421. No. 6. Abstract of a list of demands made by the Nabob from the Dutch, whereby stands: Dutch goods such as sugar, spices, etc., which Gouenram Pandoole and Mantcher, their brokers, purchase from them and sell again to merchants in the town, they, the said brokers, export in the names of the Dutch Company, customs-free, appropriating to themselves the amount of the export duty as the merchants pay it them, which being highly unjust and a great prejudice to the Sarkar, cannot be allowed. The Dutch merchandise, such as sugar, spices, etc., which Gorenram Pandool and Mantcher, their brokers, buy from them and sell again to the merchants in the city, are transported by the said brokers under the name of the Dutch Company without paying customs, thus retaining for themselves the amount of the export duties that the merchants pay them, which, being highly unjust and tending to the great prejudice of the Government, cannot be permitted. Right Honourable Sir and Sirs, Being compelled by the circumstances in which we find ourselves, and especially by the want of provisions, to accommodate ourselves with the Nabob upon such conditions as are known to your Honours and prescribed to us by your letter of the 19th of this month, except that our ordnance of 6-pounder and larger caliber shall not be secured on the glacis of the Castle, but in the Honourable Company's inner Pathi, standing under their cannon as well as the mortar, and that the ownership of the two gates of the Company's yard and of the remainder of the former King's Road shall be demonstrated and proven in loco by authentic documents; so we have the honour to inform your Honours thereof, and to invite your Honours to allow your deputies, pursuant to your latest letter of the 20th of this month, to assist tomorrow morning, being the 24th of September, at the conclusion of the treaty, for which, according to the liberty granted to us, we have chosen your Honours' Company Garden, as well as, acting as mediators, to advise the Nabob thereof, to the end that His Honour may also send some persons on his behalf thither to sign the Act of Accommodation there with our deputies. And in order mutually to ensure the execution thereof, we request your Honours to be pleased to take upon yourselves the guarantee thereof, which we trust will be done by you with the same willingness with which you accepted the mediation. For the rest, we enclose herewith a note of all our so-called heavy ordnance, namely of diverse calibers down to 4-pounders, the same consisting of: 10 twelve-pounders, 8 eight-pounders, and 8 six-pounders. Drabbe Esq., Chief from the Dutch Company, and his Council, dated 19th September 1762. Worshipful Sir and Sirs, Agreeable to what we wrote you under the 7th instant, two of our Board have waited on the Nabob and explained to him your answers to his demands. To have stayed for his replication in writing, and then to have had that to translate from the Persian, would have required more time than your unhappy situation, especially in respect of provisions, would admit. For conciseness as well as expedition's sake, therefore, we shall now acquaint you with the purport of his said replication to each article of your answer, with our opinions as mediators thereon, in the hope of its proving to your satisfaction. Further: To the 6th: The Nabob supports this charge by the written testimony of Calliandass Pursotemdass and Trikumdass Pragdass, two brokers of known credit and wealth, who severally declare that they have bought Dutch goods from your two brokers Pandole and Mantchur at advanced prices in consideration of their giving them a burty for exporting said goods free of customs; on which, otherwise, they must have paid the Government 5 per cent on their arbitrary valuation, and if more proofs be required, the Nabob adds they can be produced. It appears from hence that the Government has been great sufferers by this unjust proceeding, and that in equity reparation ought to be made, but as it will require much time, and almost endless trouble to have such an account properly adjusted, the Nabob and all others interested in this revenue must depend on your honour, Gentlemen, to prevent your brokers doing the like in future. Copy Translation of the English Missive from Mr. Thomas Hodges, English Chief here and Council, to the Right Honourable Mr. Jan Drabbe, Director of this Directorate and Council, dated the 19th September 1762. Honourable Sir and Sirs! Conformably to what we wrote to your Honours on the 7th of this month, two members of our Table have been to the Nabob and laid before him your Honours' answers to his demands, to await his reply in writing, and subsequently to cause the same to be translated from the Persian would have required more time than your Honours' unfortunate situation, especially with respect to provisions, can brook, therefore we shall for the sake of brevity, and to make greater speed, make known to your Honours the contents of his aforesaid Reply to each article of your answer, alongside our opinion as Mediators thereupon, in the hope that your Honours will rest satisfied therewith, and namely: To the 6th: The Nabob proves his accusation by the testimony of Caljaandas, Persotembas, and Trikkendas, two brokers of known credit and means, who each individually declare that they have bought Dutch goods from your Honours' brokers Pandool and Mantcher at high prices, in consideration that these gave them permission to export the said goods duty-free, of which they would otherwise have had to pay 5 percent to the Government, and that according to their estimation estimation or valuation. And if further proofs are required, the Nabob adds thereto that he can produce the same. From this it appears that the Government has suffered greatly through these unjust practices, and that according to equity reparation should be made thereof, but since it would cost very much time and endless trouble to make up the account thereof exactly, the Nabob and all others who have an interest in this revenue will have to rely upon your Honours' word of honour to prevent that your brokers do this no more in future. Extract from the Memoir of the late Councillor Extraordinary of the Dutch Indies C. L. Senfs, left by him upon his departure from Surat, Chapter 3, paragraph 54. Upon the Hon. Company's merchandises, once duty has been paid upon arrival, no one may according to the firmans demand any dues when the same are sent outward again by the Hon. Company. The request to obtain permission for that free forwarding has from the oldest times been made to the city Governor not by the Director, but solely by the brokers, in writing, which in the vernacular bears the name of Arsie, Petition; but three years ago Mr. Hodges requested that I should always sign those papers myself, under the pretext: That the brokers defrauded the customs far too much by sending out in the name of the Hon. Company goods which they had already sold to other merchants; that this could not occur if their petitions had to come under my eyes; and that on this account he requested nothing of me but that which I could not well refuse without acting unfairly. demand was entirely diverted by pointing out to him: That the Dutch Directors were indeed accustomed to present roekas, or memorials, to the City Governor, but no arzies, or petitions. That the latter had always been the work of the brokers. That for that reason, I could make no change to such an ancient and legitimate custom without greatly prejudicing the honor of myself and my successors. And that in case the statement of the brokers might appear suspicious to the Governor, he had only to send a man of quality to me, whereupon I assured that I would not only tell him the exact truth, but that I would also compel the brokers to pay him ten ropijen for every single ropij that they could be convicted of having defrauded in this matter during my presence. But a few days ago, Mr. Price revived this dispute by giving explicit orders to the Governor not to accept any arsie from the brokers, much less to sign it, unless it was first signed by me. And this went so far that some goods intended for Brootchia had to be left behind. I immediately sent the court emissary to lodge my complaint about this, but being unable to accomplish anything with verbal messages, I wrote him a rokka, which is appended hereto under No. 7, in case it might at some time be of any use to Your Honor in a similar case. And this also had the effect that permission was not only granted for the dispatch of the aforementioned goods, but also that 750 canasters of sugar were actually shipped at the same time. Agreed. E.
