Right Honorable and Most Respected Gentlemen, The High Government of the Indies has ordered that we should send our considerations on the Memorial delivered by the Papal Nuncio at Brussels to the Ambassador of Their High Mightinesses, and subsequently sent to the Indies for reply, directly to Your Right Honorable Lordships. Since our respectful opinions to Your Right Honorable Lordships had already long been dispatched to Ceylon when that order was received, we respectfully offer Your Right Honorable Lordships a concise refutation of the complaints contained in that Memorial, along with the necessary supporting documents according to the annexed register, dispatched via a private vessel to Ceylon, in the hope of still finding an opportunity from there to the Netherlands, while we shall endeavor to send the duplicate via foreign means. Spall 373 To the Right Honorable and Most Respected Gentlemen, the Directors Commissioned in the Assembly of Seventeen, representing the General Dutch East India Company in the Presidial Chamber of Zeeland. Right Honorable and Most Respected Gentlemen! Section 1. The Memorial delivered by the Papal Nuncio at Brussels to the Ambassador of Their High Mightinesses, and subsequently sent to us for reply, contains three principal propositions upon which the complaints of the Court of Rome concerning the oppression of the Roman Catholic clergy in the Company's territory here, and the request for redress, are mainly founded, namely: Section 2. 1. That the Apostolic Vicar on this coast had always visited the churches subject to his authority and had corrected the clergy as required, without distinction of temporal sovereignty, and especially also within the territory of the Company. Section 3. 2. That Governor Moens sought to alter this system, and would not permit the Apostolic Vicar to exercise any authority proper to his office, neither with regard to the visitation of the churches nor with regard to the clergy. Section 4. 3. That this demand was entirely novel and contrary to that which had been practiced until now. Section 5. Against this, we have the honor to submit the following remarks to Your Right Honorable Lordships. Section 6. The Apostolic Vicar, being the Bishop of Verapoly from the Order of the Discalced Carmelites, has never by himself, or by virtue of his office, had any right over our Roman Catholic churches or the priests appointed to them, but the oversight which he exercises over the same was entrusted to him by the Company out of free choice. We therefore prefer to begin this proof with the remarkable event at the end of this century, when their Right Honorables, the High Indian Government at Batavia, in the year 1694, had ordered that all Discalced Carmelites should depart from the Company's territory here. For then the prelate, Peter Paul De Palma, Archbishop of Ancyra, etcetera, on the point of his departure for the Indies, addressed your Right Honorable Worships with the request that the Discalced Carmelites, and among them a Bishop, might again be admitted here, which was granted to him by resolution of your Right Honorable Worships of the 1st of April 1698, and was written to us in more detail in a letter of the 8th of the same month from the Chamber Amsterdam, and by virtue of this concession, the Bishop of Metellopolis and Apostolic Vicar at Verapoli, Fra Angelus a Sancta Theresia, of the order of the Discalced Carmelites, was again recognized and accepted as such in the year 1701 by resolution of the 3rd of May in our Council, upon his request made to that effect, wherewith a new period of supervision by these Bishops over our Roman churches began, which continues to this day. Paragraph 12. This remarkable case is circumstantially described in our just-mentioned resolution, into which all further pieces of evidence are likewise inserted, and demonstrates most clearly that the Apostolic Vicar on this coast has of himself no authority, nor ever had, over our Roman churches, but acquired the same solely from the Company. Paragraph 13. But since the authority which the Apostolic Vicar now still exercises over the Roman churches under our territory here was granted and assigned to him by the Company of its own free will, it already follows from this that the nature and character of that authority must not be measured according to the notions of the Roman Church, but must be defined according to the doctrine of the Protestants, and consequently consists solely in a spiritual or pastoral oversight over the congregation and its religious exercises, without the addition of worldly authority. Paragraph 14. Yet we need not, in order to prove this latter point, rely solely on the aforementioned argument, because the repeatedly mentioned authority was already further limited at the assignment itself, both by your Right Honorable Worships and also by the Government of this coast. Paragraph 15. The first appears from your Right Honorable Worships' aforementioned resolution of the 1st of April 1698 and the ordinance decreed therewith, whereby the Bishop and further Carmelites are readmitted, under this express condition: that they shall submit to the orders of the Company, and that it shall always be and remain in the power of the Company to limit and restrict the aforementioned liberty in such a manner as shall be deemed proper. Paragraph 16. The second appears from the apostil of the Council here, granted upon the petition of the Bishop of Verapoli mentioned in paragraph 9, reading: That his Reverence and his fellow brethren, the Carmelite Fathers, here on the coast shall conduct themselves according to the contents of the ordinances, orders, and laws regarding the matter of the government and policy of this coast, both in spiritual and in worldly matters. Paragraph 18. All of which proofs are collectively found in our resolution of 3 May 1701, from which a complete extract is annexed hereto under Letter A. Paragraph 19. With particular regard to the authority over ecclesiastics, which is attributed to the Vicar Apostolic in the aforementioned Memorial, we observe: 1st. That the priests of our Roman churches, who are here called Vigairos, are not appointed by the Bishop, or Vicar Apostolic at Verapoli, but by the Governor or Commander, who in this respect usually heeds the request and nomination of the congregation, or also allows a qualified subject to be nominated by the Bishop, though without being bound to either. 2nd. That prior to their appointment, a certain formula Committendi in the Portuguese language, which they understand best of all, is presented to them for perusal, which must be signed by them, whereby they declare themselves to be the Company's subjects, pledge obedience and fidelity, and in every way submit to the orders and commands of the Company. 3rd. That thereupon the Governor or Commander grants to such candidate a written Deed of Appointment, upon which he is accepted and recognized by the congregation as Vigair, or priest, without any interference from the Bishop. 4th. That the Governor also, and not the Bishop, has the power to dismiss such priests again whenever they do not behave properly, without the Bishop or Vicar Apostolic being permitted to interfere therewith. Paragraph 20. To prove these four propositions, we annex hereto in forma probante: A copy of the formula Committendi in Portuguese and Low Dutch under Letter B. A copy of the bond which every vigair or priest must sign upon his appointment, which is then deposited at our Secretariat, under Letter C. A Deed or Commission in Communi forma of 4 August 1741 under Letter D. Another Deed granted upon the request of the congregation and the recommendation of the Bishop, dated 8 August 1767, under Letter E. Another Deed whereby the old priest is dismissed and another appointed in his place, dated 9 March 1736, under Letter F. A ditto dated 22 June 1751 under Letter G. Paragraph 21. Having thus indicated and established the narrow limits within which the pretended authority or so-called jurisdiction of the Vicar Apostolic over our Roman churches and clergy is restricted and enclosed, we must describe in detail the case at which the complaints in the aforementioned Memorial of the Papal Nuncio are actually aimed. Paragraph 22. The Roman church at Paliporte belongs under the Company, and the Roman-minded inhabitants of Paliporte are our subjects. One of them, who had been appointed by the Company as Head of the fishermen, named Pedro Kadil, held on lease from the Company a piece of land situated close to the church, upon which a small house, or rather a small booth, was built, from which all sorts of trifles were sold. Paragraph 23. In the year 1777, the then Bishop ordered this man to demolish that boutique or booth, pretending that it stood on the ground of the church; but Mr. Moens forbade this, because upon investigation that ground was found to belong to the Company. Paragraph 24. Poor Kadil Pedro, who obeyed his lawful government, was excommunicated by the Bishop on that account, along with his entire family. Paragraph 25. The Governor, having received knowledge of this, had the Bishop admonished to lift the excommunication, but received a refusal in reply, under the pretext that Kadil Pedro had made himself guilty of sacrilege. Paragraph 26. But His Honour had this accusation of sacrilege accurately investigated by three Members of the Council, and from their written report of 28 June 1778, it appeared that this accusation had been fabricated in a reprehensible manner, and that the witness who had been brought forward to prove it had not merely been induced to give false statements, but had even been compelled thereto by actual violence. Paragraph 27. Concerning this, the aforementioned Bishop was earnestly remonstrated with by Governor Moens, first by a letter of 5 July 1780, and subsequently further by a verbal message through the Company's sworn Interpreter, the Bookkeeper Barend Bles, and was once again admonished to lift the ban, but again in vain; he dismissed this, and did not scruple to declare to the said Interpreter: That Pedro with his family had been excommunicated not so much for the sake of the fabricated church-theft, as for the sake of the boutique, and that he, the Bishop, would not admit him to church communion, because this would not only conflict with Roman canon law, but he, the Bishop, would also thereby lose his authority in that church. Paragraph 28. Upon this obstinate refusal, Mr. Moens gave orders to the Vicar, or Priest, of the said church to release the often-mentioned Pedro Kadil and his family from the ban and admit them again to church communion, which was then also carried out by that Priest. Paragraph 29. De Heer Goeverneur, hiervan kennis Krij= „gende, liet den Bisschop tot de opheffing van de exkommunikaatsie vermaanen, doch ontving daar op een weigerend antwoord, onder het pretext, dat Kadil Pedro zich aan kerk= „roof had schuldig gemaakt. § 26. That not the aforementioned Lord Governor, but rather the Apostolic Vicar, has attempted to change the system according to which the Roman Catholic churches under our obedience in this country must be governed. Paragraph 33. Yes, that the design of this Prelate was aimed at undermining the secular supreme authority of the Company over the aforementioned churches and clergy, and arrogating it to himself. Paragraph 34. The consequences which this matter, after the departure of the Lord Moens from here, has further had, provide further proof that the Roman Catholic clergy, in this whole case, allowed themselves to be guided by nothing other than these ambitious designs. Paragraph 35. We shall therefore, in our opinion, do no unnecessary work if we describe here in detail the further rebellious undertakings of these priests, toward the execution of this their punishable design, after the departure of His Right Honourable and after their complaints had already been sent to Rome. Paragraph 36. As soon as the Lord Moens had departed, the poor Pedro kadil and his entire family were excommunicated anew, and when his mother, who was also included in this excommunication, died in the month of November 1781, the Priest refused to let the corpse be buried in the church (the general burial place of Catholics on this coast). Paragraph 37. Pedro therefore addressed himself to the first signatory, who having at that time not the least knowledge of what had previously happened, and receiving from his interpreters no further information other than only that the woman had died without receiving the last rites, merely confined himself to a written order to the Priest to commit the corpse to the earth, which was then also done. A few days thereafter there appeared before the first signatory a Father of verapoli with a Portuguese letter from the Bishop and 378 the further verbal message: That at Paliaporte a Roman Catholic woman, who had for a long time been excommunicated, had died without absolution and sacraments, for which reason he, the Bishop, had ordered the corpse to be buried outside the church, in unhallowed ground, but that the same had since, by order of the Lord Commander (who had had no information of the matters), been buried in the church, so that no service could be held therein until the corpse should be dug up and the church reconsecrated, etc. Paragraph 39. Because this Father was in great haste, and the translation of the letter into Dutch and of the answer thereto into Portuguese required some time, the first signatory thereupon gave this verbal answer: that such violent proceedings against a dead and buried body, which at the same time served to the insult and disgrace of the surviving family, could not be tolerated in the Company's churches and communities, and the Lord Bishop was therefore requested to desist therefrom, and to clear away the supposed obstacle in a gentler manner, without exhumation of the corpse. Paragraph 40. Yet the Bishop did not hesitate to charge the Priest of Paliporte, by a written order under pain of excommunication, to have the dead body brought up out of the grave again and thrown away, which was then also carried into execution by this man, with the assistance of the sexton and some others, in the night, the dead body being tied to a plank and thrown into the river. Paragraph 41. It took some time before we received knowledge of this, for the interpreters and other native servants, being Roman Catholic, always knew how to turn the poor Pedro away with his complaints, but finally this poor man found means to have his complaints presented to us through the resident of kranganoor, whereupon a sharp investigation into all these circumstances was immediately instituted. Paragraph 42. And then it appeared that the aforementioned excommunication of Pedro and his whole family and the violent proceedings that followed thereupon against the dead and already buried corpse of the mother of the frequently mentioned Pedro had been undertaken and carried into execution by the clergy at verapoli, 379 not only out of pure vengefulness against that man, because he had been obedient to his lawful government; but also principally with the purpose to undermine and nullify the authority of the Company over these and the other Roman Catholic churches sorting under it, as well as to make themselves master thereof. This rebellious conduct of the Bishop thus required a serious disposition, which ought not merely to be confined to the protection of the injured subject, but at the same time also served to extend to the maintenance of the Company's right and supreme authority over the Roman Catholic churches sorting under it. Matthias Scherpenseel, a German by birth, who had constantly given many proofs of his faithful attachment to the Company, was held in great esteem by the Roman Malabars as well as by the king of Koetsiem and was therefore very capable of being appointed to this position. But when the Bishop of Verapoli got wind of this, he wrote a very humble letter in the French language to the first signatory, in which he confessed his guilt, requested forgiveness, and offered satisfaction, as your right honorable Lordships may observe in more detail from the copy annexed hereto under Litera H. § 46. This offer was accepted at the session of 2 July 1782, under these conditions: 1. That the Bishop must send two Fathers to the first signatory to ask for an apology. 2. That Pedro and his family must be released from excommunication by the Bishop. 3. That the dishonored memory of his mother must be restored, and to that end, by one of the Fathers of Verapoli, the funeral duties and ceremonies that are celebrated and observed according to the ritual here at the burial of Roman Christians who have died in the bosom of the church, must still be performed in the church of Paliporte. § 47. All of which was fulfilled to the strict letter by the aforementioned Bishop. § 48. not only to bring no hindrance or prejudice to the good correspondence and understanding which the Company has always had and still has and maintains with the S:t Thomese Kristenen being there, much less to scheme or do or undertake anything whatsoever that could be disadvantageous or prejudicial to the said Company, but that on the contrary, in accordance with the offer and submission of the said Lord Archbishop, they shall be bound to reveal, report, and make known to the servants of the said Company on the aforesaid coast everything that they might learn that would serve either to the advantage and benefit or to the disadvantage or prejudice of the said Company; provided that they shall not have the power to assume or exercise any superiority or dominion over the churches of the aforesaid S:t Thomese Christenen, but that they shall let the same be governed by the natives of the land, or by those who are or shall be placed over them by the aforesaid S:t Thomese Christenen from among their own. That it shall also always be and remain in the power and discretion of the said Company to limit and restrict the aforesaid liberty in such manner, or also to expand the same as much further, as shall be found to be possible and permissible according to the circumstances of times and matters, without hindrance to the Company. — It is further understood that in places falling under the authority of the Company where the exercise of the Roman religion is permitted, the same shall be left as it is. The Directors of the General Netherlands Chartered East India Company, representing the said Company in the Assembly of Seventeen, make known: Whereas Lord Pieter paul de palma, Archbishop of Ancyra, born Duke of S:t Elie, Privy Councilor to His Imperial Majesty and his Envoy Extraordinary to the Kings of Persia, the Great Mogol, and Ethiopia, intends, for the execution of the aforesaid commission entrusted to him, to undertake the journey to the countries mentioned hereinbefore, and as it might happen that His Excellency would pass through lands, cities, trading posts, or residencies of the said Company, and as we have been requested by higher authority to provide him with a passport with a recommendation to our servants there; so it is that we will, charge, and command the Directors, Commanders, and other Chief Officers of the said Company at the trading posts and residencies of the aforesaid countries, as they are charged and commanded hereby, to regard and respect the said Lord Pieter Paul de Palma, on the aforesaid journey to the said empires, both in going and returning, as Envoy Extraordinary of His most aforementioned Imperial Majesty, and as such to show and grant to him, with his accompanying party, upon request as aforesaid, all courtesy and assistance.
