346 The Governor General has directed me to acknowledge the receipt of your honored letter of today's date, and to inform you in reply to it that he is very much inclined to comply with your wishes, but that he is very sorry that circumstances preclude him from doing so at present. The reason is this: the best yacht that the Company has in service has already been down the river for some days to wait for passengers who are expected on one of the European ships, and the small yacht is at present employed at Sooksagur and is not a vessel suitable to go into rough water. The Governor General commands me to inform you that the large yacht, as soon as it returns, will be immediately employed according to your request. Still being uncertain when it will please the Gentlemen of the Government to answer us, let alone seeing an end to our commission, and meanwhile feeling the burden of the expenses arising therefrom, we very politely request Your Right Honorable to be pleased to induce the shroff Niloeziel to send an authorization to his gomastah residing here, to advance to us provisionally on account of the Company one thousand rupees on bond, to be accounted for in due course to the Assembly along with whatever more we might require. We are sorry that His Excellency the Governor General Macpherson was unable to comply with the request made on our behalf for the yacht to fetch Director Titsingh, and we shall endeavor to supply the lack thereof in the best possible manner. Likewise we must express our regret that we have not been able, pursuant to your request, to persuade the shroff Niloeziel to assist you there with 1,000 rupees, to which he declares himself to be utterly unable. We have therefore been able to devise no other means to procure you that needed money than to authorize you to raise it there, if possible, on account of the Company, for which we hope you will be able to find an opportunity, since, should this not succeed, we are completely unable to assist you, being ourselves in such embarrassment for money that we cannot pay the so necessary expenditures for board money and wages to the servants, and for that reason it would be very agreeable to us if you, above what is needed by you, could also procure something for us. We have spent the past week here again without hearing anything with regard to our commission. The answer from the Lords Nawabs, as it appears, is also not forthcoming, and it is possible that, without declaring themselves, they seek by making us wait for it to render us impatient and cause us to abandon any further effort. But as that would not answer the intended purpose, and having once begun, one ought not to let the matter drop or lose sight of the principal point, namely the desired declaration regarding the sovereignty over us and others in the Hindostan Empire, it has occurred to us, as there is nothing to be gained by sitting still, that the cooperation of Your Honours might very likely be of some effect for us. Not that we mean thereby that Your Honours ought to engage in a special correspondence with the Calcutta Government concerning the commission, but rather to adopt one or another permissible political measure in order to set the British gentlemen in motion and, as it were, compel them to fix their attention on the matters and bring them to a final conclusion. At [illegible] No 37. 349 350 To that end, we believe that there is no readier course to take than to cause all manner of inconvenience to our dependents, whoever they may be and whoever may be included under that name, and to prevent them from carrying on their trade in contempt of the authority of the Company and under the favor of English rowanahs. The community ought now to be notified of this by the affixing of placards; but, pending the negotiation, so as not to proceed to extremities, it seems to us that it would be sufficient for the time being if, by an extract from Your Honours' resolution, the Fiscal is instructed, in this capacity of his as well as that of Village Master, to attend to the execution of this intention, and consequently to prohibit generally any goods, of whatever description, from being loaded from the shore or dispatched, or brought into or taken out of our village, otherwise than with an ordinary dustuck, and to challenge or prosecute according to the exigency of the matter anyone who wishes to make use of an English rowanah, in order thus gradually to accustom them to the obligation to show the due gratitude for the right of residence and protection as well as the carrying on of trade in and under our jurisdiction, and to pay a tolerable tax whenever matters might reach the point where the intended object is attained. All the stir that can arise from this is the complaint of one person or another to the Calcutta Government, if in such a case or cases they regard it as their competent judge, which will then have to appear if that Government should see fit to confer with us about this. Also, the Hoogly Collector, upon the dispatch of a vessel or vessels with dustucks, will apparently, just as recently again, arrogate to himself the right to refuse them passage otherwise than with a rowanah from him. In such a event, and in case of complaint about this, it is inevitable, under delivery of a written protest, to hold provisionally for his account and responsibility all costs, damages, interest, and lost profit that might have been suffered or may be suffered by the refusal of passage and the delaying of the voyage of such vessel or vessels, in order to recover them as, where, and when it shall be judged proper. It is certainly Your Honours' earnest desire as well as ours to submit to all the trouble and inconvenience that might be attached to maintaining the all too much despised honor of our nation in the protection of the rights of our Company, in such manner and insofar as we are endowed with the means, to show that we cannot and may not suffer any infractions and injustices; and with that zeal and sincerity we have the honor always to remain, Honourable Lord and Gentlemen, Your Honours' very humble and very obedient servants, Jacob Eilbracht, Cornelis van Citters Arnoutsz. 352 hesitation that exists among the English Gentlemen in this place, and we therefore very much wished to be able to cooperate in bringing Their Honors to a speedy settlement of matters. However, after mature deliberation, we could not give our approval to the means proposed thereto by Your Honor, namely to compel our residents to export and import their goods under our Desteks and not under Rowannaks, because we fear that this step, as Your Honor is negotiating in our name concerning the Tolls and the enforcement of respect for our Desteks as before, would be regarded as untimely, if not premature, and besides it would also be of too much detriment to the inhabitants of our Colony, since thereby the little Trade that is still carried on must completely fall away; for what would it profit a merchant whose transported goods, both incoming and outgoing under our Desteks, were detained, that one protested against that detention, without having the power to procure so speedy a release of the same that that delay brought him no damage; the prospect of the uncertainty of the compensation that one might claim by virtue of that protest would not encourage him to proceed in his undertakings. We have therefore thought it best to let that matter remain as it now is, until the point of the tolls and Desteks shall have been settled with the High Council. If it happens that we are restored in our transit rights regarding that and are assured that our Desteks will everywhere meet with the proper respect, then we can rightfully demand that our Residents in that respect also acknowledge our authority and pay the due tribute for carrying on a free and undisturbed Trade under our protection, and we rest assured that in that case no one will be unwilling to do so, or if such a person might be found, one will be able to compel him thereto with reason and fairness. Meanwhile, to bring about if possible greater expedition in this matter, we have decided ourselves to write to the High Council with a request for a prompt reply and settlement of affairs; we shall also have the gentlemen Nawabs petitioned for that, and we think that it would not be useless if Your Honor also from time to time pressed for it in writing; the complaint in the accompanying Kassembazaar letter concerning vexations in the Arreng Nannoor will give Your Honor an opportunity to demonstrate the disadvantage we suffer through their delays; the same 353. 35 4 the same will occur more frequently within a short time, as we daily expect goods from the arrengs, all of which being brought in with our Desteks will certainly again provide cause for complaints; a constant repetition thereof and persistence for an answer will finally make those Gentlemen weary of it and compel them to come to a decision on the matter. Nevertheless, in accordance with Your Honors' authorization, we shall do our best to negotiate here at interest the money we require and, if possible, some additional funds to support the Chinsurah treasury. However, we cannot in truth express enough astonishment at the conduct of the aforementioned Nilu Sett as well as that of others, namely in leaving the Company in such great embarrassment that Your Honors do not know how to cover the necessary expenses of the garrison's pay and board. This denotes more than mere indifference. From this vexatious conduct it can only too clearly be measured how far the affection of the native extends and what reliance can be placed on his assistance when a crisis arises. How far such a people deserves to be patronized and, as Your Honors remark in your second letter, ought not to be prejudiced or prevented in the pursuit of an unhindered trade through the use of English Rowannahs instead of the Company's Dustucks, can be better judged than described. The only liberty we take to remark upon your resolution is that our opinion regarding the Dustucks concerns only those who, we believe, in the pursuit of their private trade, cannot or may not proceed according to their own discretion, but must submit to the one who rules over them and whose privileges, whenever they maintain they may claim them, they eagerly invoke for help; even though they now, because the Company attempts to prevent them from doing so, make use of illicit transactions with foreigners, setting aside all fidelity and duty to the Honorable Company. The extent of your various memorials and the emphatic representations contained therein required the examination of the entire correspondence which had been conducted for years past between your Council and this Government; for it was our sincere desire to make the most precise arrangements in order to prevent all future hindrances in the conduct of your trade in Bengal, and this has been a principal cause why our reply to your various representations has been delayed so long. It is particularly agreeable to us to put an end to this delay at present, by acquainting you with our sentiments and resolutions on the questions which you have laid before us. These resolutions may possibly not answer your wishes in every respect, but they are as accommodating and decisive as our powers permit. We observe that many of your demands are not originally new, but have been brought forward from time to time over several years prior to the commencement of the late war. We find that notice of them was given to our superiors in Europe, and that no such precise orders have been received as could serve this government as a guide in its decision upon the same; yet we hope for excuse when we take this opportunity to remark that we, on our part, entirely did not expect a renewal of old demands after the former Director of Chinsurah and the Governor General of Bengal had entered into an agreement in 1780, which was brought into being by the accession thereto of your Director and Council, as appears by their letter to the Governor General and Council dated the 28th April of that year, whereby it is stipulated in the 6th article "that the Dutch Government should not renew any of their former claims, but that the accommodation then settled should be final and decisive." 360 Tollhouses, Your Honours will please to bear in mind the security with which your trade can now be carried on, and the unavoidable expenses with which the maintenance of that peace and security is accompanied. It is very well known, both in Holland and Great Britain, that the most formal sunnuds of the Mogul Empire, ever since the beginning of our respective Companies establishing themselves in Bengal, have served little for the protection of the commerce in this country, unless one procured the favour of the native administration to give weight to those sunnuds; and it has frequently happened that our respective Factories have had to undergo the very heaviest and most violent extortions. The nature of the inhabitants and that of the commerce of these provinces brings with it, moreover, that without exercising monopolies to a certain degree, one can obtain no manufactures, commerce, or revenues; and those only, who are totally unacquainted with the condition of India, can suppose that one can obtain the advantages of the Bengal commerce without having a share in the difficulties which are necessarily attached to the constitution of the country and its particular administration. The English Company has never, with all her local influence, obtained these unmingled advantages, and how can she procure for others that which she cannot obtain for herself? Such, however, are the requests which are often made to us, and which are insisted upon as matters of privilege. The first point which Your Honours have done us the honour of submitting to us relates to the duties with which your commerce is burdened and the power of the Director at Chinsurah, or the Chiefs of your subordinate Factories, 361 to grant dustucks or passports. Your Honours desire at the same time our attention to a claim which Your Honours renew on the part of the Dutch East India Company, namely, to a free and uninterrupted trade. In making this claim, we could have wished that Your Honours had given an exact definition thereof. are now greater than they ever were, long before the recent war, as several interruptions and exactions which formerly impeded it no longer take place. An income of about nine lacks of rupees is now remitted to the zemindars, who formerly demanded a toll at their watch posts on all merchandise that passed by them. In the recent Peace Treaty, however, no explanation of your lint was given, nor were any arrangements made on that subject, and we have received no orders from the East India Company to abolish the established tolls. The Government toll which is now levied on the goods that your Honors import and export is, just as it was before the war and indeed as it has been from time immemorial, 2½ per cent, and is payable at any of the custom houses within the provinces. We transmit enclosed herewith, for your information and instruction, a copy of the regulations made at the Buxbunder or native Custom House. We trust that your Honors will find them so clear that no dispute should take place regarding them on behalf of your commerce, and so free from any substantial objections that through them all causes of difficulty or hindrance will be cleared away. These regulations are general and exactly the same as those by which the French and Danish colonies will have to regulate themselves, as well as the trade of our own Company, which must also conform to them. The opium of this country has always been treated as a monopoly by the native government, and we have before us the testimony of a person who for more than sixty years held a considerable office at the Barbender and is still alive, that the opium and saltpetre were purchased by the foreign companies as best they could, and on the same footing as private merchants, from the persons who enjoyed the exclusive privileges of this monopoly. But even supposing the matter differed from what actually occurred, it seems that Your Honour yourselves have admitted that for several years the custom has been to purchase the opium and saltpetre from the English Company. Company in the Malda District, having been transmitted to the Commercial Resident at that place, he has observed, in answer to it, that no such proclamations as those mentioned by your Gomastas have ever been made, neither by himself, nor by his assistant, nor by any other person under him; and that he has only republished the standing orders of Government passed in 1775 and 1782 against an illicit trade with our Company's weavers. The orders of 1775 direct that weavers who have executed engagements with the Company and received the Company's advances shall deliver their cloths accordingly; that, in case any weaver fails to deliver his cloths at the times stipulated in the agreement, the Company's agents shall have the liberty to place peons upon them; and that, if any weaver in the service of the Company shall be convicted of having sold cloths to private merchants while he is deficient in his deliveries according to the times stipulated in his agreement with the Company, such offender shall be punished after he has been regularly proceeded against and convicted before the judicial court. The orders of 1782 direct that, since practices had prevailed in some parts of the country of selling cloths in a clandestine manner to private individuals which had been manufactured from the Company's advances, the purchasers of such cloths, who apparently know that the same are the property of the Company through the secret and clandestine manner which they observe in procuring them, or because it is publicly known that the weavers offering them for sale are employed by the Company, shall, upon conviction of the fact, be punished by the adalet according to the nature of their offense, and that the cloths thus purchased shall be confiscated. 373 affixed to the Gates of the subordinate Factories, as the Regulations of Government; to serve as a guideline for his orders, and he has every reason to think that the same have not been exceeded in this case, even by his Gomastas, and much less by his assistant, who was not at the aurungs when the publication ascribed to him is said to have been made; and, as Mr. Grant had neither attempted nor desired to make any further prohibition, it must be very obvious that, if he had, it would have been in vain, seeing that he had no authority over weavers out of our Company's Employ, and could expect nothing but Resistance and Complaint. We are therefore of the opinion that the Dutch Gomastas could not be ignorant of the authority from which the same originated, and, if they nevertheless wished to complain, they ought to have sent a copy of those regulations to Chinsura. However that may be, we think that they ought to have represented the matter to Mr. Grant, who informs us that such was not done. The prevention of Clandestine Trade was the main object of the Public Regulations quoted above, and it agrees with general Equity that the person who engages a weaver not bound by any previous contract, and gives him money to work, should receive the first Cloth produced by that money. To be sure of this, it sometimes happens that the Company's stamp is put upon cloths that are still in the Loom, which, as is mentioned in your complaints, might be understood as an indication of a forcible Monopoly of all that the private funds and the labour of an unengaged weaver can produce, whereas it is nothing other than distinguishing those cloths which, from advances received, the weaver has put into the Loom, and which his agreement binds him to deliver.

We are perfectly sure that an illicit trade will not be encouraged by the Gentlemen who act for the Dutch Company, but we leave it to you to judge whether the same fair dealing can be expected from natives, whose conduct in remote situations free of control is very often regulated by their own principles. We understand that the persons who now provide the Dutch investment at Malda are not the servants of the Dutch Company, but the temporary agents of other natives who have contracted for that investment at Chinsura. With respect to the above Regulations, they extend equally to Foreign Companies as to individuals, and it is proper to remark here that the regulations of 1775 owe their origin to complaints then made by the Director and Council at Chinsura concerning impediments given to their trade in the Dacca quarter. It appears from their own account that they go to Malda in the month of June to provide an investment which is to be shipped in January, and that the contractors must bear the risk of balances. It is therefore most clearly a matter of the greatest importance to them to purchase cloth already made, and it is even in some measure necessary for them to do so; and they also arrive there at a convenient time for it, in the middle of the season, when the advances of our factories are dispersed throughout the entire country. In this case we will certainly reap a part of the fruit of these advances, unless measures are taken to prevent it. To prosecute the weavers after the evil is done would only serve to add to the inconvenience, because they would then have to be kept from their work. The letter with which you honored us under date of the 23rd ultimo mentions a new representation regarding the conduct of Mr. Charles Grant from the aurangs of Badaul, Jaggernautpore, and Malda. The same has been sent to the Board of Trade, and we have requested that Mr. Grant be ordered to account for himself in that regard. We now have the honor to communicate to you our sentiments on your third memorial under date of the 19th of August. This memorial shows to us the difficulties and unpleasantnesses that are caused by the dual ownership of the grounds situated within the limits of Chinsura, part of which belongs to the Dutch Company and another part is Moorish ground or native property. The fourth and last memorandum with which you have honoured us relates to the loss sustained by the Netherlands Company and by individuals from the capture of the sloop Constantia and the pantchiallang Het Geduld by Captain Robert Geddes commanding the ship Nonsuch on the 26th June 1783, twelve days after the time fixed by the preliminary articles of peace between our respective nations for the cessation of hostilities in India. You inform us that the amount recovered from Captain Geddes falls short of the actual cost of these vessels and their cargoes; you ask for a reimbursement of that sum, and of that paid for a vessel purchased from the King of Pringana to transport the prisoners who had been landed—we suppose by the Nonsuch—in his dominions, and which vessel was afterwards lost on her voyage to Malacca. You recommend to us the claims of individuals who have suffered by the capture, and you propose that a further compensation should be allowed, not only to make good the losses which the parties have sustained, but also to compensate them for the loss of profit occasioned by their having been taken. We have the honour to offer you herewith copies of papers left with us by Captain Geddes before his departure for England; from these you will perceive that he acknowledges being indebted in the sum of Current Rupees 13,673. 1. 8 as the balance of goods and ship stores or provisions sold on account of the owners of the vessel he had taken, and that he informs us his attorneys are ready to pay this; we shall accordingly instruct them to deliver that sum to such person as shall be duly authorized to receive it, and we will transmit to them copies of the papers you have sent us, to reply thereto in the name of Captain Geddes. No part of the cargo of any ship or vessel from sea and belonging to any of the foreign settlements shall be landed at those settlements until a Talika, or authentic list of the contents, shall have been transmitted by the chief of the settlement to which the ship shall be destined, to be lodged at the Buxbunder. All goods received at the foreign settlements from the Aurangs must be furnished with Rowannahs, which Rowannahs, 393 being surrendered at the Buxbunder, will entitle the respective chiefs of the foreign settlements, whenever they have occasion to divide the said goods and dispatch them in that manner down to their ships, to exchanged Rowannahs free of further duty. The goods so exported are to be specified on the back of the original Rowannah left at the Buxbunder, under which the goods were brought from the Aurangs. Letter B 397 To the Honourable Warren Hastings, Esq., Governor General, and the Council Honourable Sir and Sirs, I have had the honour to receive your letter of the 8th ultimo with its enclosures, and have the satisfaction to inform you that the brigantine Constantia and sloop Gedult, mentioned in the letter of the Governor General and Council of Batavia to your Honourable Board, were delivered up by me on the 10th day of March last to their respective commanders at Tringany, with the stores etc. belonging to them. And I have now the honour to enclose copies of their receipts for the said vessels, etc., Honourable Sir and Sirs, Letter C 398 which it seems had not come to the knowledge of the Dutch Government at Batavia on the 27th of July, when their letter of application was addressed to you. With respect to the private applications made to the Council of Batavia for losses sustained by the capture of the aforementioned vessels, I can with great propriety declare that the greatest care was taken by me to prevent all kind of embezzlement, in particular that part claimed by Mynheer P. D. van Haak, consisting of a box of lace valued at Dollars 2335.6, which was returned by me unopened to the Shahbandar of Malacca to whom it was consigned. The remaining private claims are of so very trifling a nature that I flatter myself the enclosed receipts, granted by the captains themselves, will be a sufficient and satisfactory justification of my conduct. On my return from China I called at Malacca and gave the Dutch Governor of that place a full and clear account of my proceedings relative to the vessels, which I had supplied with people from the Nonsuch so as to assist in navigating them from Tringany, from whence we convoyed them and left them safe in the possession of the Dutch in the road of Malacca.
