The most favorable turn which the President and Council can give to this behavior is a supposition that perhaps the re-established peace between the respective nations has not been made public in all the cloth districts, and that on that account some persons are bold enough to make a bad use of this omission; we are therefore authorized to request that your Excellencies will be pleased to order this publication as yet to be made, not only, but also, after the example of 1775, that notice may be given throughout all the provinces of your Excellencies' express desire that nobody of your subjects shall hinder in any way the gathering of our Company's investments, under all such penalties as your Excellencies may deem proper and sufficient to enforce a punctual performance thereof. This having been thus far written, we receive a letter sent by the secretary of this Government to our President under the 8th Instant in answer to his letter to his Excellency the Governor General of the 9th Ultimo. It appears thereby that the above-mentioned complaints had been transmitted to the Board of Trade in order to enquire thereabout, and that it was the intention of this Government to have the trade of the Dutch carried on in every respect on the same footing as before the late war. We are authorized to return the thanks of our board to your Excellencies on this occasion, but as experience has learned that enquiries into those complaints often tend to delay matters and to give another turn thereto, we repeat our request that your Excellencies will do us the favor of giving public notice of the above-mentioned your intention and desire, as this will be of immediate effect, whereas the inquiries will be of no use. 315 We request to know whether the English Company, in its capacity as Diwan of the Khalsa Sharifah, has the power to enter into such agreements in trade and other matters with us and other European nations firmly established here, as previously used to happen with the Lords Nawabs, or not; and also whether the English Company, in the aforementioned character of Diwan, can annul our acquired firmans or letters of privilege, or whether they ought to offer us a helping hand for the furtherance of our trade, etc., in order to maintain the same. Currently, the English Company, on the contrary, seeks to subject us to an increased payment of tolls on the goods that we export from the country, and has sought to burden us with tolls on such goods as were previously imported freely with our ships. What is more, it prevents us from transporting imported goods inland to the respective places other than on rowannas granted by it; whereas the firmans residing with us very clearly dictate that we can send all our goods throughout the entire country on our own dastaks, and that the same must be respected everywhere. And although in citing all this we intend to give neither to Your Excellency nor to the English Company any cause to think that we wish to enter into any dispute concerning the aforementioned Diwani, it is nevertheless very necessary to know in whose power the government of the country rests. Therefore we take the liberty of requesting to be favored with a parwana from Your Excellency, in pursuance of which orders we may know whether we ought to conduct the affairs of the Company with the English Company as rulers of the country or in another capacity. That the following day he placed two harkaras and a sepoy with the petitioner's pykars, whereby the weavers and pykars were prevented from coming to them, and that trade has been obstructed by all this. The Nezans, Hasb ul Mokkums and Senneds relating thereto both at Surad and in Bengall, include not less than the right of citizenship and subjects of the Hindostan Empire, without, however, the Company being bound to any other but their national laws and for this right owing no other acknowledgment than, besides the customs duty, the payment of the fee or Chazannah of the grounds they inhabit and which have been ceded to them as allodial property. The strongest proofs thereof are to be found in the literal purport of the Firmaunds of Shah Jahan and Aurangzeb. According to these, the Netherlanders are admitted throughout the whole empire. They may conduct their affairs at their ease, without trouble or hindrance by anyone whatsoever. Travelling either by land or by water, they may daily cover as much distance as they themselves see fit and, halting here or there, store their merchandise where they desire, without anyone under the Mogol government being allowed to trouble or detain them. On the contrary, in all provinces, towns or districts wherever they come, everyone is obliged to recognize them, render help and assistance, and what is more, to provide all possible safety and security in the continuation of their journeys. Beside this extensive privilege equal to that of a native of this country, the Viceroys of these provinces have by their Senneds transferred to the Netherlands Company the possession and use of the villages Chinsura and the Bazaar Mirzapore belonging thereto, likewise Baranagore, for which they annually pay the Chazannah or ground rent to the lord of the country. 321 The free and uninterrupted enjoyment of this privilege has certainly much contributed to the prosperity of Chinsura and induced many great merchants and other persons of distinction to make their habitations there. All those have always been considered as entitled to the immediate protection of the Company, and they have often been protected against all such vexations and violences as were practiced in former times by the Moorish government, which often summoned persons before the Durbar notwithstanding the orders concerning the rights of protection and jurisdiction stated there against by the firmans of the Emperor, which plainly dictate that often difficulties having arisen on account of and with all such persons as were indebted to the Company or who were its subjects, by their being either in person or in the persons of their gomastas or vakils on some pretext or other summoned before the tribunal of the Subah, by which means the Company often found herself deceived in her claims on the same because the causes were then kept in suspense or remained undetermined to the great prejudice of the Company's affairs. All those practices are expressly forbidden, with orders even to deliver all fugitives or such persons as concealed themselves on the least complaint thereof. But notwithstanding this, the exercise of this right is not free from difficulty and hindrance, and that chiefly occasioned by a mixture of lands within Chinsura, which in part consists of Company's and in part of Moorish ground, situated within the perimeter of our limits. Those who inhabit Moorish grounds, having their houses and properties, and in short a fixed domicile within Chinsura, who are not Patta-dars, although they are our inhabitants, generally carry on a fairly extensive trade compared to our subjects. They land their merchandise within our colony and export and import everything at their pleasure, without paying any duty to us as possessors of the whole village called Chinsura. They dispose of their immovable property in the same manner, and regarding the chout or the government duty that is to be paid thereon, we must rest satisfied with the agreements they make with the Haldars. They alienate or dispose of their property without paying any regard to us otherwise, except in case they have some disputes with the Moorish government, when they are very ready to pretend and make agreements with the Haldars of the government about the paying of the duties, although they enjoy the same benefits and privileges as the Company's subjects, who are distinguished by the name of Patta-dars or such as pay ground rent and other duties to the Netherlands Company. Those who have a fixed domicile within Chinsura refuse sometimes to acknowledge their subjection to the Company. and Hindus remain under the jurisdiction or the decision of the Nawab or his representative, and that the decision of all civil and criminal causes of Armenians and all other Christians shall be left to us in the same manner as of the subjects of our Republic and the servants of the Netherlands East India Company. We perform our duty in requesting an equitable reflection from Your Excellencies and Honours, as also toward the satisfaction of those claims of which, apart from the general account, the proofs under Exhibits No. 2, 3 and 4 are respectfully annexed hereto, and that with such benefits in addition as may be found by Your Excellencies and Honours to be consistent with generosity and justice, in order to compensate for these unhappily sustained losses and the loss of profit occasioned thereby to one as well as the other party. as has been customary and as we have proved from the contents of the Company's privileges, they may proceed on their journey up and down the river and the Company's service may be free from all unlawful hindrances. We also find ourselves obliged to trouble Your Excellency and Your Honors further with complaints that have been received from the aurungs Baddaal, Jaggernaatpoer, and Malda by the President of the Council at Chinsura since the delivery of our memorandums, wherein among other things is shown the very severe proceeding of Mr Charles Grant against the progress of our Company's affairs, which are of such a nature that if it is not immediately redressed, the gomastas declare that they run the danger of seeing all the money advanced on the Company's account lost. We shall have the honor to deliver a copy of the letter to one of the Gentlemen Secretaries of this Government as soon as it shall have been translated into English. Meanwhile we may not omit, in view of the imminent danger of the damage to be sustained, to repeat our request to Your Excellency and Your Honors for an immediate proclamation of peace in the aurungs and at the same time also such an order as is most necessary for the promotion of our affairs, and as was requested after the example of 1775 in our second memorandum, the more so as it appears from these further complaints that the oppositions and hindrances are mainly grounded on the lack of permission for an uninterrupted progress of our trade in the aurungs. We shall be exceedingly obliged to Your Excellency and Your Honors for a copy of the aforesaid requested orders, both to the Collectors and to those that serve to be sent to the aurungs, in order to be able to send them principally for the reassurance of our constituents pending the negotiation over all the main matters. have the Gomastas broken up, to which the Naib of the Cathorie gave this answer: I have not called those merchants here, they have come here of their own accord; previously they have always been here and have performed their work; they are not merchants that one simply chases away; I am the landlord, in my district live merchants, thieves, and robbers, and all kinds of people; when traders arrive, I must therefore, according to custom, assign them guards; to what purpose then serves what you tell me? You have the power, make them move if you think fit. To which they answered by saying, it is good, it is good, in 8 days we shall burn that lodge. After that, the hawildar and sipahis came to us and said: our master forbids you to establish a washing place here, or to hire washers, or to purchase linens; bring permission from our Company and you can then make purchases, which cannot happen without a perwannah. We answered them: we are not servants of your master to execute his orders; we shall follow the orders of our Company; what perwannah does your master have in his possession by virtue of which he forbids us to buy? We shall make purchases here and we shall establish a washing place; report this to your master, and let him then make us depart. Upon this statement, two or three of them departed, shouting: it is good, it is good. We had given money to seven washers from Seerpour and had them come here, who were then in our lodge; they were carried away and we were forbidden to set up furnaces for boiling the linens, with the threat that if we did so, the same would be destroyed. Having said this, the rest departed as well and kept the washers imprisoned. So much violence have they committed against us, and placed guards on the four sides of our lodge so that not a single weaver or pykaar can come to us. You are our masters; if you can provide for this, the service can be performed, otherwise all the money that we have advanced here is lost. On the 19th of the aforesaid month they seized seven dallaals and pykaars, and imprisoned them in their lodge; today those people have returned, after they had signed a written bond, the Gomasta of the English having shown three or four letters from his master to those people to convince them that he acted thus on his orders, and adding that he could not allow them to work for us, that it had been learned that they had prepared some linens, and that he had received a very sharp letter about this which he showed to them. We send Your Honors without delay a cossid with a report of all that has occurred, so that you may ensure that better order is established here. The 24th of Sawan 1192, being the 6th of August 1785. The reply received thereto this afternoon, written to us by Secretary Hay by order of the High Council, dictates in substance that the subject of our aforementioned letter is to be taken into full consideration on next Tuesday along with the other representations submitted by us last Friday, the 19th of this month; but that, because one of our ships had already arrived and it appeared to be our wish that the delivery of its cargo at Chinsurah should be facilitated, orders had been sent to the Department of Customs to allow all boats and vessels to pass unimpeded, without search or detention, both up and down the river with goods of or for our ships, until the assembly shall have determined upon the differences which have been presented to it by us with respect to the Customs; it being expected of the Direction of Chinsurah that it will please them to bring forward the declaration or manifest of the cargo or cargoes, whenever these might be required, for the verification or confirmation of the amount which shall be judged proper to be paid in satisfaction of duties, as soon as agreement shall be reached with one another regarding the percentages. As far as this last part is concerned, so as not to be diverted from the matter itself, we shall not enter into any detail, but await what the resolution shall be on what is aimed at regarding the principle of the difference; and meanwhile we may express our gratitude for the consideration which they have provisionally pleased to give to our solicitation, inferring therefrom with some foundation that an attentive consideration of our representation may have a better effect than appeared to them beforehand. paid before the late war. our Committee of Revenue has been directed to give the necessary orders to supply the Dutch agents at Patna with such a quantity of crude opium as shall be required for the above-mentioned number of chests at the price that was usually paid before the late war. We have had before us the several vouchers that were transmitted to us from the Director and Council at Chinsura on the complaint made by the Dutch Chief at Calcapoor against Ensign Morris and other officers, for their conduct toward Mr. and Mrs. Verspyck on the 20th of last month. Lieutenant Crawford and Laird and Ensign Morris were arrested on this complaint, a specific charge was preferred against them, and according to the rules of our military service, it is necessary that they should undergo a trial by court-martial. The trial will be immediately ordered, and Mr. Verspyck will have an opportunity afforded him of substantiating his representations before a respectable tribunal, and of producing such evidence as he may think proper in support of them. This evidence will become a matter of record in the proceedings of the court-martial, and should the issue not prove a sufficient satisfaction to Mr. Verspyck, a prosecution for damages may be commenced at his instance in the Supreme Court of Judicature against the gentlemen who are said to have insulted him, and we shall pass such judgment on their conduct as it may appear from the proceedings of the court-martial to require. We do not doubt that we will be enabled, in the course of the coming week, to provide Your Excellency and Your Honors with the reply of the Council at Chinsurah on this period, finding ourselves even placed beyond the possibility of reporting our opinion on it, as it forms no point of our instructions in the Commission with which we are charged. 343 Honorable Sir, We have duly received from the hands of Mr. van Haugwitz the two packets consigned to us, together with the letters which Your Honor did us the honor of writing the day before yesterday concerning the papers enclosed therein. The packet addressed to the Supreme Council here was immediately dispatched by us to the assembly, which was still in session upon its receipt, accompanied by a letter to Mr. Hay, Secretary for the Department of Foreign Nations. Regarding the other papers, and on the basis thereof, the declaration demanded by the Deputy Collector of the value of the cargo of the ship Constantia, we are of the opinion that this demand is entirely unsupportable and inconsistent with the sense of the order of the Supreme Council, as it clearly implies that this declaration is only required once the percentage duty has been agreed upon or settled between the parties. We have the honor to return herewith the documents sent to us for perusal, and on the strength thereof, we remain of the opinion that they only serve provisionally not to hinder us in the dispatching up and down of small craft to and from the ships. Until this hour, we remain uninformed as to what may have been decided upon our submitted representations; it is certain, however, that the gentlemen were assembled about it yesterday, as the papers which we still had in hand were requested from us early in the morning.
