Examined S: Campeel pleased to write to me by secret missive of 27. April 1779, and to demand that I present to your High Noble High Mightinesses a report of what occurred in anno 1778. between us and the English concerning the taking possession by the latter of the coastal village Naoer, situated close to this city. And it is to comply with that honored order that I draw up this document. In the beginning of the month of April 1778, a rumor circulated here that the prince of Tansjour had ceded in full ownership to the English Company the coastal village Naoer, situated close to this city. After this important news, I immediately had an exact investigation made, when 474 when on 13. April it was reported to me that the day before, two English gentlemen, accompanied by a detachment of armed sepoys, had arrived at Naoer, and that several English flags had been planted by them on the boundaries, along the river and inland. As soon as I was fully informed of this, I had the Council convened on 14. thereafter, to whom I gave notice of the aforementioned important event. Whereupon I subsequently remarked that the cession of Naoer to the English Company, on the one hand, directly conflicted with the solemn promises of assurance given by the deceased prince of Tansjour, the lord Maharaasja Pajasie Pretappa Singaje Raasja 89 S: Campeel Raasja Sahib, by missive of 25. March 1750., to the then lord Governor of Nagapatnam, Mr. Liebrecht Hooreman, since the said prince had thereby solemnly promised and assured that the diwan's village Naoer would never be sold or alienated, and if it should happen that they wished to sell or alienate it, such would be done to no one else than to the Dutch Company; a promise, truly, which the present prince of Tansjour, the lord Tolaja Raza, confirmed and affirmed upon his accession to the throne in the year 1764.; While I subsequently also demonstrated that this act, on the other hand, would also entirely annul and overthrow Examined 475 overthrow the principal article in the contract between the subah of Carnatica, the lord Machomet Alichan, and the Dutch East India Company, concluded on 23. The Council, considering this proposition, noted along with me that if we did not protest against the taking possession of Naoer, the silence in that regard could be viewed and taken as a tacit relinquishment of our privileges, against which we had to watch and take care above all. Furthermore, we considered that the interest of the Company absolutely required preventing the surrender of Naoer to the English Company as long as possible, 476 as by that surrender our Company would not only lose the right that it had over all other European nations to the aforementioned seaport, but in addition stood to suffer very great damage in its revenue and trade, in case the English came to settle close to Nagapatnam. Whereupon we subsequently resolved by unanimous votes to solemnly protest against the taking possession of Naoer to the Madraspatnam Government, as well as to send copies of that protest to the prince of Tansjour and the subah of Carnatica, with a request for the maintenance of the privileges granted to the Dutch Company. And Examined F: Campie And pursuant to this resolution, we dispatched on that very day to the Madraspatnam Government a protest of the following contents. And whereas these your actions, namely the planting of an English royal flag at Naoer, is very prejudicial, and would indeed completely extinguish, not only the prerogative granted to our Company by the previous ruler of Tansjour and confirmed by the present ruler, but also the principal article for our Company in the contract entered into between the Subah of the Carnatic and the same, we, who constitute the body of the government here, in the name and on behalf of Their High Mightinesses the Lords States General of the free United Netherlands, the Honourable and Highly Esteemed Lords Directors of our Company, and Their High Excellencies the Honourable High Indian Government at Batavia, do hereby protest most emphatically against the planting at Naoer of the aforementioned English royal flag, requesting in a friendly and neighbourly manner that the same may be taken down again; leaving otherwise all damages and detriments, with the consequences thereof and all that appertains thereto, which upon refusal of this our lawful and equitable request might spring from this action of yours—which above all is completely contrary to the treaty of peace and friendship subsisting between both sovereigns in Europe—wholly and entirely to Your Honours' account and responsibility, as being the sole cause thereof. For we declare ourselves, and in us the whole Dutch nation, before God and the entire world, free and innocent of having given any cause to Your Honours to have to proceed in such a manner. Furthermore, on the grounds of the aforementioned prerogative and contract, we request and claim from the present ruler of Tansjour, the Lord Tolasa Rasa, and the Subah of the Carnatic, that they, for the maintenance of the privileges granted by them to our Company, exert their good offices with the English ministry at Madras, in order thereby to bring about that the aforementioned royal flag at Naoer be removed. and in consideration of the friendship that existed between our two sovereigns in Europe, had reason to expect that the English would have evacuated Naoer again; yet not only has the contrary happened, but the Madraspatnam Government has, moreover, attempted to render the validity of our protest void through far-fetched remarks and inferences, as will further appear to Your Honorable High Mightinesses from their letter of the 15th of May following, of which a translated copy is annexed hereto under Letter B. I have said far-fetched inferences! And how else could one call them, since they consisted Checked S: Campiel in the following remarks. Firstly, in order if possible to undermine the grounds upon which our protest rests, they remarked in their aforementioned letter that whatever assurance might have been given by the father of the present prince, we could not use the same with the slightest application in support of any of our claims to Naoer, since the privilege obtained by us from that prince was signed some 20 years earlier than the Act of renunciation of Naoer by us. And secondly: they observed that from the Treaty concluded in the Year 1773 between the Subah of the Carnatic and us, nothing else appeared than that the sea place Naoer had been sold to us by the present prince of Tanjore, and that we, after Tanjore was conquered by the arms of the Nawab, had sold that same place and lands back to the Nawab: subsequently maintaining from this that, according to the contents of that agreement, we no longer had the least claim to the prince's lands. Both reasons which, considered at first sight, must have appeared quite plausible to anyone who was ignorant of the events that occurred in the Tanjore Kingdom in the Year 1773. Yet since the sale of the aforesaid lands had proceeded quite differently from what was falsely pretended by the Madraspatnam Checked S: Campeel Government, we replied thereto at length by letter of the 16th of June 1778, in refutation of the aforesaid unfounded arguments. We first, with regard to the Treaty concluded between the Nawab and us, to which the English gentlemen sought to give a false turn by wishing to pass it off as a voluntary contract of sale, remarked in our aforementioned letter that it was, after all, sufficiently notorious to the world, indeed, what is more, that no one could be better informed of the matter than they, how His Excellency the Nawab, after he had overwhelmed the kingdom of Tanjore, formed a claim by letter of the month of September to all the lands and places that had been legally purchased by us from the prince of Tanjore, reclaiming the same under this far-fetched pretext that he could not recognize that purchase as lawful, since the prince had no power to cede or sell any of his lands to another. Subsequently we remarked that it was sufficiently known to everyone, especially to them, that we had answered the Nawab thereto by letter of the 16th of October, that we believed that the prince, being from of old Lord and Master of His lands, had the right and the power, without contradiction from anyone, to cede and to sell all such lands and places as he might see fit; that we, therefore, regarded our completed purchase, for which the money had been paid Checked F: Campiel and the deeds of sale confirmed with the prince's seal had been received by us, as lawful, and consequently could not resolve to renounce places and lands that had become our own through a lawful purchase. After having observed this, we furthermore demonstrated to the Madraspatnam Government that the Nawab, instead of recognizing this our lawful right, had answered against this our equitable refusal—which was founded on public law, nay, on the most sacred right that exists in human society, namely the Right of lawful Property—by letter of the 21st of October in very threatening terms: "that if we did not willingly cede those lands to him, he had ordered his son to take them by force." And that hereupon, without even awaiting our answer, the Young Nawab Madaroel Molk, with the troops accompanying him, had marched into the Province of Kiwaloer purchased by us, and from there, assisted by the Honorable English Company's troops under the command of General Smith, into Naoer, where the same (although we had solemnly and in writing protested against this incursion to His Excellency General Smith) immediately had our flag hauled down, and thus by force, and through the support of English troops, had taken possession of that which he knew he could not take possession of according to the right belonging to us. After Checked F: Campeel After describing this event, we demonstrated that their argument, as if we had sold those lands and places of our own free and unconstrained will to the Nawab, and had thus surrendered all our right, was far too weak to hold water when one allows equity to judge. And we consequently reiterated with emphasis: that those lands were never sold by us, but that we, to avoid further disputes with the Nawab, had renounced them on such conditions as are described in the treaty concluded concerning them with the Nawab. Furthermore, we remarked that although it was true that through this cession, in so far as it concerned the lawful ownership, we no longer held any right to the aforesaid lands, it was no less certain that immediately after the signing of the treaty we had returned to our old right that we had held over those lands according to the privilege granted to us by the father of the present prince of Tansjour, considering that this privilege could in no justice be considered to have become void through the purchase of the aforesaid lands from the prince of Tansjour, as they supposed, since through this purchase the great purpose of the aforesaid privilege had been fulfilled. Further, we noted in continuation that although this purchase, however lawful, should not have taken place, we had thereby lost nothing of our prerogative, since the Nabab as conqueror of Tansjour was certainly obliged to maintain and protect everyone in their prerogatives and privileges, and that thus the right always remained with us to be able to reclaim the privileges that had been granted to us in the year 1753 by the father of the present prince of Tansjour. After we had herewith also proved the lawfulness of our prerogative, which we hold over all nations regarding Naoer according to the privilege of the father of the present prince, we proceeded to demonstrate that, above all this, there still belonged to us the right to be able to reclaim the maintenance of what had been contracted with the Nabab by the treaty of the year 1773. Which the Madraspatnam government has attempted to render void by reflecting upon this in its above-mentioned missive of 15 May 1778: that the words occurring in the aforementioned treaty, that in the coastal places Naoer and Topotorre, belonging under the lands of Tansjour, henceforth the own flag of His Highness should fly, considered in their true and natural substance, indicated nothing other than that, having purchased the aforementioned places from the Tansjour government and in consequence of that having flown the Dutch flag from them, it was a very necessary article in the agreement with the Nabab that he, purchasing those lands from us, stipulated that his own flag should fly there instead of ours, demonstrating further that the aforesaid words, without anything further being expressed in the treaty, could indicate nothing other than that we had transferred our right to the Nabab, and that consequently this article, instead of answering to the purpose for which we had cited it, served all the more to exclude us even more strongly from the pretensions that we formed. And this we did by explaining somewhat more closely the true meaning of the words of the treaty, to which the English gave such an erroneous explanation, and consequently we remarked that not the Nabab, but we had stipulated the aforesaid article in the treaty, in order to prevent forever thereby that those lands should be ceded to anyone else, especially to any European nation, and that thus, according to the true intention of the treaty, the aforesaid words indicated that the Nabab would never be allowed to cede or sell those coastal places to any other nation, but would always have to continue to possess them himself; regarding which we further noted that we had expressed this, upon the express desire of the young Nabab, who wished to offend no one, by the words that on the coastal places Naoer and Topotorre His Highness's own flag should always fly. Subsequently, in order to deprive the Madraspatnam Council of all further exceptions, we cited that we trusted that not only the Nabab, but also every impartial person would have to concede that this was the true sense and meaning of the treaty, if one only wished to consider for a moment that if we had not intended an exclusion of flags with the aforesaid article, it would have been wholly unnecessary to let the same flow into the treaty, since, as soon as we had ceded the aforesaid place to the Nabab, in whatever manner that cession had occurred, that prince had nevertheless naturally acquired the right unto himself to let his own flag fly there without contradiction from anyone. And since we deemed that we had hereby completely refuted all the exceptions that the Madraspatnam Council had seen fit to make against our protest, we have persisted in the most powerful manner in the contents of the same, with the express declaration that we held the grounds upon which the same rested, or the privileges granted to the Dutch Company by the father of the present prince of Tansjour and His Highness the Nabab Machomet Alichan in relation to the aforesaid coastal places Naoer, in their full force and validity, by no means admitting that we should have lost anything of our right to the aforesaid coastal place.

And although we do not doubt that Your Honours will, from the contents of the aforesaid protest, to which Examined F: Campiel to which we refer ourselves, be completely convinced of the legality upon which our right rests, we have nevertheless deemed it necessary to remark herewith that when in the year 1773 we legally purchased the seaport of Naoer and several other lands from the Prince of Tansjour, according to the deeds of purchase granted thereof by His Highness, that same place and lands were reclaimed again by force and with the support of the English Company's troops by His Excellency the Nabab Machomet Alichan after he had captured the city of Tansjour, on the pretext that the Prince of Tansjour, being a tributary of the Nabab, had no power to sell or alienate any of his places; and that thereupon, to avoid 490 avoid disputes, we transferred that seaport and the other lands back to His said Excellency, yet with this express condition, as we cited in the enclosed protest, that from the seaports of Naoer and Topotorre no other flags than those of His Excellency should ever fly. This having then passed in such a manner, it appears particularly strange to us now that that stance upon which they stood so firmly then regarding the prince's inability and lack of power to sell his lands and seaports to the Dutch Company has been so quickly forgotten. Examined S: Campeel those who are not immediately informed of the circumstances that give rise to the same, or have any connection thereto; it is for this reason that we believe it is incumbent upon us to make some remarks in answer to Your Honours' protest, not doubting that the same will be fully sufficient to remove the objections that Your Honours have formulated against the aforementioned proceedings. Your Honours say that the flying of our flag at Nagoer is an infringement upon Your Honours' privileges, as it cannot be unknown to us, or at least we could long since have been informed, that the father of the present Radja of Tansjour, by a letter dated the 25th of March 1750 to the Governor of Nagapatnam at that time, firmly assured and promised that the Cercar's village of Nagoer should never be sold or alienated, but if it should happen that the same were sold, it should be done to no one else than to the Dutch Company; that these assurances were confirmed by the present Radja, alongside the other privileges formerly granted to the Dutch Company, and even were we ignorant of this, it must nevertheless be well known to us that in the last agreement between the Souba of the Carnatic Machomet Alijchan and the Dutch East India Company, concluded the 23rd of November 1773 at Naver, it was stipulated on Your Honours' part, and promised and assured by the said Souba, that at the maritime places Naver and Topotorre, belonging to the lands of Tansjour, the flag of His Highness should fly forever. These are the only grounds upon which Your Honours have founded your protest; we shall then proceed to observe, firstly: that whatever assurances may have been given to Your Honours by the father of the present Radja, we submit that the same cannot be applied with the slightest relevance in support of any pretensions that Your Honours may have formulated concerning Nagoer. It appears from the treaty previously cited between the Nabab of the Carnatic and Your Government that the city of Nagoer was sold to Your Honours by the present Radja of Tansjour, and that after the conquest of Tansjour by the arms of the Nabab, Your Honours sold the same city and lands back again to the Nabab, declaring, as appears in the words of the agreement, that Your Honours from that time forward had not the least pretension to the prince's lands. In another instrument under Your Honours' hands, dated the same day as the treaty, Your Honours declare that having received from the Cercar the amount of the said purchase (Nagoer and other districts), Your Honours have delivered up all those districts to the Cercar, and give this engagement that Your Honours have no claim upon, or dealings with, the said lands. Having thus, Gentlemen, by acts of the most public and sacred nature relinquished in the strongest terms all future claims or pretensions to the City of Nagoer and other districts of the Tansjour lands formerly in Your Honours' possession, it appears to us very extraordinary that Your Honours should at present contradict these express declarations, and renew a pretension of privileges founded upon a letter from the father of the present Radja, dated more than twenty years before that formal act of renunciation took place. The ground of this claim appearing too frail to be maintained, Your Honours placing not too much confidence in it yourselves by the abrupt transition to saying that even if we were ignorant of the assurances mentioned in the letter of the present Radja's father, it was nevertheless well known to us that in the treaty between the Souba of the Carnatic Machomet Alijchan and the Dutch Company, concluded the 23rd of November 1773, it was agreed on both sides that at the maritime towns of Nagoer and Topetorre, belonging to the lands of Tansjour, His Highness's own flag should always fly. These words in their true and natural meaning can signify nothing else than this: that whereas Your Honours had purchased the aforementioned towns from the Tansjour Government, and had consequently caused the Dutch flag to fly in the same, it was a very necessary article in the Nabab's agreement, in purchasing the same back from Your Honours, to stipulate that his own flag should fly in the future instead of that of Your Honours. To the Right Honorable Lord Thomas Rumbold President and Governor of Fort St: George and the Coast of Coromandel, on behalf of the Royal English East India Company, together with the Honorable Members of the Council; there Lord, and Honorable Gentlemen We had the honor to receive on the 20th of the past month of May Your Honor's letter of the 15th preceding; Examined S: Campeel preceding: containing among other things communication that Your Honor had duly received our letter of the 14th of April, and the protest transmitted therewith against the taking possession of Naoor, by Your Honor. Since Your Honor was pleased in the aforementioned letter to make some remarks against our protest, although Your Honor seems to have judged it unnecessary to answer the remarks appearing in our letter of the 14th of April, but the reason for which is very easily guessed, we have also judged it necessary to answer and refute in detail by this letter the objections made by Your Honor against the contents of our protest, however much they conflict with equity and sound reason, in order thereby to convince Your Honor finally and completely of the right that we have to be permitted to protest against Your Honor. In order, if possible, to knock the bottom out of the grounds upon which our Protest rests, 498 Your Honor has remarked against the same, in the first place: that whatever assurances might have been given to us by the father of the present prince, Your Honor was of the opinion that the same could not be used with the slightest application in support of any of our claims on Naoor, since the privilege obtained by us from that prince was signed fully 20 years earlier than the deed of renunciation of Naoor by us. And secondly, noted that from the treaty concluded in the year 1773 between the subah of the Carnatic and us, nothing else appeared than that the seaport of Naoor had been sold to us by the present prince of Tanjour, and that, after Tanjour had been conquered by the arms of the Examined S: Campiel Nabab, we had sold that same place and lands in turn to the Nabab, and thus according to the contents of the agreement no longer had the slightest claim on the prince's lands; citing at the same time as further proof of this unfounded assertion, that by another instrument dated on the same day that the contract was concluded, it had been declared by us that we, having received from the circar the amount of the purchase of Naoor and the other lands, had surrendered all those districts to the circar; from which Your Honor is further pleased to draw this conclusion, that we, by that cession, would have indicated that we had no demands upon or anything more pending with the said lands, and thus would have renounced all claims upon the same. To anyone, Gentlemen, to whom the events 499 of the year 1773, occurred in the kingdom of Tanjour, are unknown, the aforesaid reasons might appear very probable; but we trust that the whole world, as soon as one has properly informed it of the condition of those times, will have to find Your Honor in the wrong; regarding the incorrect interpretations which Your Honor has been pleased to give to the words of the treaty concluded between the Nabab and us. For it is indeed well enough known to the world, Gentlemen, and no one can be better informed of the case itself than Your Honor; how His Excellency the Nabab, after he had overpowered the kingdom of Tanjour, by letter of the month of September made claim to all lands and places that had been lawfully purchased by us from the Examined F: Campeel prince of Tanjour, claiming the same under this far-fetched pretext: that he could not recognize that purchase as valid, since the prince had no power to cede or sell any of his lands to another. It is also well enough known to everyone, but especially to Your Honor, that we answered this by letter of the 16th of October, that we believed that the prince, of old, being Lord and master of his lands, had the right and the power to cede and sell, without contradiction from anyone, all such lands and places as he might see fit; that we consequently held our completed purchase, for which the money had been paid and the deeds of purchase confirmed with the prince's seal had been received by us, to be lawful, and therefore could not resolve to renounce places and lands that had become our property through a lawful purchase. 500. Then instead of recognizing this our lawful right, His Excellency, against these our protests, which are equitable and based upon public, indeed the most sacred right that exists in human society, namely the right of lawful ownership, wrote to us by letter of the 21st of October in very threatening terms: that if we did not voluntarily surrender those lands to him, he had ordered his son to take them by force. Checked S: Campbell cellency, and General Smith immediately ordered our flag to be lowered; and thus the Young Nabob took possession by force and through the support of English troops of that which he knew he could not lawfully possess according to the right belonging to us. From this account, Gentlemen, which is based upon the pure truth, it is evident in the clearest possible manner that Your Honors' far-fetched remark—as if we had sold those lands and places of our own free and unconstrained will to the Nabob and had thus surrendered all our rights—is far too weak to stand the test when equity is allowed to judge. It therefore surprises us greatly that Your Honors could make use of such a faulty argument; an argument that confirms our lawful right far rather than that anything would be weakened thereby, as Your Honors suppose; the more so since we can, if necessary, demonstrate with authentic evidence that those lands were extorted from us by force by the Nabob and Your troops, who were under the command of General Smith and several other officers. For which reason we once again emphatically repeat that those lands were never sold by us. But we deemed it best, in order to avoid all further disputes with the Nabob, to cede the aforesaid lands again, upon such conditions as are described in the treaty concluded with the Nabob concerning this, all the more because he beforehand offered us the restitution of the money that we had paid for them to the Prince of Tanjore. This surely cannot be called a voluntary sale, as those lands were extorted from us, as it were, with the saber in hand. Checked F: Campbell It is true that through this cession, and so far as legal ownership is concerned, we no longer have any right to the aforesaid lands. But it is no less true that immediately after signing the treaty we stepped back into our ancient right that we had held over those lands, according to the privilege granted to us by the father of the present Prince of Tanjore; which can never be considered to have become void or lapsed through the purchase of the aforesaid lands from the present Prince of Tanjore, as Your Honors also, though on what grounds we do not know, assume; because through that purchase the great purpose of the aforesaid privilege had been fulfilled. Should this purchase, though lawfully made, not proceed, or should superior force choose so to construe it, we have not lost any of our prerogative because of it, since the Nabob, as conqueror of Tanjore, was indeed bound and obligated to maintain and protect everyone in their prerogatives and privileges, and thus also our Company. Consequently, the right has always remained with us to reclaim the privileges that were granted to us by the father of the present Prince of Tanjore in the year 1753. Herewith, Gentlemen, we believe we have fully proven the legitimacy of our prerogative, which we hold above all other nations in Nagore, according to the privilege from the father of the present Prince of Tanjore, and the illegitimacy of Your Honors' assumption. Examined S: Campiel can stand the test. Consequently, we, being principally involved in this matter, cannot consider the aforementioned remarks as legitimate; on the contrary, we hold them to be of not the slightest value, and incapable of calling our right to Naoer in any way into doubt. Wherefore we persist in the strongest manner in the contents of our protest, under express declaration to your Honours, that we maintain the grounds upon which it rests, or the privileges granted to our Company by the father of the present ruler of Tansjoúr, and His Highness Machomet Alichan, with relation to the aforementioned seaport Naoer, in their full force and value, in no way conceding that we have lost any of our right to that seaport. And although we could hereby consider your Honours' letter of the [illegible] of May to be fully refuted and answered, we nevertheless ask, before we conclude, for permission to make a single remark in further defense of our good right. Your Honours have among other things, in order to invalidate if possible the basis of our claim, founded on the privilege of the ruler of Tanjour, also seen fit to remark that that basis was all too weak to be maintained, and that we ourselves seemed to place not much confidence in it, since we stepped over so abruptly from this to our second privilege.
