 granted full authorization to him, each in proportion to his share in the subsistence fund, the amount of the gifted watch, the fine pistols, and the pammering, amounting to Rops 885; while at the same meeting the first signatory Director undertook to pay into the treasury the amount of the diamond ring and the gifted drinks, amounting together to Rops 3798:14, under a sincere declaration, however, that he actually and truly expended and gifted this money for the best of the Company; all this, as well as what the former warehouse master Holmberg has already paid into the treasury at Batavia to the amount of R. 4392:9 and was credited to this Directorate by invoice, will subsequently be brought to a total yield of Rops 16794:15 in favor of the aforesaid Bombay Commission, in order that the remainder of Rops 6763:45 be written off to the debit of the Company. And hereby hoping in reverence and with all submission to have complied with the aforementioned order of Your Right Excellencies, we take the liberty humbly to present to Your Highnesses herewith the petition submitted to us at the session of the 15th of this month by the frequently mentioned second, to the effect of requesting that to him, above the validated R. 2241:1, may still be credited all that he has paid and disbursed over and above the expenses of consumption, drinks, etc.

has done, in order thereby to be freed from a substantial debt; while we, following his request made to us in the aforesaid manner, could not refuse this second to support his plea with our humble recommendation, as we also take the liberty to do hereby, being fully aware that the overland journey from Bombay to here was never undertaken by him for amusement or pleasure, but out of the utmost necessity, and that he in addition had to incur many unavoidable expenses in this commission, above which we then must most urgently request that Your Right Honourables be pleased to be persuaded that the donation of diverse goods and drinks occurred for the benefit of the Company, as the first signatory Director will demonstrate to Your Right Honourables by his separate letters, with the added plea to be likewise freed through Your Most Honourable kindness from the aforementioned damage. Furthermore, we have caused the amount of 782 184 with Rop. 179 18 counted in cash by the frequently mentioned Warehouse Master Holmberg and charged to this Directorate by invoice, to be entered in favor of the Brootchia Commission, and the remainder to be written off, as well as the balance of the cash box, which was again handed over by the attorneys of the aforementioned junior merchant, to be written back. Moreover, we take the liberty most urgently to reiterate our request to Your Right Honourables that a very favorable authorization may be granted to us for writing off what was spent during the public celebrations of joy in anno passato on the occasion of the most auspicious birth of His Highness The Illustrious Hereditary Prince of Orange and Nassau, and that we may be exempted from reimbursing this through Your Right Honourables' renowned equity. To which end we hope that Your Right Honourables will please take into consideration that your circular order regarding this matter dated 14 June 1773 was positive in that the expenses of such celebrations of joy here in 1768 on the assumption of the Stadtholdership, etc., by His Serene Highness Willem the Fifth, were borne by the Noble Company; and that we, residing here among all foreign nations, are continually compelled to conduct such celebrations after the example of other nations and to the greatest luster of the Company, which causes no small expenses, which are impossible for us to bear when they must come out of private pockets, however much our hearts are otherwise affected with those same feelings of joy and gratitude to the Supreme Being that all true-born Netherlanders naturally feel for all happy events in the Illustrious House of Orange and Nassau as the founder and pillar of our state, freedom, and religion. Enclosed herewith goes the petition presented to us by the second factor at Brootchia, Meijer, at our meeting of the 20th of this month, likewise for the aforesaid purpose, with the humble plea that Your Right Honourables may likewise be pleased to take his request for exemption into very favorable consideration. Over and above that which we have respectfully advanced hereinbefore to demonstrate that the unfortunate Walcheren could not possibly have been dispatched earlier, we still find ourselves obliged, with regard to the remarks which Your Right Honourables were pleased to make in your letter of 31 December 1773 concerning the disputes that occurred here with the government and the acts of violence committed by the same thereupon, to report very humbly here: Firstly, that however indisputable it may be that the Company had no outstanding affairs with the fugitive Tabitas Nager, it nonetheless appears impossible here to refrain from granting proper protection to the servants and dependents of the said Company, which however in this case occurred no further for the benefit of the brokers than the sequestering of some goods, which thereafter upon their own request were released again, without the said brokers, who surrendered their claim of 39,240: 17 Rupias and suffered damage, having been involved in any further disputes. Secondly, that we never referred the Banyan Saa Rettengje Gookel (otherwise named Boetoesa) to our Court of Justice, but decided that matter here upon his own petition.

To demonstrate this and to convince Your Honour that we are incapable of inflicting any injustice upon anyone whosoever he may be, the document of which a copy is annexed hereto will show that to the aforementioned Banyan merchant Raemnaet Raemdat on the 21. April 1772. by the Director and Secunde on behalf of the Noble Dutch Company, subject to payment of the stipulated prices, were promised the same goods as mentioned in his petition to Your Honour, under this express condition, that he would pay for those goods into the Company's treasury 150000: Ropias within a month after the aforementioned 21: April and the remainder at the end of the month of June following; although he was also permitted to leave the same merchandise in our warehouse until the Coconut Feast, and under special binding of his person and property under and according to Dutch laws. And from this it follows naturally: Firstly, that this complaint is very untimely, as the aforementioned Banyan from his side has not even fulfilled his obligation to satisfy the remaining amount for the goods, roughly speaking, in our Company's treasury, as ought to have happened already at the end of June; While we are willing, indeed he has repeatedly been assured by the first two signatories that, as soon as he shall have complied therewith, all goods which are still due to him as a remainder according to the Company's trade books, drawn up from the reports of our fiscal and commissioners and from those of the commissioners at our warehouses, shall be weighed out and delivered. Secondly, that the same complaints have not been lodged in the proper place, as this Banyan in this case has bound himself under and to Dutch Laws. Thirdly, that the aforementioned complaint is in all respects unfounded, and solely devised so as, if possible, to receive once more from us such goods as have already previously been weighed out and delivered to him, and this under the specious pretext that he had given no order or authorization to the now fugitive and bankrupt Tabitas Nagerdas for the receipt of this merchandise; whereas it is nevertheless the truth and provable by us that he always used the aforementioned Tabitas in all transactions with us as his broker and as such introduced him through his blood relative Raembaeij to the first two signatories; thus he previously on the 5. April 1772: through this his broker Tabitas caused to be purchased from us, received, and paid for 200: canassers of sugar, and thus he caused this merchandise to be purchased and received through the aforementioned Tabitas, without this Raemdaet ever having spoken to any of us, indeed never having been seen by the eyes of many of us. Wherefore we cannot doubt that Your Honour, now being informed of the true circumstances of this case, will dismiss this complainant. While with regard to the complaint brought forward by the frequently mentioned Banyan Raemnaet Raemdat against Mr. Holmberg, we must inform Your Honour that this dispute, being a matter of meum and tuum, cannot be settled by us, since we have here a Council of Justice to which all such matters belong; yea, we assure Your Honour, Gentlemen, that in such cases we find ourselves in exactly the same situation as Your Honour, and that it is just as impossible for us to decide this matter in our assembly as it was impossible for Your Honour, according to your esteemed letters of 18. Dutch Company the merchandise mentioned in his petition presented to you under these express conditions, that he would pay for the merchandise into the great treasury of the Company, namely Rupees 50000: one month after the date of the said contract and the remainder towards the end of the following month of June; as well as it being further granted to him to leave these goods in our warehouses until the shipping of coconuts, with a special pledge of his person and effects under and to our jurisdiction. Thus it follows without contradiction, firstly, that this complaint is entirely out of order since this Banyan has not yet satisfied his commitments, which were to deposit approximately the surplus amount of the goods into the treasury of our Company, as he should have already done towards the end of June; whilst we are inclined, indeed as he was often assured by the first two undersigned, that as soon as he had satisfied this, all the goods that he would still claim as remaining, according to our trade books drawn up on the reports of our Fiscal with the commission of the Council of Justice and the commissioners at the warehouses, will be weighed and delivered to him. Secondly, that these same matters are not brought to the proper place, seeing that this Banyan has bound himself in this case to the Dutch jurisdiction. And thirdly, that the aforementioned complaint is in all respects ill-founded and solely contrived so that it might be possible to receive from us once again those goods which have already previously been delivered to him, and this under the specious pretext that he had given no order nor authority to the Banyan Tabidas, who having now gone bankrupt has fled, for the receipt of these goods; whilst nevertheless it is true, and we can prove it, that the mentioned Tabidas has acted at all times and in all negotiations with us in the capacity of his broker, and that he had him recommended in this capacity to the first two undersigned by his relative Prambhai; it is in this manner that he previously, around the 5th of April 1772, caused to be bought, received and paid for by his broker Tabidas 200: canassers of sugar, and in this manner he had these goods bought and paid for by the named Tabidas without this Deanaat ever having spoken with any of us, indeed he is even still unknown to this day to several among us. To this end therefore, not being able to doubt that, you gentlemen now being informed of the true circumstances of this fact, you will dismiss this complainant. And although we would gladly assume the former, 12. because we make confession of the same religion, 13. and because of the happy peace which has subsisted between the two nations for nearly a century to the prosperity of both; 14. yet your Honours' missive clearly shows that even if this injustice might be done by others, 15. there is nevertheless no intention 16. to maintain us in our privileges and ancient customs according to your Honours' obligations; 17. not only that, but also the same missive of your Honours openly shows 18. the regret that your Honours feel 19. when the Nawab, out of conviction of the open injustice and consideration of the consequences which this might have at any time, gives us a slight satisfaction; 20. while your Honours immediately embrace the first opportunity 21. to place this given satisfaction, which the Nawab 164 himself would not deny, 22. in a different light. 23. As all this shall clearly appear from the continuation of this document with the proofs annexed thereto, 24. we shall, by citing such facts as are unavoidable, follow the thread of your Honours' aforementioned missive in this matter, 25. without even making mention of thousands of unpleasantries, chicaneries, hindrances, etc., which we daily experience here and which bring no small impediments to our trade. 26. Yet we must first solemnly declare 27. how painful it is for us, if in the continuation of this we are compelled 28. to make remarks for the maintenance of our privileges that we would gladly have wished to pass over; 29. while our aim has always been and shall also henceforth be 30. to maintain and foster good harmony, 31. without concerning ourselves with anything other than our own trade. 32. Although we, in our letter of 11 December, solely insisted to Your Honour 51. to obligate the Nabab to withdraw his sepoys from the house of a subordinate of the Honourable Company, 52. as well as to release the Company's servants from prison. 53. And, in order to show how little reliance can be placed upon the word of the said Governor, 54. we mentioned the solemn assurance he had given us so recently before, 55. that no further violence would be committed henceforth, but that the Honourable Dutch Company would henceforth be preserved in its old customs and privileges. 56. Your Honour nevertheless understood this as a complaint, 57. in order thereby to have the opportunity to bring this affair onto the carpet again, and after a mature consideration and the necessary investigation, to colour it at pleasure, 58. and, by bringing the same to light, to depict our conduct very wrongly and with the most hateful colours. 59. And therefore we now find ourselves obliged 60. to set down the occurrence in the Company's Garden Attua here according to truth, and as it has been confirmed by sworn witnesses. 61. And proceeding thereto, it serves that our Director addressed himself to Mr Price in the quality of a friend in the latter part of August 1772, 62. with the request to be pleased to employ his known influence with the surrounding Regents 63. for the recovery of the bankrupt and fugitive Tabitas Nagerdas, who always belonged under our protection, leaving behind a considerable debt both to the Honourable Dutch Company and to diverse natives, 64. in order, along that way, to remove out of the way a multitude of disputes which this bankruptcy had caused, 65. and to see if there was not any means to help the creditors at least to some guarantee. 66. Which request being accepted by Mr Price to be put into execution, 67. on condition that the Director, in order to encourage this fugitive Tabitas as much as possible to return, 68. and to remove his fear of being placed under arrest and prosecuted here by us as a debtor of the Company, 69. wrote a brief letter to the same, whereby he assured him of the contrary, 70. which little letter, a copy of which accompanies this under 166 under No 1, was handed to Mr Price, as the place whither this Tabitas had fled was known to him. 71. And which was then also of such consequence 72. that Tabitas on 22 September in the evening at 9 o'clock let the Director know that he had returned, and was here in a house of one of his friends. 73. And whereupon our Director, being solely entitled to protect this Tabitas as a subordinate of the Honourable Dutch Company, 74. sent four of the said Company's sepoys to the same, 75. with orders solely to secure him from nuisance and insults, without in any respect being a hindrance to him in his affairs or in his going and coming, 76. as the declaration of these sepoys under No 2 shows. 77.
