145 The 26th October Anno 1784. Tuesday, in the forenoon. Present: The Honorable Abraham Josias Sluijsken, Gezaghebber, The Junior Merchant and Warehouse Master Egbert Nicolaas Wiardi, The Titular Junior Merchant and Fiscal Mattijs Monté, and The Titular Junior Merchant and Secretary of Police Jan Iacob van Polanen de bevere. The Honorable Company's ship Trompenburg having arrived here in the roads on the 24th of this month without having had any extraordinary encounters and only with 6 dead and sick, there was received yesterday evening from the hands of the commanding Sea Captain Willem Udemans Junior the venerated missive from Their Right Honorable Lordships dated 10th August of this year. And it appearing therefrom that it has graciously pleased the said High Rulers to dispose over the administration of this Directorate as mentioned in the heading of this document, the customary oath of fealty and secrecy was thereupon first taken by the Honorable Gezaghebber into the hands of the members, and subsequently by them reciprocally into the hands of the aforesaid Honorable Gezaghebber; after which the deliberation on the aforesaid letter of Their Right Honorable Lordships was postponed until the first upcoming opportunity. Meanwhile, it was noted in this matter that the Elected Head Administrator Iacob van der Sleijden departed this life on the 14th June last, and that the Honorable Gezaghebber gave notice thereof to Cochin by missive of the 16th June, which will likely already have been brought to the knowledge of Their Right Honorable Lordships. That His Honor aforesaid, upon the requisition of the Governor of Cochin, dispatched thither for the service of that Government on the 20th December 1783 a quantity of gold and silver fabrics, according to the invoice of that date amounting to ƒ 9126:13:8 or Rps 7605. 27, besides Rps 255 for insurance money and freight; and on the 18th of this month per the private vessel The Greyhound, commanded by Captain John Musteafer, a small invoice of similar goods to the amount of ƒ 8223.-.- or Rps 6852. 44. 146 The 26th October Anno 1784. The Administrator has, by a letter to the English, requested permission to repair the wooden jetties by the missive addressed to the Honorable Administrator and the other prisoners of war, made known that they were released from all restriction as prisoners of war, and no longer had to consider themselves as such, while all further provisions were to cease as of that day. The Honorable Administrator subsequently proposed to the meeting how during his captivity he had indeed heard it advanced now and then among the members of the English Council that the Company had no right to unload its goods at the wharf; that this, immediately after the conclusion of those Preliminaries had been published here, had induced him to sound out how far they would wish to assert this claim of theirs at any time; that he therefore, after having first purchased a small lot of beams, had addressed himself to the English Council here by the following missive of the 25th September last, with the request to grant him permission to repair or if necessary renew the wooden jetties in front of the Company's wharf, which had become partly washed away and completely unusable, in order to ensure that the Company's ships, when appearing in the roads, could be unloaded immediately after the Directorate should be restored, and thereby to prevent them from having to remain lying unloaded for weeks. That having received hereupon the following laconic answer. To Mr. Abraham Josias Sluysken Sir! I have orders from the Chief and Council to acknowledge the receipt of your letter dated the 25th instant, and to inform you that it is not in their power to grant the request made therein to them. The Honorable Administrator had sent someone to the seashore with a request to the officers of the expected ship or ships, which request is changed into an order that he, the Administrator, had therefore judged it his duty to send the bookkeeper Roelof Berends on the 3rd instant to Bhimpor at the seashore with a note addressed to the captains or commanders of the ship or ships to appear in the roads, with a request and intimation to the same not to disembark any goods of whatever description from on board, but upon their coming ashore at Surat to bring along nothing other than their papers and a change of clothes. Wherefore His Honor now proposes to the meeting whether they might not agree with him to change that made request and intimation into a direct order to the ship officers, and thus to instruct the same by extract of the minutes to ensure that no merchandise or provisions etc. are sent from on board without further orders. Whereupon, after deliberation and having taken into consideration that one must absolutely refrain from complying with such a most unlawful and illegitimate demand, even though one has not yet been restored to the possession of the wharf

Having taken into consideration that one, in this correspondence with the English ministry and that which will further have to be written in the course of this disagreeable dispute, as well as at the restitution of the Direction with all that is relative thereto, absolutely requires a translator in the English language, and that among all the servants at this factory there is no one who commands this language, except the Commander whose occupations do not permit it; so it was approved The 26th October Anno 1784. Under approval a translator appointed. And a Purveyor. approved and understood, subject to the favorable approval of Their High Mightinesses, to appoint as Translator in the English and French languages the person of George Smit, being a Dutchman by birth, who has for many years been a burgher here, and to grant him the salary of 40 ropias per month; being the ordinary salary which Their High Mightinesses grant to a Translator; wherefore the oath of secrecy was administered to him in the meeting. Their High Mightinesses having, by their revered missive, graciously pleased to defer the appointment of a Purveyor to the ministry here, it was, out of consideration that the ship must immediately, as soon as permission thereto can be obtained, be provided with the usual refreshments and meat, upon the motion of the Honorable Commander appointed the Bookkeeper Anthonij de Sille. Finally, the Honorable Commander requested of the meeting to keep secret the disposition 150 The 26th October Anno 1784. Furthermore, it was deemed proper to record that the letter mentioned therein was duly delivered to the English ministry on the 27th of this month. That on the same day, when the Captain of the ship Trompenburg lying in the roads, together with the master of equipment here, Lotsz, were about to go on board, the sepoys of the English customs master Crocatt prevented the bedding of the aforementioned master of equipment from being shipped off from the wharf, without the complaints that the Honorable Commander caused to be made about this to the English chief having any effect. It was also resolved to thank Their High Excellencies for the favorable authorization for the levying of as many of the European seamen as will be needed here and can be spared from the ship. The 29th October Anno 1784. It was resolved, in satisfaction of what was written by Their High Excellencies, to instruct the Pay Bookkeeper Monte to take into service one hundred to one hundred and fifty Moors, good, healthy, and strong people, as soon as there shall be opportunity for it, to be sent with the ship Trompenburg, the report received from Batavia concerning the continuing Surat Moors being to be handed over to him. As well as to the further requests of the said Honorable Resident, to inform Their High Mightinesses that, in reduction of the 20000 rupees which he must pay in Cochin, he will allow to be applied: the rupees 14713 and 3 which, according to what was recorded by Resolution of the 26th of this month, he has sent thither in goods, and that he will likewise settle the remainder at the first opportunity. And to request the very same repeatedly to look with favorable regard upon his submitted petition for obtaining such sum of Rupees 5945: 13 as was credited too little to him in Batavia for the amount of two bills of exchange granted to his Supercargoes in 1782 by the servants of China, and to take into consideration that no exchange rates nor evaluations of specie to which bills of exchange may be subject, because money is worth more in one place The 29th of October Anno 1784. than in the other, can be of application here, since according to the nature of the transactions and his obligation upon the receipt of these moneys he ought solely to be regarded as a transporter of the rupees 110183:— which he received in Surat, and which he could suffice to return at any Company counting-house without having obligated himself to pay them to the company precisely in Batavia; that he also actually fulfilled his obligation (as far as was practicable for him after the robbery and plundering of the ship by the English privateer McClary) as soon as he paid the moneys to the Honorable Company in China, without him needing bills of exchange upon Their High Mightinesses for it, but sufficiently with a simple receipt of the reception of the value in China, wherewith he could prove his satisfaction of the Company, and which latter ought to have been given to his Supercargoes, who took the bill of exchange out of ignorance, 39. 164 The 29th of October Anno 1784. The Resident shall ensure the satisfaction of the debt of the broker. according to the value of the Surat rupee, which was omitted by oversight; while it is certain that the Company received Rupees 5945: 13 more in China, where money is worth so much more, than it returned in Batavia, and thus in truth in this transaction has not only, as the matter now stands, secured its Rupees 110183, but has indeed gained thereon the aforesaid 5945: 13; while it must additionally be noted that if the ship had perished in the open sea or had never appeared in China, and the moneys had been paid here out of the assurances negotiated upon the same, Their Honors would not have received back more than the received sum. The same having furthermore undertaken to count into the treasury here the balance of the estate of the late Chief Surgeon Jan Fromme remaining under his administration, in the amount of 9762:55 rupees, and to remit it by bill of exchange against the usual agio to the deceased's authorized agents, Themans and Company. An extract from Their High Noble Lordships' Dispatch shall be delivered to the Head Surgeon Peperhooven, as well as to the Bazaar Commissioners, with orders to conduct themselves strictly according to its contents regarding the shipment of rosewater and the packing of silk patolas respectively. That, concerning the prices, they are the same for which the goods were delivered in Anno 1780, and the contracting was last done in 1781; and that although at first glance it would seem that the linens should now be at a lower price on account of the great desire the workmen have to get back to work, and one indeed might possibly have had the opportunity to negotiate a lower price had everything remained in its former state, it was nevertheless only with great difficulty that the suppliers could now be persuaded to undertake it for the same prices, in view of the short time of 2½ months which they now have to make the collection, whereas previously they certainly had 9 months' time for it; and that, moreover, it is greatly to be feared that the Maratha government at Broach will not be satisfied The 4th of November, Anno 1784. with the payment of the same duties as before, and it is not yet known whether that government will now grant the same privileges to the suppliers as had been granted to them when the Noble Company itself had a factory there, first by the Mogul Nawab and afterwards by the English government, in accordance with its privileges, however much the Honorable Authority also had to promise to make every effort thereto; whilst they, the suppliers, will moreover now be obliged, through the lack of protection from the Company's small vessels, to pay at least one per cent for insurance money on the goods that are manufactured outside Surat, in order to be secured against robbers; so, for all the aforementioned reasons, it was resolved to let the contracting take effect without delay for the aforementioned last prices, but first to try whether the suppliers might not be moved to deliver the goods by the end of next December. 175 The 4th of November, Anno 1784. The 4th of November Anno 1784. Netherlands East India Company of the one part, and the Suppliers Rettingje and Souraabje, or rather their sons Berangie Souraabgie and Hamootjent Ruttungie, of the other part, concerning the purchase and procurement of the linens, cloths, and cotton yarns demanded by the respective requisitions Pro Patria and India for this current year 1784. Article 1. The contracting, delivery, and acceptance of all linens, cloths, and cotton yarns demanded by the aforementioned requisitions for 1784 shall take place on the basis of the same samples as those upon which the last delivery before the war in 1780 took place, after they have first been accepted and approved in the Council of Policy, and received on behalf of the Company insofar as the outward appearance is concerned; but as regards the lengths, widths, and weights of these cloths, one shall govern oneself according to the stipulation made in the requisitions, such that even if the samples should not contain the fixed length, width, and weight, nevertheless nothing must be lacking in that respect from the delivered cloths, not counting 1/4 of a weight and 1 or 2 threads. II. For the delivery of these goods, to wit for all linens, cotton cloths, and yarns, the suppliers shall enjoy the same prices that were paid for them last in 1780, and for which the contract was again made in 1781, with the exception of the photas with gold and silver stripes, for which they shall enjoy 248 rupees per piece for the gold and 185 rupees for the silver. III. In order that the suppliers may begin the work without loss of time and proceed with vigor, an advance shall be made to them immediately, as soon as the state of the treasury permits it, of 100,000 rupees in cash, and successively along the way as much more as shall be deemed necessary, in proportion as the goods are brought in. Article IV. The suppliers shall also be credited 1 1/2 percent for invoice charges on everything that they purchase at Broach, Cambay, and Baroda or thereabouts, and ordinarily bring here by water. V. On the other hand, the suppliers shall be obliged to bring nothing but sound goods to the bazaar, and if some pieces among them should occasionally be found to be deceptively woven or otherwise extraordinarily bad, the same shall not simply be rejected, but confiscated for the benefit of the bazaar commissioners. VI. They, together with the commissioners, shall also be required to make compensation for all such pieces as may occasionally be found short, damaged, or defective upon opening well-conditioned packs in Europe or India, according to conclusive evidence; to wit, the suppliers three-fourths, and the bazaar commissioners one-fourth of the cost price thereof. VII. The suppliers expressly bind themselves to satisfy and bring to the bazaar by mid-January 1785 the entire requisition for India, with the exception of the silk patolas and the Broach baftas with gold heads, of which they shall deliver as much as possible, and likewise half of the requisition Pro Patria, with the exception of the chintzes. VIII. Lastly, everything that is not ready by that time and might be brought in later shall not only be left for the account of the suppliers, but they shall also be obliged to return immediately in cash whatever they may have already received by way of advance upon it, in order thus to settle the contract account properly in due time. For the observance of all this, the suppliers pledge their persons and goods according to law. 6 November 1784 And whereas it was resolved the day before yesterday to have new samples made for the delivery of the goods mentioned, which will be done according to the old samples of the Company, and to inspect and approve them in the meeting, the Director has now informed that during the time he was a prisoner of war, and also after that, he was fortunate enough to regain possession of the old samples, according to which deliveries have continually and for years past been made, and which had also been taken away and sold by the English, as appears from the inventory handed over to them; and thus to prevent the suppliers from having the opportunity to mislead this meeting and consequently harm the Company by making or producing samples of inferior quality and value. For which reason it was agreed to inspect in the meeting the aforesaid samples, which can be very well recognized by the written acceptance still found upon them and the seals of the Honorable Company, and thereafter to have them written upon and sealed anew, as mentioned in the resolution of the 4th of this month, without however removing the old descriptions and seals therefrom. 181 6th November 1784 The Director having subsequently informed the meeting that all his efforts, both with the English Chief Mr. Day and with the principal members of the Council, to obtain permission for unloading and shipping at the wharf, had been in vain, as all declared that it is entirely beyond their power to act otherwise than they do, since they solely execute the strict orders received from the government of Bombay, His Honor thereupon submitted the following letter, received by him this morning from the Secretary of the English. To Mr. Abraham Josias Sluysken And Messrs. Egbert Nicolaas Wiardi, Matthys Monte, Jan Jacob van Polanen de Bevere Sir and Gentlemen, The Chief and Council have ordered me to acknowledge the receipt of your Honors' letter dated the 29th past, and at the same time to inform your Honors that they cannot alter their manner of addressing before they are authorized thereto by their superiors in Bombay; and as for the signing of their letter solely by the Secretary, it is the custom in the Honorable Company's service that the Secretary signs all letters to persons who are not in a public national character. The Council must, however, observe, Gentlemen, that in that very letter in which your Honors complain of not being addressed by your proper title, your Honors are yourselves defective in the manner of addressing our Chief for the Affairs of the British Nation etc., as your Honors were duly informed in a letter of 5 December 1759. Regarding the bringing ashore of your Honors' necessities: the Council has already informed your Honors, and is still of the opinion, that the Nabob, upon proper request from your Honors, will permit your Honors to land and ship all your Honors' people, baggage, provisions, and merchandise at his custom house without any delay or hindrance whatsoever; and the Council is persuaded that the officers belonging to the custom house of the Nabob have done nothing more than their duty. 183 The 6th of November 1784 To the Honourable Thomas Daij Esquire Chief on behalf of the Affairs of the Honourable English East India Company and Governor of His Mogul's Castle and Fleet together with The Council at Souratta Sir and Gentlemen After we have looked out for six days for an answer to our letter of the 29th of October and had expected in vain that your honour would have come back from refusing to our ship that which is not refused even to the most unknown nation, we receive a letter from the secretary of your meetings, Mr. Robert, dated yesterday. We request permission to observe that we have given the Chief that title which his honour has always previously been given as far as our memory allows. The conduct of your honour towards us is so unheard of that we do not doubt but that it will be condemned by your honour's own superiors; never was there an example that any authority or The 6th of November 1784 government refused to receive and acknowledge as such the delegates and authorized representatives of another sovereign when provided with a lawful commission, unless both nations were at war. Without expressing ourselves here regarding the referral to the Nabab, we take the liberty to repeat that we, and specifically the first signatory, by a public commission from His High Honour the Governor General and the Council of the Indies, dated at Batavia the 9th of August, under the great seal of the Honourable Netherlands East India Company, are charged and authorized to take over from the Governor and Council of Bombaij or from those who shall be authorized thereto, and to restore the possessions of the Honourable Netherlands Company at Souratta, etc., pursuant to and in compliance with the preliminary peace articles concluded on the 2nd of September 1783 and ratified on the 26th of the same month between His Britannic Majesty and Their High Mightinesses the States General of the United Netherlands, and that we thus have only to do with those who are placed in the management of their affairs on behalf of the Honourable English Company. It is in this capacity that we have requested your honour to render to us in our aforesaid capacity the conveniences and services mentioned in our letter of the 26th of October, which your honours are pleased to see fit to refuse us in such an unheard-of manner, and whereby the ship of the Company still lies in the roads in the same state as it arrived, and which in case of a further refusal of 184 The 6th of November 1784 these friendly services, while we continue to await the answer from the Governor and Council of Bombaij, will place us under the disagreeable necessity of seeking a way out for the preservation of the ship and cargo, and leaving to you, gentlemen, the accountability for this refusal. It is said there has come an order from Bombay to prevent the unloading of our Company's goods and merchandise at the Dutch wharf, at the place where we have done so for many years and at the time when the wharf was seized, and when your Honour was Chief at Surat, and to which the Noble Dutch Company has an unquestionable right, it having been granted to her by Farman of the Great Mogul Muhammad Shah in the year 1729, which Farman is currently still in the possession of your Honorable Council here and can be found under No. 29, and as I think in the Bamboo, wherein among other privileges it is expressly stated that they (the Dutch Company) shall be permitted to purchase for their own money in the Singie Bunder outside the walls of Surat on the river side a piece of land, and there to construct the necessary places for the unloading of their merchandise, which Farman has always been in full force and still is, never having been disputed by any of the English Chiefs, and admitted under the Nawab's own handwriting until the time that we were captured. 1784 190 The 12th of November 1784 with its full cargo, destitute of everything and moreover so leaky that the pumps must be continually kept going. For this reason we take the liberty to request Your Honours to be pleased to provide us with permission that we, upon payment of the usual toll of 2½ per cent, may unload at the Toll place near the sjap or Castle gate, at the place where we shipped the Company's goods and merchandise before the war, and to grant us that we may make use of the Warehouses standing on the wharf as the only way to unload the ship here and to be secured against heavy losses which we cannot avoid if we should be obliged to store the merchandise, and especially the spices and the copper, under tents or in rented warehouses which are scattered throughout the entire City. Finally, the first undersigned embraces this opportunity to testify to Your Honours how greatly it will serve his pleasure whenever he shall be fortunate enough, during the time that he is at the head of the Dutch Directorate at Souratta, to foster and constantly increase the good harmony and Friendship which has been so happily restored by the Peace between the two Nations. The 12th of November 1784 having been dispatched to the same that very day, the Gentleman in Authority thereupon produced in the meeting the answer to the same, which had been delivered to His Honour yesterday evening, dated the 11th of November, and of the following content: To Mr Abraham Josias Sluysken, Director, together with the Council for the Affairs of the Dutch Nation at Souratta. Gentlemen, Your Honours' letter dated yesterday we have duly received. As soon as we shall have received orders from our high superiors for the restoration of Your Honours' Factory and flag, then the buildings will also be returned to Your Honours, with all lawful privileges belonging to Your Honours' Factory. In the meantime, although it is not at present in our power to grant Your Honours all the privileges that Your Honours formerly enjoyed, Your Honours may be assured that we shall grant Your Honours all protection, assistance, attention, and indulgence that one European Nation has a right to expect from another; and as there is at present no alliance in existence between our two sovereigns, Your Honours shall in all respects enjoy the same freedoms in trade 191 The 12th of November 1784 as have been granted to the French since the happy renewal of the peace, and consequently be permitted to land and ship at the Dacca gate. Your Honours must be convinced that we have not caused a moment's delay in the unloading, loading, and dispatch of Your Honours' ship, as we informed Your Honours in our first answer of the 29th ultimo, as supercargoes of a merchant ship, that Your Honours had full liberty to pursue Your Honours' commercial affairs by way of the custom house. It is not at present in our power to permit Your Honours the use of the Warehouses on Your Honours' former wharf for the conduct of trade. In providing rooms for Your Honours there, we hope Your Honours will be pleased to regard this as an act of civility and courtesy in which we consider ourselves happy to show our inclination to contribute to Your Honours' ease and convenience as private individuals. However, we must use this opportunity to inform Your Honours that this must be regarded as our final answer regarding your trade until Your Honours' factory shall have been returned.
