192 The 12th of November 1784 18 To send a rocha to the Nabob. must be done as with unprivileged merchants, and that one thus finds oneself, as well as them, forced to deal with the Nabob, to whom the handling of all matters relating to customs has belonged since ancient times, and to whom the English government has still outwardly left the management thereof under its administration and according to its direction, it has been resolved and agreed to dispatch at the earliest opportunity a rocha or written proposal to the said Town Governor, and therewith to request—since the Wharf is as yet refused to be returned to us—permission for the unloading and reloading of the Honourable Company's ship Trompenburg at the sjap or Castle gate, under payment of 2½ per cent customs duties according to ancient custom. After this, the Lord Authority gave notice to the meeting, regarding the consideration to be made concerning the brokers, that when he requested the Members of this Council on the 26th of October, when the dispatch from Their High Excellencies was read, to keep secret the instruction appearing therein from the said High Rulers, namely to appoint the son of the deceased broker Mandcherjie, named Bouwmandje Mandchergie, as Company broker, unless there were pressing reasons to the contrary, this was done solely with the intention of leaving the said order for the present unexecuted on account of its impracticability, and to give him, the Lord Authority, the opportunity to await Their High Excellencies' response in advance through his forthcoming secret letter. Secondly, that especially in these times—where, through the fear that has seized the Native over the conduct of the English, of which they can form no concept, and which causes them to fear that the war is not at an end, a sentiment in which they are greatly reinforced by the fact that the said nation has neglected to make any proclamation here of the concluded preliminary peace with Holland, while they have proclaimed peace with France and Spain—one is not in a position, as in 1780, to sell goods for cash, or rather with advance payment for the same under discount of interest, nor even to raise monies upon the same; and that it would inevitably bring about the ruin of anyone who should now resolve to deliver the goods and merchandise on credit to the house of Mandchergie, either alone or joined with that of Gouwe.

The 12th of November 1784 Gowenram, since it is fairly certain that the merchants who previously advanced their money to them on merchandise would, as soon as they had this in their hands, pay themselves out of it, without it being possible to obtain any redress in this regard; and thirdly, that it is therefore necessary that one should above all currently have merchants as brokers to whom one can with peace of mind entrust the merchandise, and under whose guarantee one can deliver it to the buyers, who moreover have extensive credit, by which they, under these circumstances and as long as one is prevented from selling by the failure to ship the goods, can provide the Company with the necessary funds for continuing the procurement and for the domestic expenses up to the discharge, etc.; and that these should furthermore be respectable and knowledgeable persons, whereas the nephew of Mandchergie is still a mute and ignorant youth, and the son of Gowenram is not yet sixteen years old. And on the other hand, that his indispensable duty requires him in all respects to carry out and obey the orders of his High Superiors as far as can possibly be managed, he had understood that he would advance the service of the Noble Company and his own security, as well as obey the order of Their High Noble Mightinesses, if he proposed to the meeting as brokers two of the foremost and most highly credited bankers of this city, named Zaalla Raamnaraam Sieuwnaraam and Tavaatjen Nagerdas, of whom the father of the first-mentioned already came under the protection of the Noble Company on the 17th of July 1748, persons who have extensive credit and are respected by the native government through their wealth and experience; and that he then further added to them these two youths, Bouwmandje Kauwtje, the nephew of Mandchergie, and Praamsinker Gowenram, the son of Gowenram Roederam, as second or assistant brokers, under this condition: that they indeed shall share and enjoy together the benefits which the Company grants to them for brokerage, but that nevertheless the two first-mentioned alone shall be answerable and liable for all the funds of the merchandise which, upon their demand, would be delivered to the merchants after the sale had been made, without them being permitted to resort to any excuses in this regard. Because of all which he, the Lord Commander, now proposed to this meeting to nominate and appoint as brokers of the Noble Company, subject to the honored approval of Their High Noble Mightinesses, in the manner proposed hereinbefore, the persons of Paalla Raamnaraam Sieuwnaraam, Saraatjent Nagerdas, and Praamsinker Gowenram. Whereupon, after deliberation and taking into consideration that the poor condition of the heirs of the deceased brokers Mandchergie Gorseedjen and Gowenram Roederam, and the large debts of the house of Mandchergie in particular, as well as the personal description of Bouwmandjen and Praamsinker, and the refusal of the first-mentioned, are completely and in all respects known to the meeting, on the one hand; and on the other hand, that the Lord Commander, according to the order of Their High Noble Mightinesses, is liable and responsible for the debts of the brokers, and therefore ought best to know to whom he can entrust the Company's commercial affairs, and consequently his own prosperity and security; it was thus resolved to accept the proposal made by the Lord Commander, and consequently to nominate and appoint as brokers, subject to the approval of Their High Noble Mightinesses, the aforesaid persons of Paalla Raamnaraam Sieuwnaraam, Taraatjent Nagerdas, and Praamsinker Gowenram. Because the Dutch flag is not yet flying nor is the factory restored, therefore we request the Lord Nabab etc. to be so good as to let our arriving and shipping goods pay a toll of 2½ percent as has always been customary under our custom, to which we hope Your Honour will grant your permission. The 14 November 1784 to pay as has always been customary among us, for which we hope your honour will grant his permission. Upon the request or petition of the Upperhead of the Dutch Company, Mr. Sluysken. At the top was written in the Nabab's own hand: To the Clerks of the Customhouse: Take care that as long as the Dutch flag flies, you continue to collect 3½ per cent, exclusive of the customary incidental charges, and allow the goods to pass and repass. Whereupon it was deliberated and, considering that at present there is no possibility of being freed from this increase of tolls and the payment of those incidental charges which other merchants, and among them the French, pay, while it would be fruitless to address the British ministry further on this matter, as they have already in their last letter of the 11th instant positively declared that such is their last and final answer regarding our trade until the Directorship shall be restored, it was approved and understood, as no other choice remains, to acquiesce therein, and to have the translation of the memorandum of the customary incidental charges for the custom master, being the English Council member Mr. Crokatt, as submitted by his native servant, also follow here, and to deliver a copy thereof to the Fiscal Monté in order to demand and settle the same as well as the toll from private individuals. It was now agreed, with the insertion of the resolution of this assembly of 4 November whereby the Pay Bookkeeper was expressly ordered to keep secret the resolution of Their High Mightinesses concerning the Surat Moors contained in their most respected missive of 21 December 1781, to order the same Pay Bookkeeper today, as stated therein, to proceed with the recruitment of 150 Moorish sailors mentioned in the resolution of the 29th October ult., to which end it was found good to allow the said Pay Bookkeeper, upon his request made thereto, 4000 rupees to be furnished from the cash under the usual guarantee. 18 November 1784. could in some cases be dependent on those which were to take place between the first-mentioned kingdom and France, with regard to such places as Trinconomale, which first had to be received back by Great Britain from France before that Kingdom could restore them to the Republic of Holland; and secondly, that the time of the surrender or restitution between France and Great Britain was not yet determined then, as the definitive treaty between both those powers was only concluded thereafter, or indeed on 3 September 1782. At least it may be established with certainty that it was never the intention of His Britannic Majesty, nor of Their High Mightinesses, to intend to determine by the definition of time in this manner that if the restitutions or evacuations between the first-mentioned Kingdom and France encountered any obstruction, delay, or refusal from either of the two powers, whereby the same were not effected, in such a case the restitutions and evacuations between Great Britain and Holland also had to be omitted and remain unexecuted. If this had been the will and agreement of the high contracting parties, there is not even a shadow of doubt but that this agreement 204 18 November 1784. would have been expressed and clearly stated in a subsequent article. It has therefore surprised us in the highest degree when we perceived from Your Honours' aforementioned letter that Your Honours, on such a far-fetched pretext, refuse to restore and evacuate to us this Directorate and the possessions of the Honourable Company at Souratta. A refusal, Gentlemen, which is all the stranger, and must be inexcusable, in view of the second reason which Your Honours are pleased to give for it, namely the refusal of the Marquis de Bussy to return Trinconomale as it is demanded by the Commissioners of Great Britain. For whatever the demands of these Commissioners may have been, and in whatever manner the refusal of the Marquis de Bussy may be, it is certain that the Honourable Dutch Company is the suffering party therein, because it remains deprived of the recovery and reinstatement into these its possessions, and that it offends against all justice and equity that Your Honours refuse to the said Honourable Company the restitution and evacuation of 18 November 1784 any of its possessions which have been brought into Your Honours' power by the fortune of war, because by the refusal of the Marquis de Bussy you are disabled from also restoring Trinconomale, or to say it more briefly, Your Honours are pleased to refuse the restitution and evacuation of a part because you cannot yet restore everything. The 18 November 1784 protest against this in the most emphatic manner, as we do most strongly protest against it by these presents, in the name and on behalf of Their High Mightinesses the Lords States General of the United Netherlands, our high Sovereigns, and the Noble Dutch East India Company, reserving to the same the right to demand such satisfaction from this Your Honors' refusal as the aforementioned Their High Mightinesses shall in time deem proper. Finally, we take the liberty to thank Your Honors very humbly for the kind congratulations contained in your aforesaid letter of 3 November concerning our promotion; we are also particularly sensible of the expressions which Your Honors were pleased to make therein toward maintaining the friendship that has been so happily restored between the two nations, whilst we on our part shall never fail to employ everything within our power toward that end; thus we hope that all the aforementioned reasons and motives will persuade Your Honors to comply with the repeatedly mentioned preliminary articles of peace. Whereupon, after deliberation and having taken into consideration that necessity seems absolutely to require that one publicly protests against the conduct of the English—which is so contrary to the concluded Preliminaries of Peace, which one learns were already converted into a definitive treaty of peace on 20 May last, and as contrary as it is disadvantageous and detrimental to the Noble Company—should the English refuse to rectify their conduct immediately, in order along that path to preserve and keep open for the Noble Company the right to claim the damages and losses to be suffered from the English Company. And it is furthermore understood that the aforesaid letter and original duplicate of the protest shall be sent to the Surat ministry, with a covering letter, for the further continuous request for an accommodation to be forwarded to Bombay, along with a request for access to the papers for further preparation; whereby it was further approved that, since one is unable to bring the affairs of this office into proper order and to answer the letters of Their Right Reverences according to their requisitions before the Company's papers have been returned, or at least before one has free access to them, to request therein that the Company's papers be returned to us or that the free use thereof be granted. After this, the Director submitted to the meeting for consideration how one shall respectfully answer Their Right Reverences in the next departing letter regarding their revered instructions of 21 September 1781 and 10 August of this year, in order to comply with the further clarification requested by the Lords Masters concerning the debts of the brokers, which have also been charged to him, the Director, for compensation, and in what manner the members of this council are able to obey this; to which question, the Junior Merchant and Warehouse Master Wiardi, and the Junior Merchant and Fiscal Monte (as the fellow Junior Merchant van Polanen arrived here only a few days ago, and is thus unacquainted with these affairs) declared that it was not possible for them to give Their Right Reverences any clarification in that regard other than what has been set down concerning this in the petition of the Director of 2 February 1777, read and carefully examined in the meeting today; but that it is very well known to both of them, and especially to Fiscal Monté, who has been appointed to the trade office of this Directorate for 30 years and has frequently discharged the duties thereof, that the brokers were indebted to the Noble Company when Mr. Bosman became Director and for a great many years prior; furthermore, that the assertion posited in the aforesaid petition of the Director to Their Right Reverences of 2 February 1777—by which he requests to be relieved of this assessment—namely that the brokers in the year 1763, at the time Mr. Drabbe transferred the Directorate to the Honorable Mr. Senff, were indebted to the Noble Company in the amount of f 469,913:10:8, is the pure truth and can be proven by the trade books, as well as that the same brokers on 2 December 1768, when the said Mr. Senff transferred the Directorate to the former Director Bosman, were still in actual arrears to the amount of rupees 101,378.3, to which sum the aforementioned Honorable Mr. Senff had reduced the debts that the brokers had upon the commencement of His Honor's administration as aforesaid; that it furthermore clearly appears that the debts of the brokers remained concealed for many years, both through the aforesaid practice of debiting the cash account for what those people owed, and through the manner introduced thereafter of having the brokers' account in the books debited at once for all the goods that were entered and sold, although they remained uncollected for years afterward, whereby they were then sometimes debited for over seven lakhs, without anyone being able to investigate how much they were truly indebted, unless he weighed all the trade goods and compared them with their debit; and that it had been the practice of Mr. Senff to use the monies that

208 The 18th of November 1784 which the brokers paid into the cash office at the beginning of one fiscal year, were entered into the preceding fiscal year under the date of Ultimo August, whereby in each fiscal year the debts that the brokers genuinely had did not appear; that furthermore the representation of the Lord Commander, namely that the monies for merchandise that were paid into the cash office at the beginning of the fiscal year 1768 or during the months of September and October, to an amount of rop:s 125724 47/60, were taken by the said Sentf in payment and settlement of the true debit of the brokers under Ultimo Aug:o 1767 preceding, and that these same brokers, by this arrangement, remained indebted in an equal amount for merchandise received in the aforementioned months of September and October /: is the sincere truth, and is evident from the own signature of the Honorable Lord Sentf in His Honor's notebook of receipts in the main cash office, which was submitted by the Lord Commander in this meeting and wherein was found written by the said Lord Sentf with his own hand as follows: The 18th of November 1784. Wherefore it was then resolved to let the aforesaid declaration serve, in the next departing missive, as a humble rescript and reply to the well-mentioned Their High Nobles' referred letter and requisition, while the Lord Commander requested that it may be respectfully presented to the Highly mentioned Rulers on his behalf that he is not capable of giving any further clarifications regarding these old debts of the brokers beyond those which he has alleged and demonstrated in his defense 209 The 18th of November 1784 in his humble request for discharge dated 2nd February 1777, as he is convinced in his conscience, and claims to have proven, that the same had already existed for many years and had been concealed by various methods until the said debts were fully discovered and brought to light by the manner in which he, the Commander, in the year 1769 treated the accounts of the brokers at the start of his service, by debiting them each month for the goods they received in that same month and crediting them again for the monies they paid into the cash office, whereby their exact balance was clearly visible under each month, and after the remainders of the previous years had been weighed out, it appeared that the brokers at the departure of Lord Sentf were still indebted for the aforementioned rupees 101377:3. The 27th November 1780 — In the hope of providing for his children, Your Honour's offer of a fourth part of the interest in the brokers' office, provided that the names of the new people were placed first, is contrary to the rules that are customarily used on such occasions. It is very hard that these people should precede the petitioner, who could not accept the same, out of fear that these new people, being of very little consequence, would not be able to sustain doing business as it was previously done by the petitioner's father. For when one considers it well, the function of a broker is not insignificant, but of great importance; they must sometimes take it upon themselves to negotiate matters with the Ministers, for which one cannot, in my opinion, rely upon these new people. The petitioner further demonstrates that the daughter's son of the English broker, when he was about five years old, was granted a palankeen by them, the English, by virtue of the services his relatives had rendered to the Company. And Your Honours etc. are convinced of Manchergier's services rendered to the Company, and while the petitioner is capable of the affairs, he is therefore astonished that since the broker's death no attention at all has been paid to the family. In the management of the purchase of the Company's goods, a considerable outstanding sum has remained due to the petitioner's father, and moderate sums might still be due from him; how that matter will be handled, the petitioner does not know, as well as a heavy balance due to the petitioner's father from the deceased Govindram Pandoll, whose son has been accepted into the brokers' office and has locked up the warehouses. The 5th December 1784 with the request therefore Be so good as to order him to settle everything; his long silence has been caused by the Company's lack of means in this place, which however is now recovering. Therefore requests that what he has demonstrated above may be taken into serious consideration and that the petitioner may obtain his right. For which kindness the petitioner's heavy family, consisting of about 200 persons, will pray to God for Your Honour's long and happy life. Whereas then finally the son of Gowenram, named Praamsinker, after having been called into the meeting to account for the complaint appearing in the aforesaid request of Bouwmandjen against him concerning the unlocking of his warehouse, declared that, having requested and insisted ever since the illness of Mandchergie to proceed with him to the drawing up and settling of the accounts between the said Mandchergie and his deceased father Gouenram, which has not happened for seventeen years, Bouwmandje had consented to this with great reluctance; but that when they had commenced with this about seven months ago, the latter had raised a dispute over carriage wages of merchandise that had been sent outside and had absolutely insisted that this dispute, although being only over a very minor December 1784. But that, Secondly, it is absolutely impossible to avoid the payment of the same in this city and as long as the Company has any property here, since the Nabob will make no difficulty in supporting this house, should it otherwise complain to him, and compelling the Company to pay, without one being able to expect any assistance December 1784 or support from the English, even if only because of the interest they have in this matter; it being even conceivable that, if these people were inclined to call upon the Company now and placed full trust in its justice, the English would certainly encourage them to make use of the present circumstances. And that therefore and, Thirdly, the best and most convenient way would be to insist with the English on the restitution of this aforesaid sum of one hundred thousand rupees with interest, or of that which one will have to pay to the house of Baysa; and that, if they refused to fulfill their obligation in accordance with equity, one then publicly protested against their conduct, having no other means at hand here, to be pursued subsequently in Europe, 227 5 December 1784 and that in the meantime the aforesaid house was paid.
